			</subsection></section><section id="H4C9DB5BC3F5B461EA061739A82FBF968"><enum>2.</enum><header>Tule Springs
			 Fossil Beds National Monument</header>
			<subsection id="H1406A53A654B4E46B9A9928434688485"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="H55F5AFD8655B40DF9542D3DE3DC49D21"><enum>(1)</enum><text>since 1933, the
			 Upper Las Vegas Wash has been valued by scientists because of the significant
			 paleontological fossils demonstrative of the Pleistocene Ice Age that are
			 located in the area;</text>
				</paragraph><paragraph id="HCC1FF8DD06EF4591804F9FB99B2E5CB3"><enum>(2)</enum><text>in 2004, during
			 the preparation of the Las Vegas Valley Disposal Boundary Final Environmental
			 Impact Statement, the Bureau of Land Management identified sensitive
			 biological, cultural, and paleontological resources determined to be worthy of
			 more evaluation with respect to the protective status of the resources;</text>
				</paragraph><paragraph id="H5A18A6B6705148C088A0691F03DEF459"><enum>(3)</enum><text>the Upper Las
			 Vegas Wash contains thousands of Pleistocene mammal fossils of national
			 importance, including Columbian mammoth, ground sloth, American lion, camels,
			 and horse fossils;</text>
				</paragraph><paragraph id="HAAF5046DEB76465FB392076A2A33BB72"><enum>(4)</enum><text>in addition to
			 Joshua trees and several species of cacti, the Las Vegas buckwheat, Merriam’s
			 bearpoppy, Las Vegas bearpoppy, and the halfring milkvetch are 4 unique and
			 imperiled plants that are supported in the harsh desert environment of Tule
			 Springs;</text>
				</paragraph><paragraph id="H6387C3B818BD4732975E787FF140E9EA"><enum>(5)</enum><text>the area provides
			 important habitat for threatened desert tortoise, endemic poppy bees, kit
			 foxes, burrowing owls, phainopepla, and a variety of reptiles;</text>
				</paragraph><paragraph id="HF1D7DD2769CD4D429BCDE85043571F35"><enum>(6)</enum><text>in 2010, a
			 National Park Service reconnaissance survey of the area determined that the
			 area likely contains the longest continuous section of Pleistocene strata in
			 the desert southwest, which span multiple important global climate cooling and
			 warming episodes;</text>
				</paragraph><paragraph id="HA2B947BF03824199944A271530217249"><enum>(7)</enum><text>the Upper Las
			 Vegas Wash is significant to the culture and history of the native and
			 indigenous people of the area, including the Southern Paiute Tribe;</text>
				</paragraph><paragraph id="HDCF747B47FDC42C8988C1967E8D47291"><enum>(8)</enum><text>despite the
			 findings of the studies and recommendations for further assessment of the
			 resources for appropriate methods of protection—</text>
					<subparagraph id="H17A62C2154ED4D25B3DF9004717D0A28"><enum>(A)</enum><text>the area remains
			 inadequately protected; and</text>
					</subparagraph><subparagraph id="HC268136684AD4C54BE573B8DB77B50B3"><enum>(B)</enum><text>many irreplaceable
			 fossil specimens in the area have been lost to vandalism or theft; and</text>
					</subparagraph></paragraph><paragraph id="H3CEFA7FAD51947408D0DD7D0B9981170"><enum>(9)</enum><text>designation of the
			 Upper Las Vegas Wash site as a National Monument would protect the unique
			 fossil resources of the area for present and future generations while allowing
			 for public education and continued scientific research opportunities.</text>
				</paragraph></subsection><subsection id="H274B3ED83B86471BB931E2B0DF54AC6F"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H0BFD2D144C164FA09A131D86BA6A71CC"><enum>(1)</enum><header>Council</header><text>The
			 term <term>Council</term> means the Tule Springs Fossil Beds National Monument
			 Advisory Council established by subsection (f)(1).</text>
				</paragraph><paragraph id="H9451B2166CC5401D9EC939B6F75D6DB7"><enum>(2)</enum><header>County</header><text>The
			 term <term>County</term> means Clark County, Nevada.</text>
				</paragraph><paragraph id="H554D8DD73D6E4B48A57BEC8BF0304E78"><enum>(3)</enum><header>Local
			 government</header><text>The term <term>local government</term> means the City
			 of Las Vegas, City of North Las Vegas, or the County.</text>
				</paragraph><paragraph id="H57150EB0D14841DF95D64C3B60A02560"><enum>(4)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the Monument developed under subsection (d)(3).</text>
				</paragraph><paragraph id="HA9DDED61F7F94C1E8116D45C6C31EBB0"><enum>(5)</enum><header>Map</header><text>The
			 term <term>Map</term> means the map entitled <quote>North Las Vegas Valley
			 Overview</quote> and dated June 26, 2012.</text>
				</paragraph><paragraph id="H2998532A4D784EF489511A69CA3EC5A5"><enum>(6)</enum><header>Monument</header><text>The
			 term <term>Monument</term> means the Tule Springs Fossil Beds National Monument
			 established by subsection (c)(1).</text>
				</paragraph><paragraph id="HA60C65496ECD4F14975EF9CF3072DDC2"><enum>(7)</enum><header>Public
			 land</header><text>The term <term>public land</term> has the meaning given the
			 term <term>public lands</term> in section 103 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1702).</text>
				</paragraph><paragraph id="H2A95727EB53E45C6AC17AFA5A57FFE39"><enum>(8)</enum><header>Qualified
			 electric utility</header><text>The term <term>qualified electric utility</term>
			 means any public or private utility determined by the Secretary to be
			 technically and financially capable of developing the transmission line.</text>
				</paragraph><paragraph id="H3DD438F4823D4894B0C0F91184C6BAF8"><enum>(9)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph id="HA0A3667ECA834B64B6B6D98884E7BBD6"><enum>(10)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Nevada.</text>
				</paragraph></subsection><subsection id="H2CE477FFB6884327A40DE26F160F36AC"><enum>(c)</enum><header>Establishment</header>
				<paragraph id="HC69FA5F3971341CD809D1525CE0C1D8F"><enum>(1)</enum><header>In
			 general</header><text>In order to conserve, protect, interpret, and enhance for
			 the benefit of present and future generations the unique and nationally
			 important paleontological, scientific, educational, and recreational resources
			 and values of the land described in this subsection, there is established in
			 the State the Tule Springs Fossil Beds National Monument.</text>
				</paragraph><paragraph id="H0BD88569C9414C0FBE502001AD761C1B"><enum>(2)</enum><header>Boundaries</header><text>The
			 Monument shall consist of approximately 22,650 acres of public land in the
			 County within the boundaries generally depicted on the Map.</text>
				</paragraph><paragraph id="H934D7D8BDCD548E9992A5711065AF434"><enum>(3)</enum><header>Map; legal
			 description</header>
					<subparagraph id="H15C98DBAB0C649538BD54969F1983150"><enum>(A)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall prepare an official map and legal description of
			 the boundaries of the Monument.</text>
					</subparagraph><subparagraph id="H77BC374244B747BCBE944210B98ABD7B"><enum>(B)</enum><header>Legal
			 effect</header><text>The map and legal description prepared under subparagraph
			 (A) shall have the same force and effect as if included in this section, except
			 that the Secretary may correct any clerical or typographical errors in the
			 legal description or the map.</text>
					</subparagraph><subparagraph id="H17B8EB6D806C48F3812F2F5C1F7810F4"><enum>(C)</enum><header>Availability of
			 map and legal description</header><text>The map and legal description prepared
			 under subparagraph (A) shall be on file and available for public inspection in
			 the appropriate offices of the Bureau of Land Management and the National Park
			 Service.</text>
					</subparagraph></paragraph><paragraph id="HCAD819E409284F1CA1E59ACC139CC9B4"><enum>(4)</enum><header>Minor boundary
			 adjustments</header><text>The Secretary may make minor boundary adjustments to
			 the Monument to include additional public land adjacent to the Monument, if,
			 after the date of enactment of this Act—</text>
					<subparagraph id="H4C3F3F32DC3543C4B1D96773B1EF0F66"><enum>(A)</enum><text>additional
			 paleontological resources are discovered on the adjacent public land;
			 and</text>
					</subparagraph><subparagraph id="H4C84E98923D34064B8309EFD947C1C62"><enum>(B)</enum><text>a Federal agency,
			 State agency, and local government requests that the adjacent public land be
			 included in the Monument to promote the consistent management of
			 resources.</text>
					</subparagraph></paragraph><paragraph id="H90B49EDAF9484B42972F097B9174ACC3"><enum>(5)</enum><header>Acquisition of
			 land</header>
					<subparagraph id="H11DB2094E5454B5ABB5F00649DF83A19"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Secretary may acquire
			 land or interests in land within or adjacent to the boundaries of the Monument
			 by donation, purchase with donated or appropriated funds, exchange, or transfer
			 from another Federal agency.</text>
					</subparagraph><subparagraph id="H0AFFDB3D3D004E33A8C37E7B81EC4C91"><enum>(B)</enum><header>Limitation</header><text>Land
			 or interests in land that are owned by the State or a political subdivision of
			 the State may be acquired under subparagraph (A) only by donation or
			 exchange.</text>
					</subparagraph></paragraph><paragraph id="H1164F7A44944452FA99B534DF4F1F868"><enum>(6)</enum><header>Withdrawals</header><text>Subject
			 to valid existing rights and subsection (e), any land within the Monument or
			 any land or interest in land that is acquired by the United States for
			 inclusion in the Monument after the date of enactment of this Act is withdrawn
			 from—</text>
					<subparagraph id="H035A992166714A0583F70E9FCAFDC44D"><enum>(A)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text>
					</subparagraph><subparagraph id="HE65DB20863F1497A82ED42D054FAF729"><enum>(B)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</subparagraph><subparagraph id="HCB9F783324764DF5AE3F036598FF22A8"><enum>(C)</enum><text>operation of the
			 mineral leasing laws, geothermal leasing laws, and minerals materials
			 laws.</text>
					</subparagraph></paragraph><paragraph id="HFDDB872E101641479C7F8FD55C23A373"><enum>(7)</enum><header>Effect on
			 overflights</header><text>Nothing in this Act or the management plan developed
			 for the Monument restricts or precludes—</text>
					<subparagraph id="H03E8C9ABECC540EBA58B8DE0427329FE"><enum>(A)</enum><text>overflights
			 (including low-level military and law enforcement overflights) over land in the
			 Monument, including military, law enforcement, commercial, and general aviation
			 overflights that can be seen or heard in the Monument; or</text>
					</subparagraph><subparagraph id="H52C6473388FD4669B267430B8BCBB752"><enum>(B)</enum><text>the designation or
			 creation of new units of special use airspace or the establishment of military
			 flight training routes over the Monument.</text>
					</subparagraph></paragraph></subsection><subsection id="HB724EBC73DFC40FE80359AABF57E4A2E"><enum>(d)</enum><header>Administration</header>
				<paragraph id="H1A8794F235FE4464A1AD408C35D65018"><enum>(1)</enum><header>Transfer of
			 administrative jurisdiction</header><text>Administrative jurisdiction over the
			 approximately 22,650 acres of public land depicted on the Map as <term>Tule
			 Springs Fossil Bed National Monument</term> is transferred from the Director of
			 the Bureau of Land Management to the Director of the National Park
			 Service.</text>
				</paragraph><paragraph id="H4EB1C873A7574A85AAAF1C4392C78E63"><enum>(2)</enum><header>Management</header><text>The
			 Secretary shall—</text>
					<subparagraph id="H5318DFE1B3D24EAFBE90F4AC81893C27"><enum>(A)</enum><text>allow only such
			 uses of the Monument that—</text>
						<clause id="H1850552DE0B64F81A62A9F3B9A9EAE56"><enum>(i)</enum><text>are
			 consistent with this section; and</text>
						</clause><clause id="HA1E4ADF98B944E47B86E51364DADC477"><enum>(ii)</enum><text>the
			 Secretary determines would further the purposes of the Monument; and</text>
						</clause></subparagraph><subparagraph id="H920BEE7DCEDD4984B50E38E43E6AB51A"><enum>(B)</enum><text>manage the
			 Monument—</text>
						<clause id="HF29DA32DC8EC4EE0ADFBDCCC0937EE47"><enum>(i)</enum><text>in a
			 manner that conserves, protects, interprets, and enhances the resources and
			 values of the Monument; and</text>
						</clause><clause id="H5FD5EA3EE92045028CD732B067618E47"><enum>(ii)</enum><text>in
			 accordance with—</text>
							<subclause id="H39000B986082470D86982D259A76185E"><enum>(I)</enum><text>this
			 section;</text>
							</subclause><subclause id="H00AF68920DBE4F1B9E934D84EB87E102"><enum>(II)</enum><text>the provisions of
			 laws generally applicable to units of the National Park System (including the
			 National Park Service Organic Act (16 U.S.C. 1 et seq.)); and</text>
							</subclause><subclause id="HA95B625C40D846468C8CE2018C9E12EB"><enum>(III)</enum><text>any other
			 applicable laws.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H7F8AF5CF5CF04D8980B0E4FEFB03AC15"><enum>(3)</enum><header>Buffer
			 zones</header><text>The establishment of the Monument shall not—</text>
					<subparagraph id="HB0E043F49FF9451F99715AE51476949E"><enum>(A)</enum><text>lead to the
			 creation of express or implied protective perimeters or buffer zones around or
			 over the Monument;</text>
					</subparagraph><subparagraph id="HBB65B3962A6B44F09A8E0AC436B96BDE"><enum>(B)</enum><text>preclude disposal
			 of public land adjacent to the boundaries of the Monument, if the disposal is
			 consistent with other applicable law;</text>
					</subparagraph><subparagraph id="HE50363768D5A4DCB9368C8CFE417D99D"><enum>(C)</enum><text>preclude an
			 activity on, or use of, private land adjacent to the boundaries of the
			 Monument, if the activity or use is consistent with other applicable law;
			 or</text>
					</subparagraph><subparagraph id="HD5817B02C3A744D5A82078B83ED2C67B"><enum>(D)</enum><text>directly or
			 indirectly subject an activity on, or use of, private land, to additional
			 regulation, if the activity or use is consistent with other applicable
			 law.</text>
					</subparagraph></paragraph><paragraph id="H6D4364FC6C494D70908E807DB4A2C78F"><enum>(4)</enum><header>Air and water
			 quality</header><text>Nothing in this Act alters the standards governing air or
			 water quality outside the boundary of the Monument.</text>
				</paragraph><paragraph id="HB19C961E6BAE43D793FDE1519218347F"><enum>(5)</enum><header>Management
			 plan</header>
					<subparagraph id="HC5B2DFAEAE6B44518CE5759A613D69B5"><enum>(A)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall develop a management plan that provides for the
			 long-term protection and management of the Monument.</text>
					</subparagraph><subparagraph id="HD4A8704C870144E49FDEDECEDCEAE739"><enum>(B)</enum><header>Components</header><text>The
			 management plan—</text>
						<clause id="H9EE72EA13E33484A8A098A2FB640FB27"><enum>(i)</enum><text>shall, consistent
			 with this section and the purposes of the Monument—</text>
							<subclause id="H4D5CFE81D2024E5AB09B8E6C589F714D"><enum>(I)</enum><text>describe the
			 resources at the Monument that are to be protected;</text>
							</subclause><subclause id="HE81B0478C0814FD08F557EE301E3A057"><enum>(II)</enum><text>describe the
			 appropriate uses and management of the Monument;</text>
							</subclause><subclause id="HF73B6D23CEEC4314AA9CDEEC58A5A84D"><enum>(III)</enum><text>allow for
			 continued scientific research at the Monument; and</text>
							</subclause><subclause id="HFA221FA71BF340B99D84BD391ECB2984"><enum>(IV)</enum><text>include a travel
			 management plan that may include existing public transit; and</text>
							</subclause></clause><clause id="HC5ED7C3261AA44079F28987B3A0279F8"><enum>(ii)</enum><text>may—</text>
							<subclause id="H9726584E664949478D19FA92CEC4AF12"><enum>(I)</enum><text>incorporate any
			 appropriate decisions contained in an existing management or activity plan for
			 the land designated as the Monument under subsection (c)(1); and</text>
							</subclause><subclause id="H80B3B5588FB94BE2A98C2920F4E1E8C5"><enum>(II)</enum><text>use information
			 developed in any study of land within, or adjacent to, the boundary of the
			 Monument that was conducted before the date of enactment of this Act.</text>
							</subclause></clause></subparagraph><subparagraph id="HE6419364B75041BDBA31070C30FA2AA6"><enum>(C)</enum><header>Public
			 process</header><text>In preparing the management plan, the Secretary
			 shall—</text>
						<clause id="H79394907B06A42DB9BA56B8E9BDD58CC"><enum>(i)</enum><text>consult with, and
			 take into account the comments and recommendations of, the Council;</text>
						</clause><clause id="H13FAA49E1A044D11BA8386A551DE7E25"><enum>(ii)</enum><text>provide an
			 opportunity for public involvement in the preparation and review of the
			 management plan, including holding public meetings; and</text>
						</clause><clause id="H74A644F48AAB49899D782310777C83D1"><enum>(iii)</enum><text>consider public
			 comments received as part of the public review and comment process of the
			 management plan.</text>
						</clause></subparagraph></paragraph><paragraph id="H1C4FD49DB7064C8E932618D7DB199106"><enum>(6)</enum><header>Interpretation,
			 education, and scientific research</header>
					<subparagraph id="HEFF22431E8D847C9A36613CEAA45F9AB"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall provide for public interpretation of,
			 and education and scientific research on, the paleontological resources of the
			 Monument, with priority given to exhibiting and curating the resources.</text>
					</subparagraph><subparagraph id="H6F690576C1AF4194A3883F40A205A4A4"><enum>(B)</enum><header>Cooperative
			 agreements</header><text>The Secretary may enter into cooperative agreements
			 with the State, political subdivisions of the State, nonprofit organizations,
			 and appropriate public and private entities to carry out subparagraph
			 (A).</text>
					</subparagraph></paragraph></subsection><subsection id="H9805261B7AF14F7CA102650C2290EE73"><enum>(e)</enum><header>Renewable energy
			 transmission facilities</header>
				<paragraph id="H5805C84CD6954AB485C683ADA0F14777"><enum>(1)</enum><header>In
			 general</header><text>On receipt of a complete application from a qualified
			 electric utility, the Secretary, in accordance with the National Environmental
			 Policy Act of 1969 (42 U.S.C. 4321 et seq.), shall issue to the qualified
			 electric utility a 400-foot right-of-way for the construction and maintenance
			 of high-voltage transmission facilities depicted on the Map as <quote>Renewable
			 Energy Transmission Corridor</quote>.</text>
				</paragraph><paragraph id="H3FC65DB26AAF4D2081C246452CF64893"><enum>(2)</enum><header>Requirements</header>
					<subparagraph id="HA108A26775234D1FAF012CB6B6C076FB"><enum>(A)</enum><header>In
			 general</header><text>The high-voltage transmission facilities shall—</text>
						<clause id="H3AFD1D1E7F9D4CF39456BC7B408480CF"><enum>(i)</enum><text>be
			 used—</text>
							<subclause id="HD0FF70DC5D4240DBA5DF8D6DC1BB8521"><enum>(I)</enum><text>primarily, to the
			 maximum extent practicable, for renewable energy resources; and</text>
							</subclause><subclause id="H26B93CFDCF98481E946948D12CA8790E"><enum>(II)</enum><text>to meet
			 reliability standards set by the North American Reliability Electric
			 Corporation, the Western Electricity Coordinating Council, or the public
			 utilities regulator of the State; and</text>
							</subclause></clause><clause id="HE33B8D42E627474E8A2AC06141F303B1"><enum>(ii)</enum><text>employ best
			 management practices identified as part of the compliance of the Secretary with
			 the <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.) to limit impacts on the Monument,
			 including impacts to the viewshed.</text>
						</clause></subparagraph><subparagraph id="HDA033D48D366473FBAE9388915A5B89B"><enum>(B)</enum><header>Capacity</header><text>The
			 Secretary shall consult with the qualified electric utility that is issued the
			 right-of-way under paragraph (1) and the public utilities regulator of the
			 State to seek to maximize the capacity of the high-voltage transmission
			 facilities.</text>
					</subparagraph></paragraph><paragraph id="HE2EE18B448FF43A1B7FB429C8800A5E8"><enum>(3)</enum><header>Terms and
			 conditions</header><text>The issuance of a notice to proceed on the
			 construction of the high-voltage transmission facilities within the
			 right-of-way under paragraph (1) shall be subject to terms and conditions that
			 the Secretary (in consultation with the qualified electric utility), as part of
			 the compliance of the Secretary with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (42
			 U.S.C. 4321 et seq.), determines appropriate to protect and conserve the
			 resources for which the Monument is managed.</text>
				</paragraph><paragraph id="H8292467B830E4EA087D520A1470B7DF1"><enum>(4)</enum><header>Expiration of
			 right-of-way</header><text>The right-of-way issued under paragraph (1) shall
			 expire on the date that is 15 years after the date of enactment of this Act if
			 construction of the high-voltage transmission facilities described in paragraph
			 (1) has not been initiated by that date, unless the Secretary determines that
			 it is in the public interest to continue the right-of-way.</text>
				</paragraph></subsection><subsection id="H25D960230D524C179553703BB34E8E8B"><enum>(f)</enum><header>Tule Springs
			 Fossil Beds National Monument Advisory Council</header>
				<paragraph id="HC1E450A2492A48ACB44D801DD5CD232B"><enum>(1)</enum><header>Establishment</header><text>To
			 provide guidance for the management of the Monument, there is established the
			 Tule Springs Fossil Beds National Monument Advisory Council.</text>
				</paragraph><paragraph id="H41A30F0D454B4258B1E0BEA5413B07D4"><enum>(2)</enum><header>Membership</header>
					<subparagraph id="HF76A96D84F4040F2A27BCC8AD995A8C3"><enum>(A)</enum><header>Composition</header><text>The
			 Council shall consist of 13 members, to be appointed by the Secretary, of
			 whom—</text>
						<clause id="H8312462ADAA44CDEA63F3F3C78DCE6EA"><enum>(i)</enum><text>1
			 member shall be a member of, or be nominated by, the County Commission;</text>
						</clause><clause id="H7EC6A8944B9C4F5DB2EA338134E8382F"><enum>(ii)</enum><text>1
			 member shall be a member of, or be nominated by, the city council of Las Vegas,
			 Nevada;</text>
						</clause><clause id="H4FFD3378C5C74EBBA1C501CD96A46026"><enum>(iii)</enum><text>1
			 member shall be a member of, or be nominated by, the city council of North Las
			 Vegas, Nevada;</text>
						</clause><clause id="H4372FFE2189F45B397D97F25497C1A0C"><enum>(iv)</enum><text>1
			 member shall be a member of, or be nominated by, the tribal council of the Las
			 Vegas Paiute Tribe;</text>
						</clause><clause id="H76F90CFECFAF43969C0F3011F323E158"><enum>(v)</enum><text>1
			 member shall be a representative of the conservation community in southern
			 Nevada;</text>
						</clause><clause id="H2AD9A1930F65442CB0AF442B8F31B3D2"><enum>(vi)</enum><text>1
			 member shall be a representative of, or be nominated by, the Director of the
			 Bureau of Land Management;</text>
						</clause><clause id="H065DA8C7A4CA4EF497256631C47C5505"><enum>(vii)</enum><text>1
			 member shall be a representative of, or be nominated by, the Director of the
			 United States Fish and Wildlife Service;</text>
						</clause><clause id="H2AEFCF07D8C8430784AFF3C7DA185119"><enum>(viii)</enum><text>1
			 member shall be a representative of, or be nominated by, the Director of the
			 National Park Service;</text>
						</clause><clause id="HDD33ADE90C99480189B97DEED16EF22A"><enum>(ix)</enum><text>1
			 member shall be a representative of Nellis Air Force Base;</text>
						</clause><clause id="HC91AA44C5AC6446582CBC0B28B946D30"><enum>(x)</enum><text>1
			 member shall be nominated by the State;</text>
						</clause><clause id="H98ABC4EA11CC4E16B6033FC25ED11D87"><enum>(xi)</enum><text>1
			 member shall reside in the County and have a background that reflects the
			 purposes for which the Monument was established; and</text>
						</clause><clause id="HE1C493E285E54E7380725577CE73730B"><enum>(xii)</enum><text>2
			 members shall reside in the County, both of whom shall have experience in the
			 field of paleontology, obtained through higher education, experience, or
			 both.</text>
						</clause></subparagraph><subparagraph id="HD40CD62B69E14A21B3BF35FBE4507FF3"><enum>(B)</enum><header>Initial
			 appointment</header><text>Not later than 180 days after the date of enactment
			 of this Act, the Secretary shall appoint the initial members of the Council in
			 accordance with subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="H37ACAC9B11EA4C1BA99C55588822C7F4"><enum>(3)</enum><header>Duties of the
			 council</header><text>The Council shall advise the Secretary with respect
			 to—</text>
					<subparagraph id="HEC0970DE337046978702BBDF541E948F"><enum>(A)</enum><text>the preparation
			 and implementation of the management plan; and</text>
					</subparagraph><subparagraph id="H6ADE3719DAD24ECF9478C0D93DF44EA1"><enum>(B)</enum><text>other issues
			 related to the management of the Monument (including budgetary matters).</text>
					</subparagraph></paragraph><paragraph id="H943432ED22454B76BFAF3123CE69D841"><enum>(4)</enum><header>Compensation</header><text>Members
			 of the Council shall receive no compensation for serving on the Council.</text>
				</paragraph><paragraph id="H889C1843A46741D0870D88D003BAAFDA"><enum>(5)</enum><header>Chairperson</header>
					<subparagraph id="HE6DE5752A5AF471D86B7F363BD368E5E"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Council shall elect a
			 Chairperson from among the members of the Council.</text>
					</subparagraph><subparagraph id="HFC69667B269A4A49B5402D30B83C6766"><enum>(B)</enum><header>Limitation</header><text>The
			 Chairperson shall not be a member of a Federal or State agency.</text>
					</subparagraph><subparagraph id="H06596A29FB0F43F9A45FE156160CC47D"><enum>(C)</enum><header>Term</header><text>The
			 term of the Chairperson shall be 3 years.</text>
					</subparagraph></paragraph><paragraph id="H1F4C1A73170046C68FD837BDB462F21C"><enum>(6)</enum><header>Term of
			 members</header>
					<subparagraph id="H814CA5EF038C4ABA983E50451FA4C228"><enum>(A)</enum><header>In
			 general</header><text>The term of a member of the Council shall be 3
			 years.</text>
					</subparagraph><subparagraph id="H34FF28EDFA8D4EA9BE05AB3D3D584562"><enum>(B)</enum><header>Successors</header><text>Notwithstanding
			 the expiration of a 3-year term of a member of the Council, a member may
			 continue to serve on the Council until—</text>
						<clause id="HAFA37C74EA7340AE80698D853F738E5B"><enum>(i)</enum><text>the
			 member is reappointed by the Secretary; or</text>
						</clause><clause id="H9F1967F83E744D6FBD996B53522CE5DC"><enum>(ii)</enum><text>a
			 successor is appointed.</text>
						</clause></subparagraph></paragraph><paragraph id="H08F3CEC0D0F14AB4A4FE4376453CA16F"><enum>(7)</enum><header>Vacancies</header>
					<subparagraph id="H8064DB9ADE284E86BC48097BD03A7421"><enum>(A)</enum><header>In
			 general</header><text>A vacancy on the Council shall be filled in the same
			 manner in which the original appointment was made.</text>
					</subparagraph><subparagraph id="H46CAF43002DA40079B031C61D88C66A9"><enum>(B)</enum><header>Appointment for
			 remainder of term</header><text>A member appointed to fill a vacancy on the
			 Council—</text>
						<clause id="H8A5E8A35CFBB4CC7A36A4B12EC5CEE66"><enum>(i)</enum><text>shall serve for
			 the remainder of the term for which the predecessor was appointed; and</text>
						</clause><clause id="H05A954815F8D4EB88F389C41F86D3606"><enum>(ii)</enum><text>may
			 be nominated for a subsequent term.</text>
						</clause></subparagraph></paragraph><paragraph id="H99570A731F1E48F59CB6E6CDA31D09D7"><enum>(8)</enum><header>Termination</header><text>Unless
			 an extension is jointly recommended by the Director of the National Park
			 Service and the Director of the Bureau of Land Management, the Council shall
			 terminate on the date that is 6 years after the date of enactment of this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4C62FE7FEDB34A1198E519C4EE408D9F"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 section.</text>
			</subsection></section><section id="HC3534E1C1B874C708AE7934171900DF8"><enum>3.</enum><header>Transfer of land
			 to Red Rock Canyon National Conservation Area</header>
			<subsection id="HF7E11416630B4DADBFEB10032DC5F81B"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H9249D912BC204BC9B48459BF38F3DB0C"><enum>(1)</enum><header>Conservation
			 Area</header><text>The term <term>Conservation Area</term> means the Red Rock
			 Canyon National Conservation Area established by the Red Rock Canyon National
			 Conservation Area Establishment Act of 1990 (16 U.S.C. 460ccc et seq.).</text>
				</paragraph><paragraph id="H004C8B328B774EF7A3E30BA1B9129665"><enum>(2)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>North Las Vegas Valley
			 Overview</quote> and dated June 26, 2012.</text>
				</paragraph><paragraph id="H0A3F04E0F87A4B0D88A80E637794A5E5"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="H921CB9A5F0AF41E4B2678D6DCC58B725"><enum>(b)</enum><header>Transfer of land
			 to conservation area</header>
				<paragraph id="H7CC91F25DFA6427B9B528E2441204CB8"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, subject to valid existing rights, and notwithstanding the land use
			 planning requirements of sections 202 and 203 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1712, 1713), the Secretary shall add to, and
			 administer as part of, the Conservation Area, in accordance with the laws
			 (including regulations) applicable to the Conservation Area, the land described
			 in paragraph (2).</text>
				</paragraph><paragraph id="H726948DDB8B749C59C3F3D73963CAAB4"><enum>(2)</enum><header>Description of
			 Land</header><text>The land referred to in paragraph (1) consists of
			 approximately 1,530 acres of land managed by the Bureau of Land Management
			 described on the map as <quote>Additions to Red Rock NCA</quote>.</text>
				</paragraph><paragraph id="H8CDBA7C4AFB54453875125F7C5A89D70"><enum>(3)</enum><header>Management
			 plan</header><text>Not later than 2 years after the date on which the land is
			 acquired, the Secretary shall update the management plan for the Conservation
			 Area to reflect the management requirements of the acquired land.</text>
				</paragraph><paragraph id="HB26E4AC27C51494185C4592CC9C2458C"><enum>(4)</enum><header>Map and Legal
			 Description</header>
					<subparagraph id="HF371C72FE02F4B428CEC33A88C29FEFC"><enum>(A)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall finalize the legal description of the parcel to
			 be conveyed under this section.</text>
					</subparagraph><subparagraph id="H74B0E7672D014785B2E2169317D0A8EB"><enum>(B)</enum><header>Minor
			 errors</header><text>The Secretary may correct any minor error in—</text>
						<clause id="H97F89FE5848D41A4BFC74229365392F4"><enum>(i)</enum><text>the
			 map; or</text>
						</clause><clause id="H1C40815EDCAC41CA89B475F5AD95B803"><enum>(ii)</enum><text>the
			 legal description.</text>
						</clause></subparagraph><subparagraph id="HD784A770BD4049EA8BAB98669DA097C8"><enum>(C)</enum><header>Availability</header><text>The
			 map and legal description shall be on file and available for public inspection
			 in the appropriate offices of the Bureau of Land Management.</text>
					</subparagraph></paragraph></subsection></section><section id="H6106E70F5FA4489A892EC6A47E801F0A"><enum>4.</enum><header>Conveyance of
			 Bureau of Land Management land to North Las Vegas</header>
			<subsection id="H4E260B14F05149A0BE8FAE19FE97B609"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H939449A8E79A4ED3B138A420D9C10CF2"><enum>(1)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>North Las Vegas Valley
			 Overview</quote> and dated June 26, 2012.</text>
				</paragraph><paragraph id="H5C9CEC1A1321444E922545EF0C7839A1"><enum>(2)</enum><header>North Las
			 Vegas</header><text>The term <term>North Las Vegas</term> means the city of
			 North Las Vegas, Nevada.</text>
				</paragraph><paragraph id="H7A12ACF7B0FE45608061FAAB31AF2FB9"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="H6B11DC31C2E04D05B35337D5C5C1816F"><enum>(b)</enum><header>Conveyance</header><text>As
			 soon as practicable after the date of enactment of this Act, subject to valid
			 existing rights, and notwithstanding the land use planning requirements of
			 sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (43
			 U.S.C. 1712, 1713), the Secretary shall convey to North Las Vegas, without
			 consideration, all right, title, and interest of the United States in and to
			 the land described in subsection (c).</text>
			</subsection><subsection id="H6FBBFB4C63C0494CA2D06C4B21E0B783"><enum>(c)</enum><header>Description of
			 Land</header><text>The land referred to in subsection (b) consists of land
			 managed by the Bureau of Land Management described on the map as the
			 <quote>North Las Vegas Job Creation Zone</quote>.</text>
			</subsection><subsection id="H2C17031C0A184AE2A32BD10F1E14872A"><enum>(d)</enum><header>Map and Legal
			 Description</header>
				<paragraph id="H6A94A8E78B8A41D7AF738F1D81C7E2E1"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall finalize the legal description of the parcel to
			 be conveyed under this section.</text>
				</paragraph><paragraph id="HEE87FDF0D6794A329E58508B1B099C96"><enum>(2)</enum><header>Minor
			 errors</header><text>The Secretary may correct any minor error in—</text>
					<subparagraph id="HC30EEFCCDF7A480981C724728EDE676A"><enum>(A)</enum><text>the map; or</text>
					</subparagraph><subparagraph id="H365AC96204814768BF1E6418163811A4"><enum>(B)</enum><text>the legal
			 description.</text>
					</subparagraph></paragraph><paragraph id="H32817C083B024CA09455DC32F8A92034"><enum>(3)</enum><header>Availability</header><text>The
			 map and legal description shall be on file and available for public inspection
			 in the appropriate offices of the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="H6C40CFADF29E44A98CBFF303A2FB89C5"><enum>(e)</enum><header>Use of land for
			 nonresidential development</header>
				<paragraph id="H598DCE3C0A7A45BB93B66A1971DE4570"><enum>(1)</enum><header>In
			 general</header><text>North Las Vegas may sell, lease, or otherwise convey any
			 portion of the land described in subsection (c) for nonresidential
			 development.</text>
				</paragraph><paragraph id="HC31A5CFF46BA4D8C9E8646D97CD13409"><enum>(2)</enum><header>Method of
			 sale</header><text>The sale, lease, or conveyance of land under paragraph (1)
			 shall be carried out—</text>
					<subparagraph id="H576144874E3A4DAB84F34662EB68D265"><enum>(A)</enum><text>through a
			 competitive bidding process; and</text>
					</subparagraph><subparagraph id="HBF3ACD03FD45417190E4C8211DD3E634"><enum>(B)</enum><text>for not less than
			 fair market value.</text>
					</subparagraph></paragraph><paragraph id="HE1D0FCD1A99A4F25940114DFEC2E4947"><enum>(3)</enum><header>Disposition of
			 proceeds</header><text>The gross proceeds from the sale, lease, or conveyance
			 of land under paragraph (1) shall be distributed in accordance with section
			 4(e) of the Southern Nevada Public Land Management Act of 1998 (Public Law
			 105–263; 112 Stat. 2345; 116 Stat. 2007; 117 Stat. 1317; 118 Stat. 2414; 120
			 Stat. 3045).</text>
				</paragraph></subsection><subsection id="H9AAE660C2687465C8811C9C07789868C"><enum>(f)</enum><header>Use of land for
			 recreation or other public purposes</header>
				<paragraph id="H64ED486B9B644374B958D741784895DE"><enum>(1)</enum><header>In
			 general</header><text>North Las Vegas may retain a portion of the land
			 described in subsection (c) for public recreation or other public purposes
			 consistent with the Act of June 14, 1926 (commonly known as the
			 <quote>Recreation and Public Purposes Act</quote>) (43 U.S.C. 869 et seq.) by
			 providing written notice of the election to the Secretary.</text>
				</paragraph><paragraph id="HCF8FC5FC8D5F4EC88035E0B724250B56"><enum>(2)</enum><header>Revocation</header><text>If
			 North Las Vegas retains land for public recreation or other public purposes
			 under paragraph (1), North Las Vegas may—</text>
					<subparagraph id="H40D948FC2D6B41DA8BD5842E53E0632B"><enum>(A)</enum><text>revoke that
			 election; and</text>
					</subparagraph><subparagraph id="H0E49B2E300DD4805BFFA51E0354BC5E2"><enum>(B)</enum><text>sell, lease, or
			 convey the land in accordance with subsection (e).</text>
					</subparagraph></paragraph></subsection><subsection id="HAF4AC21B78C44561B48758B4E86C6FEA"><enum>(g)</enum><header>Administrative
			 costs</header><text>The Secretary shall require North Las Vegas to pay all
			 survey costs and other administrative costs necessary for the preparation and
			 completion of any patents for, and transfers of title to, the land described in
			 subsection (c).</text>
			</subsection><subsection id="HF19AE69B381C410D9572988801B38CDB"><enum>(h)</enum><header>Reversion</header>
				<paragraph id="H1C635B53845543F1988FFE7E26CEB2E3"><enum>(1)</enum><header>In
			 general</header><text>If any parcel of land described in subsection (c) is not
			 conveyed for nonresidential development under this section or reserved for
			 recreation or other public purposes under subparagraph (f) by the date that is
			 30 years after the date of enactment of this Act, the parcel of land shall, at
			 the discretion of the Secretary, revert to the United States.</text>
				</paragraph><paragraph id="H2842E6225332483BB757E17E5D44FD06"><enum>(2)</enum><header>Inconsistent
			 use</header><text>If North Las Vegas uses any parcel of land described in
			 subsection (c) in a manner that is inconsistent with this section—</text>
					<subparagraph id="H5CDE60516D8E434792C097A37A6E84A6"><enum>(A)</enum><text>at the discretion
			 of the Secretary, the parcel shall revert to the United States; or</text>
					</subparagraph><subparagraph id="H95F9B72A718F4B8AAD22263A34F5613F"><enum>(B)</enum><text>if the Secretary
			 does not make an election under subparagraph (A), North Las Vegas shall sell
			 the parcel of land in accordance with this section.</text>
					</subparagraph></paragraph></subsection></section><section id="HC0F3143857C84453806C530A630B9040"><enum>5.</enum><header>Conveyance of
			 Bureau of Land Management land to Las Vegas</header>
			<subsection id="HE6B77756AA04404988F24C536AF86824"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H599C000A3560430BB90238DB2B7649FA"><enum>(1)</enum><header>Las
			 Vegas</header><text>The term <term>Las Vegas</term> means the city of Las
			 Vegas, Nevada.</text>
				</paragraph><paragraph id="HB7F79D6932164CCB8F6A2AC0488B07EB"><enum>(2)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>North Las Vegas Valley
			 Overview</quote> and dated June 26, 2012.</text>
				</paragraph><paragraph id="HCC487B499FA24A2CB49D1DD81A6C0914"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="H43B0634DBE9A44F9A4554806A8B752E0"><enum>(b)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, subject to valid existing rights, and notwithstanding the land use
			 planning requirements of sections 202 and 203 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1712, 1713), the Secretary shall convey to

				<paragraph id="HA44CCEE3857341359D5C1422E8E66E87"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall finalize the legal description of the parcel to
			 be conveyed under this section.</text>
				</paragraph><paragraph id="HDAF6C11D239048D49C7960168DC49997"><enum>(2)</enum><header>Minor
			 errors</header><text>The Secretary may correct any minor error in—</text>

			 map and legal description shall be on file and available for public inspection
			 in the appropriate offices of the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="H68C66DEFA1ED4A67A7505220CC1F2913"><enum>(e)</enum><header>Use of
			 land</header>
				<paragraph id="H73F16E6FA8894FB59F753B4B39B53F7F"><enum>(1)</enum><header>In
			 general</header><text>Las Vegas may sell, lease, or otherwise convey any
			 portion of the land described in subsection (c) for nonresidential
			 development.</text>
				</paragraph><paragraph id="HA11D879B2E56479A83C41E75C02A8529"><enum>(2)</enum><header>Method of
			 sale</header><text>The sale, lease, or conveyance of land under paragraph (1)
			 shall be carried out, after consultation with the Las Vegas Paiute
			 Tribe—</text>
					<subparagraph id="HFA933D7065E841528838B4EC66211285"><enum>(A)</enum><text>through a
			 competitive bidding process; and</text>
					</subparagraph><subparagraph id="HBDD504C58DBD44D5AFEEC3C61D103239"><enum>(B)</enum><text>for not less than
			 fair market value.</text>
					</subparagraph></paragraph><paragraph id="HCD3A8974331F4EB79A50E15D84D4CB3A"><enum>(3)</enum><header>Disposition of
			 proceeds</header><text>The gross proceeds from the sale, lease, or conveyance
			 of land under paragraph (1) shall be distributed in accordance with section
			 4(e) of the Southern Nevada Public Land Management Act of 1998 (Public Law
			 105–263; 112 Stat. 2345; 116 Stat. 2007; 117 Stat. 1317; 118 Stat. 2414; 120
			 Stat. 3045).</text>
				</paragraph></subsection><subsection id="H15F760E4CED24476977E643BAC9ED015"><enum>(f)</enum><header>Use of land for
			 recreation or other public purposes</header>
				<paragraph id="H66560CC6587D4602AE33E30D738E42D7"><enum>(1)</enum><header>In
			 general</header><text>Las Vegas may retain a portion of the land described in
			 subsection (c) for public recreation or other public purposes consistent with
			 the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public
			 Purposes Act</quote>) (43 U.S.C. 869 et seq.) by providing written notice of
			 the election to the Secretary.</text>
				</paragraph><paragraph id="H09A95DDE6DD646F0B5DF5ADF99E17242"><enum>(2)</enum><header>Revocation</header><text>If
			 Las Vegas retains land for public recreation or other public purposes under
			 paragraph (1), Las Vegas may—</text>
					<subparagraph id="H7B935088FFB84E22BFD1B571F5CAAF5B"><enum>(A)</enum><text>revoke that
			 election; and</text>
					</subparagraph><subparagraph id="H5130FDDCCE7D4F68887F7FA93C738FA9"><enum>(B)</enum><text>sell, lease, or
			 convey the land in accordance with subsection (e).</text>
					</subparagraph></paragraph></subsection><subsection id="HE123EA1A1E86443B88231908A08E3523"><enum>(g)</enum><header>Administrative
			 costs</header><text>The Secretary shall require Las Vegas to pay all survey
			 costs and other administrative costs necessary for the preparation and
			 completion of any patents for, and transfers of title to, the land described in
			 subsection (c).</text>
			</subsection><subsection id="H00F84751D3014E289DED1EA35E50A852"><enum>(h)</enum><header>Reversion</header>
				<paragraph id="HBACD197E8F7340918241EBAB6829DCC2"><enum>(1)</enum><header>In
			 general</header><text>If any parcel of land described in subsection (c) is not
			 conveyed for nonresidential development under this section or reserved for
			 recreation or other public purposes under subsection (f) by the date that is 30
			 years after the date of enactment of this Act, the parcel of land shall, at the
			 discretion of the Secretary, revert to the United States.</text>
				</paragraph><paragraph id="H68EE8E0F32704B2CBD7D89A1DCA80ED4"><enum>(2)</enum><header>Inconsistent
			 use</header><text>If Las Vegas uses any parcel of land described in subsection
			 (c) in a manner that is inconsistent with this section—</text>
					<subparagraph id="H316C993A9DDF4A43A1A53F9A30136C96"><enum>(A)</enum><text>at the discretion
			 of the Secretary, the parcel shall revert to the United States; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7C1860026C14E9D9968E5ABD1A8F9B6"><enum>(B)</enum><text>if the Secretary
			 does not make an election under subparagraph (A), Las Vegas shall sell the
			 parcel of land in accordance with this section.</text>
					</subparagraph></paragraph></subsection></section><section id="HCE4A9CCF3E6C44AFB7C6D2087F804D5A"><enum>6.</enum><header>Expansion of
			 conveyance to Las Vegas Metropolitan Police Department</header><text display-inline="no-display-inline">Section 703 of the Clark County Conservation
			 of Public Land and Natural Resources Act of 2002 (Public Law 107–282; 116 Stat.
			 2013) is amended by inserting before the period at the end the following:
			 <quote>and the parcel of land identified as <quote>Conveyance to Las Vegas for
			 Police Shooting Range Access</quote> on the map entitled <quote>North Las Vegas
			 Valley Overview</quote>, and dated June 26, 2012, for the development of an
			 access road and parking facilities</quote>.</text>
		</section><section id="H89FA706A6FAD420F84E1111DDC93E0FB"><enum>7.</enum><header>Spring Mountains
			 National Recreation Area withdrawal</header><text display-inline="no-display-inline">Section 8 of the Spring Mountains National
			 Recreation Area Act (16 U.S.C. 460hhh–6) is amended—</text>
			<paragraph id="HFF60D2C609644E94B1F6A9C1E1B1CCF2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>for
			 lands described</quote> and inserting <quote>as provided</quote>; and</text>
			</paragraph><paragraph id="HDC78A8F3361C4C798358BF3AC1071DB6"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC47456B2C3FB4687A8296A12DF9C1FEC" style="OLC">
					<subsection id="H504849EA313641E58C287438A682BF87"><enum>(b)</enum><header>Exceptions</header>
						<paragraph id="HBBAB8F395B8C492EB0C1AB0804A1F760"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding subsection (a),
				W<fraction>1/2</fraction>E<fraction>1/2</fraction> and
				W<fraction>1/2</fraction>, sec. 27, T23S, R58E, Mt. Diablo Meridian is not
				subject to withdrawal under that subsection.</text>
						</paragraph><paragraph id="HA8C63382F03349C4A6EDB574A673E95B"><enum>(2)</enum><header>Effect of entry
				under public land laws</header><text>Notwithstanding paragraph (1) of
				subsection (a), the following are not subject to withdrawal under that
				paragraph:</text>
							<subparagraph id="HA6905CB5995A452D9BF2472A0CACF06B"><enum>(A)</enum><text>Any Federal land
				in the Recreation Area that qualifies for conveyance under Public Law 97–465
				(commonly known as the “Small Tracts Act”) (16 U.S.C. 521c et seq.), which,
				notwithstanding section 7 of that Act (16 U.S.C. 521i), may be conveyed under
				that Act.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB4BD8A01599D49E98EC5AD30FFD87CFF"><enum>(B)</enum><text>Any Federal land
				in the Recreation Area that the Secretary determines to be appropriate for
				conveyance by exchange for non-Federal land within the Recreation Area under
				authorities generally providing for the exchange of National Forest System
				land.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0204A6709344440CA3D3AA87CA08B747"><enum>8.</enum><header>Southern Nevada
			 Public Land Management Act of 1998 amendments</header><text display-inline="no-display-inline">Section 4 of the Southern Nevada Public Land
			 Management Act of 1998 (Public Law 105–263; 112 Stat. 2344; 116 Stat. 2007) is
			 amended—</text>
			<paragraph id="H886AC3942FF648108DC780F3BF193E4D"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence of subsection (a), by
			 striking <quote>dated October 1, 2002</quote> and inserting <quote>dated June
			 26, 2012</quote>; and</text>
			</paragraph><paragraph id="H778BE720FF6A4C65948227554AC66B40"><enum>(2)</enum><text>in subsection (g),
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4BE3E432276C4FA58FCA4307DDF61429" style="OLC">
					<paragraph id="HE9FF8B4EB6284279A64326D2639812B5"><enum>(5)</enum><text>Notwithstanding
				paragraph (4), subject to paragraphs (1) through (3), Clark County may convey
				to a unit of local government or regional governmental entity, without
				consideration, land located within the Airport Environs Overlay District (as of
				the date of enactment of this paragraph) if the land is used for a public
				purpose consistent with uses allowed under the Act of June 14, 1926 (commonly
				known as the <quote>Recreation and Public Purposes Act</quote>) (43 U.S.C. 869
				et seq.), provided that if the conveyed land is used for a purpose other than a
				public purpose, paragraph (4) would apply to the
				conveyance.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB887D8AC6EDE48A6B529C58CF635A4C4"><enum>9.</enum><header>Conveyance of
			 land to the Nevada System of Higher Education</header>
			<subsection id="H7103E7F363F44A7C8E6331309475CD07"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H2ACE87B8A8E44D8088654FE51E9A0A13"><enum>(1)</enum><header>Board of
			 regents</header><text>The term <term>Board of Regents</term> means the Board of
			 Regents of the Nevada System of Higher Education.</text>
				</paragraph><paragraph id="H150701C37F7C42CD9CFEE1798D3611C0"><enum>(2)</enum><header>Campuses</header><text>The
			 term <term>Campuses</term> means the Great Basin College, College of Southern
			 Nevada, and University of Las Vegas, Nevada, campuses.</text>
				</paragraph><paragraph id="H11561725E04A4897897A806B5BB2D0C1"><enum>(3)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means each of the 3
			 parcels of Bureau of Land Management land identified on the maps as
			 <quote>Parcel to be Conveyed</quote>, of which—</text>
					<subparagraph id="H658FC11DD6204BCC94C771C32CC22DE8"><enum>(A)</enum><text>approximately 40
			 acres is to be conveyed for the College of Southern Nevada;</text>
					</subparagraph><subparagraph id="HD29659A96EF9434AB08318A8ABEBEA5A"><enum>(B)</enum><text>approximately
			 2,085 acres is to be conveyed for the University of Nevada, Las Vegas;
			 and</text>
					</subparagraph><subparagraph id="HE119359CEFE843CE9685D2DD1DBE03A0"><enum>(C)</enum><text>approximately 285
			 acres is to be conveyed for the Great Basin College.</text>
					</subparagraph></paragraph><paragraph id="HA3E7832E99FF49D188D7B2088FFE9C34"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph id="H829E5EC611D24E638B348B3DCC432B54"><enum>(5)</enum><header>State</header><text>The
			 term <quote>State</quote> means the State of Nevada.</text>
				</paragraph><paragraph id="H0252DE152AA945BDBC3EA340AD805EFE"><enum>(6)</enum><header>System</header><text>The
			 term <term>System</term> means the Nevada System of Higher Education.</text>
				</paragraph></subsection><subsection id="H497928A645BD4DE5A01B1BA697865405"><enum>(b)</enum><header>Conveyances of
			 Federal land to the System</header>
				<paragraph id="HDC0E3DEEAD8B4C149C41C1AEAF588115"><enum>(1)</enum><header>Conveyances</header>
					<subparagraph id="HABC93AA18C1E409A86CDCF1B35E6153C"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding
			 section 202 of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1712) and section 1(c) of the Act of June 14, 1926 (commonly known as the
			 <quote>Recreation and Public Purposes Act</quote>) (43 U.S.C. 869(c)) and
			 subject to all valid existing rights, the Secretary shall—</text>
						<clause id="H898E74EF3CB348B6A8D480293F3071A1"><enum>(i)</enum><text>not
			 later than 180 days after the date of enactment of this Act, convey to the
			 System, without consideration, all right, title, and interest of the United
			 States in and to—</text>
							<subclause id="H1CA108A5DE3F4D8E8274E325DCCB6519"><enum>(I)</enum><text>the Federal land
			 identified on the map entitled <quote>Great Basin College Land
			 Conveyance</quote> and dated June 26, 2012, for the Great Basin College;
			 and</text>
							</subclause><subclause id="H40006A3F184240C097914B14A4F0408F"><enum>(II)</enum><text>the Federal land
			 identified on the map entitled <quote>College of Southern Nevada Land
			 Conveyance</quote> and dated June 26, 2012, for the College of Southern Nevada,
			 subject to the requirement that, as a precondition of the conveyance, the Board
			 of Regents shall, by mutual assent, enter into a binding development agreement
			 with the City of Las Vegas that—</text>
								<item id="H49F0E8FA3FEF4289B31FBF2EB4E18A6E"><enum>(aa)</enum><text>provides for the
			 orderly development of the Federal land to be conveyed under this subclause;
			 and</text>
								</item><item id="H0AC5A49F3D11490986C4F06CABC5FDFE"><enum>(bb)</enum><text>complies with
			 State law; and</text>
								</item></subclause></clause><clause id="H742A793C7EE9405E999CEF16953CE572"><enum>(ii)</enum><text>not
			 later than 180 days after the receipt of certification of acceptable
			 remediation of environmental conditions existing on the parcel to be conveyed
			 for the University of Nevada, Las Vegas, convey to the System, without
			 consideration, all right, title, and interest of the United States in and to
			 the Federal land identified on the map entitled <quote>North Las Vegas Valley
			 Overview</quote> and dated June 26, 2012 for the University of Nevada, Las
			 Vegas, if the area identified as <quote>Potential Utility Schedule</quote> on
			 the map is reserved for use for a potential future 400-foot utility corridor of
			 certain rights-of-way for transportation and public utilities.</text>
						</clause></subparagraph><subparagraph id="H1DE1278C36474425AAF7BBBB33C182D6"><enum>(B)</enum><header>Phases</header><text>The
			 Secretary may phase the conveyance of the Federal land under subparagraph
			 (A)(ii) as remediation is completed.</text>
					</subparagraph></paragraph><paragraph id="H1EB56E0AF0D3460390DE19FFF3A94D43"><enum>(2)</enum><header>Conditions</header>
					<subparagraph id="H22CE16A3B0844EE1B95C10D8668FCE8D"><enum>(A)</enum><header>In
			 general</header><text>As a condition of the conveyance under paragraph (1)(A),
			 the Board of Regents shall agree in writing—</text>
						<clause id="H8326F3C72BB24160B770E0C822E2F08B"><enum>(i)</enum><text>to
			 pay any administrative costs associated with the conveyance, including the
			 costs of any environmental, wildlife, cultural, or historical resources
			 studies;</text>
						</clause><clause id="H7E8AA53595424B528AEF4563D5FFC70D"><enum>(ii)</enum><text>to
			 use the Federal land conveyed for educational and recreational purposes;</text>
						</clause><clause id="H339BFE2AD6DF4A9DAD0753FC0DBD2613"><enum>(iii)</enum><text>to
			 release and indemnify the United States from any claims or liabilities that may
			 arise from uses carried out on the Federal land on or before the date of
			 enactment of this Act by the United States or any person; and</text>
						</clause><clause id="H58A4873FBB0549A5AD71FE378D4DB890"><enum>(iv)</enum><text>to
			 assist the Bureau of Land Management in providing information to the students
			 of the System and the citizens of the State on—</text>
							<subclause id="H3546BB1112794FDF9E2F0001128BEFF5"><enum>(I)</enum><text>public land
			 (including the management of public land) in the Nation; and</text>
							</subclause><subclause id="HBF4ECCB3D6024812AE82EFD7E17DCB60"><enum>(II)</enum><text>the role of the
			 Bureau of Land Management in managing, preserving, and protecting the public
			 land in the State.</text>
							</subclause></clause></subparagraph><subparagraph id="HACCBF6662C1645D090D50B42BF51EFD3"><enum>(B)</enum><header>Agreement with
			 Nellis Air Force Base</header>
						<clause id="H468EBBACAE2843C597F7E52678C6955D"><enum>(i)</enum><header>In
			 general</header><text>The Federal land conveyed to the System under paragraph
			 (1)(A)(ii) shall be used in accordance with the agreement entitled the
			 <quote>Cooperative Interlocal Agreement between the Board of Regents of the
			 Nevada System of Higher Education, on Behalf of the University of Nevada, Las
			 Vegas, and the 99th Air Base Wing, Nellis Air Force Base, Nevada</quote> and
			 dated June 19, 2009.</text>
						</clause><clause id="H159828F5018A4FB2AD76D79E22F20491"><enum>(ii)</enum><header>Modifications</header><text>Any
			 modifications to the agreement described in clause (i) or any related master
			 plan shall require the mutual assent of the parties to the agreement.</text>
						</clause><clause id="HE4ABBDD38B94405A951B9D9459F9C20B"><enum>(iii)</enum><header>Limitation</header><text>In
			 no case shall the use of the Federal land conveyed under paragraph (1)(A)(ii)
			 compromise the national security mission or aviation rights of Nellis Air Force
			 Base.</text>
						</clause></subparagraph></paragraph><paragraph id="HA26E93C032D84601AFBA8C007829EB25"><enum>(3)</enum><header>Use of Federal
			 land</header>
					<subparagraph id="HF1ADD7F15A04409CB814FF6CFCAF07A6"><enum>(A)</enum><header>In
			 general</header><text>The System may use the Federal land conveyed under
			 paragraph (1)(A) for—</text>
						<clause id="H08B015AE0BB24B559F2B279C5B6C5917"><enum>(i)</enum><text>any
			 purpose relating to the establishment, operation, growth, and maintenance of
			 the System; and</text>
						</clause><clause id="HA0CBCB7ED06A44C987A1AED8FCAD3084"><enum>(ii)</enum><text>any
			 uses relating to the purposes, including residential and commercial development
			 that would generally be associated with an institution of higher
			 education.</text>
						</clause></subparagraph><subparagraph id="H2DCA25D888174B4DA18CA1113A672CE0"><enum>(B)</enum><header>Other
			 entities</header><text>The System may—</text>
						<clause id="H394C2D35D2AB4EA697791E94C72FDA75"><enum>(i)</enum><text>consistent with
			 Federal and State law, lease, or otherwise provide property or space at, the
			 Campuses, with or without consideration, to religious, public interest,
			 community, or other groups for services and events that are of interest to the
			 System or to any community located in southern Nevada;</text>
						</clause><clause id="H7230A59B41EB46CD869FEC935E6CB80A"><enum>(ii)</enum><text>allow any other
			 communities in southern Nevada to use facilities of the Campuses for
			 educational and recreational programs of the community; and</text>
						</clause><clause id="H666BDFE6ADE94C11B431CC0D05DAF9B8"><enum>(iii)</enum><text>in
			 conjunction with the city of Las Vegas, North Las Vegas, or Pahrump or Clark or
			 Nye County plan, finance (including through the provision of cost-share
			 assistance), construct, and operate facilities for the city of Las Vegas, North
			 Las Vegas, or Pahrump or Clark or Nye County on the Federal land conveyed for
			 educational or recreational purposes consistent with this subsection.</text>
						</clause></subparagraph></paragraph><paragraph id="HBD47B63946974E36A88F31E7CC94E102"><enum>(4)</enum><header>Reversion</header>
					<subparagraph id="HACA96704C9C44A87BD450C44132B17D3"><enum>(A)</enum><header>In
			 general</header><text>If the Federal land or any portion of the Federal land
			 conveyed under paragraph (1)(A) ceases to be used for the System, the Federal
			 land, or any portion of the Federal land shall, at the discretion of the
			 Secretary, revert to the United States.</text>
					</subparagraph><subparagraph id="H24796A9D136948749C58AFC761941EF2"><enum>(B)</enum><header>University of
			 Nevada, Las Vegas</header><text>If the System fails to complete the first
			 building or show progression toward development of the University of Nevada,
			 Las Vegas campus on the applicable parcels of Federal land by the date that is
			 50 years after the date of receipt of certification of acceptable remediation
			 of environmental conditions, the parcels of the Federal land described in
			 subsection (a)(3)(B) shall, at the discretion of the Secretary, revert to the
			 United States.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H095A7381DB994745AFBE922B4B3BD5B5"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 section.</text>
			</subsection></section><section id="HAE851A14B734479594FE586BBD3FD445"><enum>10.</enum><header>Land conveyance
			 for Southern Nevada Supplemental Airport</header>
			<subsection id="H85396E4B29434FD896D7B26C4BD6E9F3"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H86ADEF5CC5554BA4AEC5DA8B0126BA97"><enum>(1)</enum><header>County</header><text>The
			 term <term>County</term> means Clark County, Nevada.</text>
				</paragraph><paragraph id="H794AF0F4899347678EE75B0673A24B0D"><enum>(2)</enum><header>Map</header><text>The
			 term <term>Map</term> means the map entitled <quote>Land Conveyance for
			 Southern Nevada Supplemental Airport</quote> and dated June 26, 2012.</text>
				</paragraph><paragraph id="H8818F34355884763B766367B11808F37"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></subsection><subsection id="H7381E1BA385A494285D100CD1E3FB667"><enum>(b)</enum><header>Land
			 conveyance</header>
				<paragraph id="H349E6C5AD7D242D78969B6BD3DC9A905"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date described in
			 paragraph (2), subject to valid existing rights, and notwithstanding the land
			 use planning requirements of sections 202 and 203 of the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1712, 1713), the Secretary shall convey
			 to the County, without consideration, all right, title, and interest of the
			 United States in and to the land described in subsection (c).</text>
				</paragraph><paragraph id="HC763E24234614331BB0C97C1DE5F3381"><enum>(2)</enum><header>Date on which
			 conveyance may be made</header><text>The Secretary shall not make the
			 conveyance described in paragraph (1) until the later of the date on which the
			 Administrator of the Federal Aviation Administration has—</text>
					<subparagraph id="H02C67C75B162493CA903AB0DA5F47BC7"><enum>(A)</enum><text>approved an
			 airport layout plan for an airport to be located in the Ivanpah Valley;
			 and</text>
					</subparagraph><subparagraph id="H6C3C39E5B87648C6B70C7C5A2F57904E"><enum>(B)</enum><text>with respect to
			 the construction and operation of an airport on the site conveyed to the County
			 pursuant to section 2(a) of the Ivanpah Valley Airport Public Lands Transfer
			 Act (Public Law 106–362; 114 Stat. 1404), issued a record of decision after the
			 preparation of an environmental impact statement or similar analysis required
			 under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.).</text>
					</subparagraph></paragraph><paragraph id="H15950669B8944A47968F2CAD2394F177"><enum>(3)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the public land to be conveyed under paragraph (1) is
			 withdrawn from—</text>
					<subparagraph id="H973A90C4556D479A9991C7360EF879F3"><enum>(A)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</subparagraph><subparagraph id="H6A7A4161924A4E549B7ADA388523B0B8"><enum>(B)</enum><text>operation of the
			 mineral leasing and geothermal leasing laws.</text>
					</subparagraph></paragraph><paragraph id="H8AF079705C73493E947362D5843CFF0D"><enum>(4)</enum><header>Use</header><text>The
			 public land conveyed under paragraph (1) shall be used for the development of
			 flood mitigation infrastructure for the Southern Nevada Supplemental
			 Airport.</text>
				</paragraph></subsection><subsection id="H0030390FBC2D4A4BA8580E1D914B2EC3"><enum>(c)</enum><header>Description of
			 land</header><text>The land referred to in subsection (b) consists of the
			 approximately 2,320 acres of land managed by the Bureau of Land Management and
			 described on the map as the <quote>Conveyance Area</quote>.</text>
			</subsection><subsection id="H25833F3B57474934B72A0D27059A9C7E"><enum>(d)</enum><header>Map and legal
			 description</header>
				<paragraph id="H1BEB0705A2C84688B658EE98A62CC288"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall prepare an official legal description and map of
			 the parcel to be conveyed under this section.</text>
				</paragraph><paragraph id="HB661B85B754744D18400A43B7BEB5792"><enum>(2)</enum><header>Minor
			 errors</header><text>The Secretary may correct any minor error in—</text>
					<subparagraph id="HFB838F0CD86D4868BE4BD0E9790CF0E5"><enum>(A)</enum><text>the map; or</text>
					</subparagraph><subparagraph id="H38FF99E69A80495396650F3CB70AA8FF"><enum>(B)</enum><text>the legal
			 description.</text>
					</subparagraph></paragraph><paragraph id="H18967A94C333418C9EE66FBFA0A7326E"><enum>(3)</enum><header>Availability</header><text>The
			 map and legal description shall be on file and available for public inspection
			 in the appropriate offices of the Bureau of Land Management.</text>
				</paragraph></subsection></section><section id="HAAC012B2CEDE4B6D90A3B7B505ED7411"><enum>11.</enum><header>Sunrise Mountain
			 Instant Study Area release</header>
			<subsection id="H81AFE80C44F04FE386164B35C049A00F"><enum>(a)</enum><header>Finding</header><text>Congress
			 finds that for the purposes of section 603 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1782), the public land in Clark County,
			 Nevada, administered by the Bureau of Land Management in the Sunrise Mountain
			 Instant Study Area has been adequately studied for wilderness
			 designation.</text>
			</subsection><subsection id="H8A5C851069564DAEBEE0747E95E967C2"><enum>(b)</enum><header>Release</header><text>Any
			 public land described in subsection (a) that is not designated as
			 wilderness—</text>
				<paragraph id="HB958DF0D33994D738B29D8CB8EB9CCBF"><enum>(1)</enum><text>is no longer
			 subject to section 603(c) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1782(c)); and</text>
				</paragraph><paragraph id="H3E3D917CE23F4E929F6FBC8D9C03AE99"><enum>(2)</enum><text>shall be managed
			 in accordance with land management plans adopted under section 202 of that Act
			 (43 U.S.C. 1712).</text>
				</paragraph></subsection><subsection id="H35C03B8BADB04BD0BB8256C7402E6FFE"><enum>(c)</enum><header>Post release
			 land use approvals</header><text>Recognizing that the area released under
			 subsection (b) presents unique opportunities for the granting of additional
			 rights-of-way, including for high voltage transmission facilities, the
			 Secretary of the Interior may accommodate multiple applicants within a
			 particular right-of-way.</text>
			</subsection></section><section id="HA96B87D7CA734FCEA04A55F176D8ECFF"><enum>12.</enum><header>Nellis Dunes
			 Off-Highway Vehicle Recreation Area</header>
			<subsection id="H82CDE1928F844401B1ED95212854AF25"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H771BC2115B9540E3803236D52B46BD0E"><enum>(1)</enum><header>City</header><text>The
			 term <term>City</term> means the city of North Las Vegas, Nevada.</text>
				</paragraph><paragraph id="HFFD486DAC1E14C74895F5AB7286087B9"><enum>(2)</enum><header>County</header><text>The
			 term <term>County</term> means Clark County, Nevada.</text>
				</paragraph><paragraph id="H083469AAFF1648E08F5A4E2A1F9A93AB"><enum>(3)</enum><header>Economic support
			 area</header><text>The term <term>Economic Support Area</term> means the land
			 identified on the map as the <quote>Economic Support Area</quote>.</text>
				</paragraph><paragraph id="HB42D90E8C0ED4F0CB18C648AF3A4F469"><enum>(4)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the approximately
			 1,211 acres of Federal land in the County, as depicted on the map.</text>
				</paragraph><paragraph id="H5D261B6DA1674FC7964B921F49DD0D3B"><enum>(5)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Nellis Dunes Off-Highway
			 Vehicle Recreation Area</quote> and dated June 26, 2012.</text>
				</paragraph><paragraph id="H225D487A07B9495D9B4D63CE934CADDD"><enum>(6)</enum><header>Nellis dunes
			 recreation area</header><text>The term <term>Nellis Dunes Recreation
			 Area</term> means the Nellis Dunes Off-Highway Vehicle Recreation Area
			 identified on the map as <quote>Nellis Dunes OHV Recreation
			 Area</quote>.</text>
				</paragraph><paragraph id="H2DB9D39E14E14FF49CEC749C96A7ED20"><enum>(7)</enum><header>Net
			 proceeds</header><text>The term <term>net proceeds</term> means the amount that
			 is equal to the difference between—</text>
					<subparagraph id="HF091096D65DF4C109AF83281F1E1D9E7"><enum>(A)</enum><text>the amount of
			 gross revenues received by the County from any activities at the Economic
			 Support Area; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAD48A12D34CC4039953A7E543755B98A"><enum>(B)</enum><text>the total amount
			 expended by the County for capital improvements to each of the Economic Support
			 Area and the Nellis Dunes Recreation Area, provided that the capital
			 improvements shall not exceed 80 percent of the total gross proceeds.</text>
					</subparagraph></paragraph><paragraph id="H9F7FF4B46B2D4EBF9A23E6A9D1D449C2"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph id="HA3803353EBA94BF6ACE95ACECC08AC03"><enum>(9)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Nevada.</text>
				</paragraph></subsection><subsection commented="no" id="HF2D7BE9E2100415BA3B76C1F33CC59C7"><enum>(b)</enum><header>Conveyance of
			 Federal Land to Clark County, Nevada</header>
				<paragraph commented="no" id="HDCFEF013152F4F88B0C1D0E70B6E0843"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall convey to the County, subject to valid existing
			 rights, without consideration, all right, title, and interest of the United
			 States in and to the parcels of Federal land.</text>
				</paragraph><paragraph commented="no" id="HC28BFBDCD64F4744A7B18E6C4252CC10"><enum>(2)</enum><header>Use of federal
			 land</header>
					<subparagraph commented="no" id="H876C421178764439BAA3A120EBC4454A"><enum>(A)</enum><header>In
			 general</header><text>The parcels of Federal land conveyed under paragraph
			 (1)—</text>
						<clause commented="no" id="H69BE6D7261CD405FB149B2C8F9045682"><enum>(i)</enum><text>shall be used by
			 the County—</text>
							<subclause commented="no" id="H48ACEA27380645EBA075E73F8D71DDC8"><enum>(I)</enum><text>to provide a
			 suitable location for the establishment of a centralized off-road vehicle
			 recreation park in the County;</text>
							</subclause><subclause commented="no" id="H88BD7B6630064B3791B1356990AC795E"><enum>(II)</enum><text>to provide the
			 public with opportunities for off-road vehicle recreation, including a location
			 for races, competitive events, training and other commercial services that
			 directly support a centralized off-road vehicle recreation area and County
			 park; and</text>
							</subclause><subclause commented="no" id="HDB84786F1327441F84A415D65A0BAA6D"><enum>(III)</enum><text>to provide a
			 designated area and facilities that would discourage unauthorized use of
			 off-highway vehicles in areas that have been identified by the Federal
			 Government, State government, or County government as containing
			 environmentally sensitive land; and</text>
							</subclause></clause><clause commented="no" id="H20F5A520190F4B00BF3D9DC415A5A4D2"><enum>(ii)</enum><text>shall not be
			 disposed of by the County.</text>
						</clause></subparagraph><subparagraph commented="no" id="H940AD309C4A04EE58CD4AC46AEDB7C28"><enum>(B)</enum><header>Reversion</header><text>If
			 the County ceases to use any parcel of the Federal land for the purposes
			 described in subparagraph (A)(i) or subparagraph (C)—</text>
						<clause commented="no" id="HF92104679D5047FD8C2A5143E6191124"><enum>(i)</enum><text>title to the
			 parcel shall revert to the United States, at the option of the United States;
			 and</text>
						</clause><clause commented="no" id="HA77E65549F2C4D65B9344DF06D01729B"><enum>(ii)</enum><text>the County shall
			 be responsible for any reclamation necessary to revert the parcel to the United
			 States.</text>
						</clause></subparagraph><subparagraph commented="no" id="H97C53F2C2EEE4F33AB1D4BB8BD080148"><enum>(C)</enum><header>Renewable and
			 solar energy</header><text>The Federal land conveyed to the County under
			 paragraph (1) and the land conveyed to the County under section 1(c) of Public
			 Law 107–350 (116 Stat. 2975) may be used for the incidental purpose of
			 generating renewable energy and solar energy for use by the Clark County Off
			 Highway Vehicle Recreation Park, the shooting park authorized under Public Law
			 107–350 (116 Stat. 2975), and the County.</text>
					</subparagraph><subparagraph commented="no" id="HFCCDE9C2F3EC4D62B8731E0BD84AE76F"><enum>(D)</enum><header>Consultation
			 with the secretary of the air force</header>
						<clause commented="no" id="H66687217793A400E8174002AFABEF66C"><enum>(i)</enum><header>Restriction</header><text>Any
			 project authorized under subparagraph (C) shall not interfere with the national
			 security mission of Nellis Air Force Base (or any military operation).</text>
						</clause><clause commented="no" id="H8F2B6D76B78A4C33AC343B677E19A94C"><enum>(ii)</enum><header>Condition</header><text>Before
			 the construction of any proposed project under subparagraph (C), the project
			 proponent shall consult with the Secretary of Defense (or a designee).</text>
						</clause></subparagraph><subparagraph commented="no" id="H9DEE510FD52142C6AE52BCB5F7197B6F"><enum>(E)</enum><header>Future
			 conveyances</header><text>Any future conveyance of Federal land for addition to
			 the Clark County Off Highway Vehicle Park or the Nellis Dunes Recreation Area
			 shall be subject to—</text>
						<clause commented="no" id="H2716A0B4010F434E93335ED63E38A4F4"><enum>(i)</enum><text>the binding
			 interlocal agreement under paragraph (3)(B); and</text>
						</clause><clause commented="no" id="H734CB7C69A2C467A8CBA826D156FDC2F"><enum>(ii)</enum><text>the aviation
			 easement requirements under paragraph (6).</text>
						</clause></subparagraph><subparagraph commented="no" id="H0EE4F2332AAC4A91848FC326B18C0DD0"><enum>(F)</enum><header>Management
			 plan</header><text>The Secretary, in consultation with the Secretary of the Air
			 Force and the County, may develop a special management plan for the Federal
			 land—</text>
						<clause commented="no" id="HC9D88566CF794B15A7BC26D49D10A8D8"><enum>(i)</enum><text>to enhance public
			 safety and safe off-highway vehicle recreation use in the Nellis Dunes
			 Recreation Area;</text>
						</clause><clause commented="no" id="H67B2F9070BD543F69A349623D0C56006"><enum>(ii)</enum><text>to ensure
			 compatible development with the mission requirements of the Nellis Air Force
			 Base; and</text>
						</clause><clause commented="no" id="H875A2C055F194C51BAB8D67EDFD8A779"><enum>(iii)</enum><text>to avoid and
			 mitigate known public health risks associated with off-highway vehicle use in
			 the Nellis Dunes Recreation Area.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="HC495748ACE6C40FEA3BD14177F3844DA"><enum>(3)</enum><header>Economic support
			 area</header>
					<subparagraph commented="no" id="HCE382E2A4D5145A7B7A2AA1969201F02"><enum>(A)</enum><header>Designation</header><text>There
			 is designated the Economic Support Area.</text>
					</subparagraph><subparagraph commented="no" id="HFB2F5D6D688740EBAAAF0B2A1E9018BD"><enum>(B)</enum><header>Interlocal
			 agreement</header>
						<clause commented="no" id="H4389C253352647C2B5617FDFFC5F1F49"><enum>(i)</enum><header>In
			 general</header><text>Before the Economic Support Area may be developed, the
			 City and County shall enter into an interlocal agreement regarding the
			 development of the Economic Support Area.</text>
						</clause><clause commented="no" id="HE31C7917C6AF476B816FBF6A8F870A52"><enum>(ii)</enum><header>Limitation of
			 agreement</header><text>In no case shall the interlocal agreement under this
			 subparagraph compromise or interfere with the aviation rights provided under
			 paragraph (6) and subsection (c)(4).</text>
						</clause></subparagraph><subparagraph commented="no" id="HCDD90D1EE41148C9B24C80C183BBDE18"><enum>(C)</enum><header>Use of
			 proceeds</header><text>Of the net proceeds from the development of the Economic
			 Support Area, the County shall—</text>
						<clause commented="no" id="H7F8FA829AB384A1EB4DC1DBDDF37C94C"><enum>(i)</enum><text>annually deposit
			 50 percent in a special account in the Treasury, to be used by the Secretary
			 for the development, maintenance, operations, and environmental restoration and
			 mitigation of the Nellis Dunes Recreation Area; and</text>
						</clause><clause commented="no" id="H863CBD08A5EB4390A49E9D3CD9E0DB33"><enum>(ii)</enum><text>retain 50
			 percent, to be used by the County—</text>
							<subclause commented="no" id="H31F4AF46AC4D46C1885E95E9C613A61D"><enum>(I)</enum><text>to pay for capital
			 improvements that are not covered by subsection (a)(7)(B); and</text>
							</subclause><subclause commented="no" id="H0AC6F126FB314EC0BD60FE56323DC6A2"><enum>(II)</enum><text>to maintain and
			 operate the park established under paragraph (2)(A)(i)(I).</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H965F9F456A71444C99A02B3802206609"><enum>(4)</enum><header>Agreement with
			 Nellis Air Force Base</header>
					<subparagraph commented="no" id="HDDCC931902F4428590463375D8D70A3A"><enum>(A)</enum><header>In
			 general</header><text>Before the Federal land may be conveyed to the County
			 under paragraph (1), the Clark County Board of Commissioners, the Bureau of
			 Land Management, and Nellis Air Force Base shall enter into an interlocal
			 agreement for the Federal land and the Nellis Dunes Recreation Area—</text>
						<clause commented="no" id="H418DD70A493347DE83E852B18C53305C"><enum>(i)</enum><text>to enhance safe
			 off-highway recreation use; and</text>
						</clause><clause commented="no" id="HDB1725440C774B92B5D60B44160FAEFC"><enum>(ii)</enum><text>to ensure that
			 development of the Federal land is consistent with the long-term mission
			 requirements of Nellis Air Force Base.</text>
						</clause></subparagraph><subparagraph commented="no" id="HCC50FE68EBCD4A57857F293AF8DD87D6"><enum>(B)</enum><header>Limitation</header><text>The
			 use of the Federal land conveyed under paragraph (1) shall not compromise the
			 national security mission or aviation rights of Nellis Air Force Base.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H7BFE513680BA4124B899B185A0AE4112"><enum>(5)</enum><header>Additional terms
			 and conditions</header><text>With respect to the conveyance of Federal land
			 under paragraph (1), the Secretary may require such additional terms and
			 conditions as the Secretary considers to be appropriate to protect the
			 interests of the United States.</text>
				</paragraph><paragraph commented="no" id="HD92CA05EC0A14B19AFFD6FA6D666E9C4"><enum>(6)</enum><header>Aviation
			 easement</header>
					<subparagraph commented="no" id="H1047C363856747819574ADC832AD1B6C"><enum>(A)</enum><header>In
			 general</header><text>Each deed entered into for the conveyance of the Federal
			 land shall contain a perpetual aviation easement reserving to the United States
			 all rights necessary to preserve free and unobstructed overflight in and
			 through the airspace above, over, and across the surface of the Federal land
			 for the passage of aircraft owned or operated by any Federal agency or other
			 Federal entity.</text>
					</subparagraph><subparagraph commented="no" id="H8C47948953ED4FD899B70D746E043E38"><enum>(B)</enum><header>Requirements</header><text>Each
			 easement described in subparagraph (A) shall include such terms and conditions
			 as the Secretary of the Air Force determines to be necessary to comply with
			 subparagraph (A).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H74E3557D00D14A7CA563A1A5130D58F9"><enum>(c)</enum><header>Designation of
			 the Nellis Dunes National Off-Highway Vehicle Recreation Area</header>
				<paragraph commented="no" id="H513EBE2FF3F34BBEBB095D780277F66E"><enum>(1)</enum><header>In
			 general</header><text>The approximately 10,000 acres of land identified as
			 <quote>Nellis Dunes</quote> in the Bureau of Land Management Resource
			 Management Plan shall be known and designated as the <quote>Nellis Dunes
			 Off-Highway Vehicle Recreation Area</quote>.</text>
				</paragraph><paragraph commented="no" id="HB9ACB20F3A9F4933A726CBBF1A3E6183"><enum>(2)</enum><header>Management
			 plan</header><text>The Director of the Bureau of Land Management may develop a
			 special management plan for the Nellis Dunes Recreation Area to enhance the
			 safe use of off-highway vehicles for recreational purposes.</text>
				</paragraph><paragraph commented="no" id="H5C12DDFBAD894EF1B1EDBE092DA3B139"><enum>(3)</enum><header>Exclusion from
			 National Landscape Conservation System</header><text>The Nellis Dunes
			 Recreation Area shall not be considered a unit of the National Landscape
			 Conservation System.</text>
				</paragraph><paragraph commented="no" id="HB7F4FA90FBB34374B83E938103E62385"><enum>(4)</enum><header>Aviation
			 rights</header><text>The aviation rights described in subsection (b)(6) shall
			 apply to the Nellis Dunes Recreation Area.</text>
				</paragraph></subsection><subsection commented="no" id="HA5555AFDC8A346C1A360CB8E294554E7"><enum>(d)</enum><header>Withdrawal and
			 Reservation of land for Nellis Air Force Base</header>
				<paragraph commented="no" id="HF03E5FE256C84AA2B56C7010E44783D2"><enum>(1)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights and except as otherwise provided in this
			 subsection—</text>
					<subparagraph commented="no" id="H2AB6B34EECA2476AB0DEEC962ABFDDC6"><enum>(A)</enum><text>the Federal land
			 and interests in the Federal land identified on the map as <quote>Land to be
			 withdrawn for Nellis Air Force Base</quote> are withdrawn from all forms of
			 appropriation under the general land laws, including the mining, mineral
			 leasing, and geothermal leasing laws; and</text>
					</subparagraph><subparagraph commented="no" id="HED8BF55F0F9E418E80986B06401B31C3"><enum>(B)</enum><text>jurisdiction over
			 the land and interest in land withdrawn and reserved by this subsection is
			 transferred to the Secretary of the Air Force.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H4B7F7B08BB8F43808974C545A1C100BF"><enum>(2)</enum><header>Reservation</header><text>The
			 land withdrawn under paragraph (1) is reserved for use by the Secretary of the
			 Air Force for—</text>
					<subparagraph commented="no" id="HBA7A9D7BF47B40D99F4C72C92D066AB3"><enum>(A)</enum><text>the enlargement
			 and protection of Nellis Air Force Base; or</text>
					</subparagraph><subparagraph commented="no" id="HCED298F8A75648B5B5B98F7AAE092F4A"><enum>(B)</enum><text>other
			 defense-related purposes consistent with the purposes of this
			 subsection.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HBE05C3A4A295442CBB7EF176E0EC9CBA"><enum>(3)</enum><header>Changes in
			 use</header><text>The Secretary of the Air Force shall consult with the
			 Secretary before using the land withdrawn and reserved by this subsection for
			 any purpose other than the purposes described in subsection (b)(2).</text>
				</paragraph><paragraph commented="no" id="H510D3C19AFA247F880629E123E3AD82E"><enum>(4)</enum><header>Easement</header><text>The
			 United States reserves—</text>
					<subparagraph commented="no" id="H59FFD73BD92B44F6A673B82159CF203B"><enum>(A)</enum><text>a right of flight
			 for the passage of aircraft in the airspace above the surface of the Federal
			 land conveyed to the County; and</text>
					</subparagraph><subparagraph commented="no" id="H6133198E575F4500AC59D562ED2F3547"><enum>(B)</enum><text>the right to cause
			 in the airspace any noise, vibration, smoke, or other effects that may be
			 inherent in the operation of aircraft landing at, or taking off from, Nellis
			 Air Force Base.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
