		<official-title>To amend title XVIII of the Social Security Act to
		  protect Medicare beneficiaries’ access to home health services under the
		  Medicare Program.</official-title>

		<section id="H26A96190DCD846869C2C1AE1450E73D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Home Health Care Access Protection Act
			 of 2012</short-title></quote>.</text>
		</section><section id="H60E5CD5E3B524C7AAF0CEC70A64F642C"><enum>2.</enum><header>Protecting access
			 to Medicare home health services</header><text display-inline="no-display-inline">Section 1895(b)(3)(B) of the Social Security
			 Act (42 U.S.C. 1395fff(b)(3)(B)) is amended—</text>
			<paragraph id="HC0D05DF9511A4A58B5A81C0560FFBF05"><enum>(1)</enum><text>in clause (iv), by
			 striking <quote>Insofar as</quote> and inserting <quote>Subject to clause
			 (vii), insofar as</quote>; and</text>
			</paragraph><paragraph id="H05D36CD6E2614F8284D7E4FBDDFEF2ED"><enum>(2)</enum><text>by adding at the
			 end the following new clause:</text>
				<quoted-block id="HF95EA488CD664D48A6A06544E5215F2D" style="OLC">
					<clause id="H03DA902E24854444B8F18C7473C816D9"><enum>(vii)</enum><header>Special rules
				for case mix changes for 2013 and later</header>
						<subclause id="H4D014166509E4881AF87C9D639AEDAC1"><enum>(I)</enum><header>In
				general</header><text>The adjustment under clause (iv) shall only be made for
				years beginning with 2013 using standards developed by the Secretary consistent
				with the processes described in subclause (II) taking into account the criteria
				described in subclause (III).</text>
						</subclause><subclause id="H5084167B37F4441086344E62A16B1C35"><enum>(II)</enum><header>Processes and
				criteria for evaluating changes in case mix</header><text>For purposes of
				subclause (I), the processes described in this subclause are the
				following:</text>
							<item id="H6F19CC77B68A445A95A0721878075AF6"><enum>(aa)</enum><text>In
				developing standards referred to in such subclause, the Secretary shall convene
				a Technical Advisory Group consisting of stakeholders, including individuals
				and organizations representing the interests of Medicare beneficiaries, the
				home health community, health care academia, and health care professionals, in
				equal numbers from each and limited to parties without an existing contractual
				relationship with the Secretary, to advise the Secretary concerning the
				establishment of such standards in order to distinguish between real changes in
				case mix and changes in coding or classification of different units of services
				that do not reflect real changes in case mix. The Technical Advisory Group
				shall be given the opportunity to review and comment on any proposed rulemaking
				or final determination by the Secretary on such standards prior to such
				rulemaking or determination.</text>
							</item><item id="H4FE11DD41DAE4868A02B1912C9553E0D"><enum>(bb)</enum><text>If
				the Secretary engages an outside contractor to participate in the evaluation of
				case mix changes described in item (aa), the Secretary shall only utilize a
				contractor that has not previously participated in the design and establishment
				of the case mix adjustment factors under this subparagraph.</text>
							</item><item id="H1E6017A555DA49F0863FC1BB5D71CC11"><enum>(cc)</enum><text>If
				the Secretary determines that any increase in case mix relates to changes in
				the volume or nature of services provided to home health services patients, the
				Secretary shall evaluate such increase through actual review of claims and
				services and shall not use any proxy or surrogate for determining whether the
				change in volume or nature of services is reasonable and necessary.</text>
							</item><item id="H28ECF95C14B045938E22ED6C708E70C3"><enum>(dd)</enum><text>The
				Secretary shall establish the standards referred to in item (aa) by
				regulation.</text>
							</item><item id="H9CB321F495BB46698940C8A516F0CFBF"><enum>(ee)</enum><text>With respect to
				establishment of such standards, the Secretary shall make public all data,
				reports, and supporting materials, including any comments by the Technical
				Advisory Group pursuant to item (aa), regarding the standards at the time of
				notice of such standards.</text>
							</item></subclause><subclause id="HDF0CCDC41EF44F79BDC763B62B0E71EB"><enum>(III)</enum><header>Criteria</header><text>The
				criteria described in this subclause are the following:</text>
							<item id="HCAB51798ACE64AAE825755817F11A9B9"><enum>(aa)</enum><text>The
				impact of changes in the program under this title that may affect the
				characteristics of individuals receiving home health services.</text>
							</item><item id="HE8AE8B2672F24FE48F676F4461AD517C"><enum>(bb)</enum><text>The
				impact of changes in the provision of health care services by providers of
				services other than home health agencies.</text>
							</item><item id="HB638EA100FE14405AFB8245D7F407BF8"><enum>(cc)</enum><text>Distinctions in
				the characteristics of individuals initiating home health services from the
				community and institutional care settings.</text>
							</item><item id="HC412EC4158EA46F7AEE8E1EF1A81BDF3"><enum>(dd)</enum><text>Whether any
				changes in coding resulted in a change in expenditures overall annually and
				disregarding changes in coding that do not have an overall expenditure
				impact.</text>
							</item><item id="H9FC6908E9B0742DB81763F4B65353B20"><enum>(ee)</enum><text>Any
				other factors determined appropriate by the Secretary in consultation with the
				Technical Advisory Group under subclause
				(II)(aa).</text>
