		<official-title>To approve the Agreement providing terms for a
		  continuation of the free association between the United States and Palau, and
		  for other purposes.</official-title>

		<section id="H3BEBD794A765444CB954FC5BBA903BE4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Continued Free Association with Palau
			 Act of 2012</short-title></quote>.</text>
		</section><section id="H7FDE6172EC0C4E92A229E0B7CCFBCCC5"><enum>2.</enum><header>Approval of
			 agreement</header><text display-inline="no-display-inline">Title I of Public
			 Law 99–658 (48 U.S.C. 1931 et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block id="HB4102F97ACAA44A5AF0A6DBE18896E22" style="OLC">
				<section id="HA59A1E49950B4D1690072A3EA2CDA747"><enum>105.</enum><header>Compact 15th
				anniversary section 432 review agreement</header>
					<subsection id="H0BD6E524917F4019B85E8215D0BF9702"><enum>(a)</enum><header>In
				general</header><text>The Agreement and appendices signed by the United States
				and the Republic of Palau on September 3, 2010 (in this section referred to as
				the <quote>Agreement</quote>), in connection with section 432 of the Compact of
				Free Association between the Government of the United States of America and the
				Government of Palau (48 U.S.C. 1931 note; Public Law 99–658) (in this section
				referred to as the <quote>Compact of Free Association</quote>), are
				approved—</text>
						<paragraph id="HD81BF3A60F74464691E674831FAAB71E"><enum>(1)</enum><text>except for the
				extension of Article X of the Agreement Regarding Federal Programs and
				Services, and Concluded Pursuant to Article II of Title Two and section 232 of
				the Compact of Free Association; and</text>
						</paragraph><paragraph id="H04ABCF71C0F04FCD8516507FF4B44400"><enum>(2)</enum><text>subject to the
				provisions of this section.</text>
						</paragraph></subsection><subsection id="H76C26095F09746BCB94A92F504D3D74A"><enum>(b)</enum><header>Funding
				provisions</header>
						<paragraph id="HBF0DF65233104DB983FDDA58F4F0C5A6"><enum>(1)</enum><header>Infrastructure
				maintenance</header><text>The amounts to be provided by the United States and
				Palau in fiscal year 2011 under section 2(a) of the Agreement shall be provided
				in fiscal year 2013, in addition to the amounts otherwise to be provided under
				that section in that fiscal year.</text>
						</paragraph><paragraph id="HD2852A6AD96A44C7A35D6519C2D4BC46"><enum>(2)</enum><header>Fiscal
				consolidation fund</header><text>The amounts to be provided by the United
				States under section 3 of the Agreement in fiscal years 2011 and 2012 shall be
				provided in fiscal years 2012 and 2013, respectively, and the amount so
				provided by the United States under that section in fiscal year 2012 shall be
				reduced by $411,000.</text>
						</paragraph><paragraph id="HDDC5B383505E42D49762B01B9DB18CCC"><enum>(3)</enum><header>Infrastructure
				projects</header><text>The amounts to be provided by the United States under
				section 5 of the Agreement in fiscal years 2011 through 2016 shall be provided
				in fiscal years 2012 through 2017, respectively.</text>
						</paragraph></subsection><subsection id="H176145155E8E4AAA8E460536DCF2D5EB"><enum>(c)</enum><header>Approval of
				amendments to Compact Subsidiary Agreements</header><text>Congress consents to
				the amendments to the Compact subsidiary agreements referred to in sections 7
				and 8 of the Agreement .</text>
					</subsection><subsection id="HDDDC41DF87FB4A54A6EF3FD82AF640DE"><enum>(d)</enum><header>Application of
				related law</header><text>Section 105(f)(1)(B)(ix) of the Compact of Free
				Association Amendments Act of 2003 (48 U.S.C. 1921d(f)(1)(B)(ix) shall be
				applied by substituting <quote>2024</quote> for <quote>2009</quote>.</text>
					</subsection><subsection id="H1C16DDF3299F4A3793F51753059F1C8F"><enum>(e)</enum><header>Authorization of
				Appropriations</header>
						<paragraph display-inline="no-display-inline" id="H4B857992AAC043FFBC0AFE743BF5C65C"><enum>(1)</enum><header>Postal
				services</header><text>There are authorized to be appropriated to the
				Department of the Interior $1,500,000 for each of fiscal years 2012 through
				2024 for postal services related to Palau, the Federated States of Micronesia,
				and the Marshall Islands, to remain available until expended. The Department of
				the Interior may transfer funds made available pursuant to this paragraph to
				the United States Postal Service so long as domestic postage may be used for
				mail to Palau, the Federated States of Micronesia, and the Marshall
				Islands.</text>
						</paragraph><paragraph id="HFFA9D44A893543DE83DD4FFB96A1C9CE"><enum>(2)</enum><header>Continuation of
				other appropriations</header><text>Appropriations to the Federal entities
				referred to in paragraphs (1), (3), and (4) of section 221(a) of the Compact of
				Free Association, and the successors to such Federal entities, to which
				appropriations have been made available in fiscal year 2011, may be made
				through fiscal year 2024 to carry out the purposes of those paragraphs, and
				shall remain available until expended.</text>
						</paragraph><paragraph id="H30017B1DD1DF4B1D926BCD57E7FE6B68"><enum>(3)</enum><header>Full faith and
				credit</header><text>Section 236 of the Compact applies to the commitments of
				the United States under sections 1, 2(a), 3, 4(a), and 5 of the Compact Review
				Agreement, and to the amounts necessary to conduct the audits required by
				Appendix D to the Compact Review Agreement, to the same extent as such section
				236 applies to the Compact. Section 215 of the Compact shall be applied to such
				commitments and amounts by substituting <quote>2011</quote> for
				<quote>1981</quote>.</text>
						</paragraph></subsection><subsection id="H171A3E94B40B48E5B070336DC113E3D1"><enum>(f)</enum><header>Oversight and
				report to appropriate congressional committees</header>
						<paragraph id="H1F395C95089F4AD198A70D622948E0E4"><enum>(1)</enum><header>Finding</header><text>The
				Congress finds that the Government of Palau is eligible for certain United
				States domestic programs.</text>
						</paragraph><paragraph id="HD984E324577545B0AC4DB8B9B97ACA8A"><enum>(2)</enum><header>Annual
				report</header>
							<subparagraph id="H6EFE254E439E4412BB879342D8C15581"><enum>(A)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary of the Interior, because of
				the Secretary’s jurisdiction with respect to the administration of financial
				assistance under the Compact, shall, not later than March 1 of each year,
				submit to the Committee on Energy and Natural Resources of the Senate and to
				the Committee on Foreign Affairs and the Committee on Natural Resources of the
				House of Representatives, a report on the use and effectiveness of financial,
				technical, and other assistance provided to Palau under any United States
				domestic program described in paragraph (1).</text>
							</subparagraph><subparagraph id="H97A092E765AB4D9FB9CD3E13345FFA84"><enum>(B)</enum><header>Consultation</header><text>In
				preparing each report required by subparagraph (A) with respect to a domestic
				program, the Secretary of the Interior shall consult with the Federal agency or
				agencies with jurisdiction over that domestic
				program.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H3178B5AC1EE64323A098A6B0E09EA26E"><enum>3.</enum><header>Offsets</header>
			<subsection id="H01036F3118354B6C9F90B2CB3B8D9E48"><enum>(a)</enum><header>Repeal of prior
			 authorization for civil administration of Trust Territory of the Pacific
			 Islands</header><text>Section 3 of the Act of June 30, 1954 (68 Stat. 330, 82
			 Stat. 1213, chapter 423) is repealed.</text>
			</subsection><subsection id="H40A4592F48D04AFFB752C792FD5D7417"><enum>(b)</enum><header>Global health
			 programs</header><text display-inline="yes-display-inline">Chapter 1 of part I
			 of the Foreign Assistance Act of 1961 (22 U.S.C. 2151 et seq.) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H690F0DCF759E43B4A75898BDC323B7A1" style="OLC">
					<section id="H11E0233EA44D476CA81CCEDA91A2510C"><enum>136.</enum><header>Limitation on
				use of funds</header>
						<subsection id="H01C885EBB38F4D53A13689B62DF6B9A5"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">None of the funds made available to carry
				out this chapter or chapter 10 for global health activities for fiscal year
				2012 and each fiscal year thereafter through fiscal year 2024 may be used to
				provide assistance to the People’s Republic of China for such
				activities.</text>
						</subsection><subsection id="H90F68646E35B4839957FB36C1CF4845B"><enum>(b)</enum><header>Amount of
				reduction</header><text display-inline="yes-display-inline">The total amount
				that may be obligated for global health activities for a fiscal year in
				subsection (a) is $2,000,000 less than the total amount made available for such
				activities for such fiscal year.</text>
						</subsection><subsection id="HD671CBC92D434A62ADE3D5A2C795529F"><enum>(c)</enum><header>Applicability</header><text>This
				section applies notwithstanding any other provision of law enacted after the
				enactment of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1A08526E1ECA4F5D953CA23C52F9E30A"><enum>(c)</enum><header>Climate change
			 funds</header><text display-inline="yes-display-inline">Chapter 4 of part II of
			 the Foreign Assistance Act of 1961 (relating to the economic support fund) (22
			 U.S.C. 2346 et seq.) is amended by adding at the end the following:</text>

				use of funds</header>
						<subsection id="HD2BD4C64F047485E87EE8315AD288472"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">None of the funds made available to carry
				out this chapter for climate change activities for fiscal year 2012 and each
				fiscal year thereafter through fiscal year 2024 may be used to provide
				assistance to the People’s Republic of China for such activities.</text>
						</subsection><subsection id="H654374CE0CC541AEB6C650B57C85AD72"><enum>(b)</enum><header>Amount of
				reduction</header><text display-inline="yes-display-inline">The total amount
				that may be obligated for climate change activities for a fiscal year in
				subsection (a) is $4,500,000 less than the total amount made available for such
				activities for such fiscal year.</text>
						</subsection><subsection id="H035CBE24D6ED462A93517246A521BF27"><enum>(c)</enum><header>Applicability</header><text>This
				section applies notwithstanding any other provision of law enacted after the
				enactment of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD901038A2D994D21945D1E126304E150"><enum>(d)</enum><header>Prohibition on
			 funding for Development Innovation Ventures (DIV) program</header><text display-inline="yes-display-inline">Section 667 of the Foreign Assistance Act
			 of 1961 (22 U.S.C. 2427) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE5BF66CB08794E9D8FCD6D67061769BB" style="OLC">
					<subsection id="HE8994BEBD83941579B5969DA920147A6"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H25BED5CC14B740C4A6464E2A0D49108A"><enum>(1)</enum><text display-inline="yes-display-inline">None of the funds made available for fiscal
				years 2012 and 2013 to the United States Agency for International Development
				may be used for the Development Innovation Ventures (DIV) program or any
				successor program.</text>
						</paragraph><paragraph id="HA9282EEF47DF4B19AC58765AC90D2BC1" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The total amount that may be obligated by
				the United States Agency for International Development for a fiscal year in
				subsection (a) is $28,200,000 less than the total amount made available for
				such Agency for such fiscal year.</text>
						</paragraph><paragraph id="HE450D410676847FF917A0B1446FDCC28" indent="up1"><enum>(3)</enum><text>This subsection applies
				notwithstanding any other provision of law enacted after the enactment of this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8A5C133963C8426C81C466D25D8CAFFF"><enum>(e)</enum><header>IMET</header><text display-inline="yes-display-inline">Section 542 of the Foreign Assistance Act
			 of 1961 (22 U.S.C. 2347a) is amended—</text>

				that may be obligated under this chapter for a fiscal year in subsection (a) is

			 Assistance Act of 1961 (22 U.S.C. 301 et seq.) is amended by adding at the end
			 the following:</text>

				use of funds</header>

				year 2012 and each fiscal year thereafter through fiscal year 2024 for United
				States assessed contributions to the United Nations may be used for such
				contributions to the United Nations Educational, Scientific and Cultural
				Organization.</text>

				reduction</header><text display-inline="yes-display-inline">The total amount
				that may be obligated for a fiscal year in subsection (a) for United States
				assessed contributions to the United Nations is $4,500,000 less than the total
				amount made available for such contributions for such fiscal year.</text>

			 Institute of Peace</header><text display-inline="yes-display-inline">Section
			 1710 of the United States Institute of Peace (22 U.S.C. 4609) is amended by
			 adding at the end the following:</text>

				through fiscal year 2024 is $6,811,000 less than the total amount made
				available for such purpose for such fiscal year.</text>
