		  provide for increased penalties for foreign and economic espionage, and for

		<section id="H0DFD530535AB4AE888BAEA098F813824" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Foreign and Economic Espionage Penalty
			 Enhancement Act of 2012</short-title></quote>.</text>
		</section><section id="H30CB9E13815943BCAE72FBFC5A343414"><enum>2.</enum><header>Protecting U.S.
			 businesses from foreign espionage</header>
			<subsection id="H92DA310E31294A23B5B35377166290CE"><enum>(a)</enum><header>For offenses
			 committed by individuals</header><text>Section 1831(a) of title 18, United
			 States Code, is amended, in the matter after paragraph (5)—</text>
				<paragraph id="HD9C8E42CDDF949139F0BC95BD8FDF8B2"><enum>(1)</enum><text>by striking
			 <quote>15 years</quote> and inserting <quote>20 years</quote>; and</text>
				</paragraph><paragraph id="H8C59819F3A5249428668885EC776BE4A"><enum>(2)</enum><text>by striking
			 <quote>not more than $500,000</quote> and inserting <quote>not more than
			 $5,000,000</quote>.</text>
				</paragraph></subsection><subsection id="H85E203984CDB495BAAEB072413DDBDC0"><enum>(b)</enum><header>For offenses
			 committed by organizations</header><text>Section 1831(b) of such title is
			 amended by striking <quote>not more than $10,000,000</quote> and inserting
			 <quote>not more than the greater of $10,000,000 or 3 times the value of the
			 stolen trade secret to the organization, including expenses for research and
			 design and other costs of reproducing the trade secret that the organization
			 has thereby avoided</quote>.</text>
			</subsection></section><section id="H99B0EC7787714D068A2873C470FDD4F8"><enum>3.</enum><header>Review by the
			 United States Sentencing Commission</header>
			<subsection id="HB44AEABCA4BF44B88508DD89BF36D8A3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Pursuant to its
			 authority under section 994(p) of title 28, United States Code, the United
			 States Sentencing Commission shall review and, if appropriate, amend the
			 Federal sentencing guidelines and policy statements applicable to persons
			 convicted of offenses relating to the transmission or attempted transmission of
			 a stolen trade secret outside of the United States or economic espionage, in
			 order to reflect the intent of Congress that penalties for such offenses under
			 the Federal sentencing guidelines and policy statements appropriately, reflect
			 the seriousness of these offenses, account for the potential and actual harm
			 caused by these offenses, and provide adequate deterrence against such
			 offenses.</text>
			</subsection><subsection id="H314FCD214DAB4D45A1512759BB65F63A"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this section, the United
			 States Sentencing Commission shall—</text>
				<paragraph id="H3BE0AA868A354A0D84D9980E9E665E7A"><enum>(1)</enum><text display-inline="yes-display-inline">consider the extent to which the Federal
			 sentencing guidelines and policy statements appropriately account for the
			 simple misappropriation of a trade secret, including the sufficiency of the
			 existing enhancement for these offenses to address the seriousness of this
			 conduct;</text>
				</paragraph><paragraph id="HF2128BCFC31E471CADCE0300F6D0A6A4"><enum>(2)</enum><text display-inline="yes-display-inline">consider whether additional enhancements in
			 the Federal sentencing guidelines and policy statements are appropriate to
			 account for—</text>
					<subparagraph id="H5AF40B00F3DD481894C166036E7EB38F"><enum>(A)</enum><text display-inline="yes-display-inline">the transmission or attempted transmission
			 of a stolen trade secret outside of the United States; and</text>
					</subparagraph><subparagraph id="H1FC822EC47E74B9A91F84FA2E488D7E0"><enum>(B)</enum><text display-inline="yes-display-inline">the transmission or attempted transmission
			 of a stolen trade secret outside of the United States that is committed or
			 attempted to be committed for the benefit of a foreign government, foreign
			 instrumentality, or foreign agent;</text>
					</subparagraph></paragraph><paragraph id="H123DD46432BF460FB9D826515EB3CE0E"><enum>(3)</enum><text display-inline="yes-display-inline">ensure the Federal sentencing guidelines
			 and policy statements reflect the seriousness of these offenses and the need to
			 deter such conduct;</text>
				</paragraph><paragraph id="H4D81BDB9530145FE89EDC996531DF2A7"><enum>(4)</enum><text display-inline="yes-display-inline">ensure reasonable consistency with other
			 relevant directives, Federal sentencing guidelines and policy statements, and
			 related Federal statutes;</text>
				</paragraph><paragraph id="HB152B276535643D6A801FB9B2A6E84EC"><enum>(5)</enum><text display-inline="yes-display-inline">make any necessary conforming changes to
			 the Federal sentencing guidelines and policy statements; and</text>
				</paragraph><paragraph id="HAD5D3C797857439CBE096179BC6C94E0"><enum>(6)</enum><text display-inline="yes-display-inline">ensure that the Federal sentencing
			 guidelines adequately meet the purposes of sentencing as set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
				</paragraph></subsection><subsection id="H52967722E9CE4EC594D66B92F3C54B1A"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out the review required under
			 this section, the Commission shall consult with individuals or groups
			 representing law enforcement, owners of trade secrets, victims of economic
			 espionage offenses, the United States Department of Justice, the United States
			 Department of Homeland Security, the United States Department of State and the
			 Office of the United States Trade Representative.</text>
			</subsection><subsection id="H2160D63140BC4432935587BAD9027B38"><enum>(d)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Commission shall complete its consideration and
			 review under this section.</text>
