			 the term <quote>appropriate congressional committees</quote> means the
			 Committee on Foreign Affairs of the House of Representatives and the Committee
			 on Foreign Relations of the Senate.</text>

			 following amounts are authorized to be appropriated for the Department of State
			 under <quote>Administration of Foreign Affairs</quote> to carry out the
			 authorities, functions, duties, and responsibilities in the conduct of foreign
			 affairs of the United States, and for other purposes authorized by law:</text>

			 Consular Programs</header><text display-inline="yes-display-inline">For
			 <quote>Diplomatic and Consular Programs</quote>, $8,983,778,000 for fiscal year
			 2013.</text>

			 security protection</header><text>Of such amounts, not less than $1,591,201,000
			 is authorized to be appropriated for worldwide security protection.</text>

			 Democracy, Human Rights, and Labor</header><text>Of such amounts, not less than
			 $24,147,000 for fiscal year 2013 is authorized to be appropriated for the
			 Bureau of Democracy, Human Rights and Labor.</text>

			 functions, duties, and responsibilities in the conduct of the foreign affairs
			 of the United States with respect to international organizations and to carry
			 out other authorities in law consistent with such purposes.</text>

			 for International Peacekeeping Activities</header><text display-inline="no-display-inline">There are authorized to be appropriated for
			 <quote>Contributions for International Peacekeeping Activities</quote>,
			 $1,828,182,000 for fiscal year 2013 for the Department of State to carry out
			 the authorities, functions, duties, and responsibilities of the United States
			 with respect to international peacekeeping activities and to carry out other
			 authorities in law consistent with such purposes.</text>

			 of section 38(d) of the State Department Basic Authorities Act of 1956

			 State from another agency of the United States Government or pursuant

									</subparagraph><subparagraph id="H14A61A9090D94833B722E74C1727AA6C"><enum>(B)</enum><text>if the offeror is
				a joint venture, as the employees of one of the persons or parties constituting
				the joint venture; or</text>
									</subparagraph><subparagraph id="H6D9358CE384242428A5C0F9525CC2C60"><enum>(C)</enum><text>as employees of a
				subcontractor to the offeror, and not as independent contractors to the offeror
				or any other entity performing under such
				contracts.</text>

				term of imprisonment of at least four years under Federal, State, or local law
				that involves at least one jurisdiction outside the United States and that is
				intended to obtain, directly or indirectly, a financial or other material
				benefit.</text>
										</subparagraph></paragraph><paragraph id="HA012D53A1012428F89F38B7509E0D842"><enum>(6)</enum><header>Transnational
				organized crime group</header><text display-inline="yes-display-inline">The
				term <quote>transnational organized crime group</quote> means a group of
				persons that includes one or more citizens of a foreign country, exists for a
				period of time, and acts in concert with the aim of engaging in transnational
				organized
				crime.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HE720BB9BACEB49E8B5660544CBCC8926"><enum>(b)</enum><header>Advance
			 notification for international criminal tribunal rewards</header><text>Section
			 36(g) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2708">22 U.S.C. 2708(g)</external-xref>)
			 is amended by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HF0090090A70E485592156F638B9CDBCC" style="OLC">
							<paragraph id="HF6FD0893E3394955A6DBBDD7FFB3060C"><enum>(3)</enum><header>Advance
				notification for international criminal tribunal rewards</header><text display-inline="yes-display-inline">Not less than 15 days before publicly
				announcing that a reward may be offered for the arrest or conviction in any
				country, or the transfer to or conviction by an international criminal tribunal
				(including a hybrid or mixed tribunal), of a foreign national accused of war
				crimes, crimes against humanity, or genocide (as defined under the statute of
				such tribunal), the Secretary shall submit to the appropriate congressional
				committees a report, which may be submitted in classified form if necessary,
				specifying the reasons why such arrest or conviction or transfer of such
				foreign national is in the national interests of the United
				States.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HEE7547CC0EDB415184144B8DDCB3900B"><enum>(c)</enum><header>Enhancing
			 publicity of rewards information</header><text>The Department of State and the
			 Broadcasting Board of Governors shall make themselves available to the
			 appropriate congressional committees for periodic briefings on their
			 cooperative efforts to publicize rewards authorized under section 36 of the
			 State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2708">22 U.S.C. 2708</external-xref>).</text>
					</subsection><subsection id="H8A0F1FDE34EF4EE784BAF6FBE1E7D0E0"><enum>(d)</enum><header>Technical
			 correction</header><text>Section 36(e)(1) of the State Department Basic
			 Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2708">22 U.S.C. 2708</external-xref>) is amended by
			 striking <quote>The Secretary shall authorize a reward of $50,000,000 for the
			 capture or death or information leading to the capture or death of Osama bin
			 Laden.</quote>.</text>
					</subsection><subsection id="HB7F0AB63156F477BA7CC0A3C78FB6C9A"><enum>(e)</enum><header>Rule of
			 construction</header><text>Nothing in this section shall be construed as
			 authorizing the use of activity precluded under the American Servicemembers’
			 Protection Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/206">Public Law 107–206</external-xref>).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H2C8FAD73CCAC4BB0B18D626C87DA9B98"><enum>(f)</enum><header>Funding</header><text>To
			 carry out this section, the Secretary of State shall use amounts appropriated
			 or otherwise made available to the Emergencies in the Diplomatic and Consular
			 Service account of the Department of State.</text>
					</subsection></section><section id="HEE63D2178A834FD099E7DEE9E8A6621E" section-type="subsequent-section"><enum>208.</enum><header>Cybersecurity
			 efforts of the Department of State</header>
					<subsection id="H018FA8D158804B49A0E8662C72CFA2EE"><enum>(a)</enum><header>Coordinator for
			 Cyber Issues of the Department of State</header>
						<paragraph id="HBC9801FB25FD41309491B3A13814B40A"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of State is authorized to establish within
			 the office of the Secretary of State a Coordinator for Cyber Issues (in this
			 section referred to as the <quote>Coordinator</quote>), who shall be appointed
			 by the President, by and with the advice and consent of the Senate.</text>
						</paragraph><paragraph id="HD5963F86CFD84CEFB556DBAC2DEBD273"><enum>(2)</enum><header>Principal
			 duties</header><text display-inline="yes-display-inline">The Coordinator
			 should—</text>
							<subparagraph id="H062EB6B124B94DF2889457F9409BA1EC"><enum>(A)</enum><text display-inline="yes-display-inline">be the principal official within the senior
			 management of the Department responsible for cyberspace and cybersecurity
			 issues;</text>
							</subparagraph><subparagraph id="HF6632ED2907F47868DB38589EE51D199"><enum>(B)</enum><text>be the principal
			 advisor to the Secretary of State on international cyberspace and cybersecurity
			 issues;</text>
							</subparagraph><subparagraph id="HE0452DCD7BEE4DAD976B7D05AD624222"><enum>(C)</enum><text>report directly to
			 the Secretary;</text>
							</subparagraph><subparagraph id="HD05DEBDE450B40A2A62BD0BB6C45AC9F"><enum>(D)</enum><text>perform such
			 duties and exercise such powers as the Secretary shall prescribe; and</text>
							</subparagraph><subparagraph id="HD156BD9AB821481EAB0FA50923141E62"><enum>(E)</enum><text>coordinate United
			 States cyberspace and cybersecurity foreign policy in each country or region
			 that the Secretary considers significant with respect to efforts of the United
			 States Government to enhance cybersecurity globally.</text>
							</subparagraph></paragraph><paragraph id="H2C9513F121894B0CAEFD7FD17D6F5B75"><enum>(3)</enum><header>Additional
			 duties</header><text display-inline="yes-display-inline">In addition to the
			 duties described in paragraph (2), the Coordinator should—</text>
							<subparagraph id="H2D3942EA8B84418D8113C7EF5954D3CD"><enum>(A)</enum><text display-inline="yes-display-inline">provide strategic direction and
			 coordination for Department of State policy and programs aimed at addressing
			 and responding to cyberspace and cybersecurity issues overseas;</text>
							</subparagraph><subparagraph id="H166269B2FC934DFB8342A2842484673B"><enum>(B)</enum><text>work with relevant
			 Federal departments and agencies, including the Department of Homeland
			 Security, the Department of Defense, the Department of the Treasury, the
			 Department of Justice, the Department of Commerce, and the intelligence
			 community, in the development of interagency plans regarding international
			 cyberspace and cybersecurity issues;</text>
							</subparagraph><subparagraph id="HE9DA57E0676D4954B8F626A5AAEBE24F"><enum>(C)</enum><text>conduct internal
			 exercises for the Department of State to plan for responses to a cyber
			 attack;</text>
							</subparagraph><subparagraph id="HC1C027D7E6784EEC9762C1242E8A5ADF"><enum>(D)</enum><text>consult, where
			 appropriate, with the private sector on international cyberspace and
			 cybersecurity issues; and</text>
							</subparagraph><subparagraph id="H7C07B02E294045C6A0A0D3B716F440A2"><enum>(E)</enum><text>build multilateral
			 cooperation to develop international norms, common policies, and responses to
			 secure the integrity of cyberspace.</text>
							</subparagraph></paragraph><paragraph id="H8818DB7B6B1E43A891CED91E9E045CF2"><enum>(4)</enum><header>Rank and status
			 of ambassador</header><text display-inline="yes-display-inline">The Coordinator
			 should have the rank and status of Ambassador-at-Large.</text>
						</paragraph></subsection><subsection id="H06FBC83399824168A4262BD26EC05A77"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary of State shall submit to the Committee
			 on Foreign Affairs of the House of Representatives and Committee on Foreign
			 Relations of the Senate a report that includes the following:</text>
						<paragraph id="HBC8ADEC2E3F64D84B762C88FF13139F8"><enum>(1)</enum><text display-inline="yes-display-inline">A description of the Department of State’s
			 internal cybersecurity efforts, including the following:</text>
							<subparagraph id="HDB1768F9216145278F13B540545EAAB3"><enum>(A)</enum><text>A description of
			 the nature and scope of major incidents of cybercrime against the Department of
			 State.</text>
							</subparagraph><subparagraph id="H30E5858CACD64C479D9DB47154B86803"><enum>(B)</enum><text>A description of
			 action taken to ensure that all individuals trained by the Department of State
			 are adequately prepared to detect and respond to existing and foreseeable
			 vulnerabilities in the Department’s information security.</text>
							</subparagraph><subparagraph id="H82B23A933BD94883A715124A2C12167D"><enum>(C)</enum><text>An assessment of
			 whether the Department of State’s staffing levels, facilities, financial
			 resources, and technological equipment are sufficient to provide effective
			 cybersecurity training and protection against incidents of cybercrime.</text>
							</subparagraph><subparagraph id="H8EB95C41313A42038B51B66711EAF804"><enum>(D)</enum><text>A description of
			 action taken to develop and implement response plans to mitigate and isolate
			 disruption caused by incidents of cybercrime.</text>
							</subparagraph><subparagraph id="H9F4EB20F5B2947DEADBC0BF2D2F1EA20"><enum>(E)</enum><text>A description of
			 action taken to enhance cooperation on cybersecurity issues with other Federal
			 departments and agencies.</text>
							</subparagraph><subparagraph id="H1B3513D21C6044F8B1C4C4093A6A8960"><enum>(F)</enum><text display-inline="yes-display-inline">A description of any deployments of
			 interagency teams from the Department of State, the United States Agency for
			 International Development, and other Federal departments and agencies that have
			 been deployed to foreign countries to respond to incidents of
			 cybercrime.</text>
							</subparagraph></paragraph><paragraph id="H3AD745318CC3409481CB9CA0CA7558BB"><enum>(2)</enum><text display-inline="yes-display-inline">A description of the actions that the
			 Department of State is taking to work with other countries and international
			 organizations to strengthen cooperative efforts to—</text>
							<subparagraph id="HB203D1C5C4B84E599B0C29CE6469144D"><enum>(A)</enum><text>combat cybercrime
			 and enhance information security;</text>
							</subparagraph><subparagraph commented="no" id="H85297A762A284CE88FFD1E27478B5EF5"><enum>(B)</enum><text>pressure countries
			 identified as countries of cybersecurity concern under subsection (c) to take
			 effective action to end incidents of cybercrime; and</text>
							</subparagraph><subparagraph id="H8957AF4A3EA74D62BC3384698CCF1782"><enum>(C)</enum><text>assist
			 cybersecurity capacity-building in less developed countries.</text>
							</subparagraph></paragraph></subsection><subsection id="H4DB5D06FCCE7491486CB912F06DFBDD4"><enum>(c)</enum><header>List of
			 countries of cybersecurity concern</header>
						<paragraph id="HFCD4EC6D66484E7D8D7F61EE5CA32277"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of the enactment of this Act, the Secretary of State shall
			 determine if a country is a country of cybersecurity concern if the Secretary
			 of State finds that with respect to such a country—</text>
							<subparagraph id="H616EC1665C0C4384835B25B1B6B04502"><enum>(A)</enum><text display-inline="yes-display-inline">during the two-year period preceding the
			 date of the Secretary of State’s determination, there is significant credible
			 evidence that there has been a pattern of incidents of cybercrime—</text>
								<clause id="HBFE85325960849B4BA3F96DDFA4B218C"><enum>(i)</enum><text display-inline="yes-display-inline">against the United States Government or
			 United States persons, or that disrupt United States electronic commerce or
			 otherwise negatively impact the trade or intellectual property interests of the
			 United States; and</text>
								</clause><clause id="H1B6D463B393A416FAB8335840F8FD1E6"><enum>(ii)</enum><text>that are
			 attributable to persons or property based in such country; and</text>
								</clause></subparagraph><subparagraph id="HE87EF60756184DA3A51211476DAA1D22"><enum>(B)</enum><text display-inline="yes-display-inline">the government of such country has
			 demonstrated a pattern of being uncooperative with efforts to combat cybercrime
			 by—</text>
								<clause id="H59C7B050F65043509C43CE5B88011567"><enum>(i)</enum><text display-inline="yes-display-inline">failing to conduct its own reasonable
			 criminal investigations, prosecutions, or other proceedings with respect to the
			 incidents of cybercrime described in subparagraph (A);</text>
								</clause><clause id="HF8CBFA4564B5421DAA73CCA1BC145C9B"><enum>(ii)</enum><text>failing to
			 cooperate with the United States, any other party to the Convention on
			 Cybercrime, or INTERPOL, in criminal investigations, prosecutions, or other
			 proceedings with respect to such incidents, in accordance with chapter III of
			 the Convention on Cybercrime; or</text>
								</clause><clause id="H9E1A326EB1B94AF78F4653918A75BED0"><enum>(iii)</enum><text>not adopting or
			 implementing legislative or other measures in accordance with chapter II of the
			 Convention on Cybercrime with respect to criminal offenses related to computer
			 systems or computer data.</text>
								</clause></subparagraph></paragraph><paragraph id="H419EFA2734444B0EBC8448FE970DAB06"><enum>(2)</enum><header>Submission of
			 list</header>
							<subparagraph id="HC18951901BC84232855BA08FAD18E04F"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Upon making the
			 determinations under paragraph (1), the Secretary of State shall submit to
			 Congress a list of—</text>
								<clause id="H1C11A26A01E846E98D20130532C25FD8"><enum>(i)</enum><text>each
			 country that is a country of cybersecurity concern;</text>
								</clause><clause id="H61428BDC1C6042609AC9D8EDA2F4A9D3"><enum>(ii)</enum><text>the
			 basis for each such determination; and</text>
								</clause><clause id="H5DB0EBDD50D54AD5B785EFE4702A57E6"><enum>(iii)</enum><text>any actions the
			 Department of State is taking to address the concerns described in such
			 paragraph.</text>
								</clause></subparagraph><subparagraph id="HCDDC38B33B974872BB2EB138782AFA28"><enum>(B)</enum><header>Form</header><text>The
			 Secretary of State may submit the list described in this paragraph (or any
			 portion of such list) in classified form if the Secretary determines that such
			 is appropriate.</text>
							</subparagraph></paragraph></subsection><subsection id="HD18E89B9B2CA4A679FE3DC1223EBFA83"><enum>(d)</enum><header>Strategy for
			 United States engagement on international cyber issues</header>
						<paragraph commented="no" id="H579C75E8273A4E67BB67B1F2006DCF16"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Coordinator, in
			 consultation with the heads of appropriate Federal departments and agencies
			 with relevant technical expertise or policy mandates pertaining to cyberspace
			 and cybersecurity issues, shall, not later than 180 days after the date of the
			 enactment of this Act, develop and submit to congressional committees specified
			 in subsection (b) a strategy to support the objective of promoting United
			 States engagement on international cyber issues.</text>
						</paragraph><paragraph id="H619B96FA2C7545549F6DDF343F7EBDD2"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The strategy developed under paragraph (1)
			 shall—</text>
							<subparagraph id="H773EF9956C374F23ADEA4326BC87CC03"><enum>(A)</enum><text>include—</text>
								<clause id="HD2BF036FF1784127A6F7A1C06E6CD9DB"><enum>(i)</enum><text display-inline="yes-display-inline">efforts to be undertaken;</text>
								</clause><clause id="H60F4C9EB0EF54BE1884D3093826C49C3"><enum>(ii)</enum><text>specific and
			 measurable goals;</text>
								</clause><clause id="H70F4643DDEE744F69B18FF01A2801D72"><enum>(iii)</enum><text>benchmarks and
			 timeframes for achieving the objectives referred to in subsection (d)(3)(B);
			 and</text>
								</clause><clause id="H805DAA24A69A401693C512111AFEA713"><enum>(iv)</enum><text>progress made
			 towards achieving the benchmarks and timeframes described in clause (iii);
			 and</text>
								</clause></subparagraph><subparagraph id="H332FB47781DC4AB39DCBE2493B30C79F"><enum>(B)</enum><text>to the greatest
			 extent practicable, draw upon the expertise of technology, security, and policy
			 experts, private sector actors, international organizations, and other
			 appropriate entities.</text>
							</subparagraph></paragraph><paragraph id="H02ED67F5ABE148A1ACB94ECC06109D3D"><enum>(3)</enum><header>Components</header><text>The
			 strategy developed under paragraph (1) should include—</text>
							<subparagraph id="H8407F906ACC34CE8BE1385FA98819E0F"><enum>(A)</enum><text display-inline="yes-display-inline">assessments and reviews of existing
			 strategies for international cyberspace and cybersecurity policy and
			 engagement;</text>
							</subparagraph><subparagraph commented="no" id="H848648DF7B8746FD8753AB361371C15F"><enum>(B)</enum><text>short- and
			 long-term objectives for United States cyberspace and cybersecurity engagement;
			 and</text>
							</subparagraph><subparagraph id="H069317364BA5456A9C22C9F25FDE45D2"><enum>(C)</enum><text>a description of
			 programs, activities, and policies to foster United States Government
			 collaboration and coordination with other countries and organizations to
			 bolster an international framework of cyber norms, governance, and deterrence,
			 including consideration of the utility of negotiating a multilateral framework
			 to provide internationally acceptable principles to better mitigate
			 cyberwarfare, including noncombatants.</text>
							</subparagraph></paragraph></subsection><subsection id="H71B8FFFD3BBA41DBA6D21EF0129CD9EA"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="H094A62BF1BA04C9FAD289C6010881136"><enum>(1)</enum><header>Computer
			 data</header><text display-inline="yes-display-inline">The term <quote>computer
			 data</quote> means any representation of facts, information, or concepts in a
			 form suitable for processing in a computer system, including a program suitable
			 to cause a computer system to perform a function.</text>
						</paragraph><paragraph id="H39C2B694255F47B88ED8A6F4EAC14460"><enum>(2)</enum><header>Computer
			 systems</header><text>The term <quote>computer systems</quote> means any device
			 or group of interconnected or related devices, one or more of which, pursuant
			 to a program, performs automatic processing of data.</text>
						</paragraph><paragraph id="HB29F7038C6074E82A92CFBBE35D9FC31"><enum>(3)</enum><header>Convention on
			 Cybercrime</header><text>The term <quote>Convention on Cybercrime</quote>
			 refers to the Council of Europe Convention on Cybercrime, done at Budapest on
			 November 23, 2001, as ratified by the United States Senate with any relevant
			 reservations or declarations.</text>
						</paragraph><paragraph id="HAFE1A40D44A14DF4BE33E935D275B78D"><enum>(4)</enum><header>Cybercrime</header><text>The
			 term <quote>cybercrime</quote> refers to criminal offenses relating to computer
			 systems or computer data described in the Convention on Cybercrime.</text>
						</paragraph><paragraph commented="no" id="H55AA358563DB4EA498B5DAD0270CBF01"><enum>(5)</enum><header>Electronic
			 commerce</header><text>The term <quote>electronic commerce</quote> has the
			 meaning given such term in section 1105(3) of the Internet Tax Freedom Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C.
			 151</external-xref> note).</text>
						</paragraph><paragraph id="H0FD3C0A79F45486EABBE16A209E75AE8"><enum>(6)</enum><header>Information
			 security</header><text>The term <quote>information security</quote> refers
			 to—</text>
							<subparagraph id="H114F69C933DA473398EA0A196A04027B"><enum>(A)</enum><text display-inline="yes-display-inline">the confidentiality, integrity, or
			 availability of an information system, or the information such system
			 processes, stores, or transmits; and</text>
							</subparagraph><subparagraph id="H9F4BDA26D98C40EBB4B7C28714E98FD0"><enum>(B)</enum><text>the security
			 policies, security procedures, or acceptable use policies with respect to an
			 information system.</text>
							</subparagraph></paragraph><paragraph id="HDBAE8ADFD2CF4DB3A6A58DE210D2A14A"><enum>(7)</enum><header>INTERPOL</header><text display-inline="yes-display-inline">The term <quote>INTERPOL</quote> means the
			 International Criminal Police Organization.</text>
						</paragraph><paragraph id="HBCF2C7202EC94248988F99598C7934D3"><enum>(8)</enum><header>United States
			 person</header><text>The term <quote>United States person</quote> means—</text>
							<subparagraph id="HF7D47977DE47488DABA285AF7C68427D"><enum>(A)</enum><text display-inline="yes-display-inline">a United States citizen or an alien
			 lawfully admitted for permanent residence to the United States; or</text>
							</subparagraph><subparagraph id="H18490A59908B45BF9ED9BE0E18E6AEA3"><enum>(B)</enum><text>an entity
			 organized under the laws of the United States, or of any jurisdiction within
			 the United States.</text>
							</subparagraph></paragraph></subsection></section><section id="H7461598D1D8A4D299A8F9D7A6D2D799A"><enum>209.</enum><header>Center for
			 Strategic Counterterrorism Communications of the Department of State</header>
					<subsection id="HA7BCD3D14CD5443BB5D7AC369D84C362"><enum>(a)</enum><header>Statement of
			 policy</header><text>As articulated in Executive Order 13584, issued on
			 September 9, 2011, it is the policy of the United States to actively counter
			 the actions and ideologies of al-Qa’ida, its affiliates and adherents, other
			 terrorist organizations, and violent extremists overseas that threaten the
			 interests and national security of the United States.</text>
					</subsection><subsection id="HB430115ECE0749C0BB4D66EC3268A794"><enum>(b)</enum><header>Establishment of
			 Center for Strategic Counterterrorism Communications</header><text>There is
			 authorized to be established within the Department of State, under the
			 direction of the Secretary of State, the Center for Strategic Counterterrorism
			 Communications (in this section referred to as the <quote>CSCC</quote>).</text>
					</subsection><subsection id="H36BACBE080334A57AFC0D43DDA90004F"><enum>(c)</enum><header>Mission</header><text>The
			 CSCC may coordinate, orient, and inform government-wide public communications
			 activities directed at audiences abroad and targeted against violent extremists
			 and terrorist organizations, especially al-Qa’ida and its affiliates and
			 adherents.</text>
					</subsection><subsection id="H680BE8118C0B4805AD96F5C959667A35"><enum>(d)</enum><header>Coordinator of
			 the Center for Strategic Counterterrorism Communications</header><text>The head
			 of the CSCC should be the Coordinator. The Coordinator of the CSCC
			 should—</text>
						<paragraph id="H56205123A5FA40BC999AC3B7D8EB812D"><enum>(1)</enum><text>report to the
			 Under Secretary for Public Diplomacy and Public Affairs; and</text>
						</paragraph><paragraph id="HB7D7E1F52E3E4184967473B1C1F2AEF0"><enum>(2)</enum><text>collaborate with
			 the Bureau of Counterterrorism of the Department of State, other Department
			 bureaus, and other United States Government agencies.</text>
						</paragraph></subsection><subsection id="H40A88E124BB24EED836E021B7F777D41"><enum>(e)</enum><header>Duties</header><text>The
			 CSCC may—</text>
						<paragraph id="HD73610886E584735BDEE08EB3B031282"><enum>(1)</enum><text>monitor and
			 evaluate extremist narratives and events abroad that are relevant to the
			 development of a United States strategic counterterrorism narrative designed to
			 counter violent extremism and terrorism that threaten the interests and
			 national security of the United States;</text>
						</paragraph><paragraph id="H1376B4D1EC834AE197E196422E41DDB1"><enum>(2)</enum><text>develop and
			 promulgate for use throughout the executive branch United States strategic
			 counterterrorism narrative developed in accordance with paragraph (1), and
			 public communications strategies to counter the messaging of violent extremists
			 and terrorist organizations, especially al-Qa’ida and its affiliates and
			 adherents;</text>
						</paragraph><paragraph id="H67DF9FD95DE442C88A15EEDE0AF9EA19"><enum>(3)</enum><text>identify current
			 and emerging trends in extremist communications and communications by al-Qa’ida
			 and its affiliates and adherents in order to coordinate and provide guidance to
			 the United States Government regarding how best to proactively promote a United
			 States strategic counterterrorism narrative developed in accordance with
			 paragraph (1) and related policies, and to respond to and rebut extremist
			 messaging and narratives when communicating to audiences outside the United
			 States;</text>
						</paragraph><paragraph id="HEB27F96B791549FFAD85FE5325AB0A90"><enum>(4)</enum><text>facilitate the use
			 of a wide range of communications technologies by sharing expertise and best
			 practices among United States Government and non-government sources;</text>
						</paragraph><paragraph id="H96BF76D4CD4344DEA68F718F8F57606E"><enum>(5)</enum><text>identify and
			 request relevant information from United States Government agencies, including
			 intelligence reporting, data, and analysis; and</text>
						</paragraph><paragraph id="H63B38011BB7647809047B4C20C1B302F"><enum>(6)</enum><text>identify
			 shortfalls in United States capabilities in any areas relevant to the CSCC’s
			 mission, and recommend necessary enhancements or changes.</text>
						</paragraph></subsection><subsection id="H15EC13BF16DA4899AAD90D265415B66B"><enum>(f)</enum><header>Steering
			 Committee</header>
						<paragraph id="H2D95523A28474BAD869F2970CA323313"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of State may establish a Steering Committee
			 composed of senior representatives of United States Government agencies
			 relevant to the CSCC’s mission to provide advice to the Secretary on the
			 operations and strategic orientation of the CSCC and to ensure adequate support
			 for the CSCC.</text>
						</paragraph><paragraph id="HC6B95C75ED024E74A68CB188663F0B4A"><enum>(2)</enum><header>Meetings</header><text>The
			 Steering Committee should meet not less often than once every six
			 months.</text>
						</paragraph><paragraph id="H63344065AFD64F1F84858C999174090B"><enum>(3)</enum><header>Leadership</header><text>The
			 Steering Committee should be chaired by the Under Secretary of State for Public
			 Diplomacy. The Coordinator for Counterterrorism of the Department of State
			 should serve as Vice Chair. The Coordinator of the CSCC should serve as
			 Executive Secretary.</text>
						</paragraph><paragraph id="H51359CF4DB0342809E61FC386CB059DE"><enum>(4)</enum><header>Composition</header>
							<subparagraph id="H553A586D7218487B8A20A711B8777C7D"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Steering
			 Committee may include one senior representative designated by the head of each
			 of the following agencies:</text>

			 authority to assess passport surcharge</header><text display-inline="no-display-inline">Paragraph (2) of section 1(b) of the Act of
			 June 4, 1920 (41 Stat. 750; chapter 223;

			<section id="HEC0A423F3D0C4D949BD7BCD22901B582"><enum>301.</enum><header>Suspension of
			 Foreign Service members without pay</header>
				<subsection id="H9F43FBDDB0D543748EA9C53083CA3FAA"><enum>(a)</enum><header>Suspension</header><text>Section
			 610 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4010">22 U.S.C. 4010</external-xref>) is amended by
			 adding at the end the following new subsection:</text>
					<quoted-block id="H7BE7AA8A2043401CBA1238016B8D8D67" style="OLC">
						<subsection id="HAC82BD5076D14B828C36E38C5F64ABAA"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF0D1B71EF7444CED80CCA626D92C7D82"><enum>(1)</enum><text>In order to promote the
				efficiency of the Service, the Secretary may suspend a member of the Foreign
				Service without pay when the member’s security clearance is suspended or when
				there is reasonable cause to believe that the member has committed a crime for
				which a sentence of imprisonment may be imposed.</text>
							</paragraph><paragraph id="H4D48BB83E6074594964DBF334FED86F9" indent="up1"><enum>(2)</enum><text>Any member of the Foreign Service for
				whom a suspension is proposed in accordance with paragraph (1) shall be
				entitled to—</text>
								<subparagraph id="H5DACD44A619C4A70B6F9DB332D9FC01F"><enum>(A)</enum><text>written notice stating the specific
				reasons for the proposed suspension;</text>
								</subparagraph><subparagraph id="H41A0C6695FF548648073C8E1C6CB2123"><enum>(B)</enum><text>a reasonable time to respond orally
				and in writing to the proposed suspension;</text>
								</subparagraph><subparagraph id="H3E22CF3D1F724239B41A45B9AB03FD9A"><enum>(C)</enum><text>representation by an attorney or other
				representative; and</text>
								</subparagraph><subparagraph id="H44DF685590904B9DB8943BF2FAE93B05"><enum>(D)</enum><text>a final written decision, including
				the specific reasons for such decision, as soon as practicable.</text>
								</subparagraph></paragraph><paragraph id="HA4C0055D054C4CA0B1C211C68E9B0875" indent="up1"><enum>(3)</enum><text>Any member suspended under this
				section may file a grievance in accordance with the procedures applicable to
				grievances under chapter 11.</text>
							</paragraph><paragraph id="H5A1B129924EB40DC8EDDD2C3A183D02D" indent="up1"><enum>(4)</enum><text>In the case of a grievance filed
				under paragraph (3)—</text>
								<subparagraph id="H2BFB5BE206A74488B4F8771590B00567"><enum>(A)</enum><text>the review by the Foreign Service
				Grievance Board shall be limited to a determination of whether the provisions
				of paragraphs (1) and (2) have been fulfilled; and</text>
								</subparagraph><subparagraph id="HA85BC55B83744BD59B8C3497C22A10F0"><enum>(B)</enum><text>the Foreign Service Grievance Board
				may not exercise the authority provided under section 1106(8).</text>
								</subparagraph></paragraph><paragraph id="H1BBAC8AF192C47A78E962E3767F63719" indent="up1"><enum>(5)</enum><text>In this subsection:</text>
								<subparagraph id="H8698C75265BD4B67971BBA76DF7FCB4E"><enum>(A)</enum><text>The term <quote>reasonable
				time</quote> means—</text>
									<clause id="H7AC6FF9E291D4ABE8355F5D6CB01E296"><enum>(i)</enum><text>with respect to a member of the
				Foreign Service assigned to duty in the United States, 15 days after receiving
				notice of the proposed suspension; and</text>
									</clause><clause id="HD61D442DC98D497FB8E70F95039CBF2B"><enum>(ii)</enum><text>with respect to a member of the
				Foreign Service assigned to duty outside the United States, 30 days after
				receiving notice of the proposed suspension.</text>
									</clause></subparagraph><subparagraph id="H37CFA523E89F45EBA31B3E01A3919216"><enum>(B)</enum><text>The term <quote>suspend</quote> or
				<quote>suspension</quote> means the placing of a member of the Foreign Service
				in a temporary status without duties and
				pay.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HCAE67B2478944C8FB6E564688B782F3E"><enum>(b)</enum><header>Conforming and
			 clerical amendments</header>
					<paragraph id="H5DDCF755DD6A4766BF452FCFBECD34C7"><enum>(1)</enum><header>Amendment of
			 section heading</header><text>Section 610 of the Foreign Service Act of 1980,
			 as amended by subsection (a) of this section, is further amended, in the
			 section heading, by inserting <quote><header-in-text level="subsection" style="OLC">; Suspension</header-in-text></quote> before the period at the
			 end.</text>

				Service employees who have served five consecutive years under a limited
				appointment may be reappointed to a subsequent limited appointment if there is
				a one year break in service between each such appointment. The Secretary may in
				cases of special need waive the requirement for a one year break in
				service.</text>

				</paragraph></section><section id="H5BF7410B6D154238AB2F14552134DC14"><enum>304.</enum><header>Limitation of
			 compensatory time off for travel</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/5550b">Section 5550b</external-xref> of
			 title 5, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block id="H3AF8197DE6B94D20B684D3456BE44654" style="OLC">
					<subsection id="H43D688DBD5104C84BB341CCDAD24042D"><enum>(c)</enum><text>The maximum amount
				of compensatory time off earned under this section may not exceed 104 hours
				during any leave year (as defined by regulations established by the Office of
				Personnel
				Management).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" id="HB23457EFAB934563AB785757F8805831"><enum>305.</enum><header>Department of
			 State organization</header><text display-inline="no-display-inline">The
			 Secretary of State may, after consultation with the appropriate congressional
			 committees, transfer to such other officials or offices of the Department of
			 State as the Secretary may determine from time to time any authority, duty, or
			 function assigned by statute to the Coordinator for Counterterrorism, the
			 Coordinator for Reconstruction and Stabilization, or the Coordinator for
			 International Energy Affairs.</text>
			</section><section commented="no" id="H1527A010DACA48AF9569CE082323779D"><enum>306.</enum><header>Reemployment of
			 annuitants in high-risk posts</header><text display-inline="no-display-inline">Paragraph (2)(A) of section 824(g) of the
			 Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4064">22 U.S.C. 4064(g)(2)(A)</external-xref>) is amended
			 by striking <quote>2010</quote> and inserting <quote>2013</quote>.</text>
			</section><section commented="no" id="HBABEA7AFB79A486A9FB7C4346EFB7424"><enum>307.</enum><header>Overseas
			 comparability pay limitation</header>
				<subsection id="H3B6D4078230548BF906F01112B205C74"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to the
			 limitation described in subsection (b), the authority provided by section 1113
			 of the Supplemental Appropriations Act, 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/32">Public Law 111–32</external-xref>; 123 Stat. 1904), shall remain in effect through
			 September 30, 2013.</text>
				</subsection><subsection id="HC2BBF694E1F14C01A018D0A7A30385BB"><enum>(b)</enum><header>Limitation</header><text>The
			 authority described in subsection (a) may not be used to pay an eligible member
			 of the Foreign Service (as defined in section 1113(b) of the Supplemental
			 Appropriations Act, 2009) a locality-based comparability payment (stated as a
			 percentage) that exceeds two-thirds of the amount of the locality-based
			 comparability payment (stated as a percentage) that would be payable to such
			 member under <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section
			 5304</external-xref> of title 5, United States Code, if such member’s official
			 duty station were in the District of Columbia.</text>
				</subsection></section></title><title id="HB0326D23DA4D413484B1D3EBD2CC4154"><enum>IV</enum><header>United States
			 International Broadcasting</header>
			<section id="HC0EB39EF296F4E3CAF21CFB370CC34E6"><enum>401.</enum><header>Authorization
			 of appropriations for international broadcasting</header><text display-inline="no-display-inline">The following amounts are authorized to be
			 appropriated to carry out United States international broadcasting activities
			 under the United States Information and Educational Exchange Act of 1948, the
			 Radio Broadcasting to Cuba Act, the Television Broadcasting to Cuba Act, the
			 United States International Broadcasting Act of 1994, and the Foreign Affairs
			 Reform and Restructuring Act of 1998, and to carry out other authorities in law

			 conforming penalties for violations of sections 38 and 39 of the Arms Export
			 Control Act</header>

			 general</header><text>Section 38(c) of the Arms Export Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C.

				(j)(1)(c)(i) or an implementing arrangement pursuant to such a treaty, or who,
				in a registration or license application or required report, makes any untrue
				statement of a material fact or omits to state a material fact required to be
				stated therein or necessary to make the statements therein not
				misleading.</text>
								</paragraph><paragraph id="HCCC20C9C0C83453F9F38C568036C8026"><enum>(2)</enum><header>Criminal
				penalties</header><text>A person who willfully commits an unlawful act
				described in paragraph (1) shall upon conviction—</text>
									<subparagraph id="HA8AFE3BA1E7046FCAD4774F968A10FA0"><enum>(A)</enum><text>be fined for each
				violation in an amount not to exceed $1,000,000, or</text>
									</subparagraph><subparagraph id="HE79DFEAEB4E344FCAD42EB81A8B09556"><enum>(B)</enum><text>in the case of a
				natural person, imprisoned for not more than 20 years or
				both.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H054BED551C3F46F480DB09D8973C5DBF"><enum>(b)</enum><header>Mechanisms To
			 identify violators</header><text>Section 38(g) of the Arms Export Control Act

			 date</header><text>The amendment made by subsection (a) shall take effect on
			 the date of the enactment of this Act and shall apply with respect to
			 violations of sections 38 and 39 of the Arms Export Control Act committed on or
			 after that date.</text>
					</subsection></section><section id="HE4802C20923A49D586B199CE9F665DE8"><enum>508.</enum><header>Clarification
			 of prohibitions relating to state sponsors of terrorism and their
			 nationals</header><text display-inline="no-display-inline">Section 40(d) of the
			 Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>) is
			 amended—</text>
					<paragraph id="H9B3E688DBB3E44F38C84087338DBF2FA"><enum>(1)</enum><text>by inserting
			 <quote>or to the nationals of that country whose substantive contacts with that
			 country give reasonable grounds for raising risk of diversion, regardless of
			 whether such persons maintain such nationality or the nationality of another
			 country not covered by this section</quote> after <quote>with respect to a
			 country</quote>; and</text>
					</paragraph><paragraph commented="no" id="H496F8071889B445FA4BA2804646D28FF"><enum>(2)</enum><text>by adding at the
			 end the following: <quote>For purposes of this subsection, the term
			 <term>national</term> means an individual who acquired citizenship by birth
			 from a country that is subject to
			 <external-xref legal-doc="regulation" parsable-cite="cfr/22/126.1">section
			 126.1</external-xref> of title 22, Code of Federal Regulations (or any
			 successor regulations).</quote>.</text>
					</paragraph></section><section id="HCA6FA1BC6E214F7DA293ACB670696456"><enum>509.</enum><header>Exemption for
			 transactions with countries supporting acts of international
			 terrorism</header><text display-inline="no-display-inline">Section 40(h) of the
			 Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(h)</external-xref>) is
			 amended—</text>
					<paragraph id="H9B398AFF09124955A2155BCF16868067"><enum>(1)</enum><text>in the
			 heading—</text>

					</paragraph></section><section id="HBACFAB9914154795A91728DB006B9F74"><enum>510.</enum><header>Report on
			 Foreign Military Financing program</header><text display-inline="no-display-inline">Section 23 of the Arms Export Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/2763">22 U.S.C.
			 2763</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HBD2D63C7D1794CAAB9BECA011365203A" style="OLC">
						<subsection id="HAA67D59EF43647E6A574CA2D32679269"><enum>(i)</enum><header>Report</header>
							<paragraph id="HCDA65BA071114883B3F59B859C6A94F3"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President shall
				transmit to the appropriate congressional committees as part of the supporting
				materials of the annual congressional budget justification a report on the
				implementation of this section for the prior fiscal year.</text>
							</paragraph><paragraph id="H9FB0A13B7A9D4A069DB21682888360DE"><enum>(2)</enum><header>Matters to be
				included</header><text>The report required under paragraph (1) shall include a
				description of the following:</text>
								<subparagraph id="H7ABF89BA66A749DF85EBE5A66A9607E8"><enum>(A)</enum><text>The extent to
				which the use of the authority of this section is based on a well-formulated
				and realistic assessments of the capability requirements of foreign countries
				and international organizations.</text>
								</subparagraph><subparagraph id="H7D4D7853BC8244D9B5A2CF5AD165C765"><enum>(B)</enum><text>The extent to
				which the provision of grants under the authority of this section are
				consistent with United States conventional arms transfer policy.</text>
								</subparagraph><subparagraph id="H343398CA35A04BB88B8FF5666C67A779"><enum>(C)</enum><text>The extent to
				which the Department of State has developed and implemented specific plans to
				monitor and evaluate outcomes under the authority of this section, including at
				least one country or international organization assessment each fiscal
				year.</text>
								</subparagraph></paragraph><paragraph id="H146ACB224086424CA2A1DBF9515D0BBA"><enum>(3)</enum><header>Appropriate
				congressional committees</header><text>In this subsection, the term
				<term>appropriate congressional committees</term> means—</text>
								<subparagraph id="HA6F989FB611E47698FBC9B9C55632C85"><enum>(A)</enum><text>the Committee on
				Appropriations and the Committee on Foreign Affairs of the House of
				Representatives; and</text>
								</subparagraph><subparagraph id="HB6AD35EC6DC1416BAE11C0B2764DF7B1"><enum>(B)</enum><text>the Committee on
				Appropriations and the Committee on Foreign Relations of the
				Senate.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H9F3B63C05BBA40C98BC9D948BB46E782"><enum>511.</enum><header>Congressional
			 notification of regulations and amendments to regulations under section 38 of
			 the Arms Export Control Act</header>
					<subsection id="HB93E3DDEB85C4437B4E248B842E26CAB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 38 of the
			 Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>) is amended by
			 adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H5CEF1097707C4BCDA6C125BD4577566C" style="OLC">
							<subsection id="H26BB815A0975453FB3D3C702362117FF"><enum>(k)</enum><header>Congressional
				notification</header><text display-inline="yes-display-inline">The President
				shall submit to the Committee on Foreign Affairs of the House of
				Representatives and the Committee on Foreign Relations of the Senate a copy of
				regulations or amendments to regulations issued to carry out this section at
				least 30 days before publication of the regulations or amendments in the
				Federal Register unless, after consulting with such Committees, the President
				determines that there is an emergency that requires a shorter period of time
				for submittal of such regulations or
				amendments.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H1BF3D3AB3CAB4E9282BFC0E294D4100C"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) takes effect on the
			 date of the enactment of this Act and applies with respect the issuance of
			 regulations or amendments to regulations made on or after the date of the
			 enactment of this Act.</text>
					</subsection></section><section id="H6C855F3EA7A24DC8A242F033EDDBE677"><enum>512.</enum><header>Diplomatic
			 efforts to strengthen national and international arms export
			 controls</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, and annually thereafter for 4
			 years, the President shall transmit to the appropriate congressional committees
			 a report on United States diplomatic efforts to strengthen national and
			 international arms export controls, including a detailed description of any
			 senior-level initiative, to ensure that those arms export controls are
			 comparable to and supportive of United States arms export controls,
			 particularly with respect to countries of concern to the United States.</text>
				</section><section id="HBEE553E0AAF9492FAFBF3E469457C934"><enum>513.</enum><header>Review and
			 report of investigations of violations of section 3 of the Arms Export Control
			 Act</header>
					<subsection id="H9190F3FA014F4846A08BEA749931D4B9"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">The Inspector General of the Department of
			 State shall conduct a review of investigations by the Department of State
			 during each of fiscal years 2013 through 2017 of any and all possible
			 violations of section 3 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>)
			 with respect to misuse of United States-origin defense items to determine
			 whether the Department of State has fully complied with the requirements of
			 such section, as well as its own internal procedures (and whether such
			 procedures are adequate), for reporting to Congress any information regarding
			 the unlawful use or transfer of United States-origin defense articles, defense
			 services, and technology by foreign countries, as required by such
			 section.</text>
					</subsection><subsection id="H4253B20890334221929140EE50F17984"><enum>(b)</enum><header>Report</header><text>The
			 Inspector General of the Department of State shall submit to the Committee on
			 Foreign Affairs of the House of Representatives and the Committee on Foreign
			 Relations of the Senate for each of fiscal years 2013 through 2017 a report
			 that contains the findings and results of the review conducted under subsection
			 (a). The report shall be submitted in unclassified form to the maximum extent
			 possible, but may include a classified annex.</text>
					</subsection></section><section commented="no" id="HCE6AF934175849FE9C26F79B90273ED2" section-type="subsequent-section"><enum>514.</enum><header>Reports on
			 commercial and governmental military exports under the Arms Export Control Act;
			 congressional actions</header>
					<subsection commented="no" id="H2DF2407F96974C53AB0771F00D1CF933"><enum>(a)</enum><header>Congressional
			 consultation</header>
						<paragraph commented="no" id="H80524A5BFA9D41E2AB833584BFEEE054"><enum>(1)</enum><header>Government
			 sales</header><text>Section 36(b)(1) of the Arms Export Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C.
			 2776(b)(1)</external-xref>) is amended by adding at the end the following:
			 <quote>The President shall consult fully and completely with the Committee on
			 Foreign Affairs of the House of Representatives and the Committee on Foreign
			 Relations of the Senate before submitting a certification under this

						</paragraph></subsection><subsection commented="no" id="HFA0FB65D442D49AA9B6339377314531F"><enum>(b)</enum><header>Requirement To
			 provide advance notification and consultation on certain sales and
			 exports</header><text>Section 36 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776</external-xref>) is
			 amended by adding at the end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="HD697BF26914144CE875A425B246B360E" style="OLC">
							<subsection commented="no" id="H63F03D00C33B4407B5055DA34137B3F3"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HDCD6CE33A9844F5C9B67E84E65BB0C58"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA9114223C01244179B6DFC319DFCEE2A"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 60 calendar days prior to
				the submission of a certification under subsection (b), (c), or (d) of this
				section, the President shall provide advance notification in writing to, and
				consult with, the chairs and ranking minority members of the appropriate
				congressional committees of the offer to sell or export the defense articles or
				defense services with respect to which such a certification is required to be
				submitted pursuant to any such subsection.</text>
									</subparagraph><subparagraph commented="no" id="HDD3900B687EE45229CA562EAC95E9E00" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H2471550A8ED84DD69072D0D7FCF199E3"><enum>(i)</enum><text>The requirement of
				subparagraph (A) to provide 60 calendar days advance notification in writing to
				the chairs and ranking minority members of the appropriate congressional
				committees shall not apply if the chairs and ranking minority members of the
				appropriate congressional committees have agreed, at their discretion, to waive
				such requirement.</text>
										</clause><clause commented="no" id="H80441B2C0C924AA78F4A707D0A6E233A" indent="up1"><enum>(ii)</enum><text>The requirements of subparagraph (A)
				shall not apply if the President states in the certification that an emergency
				exists that requires the sale or export of defense articles or defense services
				to be in the national security interests of the United States in accordance
				with subsection (b), (c), or (d) of this section.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="H996C6B3F1C0A4CD98B7C1B20DEF970E7" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1227B8A16C8448B290F490C44D9BE50B"><enum>(A)</enum><text display-inline="yes-display-inline">A certification submitted under subsection
				(b), (c), or (d) of this section shall be subject to the procedures applicable
				to reprogramming notifications under section 634A(a) of the Foreign Assistance
				Act of 1961.</text>
									</subparagraph><subparagraph commented="no" id="HBBE6CBE36A924E0596EE76EE41415E47" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The requirement of subparagraph (A) shall
				not apply if the President transmits to the chairs and ranking minority members
				of the appropriate congressional committees a report in writing that contains a
				determination of the President that extraordinary circumstances exist which
				necessitates the obviation of such requirement and a detailed description of
				such
				circumstances.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" id="HE4278190323F4765A7FB4307D979714F"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 36(e) of the Arms Export Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C.
			 2776(e)</external-xref>) is amended—</text>
						<paragraph commented="no" id="HAF258172D66742C38E659253CDDB4788"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text>
						</paragraph><paragraph commented="no" id="HE11CFE85FD144BD5A03F8E4FA6469B9D"><enum>(2)</enum><text>by inserting
			 before paragraph (2) (as redesignated) the following new paragraph:</text>

			 Provisions</header>
				<section id="H6CD7550893BE4BDFBC782530ACF503BA"><enum>521.</enum><header>Treatment of
			 militarily insignificant parts and components</header><text display-inline="no-display-inline">It shall be the policy of the United States,
			 pursuant to section 38(f) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>) to
			 prioritize the removal of those militarily insignificant parts, components,
			 accessories, and attachments from the United States Munitions List that, even
			 if specifically designed for a defense article controlled on the United States
			 Munitions List, would warrant no more than anti-terrorism controls under the
			 Export Administration Act of 1979 (as continued in effect under the
			 International Emergency Economic Powers Act) or any successor Act.</text>
				</section><section id="HA76DCF23D2FD47A1AD081E6145010498"><enum>522.</enum><header>Special export
			 licensing for United States allies</header><text display-inline="no-display-inline">Section 38 of the Arms Export Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C.
			 2778</external-xref>), as amended by this Act, is further amended by adding the
			 following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H77E7A50FBFEE47568221430DF4BD9C0A" style="OLC">
						<subsection id="HF35DE42EFF5F4997938212DDE15F6BC2"><enum>(l)</enum><header>Special export
				licensing for United States allies</header><text>The President may establish
				special licensing procedures for the export of replacement components, parts,
				accessories, attachments, equipment, firmware, software or technology that are
				not designated as major defense equipment or significant military equipment to
				the North Atlantic Treaty Organization, any member country of that
				Organization, or any other country described in section 36(c)(2)(A) of this
				Act.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H6C5BEF533B8140F4AB0E81D2D343C984"><enum>523.</enum><header>Improving and
			 streamlining licensing under United States Government arms export control
			 programs</header><text display-inline="no-display-inline">In implementing
			 reforms of United States arms export control programs, the President should
			 prioritize the development of a new framework to improve and streamline
			 licensing under such programs, including by seeking to revise the Special
			 Comprehensive Export Authorizations for the North Atlantic Treaty Organization,
			 any member country of that Organization, or any other country described in
			 section 36(c)(2)(A) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C.
			 2776(c)(2)(A)</external-xref>) under
			 <external-xref legal-doc="regulation" parsable-cite="cfr/15/126.14">section
			 126.14</external-xref> of title 15, Code of Federal Regulations (relating to
			 the International Traffic in Arms Regulations).</text>
				</section><section id="HE40B3E9C099B4BCCBC36DE4650891C6A"><enum>524.</enum><header>Authority to
			 remove satellites and related components from the United States Munitions
			 List</header>
					<subsection id="HCA3A80AD4B6641B7BFBAE50D21182718"><enum>(a)</enum><header>Authority</header><text>Subject
			 to subsection (b), the President is authorized to remove commercial satellites
			 and related components and technology from the United States Munitions List
			 pursuant to section 38(f) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C.
			 2778(f)</external-xref>).</text>
					</subsection><subsection id="H5D50D5C73BDE4ADB97345ACD4A58A2DD"><enum>(b)</enum><header>Determination</header><text>The
			 President may exercise the authority provided in subsection (a) only if the
			 President submits to the appropriate congressional committees a determination
			 that the transfer of commercial satellites and related components and
			 technology from the United States Munitions List does not pose an unacceptable
			 risk to the national security of the United States. Such determination shall
			 include a description of the risk-mitigating controls, procedures, and
			 safeguards the President will put in place to reduce such risk to an absolute
			 minimum.</text>
					</subsection><subsection id="H855B8A61E7FC4C6F9819B0772B7FBD31"><enum>(c)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No license or other authorization for
			 export shall be granted for the transfer, retransfer, or reexport of any
			 commercial satellite or related component or technology contained on the
			 Commerce Control List maintained under part 774 of title 15, Code of Federal
			 Regulations to any person or entity of the following:</text>
						<paragraph id="H8EAB8B85CA6B49B0A593EBC94F33A8E1"><enum>(1)</enum><text>The People’s
			 Republic of China.</text>
						</paragraph><paragraph id="H50891DD01B114A55B7E3379EA2CE7C1A"><enum>(2)</enum><text>Cuba.</text>
						</paragraph><paragraph id="H85BA0ABCDE8A46C6822D307C870C52EF"><enum>(3)</enum><text>Iran.</text>
						</paragraph><paragraph id="H652AF34B07C446F8A1A0CCA8424BD08D"><enum>(4)</enum><text>North
			 Korea.</text>
						</paragraph><paragraph id="H84AA07E39A3A4F38AD39A09D8C0979DA"><enum>(5)</enum><text>Sudan.</text>
						</paragraph><paragraph id="HE75579CD1F8A492F9DE666DFECFBD77C"><enum>(6)</enum><text>Syria.</text>
						</paragraph><paragraph id="HFD0E4B35E1064FB5BBE70BB418980462"><enum>(7)</enum><text>Any country with
			 respect to which the United States would deny the application for licenses and
			 other approvals for exports and imports of defense articles under
			 <external-xref legal-doc="regulation" parsable-cite="cfr/15/126.1">section
			 126.1</external-xref> of title 15, Code of Federal Regulations (relating to the
			 International Traffic in Arms Regulations).</text>
						</paragraph></subsection><subsection id="HD2B80D311496472A880E0FA1C557722F"><enum>(d)</enum><header>Report</header>
						<paragraph id="HB424BCFE45B54DD4A73F37E2A426DE83"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, and annually thereafter, the Director of National Intelligence shall
			 submit to the appropriate congressional committees on efforts of state sponsors
			 of terrorism, other foreign countries, or entities to illicitly acquire
			 commercial satellites and related components and technology.</text>
						</paragraph><paragraph id="HB397FAB2FAE34E569AA865D933005667"><enum>(2)</enum><header>Form</header><text>Such
			 report shall be submitted in unclassified form, but may contain a classified
			 annex.</text>
						</paragraph></subsection><subsection id="H3A1A3A4053554D35A9D7EB89B19FC655"><enum>(e)</enum><header>Definition</header><text>In
			 this section, the term <quote>appropriate congressional committees</quote>
			 means—</text>
						<paragraph id="HCD8FE542346E4F548658744C15510BC3"><enum>(1)</enum><text>the Committees on
			 Foreign Relations, Armed Services, and Intelligence of the Senate; and</text>
						</paragraph><paragraph id="H80D0E5571C8641A39E26795F2FB5AC6C"><enum>(2)</enum><text>the Committees on
			 Foreign Affairs, Armed Services, and Intelligence of the House of
			 Representatives.</text>
						</paragraph></subsection></section><section id="H6D00B958DDE748AF8450F4F8FC88B7B2"><enum>525.</enum><header>Report on
			 licenses and other authorizations to export commercial satellites and related
			 components and technology contained on the Commerce Control List</header>
					<subsection id="H0CD86E12251C49E59DB51AF0FC0AC62B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 60
			 days after the end of each calendar quarter, the President shall transmit to
			 the Committee on Foreign Affairs of the House of Representatives and the
			 Committee on Banking, Finance, and Urban Affairs of the Senate a report
			 containing a listing of all licenses and other authorizations to export
			 commercial satellites and related components and technology contained on the
			 Commerce Control List maintained under part 774 of title 15, Code of Federal
			 Regulations.</text>
					</subsection><subsection id="H69D33A9E50E943959E489BE7DF825FC9"><enum>(b)</enum><header>Form</header><text>Such
			 report shall be submitted in unclassified form, but may contain a classified
			 annex.</text>
					</subsection></section><section id="HC18E1EF297444125B3F1B3EB6BF9C259"><enum>526.</enum><header>Review of
			 United States Munitions List</header><text display-inline="no-display-inline">Section 38(f)(1) of the Arms Export Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C.
			 2778</external-xref>) is amended by striking the last sentence and inserting
			 the following: <quote>Such notice shall include, to the extent practicable, an
			 enumeration of the item or items to be removed and describe the nature of any
			 controls to be imposed on that item under any other provision of
			 law.</quote>.</text>
				</section><section id="H762A0035CD4643689695F867F9B136C5"><enum>527.</enum><header>Report on
			 country exemptions for licensing of exports of munitions and related technical
			 data</header>
					<subsection id="H5655DC246CD64A3496D8634D011C38A6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 120
			 days after the date of enactment of this Act, the Attorney General, the
			 Secretary of Commerce, and the Secretary of Homeland Security shall submit to
			 the appropriate congressional committees a report that includes—</text>
						<paragraph id="HFDC4157432F54084A93BFAD32C2E2372"><enum>(1)</enum><text>an assessment of
			 the extent to which the terms and conditions of exemptions for foreign
			 countries from the licensing requirements of the Commerce Munitions List (or
			 analogous controls for commercial satellites and related components and
			 technology) contain strong safeguards; and</text>
						</paragraph><paragraph id="H8D2AE885B0014A1FB0D99BD67798BFB5"><enum>(2)</enum><text display-inline="yes-display-inline">a compilation of sufficient documentation
			 relating to the export of munitions, commercial spacecraft, and related
			 technical data to facilitate law enforcement efforts to effectively detect,
			 investigate, deter and enforce criminal violations of any provision of the
			 Export Administration Regulations, including efforts on the part of state
			 sponsors of terrorism, other countries or entities to illicitly acquire such
			 controlled United States technology.</text>
						</paragraph></subsection><subsection id="H8C55CE282D1646EDABB4A2A0DCF7BC7E"><enum>(b)</enum><header>Definitions</header><text>In
			 this section—</text>
						<paragraph id="H4E1090DCAC754155B3E792111E0A1508"><enum>(1)</enum><text>the term
			 <quote>appropriate congressional committees</quote> means—</text>
							<subparagraph id="H6631AC96843346498248343B1FB8A49A"><enum>(A)</enum><text>the Committee on
			 Foreign Affairs and the Committee on Homeland Security of the House of
			 Representatives; and</text>
							</subparagraph><subparagraph id="H05D8AD84C3604B54859273F5199DF0BE"><enum>(B)</enum><text>the Committee on
			 Banking, Housing, and Urban Affairs and the Committee on Homeland Security and
			 Governmental Affairs of the Senate; and</text>
							</subparagraph></paragraph><paragraph id="H977506F4A8C3441387AA1DCFFF20374F"><enum>(2)</enum><text>the term
			 <quote>munitions</quote> means—</text>
							<subparagraph id="HA48A68A49A194019B944969B39F7657C"><enum>(A)</enum><text>items transferred
			 from the United States Munitions List to the Commerce Control List and
			 designated as <quote>600 series</quote> items on the Commerce Control List
			 under the Export Administration Regulations, as proposed by the Bureau of
			 Industry and Security of the Department of Commerce on July 15, 2011 (76 Fed.
			 Reg. 41958); or</text>
							</subparagraph><subparagraph id="HC236A1708CAA4D93A04DB6F5119B4B53"><enum>(B)</enum><text>any successor
			 regulations.</text>
							</subparagraph></paragraph></subsection></section><section id="H019EA0877BEC4228BB8870C66A009DAB"><enum>528.</enum><header>End-use
			 monitoring of munitions</header>
					<subsection id="HBEF79978CB924836B65B05F51AEDADA8"><enum>(a)</enum><header>Establishment of
			 monitoring program</header><text>In order to ensure accountability with respect
			 to the export of munitions and related technical data on the Commerce Munitions
			 List, the President shall establish a program to provide for the end-use
			 monitoring of such munitions and related technical data.</text>
					</subsection><subsection id="H5B5F9DF6742045398C5BF48D28A046D7"><enum>(b)</enum><header>Report to
			 congress</header><text>Not later than 180 days after the date of the enactment
			 of this Act, and annually thereafter, the President shall submit to Congress a
			 report describing the actions taken to implement this section, including a
			 detailed accounting of the costs and number of personnel associated with the
			 program established under subsection (a).</text>
					</subsection><subsection id="HDC46051B17984AB8B89922DC8B9A7840"><enum>(c)</enum><header>Munitions</header><text>In
			 this section, the term <quote>munitions</quote> means—</text>
						<paragraph id="H6E1EB3B16C5F48F9B35DE59E57B35205"><enum>(1)</enum><text>items transferred
			 from the United States Munitions List to the Commerce Control List and
			 designated as <quote>600 series</quote> items on the Commerce Control List
			 under the Export Administration Regulations, as proposed by the Bureau of
			 Industry and Security of the Department of Commerce on July 15, 2011 (76 Fed.
			 Reg. 41958); or</text>
						</paragraph><paragraph id="H8864D0D90C104E6EA30BFE2215434296"><enum>(2)</enum><text>any successor
			 regulations.</text>
						</paragraph></subsection></section><section id="HE4BA3ED1758140768CA45FF2C52E381A"><enum>529.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
					<paragraph id="H80B1832AAB1B4AE297166356D78C2CED"><enum>(1)</enum><header>Commerce
			 munitions list</header><text>The term <quote>Commerce Munitions List</quote>
			 means—</text>
						<subparagraph id="H4A2D318549464440B4B6CBAFA9A14274"><enum>(A)</enum><text>items transferred
			 from the United States Munitions List to the Commerce Control List and
			 designated as <quote>600 series</quote> items on the Commerce Control List
			 under the Export Administration Regulations, as proposed by the Bureau of
			 Industry and Security of the Department of Commerce on July 15, 2011 (76 Fed.
			 Reg. 41958); or</text>
						</subparagraph><subparagraph id="H20AAF5D8F7B64F9B88FCF07192C6A20B"><enum>(B)</enum><text>any successor
			 regulations.</text>
						</subparagraph></paragraph><paragraph id="H408BA6B134A04EC48B3A46579877AA72"><enum>(2)</enum><header>Commercial
			 satellites and related components and technology</header><text>The term
			 <quote>commercial satellites and related components and technology</quote>
			 means—</text>
						<subparagraph id="H3C54451CDFBA43F3AC21701DE134E72D"><enum>(A)</enum><text>communications
			 satellites that do not contain classified components, including remote sensing
			 satellites with performance parameters below thresholds identified on the
			 United States Munitions List; and</text>
						</subparagraph><subparagraph id="H18A69E20F8D8494FBE8828B0450EA4A8"><enum>(B)</enum><text>systems,
			 subsystems, parts, and components associated with such satellites and with
			 performance parameters below thresholds specified for items that would remain
			 on the United States Munitions List.</text>
						</subparagraph></paragraph><paragraph id="H47BBCE7F80D9492F9C841F466E073BFC"><enum>(3)</enum><header>Export
			 administration regulations</header><text>The term <quote>Export Administration
			 Regulations</quote> means—</text>

			 Administration Regulations as maintained and amended under the authority of the
			 International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or</text>
						</subparagraph><subparagraph id="H5CE29484197742F9A89D826BD40A8ADB"><enum>(B)</enum><text>any successor
			 regulations.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H35CF814F6B05450B893252D43BD90C7C"><enum>(4)</enum><header>State sponsor of
			 terrorism</header><text>The term <term>state sponsor of terrorism</term> means
			 a country the government of which has been determined by the Secretary of
			 State, for purposes of section 6(j) of the Export Administration Act of 1979
			 (as continued in effect under the International Emergency Economic Powers Act),
			 section 620A of the Foreign Assistance Act of 1961, section 40 of the Arms
			 Export Control Act, or any other provision of law, is a government that has
			 repeatedly provided support for acts of international terrorism.</text>
					</paragraph><paragraph id="H6465399BCBEE4D6682E089123F2D2F1A"><enum>(5)</enum><header>United states
			 munitions list</header><text>The term <quote>United States Munitions
			 List</quote> means the list referred to in section 38(a)(1) of the Arms Export
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22
			 U.S.C. 2778(a)(1)</external-xref>).</text>
