<official-title display="yes">To amend title 5, United States Code, to provide for investigative leave requirements with respect to Senior Executive Service employees, and for other purposes.</official-title>

<section id="H775631D907774A78B32EC450AAC8C4D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Government Employee Accountability Act</quote>.</text></section> 
<section id="HCCB75836B3984BB293F801B6F56AF237" commented="no"><enum>2.</enum><header>Suspension for 14 days or less for senior executive service employees</header><text display-inline="no-display-inline"> Paragraph (1) of section 7501 of title 5, United States Code, is amended to read as follows:</text> 
<quoted-block style="USC" id="H9CA9498DC25A4F908F6F8426F3E69E56" display-inline="no-display-inline"> 
<paragraph id="H895BCC9E784B419E96E05F4AC2F18301"><enum>(1)</enum><text display-inline="yes-display-inline"><quote>employee</quote> means—</text> 
<subparagraph id="H2AE2F29D3A7D42099117263A66E8B3C5" commented="no"><enum>(A)</enum><text>an individual in the competitive service who is not serving a probationary or trial period under an initial appointment or who has completed 1 year of current continuous employment in the same or similar positions under other than a temporary appointment limited to 1 year or less; or</text></subparagraph> 
<subparagraph id="H2FDEA63B7BB34FBDB86DE63C412D5A91" commented="no"><enum>(B)</enum><text>a career appointee in the Senior Executive Service who—</text> 
<clause id="HDB452908B05C4BC68F7668219A6DE5C8" commented="no"><enum>(i)</enum><text>has completed the probationary period prescribed under section 3393(d); or</text></clause> 
<clause id="HF5C73B4D0BDC4FD78D55EC262F1A279B" commented="no"><enum>(ii)</enum><text>was covered by the provisions of subchapter II of this chapter immediately before appointment to the Senior Executive Service;</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6B803A15EB354CA69109CBE580D863F1"><enum>3.</enum><header>Investigative leave for Senior Executive Service employees</header> 
<subsection id="H6342C3296A3442C7B46E641C42A3A538"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 75 of title 5, United States Code, is amended by adding at the end the following:</text>

<subchapter id="H1F1E6426BCE34C668BEAA50AC54EB056"><enum>VI</enum><header>Investigative leave for Senior Executive Service employees</header> 
<section id="H2FCC71A0E1804D82AEF2F260C30334D5"><enum>7551.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this subchapter—</text> 
<paragraph id="HF27D7ACF26CE4003A190CC1F9077EA39"><enum>(1)</enum><text><quote>employee</quote> has the meaning given such term in section 7541; and</text></paragraph> 
<paragraph id="HFD85A2EF676246328B7CE6D9D29B58A8"><enum>(2)</enum><text display-inline="yes-display-inline"><quote>investigative leave</quote> means a temporary absence without duty for disciplinary reasons, of a period not greater than 90 days.</text></paragraph></section> 
<section display-inline="no-display-inline" id="HF3AA074A8F714B01A593827087877919" section-type="subsequent-section"><enum>7552.</enum><header>Actions covered</header><text display-inline="no-display-inline">This subchapter applies to investigative leave.</text></section> 
<section id="H79D5E4522F1F43AAB01ED17E1DE5161A"><enum>7553.</enum><header>Cause and procedure</header> 
<subsection id="H5B86B1A2CA2F4E9FBDB6729E70AC8602"><enum>(a)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H9454BE3B2B8842168BB854DAB71A1DE5"><enum>(1)</enum><text display-inline="yes-display-inline">Under regulations prescribed by the Office of Personnel Management, an agency may place an employee on investigative leave, without loss of pay and without charge to annual or sick leave, only for misconduct, neglect of duty, malfeasance, or misappropriation of funds.</text></paragraph> 
<paragraph id="H3EDBD35B2A8C4E4DB3E56AD49D62D036" indent="up1"><enum>(2)</enum><text>If an agency determines that such employee’s conduct is serious or flagrant, the agency may place such employee on investigative leave under this subchapter without pay.</text></paragraph></subsection> 
<subsection id="HFA0D00781FC24E79B2394CAE858E340D"><enum>(b)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HF1803D75691E458CA75C27CACD40CE43"><enum>(1)</enum><text display-inline="yes-display-inline">At the end of each 45-day period during a period of investigative leave implemented under this section, the relevant agency shall review the investigation into the employee with respect to the misconduct, neglect of duty, malfeasance, or misappropriation of funds.</text></paragraph> 
<paragraph id="H6C0638F6690C499AA750F6C90F0C06E8" indent="up1"><enum>(2)</enum><text>Not later than 5 business days after the end of each such 45-day period, the agency shall submit a report describing such review to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></paragraph> 
<paragraph id="H82AD26CE10A14DEAB4C858951E98A1FE" indent="up1"><enum>(3)</enum><text>At the end of a period of investigative leave implemented under this section, the agency shall—</text> 
<subparagraph id="H36D068954CD446098A51F69CE735EB08"><enum>(A)</enum><text>remove an employee placed on investigative leave under this section;</text></subparagraph> 
<subparagraph id="H002183A0101A40019CD4DDDB3152EFC6"><enum>(B)</enum><text>suspend such employee without pay; or</text></subparagraph> 
<subparagraph id="H7815CBF9B3C54FE782EF41DC6A7BFF58"><enum>(C)</enum><text>reinstate or restore such employee to duty.</text></subparagraph></paragraph> 
<paragraph id="H5DB6C35182FA4CF3B02385EA99E995C6" indent="up1"><enum>(4)</enum><text>The agency may extend the period of investigative leave with respect to an action under this subchapter for an additional period not to exceed 90 days.</text></paragraph></subsection> 
<subsection id="H2C238C61B6E644E78B881514A15339C8"><enum>(c)</enum><text display-inline="yes-display-inline">An employee against whom an action covered by this subchapter is proposed is entitled to, before being placed on investigative leave under this section—</text> 
<paragraph id="H6C95C515AEA54210BE32099E04743602"><enum>(1)</enum><text display-inline="yes-display-inline">at least 30 days’ advance written notice, stating specific reasons for the proposed action, unless—</text> 
<subparagraph id="H65B002FD789F44C3BEE6B2A4EC34B028"><enum>(A)</enum><text>there is reasonable cause to believe that the employee has committed a crime for which a sentence of imprisonment can be imposed; or</text></subparagraph> 
<subparagraph id="HD3E6B61BB75D4BCFB43B79658DCFEA02"><enum>(B)</enum><text display-inline="yes-display-inline">the agency determines that the employee’s conduct with respect to which an action covered by this subchapter is proposed is serious or flagrant as prescribed in regulation by the Office of Personnel Management;</text></subparagraph></paragraph> 
<paragraph id="HB114011DE2F6495D8FB4EC4A55557750"><enum>(2)</enum><text display-inline="yes-display-inline">a reasonable time, but not less than 7 days, to answer orally and in writing and to furnish affidavits and other documentary evidence in support of the answer;</text></paragraph> 
<paragraph id="H3789C1F963374ADDA96D82C51EBF8266"><enum>(3)</enum><text display-inline="yes-display-inline">be represented by an attorney or other representative; and</text></paragraph> 
<paragraph id="HF8518A184C4640BDB10B1732C3C40A98"><enum>(4)</enum><text display-inline="yes-display-inline">a written decision and specific reasons therefor at the earliest practicable date.</text></paragraph></subsection> 
<subsection id="HFC56E2F5E2B54F2394E0C07783A0774A"><enum>(d)</enum><text display-inline="yes-display-inline">An agency may provide, by regulation, for a hearing which may be in lieu of or in addition to the opportunity to answer provided under subsection (c)(2).</text></subsection> 
<subsection id="H24C302EB3F224A6DB6C3F6702023168D"><enum>(e)</enum><text>An employee against whom an action is taken under this section is entitled to appeal to the Merit Systems Protection Board under section 7701.</text></subsection> 
<subsection id="H6D4E7852FEFF4DE191648554972FF3D9"><enum>(f)</enum><text display-inline="yes-display-inline">Copies of the notice of proposed action, the answer of the employee when written, and a summary thereof when made orally, the notice of decision and reasons therefor, and any order effecting an action covered by this subchapter, together with any supporting material, shall be maintained by the agency and shall be furnished to the Merit Systems Protection Board upon its request and to the employee affected upon the employee’s request.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAE0D8AE2D3FA452AB23A2331A7108FEF"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 75 of title 5, United States Code, is amended by adding after the item relating to section 7543 the following:</text>

<paragraph id="H4B3B945856604E57AE4074EEAC81EF00"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>misappropriation of funds,</quote> after <quote>malfeasance,</quote>; and</text></paragraph> 
<paragraph id="HFE3B5967F3AF45338718D1235D920E29"><enum>(2)</enum><text>in subsection (b), by amending paragraph (1) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H15FD858C3E8449B5B4F45CC31E578E57" style="USC"> 
<paragraph id="HC8B54AF1DACF41F2A862117CB7CFAF25"><enum>(1)</enum><text display-inline="yes-display-inline">at least 30 days’ advance written notice, stating specific reasons for the proposed action, unless—</text>

<section id="H671DD6D059AB420386255BFF574DE6B4"><enum>5.</enum><header>Misappropriation of funds amendments</header> 
<subsection id="HCEF1FC2D1786477F9AC9578441F8BF2C" commented="no"><enum>(a)</enum><header>Reinstatement in the Senior Executive Service</header><text>Section 3593 of title 5, United States Code, is amended—</text> 
<paragraph id="H74863D5B9B6B49E5B860C4A9855843CA" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by inserting <quote>misappropriation of funds,</quote> after <quote>malfeasance,</quote>; and</text></paragraph> 
<paragraph id="HB2E3192EA89F467397116A92C68E3CA5" commented="no"><enum>(2)</enum><text>in subsection (b), by striking <quote>or malfeasance</quote> and inserting <quote>malfeasance, or misappropriation of funds</quote>.</text></paragraph></subsection> 
<subsection id="HEB8A0FD6935D40BDA0E32D72A2F7F14B" commented="no"><enum>(b)</enum><header>Placement in other personnel systems</header><text>Section 3594(a) of title 5, United States Code, is amended by striking <quote>or malfeasance</quote> and inserting <quote>malfeasance, or misappropriation of funds</quote>.</text></subsection></section>
