		<section id="H9E1AE73216E745C59C12D185DBAF817B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Katie Sepich Enhanced DNA Collection
			 Act of 2012</short-title></quote>.</text>
		</section><section id="H6F0A0BB453D54131BA1378EA0D77428E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text>
			<paragraph id="HD0233F09DA504D76999BE0EBA7FF92D4"><enum>(1)</enum><header>DNA arrestee
			 collection process</header><text display-inline="yes-display-inline">The term
			 <quote>DNA arrestee collection process</quote> means, with respect to a State,
			 a process under which the State provides for the collection, for purposes of
			 inclusion in the index described in section 210304(a) of the DNA Identification
			 Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14132">42
			 U.S.C. 14132(a)</external-xref>) (in this Act referred to as the
			 <quote>National DNA Index System</quote>), of DNA profiles or DNA data from the
			 following individuals who are at least 18 years of age:</text>
				<subparagraph id="HD9039F6178A248D880BD779CEE69ACC0"><enum>(A)</enum><text>Individuals who
			 are arrested for or charged with a criminal offense under State law that
			 consists of a homicide.</text>
				</subparagraph><subparagraph id="H8591F982047A429FBE68C7D7D1BAA7CF"><enum>(B)</enum><text>Individuals who
			 are arrested for or charged with a criminal offense under State law that has an
			 element involving a sexual act or sexual contact with another and that is
			 punishable by imprisonment for more than 1 year.</text>
				</subparagraph><subparagraph id="H94754F933AB34297840E49C7ADEA60EA"><enum>(C)</enum><text>Individuals who
			 are arrested for or charged with a criminal offense under State law that has an
			 element of kidnaping or abduction and that is punishable by imprisonment for
			 more than 1 year.</text>
				</subparagraph><subparagraph id="H24B8CD71A5CA4C5485D1C666B73A3BFF"><enum>(D)</enum><text>Individuals who
			 are arrested for or charged with a criminal offense under State law that
			 consists of burglary punishable by imprisonment for more than 1 year.</text>
				</subparagraph><subparagraph id="H9E23D4E2C1DD4467938EB3E4670318A0"><enum>(E)</enum><text>Individuals who
			 are arrested for or charged with a criminal offense under State law that
			 consists of aggravated assault punishable by imprisonment for more than 1
			 year.</text>
				</subparagraph></paragraph><paragraph id="H847537565EEB4E42B32D4891B057BD38"><enum>(2)</enum><header>State</header><text>The
			 term <quote>State</quote> means any State of the United States, the District of
			 Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, American Samoa,
			 Guam, and the Commonwealth of the Northern Mariana Islands.</text>
			</paragraph></section><section id="H09CEF5A9D13E4D7FA623A68E55D03FB5"><enum>3.</enum><header>Grants to States
			 to implement DNA arrestee collection processes</header>
			<subsection id="HDA566C0D7FD044E888296EA825D6A430"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General shall, subject to amounts made
			 available pursuant to section 5, carry out a grant program for the purpose of
			 assisting States with the costs associated with the implementation of DNA
			 arrestee collection processes.</text>
			</subsection><subsection id="HD29483518E7A4A70B019FE9F12F78EFE"><enum>(b)</enum><header>Applications</header>
				<paragraph id="H3F8F5CEF78964AC1AA73F2B4A7429903"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to receive a grant under this section, in
			 addition to any other requirements specified by the Attorney General, a State
			 shall submit to the Attorney General an application that demonstrates that it
			 has statutory authorization for the implementation of a DNA arrestee collection
			 process.</text>
				</paragraph><paragraph id="HE2FFE5AE4C614B64B29918198F866459"><enum>(2)</enum><header>Non-supplanting
			 funds</header><text>An application submitted under paragraph (1) by a State
			 shall include assurances that the amounts received under the grant under this
			 section shall be used to supplement, not supplant, State funds that would
			 otherwise be available for the purpose described in subsection (a).</text>
				</paragraph><paragraph id="HB0B63E7FB47B4A4F99FEA48D6CA54F1D"><enum>(3)</enum><header>Other
			 requirements</header><text>The Attorney General shall require a State seeking a
			 grant under this section to document how such State will use the grant to meet
			 expenses associated with a State’s implementation or planned implementation of
			 a DNA arrestee collection process.</text>
				</paragraph></subsection><subsection id="HF9C2434CF8F840BEB0B5A3C35CA16F0D"><enum>(c)</enum><header>Grant
			 allocation</header>
				<paragraph id="HFFFE4F4CD2A64F2894D8A4D0FE203C00"><enum>(1)</enum><header>In
			 general</header><text>The amount available to a State under this section shall
			 be based on the projected costs that will be incurred by the State to implement
			 a DNA arrestee collection process. Subject to paragraph (2), the Attorney
			 General shall retain discretion to determine the amount of each such grant
			 awarded to an eligible State.</text>
				</paragraph><paragraph id="HC97E238101DB4E40BC61515B3257E4D6"><enum>(2)</enum><header>Maximum grant
			 allocation</header><text display-inline="yes-display-inline">In the case of a
			 State seeking a grant under this section with respect to the implementation of
			 a DNA arrestee collection process, such State shall be eligible for a grant
			 under this section that is equal to no more than 100 percent of the first year
			 costs to the State of implementing such process.</text>
				</paragraph></subsection><subsection id="H1FC5E0E47307460C8317A51D6FA9A670"><enum>(d)</enum><header>Grant
			 conditions</header><text>As a condition of receiving a grant under this
			 section, a State shall have a procedure in place to—</text>
				<paragraph id="H1AA0EE4C9FCE4628BD59E19C9C957EA9"><enum>(1)</enum><text>provide written
			 notification of expungement provisions and instructions for requesting
			 expungement to all persons who submit a DNA profile or DNA data for inclusion
			 in the index;</text>
				</paragraph><paragraph id="HFF9E78424939434F88DA7A509DE60B5B"><enum>(2)</enum><text>provide the
			 eligibility criteria for expungement and instructions for requesting
			 expungement on an appropriate public Web site; and</text>
				</paragraph><paragraph id="H1A74BA960EDD4C56806CDEA1716F2950"><enum>(3)</enum><text>make a
			 determination on all expungement requests not later than 90 days after receipt
			 and provide a written response of the determination to the requesting
			 party.</text>
				</paragraph></subsection></section><section id="H774B09C62FAB4D619D318692D2B74FAB"><enum>4.</enum><header>Expungement of
			 profiles</header><text display-inline="no-display-inline">The expungement
			 requirements under section 210304(d) of the DNA Identification Act of 1994
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/14132">42 U.S.C.
			 14132(d)</external-xref>) shall apply to any DNA profile or DNA data collected
			 pursuant to this Act for purposes of inclusion in the National DNA Index
			 System.</text>
		</section><section id="H4C14552B68DA4357ADB0C8B1AC1944D8"><enum>5.</enum><header>Offset of funds
			 appropriated</header><text display-inline="no-display-inline">Any funds
			 appropriated to carry out this Act, not to exceed $10,000,000 for each of
			 fiscal years 2013 through 2015, shall be derived from amounts appropriated
			 pursuant to subsection (j) of section 2 of the DNA Analysis Backlog Elimination
			 Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135">42
			 U.S.C. 14135</external-xref>) in each such fiscal year for grants under such
			 section.</text>
		</section><section id="H734878B6BB6D4A7F81D693713C940BEB"><enum>6.</enum><header>Conforming
			 amendment to the Debbie Smith DNA backlog grant program</header><text display-inline="no-display-inline">Section 2(a) of the DNA Analysis Backlog
			 Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135">42 U.S.C. 14135(a)</external-xref>) is amended by
			 adding at the end the following new paragraph:</text>
			<quoted-block id="H4C1BC19E84214379A9DDC932327D1C29" style="OLC"><pagebreak></pagebreak>
				<paragraph id="HAAC59904B796457E83F7DA00D01FA815"><enum>(6)</enum><text>To implement a DNA
				arrestee collection process consistent with the Katie Sepich Enhanced DNA
				Collection Act of
				2012.</text>
