		<legis-type>A BILL</legis-type>
		<official-title>To authorize the Secretary of Homeland Security to
		  provide to owners of certain intellectual property rights information on, and
		  unredacted samples and images of, semiconductor chip products suspected of
		  being imported in violation of the rights of the owner of a registered mark or
		  the owner of a mask work.</official-title>

		<section id="H8F5DB79F2499413AA40406E2D2FE4562" section-type="section-one"><enum>1.</enum><header>Provision of information and
			 unredacted samples</header>
			<subsection id="H4FC88E046E824B1B958886D495DDB5BB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1905 of title
			 18, United States Code, is amended—</text>
				<paragraph id="H917D7CC14A2F480495F5FCBFB1AF1C46"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Whoever</quote> and
			 inserting <quote>(a) <header-in-text level="subsection" style="OLC">Restrictions.—</header-in-text>Whoever</quote>; and</text>
				</paragraph><paragraph id="HA7A10B583C9B4AE0AC70A1DF9317B80D"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5595379BF5764D38952B3A183CE5CB0B" style="OLC">
						<subsection id="H3DDEA1A89BD54474A06D58F2CF0B9416"><enum>(b)</enum><header>Treatment of
				semiconductor chip products</header>
							<paragraph id="H2EF7C51F01204AFA81B8FFC10B0B3912"><enum>(1)</enum><header>Semiconductor
				chip products</header><text display-inline="yes-display-inline">For purposes of
				determining whether semiconductor chip products are being imported into the
				United States in violation of section 42 of the Lanham Act or in violation of
				any of the exclusive rights of the owner of a mask work under chapter 9 of
				title 17, upon presentation the Secretary of Homeland Security (except in such
				cases as would compromise an ongoing law enforcement investigation or would
				compromise national security)—</text>
								<subparagraph id="H4C6215DD3CB8431295988EBF0AFEFC77"><enum>(A)</enum><text>may, and upon
				detention shall, share with the holder of the registered mark or the owner of
				the mask work, as the case may be, information on the semiconductor chip
				products and their packaging and labels, including unredacted photographs or
				digital images of such products, packaging, and labels; and</text>
								</subparagraph><subparagraph id="H4F5767FC7890400D94AC3655E3FC9069"><enum>(B)</enum><text display-inline="yes-display-inline">may, at any time, subject to any applicable
				bonding requirements, supply un­re­dact­ed samples of such products to such
				holder of the registered mark or owner of the mask work.</text>
								</subparagraph></paragraph><paragraph id="HA33763D785BF4257AD9ADEF74F9911F8"><enum>(2)</enum><header>Action not a
				violation</header><text>Actions by the Secretary of Homeland Security in
				accordance with paragraph (1) shall not be a violation of subsection
				(a).</text>
							</paragraph></subsection><subsection id="H4B3320428D014A818BFBC245574CECBD"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text>
							<paragraph id="H98BDE9D2F2304D87837595B843953886"><enum>(1)</enum><text>the term
				<term>Lanham Act</term> has the meaning given that term in section 2320(e) of
				this title;</text>
							</paragraph><paragraph id="HB6566F6427984BD49E27492EEEEC7B89"><enum>(2)</enum><text>the terms
				<term>mask work</term> and <term>semiconductor chip product</term> have the
				meanings given those terms in section 901 of title 17;</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H2ACD4E09B21F4639B2F3C49A48F4C946"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>registered mark</term> has
				the meaning given that term in section 45 of the Lanham Act (15 U.S.C. 1127);
				and</text>
							</paragraph><paragraph id="H42665D5867304BB9BA75CB233689D14F"><enum>(4)</enum><text>the term
				<term>unredacted</term> means without removing, revising, or otherwise
				obscuring any information or markings appearing on a product or its retail
				packaging.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="HD0DA70E8F2634C9DB23DA1DEAF47C736"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect on
			 the date of the enactment of this Act.</text>
