<section id="H27517CD2D04F42BA8A17F6696FFF555A" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Manhattan Project National Historical Park Act</short-title></quote>.</text> </section> 
<section id="HC5666D554E134DC7B188120AC6F74049"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HE2D360E8AC6C4ADD860BBDF03DBE6BC3"><enum>(1)</enum><text>the Manhattan Project was an unprecedented top-secret program implemented during World War II to produce an atomic bomb before Nazi Germany;</text> </paragraph> 
<paragraph id="H6012E42C9750442E8D1E3545EC2DE061"><enum>(2)</enum><text>a panel of experts convened by the President’s Advisory Council on Historic Preservation in 2001—</text> 
<subparagraph id="HAF571FCB9815499F8A518820CFB9FF82"><enum>(A)</enum><text>stated that <quote>the development and use of the atomic bomb during World War II has been called <quote>the single most significant event of the 20th century</quote></quote>; and</text> </subparagraph> 
<subparagraph id="H9B57376E1DE048CE9C432C58D8AE0A33"><enum>(B)</enum><text>recommended that nationally significant sites associated with the Manhattan Project be formally established as a collective unit and be administered for preservation, commemoration, and public interpretation in cooperation with the National Park Service;</text> </subparagraph></paragraph> 
<paragraph id="H3BECB6D33E7E450298DE86B8BDE4C257"><enum>(3)</enum><text>the Manhattan Project National Historical Park Study Act (Public Law 108–340; 118 Stat. 1362) directed the Secretary of the Interior, in consultation with the Secretary of Energy, to conduct a special resource study of the historically significant sites associated with the Manhattan Project to assess the national significance, suitability, and feasibility of designating one or more sites as a unit of the National Park System;</text> </paragraph> 
<paragraph id="H97A850128B154CC8B0F41CF9339E497E"><enum>(4)</enum><text>after significant public input, the National Park Service study found that <quote>including Manhattan Project-related sites in the national park system will expand and enhance the protection and preservation of such resources and provide for comprehensive interpretation and public understanding of this nationally significant story in the 20th century American history</quote>;</text> </paragraph> 
<paragraph id="HB47AEA1890B648DF9B0D0E18643BC46C"><enum>(5)</enum><text>the Department of the Interior, with the concurrence of the Department of Energy, recommended the establishment of a Manhattan Project National Historical Park comprised of resources at—</text> 
<subparagraph id="HC6150C9C06D84EA585C9211B74F5A399"><enum>(A)</enum><text>Oak Ridge, Tennessee;</text> </subparagraph> 
<subparagraph id="H68DE176F948A4A30B37417883BBB5F0E"><enum>(B)</enum><text>Los Alamos, New Mexico; and</text> </subparagraph> 
<subparagraph id="H263DA4492E524CB2B5B151A5E16E20E8"><enum>(C)</enum><text>Hanford, in the Tri-Cities area, Washington; and</text> </subparagraph></paragraph> 
<paragraph id="H4FB1F1E494EE436DAD02C8A62E282ABE"><enum>(6)</enum><text display-inline="yes-display-inline">designation of a Manhattan Project National Historical Park as a unit of the National Park System would improve the preservation of, interpretation of, and access to the nationally significant historic resources associated with the Manhattan Project for present and future generations to gain a better understanding of the Manhattan Project, including the significant, far-reaching, and complex legacy of the Manhattan Project.</text> </paragraph></section> 
<section id="H40BD111E8D074E9385E6B4EC194006F8"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> 
<paragraph id="H85788681FBED4A27A51BA20A79779980"><enum>(1)</enum><text>to preserve and protect for the benefit of present and future generations the nationally significant historic resources associated with the Manhattan Project;</text> </paragraph> 
<paragraph id="H04458E03633742709DCD5ADED2B2BC48"><enum>(2)</enum><text display-inline="yes-display-inline">to improve public understanding of the Manhattan Project and the legacy of the Manhattan Project through interpretation of the historic resources associated with the Manhattan Project;</text> </paragraph> 
<paragraph id="H62C1B9DD83AF49C98824F6745EEFDA11"><enum>(3)</enum><text display-inline="yes-display-inline">to enhance public access to the Historical Park consistent with protection of public safety, national security, and other aspects of the mission of the Department of Energy; and</text> </paragraph> 
<paragraph id="HBE477944B4BB4CE8AC36653E2188AD18"><enum>(4)</enum><text display-inline="yes-display-inline">to assist the Department of Energy, Historical Park communities, historical societies, and other interested organizations and individuals in efforts to preserve and protect the historically significant resources associated with the Manhattan Project.</text> </paragraph></section> 
<section id="HA08E5E9856F84D0092B346E9B9B8B495"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HBFDFC1E87C3C44A088610B0D941A6938"><enum>(1)</enum><header>Historical park</header><text>The term <quote>Historical Park</quote> means the Manhattan Project National Historical Park established under section 5.</text> </paragraph> 
<paragraph id="HE90F8CF751C84FEDAED1A14CD42E481D"><enum>(2)</enum><header>Manhattan project</header><text>The term <quote>Manhattan Project</quote> means the Federal program to develop an atomic bomb ending on December 31, 1946.</text> </paragraph> 
<paragraph id="HCFCB840E71D3415BA3A29FB0BD7BAA21"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text> </paragraph></section> 
<section id="H20492D755B90497EA008C821E9847CFF"><enum>5.</enum><header>Establishment of manhattan project national historical park</header> 
<subsection id="HBFCB6F028A2A4F5386E925BF19D0A042"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H627E3E33CCF64E15ADA3AC0DB929ACC0"><enum>(1)</enum><header>Date</header><text>Not later than 1 year after the date of enactment of this Act, there shall be established as a unit of the National Park System the Manhattan Project National Historical Park.</text> </paragraph> 
<paragraph id="HA11B2369609542D9803883ED9F9F6B58"><enum>(2)</enum><header>Areas included</header><text>The Historical Park shall consist of facilities and areas listed under subsection (b) as determined by the Secretary, in consultation with the Secretary of Energy. The Secretary shall include the area referred to in subsection (b)(3)(A), the B Reactor National Historic Landmark, in the Historical Park.</text> </paragraph></subsection> 
<subsection id="H44F2E30673644E1AA2AB88D6440018B6"><enum>(b)</enum><header>Eligible areas</header><text display-inline="yes-display-inline">The Historical Park may only be comprised of one or more of the following areas, or portions of the areas, and depicted in the map titled ___ and numbered ____:</text> 
<paragraph id="HC4AC11F778F44253AAD69FA472F48EE3"><enum>(1)</enum><header>Oak ridge, Tennessee</header><text>Facilities, land, or interests in land that are—</text> 
<subparagraph id="H80D6EEB4D66C4C34A0CFC6C3EB4C224E"><enum>(A)</enum><text>at Buildings 9204–3 and 9731 at the Y–12 National Security Complex;</text> </subparagraph> 
<subparagraph id="H7B618595C777466A8EB6BAF5AD2D6400"><enum>(B)</enum><text>at the X–10 Graphite Reactor at the Oak Ridge National Laboratory;</text> </subparagraph> 
<subparagraph id="H989FDE36C45B47E0807146CC6B40696F"><enum>(C)</enum><text>at the K–25 Building site at the East Tennessee Technology Park; and</text> </subparagraph> 
<subparagraph id="H4D2E1C2A7A454ECE9F87A27E3A073D86"><enum>(D)</enum><text>at the former Guest House located at 210 East Madison Road.</text> </subparagraph></paragraph> 
<paragraph id="HD0837C34A7D2467BB98D36B310ECFC96"><enum>(2)</enum><header>Los Alamos, new mexico</header><text>Facilities, land, or interests in land that are—</text> 
<subparagraph id="HB0DD2B5F6EE84F42936A380DAC8D2987"><enum>(A)</enum><text>in the Los Alamos Scientific Laboratory National Historic Landmark District, or any addition to the Landmark District proposed in the National Historic Landmark Nomination—Los Alamos Scientific Laboratory (LASL) NHL District (Working Draft of NHL Revision), Los Alamos National Laboratory document LA–UR 12–00387 (January 26, 2012);</text> </subparagraph> 
<subparagraph id="H382B773803104BDF80519B560436ED7E"><enum>(B)</enum><text>at the former East Cafeteria located at 1670 Nectar Street; and</text> </subparagraph> 
<subparagraph id="HAE74480C740B4EC58FCBD06D3F1B5D14"><enum>(C)</enum><text>at the former dormitory located at 1725 17th Street.</text> </subparagraph></paragraph> 
<paragraph id="H0360C1BD1AD948308FB8AFC86711BB7D"><enum>(3)</enum><header>Hanford, Washington</header><text>Facilities, land, or interests in land that are—</text> 
<subparagraph id="H967B84AFFAAB4DF0AF000C3B11D63031"><enum>(A)</enum><text>the B Reactor National Historic Landmark;</text> </subparagraph> 
<subparagraph id="HE5A03A1F65C44CCD88A33A7448EC55C1"><enum>(B)</enum><text>the Hanford High School in the town of Hanford and Hanford Construction Camp Historic District;</text> </subparagraph> 
<subparagraph id="H902ECC718B49408EA32BA0880ADCD565"><enum>(C)</enum><text>the White Bluffs Bank building in the White Bluffs Historic District;</text> </subparagraph> 
<subparagraph id="H1370AC35B7844902B98F67906A45672B"><enum>(D)</enum><text>the warehouse at the Bruggemann’s Agricultural Complex;</text> </subparagraph> 
<subparagraph id="HE977BFB977174434BE53DCAAFB9E1843"><enum>(E)</enum><text>the Hanford Irrigation District Pump House; and</text> </subparagraph> 
<subparagraph id="H06C6A1DACC4A457BB6B2CED2780E67FF"><enum>(F)</enum><text>the T Plant (221–T Process Building).</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" id="HF2034038DF5D453186CEE9A4D6496E9B"><enum>(c)</enum><header>Written consent of owner</header><text>No non-Federal property may be included in the Historical Park without the written consent of the owner.</text> </subsection></section> 
<section id="H13DE47AB535A450A97405321A676AA95"><enum>6.</enum><header>Agreement</header> 
<subsection id="H31E3E08B492B4506AB2FFA2BE94AC746"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary and the Secretary of Energy (acting through the Oak Ridge, Los Alamos, and Richland site offices) shall enter into an agreement governing the respective roles of the Secretary and the Secretary of Energy in administering the facilities, land, or interests in land under the administrative jurisdiction of the Department of Energy that is to be included in the Historical Park under section 5(b), including provisions for enhanced public access, management, interpretation, and historic preservation.</text> </subsection> 
<subsection id="HE2DCEABB888C48B698D0FE8AC94C26E5"><enum>(b)</enum><header>Responsibilities of the Secretary</header><text>Any agreement under subsection (a) shall provide that the Secretary shall—</text> 
<paragraph id="HB8FAD4716B5D4B82B159845540E4B218"><enum>(1)</enum><text>have decisionmaking authority for the content of historic interpretation of the Manhattan Project for purposes of administering the Historical Park; and</text> </paragraph> 
<paragraph id="H89CA01F14C22446A8637CD4353892A9B"><enum>(2)</enum><text>ensure that the agreement provides an appropriate advisory role for the National Park Service in preserving the historic resources covered by the agreement.</text> </paragraph></subsection> 
<subsection id="HC673C9A68EB443E5918A6EADE7CE684C"><enum>(c)</enum><header>Responsibilities of the secretary of energy</header><text>Any agreement under subsection (a) shall provide that the Secretary of Energy—</text> 
<paragraph id="HBD7CEAD94DBC42398D56A78A91971D76"><enum>(1)</enum><text display-inline="yes-display-inline">shall ensure that the agreement appropriately protects public safety, national security, and other aspects of the ongoing mission of the Department of Energy at the Oak Ridge Reservation, Los Alamos National Laboratory, and Hanford Site;</text> </paragraph> 
<paragraph id="H76C70DB4D0B54C8F8A32FD4FAAD6C625"><enum>(2)</enum><text>may consult with and provide historical information to the Secretary concerning the Manhattan Project;</text> </paragraph> 
<paragraph id="H00813855A57C41B6BE916354B7DDA2A5"><enum>(3)</enum><text display-inline="yes-display-inline">shall retain responsibility, in accordance with applicable law, for any environmental remediation that may be necessary in or around the facilities, land, or interests in land governed by the agreement; and</text> </paragraph> 
<paragraph id="H629D05F9B0B14868B199FA7E710554EE"><enum>(4)</enum><text>shall retain authority and legal obligations for historic preservation and general maintenance, including to ensure safe access, in connection with the Department’s Manhattan Project resources.</text> </paragraph></subsection> 
<subsection id="HA2CA2A4C32D3498DBB9DC725049F5254"><enum>(d)</enum><header>Amendments</header><text>The agreement under subsection (a) may be amended, including to add to the Historical Park facilities, land, or interests in land within the eligible areas described in section 5(b) that are under the jurisdiction of the Secretary of Energy.</text> </subsection></section> 
<section id="HCF9A820FBA58428F88BC8871A9BEA6F8"><enum>7.</enum><header>Public participation</header> 
<subsection id="H583CC225A34647CBB72274F6EC0C41D2"><enum>(a)</enum><header>In general</header><text>The Secretary shall consult with interested State, county, and local officials, organizations, and interested members of the public—</text> 
<paragraph id="H55699D75930041D28A02CD8CD58B9B0D"><enum>(1)</enum><text>before executing any agreement under section 6; and</text> </paragraph> 
<paragraph id="HCE82A39D86E54548B54C6D039A8EB266"><enum>(2)</enum><text>in the development of the general management plan under section 8(b).</text> </paragraph></subsection> 
<subsection id="H63E10D7B2BD74689BFE0EAA44E7E547C"><enum>(b)</enum><header>Notice of determination</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which an agreement under section 6 is entered into, the Secretary shall publish in the Federal Register notice of the establishment of the Historical Park, including an official boundary map.</text> </subsection> 
<subsection id="H3492213D55D546C7ABE34C76547AD865"><enum>(c)</enum><header>Availability of map</header><text>The official boundary map published under subsection (b) shall be on file and available for public inspection in the appropriate offices of the National Park Service. The map shall be updated to reflect any additions to the Historical Park from eligible areas described in section 5(b).</text> </subsection> 
<subsection id="H499AB82955FF481B8BA437094F8C3B75"><enum>(d)</enum><header>Additions</header><text>Any land, interest in land, or facility within the eligible areas described in section 5(b) that is acquired by the Secretary or included in an amendment to the agreement under section 6(d) shall be added to the Historical Park.</text> </subsection></section> 
<section id="H33F3368102AE400EBE548CDC819D850D"><enum>8.</enum><header>Administration</header> 
<subsection id="H06169026B94944CC884A82C18471359E"><enum>(a)</enum><header>In general</header><text>The Secretary shall administer the Historical Park in accordance with—</text> 
<paragraph id="H679F29D60F744B61BDCA50D367E2E83E"><enum>(1)</enum><text>this Act; and</text> </paragraph> 
<paragraph id="HE8858F8492524BC0A89731F7C6847D94"><enum>(2)</enum><text>the laws generally applicable to units of the National Park System, including—</text> 
<subparagraph id="H5E0E42EC2A27422F825CE69A6DC08E71"><enum>(A)</enum><text>the National Park System Organic Act (16 U.S.C. 1 et seq.); and</text> </subparagraph> 
<subparagraph id="H3E1CC07C4E8B4E6FAED8D6C636424609"><enum>(B)</enum><text>the Act of August 21, 1935 (16 U.S.C. 461 et seq.).</text> </subparagraph></paragraph></subsection> 
<subsection id="H66372BE4277F4E51917E3DA99BA3FAE5"><enum>(b)</enum><header>General management plan</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary, with the concurrence of the Secretary of Energy, and in consultation and collaboration with the Oak Ridge, Los Alamos and Richland Department of Energy site offices, shall complete a general management plan for the Historical Park in accordance with section 12(b) of Public Law 91–383 (commonly known as the <quote>National Park Service General Authorities Act</quote>) (16 U.S.C. 1a–7(b)).</text> </subsection> 
<subsection id="H626334C0DE924B5A95CBD74E3916A185"><enum>(c)</enum><header>Interpretive tours</header><text display-inline="yes-display-inline">The Secretary may, subject to applicable law, provide interpretive tours of historically significant Manhattan Project sites and resources in the States of Tennessee, New Mexico, and Washington that are located outside the boundary of the Historical Park.</text> </subsection> 
<subsection id="H008AFB157CD84CF39DEE4812EFC0F756"><enum>(d)</enum><header>Land acquisition</header> 
<paragraph id="HBB8178C1C9D9403C9F1A932086D3747E"><enum>(1)</enum><header>In general</header><text>The Secretary may acquire land and interests in land within the eligible areas described in section 5(b) by—</text> 
<subparagraph id="H0AE536ECFC9C492589BE98C58D77F493"><enum>(A)</enum><text>transfer of administrative jurisdiction from the Department of Energy by agreement between the Secretary and the Secretary of Energy;</text> </subparagraph> 
<subparagraph id="HFCF17801800E46A181E27F9572970BF9"><enum>(B)</enum><text>donation; or</text> </subparagraph> 
<subparagraph id="H2B34AA5E7FE347DC8E453E2C1370079B"><enum>(C)</enum><text>exchange.</text> </subparagraph></paragraph> 
<paragraph id="H1237E6CDCB654725A92F9B4FCD2F202C"><enum>(2)</enum><header>No use of condemnation</header><text>The Secretary may not acquire by condemnation any land or interest in land under this Act or for the purposes of this Act.</text> </paragraph></subsection> 
<subsection id="HA8F49C5037914F939F1C5AC4C851F37A"><enum>(e)</enum><header>Donations; cooperative agreements</header> 
<paragraph id="H98E0E537130F4523B51AE35B0C20858B"><enum>(1)</enum><header>Federal facilities</header> 
<subparagraph id="HD8FE08F1EF7F4AEABE67A563D7E12EE5"><enum>(A)</enum><header>In general</header><text>The Secretary may enter into one or more agreements with the head of a Federal agency to provide public access to, and management, interpretation, and historic preservation of, historically significant Manhattan Project resources under the jurisdiction or control of the Federal agency.</text> </subparagraph> 
<subparagraph id="HE788B75417A044EE9B21A589BC93A7DE"><enum>(B)</enum><header>Donations; cooperative agreements</header><text display-inline="yes-display-inline">The Secretary may accept donations from, and enter into cooperative agreements with, State governments, units of local government, tribal governments, organizations, or individuals to further the purpose of an interagency agreement entered into under subparagraph (A) or to provide visitor services and administrative facilities within reasonable proximity to the Historical Park.</text> </subparagraph></paragraph> 
<paragraph id="HB54E97D118B1476D88EB201392138761"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to State, local, or tribal governments, organizations, or individuals for the management, interpretation, and historic preservation of historically significant Manhattan Project resources not included within the Historical Park.</text> </paragraph> 
<paragraph id="H15813B54B8C64331B63E3E9C20CE0BAC"><enum>(3)</enum><header>Donations to department of energy</header><text>For the purposes of this Act, or for the purpose of preserving and providing access to historically significant Manhattan Project resources, the Secretary of Energy may accept, hold, administer, and use gifts, bequests, and devises (including labor and services).</text> </paragraph></subsection></section> 
<section id="H09689901A9324EBC9935CD0D1E8BEFF8"><enum>9.</enum><header>Clarification</header> 
<subsection id="HC7B3CDF25C2349AEBB2B0C6FA46BFBF1"><enum>(a)</enum><header>No buffer zone created</header><text>Nothing in this Act, the establishment of the Historical Park, or the management plan for the Historical Park shall be construed to create buffer zones outside of the Historical Park. That an activity can be seen and heard from within the Historical Park shall not preclude the conduct of that activity or use outside the Historical Park.</text> </subsection> 
<subsection id="HB0E8FD192FEC4E12B68EBD4ECB7448F1"><enum>(b)</enum><header>No cause of action</header><text>Nothing in this Act shall constitute a cause of action with respect to activities outside or adjacent to the established boundary of the Historical Park.</text> </subsection></section>
