		<official-title>To amend the Consolidated Omnibus Budget Reconciliation
		  Act of 1985 to authorize the Commissioner of U.S. Customs and Border Protection
		  to enter into reimbursable fee agreements for the provision of additional
		  services at Customs ports of entry, and for other purposes.</official-title>

		<section id="H9A262E7FE4A040AF9C8FDB24CA92DAE4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Services to Allow New Destinations for
			 Tourism Act</short-title></quote> or <quote><short-title>STAND for Tourism Act</short-title></quote>.</text>
		</section><section id="H4066BF0A0040421388D543F575D91A58"><enum>2.</enum><header>Reimbursable fee
			 agreements for provision of additional Customs services</header>
			<subsection id="H5752C804368A4F198BE5A638797284A4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 13031 of the
			 Consolidated Omnibus Budget Reconciliation Act of 1985 (19 U.S.C. 58c) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H95FF7ABC7D774B409A3999E55CC8B4FD" style="OLC">
					<subsection id="HAD0381115A824616854AA5D9FCAC2448"><enum>(l)</enum><header>Reimbursable fee
				agreements for provision of additional Customs services</header>
						<paragraph id="HB6F3EBECEE4C425DBA4F3011E292ADF1"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, and upon the
				request of any person requesting Customs services, the Commissioner may enter
				into an agreement with such person under which the person agrees to pay a fee
				to reimburse U.S. Customs and Border Protection for the provision of additional
				services and any other costs incurred by U.S. Customs and Border Protection
				relating to such services at Customs ports of entry.</text>
						</paragraph><paragraph id="H475BA7C0970940DAA19C07588D0D9EF8"><enum>(2)</enum><header>Accounts and use
				of funds</header><text>Funds collected pursuant to any agreement entered into
				under this subsection—</text>
							<subparagraph id="HC5FEA197D94343F087528301E5F00851"><enum>(A)</enum><text>shall be credited
				to accounts that may be established by the Commissioner for the provision of
				U.S. Customs and Border Protection services and remain available until expended
				for the purposes described in paragraph (1), without fiscal year limitation;
				and</text>
							</subparagraph><subparagraph id="HD925588E75914B3389E3EDAA5A60C3F8"><enum>(B)</enum><text>shall be used to
				pay any expenses incurred by U.S. Customs and Border Protection in providing
				additional Customs services and any other costs incurred by U.S. Customs and
				Border Protection relating to such services at Customs ports of entry.</text>
							</subparagraph></paragraph><paragraph id="H80B069B128D74610A14568A967C9F341"><enum>(3)</enum><header>Amount and
				payment of fees</header><text>The amount of the fee to be charged pursuant to
				an agreement entered into under this subsection shall be paid by each person
				requesting additional Customs services and shall include the salary and
				expenses of individuals employed by U.S. Customs and Border Protection to
				provide such Customs services and other costs incurred by U.S. Customs and
				Border Protection relating to such services at Customs ports of entry, such as
				temporary placement or permanent relocation of those individuals.</text>
						</paragraph><paragraph id="H07E86F15E30642C9BD2C868CBDCC96BE"><enum>(4)</enum><header>Failure to pay
				fee</header><text>Any person who, after notice and demand for payment of any
				fee charged under subsection (a) of this section, fails to pay such fee in a
				timely manner shall—</text>
							<subparagraph id="H4161269B15F3480897EC701CE17AE565"><enum>(A)</enum><text>be guilty of a
				misdemeanor, and if convicted thereof shall pay a fine that does not exceed an
				amount equal to 200 percent of such fee in addition to court costs; and</text>
							</subparagraph><subparagraph id="HBAA52E7B98114602B818766EEB55B411"><enum>(B)</enum><text>be liable for a
				penalty or liquidated damage equal to 2 times the amount of the fee in addition
				to court costs.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">Any amount
				collected pursuant to this paragraph shall be deposited into 1 or more of the
				accounts established under paragraph (2) and shall be available as described
				therein.</continuation-text></paragraph><paragraph id="H8B86F328A39E4301B59356B6E66E8506"><enum>(5)</enum><header>Provision of
				facilities and equipment</header><text>Each facility at which such Customs
				services are performed shall provide, maintain, and equip, without cost to the
				Federal Government, such facilities in accordance with U.S. Customs and Border
				Protection specifications.</text>
						</paragraph><paragraph id="H513EF172971A40BD80B2F08524D3E1CE"><enum>(6)</enum><header>Definitions</header><text>In
				this subsection—</text>
							<subparagraph id="HC715261DD5E24CB99C60ADBBAE98CFB8"><enum>(A)</enum><text>the term
				<term>Commissioner</term> means the Commissioner of U.S. Customs and Border
				Protection of the Department of Homeland Security; and</text>
							</subparagraph><subparagraph id="H8E241EF573DD4D298FA2F99916043FFB"><enum>(B)</enum><text>the term
				<term>person</term> means—</text>
								<clause id="H2D0C7B9CD6554D2595632F998C639453"><enum>(i)</enum><text>a
				natural person; or</text>
								</clause><clause commented="no" id="H01365729269744C2BC3AA9A22EC30B0B"><enum>(ii)</enum><text>a corporation,
				partnership, trust, association, or any other public or private entity,
				including any foreign government or transit authority, or any officer,
				employee, or agent
				thereof.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF0819E40C70442E3A7DAF7486D3BED61"><enum>(b)</enum><header>Conforming
			 amendment</header>
				<paragraph id="H8262522AA7B7474194E9F8D6AD4D6F79"><enum>(1)</enum><header>In
			 general</header><text>Section 13031(e)(2)(A) of the Consolidated Omnibus Budget
			 Reconciliation Act of 1985 (19 U.S.C. 58c(e)(2)(A)) is amended by adding at the
			 end before the period the following: <quote>, or any agreement entered into
			 pursuant to subsection (l) of this section</quote>.</text>
				</paragraph><paragraph id="H310861A4641A4D4799D291851CEBCEC2"><enum>(2)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 paragraph (1) shall take effect on October 1, 2012.</text>
