			 and related diseases</header>
					<subsection id="H0566F9DEA767473BB2563D593D744E34"><enum>(a)</enum><header>Findings and
			 purposes</header><text>Section 401 of the Healthy Forests Restoration Act of
			 2003 (16 U.S.C. 6551) is amended—</text>
						<paragraph id="HC47393CA1FA041B98DED363B68538573"><enum>(1)</enum><text>in subsection
			 (a)—</text>
							<subparagraph id="H2BE304454C2142128FC34C8E0556BA12"><enum>(A)</enum><text>by redesignating
			 paragraphs (3) through (12) as paragraphs (4) through (13), respectively;
			 and</text>
							</subparagraph><subparagraph id="H19D062ACEAD5461880C7FE56CE9D2994"><enum>(B)</enum><text>by inserting after
			 paragraph (2) the following:</text>
								<quoted-block display-inline="no-display-inline" id="H2759B8E7401B4197A1607560FEBEEDD4" style="OLC">
									<paragraph id="HCA32BD308FCB44E982AE223BFB055C7E"><enum>(3)</enum><text>the mountain pine
				beetle is—</text>
										<subparagraph id="H4758D64EEEB54D3B848B7E2BBE22C798"><enum>(A)</enum><text>threatening and
				ravaging forests throughout the Western region of the United States, including
				Arizona, California, Colorado, Idaho, Montana, Nevada, New Mexico, Oregon, and
				South Dakota;</text>
										</subparagraph><subparagraph id="H50E967D033814ACA9BDCB04C51D22DCF"><enum>(B)</enum><text>reaching epidemic
				populations and severely impacting over 41,000,000 acres in western forests;
				and</text>
										</subparagraph><subparagraph id="H1AC8085339BA4F7A9F3D2307BE0E1BB6"><enum>(C)</enum><text>deteriorating
				forest health in national forests and, when combined with drought, disease, and
				storm damage, is resulting in extreme fire hazards in national forests across
				the Western United States and endangering the economic stability of surrounding
				adjacent communities, ranches, and
				parks;</text>
										</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="H6DBD38C068EF4AEA9AB6915BFF22D6CE"><enum>(2)</enum><text>in subsection
			 (b)—</text>
							<subparagraph id="HFE1D25D3AAF340BF80971031ED453868"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> at the end;</text>
							</subparagraph><subparagraph id="H158CB49DE7724729B7B1047FFA9CF085"><enum>(B)</enum><text>in paragraph (3),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
							</subparagraph><subparagraph id="H4A6FB711617947DE8CC9B4235155ADD3"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

				designation of treatment areas pursuant to section
				405.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection id="HCFE4D7DC0E5C4BBDA143ED736F4F3AB4"><enum>(b)</enum><header>Designation of
			 treatment areas</header><text>Title IV of the Healthy Forests Restoration Act
			 of 2003 (16 U.S.C. 6551 et seq.) is amended—</text>
						<paragraph id="H376B7EBABFAE47F8A2A75128D7684EEF"><enum>(1)</enum><text>by redesignating
			 sections 405 and 406 (16 U.S.C. 6555, 6556) as sections 406 and 407,
			 respectively; and</text>
						</paragraph><paragraph id="H282ADC8DD3E34DA5A40010DC10804CE5"><enum>(2)</enum><text>by inserting after
			 section 404 (16 U.S.C. 6554) the following:</text>
							<quoted-block display-inline="no-display-inline" id="HC749899D868B400E9A866D1D38005B74" style="OLC">
								<section id="HDBB78BF9375E4E52A818A77908D88EE1"><enum>405.</enum><header>Designation of
				insect and disease treatment and research pilot program areas</header>
									<subsection id="HEF6FDF84F23F45D3AB229CEF60D27C6F"><enum>(a)</enum><header>Designation of
				treatment areas</header><text display-inline="yes-display-inline">Not later
				than 60 days after the date of enactment of the
				<short-title>Depleting Risk from Insect Infestation, Soil
				Erosion, and Catastrophic Fire Act of 2012</short-title>, the Secretary, in
				consultation with the Governor of each State, shall designate as part of an
				insect and disease treatment and research pilot program 1 or more subwatersheds
				(sixth-level hydrologic units, according to the System of Hydrologic Unit Codes
				of the United States Geological Survey) in at least 1 national forest in each
				State that is experiencing an insect or disease epidemic.</text>
									</subsection><subsection id="H5E0D2AA460A64C2AB72612D5DDF76A33"><enum>(b)</enum><header>Requirements</header><text>A
				subwatershed designated under subsection (a) shall be—</text>
										<paragraph id="HAB413A548B2E4B1FAEC855B8636CDE24"><enum>(1)</enum><text>experiencing
				substantially increased tree mortality due to insect or disease infestation,
				based on annual forest health surveys conducted by the Secretary;</text>
										</paragraph><paragraph id="HB04D3BC9CBCD4185B83D6682D6727435"><enum>(2)</enum><text>at risk of
				experiencing substantially increased tree mortality over the next 15 years due
				to insect or disease infestation, based on the most recent National Insect and
				Disease Risk Map published by the Forest Service; or</text>
										</paragraph><paragraph id="H6D9A67766F8F4152BFDDD7B9C0F5FC38"><enum>(3)</enum><text>in an area in
				which the risk of hazard trees poses an imminent risk to public infrastructure,
				health, or safety.</text>
										</paragraph></subsection><subsection id="HC27B2CFF778A44188A27EC0C21D7DC43"><enum>(c)</enum><header>Treatment
				areas</header>
										<paragraph id="HAD69982A288C4B34AC4E21E9EAD1BAD0"><enum>(1)</enum><header>In
				general</header><text>The Secretary may carry out priority projects on Federal
				land in the subwatersheds designated under subsection (a) to reduce the risk or
				extent of, or increase the resilience to, insect or disease infestation in the
				subwatersheds.</text>
										</paragraph><paragraph id="H9E5F401B93D54F6C8E9FFF7DB766E834"><enum>(2)</enum><header>Authority</header><text>Any
				project under paragraph (1) for which a public notice to initiate scoping is
				issued on or before September 30, 2017, may be carried out in accordance with
				subsections (b), (c), (d), and (g) of section 102, and sections, 104, 105, 106,
				and 401.</text>
										</paragraph><paragraph id="H1B6EBA8C78B44BDBBBA4127B35340B62"><enum>(3)</enum><header>Effect</header><text>Projects
				carried out under this subsection shall be considered <quote>authorized
				hazardous fuel reduction projects</quote> for purposes of the authorities
				described in paragraph (2).</text>
										</paragraph><paragraph id="H088DD10812B0426295AABDEB25D5B1B3"><enum>(4)</enum><header>Report</header><text>Not
				later than September 30, 2017, the Secretary shall issue a report that
				includes—</text>
											<subparagraph id="HED870EA1213C4BC38068211EE9C914D7"><enum>(A)</enum><text>an evaluation of
				the progress towards project goals; and</text>
											</subparagraph><subparagraph id="H05923F83DEB94D89AB36351701938B55"><enum>(B)</enum><text>recommendations
				for modifications to the projects and management treatments.</text>
											</subparagraph></paragraph></subsection><subsection id="HCF0D2F293055455184583CF92D3AFC5F"><enum>(d)</enum><header>Tree
				retention</header><text display-inline="yes-display-inline">The Secretary shall
				carry out projects under subsection (c) in a manner that maximizes the
				retention of old-growth and large trees, as appropriate for the forest type, to
				the extent that the trees promote stands that are resilient to insects and
				disease.</text>
									</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HA337EAE7AE3145FC81C28B4780E6CEAE"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Section 407 of
			 the Healthy Forests Restoration Act of 2003 (as redesignated by subsection
			 (b)(1)) is amended by striking <quote>2008</quote> and inserting
			 <quote>2017</quote>.</text>
					</subsection></section><section id="H3466745321184030BF1ADFB100A271BB" section-type="subsequent-section"><enum>102.</enum><header>Change in funding
			 source for healthy forests reserve program</header><text display-inline="no-display-inline">Section 508 of the Healthy Forests
			 Restoration Act of 2003 (16 U.S.C. 6578) is amended—</text>
					<paragraph id="HEA9C7C1019684A78AF8E01F0AB59CB18"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote><header-in-text level="subsection" style="OLC">In
			 general</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Fiscal years 2009 through
			 2012</header-in-text></quote>;</text>
					</paragraph><paragraph id="H400124657F92490E9DFD6027CEB4F2AA"><enum>(2)</enum><text>by redesignating
			 subsection (b) as subsection (d); and</text>
					</paragraph><paragraph id="H67896E5D892D4EF0967470CBD4D4DD91"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="HA37006BB4F04466C82F269EE875614A3" style="OLC">
							<subsection id="HCF1F4F515BEC4FC6AEC86788181FEC27"><enum>(b)</enum><header>Fiscal years
				2013 through 2017</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to the Secretary of Agriculture to carry out this
				section $9,750,000 for each of fiscal years 2013 through 2017.</text>
							</subsection><subsection id="H1B41E285ECB44B0B81FF75F5D5528B37"><enum>(c)</enum><header>Additional
				source of funds</header><text display-inline="yes-display-inline">In addition
				to funds appropriated pursuant to the authorization of appropriations in
				subsection (b) for a fiscal year, the Secretary may use such amount of the
				funds appropriated for that fiscal year to carry out the Soil Conservation and
				Domestic Allotment Act (16 U.S.C. 590a et seq.) as the Secretary determines
				necessary to cover the cost of technical assistance, management, and
				enforcement responsibilities for land enrolled in the healthy forests reserve
				program pursuant to subsections (a) and (b) of section
				504.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section></subtitle><subtitle id="H36A56B712BC34C129192DA86EE00D2C8"><enum>B</enum><header>Stewardship End
			 Result Contracting</header>
				<section id="HCE48947ADA4F4A7F9D8B07F7A38A5173"><enum>121.</enum><header>Stewardship end
			 result contracting projects</header>
					<subsection id="H296F79F973514FDA82FAA124818EC2C5"><enum>(a)</enum><header>In
			 general</header><text>Title VI of the Healthy Forests Restoration Act of 2003
			 (16 U.S.C. 6591) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H6B3C3E11B1F04821AC21B964D3F19987" style="OLC">
							<section id="H38C3173332084969A4540CC40DBB9FCD"><enum>602.</enum><header>Stewardship end
				result contracting projects</header>
								<subsection id="H7C390C60EA2A4FF58EBB03D9354B650D"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
									<paragraph id="H9523214EEF9E47B2A1705FD6B84E442B"><enum>(1)</enum><header>Chief</header><text>The
				term <term>Chief</term> means the Chief of the Forest Service.</text>
									</paragraph><paragraph id="H8D2AA49D843742A7B9829505ADACCD04"><enum>(2)</enum><header>Director</header><text>The
				term <term>Director</term> means the Director of the Bureau of Land
				Management.</text>
									</paragraph></subsection><subsection id="H2759DEDB9D7747118C3B1D08C69D03B9"><enum>(b)</enum><header>Projects</header><text>The
				Chief and the Director, via agreement or contract as appropriate, may enter
				into stewardship contracting projects with private persons or other public or
				private entities to perform services to achieve land management goals for the
				national forests and the public lands that meet local and rural community
				needs.</text>
								</subsection><subsection id="HBA391D24729941AA97314D885A35B288"><enum>(c)</enum><header>Land management
				goals</header><text>The land management goals of a project under subsection (b)
				may include—</text>
									<paragraph id="H1AF16E4132A04146889A842E92C46950"><enum>(1)</enum><text>road and trail
				maintenance or obliteration to restore or maintain water quality;</text>
									</paragraph><paragraph id="H33ECFD51F8AC43B1B5396B833AB19221"><enum>(2)</enum><text>soil productivity,
				habitat for wildlife and fisheries, or other resource values;</text>
									</paragraph><paragraph id="H84E4E1A3C7F84F93BF316082AE904092"><enum>(3)</enum><text>setting of
				prescribed fires to improve the composition, structure, condition, and health
				of stands or to improve wildlife habitat;</text>
									</paragraph><paragraph id="H300E37AB45C3458EB81AEC014C1DD6FC"><enum>(4)</enum><text>removing
				vegetation or other activities to promote healthy forest stands, reduce fire
				hazards, or achieve other land management objectives;</text>
									</paragraph><paragraph id="HD98BE76573DB4685B2EF91C2E6EAE1EF"><enum>(5)</enum><text>watershed
				restoration and maintenance;</text>
									</paragraph><paragraph id="H134D850931F34E7FB58E5835BD64068C"><enum>(6)</enum><text>restoration and
				maintenance of wildlife and fish; or</text>
									</paragraph><paragraph id="HBF1E7E89A763401EB5B0EDF3AF4D8DAB"><enum>(7)</enum><text>control of noxious
				and exotic weeds and reestablishing.</text>
									</paragraph></subsection><subsection id="H7947D83181FD4074AF9668E807CF9720"><enum>(d)</enum><header>Agreements or
				contracts</header>
									<paragraph id="H3A844488C3E44F8A851960A22D3825C1"><enum>(1)</enum><header>Procurement
				procedure</header><text>A source for performance of an agreement or contract
				under subsection (b) shall be selected on a best-value basis, including
				consideration of source under other public and private agreements or
				contracts.</text>
									</paragraph><paragraph id="H18E96E8514594542AF8C72249483ACE2"><enum>(2)</enum><header>Contract for
				sale of property</header><text>A contract entered into under this section may,
				at the discretion of the Secretary of Agriculture, be considered a contract for
				the sale of property under such terms as the Secretary may prescribe without
				regard to any other provision of law.</text>
									</paragraph><paragraph id="H5D32C48EA35546068D568C2187ECAD1A"><enum>(3)</enum><header>Term</header>
										<subparagraph id="H24EFE3EF1D824A1D822508C94493099C"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the Chief and the
				Director may enter into a contract under subsection (b) in accordance with
				section 3903 of title 41, United States Code.</text>
										</subparagraph><subparagraph id="HAFF9D81A24B04EE681C9A7D0DEC5809D"><enum>(B)</enum><header>Maximum</header><text>The
				period of the contract under subsection (b) may exceed 5 years but may not
				exceed 10 years.</text>
										</subparagraph></paragraph><paragraph id="HE4A63A1F238D4099A56F28DA1ADB0878"><enum>(4)</enum><header>Offsets</header>
										<subparagraph id="HAF8669B1517D46008D24FCFABF1174E7"><enum>(A)</enum><header>In
				general</header><text>The Chief and the Director may apply the value of timber
				or other forest products removed as an offset against the cost of services
				received under the agreement or contract described in subsection (b).</text>
										</subparagraph><subparagraph id="H0C3DC500DC0340BF82547677E0F164A2"><enum>(B)</enum><header>Methods of
				appraisal</header><text>The value of timber or other forest products used as an
				offset under subparagraph (A)—</text>
											<clause id="H52060F99476445868DFA65AA1A30DD79"><enum>(i)</enum><text>shall be
				determined using appropriate methods of appraisal commensurate with the
				quantity of products to be removed; and</text>
											</clause><clause id="H3958D4359FDA4E529FAC87C13840D574"><enum>(ii)</enum><text>may—</text>
												<subclause id="H405F923C724B40058CC52B242D5DD140"><enum>(I)</enum><text>be determined
				using a unit of measure appropriate to the contracts; and</text>
												</subclause><subclause id="HD500D9427F5F4FEE9568FBFEC868CDA5"><enum>(II)</enum><text>include valuing
				products on a per-acre basis.</text>
												</subclause></clause></subparagraph></paragraph><paragraph id="H4BA4CB37DAF24F7FB9A088D2A410209B"><enum>(5)</enum><header>Relation to
				other laws</header><text>Notwithstanding subsections (d) and (g) of section 14
				of the National Forest Management Act of 1976 (16 U.S.C. 472a), the Chief may
				enter into an agreement or contract under subsection (b).</text>
									</paragraph><paragraph id="HA4BD269E95B546879774C2898F8E28AE"><enum>(6)</enum><header>Contracting
				officer</header><text>Notwithstanding any other provision of law, the Secretary
				or the Secretary of the Interior may determine the appropriate contracting
				officer to enter into and administer an agreement or contract under subsection
				(b).</text>
									</paragraph></subsection><subsection id="H689ED020D49B4BB89CD8AAD76C8E4FB2"><enum>(e)</enum><header>Receipts</header>
									<paragraph id="H270C76D064E24A938B9DE004E822EEA2"><enum>(1)</enum><header>In
				general</header><text>The Chief and the Director may collect monies from an
				agreement or contract under subsection (b) if the collection is a secondary
				objective of negotiating the contract that will best achieve the purposes of
				this section.</text>
									</paragraph><paragraph id="H1AA74E0B995640968AE5206BD5FFCD48"><enum>(2)</enum><header>Use</header><text>Monies
				from an agreement or contract under subsection (b)—</text>
										<subparagraph id="H52E44ACF32DB4401B2FCDF5AB3544811"><enum>(A)</enum><text>may be retained by
				the Chief and the Director; and</text>
										</subparagraph><subparagraph id="HB6C71BF530984C6FAAB666D4DCA2B0E3"><enum>(B)</enum><text>shall be available
				for expenditure without further appropriation at the project site from which
				the monies are collected or at another project site.</text>
										</subparagraph></paragraph><paragraph id="H82CFA098334F4BAF8BA19A93FCF06B77"><enum>(3)</enum><header>Relation to
				other laws</header>
										<subparagraph id="HDA5798E63F87404694BD3DEAAAF85D48"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, the value of
				services received by the Chief or the Director under a stewardship contract
				project conducted under this section, and any payments made or resources
				provided by the contractor, Chief, or Director shall not be considered monies
				received from the National Forest System or the public lands.</text>
										</subparagraph><subparagraph id="HA86137B07B9042AD9015750D2387972F"><enum>(B)</enum><header>Knutson-Vanderberg
				Act</header><text>The Act of June 9, 1930 (commonly known as the
				<quote>Knutson-Vanderberg Act</quote>) (16 U.S.C. 576 et seq.) shall not apply
				to any agreement or contract under subsection (b).</text>
										</subparagraph></paragraph></subsection><subsection id="HF4787FD883D94EF2974014980125ED83"><enum>(f)</enum><header>Costs of
				removal</header><text>Notwithstanding the fact that a contractor did not
				harvest the timber, the Chief may collect deposits from a contractor covering
				the costs of removal of timber or other forest products under—</text>
									<paragraph id="H6FBBEF22B4444CEB89350807E1715E08"><enum>(1)</enum><text>the Act of August
				11, 1916 (16 U.S.C. 490); and</text>
									</paragraph><paragraph id="H56DEE7B152C241689F807826BB58258D"><enum>(2)</enum><text>the Act of June
				30, 1914 (16 U.S.C. 498).</text>
									</paragraph></subsection><subsection id="HFCDBE23D54524CB3976DB8E7FF1693AB"><enum>(g)</enum><header>Performance and
				payment guarantees</header>
									<paragraph id="HCC4DF8B3AAF64C698DC4587CDA685A29"><enum>(1)</enum><header>In
				general</header><text>The Chief and the Director may require performance and
				payment bonds under sections 28.103–2 and 28.103–3 of the Federal Acquisition
				Regulation, in an amount that the contracting officer considers sufficient to
				protect the investment in receipts by the Federal Government generated by the
				contractor from the estimated value of the forest products to be removed under
				a contract under subsection (b).</text>
									</paragraph><paragraph id="H4F163F350AFF4565880FA6D09B780239"><enum>(2)</enum><header>Excess offset
				value</header><text>If the offset value of the forest products exceeds the
				value of the resource improvement treatments, the Chief and the Director
				may—</text>
										<subparagraph id="HF95FD4AB52FB4759813D73A0BC1CA745"><enum>(A)</enum><text>collect any
				residual receipts under the Act of June 9, 1930 (commonly known as the
				<quote>Knutson-Vanderberg Act</quote>) (16 U.S.C. 576 et seq.); and</text>
										</subparagraph><subparagraph id="H2891A71D949348E78AF17DB68634A954"><enum>(B)</enum><text>apply the excess
				to other authorized stewardship projects.</text>
										</subparagraph></paragraph></subsection><subsection id="HB795D9A2F010449BA91EF20682556ED1"><enum>(h)</enum><header>Monitoring and
				evaluation</header>
									<paragraph id="HD2A0E904CDE84ECC9ECD2E82E29AF2DC"><enum>(1)</enum><header>In
				general</header><text>The Chief and the Director shall establish a multiparty
				monitoring and evaluation process that accesses the stewardship contracting
				projects conducted under this section.</text>
									</paragraph><paragraph id="HED5B78704E364AB59E6B8F2E1E44A98A"><enum>(2)</enum><header>Participants</header><text>Other
				than the Chief and Director, participants in the process described in paragraph
				(1) may include—</text>
										<subparagraph id="HAE93A37AD2444112BE82E3CC36AD8038"><enum>(A)</enum><text>any cooperating
				governmental agencies, including tribal governments; and</text>
										</subparagraph><subparagraph id="H9FB050AACE5B4B3BBCB146D3216AE4B4"><enum>(B)</enum><text>any other
				interested groups or individuals.</text>
										</subparagraph></paragraph></subsection><subsection id="H0D4DA4B5BCA64F809749F547D68D66D4"><enum>(i)</enum><header>Reporting</header><text>Not
				later than 1 year after the date of enactment of this section, and annually
				thereafter, the Chief and the Director shall report to the Committee on
				Agriculture, Nutrition, and Forestry of the Senate and the Committee on
				Agriculture of the House of Representatives on—</text>
									<paragraph id="HC9D71EDF3C334C35B520F7C258794616"><enum>(1)</enum><text>the status of
				development, execution, and administration of agreements or contracts under
				subsection (b);</text>
									</paragraph><paragraph id="H710C779B9B6447B1AB1DF38F29A41158"><enum>(2)</enum><text>the specific
				accomplishments that have resulted; and</text>
									</paragraph><paragraph id="H982A258896F84F118E0904F3695E0A0F"><enum>(3)</enum><text>the role of local
				communities in the development of agreements or contract
				plans.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H5D188C6DEE72417C80CE80A9893C7443"><enum>(b)</enum><header>Repeal of
			 superseded program</header><text>Section 347 of the Department of the Interior
			 and Related Agencies Appropriations Act, 1999 (16 U.S.C. 2104 note; Public Law
			 105–277) is repealed.</text>
					</subsection></section></subtitle><subtitle id="H0F70636B101D4A53B7C9503789EC0E25"><enum>C</enum><header>Good Neighbor
			 Authority</header>
				<section id="H3381F731B6C249DEB951DEA580199F26"><enum>141.</enum><header>Good neighbor
			 authority</header>
					<subsection id="H2C61C6E404E6446D8EA34E254233664F"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="H7B4DA8310B2C471FBB5F1469BA0081BC"><enum>(1)</enum><header>Authorized
			 restoration services</header><text>The term <term>authorized restoration
			 services</term> means similar and complementary forest, rangeland, and
			 watershed restoration services carried out on adjacent Federal land and
			 non-Federal land by either the Secretary or a Governor pursuant to—</text>
							<subparagraph id="HB663221DC58C46019C65DD5D6433EDE0"><enum>(A)</enum><text>a good neighbor
			 agreement; and</text>
							</subparagraph><subparagraph id="H955EE5D254CD4786A9C999B516622DB8"><enum>(B)</enum><text>a cooperative
			 agreement or contract entered into under subsection (c).</text>
							</subparagraph></paragraph><paragraph id="H9B9EB63E1CD2477F9DCDBD9D28793924"><enum>(2)</enum><header>Federal
			 land</header>
							<subparagraph id="H220B74FD48A44C14A89A37B97F430B09"><enum>(A)</enum><header>In
			 general</header><text>The term <term>Federal land</term> means the following
			 land in a State located in whole or in part west of the 100th meridian:</text>
								<clause id="H6DD75BDEBC1D47099F39542CB0FD7BAC"><enum>(i)</enum><text>National Forest
			 System land.</text>
								</clause><clause id="H541DD30601F84B0597729E99C82BB5D9"><enum>(ii)</enum><text>Public lands (as
			 defined in section 103 of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1702)).</text>
								</clause></subparagraph><subparagraph id="HC87AE7953E1448D5987F5EABAA267CAD"><enum>(B)</enum><header>Exclusions</header><text>The
			 term <term>Federal land</term> does not include—</text>
								<clause id="H84D28E5EE60745EAB56294A32F76F86A"><enum>(i)</enum><text>a
			 component of the National Wilderness Preservation System, National Wild and
			 Scenic Rivers System, National Trails System, or National Landscape
			 Conservation System;</text>
								</clause><clause id="H1A177658DEFC498BBA824710FFF325C3"><enum>(ii)</enum><text>a
			 National Monument, National Preserve, National Scenic Area, or National
			 Recreation Area; or</text>
								</clause><clause id="HA0B5264F78A843B4B8CD7A0A026947EA"><enum>(iii)</enum><text>a
			 wilderness study area.</text>
								</clause></subparagraph></paragraph><paragraph id="HE55D9B42DFDC41C382219BAB034B585E"><enum>(3)</enum><header>Forest,
			 rangeland, and watershed restoration services</header><text>The term
			 <term>forest, rangeland, and watershed restoration services</term>
			 means—</text>
							<subparagraph id="H54F85D7FD07F4623881EC1C8C70629C2"><enum>(A)</enum><text>activities to
			 treat insect- and disease-infected trees;</text>
							</subparagraph><subparagraph id="HDB70E8D0440C4F87B372C06E6BD70345"><enum>(B)</enum><text>activities to
			 reduce hazardous fuels;</text>
							</subparagraph><subparagraph id="HCFCC06FA8C83488DB980BF3E4498DC7B"><enum>(C)</enum><text>activities to
			 maintain roads and trails that cross a boundary between Federal land and
			 non-Federal land; and</text>
							</subparagraph><subparagraph id="H39FD1CA4B65545618B9016BA1C138C36"><enum>(D)</enum><text>any other
			 activities to restore or improve forest, rangeland, or watershed health,
			 including fish and wildlife habitat.</text>
							</subparagraph></paragraph><paragraph id="H7C6C5B7B93874C49A163D4E2DF760F6E"><enum>(4)</enum><header> Good neighbor
			 agreement</header><text>The term <term>good neighbor agreement</term>
			 means—</text>
							<subparagraph id="HFBF0CA1162AD472D9241B8E733A24490"><enum>(A)</enum><text>a nonfunding
			 master cooperative agreement entered into between the Secretary and a Governor
			 under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/63">chapter 63</external-xref> of title 31,
			 United States Code; or</text>
							</subparagraph><subparagraph id="H6D315F6EF2E14646B82140647B50FB0E"><enum>(B)</enum><text>a memorandum of
			 agreement or understanding entered into between the Secretary and a
			 Governor.</text>
							</subparagraph></paragraph><paragraph id="H533C86E0172A4D1F9AC963EADDC956E8"><enum>(5)</enum><header>Governor</header><text>The
			 term <term>Governor</term> means the Governor or any other appropriate
			 executive official of an affected State.</text>
						</paragraph><paragraph id="H5A89FF35BAAF4CCF9CDEAA78BD59AD49"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means—</text>
							<subparagraph id="HF65463418DBB4DE787DCC67EDC3A1839"><enum>(A)</enum><text>the Secretary of
			 Agriculture, with respect to National Forest System land; and</text>
							</subparagraph><subparagraph id="H362897782CB14035B912BB2BFBF51E27"><enum>(B)</enum><text>the Secretary of
			 the Interior, with respect to Bureau of Land Management land.</text>
							</subparagraph></paragraph></subsection><subsection id="H1343A1BD6A3D4C7DB4296AD2FF2B8922"><enum>(b)</enum><header>Good neighbor
			 agreements</header>
						<paragraph id="H5DEAE7ACB2294C9DA6552818A69BDDD3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may enter into a good neighbor agreement
			 with a Governor to coordinate the procurement and implementation of authorized
			 restoration services in accordance with this section.</text>
						</paragraph><paragraph id="H40079580150146B7B6F69AAD6785161C"><enum>(2)</enum><header>Public notice
			 and comment</header><text>The Secretary shall make each good neighbor agreement
			 available to the public.</text>
						</paragraph></subsection><subsection id="H16A920CE2FA749BA97E1A062B882675D"><enum>(c)</enum><header>Task orders,
			 contracts, and cooperative agreements</header>
						<paragraph id="H70A8D27622E3453A8CD0CECFD3A8C8C3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may issue a task order for, or enter into a
			 contract (including a sole source contract) or cooperative agreement with, a
			 Governor to carry out authorized restoration services.</text>
						</paragraph><paragraph id="HF478B2EEB2E74B50B73B01B3671805BF"><enum>(2)</enum><header>Requirements</header><text>Each
			 task order, contract, or cooperative agreement entered into under paragraph (1)
			 shall be executed in accordance with—</text>
							<subparagraph id="H99E1214D254D4645B45FF14D255BB86F"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/63">chapter
			 63</external-xref> of title 31, United States Code; and</text>
							</subparagraph><subparagraph id="HAF46E573087F40F1A758347EE111B9F6"><enum>(B)</enum><text>the applicable
			 good neighbor agreement.</text>
							</subparagraph></paragraph></subsection><subsection id="HFABA04056C394FC8BF9E2A33E9AFC5B3"><enum>(d)</enum><header>Contract and
			 subcontract requirements</header>
						<paragraph id="H430E4A9DFF2A41589705FBC4F6A21177"><enum>(1)</enum><header>Requirements for
			 services on Federal land</header>
							<subparagraph id="H98B9DE58ADE94CCC9CCD80C56EA531FF"><enum>(A)</enum><header>In
			 general</header><text>For authorized restoration services carried out on
			 Federal land under subsection (c), each contract and subcontract issued under
			 the authority of a Governor shall include the provisions described in
			 subparagraph (B) that would have been included in the contract had the
			 Secretary been a party to the contract.</text>
							</subparagraph><subparagraph id="H1738E5D015D840478D30259A1289474E"><enum>(B)</enum><header>Applicable
			 provisions</header><text>The provisions referred to in subparagraph (A) are
			 provisions for—</text>
								<clause id="H520F4F593E5B475F95A0CBBDE079DC2D"><enum>(i)</enum><text>wages and benefits
			 for workers employed by contractors and subcontractors required by—</text>
									<subclause id="H70B7F6B2443048EFBD447131C508A176"><enum>(I)</enum><text>subchapter IV of
			 chapter 31 of part A of subtitle II of title 40, United States Code; and</text>
									</subclause><subclause id="H71982C1656A14A228E31C4DF02702DBB"><enum>(II)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/6">chapter
			 6</external-xref> of title 41, United States Code;</text>
									</subclause></clause><clause id="H994D5EAED5AA4E4A8AFE5EE9BCEA63AC"><enum>(ii)</enum><text>nondiscrimination;
			 and</text>
								</clause><clause id="H3E03975BB03D4FF286E2D3936E0EF8FE"><enum>(iii)</enum><text>worker safety
			 and protection.</text>
								</clause></subparagraph></paragraph><paragraph id="H3971AFA480BE4DDF87D80E363A97FC86"><enum>(2)</enum><header> Requirements
			 for small businesses</header><text>Each contract and subcontract for authorized
			 restoration services under subsection (c) shall comply with provisions for
			 small business assistance and protection that would have been applicable to the
			 contract had the Secretary been a party to the contract.</text>
						</paragraph><paragraph id="H39FAA85FA73C44D483F888CB8FBC218B"><enum>(3)</enum><header>Liability</header><text>The
			 Secretary shall include provisions in each good neighbor agreement, contract,
			 or cooperative agreement, as appropriate, governing the potential liability of
			 the State and the Secretary for actions carried out under this Act.</text>
						</paragraph></subsection><subsection id="H93D34D49A0BB4AF3A3351BCE61E2FF96"><enum>(e)</enum><header>Termination of
			 effectiveness</header>
						<paragraph id="HFF66C5DF98414ACA9E48F83303A42592"><enum>(1)</enum><header>In
			 general</header><text>The authority of the Secretary to enter into cooperative
			 agreements and contracts under this section terminates on September 30,
			 2019.</text>
						</paragraph><paragraph id="H8CB94F0BA63F4154A1380F40FF8A2EF5"><enum>(2)</enum><header>Contract
			 date</header><text>The termination date of a cooperative agreement or contract
			 entered into under this section shall not extend beyond September 30,
			 2020.</text>
						</paragraph><paragraph id="H63A7CF67C6B349F0BC1242EB914620F2"><enum>(3)</enum><header>Consolidated
			 authority</header>
							<subparagraph id="H6187EC253BDA4046A6B52CEF50B36275"><enum>(A)</enum><header>Federal and
			 State cooperative watershed restoration and protection in
			 Colorado</header><text>Section 331 of the Department of the Interior and
			 Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/291">Public Law
			 106–291</external-xref>; 114 Stat. 996) is repealed.</text>
							</subparagraph><subparagraph id="HAA3563E3F2D54EB1BD3517D845414A4F"><enum>(B)</enum><header>Federal and
			 State cooperative forest, rangeland, and watershed restoration in
			 Utah</header><text>Section 337 of the Department of the Interior and Related
			 Agencies Appropriations Act, 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref>; 118 Stat. 3102)
			 is repealed.</text>
							</subparagraph></paragraph><paragraph id="H7EF5A14B761744058BED8735C60B6CEA"><enum>(4)</enum><header>Existing
			 contracts</header><text>Nothing in the amendments made by this section affects
			 contracts in effect on the day before the date of enactment of this Act.</text>
						</paragraph></subsection></section></subtitle></title><title id="HD2EF06F937CA43BDAAB34BB3B43CACB8"><enum>II</enum><header>Post
			 Fire Rehabilitation</header>
			<section id="H8B841FF70D8D4604A766A58AEC9C6A12"><enum>201.</enum><header>Emergency
			 watershed protection program</header><text display-inline="no-display-inline">Section 403 of the Agricultural Credit Act
			 of 1978 (16 U.S.C. 2203) is amended by adding at the end the following new
			 sentence: <quote>In evaluating landowner and land user applications for
			 assistance under this section, the Secretary shall give priority consideration
			 to applications submitted by landowners and land users for runoff retardation
			 and soil-erosion preventive measures needed to remediate the effects of
			 catastrophic wildfire on Federal land that is the source of drinking water for
			 the landowners and land users.</quote>.</text>
