		<official-title>To promote coastal jobs creation, promote sustainable
		  fisheries and fishing communities, revitalize waterfronts, and for other
		  purposes.</official-title>

		<section id="H5F988000B4624E7980913877FA5D34F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Coastal Jobs Creation Act of
			 2011</short-title></quote>.</text>
		</section><section id="HB4854C74C17646C2A41F40E8D2670633"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to provide
			 employment opportunities for coastal communities by increasing support
			 for—</text>
			<paragraph id="H64D2AC98C0514C62991118BFA8563765"><enum>(1)</enum><text>cooperative
			 research and monitoring;</text>
			</paragraph><paragraph id="H0DE9DBCBA8BA4396A728AC2F30EB2083"><enum>(2)</enum><text>the revitalization
			 of coastal infrastructure;</text>
			</paragraph><paragraph id="H02EF48A4E68A4DE786F37C8F96F88EAA"><enum>(3)</enum><text display-inline="yes-display-inline">recreational fishing registry
			 programs;</text>
			</paragraph><paragraph id="H5922FE24EA214F82A4732B1272F2C8B6"><enum>(4)</enum><text>marine debris
			 removal; and</text>
			</paragraph><paragraph id="HF3CABDD48CF4497F842BDAD5AF8E5036"><enum>(5)</enum><text>restoration of
			 coastal resources.</text>
			</paragraph></section><section id="H241C73AC2D034705B0C25C4B81567883"><enum>3.</enum><header>Coastal jobs
			 creation grant program</header>
			<subsection id="HB492D116E11849AEA349819A93A49C95"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Commerce (in this Act
			 referred to as the <quote>Secretary</quote>) shall use funds made available
			 under this Act to implement a Coastal Jobs Creation Grant Program using the
			 authorities listed in subsection (b). The Secretary shall expend such funds as
			 quickly as possible consistent with prudent management.</text>
			</subsection><subsection id="HBDECFF0C241E42B08ED5FEFEA62586E4"><enum>(b)</enum><header>Authorities</header><text>The
			 authorities referred to in subsection (a) are authorities under the following
			 laws:</text>
				<paragraph id="HCED21B72706A4236B1A2F2B74180B30E"><enum>(1)</enum><text>Section 306A of
			 the Coastal Zone Management Act of 1972 (16 U.S.C. 1455a).</text>
				</paragraph><paragraph id="HDDA75233B0D743219F5CF65977BBFDCC"><enum>(2)</enum><text>Section 315(e) of
			 the Coastal Zone Management Act (16 U.S.C. 1461(e)).</text>
				</paragraph><paragraph id="H2A5FF57083374527A1B5D6F9FC36F151"><enum>(3)</enum><text>Section 204 of the
			 Coral Reef Conservation Act (16 U.S.C. 6403).</text>
				</paragraph><paragraph id="HB338D100FF4847139625DE526C1B1F2D"><enum>(4)</enum><text>Section 12304 of
			 the Integrated Coastal and Ocean Observation System Act of 2009 (33 U.S.C.
			 3603).</text>
				</paragraph><paragraph id="H15EC1C610A1B40989D613C6EEA6B8F40"><enum>(5)</enum><text>Section 318 of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C.
			 1867).</text>
				</paragraph><paragraph id="H32EAEEA57096478F891364529E266DC7"><enum>(6)</enum><text display-inline="yes-display-inline">Section 401(g) of the Magnuson-Stevens
			 Fishery Conservation and Management Act (16 U.S.C. 1881(g)).</text>
				</paragraph><paragraph id="H95AC480642104DB38A8E5FEA7F68E217"><enum>(7)</enum><text>Section 3 of the
			 Marine Debris Research, Prevention, and Reduction Act (33 U.S.C. 1952).</text>
				</paragraph><paragraph id="HC0C54C63F20440E1BCDC38AF7B098119"><enum>(8)</enum><text>Section 408 of the
			 Marine Mammal Protection Act of 1972 (16 U.S.C. 1421f–1).</text>
				</paragraph><paragraph id="HD0EE460C0CF34865A59973C4DC85C59E"><enum>(9)</enum><text>Section 311 of the
			 National Marine Sanctuaries Act (16 U.S.C. 1442).</text>
				</paragraph><paragraph id="HAD292E52FFF647DE83959EA84EA7804F"><enum>(10)</enum><text>Section 205 of
			 the National Sea Grant College Program Act (33 U.S.C. 1124).</text>
				</paragraph></subsection><subsection id="H57D2E9909B1F44DB966118041919C4A1"><enum>(c)</enum><header>Activities</header><text>Activities
			 funded under the Coastal Jobs Creation Grant Program shall include the
			 following:</text>
				<paragraph id="H5867335EBF78417BADC81DBB1D38EB8A"><enum>(1)</enum><text>Cooperative
			 research to collect and compile economic and social data related to
			 recreational and commercial fisheries management.</text>
				</paragraph><paragraph id="H9B718EF693D54EE6A0510113FAA1EDB8"><enum>(2)</enum><text>Cooperative
			 research to identify habitat areas of particular concern and for habitat
			 restoration and conservation.</text>
				</paragraph><paragraph id="H3EFBD0E25EA74877833BA991CDD987AD"><enum>(3)</enum><text>Improving the
			 quality and accuracy of information generated by the Marine Recreational
			 Fishery Statistics Survey.</text>
				</paragraph><paragraph id="H378DEF524DF94A79A8AD4DD153D12CB8"><enum>(4)</enum><text display-inline="yes-display-inline">Establishment and implementation of State
			 recreational fishing registry programs.</text>
				</paragraph><paragraph id="H99987FC08977452C9FE1FEC25B85F0EE"><enum>(5)</enum><text>Training and
			 deploying observers authorized or required under the Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1801 et seq.).</text>
				</paragraph><paragraph id="HE586B901BF8B4B2EAC00CC9257BEF437"><enum>(6)</enum><text display-inline="yes-display-inline">Preservation or restoration of coastal
			 resources identified for their conservation, recreational, ecological,
			 historic, or aesthetic values.</text>
				</paragraph><paragraph id="H832F2E105E66443F99774F8851ED2B06"><enum>(7)</enum><text>Redevelopment of
			 deteriorating and underutilized working waterfronts and ports.</text>
				</paragraph><paragraph id="H7982A593B92B41EA89FD7064FE46E5AE"><enum>(8)</enum><text>Research and
			 monitoring within the National Estuarine Research Reserve System, the National
			 Marine Sanctuary System, and coral reef ecosystems, and under the National Sea
			 Grant College Program.</text>
				</paragraph><paragraph id="HF5F76189A8FC4638B79CBF96FD944F17"><enum>(9)</enum><text>Implementation of
			 local strategies developed by State or Federal agencies to conserve coral reef
			 ecosystems.</text>
				</paragraph><paragraph id="H770344FD735743D8A02376B08DD982E8"><enum>(10)</enum><text>Research to
			 develop, test, and deploy innovations and improvements in coastal and ocean
			 observation technologies.</text>
				</paragraph><paragraph id="HCD1C1E09B1EA4A3C8E13641D1B92E1D6"><enum>(11)</enum><text>Cooperative
			 research to collect data to improve, supplement, or enhance fishery and marine
			 mammal stock assessments.</text>
				</paragraph><paragraph id="H15BA097AE82B49F8B90D4C2A6898556E"><enum>(12)</enum><text>Cooperative
			 research to assess the amount and type of bycatch and to engineer gear types
			 designed to reduce bycatch.</text>
				</paragraph><paragraph id="H3DDA78558BD54A0BB0A71BE4269F7B7F"><enum>(13)</enum><text>Reducing and
			 preventing the occurrence and adverse impacts of marine debris on the marine
			 environment and navigation safety.</text>
				</paragraph></subsection><subsection id="H16417540F6FA47D187A9C427BFB78715"><enum>(d)</enum><header>Funding
			 criteria</header><text>The Secretary may not make funds available under this
			 Act for a proposed project unless the project, to the maximum extent
			 practicable—</text>
				<paragraph id="H140767041F434CBF828A94D28D1E19E1"><enum>(1)</enum><text display-inline="yes-display-inline">provides the greatest employment
			 opportunities for coastal communities and benefits commercial and recreational
			 fishing industries;</text>
				</paragraph><paragraph id="H77D7B65BF9714AE9B90C5DF660D08483"><enum>(2)</enum><text>replicates or
			 builds upon a successful local, State, Federal, or tribal project;</text>
				</paragraph><paragraph id="H8C5AB2BB67C947BE89D9583419B93219"><enum>(3)</enum><text>utilizes existing
			 fishing community infrastructure, including idled fishing vessels;</text>
				</paragraph><paragraph id="H606A6D5B58F942F39172395DA43A0D67"><enum>(4)</enum><text>supports research
			 and monitoring that improves science-based management decisions; or</text>
				</paragraph><paragraph id="H0F9CE18733E64C018134DEECBC92C3AA"><enum>(5)</enum><text>contributes to
			 restoring, protecting, or preserving coastal and ocean ecosystems.</text>
				</paragraph></subsection><subsection id="H861AA49623DB45ED89ACF686F1630CB5"><enum>(e)</enum><header>Guidelines</header><text>Within
			 30 days after the date of enactment of this Act, the Secretary shall develop
			 guidelines necessary to implement the Coastal Jobs Creation Grant
			 Program.</text>
			</subsection></section><section id="H3F59AF1EECCB42D7A7E2331077946280"><enum>4.</enum><header>Amendment of
			 Magnuson-Stevens Fishery Conservation and Management Act</header><text display-inline="no-display-inline">Section 401(g) of Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1881(g)) is amended by redesignating
			 paragraph (4) as paragraph (5), and by inserting after paragraph (3) the
			 following new paragraph:</text>
			<quoted-block id="HE73F50A59BF54A9387FEA8171233AB2B" style="OLC">
				<paragraph id="H472DFC765C804FBC80A72C59E4385581"><enum>(4)</enum><header>Funding</header><text>The
				Secretary, subject to the availability of appropriations, shall enter into
				contracts with, or provide grants to, States for the purpose of establishing
				and implementing a registry program to meet the requirements for exemption
				under paragraph
				(2).</text>

		</section><section id="H09A63802C3EC4601B747102E234A973A"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">To carry out
			 the Coastal Jobs Creation Grant Program there is authorized to be appropriated
			 to the Secretary of Commerce $80,000,000 for each of fiscal years 2012 through
			 2016, of which no more than 5 percent may be used each fiscal year for
			 administrative expenses of such program.</text>
