		<official-title>To amend section 1120A of the Elementary and Secondary
		  Education Act of 1965 to modify the comparability of services
		  requirements.</official-title>

		<section id="H5F75D06A50794D178ABB480A5AB2E9FD" section-type="section-one"><enum>1.</enum><header>Comparability of
			 services</header><text display-inline="no-display-inline">Section 1120A of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6321) is
			 amended—</text>
			<paragraph id="H8D629B8F03444BEE8F9822D76650753B"><enum>(1)</enum><text>in subsection (a),
			 by striking “involved”; and</text>
			</paragraph><paragraph id="H139B79E5E2DE4B1C932292659C8B51B2"><enum>(2)</enum><text>by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC5F4FF35779E4BB8B204C2D9D29DAA3D" style="OLC">
					<subsection id="H7D6DB1B14E80493185829FD9E16C84CA"><enum>(c)</enum><header>Comparability</header>
						<paragraph id="H9C8B37EB66954F51B8AA7A3D34222567"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="H879F05BAC2F048F2A6B4D6C2C17990CB"><enum>(A)</enum><header>Comparability</header><text display-inline="yes-display-inline">Beginning for the 2015–2016 school year, a
				local educational agency may receive funds under this part only if the local
				educational agency demonstrates to the State educational agency that the
				combined State and local per-pupil expenditures (including actual personnel and
				actual non-personnel expenditures) in each school served under this part, in
				the most recent year for which such data were available, are not less than the
				average combined State and local per-pupil expenditures (including actual
				personnel and actual non-personnel expenditures) for those schools that are not
				served under this part.</text>
							</subparagraph><subparagraph id="H460AB17E3C4C473D8FED7B5E4A85864D"><enum>(B)</enum><header>Alternative
				comparability</header><text display-inline="yes-display-inline">If the local
				educational agency is serving all of the schools under its jurisdiction under
				this part, the agency shall demonstrate to the State educational agency that
				the average combined State and local per-pupil expenditures (including actual
				personnel and actual non-personnel expenditures) for its high-poverty schools,
				in the most recent year for which such data are available, were not less than
				the average combined State and local per-pupil expenditures (including actual
				personnel and actual non-personnel expenditures) for its low-poverty
				schools.</text>
							</subparagraph><subparagraph id="H041497885E5E4BA6B32015D753D6591E"><enum>(C)</enum><header>Basis</header><text>A
				local educational agency may meet the requirements of subparagraphs (A) and (B)
				on a grade-span by grade-span or school-by-school basis.</text>
							</subparagraph><subparagraph id="H8AB5150ACA574CF1A5C06E6D58EEE4AF"><enum>(D)</enum><header>Exclusion of
				funds</header>
								<clause id="H4B265899D5B34B25908A23F7A7F108A7"><enum>(i)</enum><header>In
				General</header><text>For the purpose of complying with this paragraph, a local
				educational agency shall exclude any State or local funds expended in any
				school for—</text>
									<subclause id="HC8348A2B600D4997A29C153C12301FFC"><enum>(I)</enum><text>excess costs of
				providing services to English learners;</text>
									</subclause><subclause id="H280DB2E3A57D43FB8420113A4FDE7867"><enum>(II)</enum><text>excess costs of
				providing services to children with disabilities;</text>
									</subclause><subclause id="HC7E31B08D3074726B5BDEC963603C970"><enum>(III)</enum><text>capital
				expenditures; and</text>
									</subclause><subclause id="HDA5CC72A17984D88A70F5B0515E54096"><enum>(IV)</enum><text>such other
				expenditures as the Secretary determines appropriate.</text>
									</subclause></clause><clause id="H4F313CC195D2469BB4A988C03792337D"><enum>(ii)</enum><header>Changes after
				the beginning of the school year</header><text>A local educational agency need
				not include unpredictable changes in student enrollment or personnel
				assignments that occur after the beginning of a school year in determining
				compliance under this subsection.</text>
								</clause></subparagraph></paragraph><paragraph id="H8E58E7C15B2B4B67A51D975313F96DBB"><enum>(2)</enum><header>Documentation</header><text>A
				local educational agency shall demonstrate that it is meeting the requirements
				of paragraph (1) by submitting to the State educational agency the per-pupil
				expenditures, personnel expenditures, non-personnel expenditures, and total
				expenditures for each school served by the local educational agency.</text>
						</paragraph><paragraph id="H35406FD1247C4C2B9F27B1CB86F17C57"><enum>(3)</enum><header>Inapplicability</header><text>This
				subsection shall not apply to a local educational agency that does not have
				more than one building for each grade span.</text>
						</paragraph><paragraph id="HBD7B413178294146804E59CB5FF62A57"><enum>(4)</enum><header>Process and
				procedures</header>
							<subparagraph id="H399095D9DF474D828E11F0109F98E14A"><enum>(A)</enum><header>Local
				Educational Agency responsibilities</header><text display-inline="yes-display-inline">Each local educational agency assisted
				under this part shall, by October 31, 2014, report to the State educational
				agency on its compliance with the requirements of this subsection for the
				preceding school year by submitting to the State educational agency the
				per-pupil expenditures, personnel expenditures, non-personnel expenditures, and
				total expenditures for each school served by the local educational
				agency.</text>
							</subparagraph><subparagraph id="H8DBC9E295A7945958E0EAADDD0782CE2"><enum>(B)</enum><header>State
				educational Agency responsibilities</header><text>Each State educational agency
				assisted under this part shall ensure that such information is made publicly
				available by the State or the local educational agency, including the school by
				school listing described in subparagraph (A).</text>
							</subparagraph><subparagraph id="HCCF731D485104913A7A98999302B4312"><enum>(C)</enum><header>Plan</header><text>A
				local educational agency that does not meet the requirements of this subsection
				in any year shall develop and implement a plan to ensure compliance for the
				subsequent school year and may be required by the State educational agency to
				report on its progress in implementing such plan.</text>
							</subparagraph></paragraph><paragraph id="HABFCCB21921A4B9995023501C85E677F"><enum>(5)</enum><header>Transition
				Provisions</header>
							<subparagraph id="HB02B94B45C5D46F0B4BDFBBFACCFC7D4"><enum>(A)</enum><header>School years
				preceding the 2015–2016 school year</header><text display-inline="yes-display-inline">For school years preceding the 2015–2016
				school year, a local educational agency may receive funds under this part only
				if the local educational agency demonstrates to the State educational agency
				that the local educational agency meets the requirements of this subsection, as
				in effect before the effective date of the most recent amendment to this
				section.</text>
							</subparagraph><subparagraph id="HE8573BA6037A4C86A380727F9FC412EB"><enum>(B)</enum><header>Transition
				between requirements</header><text display-inline="yes-display-inline">The
				Secretary shall take such steps as are necessary to provide for the orderly
				transition between the requirements under this section, as in effect before the
				effective date of the most recent amendment to this section, and the new
				requirements under this section, as so amended.</text>
							</subparagraph></paragraph><paragraph id="H1F94710FD91C45BD979378C428C546E5"><enum>(6)</enum><header>Definitions</header><text>The
				Secretary shall promulgate regulations defining the terms used in this
				subsection, including the terms <quote>per-pupil expenditure</quote>,
				<quote>personnel expenditure</quote>, <quote>non-personnel expenditure</quote>,
				<quote>high-poverty school</quote>, and <quote>low-poverty
				school</quote>.</text>
