		</section><section id="H00A913316E324EE498CD61C332EB3346"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H1704249F4A624779A3C3D87D5E7FFAB1"><enum>(1)</enum><text>The United States
			 must establish a nationwide and comprehensive approach to address the lack of
			 access to needed dental care and reduce oral health disparities.</text>
			</paragraph><paragraph id="H65290CCE3B96451192F1F5B61CE2802A"><enum>(2)</enum><text>Since 2000, when
			 the Surgeon General of the United States called dental disease a <quote>silent
			 epidemic</quote>, there has been increasing but still insufficient attention
			 given to addressing oral health issues. The Healthy People 2020 initiative
			 includes oral health as a leading health indicator for the first time in the
			 history of the Healthy People program, and in 2011, the Institute of Medicine
			 published 2 reports, <quote>Improving Access to Oral Health Care for Vulnerable
			 and Underserved Populations</quote> and <quote>Advancing Oral Health in
			 America</quote>, that focused on oral health.</text>
			</paragraph><paragraph id="H10FF2FDBC2D144779ED8A0F0A7E3E296"><enum>(3)</enum><text>Dental caries,
			 commonly known as cavities, are the most common chronic disease for children in
			 the United States, affecting nearly 60 percent of children between 5 and 17
			 years of age. Additionally, 25 percent of American adults who have attained 65
			 years of age have lost all of their teeth.</text>
			</paragraph><paragraph id="H9132C711862E4FA184B17812DB4FAEB8"><enum>(4)</enum><text>Untreated oral
			 health problems contribute to an increased risk for serious medical conditions
			 such as diabetes, hospital-acquired pneumonia, and poor birth outcomes.</text>
			</paragraph><paragraph id="HA775E5DE1B5E45D981427DFBF3ED21A4"><enum>(5)</enum><text>More than
			 47,000,000 individuals reside in areas where it is difficult to access dental
			 care. Only 45 percent of Americans over 2 years of age have had a dental visit
			 in the preceding 12 months, and approximately 17,000,000 low-income children go
			 each year without seeing a dentist.</text>
			</paragraph><paragraph id="H0C01D7CF917C440F89B2AE585E85EF95"><enum>(6)</enum><text>While the lack of
			 access to oral health services is a national problem, those who are most likely
			 to remain underserved are individuals with low incomes, racial and ethnic
			 minorities, pregnant women, older adults, individuals with special needs, and
			 individuals living in rural communities.</text>
			</paragraph><paragraph id="H1A8BF0132D12453CB49558991074DF83"><enum>(7)</enum><text>Nearly 9,500
			 additional dental providers are needed in order to meet this Nation's current
			 oral health needs, especially to work in areas where the need for dental care
			 is the greatest. Only 20 percent of practicing dentists in the United States
			 provide care to individuals enrolled in Medicaid, and a very small percentage
			 of dentists devote a substantial part of their practice towards caring for
			 individuals who are underserved.</text>
			</paragraph><paragraph id="HC988A1888B23486683D62EA1E076FA2C"><enum>(8)</enum><text>Over 40 percent of
			 the total expenditures on dental care in the United States are out-of-pocket
			 payments by individuals.</text>
			</paragraph><paragraph id="HBB3DA1084E3940F1A4133FFE54C9DE1F"><enum>(9)</enum><text>The Medicare
			 program and the Department of Veterans Affairs do not provide dental coverage
			 to the majority of their beneficiaries, and States can elect whether to provide
			 dental coverage to adults under the Medicaid program.</text>
			</paragraph><paragraph id="H48468EDE42E34603A12020233E919403"><enum>(10)</enum><text>The number of
			 individuals without dental health insurance is 3 times higher than the number
			 of individuals who lack general health insurance.</text>
			</paragraph><paragraph id="H1E8CFBC5F76F42EB9917DFEB9D8FA851"><enum>(11)</enum><text>The lack of
			 access to oral health services can be extremely costly, resulting in higher
			 health care expenditures. In 2009, there were over 830,000 visits to emergency
			 rooms across the United States for preventable dental conditions, which is 16
			 percent higher than in 2006.</text>
			</paragraph><paragraph id="H62CBC33D317B4378AB7A59BC4CE54085"><enum>(12)</enum><text>According to a
			 report by the Surgeon General of the United States, students miss more than
			 51,000,000 hours of school and employed adults lose more than 164,000,000 hours
			 of work each year due to dental disease and dental visits.</text>
			</paragraph></section><title id="H062C5F8BEBCC4E13A454848A5927418E"><enum>I</enum><header>Medicare and
			 Medicaid</header>
			<subtitle id="H30E89E70BA104251836B9E51E79A1AC8"><enum>A</enum><header>Medicare</header>
				<section id="H999CC814217949F4B9B9B2EE8E26406B"><enum>101.</enum><header>Coverage of
			 dental services under the Medicare program</header>
					<subsection id="H31EFDEE6FD9F4FF5B68B4E8922F230A3"><enum>(a)</enum><header>Coverage</header><text>Section
			 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (42 U.S.C. 1395x(s)(2)) is amended—</text>
						<paragraph id="H7A659A6AA71F469299CAEE883E133346"><enum>(1)</enum><text>in subparagraph
			 (EE), by striking <quote>and</quote> after the semicolon at the end;</text>
						</paragraph><paragraph id="HAAE7F701D8D3447C97BDF8228ADCA5C2"><enum>(2)</enum><text>in subparagraph
			 (FF), by adding <quote>and</quote> after the semicolon at the end; and</text>
						</paragraph><paragraph id="H49FA9AE6678A4C9D85E89A95F1072841"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="H9BACDCF7E4224DADBFE864C3F808FE01" style="OLC">
								<subparagraph id="HDDE0890DB06E4059B3B824A0E0437385" indent="up1"><enum>(GG)</enum><text>dental services (as defined in
				subsection
				(iii));</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H43A10B73636A4FA795A5865788726E6E"><enum>(b)</enum><header>Dental services
			 defined</header><text>Section 1861(s) of the Social Security Act (42 U.S.C.
			 1395x(s)) is amended by adding at the end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H851181C4417E4671BCA07FCF172D0229" other-style="archaic" style="other">
							<subsection id="H37B2A311BEB04168B4805EF8FE9B8990"><enum>(iii)</enum><header>Dental services</header><paragraph commented="no" display-inline="yes-display-inline" id="H5A4C2BC2E1FF4F8D9CE745A00FCB0B2B"><enum>(1)</enum><text>The term <term>dental
				services</term> means oral health services (as defined by the Secretary)
				provided by a licensed oral health care provider that are necessary to prevent
				disease and promote oral health, restore oral structures to health and
				function, and treat emergency conditions.</text>
								</paragraph><paragraph id="H71823021D1A548CC9557743FBD14EC3E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), such term
				shall include mobile and portable oral health services (as defined by the
				Secretary) that—</text>
									<subparagraph id="H1ECFA20CEABB49869B5343C1765F2620"><enum>(A)</enum><text display-inline="yes-display-inline">are provided for the purpose of overcoming
				mobility, transportation, and access barriers for individuals; and</text>
									</subparagraph><subparagraph id="HCBEF8498E41E4159B9D6857C2DFEAD36"><enum>(B)</enum><text>satisfy the standards and
				certification requirements established under section 1902(a)(84)(B) for the
				State in which the services are
				provided.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H9C3784173AA14FCAA456B4307BCCBC14"><enum>(c)</enum><header>Payment and
			 coinsurance</header><text>Section 1833(a)(1) of the Social Security Act (42
			 U.S.C. 1395l(a)(1)) is amended—</text>
						<paragraph id="HEA65AA4539B04618BBECB8ADB859C877"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(Z)</quote>; and</text>
						</paragraph><paragraph id="HBABEE72F53BC4F3F8F50B839D90600D2"><enum>(2)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (AA) with respect
			 to dental services (as defined in section 1861(iii)), the amount paid shall be
			 (i) in the case of such services that are dental health preventive services
			 described in paragraph (1)(D) of such section, 100 percent of the lesser of the
			 actual charge for the services or the amount determined under the payment basis
			 determined under section 1848, and (ii) in the case of all other such services,
			 80 percent of the lesser of the actual charge for the services or the amount
			 determined under the payment basis determined under section
			 1848</quote>.</text>
						</paragraph></subsection><subsection id="H43ED2E2D9E0845FEAAC2E28AEDBC4300"><enum>(d)</enum><header>Payment under
			 physician fee schedule</header><text>Section 1848(j)(3) of the Social Security
			 Act (42 U.S.C. 1395w–4(j)(3)) is amended by inserting <quote>(2)(GG),</quote>
			 after <quote>risk assessment),</quote>.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HDDB02D6A80C64688AB35A4D2C634C69E"><enum>(e)</enum><header>Dentures</header><text>Section
			 1861(s)(8) of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (42 U.S.C. 1395x(s)(8)) is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H6636333ADAFE4068BC83753F342FC4C9"><enum>(1)</enum><text>by striking
			 <quote>(other than dental)</quote> and inserting <quote>(including
			 dentures)</quote>; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5192F9BEB9314753A8E6AAAB677B79E0"><enum>(2)</enum><text>by striking
			 <quote>internal body</quote>.</text>
						</paragraph></subsection><subsection id="H2DC37FB3084841BFB8FF8A7BD4F6575C"><enum>(f)</enum><header>Repeal of ground
			 for exclusion</header><text>Section 1862(a) of the Social Security Act (42
			 U.S.C. 1395y) is amended by striking paragraph (12).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HDBA91274C3F94E4492F9519A507422C0"><enum>(g)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2013.</text>
					</subsection></section></subtitle><subtitle id="H00DEB48860344E9D8CDDB6B18AE44EC0"><enum>B</enum><header>Medicaid</header>
				<section id="H507A68EC69A34D2197201AB1C4086524"><enum>111.</enum><header>Coverage of
			 dental services under the Medicaid program</header>
					<subsection id="HC24F363773AE4EFD9C79B8946C5DD992"><enum>(a)</enum><header>In
			 general</header><text>Section 1905 of the Social Security Act (42 U.S.C. 1396d)
			 is amended—</text>
						<paragraph id="HED86BB62495C43D58512A3C6FE9F06F9"><enum>(1)</enum><text>in subsection
			 (a)(10), by adding <quote>(as described in subsection (ee)(1))</quote> after
			 <quote>dental services</quote>; and</text>
						</paragraph><paragraph id="H9478B9106C1F440FBFCE07D9B6BDF4FD"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H295D73663F594EDC9603B0DC6A064098" style="traditional">
								<subsection id="H4D59B0F30AF3423B93C8625B2736B958"><enum>(ee)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H961AAD5857E34577B20B5690D47A202E"><enum>(1)</enum><text>Subject to paragraphs
				(2) and (3), for purposes of this title, the term <term>dental services</term>
				means oral health services (as defined by the Secretary) provided by a licensed
				oral health care provider that are necessary to prevent disease and promote
				oral health, restore oral structures to health and function, and treat
				emergency conditions.</text>
									</paragraph><paragraph id="HFF60FC58804E47E08019DF9BF899DAD4" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), such term
				shall include mobile and portable oral health services (as defined by the
				Secretary) that—</text>
										<subparagraph id="H51F94EFFD428414895164909CAC5492D"><enum>(A)</enum><text>are provided for the purpose of
				overcoming mobility, transportation, and access barriers for individuals;
				and</text>
										</subparagraph><subparagraph id="HF51A7EC6967B42729415569881A87BBC"><enum>(B)</enum><text>satisfy the standards and
				certification requirements established under section 1902(a)(84)(B) for the
				State in which the services are provided.</text>
										</subparagraph></paragraph><paragraph id="H3D93024824274D74B76026CDB5F19497" indent="up1"><enum>(3)</enum><text>For purposes of paragraph (1), such
				term shall not apply to dental care or services provided to individuals under
				the age of 21 under subsection
				(r)(3).</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H28651C1D77BC432690EF9C93140D6856"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 1902(a) of such Act (42 U.S.C. 1396a(a)) is
			 amended—</text>
						<paragraph id="HE3531C3E607C47EEA918F1A38F41D768"><enum>(1)</enum><text>in paragraph
			 (10)(A), in the matter preceding clause (i), by inserting <quote>(10),</quote>
			 after <quote>(5),</quote>;</text>
						</paragraph><paragraph id="HAD334233F0464CF592CF48C6AF082885"><enum>(2)</enum><text>in paragraph
			 (82)(C), by striking <quote>and</quote> at the end;</text>
						</paragraph><paragraph id="HDD51A4762CF840C78D8A3BAB91426D81"><enum>(3)</enum><text>in paragraph (83),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
						</paragraph><paragraph id="H67CB0CB3995040FD92E150F93C466587"><enum>(4)</enum><text>by inserting after
			 paragraph (83) the following:</text>
							<quoted-block display-inline="no-display-inline" id="H0993FE5911AD43C9B6868F530FF0B7FA" style="OLC">
								<paragraph id="HA400395BAD9E43EA8A8549E8C065DF10"><enum>(84)</enum><text>provide
				for—</text>
									<subparagraph id="HC140B9291E494F86A578C3CC563A97D2"><enum>(A)</enum><text>informing, in
				writing, all individuals who have been determined to be eligible for medical
				assistance of the availability of dental services (as defined in section
				1905(ee)(1)); and</text>
									</subparagraph><subparagraph id="H6C59D8EA587A40DF9B9632D6AE796069"><enum>(B)</enum><text>establishing and
				maintaining standards for and certification of mobile and portable oral health
				services (as described in subsections (r)(3)(C) and (ee)(2) of section
				1905).</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H0C99AA47ED9144369E23CF617E7BB066"><enum>(c)</enum><header>Mobile and
			 portable oral health services under EPSDT</header><text>Section 1905(r)(3) of
			 the Social Security Act (42 U.S.C. 1396d(r)(3)) is amended—</text>
						<paragraph id="HEF828AC88FC341BCBC56154D5115C39F"><enum>(1)</enum><text>in subparagraph
			 (A)(ii), by striking <quote>; and</quote> and inserting a semicolon;</text>
						</paragraph><paragraph id="H705983FA5F4F44C79D8340CA9BB0CE63"><enum>(2)</enum><text>in subparagraph
			 (B), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
						</paragraph><paragraph id="HA1299068D89649888F51EB98F3CD1196"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="H8281F8199AFA44A2A516E8F9087742F4" style="OLC">
								<subparagraph id="H89EC629B435E49ECB25832C5CADE8EAF" indent="up1"><enum>(C)</enum><text>which shall include mobile and
				portable oral health services (as defined by the Secretary) that—</text>
									<clause id="H800BA58AD32D4754B3377781A3D8C45D"><enum>(i)</enum><text>are provided for the purpose of
				overcoming mobility, transportation, or access barriers for children;
				and</text>
									</clause><clause id="H34B76585668A49B0B803890C4390CC09"><enum>(ii)</enum><text>satisfy the standards and
				certification requirements established under section 1902(a)(84)(B) for the
				State in which the services are
				provided.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HB68A31A34FF74077A88816789C0B9FA3"><enum>(d)</enum><header>Increased
			 federal funding for dental services</header>
						<paragraph id="HA532A8B37B6345C685930DF34D03E02F"><enum>(1)</enum><header>In
			 general</header><text>Section 1905 of the Social Security Act (42 U.S.C.
			 1396d), as amended by subsection (a), is amended—</text>
							<subparagraph id="H480469026F7D4062A0EE25A4BCFBBE1B"><enum>(A)</enum><text>in subsection (b),
			 in the first sentence, by striking <quote>and (aa)</quote> and inserting
			 <quote>(aa), and (ff)</quote>; and</text>
							</subparagraph><subparagraph id="HBE18561772FA42E78232A1C4EBCBB762"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
								<quoted-block display-inline="no-display-inline" id="H2CED5B2E1B154F47B3B4F47749E4F09F" style="OLC">
									<subsection commented="no" id="H9CF739E8761A4B74A9ED061B2AD58B5C"><enum>(ff)</enum><header>Increased FMAP
				for dental services</header>
										<paragraph commented="no" id="HC01A33FB110F4B48BF60ABE538D445AD"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (b) and section 1903(a)(7) and subject to the requirements described
				in paragraphs (3) and (4), with respect to amounts expended on or after October
				1, 2012, for covered dental expenses (as described in paragraph (2)), the
				Federal medical assistance percentage for a State that is one of the 50 States
				or the District of Columbia for such expenses shall be equal to the Federal
				medical assistance percentage that would otherwise apply to the State for the
				fiscal year, as determined under subsection (b) or section 1903(a)(7),
				increased by 10 percentage points.</text>
										</paragraph><paragraph commented="no" id="H4BC54BCE6ED7471EA842B78CCB9563A5"><enum>(2)</enum><header>Covered dental
				expenses</header><text>For purposes of paragraph (1), the term <term>covered
				dental expenses</term> means the amounts expended for medical assistance for
				dental services (as described in subsection (ee)(1)) and amounts expended for
				the proper and efficient administration of the provision of such dental
				services under the State plan.</text>
										</paragraph><paragraph commented="no" id="HEFDF5FE9971048FA963A09C9D9D0255D"><enum>(3)</enum><header>Requirements</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the Federal
				medical assistance percentage applicable to covered dental expenses under this
				subsection shall not apply to a State unless—</text>
											<subparagraph commented="no" id="HBDBAB6BB6B0D4378ABD24565BE0774C1"><enum>(A)</enum><text display-inline="yes-display-inline">the State plan for medical assistance
				provides payment for dental services (as so defined) furnished by a dental
				provider at a rate that is not less than 70 percent of the usual and customary
				fee for such services in the State; and</text>
											</subparagraph><subparagraph commented="no" id="H06E55BDB3A5448DC96F62310370D814C"><enum>(B)</enum><text display-inline="yes-display-inline">the State satisfies such additional
				requirements as are established by the Secretary, which shall include—</text>
												<clause commented="no" id="H4157884F4AF243DFBE4EE437EEF1C262"><enum>(i)</enum><text display-inline="yes-display-inline">streamlining of administrative procedures
				for purposes of ensuring adequate provider participation and increasing patient
				utilization of dental services; and</text>
												</clause><clause commented="no" id="HCFB8BC00B5364853AF592C20951206E9"><enum>(ii)</enum><text>the provision of
				technical assistance to dental providers designed to reduce the number of
				missed patient appointments and eliminate other barriers to the provision of
				oral health services.</text>
												</clause></subparagraph></paragraph><paragraph commented="no" id="H87894562820843F4ABC581AFD5451AD8"><enum>(4)</enum><header>Limitation</header><text>For
				purposes of amounts expended for covered dental services, in no case shall any
				increase under this subsection result in a Federal medical assistance
				percentage that exceeds 100
				percent.</text>
										</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="HE7C520166B2A4A4DA2C66A5824DD051C"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 1903(a)(7) of the Social Security Act (42
			 U.S.C. 1396b(a)(7)) is amended by striking <quote>section 1919(g)(3)(B)</quote>
			 and inserting <quote>sections 1905(ff) and 1919(g)(3)(B)</quote>.</text>
						</paragraph></subsection><subsection id="H3697019FD38B4B3DA0B2609C03A145C3"><enum>(e)</enum><header>Effective
			 date</header>
						<paragraph id="H65D28C47E681409CBC553762B37C1952"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by this section shall apply to calendar quarters beginning on or after January
			 1, 2013, without regard to whether or not final regulations to carry out such
			 amendments have been promulgated by such date.</text>
						</paragraph><paragraph id="H502CBD4CA59647FBA3566239DF9AD05F"><enum>(2)</enum><header>Delay permitted
			 for State plan amendment</header><text>In the case of a State plan for medical
			 assistance under title XIX of the Social Security Act which the Secretary of
			 Health and Human Services determines requires State legislation (other than
			 legislation appropriating funds) in order for the plan to meet the additional
			 requirements imposed by the amendments made by this section, the State plan
			 shall not be regarded as failing to comply with the requirements of such title
			 solely on the basis of its failure to meet these additional requirements before
			 the first day of the first calendar quarter beginning after the close of the
			 first regular session of the State legislature that begins after the date of
			 enactment of this Act. For purposes of the previous sentence, in the case of a
			 State that has a 2-year legislative session, each year of such session shall be
			 deemed to be a separate regular session of the State legislature.</text>
						</paragraph></subsection></section></subtitle><subtitle id="H7E86E1A2D74C40B2BBC2042657BB72CB"><enum>C</enum><header>Grant
			 programs</header>
				<section id="H10A8500972E54B749789F3BB29C2BBEE"><enum>121.</enum><header>Case management
			 grant program</header>
					<subsection id="H154C528522804FF8983D6EB00DA5BAE4"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary shall award grants to States and eligible entities for the purpose of
			 developing case management programs that—</text>
						<paragraph id="H033E278AB6D5499E98E899723BC9A39E"><enum>(1)</enum><text>identify eligible
			 individuals who are in need of dental services, with a particular focus on
			 pregnant women, individuals with disabilities, and older adults, and provide
			 them with information regarding dental providers in proximity to their
			 residence;</text>
						</paragraph><paragraph id="HC6FBF9A678CF429FB11B25373E32E4F1"><enum>(2)</enum><text>determine the
			 coverage status of an eligible individual or whether such individual is
			 eligible for free dental services;</text>
						</paragraph><paragraph id="H148884121D5F42C49CEE804364D46C21"><enum>(3)</enum><text>recruit licensed
			 dental providers and coordinate the voluntary provision of medically
			 recommended dental services by such providers to eligible individuals described
			 in subsection (f)(2)(E) with no fee or charge to such individuals and in a
			 manner consistent with State licensing laws;</text>
						</paragraph><paragraph id="H4FC87BFCC7D648378AA159C40B928D94"><enum>(4)</enum><text>provide
			 community-level oral health education, with a focus on oral health literacy and
			 prevention, and resource information to eligible individuals; and</text>
						</paragraph><paragraph id="H19306363B854458180359ABEE25C7E49"><enum>(5)</enum><text>identify and
			 coordinate transportation for eligible individuals in need of dental services
			 as necessary to overcome mobility impairments and transportation
			 barriers.</text>
						</paragraph></subsection><subsection commented="no" id="H6E3747522FB24971A192E499CAD8CF45"><enum>(b)</enum><header>Application</header><text>A
			 State or eligible entity that desires to participate in the grant program under
			 this section shall submit to the Secretary an application at such time, in such
			 manner, and containing such information as the Secretary may require.</text>
					</subsection><subsection commented="no" id="H07359C4FF3FC46C2A221936334EB6245"><enum>(c)</enum><header>Duration and
			 scope</header><text>From any amounts appropriated to carry out this section,
			 the Secretary shall award grants to a total of 10 States and eligible entities,
			 with the amount of each grant to be determined at the discretion of the
			 Secretary.</text>
					</subsection><subsection commented="no" id="H59412D81709E4351ADF171D6B9460904"><enum>(d)</enum><header>Evaluation</header><text>Not
			 later than January 1, 2016, the Secretary shall—</text>
						<paragraph commented="no" id="H67B08D71C5E14B779821127A9590A357"><enum>(1)</enum><text>conduct an
			 evaluation of the grant program under this section for purposes of determining
			 if case management programs established by participating States and eligible
			 entities sufficiently increased access to dental services; and</text>
						</paragraph><paragraph commented="no" id="H13307F72522042E086838585B2F50E11"><enum>(2)</enum><text>determine whether
			 case management programs should be made available on a nationwide basis.</text>
						</paragraph></subsection><subsection commented="no" id="HE01BEC67F43C4DD2A2CA75006DAE5110"><enum>(e)</enum><header>Authorization</header><text>To
			 carry out the grant program under this section, there are authorized to be
			 appropriated such sums as may be necessary for each of fiscal years 2013
			 through 2015.</text>
					</subsection><subsection id="H55CF8354CA5B465EAEAF63D152A81A2D"><enum>(f)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="H6A88A1C212604F37A0EAD51AAE95FEEA"><enum>(1)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means an
			 organization that is described in section 501(c)(3) of the Internal Revenue
			 Code of 1986 and exempt from tax under section 501(a) of such Code.</text>
						</paragraph><paragraph id="H4F178894C0404DA8B11D6004DF6E5561"><enum>(2)</enum><header>Eligible
			 individual</header><text>The term <term>eligible individual</term> means an
			 individual who is—</text>
							<subparagraph id="HB2535CF5C65340B7BC4D1A018637C6C5"><enum>(A)</enum><text>entitled to, or
			 enrolled for, benefits under part A of title XVIII of the Social Security Act
			 or enrolled for benefits under part B of such title;</text>
							</subparagraph><subparagraph id="H38F65B7C9BA4407586B60B97EAFC05A1"><enum>(B)</enum><text>eligible to
			 receive medical assistance under a State plan under title XIX of the Social
			 Security Act or any waiver approved with respect to such plan;</text>
							</subparagraph><subparagraph id="H889098DE126244E28DBFB36028C096FF"><enum>(C)</enum><text>eligible to
			 receive child health assistance under a State child health plan under title XXI
			 of the Social Security Act or any waiver approved with respect to such
			 plan;</text>
							</subparagraph><subparagraph id="HDE35B97E85204786860C68463C9A66C3"><enum>(D)</enum><text>entitled to
			 receive medical benefits under the laws administered by the Secretary of
			 Veterans Affairs; or</text>
							</subparagraph><subparagraph id="H5A9CE88315AC480EACDCBD8830A864B7"><enum>(E)</enum><text>has an income
			 below 200 percent of the Federal poverty level and does not otherwise have any
			 dental insurance coverage.</text>
							</subparagraph></paragraph><paragraph id="HAEAA3499944B4BFDA619F05A7B14E454"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Health and Human
			 Services.</text>
						</paragraph><paragraph id="H81D00829E7054753A9C2A678A01370CC"><enum>(4)</enum><header>State</header><text>The
			 term <term>State</term> means the 50 States and the District of
			 Columbia.</text>
						</paragraph></subsection></section></subtitle></title><title id="H765B4D4F08314711906B108B37A6EB34"><enum>II</enum><header>Public Health

			 education</header>
				<section id="HF08F02451D36452E9CE05F0DF06BC2CA"><enum>211.</enum><header>Authorization
			 of appropriations for oral health education for medical providers</header><text display-inline="no-display-inline">Section 747(c) of the Public Health Service
			 Act (42 U.S.C. 293k(c)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HBAC3098E148842309C083A2EEE85BCCF" style="OLC">
						<paragraph id="HB971757798044E44ADA202EC19040D6E"><enum>(4)</enum><header>Oral health

				physicians, nurses, and pharmacists, about oral health, including issues such
				as oral hygiene instruction, topical application of fluoride, and oral health
				screenings, with the goal of integrating oral health care into overall health
				care.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HDC945F4567AD4CB083BDF59C18032C3F"><enum>212.</enum><header>Oral health
			 education for other non-health professionals</header><text display-inline="no-display-inline">Subpart I of part C of title VII of the
			 Public Health Service Act (42 U.S.C. 293k et seq.) is amended by inserting
			 after section 748 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1F26300E16F542B0B59248DE9A1926C3" style="OLC">
						<section id="H9A61CF3C426F44008F8F9148DDD44C30"><enum>748A.</enum><header>Oral health
				education for other non-oral health professionals</header>
							<subsection id="H0272DB72F76546C783EE10CD98D91AD9"><enum>(a)</enum><header>In
				general</header><text>The Secretary may make grants to, or enter into contracts
				with, an accredited public or nonprofit private hospital, an educational
				institution, or a public or private nonprofit entity which the Secretary has
				determined is capable of carrying out such grant or contract to educate
				individuals, such as community health workers, social workers, nutritionists,
				health educators, occupational therapists, and psychologists, to promote oral
				health education and to provide support for behavior change and assistance with
				care coordination with respect to oral health.</text>
							</subsection><subsection id="H80A4317009F04F4F9393666E76499652"><enum>(b)</enum><header>Authorization of
				appropriations</header><text>To carry out this section, there is authorized to
				be appropriated such sums as may be necessary for fiscal years 2013 through
				2016.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H71FC4F858AD14998958388673D4A9696"><enum>213.</enum><header>Dental
			 education</header>
					<subsection id="H7F9886EA2F4E4ED2BEA66E8F05E1209A"><enum>(a)</enum><header>Training in
			 general, pediatric, and public health dentistry</header><text display-inline="yes-display-inline">Section 748 of the Public Health Service
			 Act (42 U.S.C. 293k–2) is amended—</text>
						<paragraph id="H0E28D7CB7465459F9878D84E7D5E6DFC"><enum>(1)</enum><text>in subsection
			 (a)(1)(H), by striking <quote>pediatric training programs</quote> and inserting
			 <quote>pediatric dental training programs</quote>; and</text>
						</paragraph><paragraph id="HFDFED8324EB34A1E9198F44844826462"><enum>(2)</enum><text>in subsection
			 (c)—</text>

			 programs</header><text>Part B of title III of the Public Health Service Act (42

				require individuals enrolled in such residency programs to provide dental

				dental training otherwise required by such residency
				program.</text>

			 professional student loans</header><text display-inline="no-display-inline">Part F of title VII of the Public Health
			 Service Act (42 U.S.C. 295j) is amended by adding at the end the
			 following:</text>

				general</header><text>The Secretary shall establish and operate a student loan
				fund for oral health professional students, including dental hygienists, dental
				therapists, and dentists.</text>
							</subsection><subsection id="H250491DE959C4C06B24CC01CE57BB808"><enum>(b)</enum><header>Content</header><text>The
				Secretary shall establish and operate the student loan fund program under
				subsection (a) in the same manner and subject to the same terms as the loan
				fund program established with schools of nursing under section 835.</text>
							</subsection><subsection id="H915D190109B440F9A56E24B51F2F69A9"><enum>(c)</enum><header>Authorization of
				appropriations</header><text>To carry out this section, there are authorized to
				be appropriated such sums as may be necessary for fiscal years 2013 through

				</section></subtitle><subtitle id="H28CCF9D5F30C420A992E7463027C235F"><enum>C</enum><header>Other oral health
			 programs</header>
				<section commented="no" id="H80B8B04A4B2040EFA9F60E760A89D259"><enum>221.</enum><header>Access
			 points</header><text display-inline="no-display-inline">Subpart X of part D of
			 title III of the Public Health Service Act (42 U.S.C. 256f et seq.) is amended
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA543DE7F62CF40528E0E3070C3E01CAF" style="OLC">
						<section id="H403F21CE0B4A46FE9A0CF494E2646267"><enum>340G–2.</enum><header>Funding for
				oral health services</header>
							<subsection id="H682A3B031688469A86DCDF1E3BF8969D"><enum>(a)</enum><header>In
				general</header><text>The Secretary, acting through the Administrator of the
				Health Resources and Services Administration, shall establish a program to
				award grants to eligible entities to provide oral health services, or to
				contract with private dental practices to provide comprehensive oral health
				services, to low income individuals and individuals who are underserved with
				respect to oral health care.</text>
							</subsection><subsection id="HAACAB369F3394B058CC5A12CC73CFF4E"><enum>(b)</enum><header>Technical
				assistance</header><text>The Secretary shall provide technical assistance to
				entities receiving grants under subsection (a) to provide technical assistance
				to such entities in order to—</text>
								<paragraph commented="no" id="H26FCB8B6A2594613893679F514200662"><enum>(1)</enum><text>with respect to
				oral health care services, increase efficiency and minimize missed
				appointments, contract with offsite providers, recruit providers (including
				oral health specialists), and operate programs outside the physical facilities
				to take advantage of new systems to improve access to oral health services;
				or</text>
								</paragraph><paragraph commented="no" id="H158CBE83A69F4E72A4CC648BB2EAFF0A"><enum>(2)</enum><text>contract with
				private dental practices that will provide oral health services other than
				preventive oral health care, including restoration and maintenance of oral
				health, in order to meet the need for oral health services in the
				community.</text>
								</paragraph></subsection><subsection id="H1146412853CA49FBB7FDAAD6FCDE1E2C"><enum>(c)</enum><header>Eligible
				entities</header><text>To be eligible to receive a grant under subsection (a),
				an entity shall—</text>
								<paragraph id="H95CAF4A8383E422B86731EBCFF95B1E7"><enum>(1)</enum><text>be—</text>
									<subparagraph id="H6625A983511F45138BAABC0E40DD6E8B"><enum>(A)</enum><text>a Federally
				qualified health center (as defined in section 1861(aa) of the Social Security
				Act);</text>
									</subparagraph><subparagraph id="H52F541BEAE4B46C2B40A1DB9A469B08A"><enum>(B)</enum><text>a safety net
				clinic or a free clinic (as defined by the Secretary);</text>
									</subparagraph><subparagraph id="H96B1A4C0D52D4B9F987676C071A169CF"><enum>(C)</enum><text>a health care
				clinic that provides services to tribal organizations or urban Indian
				organizations (as such terms are defined in section 4 of the Indian Health Care
				Improvement Act); or</text>
									</subparagraph><subparagraph id="HC921F0B924074AA3B4FF288EF99F7E37"><enum>(D)</enum><text>any other
				interested public or private sector health care provider or organization that
				the Secretary determines has a demonstrated history in serving a high number of
				uninsured and or low-income individuals or those who lack ready access to oral
				health services; and</text>
									</subparagraph></paragraph><paragraph id="H438132C4E3ED40D5BA18EE1E213761C5"><enum>(2)</enum><text>demonstrate a
				clear need to expand oral health care services beyond preventive oral health
				care.</text>
								</paragraph></subsection><subsection id="H30C5B06A129846BCA78E032E30869AFF"><enum>(d)</enum><header>Allocation for
				hiring oral health care specialists</header><text>A portion of the funds
				available under this section shall be allocated toward hiring oral health care
				specialists, such as oral surgeons, at entities receiving grants under this
				section.</text>
							</subsection><subsection id="HB15AFA9B44DE4B46B2CAD3987504C384"><enum>(e)</enum><header>Authorization of
				appropriations</header><text>To carry out this section, there is authorized to
				be appropriated such sums as may be necessary for each of fiscal years 2013
				through
				2016.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HAB231C2B4AF64BD1AA9C80C32F9DF65A"><enum>222.</enum><header>Dental clinics
			 in schools</header><text display-inline="no-display-inline">Part Q of title III
			 of the Public Health Service Act (42 U.S.C. 280h et seq.) is amended by adding
			 at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5CBD958CBB314315BB4994B1FB40FB6D" style="OLC">
						<section commented="no" id="HB259083C95AC42CBBD486A73A3B7D673"><enum>399Z–2.</enum><header>Dental
				clinics in schools</header>
							<subsection commented="no" id="H6E19AEA065BA48969479E7B790AB1747"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall award grants to qualified entities
				for the purpose of funding the building, operation, or expansion of dental
				clinics in schools.</text>
							</subsection><subsection commented="no" id="HBF6F52E0A9C54F6CB6631598CCFDE05E"><enum>(b)</enum><header>Qualified
				entities</header><text>To receive a grant under this section, a qualified
				entity shall submit an application to the Secretary at such time, in such
				manner, and containing such information as the Secretary may require.</text>
							</subsection><subsection commented="no" id="HA62758F2552D4D4C8BE4D40009F3E3E0"><enum>(c)</enum><header>Requirements</header><text>An
				entity receiving a grant under this section shall—</text>
								<paragraph commented="no" id="H4D5B0D2406E540589338684FB9FC8EBB"><enum>(1)</enum><text>provide
				comprehensive oral health services at a dental clinic based at a school,
				including oral health education, oral screening, fluoride application,
				prophylaxis, and sealants;</text>
								</paragraph><paragraph commented="no" id="HB081F8165DC248AB9F0C8D940F36ACF9"><enum>(2)</enum><text>refer patients to
				an available qualified oral health provider in the community for any required
				oral health services not provided in the dental clinic in the school, to ensure
				that all the oral health needs of students are met; and</text>
								</paragraph><paragraph commented="no" id="H3E9CC82F01BA4F9EAC742BB065421554"><enum>(3)</enum><text>maintain clinic
				hours that extend beyond school hours.</text>
								</paragraph></subsection><subsection commented="no" id="HE9598D3C947449D39FFA24F36ED688B8"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>For purposes of carrying out this section, there
				is authorized to be appropriated such sums as may be necessary for fiscal years
				2013 through
				2016.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H871F46A844DC46EA96EE13733AFDC045"><enum>223.</enum><header>Emergency room
			 care coordination</header><text display-inline="no-display-inline">Part B of
			 title III of the Public Health Service Act (42 U.S.C. 243 et seq.), as amended
			 by section 213(b), is further amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H79FB55C9352C40BF8D906E10AB55757F" style="OLC">
						<section commented="no" id="H150AEB3DB19B44D7957A9BC04DF3515D"><enum>320C.</enum><header>Emergency room
				care coordination with respect to dental care</header>
							<subsection commented="no" id="HD32869781A794AD2AED6C758C61DA057"><enum>(a)</enum><header>In
				general</header><text>The Secretary, acting through the Administrator of the
				Health Resources and Services Administration, shall establish a grant program
				to enable individuals to receive dental care at a facility operated by a grant
				recipient rather than at a hospital emergency room.</text>
							</subsection><subsection commented="no" id="H1F6265C0B5624C94B0BE7142EF7F58EC"><enum>(b)</enum><header>Eligible
				entities</header><text>To be eligible to receive a grant under this section, an
				entity shall be—</text>
								<paragraph commented="no" id="H520DDD9512574E52AB4E1E2E968D0649"><enum>(1)</enum><text>a hospital in
				partnership with a Federally qualified health center;</text>
								</paragraph><paragraph commented="no" id="H8D68BE3B8CD848EA99BE4588CD301148"><enum>(2)</enum><text>a Federally
				qualified health center;</text>
								</paragraph><paragraph commented="no" id="H044300D5EA654F8794F145D8D6558D7D"><enum>(3)</enum><text>a private dental
				practice; or</text>
								</paragraph><paragraph commented="no" id="H3AFE998D895E41C29527F7090799A4E8"><enum>(4)</enum><text>any other
				interested public or private sector health care provider or organization that
				the Secretary determines has the capacity to serve a high number of individuals
				who lack access to oral health services.</text>
								</paragraph></subsection><subsection commented="no" id="HE99C7D7FD7C348B688F5E7C821A269F2"><enum>(c)</enum><header>Oral health
				education for ER physicians</header><text>The Secretary shall allocate a
				portion of the amounts appropriated under subsection (e) toward medical
				education for emergency room physicians to be trained in oral health.</text>
							</subsection><subsection commented="no" id="HF1B2156CECCF4ED297ADCDC262F2361A"><enum>(d)</enum><header>Report</header><text>Not
				later than January 1, 2016, the Secretary shall submit to Congress a report on
				the best practices determined by the program established under this section to
				address oral health needs of individuals who go to emergency rooms in need of
				oral health care.</text>
							</subsection><subsection commented="no" id="H6637920046714E14A9A53F9758446E37"><enum>(e)</enum><header>Authorization of
				appropriations</header><text>To carry out this section, there is authorized to
				be appropriated such sums as may be necessary for fiscal years 2013 through
				2016.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H1731D88A2F1C4E8F9FA3B5E8FF8E949A"><enum>224.</enum><header>Research
			 funding</header><text display-inline="no-display-inline">For fiscal years 2013
			 through 2016, there is authorized to be appropriated such sums as may be
			 necessary to each of—</text>
					<paragraph id="H431A6D7FEFC34DE3A93DCC5032ED33F9"><enum>(1)</enum><text>the Centers for
			 Disease Control and Prevention, for the purpose of conducting research
			 on—</text>
						<subparagraph id="H04A1F9D19A054CCEA7B9814739BA5285"><enum>(A)</enum><text>the prevention of
			 oral health disease; and</text>
						</subparagraph><subparagraph id="H44C27B0E90BE41B6882BFCB969F2FE00"><enum>(B)</enum><text>oral health
			 disease management;</text>
						</subparagraph></paragraph><paragraph id="H786D8F01E9B54B978F6A8357113DDD09"><enum>(2)</enum><text>the Agency for
			 Healthcare Research and Quality, for the purpose of conducting—</text>
						<subparagraph id="HDAC18F659FD04D3090DD839228AA66CC"><enum>(A)</enum><text>research with
			 respect to oral health services and the delivery of oral health services;
			 and</text>
						</subparagraph><subparagraph id="H0A73910127974678925A102E30CE5A97"><enum>(B)</enum><text>an evaluation of
			 oral health service delivery to underserved and vulnerable populations;</text>
						</subparagraph></paragraph><paragraph id="HE16E922D8AB746588386378066D03C03"><enum>(3)</enum><text>the National
			 Institute of Dental and Craniofacial Research for the purpose of conducting
			 research on oral health disease management including pharmaceutical-behavioral
			 intervention; and</text>
					</paragraph><paragraph id="HBA20914AB8F8422A8794B48D452B2E2C"><enum>(4)</enum><text>the Maternal and
			 Child Health Bureau for the purpose of conducting research on maternal and
			 child oral health issues.</text>
					</paragraph></section><section id="HED7995DE715F42A683BBBBC40ED292EC"><enum>225.</enum><header>Mobile and
			 portable dental services</header><text display-inline="no-display-inline">Subpart X of part D of title III of the
			 Public Health Service Act (42 U.S.C. 256f et seq.), as amended by section 221,

				facilities that provide services under the Special Supplemental Nutrition
				Program for Women, Infants, and Children (the WIC program) or the Head Start
				Act (42 U.S.C. 9831 et seq.).</text>

			 dental health care providers defined</header><text>In this section, the term
			 <term>alternative dental health care providers</term> has the meaning given

			 purposes of alternative dental health care providers and any other dental care

			 for dental health care services for prisoners within the custody of the Bureau
			 of Prisons</header>
				<subsection id="HA5D40FA87893429FAEE6D4B717A47AC2"><enum>(a)</enum><header>Demonstration
			 program authorized</header><text>The Attorney General, acting through the
			 Director of the Bureau of Prisons, may carry out a demonstration program to
			 establish programs to train and employ alternative dental health care providers
			 in order to increase access to dental health services for prisoners within the
			 custody of the Bureau of Prisons.</text>
				</subsection><subsection id="HF4603B4FF12D4703B0D763041C9C60AA"><enum>(b)</enum><header>Telehealth</header><text>For
			 purposes of alternative dental health care providers and any other dental care
			 providers who are licensed to provide clinical care, dental services provided
			 under the demonstration program under this section may be administered by such
			 providers through telehealth-enabled collaboration and supervision when deemed
			 appropriate and feasible.</text>
				</subsection><subsection id="H467233229AB54BC7AA5AED233FDF1AFF"><enum>(c)</enum><header>Alternative
			 dental health care providers defined</header><text>In this section, the term
			 <term>alternative dental health care providers</term> has the meaning given
			 that term in section 340G–1(a)(2) of the Public Health Service Act (42 U.S.C.
			 256g–1(a)(2)).</text>
				</subsection><subsection id="H60AD8F235248460A83425C8F4062D505"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as are necessary to carry out the demonstration program under this
			 section.</text>
				</subsection></section></title><title id="HCF4B4E8E11454226AE33AD4C709DAB03"><enum>V</enum><header>Indian Health
			 Service</header>
			<section id="H8E690C00DAB14A0BA39AC5F84ACA8E51"><enum>501.</enum><header>Demonstration
			 program on training and employment of alternative dental health care providers
			 for dental health care services under the Indian Health Service</header>
				<subsection id="H0CE55F9D36DA4999AAE26ED6CB98C8C6"><enum>(a)</enum><header>Demonstration
			 program authorized</header><text>The Secretary of Health and Human Services,
			 acting through the Indian Health Service, may carry out a demonstration program
			 to establish programs to train and employ alternative dental health care
			 providers in order to help eliminate oral health disparities and increase
			 access to dental services through health programs operated by the Indian Health
			 Service, Indian tribes, tribal organizations, and Urban Indian organizations
			 (as those terms are defined in section 4 of the Indian Health Care Improvement
			 Act (25 U.S.C. 1603)).</text>
				</subsection><subsection id="H751E2DF1D2AE4B0C82F3F18969854D75"><enum>(b)</enum><header>Telehealth</header><text>For
			 purposes of alternative dental health care providers and any other dental care
			 providers who are licensed to provide clinical care, dental services provided
			 under the demonstration program under this section may be administered by such
			 providers through telehealth-enabled collaboration and supervision when deemed
			 appropriate and feasible.</text>

				</subsection></section></title><title id="H9BE8115AE606495FA8A39A375F17BB68"><enum>VI</enum><header>Reports to
			 Congress</header>
			<section id="H9E3FA98EB2CE43ACBC632BA54D14F165"><enum>601.</enum><header>Evaluation of
			 expansion of coverage for dental services</header>
				<subsection id="H7752583811054E54A7C11DC1DCDACC8C"><enum>(a)</enum><header>Secretary of
			 Health and Human Services</header><text display-inline="yes-display-inline">Not
			 later than October 1, 2016, the Secretary of Health and Human Services shall
			 submit to Congress a report that provides a comprehensive cost-benefit analysis
			 regarding the expansion of coverage for dental services pursuant to this Act,
			 including whether the provision of such services resulted in a reduction in
			 total health care costs for individuals under the Medicare and Medicaid
			 programs.</text>
				</subsection><subsection id="HFB597AC0AE95450A8519CDB2FDD560B4"><enum>(b)</enum><header>Comptroller
			 General</header>
					<paragraph id="H41205CC3B7FE41E9907BE123AE248617"><enum>(1)</enum><header>Medicaid and
			 Medicare</header><text>Not later than October 1, 2015, the Comptroller General
			 of the United States shall submit to Congress a report that provides a
			 comprehensive analysis and evaluation of the implementation and utilization of
			 the expanded coverage for dental services pursuant to this Act for individuals
			 enrolled in the Medicare and Medicaid programs.</text>
					</paragraph><paragraph id="HD96488F84DB941B089DF93F1C045FB99"><enum>(2)</enum><header>Demonstration
			 programs</header><text>Not later than October 1, 2016, the Comptroller General
			 of the United States shall submit to Congress a report that provides a
			 comprehensive analysis and evaluation of the demonstration programs described
			 in sections 302, 311, 401, and 501, including—</text>
						<subparagraph id="H8C44EF39213646F9BB947402E2DD863C"><enum>(A)</enum><text>the extent to
			 which the programs improved access to oral health care and increased
			 utilization of oral health services; and</text>
						</subparagraph><subparagraph id="H07CDA6B578D546F2B02E4D825523D86C"><enum>(B)</enum><text>an examination of
			 the training provided under the programs to alternative dental health care
			 providers and the quality of care provided by such providers.</text>
						</subparagraph></paragraph></subsection></section></title><title id="H42AD7978FD12412FA75704D196C1FD49"><enum>VII</enum><header>Funding</header>
			<section id="H632D7B01D0DC48369A4DA1A703288A41"><enum>701.</enum><header>Transaction
			 tax</header>
				<subsection id="HBCE9F7E453EF4FC7AAA4E7DE8D41A9AE"><enum>(a)</enum><header>In
			 general</header><text>Chapter 36 of the Internal Revenue Code of 1986 is
			 amended by inserting after subchapter B the following new subchapter:</text>

							</toc>
							<section id="HF42A213CB29D44A99490F5EB29E5DEBC"><enum>4475.</enum><header>Tax on trading
				transactions</header>
								<subsection id="H19AFC0787DD844AEBACD3A53694E20DE"><enum>(a)</enum><header>Imposition of
				tax</header><text display-inline="yes-display-inline">There is hereby imposed a
				tax on each covered transaction with respect to any security.</text>
								</subsection><subsection id="HC015CE29EE9A412EAC0EA81BD2396731"><enum>(b)</enum><header>Rate of
				tax</header><text display-inline="yes-display-inline">The tax imposed under
				subsection (a) with respect to any covered transaction shall be 0.025 percent
				of the specified base amount with respect to such covered transaction.</text>
								</subsection><subsection id="H8FBD728348E640A0B2C412E10DC47D66"><enum>(c)</enum><header>Specified base
				amount</header><text>For purposes of this section, the term <quote>specified
				base amount</quote> means—</text>
									<paragraph id="H9AC66B6F6F1442D9A2BBFC5F5B9D9B68"><enum>(1)</enum><text>except as provided
				in paragraph (2), the fair market value of the security (determined as of the
				time of the covered transaction), and</text>
									</paragraph><paragraph id="H04C709EFE7A54D89AB16116B75EA0AA1"><enum>(2)</enum><text>in the case of any
				payment described in subsection (h), the amount of such payment.</text>
									</paragraph></subsection><subsection id="H7C3E6E1859EA4851BC80D7BF0838009A"><enum>(d)</enum><header>Covered
				transaction</header><text>For purposes of this section, the term <quote>covered
				transaction</quote> means—</text>
									<paragraph id="H8E11F608603145C487EB4D631742158C"><enum>(1)</enum><text>except as provided
				in paragraph (2), any purchase if—</text>
										<subparagraph id="H0FAD8C7670FE4085A55784D4D1EE08BE"><enum>(A)</enum><text>such purchase
				occurs or is cleared on a facility located in the United States, or</text>
										</subparagraph><subparagraph id="HDC5904FDCEF64CECBC8F4103A4EC3657"><enum>(B)</enum><text>the purchaser or
				seller is a United States person, and</text>
										</subparagraph></paragraph><paragraph id="H2F6E85514FDF487A835CAD372C1E07B7"><enum>(2)</enum><text>any transaction
				with respect to a security described in subparagraph (D), (E), or (F) of
				subsection (e)(1), if—</text>
										<subparagraph id="H15576E653E0D4E3D806384D3305021B7"><enum>(A)</enum><text>such security is
				traded or cleared on a facility located in the United States, or</text>
										</subparagraph><subparagraph id="H8887FF0FA93F443EAEB0F4D5653F11AC"><enum>(B)</enum><text>any party with
				rights under such security is a United States person.</text>
										</subparagraph></paragraph></subsection><subsection id="H9DF23F950EFD484298B995E98D36F1F9"><enum>(e)</enum><header>Security and
				other definitions</header><text>For purposes of this section:</text>
									<paragraph id="H79D07C6747E640859006D2735C76472B"><enum>(1)</enum><header>In
				general</header><text>The term <term>security</term> means—</text>
										<subparagraph id="H9D299FA58EE94E7A96D2B66EE203BDB2"><enum>(A)</enum><text>any share of stock
				in a corporation,</text>
										</subparagraph><subparagraph id="H8840C0888C6B4F7B8AB9A2882ACFDC68"><enum>(B)</enum><text>any partnership or
				beneficial ownership interest in a partnership or trust,</text>
										</subparagraph><subparagraph id="HB70DFE3B3A834A8CB2EC39051B578A21"><enum>(C)</enum><text>any note, bond,
				debenture, or other evidence of indebtedness,</text>
										</subparagraph><subparagraph id="HB3C4B894D58D4E0F848C84A6B8D91761"><enum>(D)</enum><text>any evidence of an
				interest in, or a derivative financial instrument with respect to, any security
				or securities described in subparagraph (A), (B), or (C),</text>
										</subparagraph><subparagraph id="H6ED45DABEB8B417288B4825DA9119C9C"><enum>(E)</enum><text>any derivative
				financial instrument with respect to any currency or commodity, and</text>
										</subparagraph><subparagraph id="HBD6C819889E44A1F8543F2C0E0A9D37B"><enum>(F)</enum><text>any other
				derivative financial instrument any payment with respect to which is calculated
				by reference to any specified index.</text>
										</subparagraph></paragraph><paragraph id="H25D6F9B6B1A94817B6CE70F5278B006E"><enum>(2)</enum><header>Derivative
				financial instrument</header><text>The term <term>derivative financial
				instrument</term> includes any option, forward contract, futures contract,
				notional principal contract, or any similar financial instrument.</text>
									</paragraph><paragraph id="HCD6299E8271A4354BE557578BF278924"><enum>(3)</enum><header>Specified
				index</header><text>The term <term>specified index</term> means any 1 or more
				of any combination of—</text>
										<subparagraph id="HA406297DF33742E3A5D76369C0E7D898"><enum>(A)</enum><text>a fixed rate,
				price, or amount, or</text>
										</subparagraph><subparagraph id="HB91035F33CF6439A8AB5EDD13E5DFD32"><enum>(B)</enum><text>a variable rate,
				price, or amount,  </text>
										</subparagraph><continuation-text continuation-text-level="paragraph">which is
				based on any current objectively determinable information which is not within
				the control of any of the parties to the contract or instrument and is not
				unique to any of the parties’ circumstances.</continuation-text></paragraph><paragraph id="H36E7CD376E354C53952D113CCE7DDAB6"><enum>(4)</enum><header>Treatment of
				exchanges</header>
										<subparagraph id="H36900A4343B444B09CF2B3053FEEF837"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">An exchange shall be
				treated as the sale of the property transferred and a purchase of the property
				received by each party to the exchange.</text>
										</subparagraph><subparagraph id="H3528FEBC49BB48EDB4428A39BC72CCDB"><enum>(B)</enum><header>Certain deemed
				exchanges</header><text>In the case of a distribution treated as an exchange
				for stock under section 302 or 331, the corporation making such distribution
				shall be treated as having purchased such stock for purposes of this
				section.</text>
										</subparagraph></paragraph></subsection><subsection id="H292791E4645645F78224D0A27E709215"><enum>(f)</enum><header>Exceptions</header>
									<paragraph id="H60EEF347173E4D35B965756A810FC9ED"><enum>(1)</enum><header>Exception for
				initial issues</header><text display-inline="yes-display-inline">No tax shall
				be imposed under subsection (a) on any covered transaction with respect to the
				initial issuance of any security described in subparagraph (A), (B), or (C) of
				subsection (e)(1).</text>
									</paragraph><paragraph id="HCC4165D674D34146AB050C1F16B046F5"><enum>(2)</enum><header>Exception for
				certain traded short-term indebtedness</header><text>A note, bond, debenture,
				or other evidence of indebtedness which—</text>
										<subparagraph id="H2D2D610AB5AB474EB28E0AB23C0FC95D"><enum>(A)</enum><text>is traded on a
				trading facility located in the United States, and</text>
										</subparagraph><subparagraph id="H3FCE3F39046744C3A2020427478337F7"><enum>(B)</enum><text>has a fixed
				maturity of not more than 100 days,</text>
										</subparagraph><continuation-text continuation-text-level="paragraph">shall not
				be treated as described in subsection (e)(1)(C).</continuation-text></paragraph><paragraph id="H99DA486ECA684BA8B3A813C9D7FA5E3C"><enum>(3)</enum><header>Exception for
				securities lending arrangements</header><text>No tax shall be imposed under
				subsection (a) on any covered transaction with respect to which gain or loss is
				not recognized by reason of section 1058.</text>
									</paragraph></subsection><subsection id="H3C51D89FB7284F6EBBB12311F64197FE"><enum>(g)</enum><header>By whom
				paid</header>
									<paragraph id="H124FC0BBE1404A3F93701FD3F957B221"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The tax imposed by
				this section shall be paid by—</text>
										<subparagraph id="H0C9F277D9BBA4EE082F377B946AFB2F6"><enum>(A)</enum><text>in the case of a
				transaction which occurs or is cleared on a facility located in the United
				States, such facility, and</text>
										</subparagraph><subparagraph id="HFD350E6414A74377AC57C0D308C1198E"><enum>(B)</enum><text>in the case of a
				purchase not described in subparagraph (A) which is executed by a broker (as
				defined in section 6045(c)(1)) which is a United States person, such
				broker.</text>
										</subparagraph></paragraph><paragraph id="H724BFF7E0E7543AAA77F2159CB17B2C0"><enum>(2)</enum><header>Special rules
				for direct, etc., transactions</header><text>In the case of any transaction to
				which paragraph (1) does not apply, the tax imposed by this section shall be
				paid by—</text>
										<subparagraph id="H18E5958665A24AD59F194EEC1534AC12"><enum>(A)</enum><text>in the case of a
				transaction described in subsection (d)(1)—</text>
											<clause id="HE27366C2F917433FA215E90D6ADBB798"><enum>(i)</enum><text>the purchaser if
				the purchaser is a United States person, and</text>
											</clause><clause id="HB33B4676FC774A13ABC0E876D3BF5532"><enum>(ii)</enum><text>the seller if the
				purchaser is not a United States person, and</text>
											</clause></subparagraph><subparagraph id="HA665295E1E1547ACBDE63E06CE432094"><enum>(B)</enum><text>in the case of a
				transaction described in subsection (d)(2)—</text>
											<clause id="H964ED728805B4D7DB42FFD1551DC45FF"><enum>(i)</enum><text>the payor if the
				payor is a United States person, and</text>
											</clause><clause id="H193F69B9CCAB4B26891E5968068AA4D1"><enum>(ii)</enum><text>the payee if the
				payor is not a United States person.</text>
											</clause></subparagraph></paragraph></subsection><subsection commented="no" id="H526720B2BB9C47FD973DD38C2252115B"><enum>(h)</enum><header>Certain payments
				treated as separate transactions</header><text display-inline="yes-display-inline">Except as otherwise provided by the
				Secretary, any payment with respect to a security described in subparagraph
				(D), (E), or (F) of subsection (e)(1) shall be treated as a separate
				transaction for purposes of this section, including—</text>
									<paragraph id="H186D24A0D8284D1E86F26D24253E87CD"><enum>(1)</enum><text>any net initial
				payment, net final or terminating payment, or net periodical payment with
				respect to a notional principal contract (or similar financial
				instrument),</text>
									</paragraph><paragraph commented="no" id="H09F901F6C9A249179D06C95CE3FDEB9E"><enum>(2)</enum><text>any payment with
				respect to any forward contract (or similar financial instrument), and</text>
									</paragraph><paragraph id="H6AB1B0ADD2184B3CABDD35F87EF0C408"><enum>(3)</enum><text>any premium paid
				with respect to any option (or similar financial instrument).</text>
									</paragraph></subsection><subsection id="H98E92B45D94E478580613FE84495DC55"><enum>(i)</enum><header>Administration</header><text>The
				Secretary shall carry out this section in consultation with the Securities and
				Exchange Commission and the Commodity Futures Trading Commission.</text>
								</subsection><subsection id="H0A7ECAEE71324DF7BF66902087422F02"><enum>(j)</enum><header>Guidance;
				regulations</header><text>The Secretary shall—</text>
									<paragraph id="HB1A4358E6E21467794C4E5EC7198D62F"><enum>(1)</enum><text>provide guidance
				regarding such information reporting concerning covered transactions as the
				Secretary deems appropriate, and</text>
									</paragraph><paragraph id="HD9267B724AB5455CBD7ED05CA9EF8437"><enum>(2)</enum><text>prescribe such
				regulations as are necessary or appropriate to prevent avoidance of the
				purposes of this section, including the use of non-United States persons in
				such
				transactions.</text>
									</paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H45B32559B06046F7A759393610F2DB85"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of subchapters for chapter 36 of the Internal
			 Revenue Code of 1986 is amended by inserting after the item relating to
			 subchapter B the following new item:</text>
