		<section id="H2CA754D59FB94F3790EF6C67D45DE8AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Purchasing American Generates
			 Employment Act</short-title></quote>.</text>
		</section><section id="HA96118EE854E4B998EC5DFFEAB57C57A" section-type="subsequent-section"><enum>2.</enum><header>Requirement to buy
			 paper and paper products from American sources; exceptions</header>
			<subsection id="H6E302B0A81A2482BAC72E20E4E1ACA00"><enum>(a)</enum><header>Requirement</header><text>Except
			 as provided in subsections (c) through (f), funds appropriated or otherwise
			 available to a Federal department or agency may not be used for the procurement
			 of an item described in subsection (b) if the item is not grown, reprocessed,
			 reused, or produced in the United States.</text>
			</subsection><subsection id="H4387473048094B719DD131B8197D863C"><enum>(b)</enum><header>Covered
			 Items</header><text>An item referred to in subsection (a) is any article or
			 item of paper or paper products, including any of the following:</text>
				<paragraph id="HE37D3B298C6147EF81D3BE962EB559F6"><enum>(1)</enum><text>Xerographic
			 paper.</text>
				</paragraph><paragraph id="HBE33D3EC027943FFA1C1069BF3CFBE07"><enum>(2)</enum><text>Printer
			 paper.</text>
				</paragraph><paragraph id="HB08E312AA91B425B97B91A4AA5A7D682"><enum>(3)</enum><text>Copier
			 paper.</text>
				</paragraph><paragraph id="H4D65DE8DBED74AB0BD3FF2AA3FBED58D"><enum>(4)</enum><text>Fax paper.</text>
				</paragraph><paragraph id="H007CC141FF21437B8C94CC8C801A10FA"><enum>(5)</enum><text>Envelopes.</text>
				</paragraph><paragraph id="H234AAE1CE8C245FB939C254F3C96887E"><enum>(6)</enum><text>Toilet
			 tissue.</text>
				</paragraph><paragraph id="HE3366C4FFF0E42CD9A5821F46B024056"><enum>(7)</enum><text>Paper
			 towels.</text>
				</paragraph><paragraph id="HB995852D430945D99FB546C4B58ADA7E"><enum>(8)</enum><text>Toilet seat
			 covers.</text>
				</paragraph><paragraph id="HF2A37106F3894E94995B54966FEB9DBC"><enum>(9)</enum><text>Facial
			 tissues.</text>
				</paragraph><paragraph id="H5C26DCEDA3774534AAF9951AF2EAC220"><enum>(10)</enum><text display-inline="yes-display-inline">Thermal paper.</text>
				</paragraph><paragraph id="H47DFC1EA306142FFA415F92FC070AFAA"><enum>(11)</enum><text>Thermal receipt
			 paper.</text>
				</paragraph><paragraph id="H7026E64E078A44A28FA69846455F3F2A"><enum>(12)</enum><text>Security
			 paper.</text>
				</paragraph><paragraph id="HF39B0F5FDECC4BA2B4DE415A8BAA6498"><enum>(13)</enum><text>Carbonless
			 paper.</text>
				</paragraph></subsection><subsection id="HC2A6EDC91BA04D06A163B5B5A118012B"><enum>(c)</enum><header>Availability
			 Exception</header><text>Subsection (a) does not apply to the extent that the
			 head of the Federal department or agency concerned determines that satisfactory
			 quality and sufficient quantity of any such article or item described in
			 subsection (b) grown, reprocessed, reused, or produced in the United States
			 cannot be procured as and when needed at United States market prices.</text>
			</subsection><subsection id="H7A9B9BA2D48B423BA0D7DEAD090BDC05"><enum>(d)</enum><header>Exception for
			 Certain Procurements</header><text>Subsection (a) does not apply to the
			 following:</text>
				<paragraph id="H8798B77E04B3405E8E95AB9DCE7F690E"><enum>(1)</enum><text>Procurements
			 outside the United States in support of combat operations or procurements of
			 any item listed in subsection (b) in support of contingency operations.</text>
				</paragraph><paragraph id="H927537EB488A450DB7801C5B9872F19C"><enum>(2)</enum><text>Procurements by
			 vessels in foreign waters.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HD51C8C5930E2440EB1D773E0B76708DD"><enum>(e)</enum><header>Exception for
			 Commissaries, Exchanges, and Other Nonappropriated Fund
			 Instrumentalities</header><text>Subsection (a) does not apply to items
			 purchased for resale purposes in commissaries, exchanges, or nonappropriated
			 fund instrumentalities operated by the Department of Defense.</text>
			</subsection><subsection id="H057C02FAFCC342FEB3178B002E6891F1"><enum>(f)</enum><header>Applicability to
			 Contracts and Subcontracts for Procurement of Commercial
			 Items</header><text>This section is applicable to contracts and subcontracts
			 for the procurement of commercial items notwithstanding section 1906 of title
			 41, United States Code.</text>
			</subsection><subsection id="HD5AA42B6A033477B92FCBD8C78B64C5B"><enum>(g)</enum><header>Geographic
			 Coverage</header><text>In this section, the term <term>United States</term>
			 includes the possessions of the United States.</text>
			</subsection><subsection id="HAEB4F51C33CD42B79367CB2AA7C096C0"><enum>(h)</enum><header>Notification
			 Required Within 7 Days After Contract Award if Certain Exceptions
			 Applied</header><text display-inline="yes-display-inline">In the case of any
			 contract for the procurement of an item described in subsection (b), if the
			 head of the Federal department or agency concerned applies an exception set
			 forth in subsection (c) with respect to that contract, the head shall, not
			 later than 7 days after the award of the contract, post a notification that the
			 exception has been applied on the Internet site maintained by the General
			 Services Administration known as www.fbo.gov.</text>
			</subsection><subsection id="H6FA6F7EDE93A4FA18B2A98CC2E318BEB"><enum>(i)</enum><header>Federal
			 department or agency defined</header><text>In this section, the term
			 <quote>Federal department or agency</quote> has the meaning provided the term
			 <quote>Executive agency</quote> in section 105 of title 5, United States
			 Code.</text>
