		<section id="H1F33B199067E41A59307828BBC410D12" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Defense Base Act Insurance Improvement
			 Act of 2012</short-title></quote>.</text>
		</section><section id="HAC29B664E147408EA5BF7CD9289EFDD6" section-type="subsequent-section"><enum>2.</enum><header>Requirement for use of
			 Government self-insurance program for insurance under Defense Base
			 Act</header><text display-inline="no-display-inline">Section 1 of the Defense
			 Base Act (42 U.S.C. 1651) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HFBF23B3A2D794E0082102989F7BDB8F5" style="OLC">
				<subsection id="HEDA5EAC7E21B4793AF49C5FE67339A63"><enum>(g)</enum><header>Transition to
				Government self-Insurance program</header>
					<paragraph id="H16ABBE48BDC84C5EADB1A2C881C08529"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">On the effective date
				of this subsection, the requirements in paragraphs (1) through (6) of
				subsection (a) imposed on contractors to secure the payment of compensation and
				other benefits under the provisions of this Act and to maintain in full force
				and effect such security for the payment of such compensation and benefits
				shall, for injuries sustained after such effective date, be satisfied through
				the Government Defense Base Act self-insurance program.</text>
					</paragraph><paragraph id="HF6F525E7774D40559374B27FDB4E8959"><enum>(2)</enum><header>Government
				Defense Base Act self-insurance program defined</header><text display-inline="yes-display-inline">In this subsection, the term
				<quote>Government Defense Base Act self-insurance program</quote> means a
				self-insurance program developed in the implementation strategy required by
				section 3 of the Defense Base Act Insurance Improvement Act of 2012 and under
				which—</text>
						<subparagraph id="H1F04AC9462284C6C9311DDEF43E0447A"><enum>(A)</enum><text>compensation and
				benefits for injuries sustained are satisfied directly by the Government,
				without action of the contractor (or subcontractor or subordinate contractor
				with respect to such contractor); and</text>
						</subparagraph><subparagraph id="HF5A99D3C82BB4E47BE3C250F53E49CA8"><enum>(B)</enum><text>compensation and
				benefits are funded by the agencies whose contracts are affected.</text>
						</subparagraph></paragraph><paragraph id="H698E8C4B6B814E7CBC600735DC702D9B"><enum>(3)</enum><header>Effective
				date</header><text>The effective date of this subsection is the date occurring
				one year after the date of the enactment of the Defense Base Act Insurance
				Improvement Act of
				2012.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0A55DF2876B2472C95FE8D68CF68DC77"><enum>3.</enum><header>Implementation
			 strategy for Government Defense Base Act self-insurance program</header>
			<subsection id="H997AA99479D646BCB8657D9D1EA6C60D"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary of Defense and the Secretary
			 of Labor shall jointly develop and execute an implementation strategy for a
			 self-insurance program for insurance required by the Defense Base Act (42
			 U.S.C. 1651 et seq.).</text>
			</subsection><subsection id="HA2E6060551FB4280A6066BA0FBFC9540"><enum>(b)</enum><header>Matters
			 covered</header><text>The implementation strategy required under subsection (a)
			 shall address and provide a plan for the following:</text>
				<paragraph id="HC2D27F2F6B774CBD9B10F32E88F988B2"><enum>(1)</enum><text display-inline="yes-display-inline">Appropriate administration of the
			 self-insurance program, including appropriate program financing.</text>
				</paragraph><paragraph id="H125904759C48481FBC80811E4690FB9C"><enum>(2)</enum><text display-inline="yes-display-inline">Appropriate procedures for claims
			 processing, claims adjudication, and benefits delivery, taking into
			 consideration the unique circumstances of insuring overseas contractors.</text>
				</paragraph><paragraph id="HD2C5A88B81B746DEAA589DEABD18F793"><enum>(3)</enum><text>A
			 timeline and strategy to transfer existing claims covered under the Defense
			 Base Act (42 U.S.C. 1651 et seq.) and the War Hazards Compensation Act (42
			 U.S.C. 1701 et seq.) by private carriers to a Government self-insurance
			 program.</text>
				</paragraph><paragraph id="H0BE8F1BBDE5A47B5BAC5D301ABAC2701"><enum>(4)</enum><text>Recommendations
			 for any additional statutory revisions necessary to carry out the
			 strategy.</text>
				</paragraph></subsection><subsection id="H4DD790CC57394C748F0294D2B945F549"><enum>(c)</enum><header>Report and
			 deadline</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Secretary of Defense and the Secretary of Labor shall jointly
			 prepare and submit to the appropriate congressional committees a report on the
			 implementation strategy.</text>
			</subsection></section><section id="H5E0EA91AC0F640188C3C916F28CE22D9"><enum>4.</enum><header>Report</header>
			<subsection id="HD68C0402D2C5457886D3FE69F4B6F23F"><enum>(a)</enum><header>Report
			 requirement</header><text display-inline="yes-display-inline">Not later than 2
			 years after the date of the enactment of this Act, the Secretary of Defense and
			 the Secretary of Labor shall jointly prepare a report on the implementation of
			 this Act and the amendment made by this Act.</text>
			</subsection><subsection id="HAB9F12248B7344F9898E000D5CF5A5E0"><enum>(b)</enum><header>Matters
			 covered</header><text>The report shall cover, at a minimum, the following with
			 respect to the Government Defense Base Act self-insurance program (as defined
			 in the amendment made by section 2):</text>
				<paragraph id="H3C0EEC6538BE4EA7B1C42BFB47057106"><enum>(1)</enum><text>The cost savings
			 from the use of the self-insurance program.</text>
				</paragraph><paragraph id="HC0BF8D517F624F1682AA4CBE0BA20A65"><enum>(2)</enum><text>The quality of
			 administration of the self-insurance program.</text>
				</paragraph><paragraph id="H795FBD9200E847448E30C55015289D0E"><enum>(3)</enum><text>Whether the
			 delivery of benefits to injured employees and their survivors (in the case of
			 death) has improved under the self-insurance program.</text>
				</paragraph><paragraph id="H68A73FE76BF64AB18CA8C58B8E186A32"><enum>(4)</enum><text display-inline="yes-display-inline">Recommendations for improvement of the
			 self-insurance program.</text>
				</paragraph><paragraph id="H7E98BBD71E6F4CFE9A3BE67CF6A328B2"><enum>(5)</enum><text>Such other matters
			 as the Secretaries consider appropriate.</text>
				</paragraph></subsection></section><section id="H2193F7F04A394BA7BBC5D78BE0E0CC1D"><enum>5.</enum><header>Definition of
			 congressional committees</header><text display-inline="no-display-inline">In
			 this Act, the term <quote>appropriate congressional committees</quote> means
			 the following:</text>
			<paragraph id="H63CDA0EA4BD84090A4D30DF593655A48"><enum>(1)</enum><text>The Committees on
			 Armed Services of the Senate and the House of Representatives.</text>
			</paragraph><paragraph id="H84403049517B4767B185FBEB8981DF99"><enum>(2)</enum><text>The Committee on
			 Homeland Security and Governmental Affairs of the Senate and the Committee on
			 Oversight and Government Reform of the House of Representatives.</text>
			</paragraph></section></legis-body>
