		<official-title>To amend the Farm Security and Rural Investment Act of
		  2002 to modify the definition of the term <quote>biobased

		<section id="H429C30CCCD964090B09E1A31B85C8B7A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Forest Products Fairness Act of
			 2012</short-title></quote>.</text>
		</section><section id="H88556BC2FB3C4319B6BAA95093D00D33"><enum>2.</enum><header>Definition of
			 biobased product</header><text display-inline="no-display-inline">Section 9001
			 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 8101) is
			 amended—</text>
			<paragraph id="H3001A1AC0B2C4EE380F6DC9AF30C2552"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (4) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HE4A39FB70E43496BBC6B4A2231F02BAE" style="OLC">
					<paragraph id="H73CD0AF8D1B144B88EAA3FB377672098"><enum>(4)</enum><header>Biobased
				product</header>
						<subparagraph id="HB9FCD7698BA6472F86A485B2F75F55CB"><enum>(A)</enum><header>In
				general</header><text>The term <term>biobased product</term> means a product
				determined by the Secretary to be a commercial or industrial product (other
				than food or feed) that is—</text>
							<clause id="HFBBB2238E4294D63A2C51154A8E35FDA"><enum>(i)</enum><text>composed, in whole
				or in significant part, of biological products, including renewable domestic
				agricultural materials and forestry materials; or</text>
							</clause><clause id="H7B377E5FA89142BDA032E2F26F198A9E"><enum>(ii)</enum><text>an intermediate
				ingredient or feedstock.</text>
							</clause></subparagraph><subparagraph id="H9F74D0621BF344D0AF9E6FA774777A45"><enum>(B)</enum><header>Inclusion</header><text>The
				term <term>biobased product</term>, with respect to forestry materials,
				includes forest products that meet biobased content requirements,
				notwithstanding the market share the product holds, the age of the product, or
				whether the market for the product is new or
				emerging.</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H11D7EB9E8D52446191D686786BD11F95"><enum>(2)</enum><text>by redesignating
			 paragraphs (9) through (14) as paragraphs (10) through (15), respectively;
			 and</text>
			</paragraph><paragraph id="H622D28F2CE72444A98F35CECFCA0D773"><enum>(3)</enum><text>by inserting after
			 paragraph (8) the following:</text>

					<paragraph id="HC71BF1F5EDA743038883A5D1EA883F15"><enum>(9)</enum><header>Forest
				product</header>
						<subparagraph id="H2E31CDD9A28D4357B31F799C6D58E33C"><enum>(A)</enum><header>In
				general</header><text>The term <term>forest product</term> means a product made
				from materials derived from the practice of forestry or the management of
				growing timber.</text>
						</subparagraph><subparagraph id="HD096E915651747FF8BC2622FDACFB56B"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>forest product</term> includes—</text>
							<clause id="H2F4F1E0AB72E48839AAEF092E9A3DEFF"><enum>(i)</enum><text>pulp, paper,
				paperboard, pellets, and wood products; and</text>
							</clause><clause id="HB7B8F682FB8646A6B966DD8D80EF8128"><enum>(ii)</enum><text>any recycled
				products derived from forest
				materials.</text>
