		<section id="H6E11D00038124DB1B1A95D77FA3F4C68" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Manufacturing Competitiveness
			 Act of 2012</short-title></quote>.</text>
		</section><section id="H4C8EAD092C97447E9D9DB0F85BA5E19A"><enum>2.</enum><header>National
			 manufacturing competitiveness strategy</header><text display-inline="no-display-inline">Not later than June 1, 2014, and June 1,
			 2018, the President shall submit to Congress, and publish on a public website,
			 a strategy to promote growth, sustainability, and competitiveness in the
			 Nation’s manufacturing sector, create well-paid, stable jobs, enable innovation
			 and investment, and support national security.</text>
		</section><section id="H68C607EABCDD4CFBB22DBC55399027C1"><enum>3.</enum><header>Manufacturing
			 competitiveness board</header>
			<subsection id="H4C7AC7F95BF64BA39E9F0038CDE3C027"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">On the first day of
			 each of the two Presidential terms following the date of enactment of this Act,
			 there is established within the Department of Commerce an American
			 Manufacturing Competitiveness Board.</text>
			</subsection><subsection id="HD01A6126B5B44DE694D026CCAFC8B5EA"><enum>(b)</enum><header>Members</header><text display-inline="yes-display-inline">Members of the Board shall be appointed as
			 follows:</text>
				<paragraph commented="no" id="H9ACBB88ED2B041328C47923EE7A5D7B0"><enum>(1)</enum><header>Public Sector
			 Members</header><text>The President shall appoint to the Board—</text>
					<subparagraph id="HEE74C2073B014BF98A0844FFD743A5E9"><enum>(A)</enum><text>the Secretary of
			 Commerce;</text>
					</subparagraph><subparagraph id="HFAB783505D3949CE922AF5E91EE0B567"><enum>(B)</enum><text display-inline="yes-display-inline">Governors of two States, from different
			 political parties, after consulting with the National Governors Association;
			 and</text>
					</subparagraph><subparagraph id="H93B340A5E381424DA54BB78C13FC38BA"><enum>(C)</enum><text>two other members
			 who are current or former officials of the executive branch of
			 government.</text>
					</subparagraph></paragraph><paragraph id="H105BC46855914AF8AFF3302FA65FA619"><enum>(2)</enum><header>Private Sector
			 Members</header>
					<subparagraph id="HFB695E7E9BED4FCCA373109DB0040EBD"><enum>(A)</enum><header>Criteria</header><text>Ten
			 individuals from the private sector shall be appointed to the Board in
			 accordance with subparagraph (B) from among individuals with experience in the
			 areas of—</text>
						<clause id="H437A624455574BDDBC3DD0AC1CFF0F0B"><enum>(i)</enum><text display-inline="yes-display-inline">managing manufacturing companies, including
			 businesses with fewer than 100 employees;</text>
						</clause><clause id="H22F821FCC43B4E0FABB3FC3A07FBE99F"><enum>(ii)</enum><text>managing supply
			 chain providers;</text>
						</clause><clause id="HD2611DEF3041419B9DEB4362F8EEE183"><enum>(iii)</enum><text>managing labor
			 organizations;</text>
						</clause><clause id="H0A310F5885D24E0094AB0E8F13A5A326"><enum>(iv)</enum><text>workforce
			 development;</text>
						</clause><clause id="H168E5E2F8C3B48078B42539C3DEB6A93"><enum>(v)</enum><text>finance;</text>
						</clause><clause id="H6B24EE9F37994624AA0D3750A84AF5E1"><enum>(vi)</enum><text display-inline="yes-display-inline">analyzing manufacturing policy and
			 competitiveness;</text>
						</clause><clause id="H8F0CA28B7DFE40E49DAE7A51823CAE69"><enum>(vii)</enum><text>conducting
			 manufacturing-related research and development; and</text>
						</clause><clause id="H33CE430B6797457390F4F9EF53FE4ADF"><enum>(viii)</enum><text>the defense
			 industrial base.</text>
						</clause></subparagraph><subparagraph id="HE7375554E5C449AC9DC28103B0B74968"><enum>(B)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Speaker of the House of Representatives
			 and the majority leader of the Senate shall each appoint 3 members to the
			 Board. The minority leader of the House of Representatives and the minority
			 leader of the Senate shall each appoint 2 members to the Board.</text>
					</subparagraph></paragraph></subsection><subsection id="HE9AE2778F49D48F9A92B5498F34BB3F2"><enum>(c)</enum><header>Termination</header><text display-inline="yes-display-inline">The Board shall terminate 60 days after
			 submitting its final report pursuant to section 4(c)(3).</text>
			</subsection><subsection commented="no" id="H55994F395EAA4EEBA3EC93761F0BC443"><enum>(d)</enum><header>Co-chairmen</header><text display-inline="yes-display-inline">The co-chairmen of the Board shall be the
			 Secretary of Commerce (or the designee of the Secretary) and a member elected
			 by the private sector members of the Board appointed pursuant to subsection
			 (b)(2).</text>
			</subsection><subsection id="HA0F5EC0451A34422B161F9DCA6F4F218"><enum>(e)</enum><header>Subgroups</header><text>The
			 Board may convene subgroups to address particular industries, policy topics, or
			 other matters and to take advantage of the expertise of other individuals and
			 entities in matters to be addressed by the Board. Such subgroups may include
			 members representing any of the following:</text>
				<paragraph id="H22CCC7B10D884F54B7A8A79D931F94ED"><enum>(1)</enum><text>Other Federal
			 agencies, as the co-chairmen determine appropriate.</text>
				</paragraph><paragraph id="H569B5789FEAB414F856E254C200C6D9A"><enum>(2)</enum><text>State, tribal, and
			 local governments.</text>
				</paragraph><paragraph id="H5CEEF2CFB2E643EA80F55E642FFCD105"><enum>(3)</enum><text>The private
			 sector.</text>
				</paragraph></subsection><subsection id="H14DF18FD0E1F459FA7AA64E956CF8D5E"><enum>(f)</enum><header>Quorum</header><text>Ten
			 members of the Board shall constitute a quorum for the transaction of business
			 but a lesser number may hold hearings with the agreement of the
			 co-chairmen.</text>
			</subsection><subsection id="H06FE58B8498C43DE8AED28086E569CEE"><enum>(g)</enum><header>Meetings and
			 hearings</header>
				<paragraph id="H4B8DA29956C5411EBD251685B5DFEFBC"><enum>(1)</enum><header>Timing and
			 frequency of meetings</header><text>The Board shall meet at the call of the
			 co-chairmen, and not fewer than 2 times.</text>
				</paragraph><paragraph id="H4BDFA4E8E1F74331A5F40E209768A141"><enum>(2)</enum><header>Public hearings
			 required</header><text>The Board shall convene public hearings to solicit views
			 on the Nation’s manufacturing sector and recommendations for the national
			 manufacturing competitiveness strategy.</text>
				</paragraph><paragraph id="HBC1FE2C92EEC497793F5F37ACE0474AE"><enum>(3)</enum><header>Locations of
			 public hearings</header><text>The locations of public hearings convened under
			 paragraph (2) shall ensure the inclusion of multiple regions and industries of
			 the manufacturing sector.</text>
				</paragraph></subsection><subsection id="H3533A06916F64876A8F2B70A7D3915D6"><enum>(h)</enum><header>Application of
			 Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act
			 (5 U.S.C. App.), other than section 14 of such Act, shall apply to the Board,
			 including any subgroups established pursuant to subsection (e).</text>
			</subsection></section><section id="H539BE48EB4FB4C33A02E69040DF223C1"><enum>4.</enum><header>Duties of the
			 Board</header>
			<subsection id="HF04D145964854FF2B6BB9074C5851CFE"><enum>(a)</enum><header>In
			 General</header><text>The Board shall—</text>
				<paragraph id="H5D5C1E1CBEC743B68DC9A10F3E893E3E"><enum>(1)</enum><text>advise the
			 President on issues affecting the Nation’s manufacturing sector;</text>
				</paragraph><paragraph id="HB1AA6F0AF41945B18EFE16A425262665"><enum>(2)</enum><text>conduct a
			 comprehensive analysis in accordance with subsection (b); and</text>
				</paragraph><paragraph id="HF09F02F296664F42B955F5CF2A5F4724"><enum>(3)</enum><text>develop a national
			 manufacturing competitiveness strategy in accordance with subsection
			 (c).</text>
				</paragraph></subsection><subsection id="HAF620F7FFE764EEEB7BD566EBAEA377F"><enum>(b)</enum><header>Comprehensive
			 Analysis</header><text display-inline="yes-display-inline">In developing a
			 national manufacturing competitiveness strategy under subsection (c), the Board
			 shall conduct a comprehensive analysis of the Nation’s manufacturing sector,
			 taking into consideration analyses, data, and other information previously
			 compiled, as well as relevant reports, plans, or recommendations issued by
			 Federal agencies, Federal advisory boards, and the private sector. Such
			 analysis shall, to the extent feasible, address—</text>
				<paragraph id="HFA89DE0619B141E8AA94C27B93766F4C"><enum>(1)</enum><text>the value and role
			 of manufacturing in the Nation’s economy, security, and global
			 leadership;</text>
				</paragraph><paragraph id="H9AAA8E143D0742FDA9A1FBEFCD40D1FD"><enum>(2)</enum><text display-inline="yes-display-inline">the current domestic and international
			 environment for the Nation’s manufacturing sector, and any subsector identified
			 by the Board as warranting special study for competitiveness or for comparison
			 purposes;</text>
				</paragraph><paragraph id="H42F425E9DFA4475D891AF4FE23872942"><enum>(3)</enum><text>Federal, State,
			 tribal, and local policies, programs, and conditions that affect
			 manufacturing;</text>
				</paragraph><paragraph id="HD59A1DE384004A07877EEE09A82EB888"><enum>(4)</enum><text display-inline="yes-display-inline">a summary of the manufacturing policies and
			 strategies of the Nation’s 10 largest trading partners, to the extent
			 known;</text>
				</paragraph><paragraph id="H055B8F76F3554BC18EA0FDA75BC01434"><enum>(5)</enum><text display-inline="yes-display-inline">new, emerging, or evolving markets,
			 technologies, and products for which the Nation’s manufacturers could
			 compete;</text>
				</paragraph><paragraph id="HF38B3D1F93974FDAB3025C0DC62FA98C"><enum>(6)</enum><text display-inline="yes-display-inline">the identification of redundant or
			 ineffective government programs related to manufacturing, as well as any
			 programs that have improved manufacturing competitiveness;</text>
				</paragraph><paragraph id="H0A67A02B855E4DD0A06D5339BB50F2E7"><enum>(7)</enum><text>the short- and
			 long-term forecasts for the Nation’s manufacturing sector, and forecasts of
			 expected national and international trends and factors likely to affect such
			 sector in the future;</text>
				</paragraph><paragraph id="HB73744BBCB4A493EA5CC2EF5B6363183"><enum>(8)</enum><text display-inline="yes-display-inline">the manner in which Federal agencies share
			 information and views with respect to the effects of proposed or active
			 regulations or other executive actions on the Nation’s manufacturing sector and
			 its workforce;</text>
				</paragraph><paragraph id="H06BEE275445A4B23BCED371F1CDCB193"><enum>(9)</enum><text>the
			 recommendations of the Department of Commerce Manufacturing Council, whether
			 such recommendations have been implemented, and the effect of such
			 recommendations; and</text>
				</paragraph><paragraph id="H8C88C6857D3245CCA52EC2D5F07410DC"><enum>(10)</enum><text display-inline="yes-display-inline">any other matters affecting the growth,
			 stability, and sustainability of the Nation’s manufacturing sector or the
			 competitiveness of the Nation’s manufacturing environment, particularly
			 relative to that of other nations, including—</text>
					<subparagraph id="HC8015E0030FD419DB71E7CBA7CF35ABA"><enum>(A)</enum><text display-inline="yes-display-inline">workforce skills, gaps, and
			 development;</text>
					</subparagraph><subparagraph id="HF940E23E19BC4CCDADAE9440EC526FE9"><enum>(B)</enum><text display-inline="yes-display-inline">productivity and the extent to which
			 national economic statistics related to manufacturing accurately measure
			 manufacturing output and productivity growth;</text>
					</subparagraph><subparagraph id="HFF76D1087C844DADB966951F8E30F23B"><enum>(C)</enum><text>trade policy and
			 balance;</text>
					</subparagraph><subparagraph id="H271A4318F7D94D739702DAA4AD9A9629"><enum>(D)</enum><text display-inline="yes-display-inline">energy policy, forecasts, and
			 developments;</text>
					</subparagraph><subparagraph id="HF2E3603AB03E4CD8B929479AF133FC2A"><enum>(E)</enum><text>expenditures on
			 basic and applied research related to manufacturing technology;</text>
					</subparagraph><subparagraph id="H11B5409B975E4CC28973532BC4873BCC"><enum>(F)</enum><text>programs to help
			 small and mid-sized manufacturers become more competitive;</text>
					</subparagraph><subparagraph id="HB44C47A56A2B496C83FB0AD4B79D6A42"><enum>(G)</enum><text display-inline="yes-display-inline">the impact of Federal statutes and
			 regulations;</text>
					</subparagraph><subparagraph id="H152E16FCA6984E488FE7B855CC1F8EB2"><enum>(H)</enum><text>the impact of
			 domestic and international monetary policy;</text>
					</subparagraph><subparagraph id="H05B009375E27472496A6BA5CE2921080"><enum>(I)</enum><text>the impact of
			 taxation;</text>
					</subparagraph><subparagraph id="H90AAF5B345924C55B86FDFDEA19E84D2"><enum>(J)</enum><text display-inline="yes-display-inline">financing and investment, including
			 challenges associated with commercialization and scaling up of
			 production;</text>
					</subparagraph><subparagraph id="H5DC224D77C04441F853FE7BA6897B282"><enum>(K)</enum><text>research and
			 development;</text>
					</subparagraph><subparagraph id="H219A7BF01C4C4D3CB9A742C021CFC436"><enum>(L)</enum><text>job creation and
			 employment disparities;</text>
					</subparagraph><subparagraph id="HCDC49A5F5CDC40ADABBE5E8746D6F9EA"><enum>(M)</enum><text display-inline="yes-display-inline">levels of domestic production;</text>
					</subparagraph><subparagraph id="HF72393E5126E41B3B20E7548D3382C50"><enum>(N)</enum><text>adequacy of the
			 industrial base for maintaining national security;</text>
					</subparagraph><subparagraph id="H64D72A5484264189B8D74CF16609656F"><enum>(O)</enum><text display-inline="yes-display-inline">protections for intellectual property and
			 the related policies, procedures, and law on technology transfer; and</text>
					</subparagraph><subparagraph id="H9D5DCF57C659461A956C6806C7A4B04A"><enum>(P)</enum><text>customs
			 enforcement and counterfeiting.</text>
					</subparagraph></paragraph></subsection><subsection id="H4CEE21793F8D446A90655A6DC14122D7"><enum>(c)</enum><header>National
			 Manufacturing Competitiveness Strategy</header>
				<paragraph id="H1B501456DBFA4B209C2A2F5E73507DC8"><enum>(1)</enum><header>Development</header><text>The
			 Board shall develop a national manufacturing competitiveness strategy, based
			 on—</text>
					<subparagraph id="HD0ADA3542AAD4CE4BECAE9F5161A6CDC"><enum>(A)</enum><text>the results of the
			 comprehensive analysis conducted under subsection (b); and</text>
					</subparagraph><subparagraph id="H428029014DA14C3E93C34B78BAE7B077"><enum>(B)</enum><text>any other
			 information, studies, or perspectives that the Board determines to be
			 appropriate.</text>
					</subparagraph></paragraph><paragraph id="HAE864B7E474646E7AFC1B48FE71B7D43"><enum>(2)</enum><header>Goals and
			 recommendations</header>
					<subparagraph id="HB2ED6F79BCE14547840FD6881D18CC25"><enum>(A)</enum><header>Goals</header><text display-inline="yes-display-inline">The Board shall include in the national
			 manufacturing competitiveness strategy short- and long-term goals for improving
			 the competitiveness conditions of the Nation’s manufacturing environment,
			 taking into account the matters addressed in the comprehensive analysis
			 conducted under subsection (b).</text>
					</subparagraph><subparagraph id="HA1B2802BD3EC4D73A308A9F08F5729B3"><enum>(B)</enum><header>Recommendations</header><text>The
			 Board shall include in the national manufacturing competitiveness strategy
			 recommendations for achieving the goals provided under subparagraph (A). Such
			 recommendations may propose—</text>
						<clause id="H119E7E994FD24121B8C7443C407AE280"><enum>(i)</enum><text>actions to improve
			 manufacturing competitiveness to be taken by the President, Congress, State and
			 local governments, and the private sector;</text>
						</clause><clause id="H83DAF568FF804B06AA377F6C82A6AB82"><enum>(ii)</enum><text display-inline="yes-display-inline">actions to improve government policies and
			 coordination among entities developing such policies;</text>
						</clause><clause id="H5D9C390E553A4F2996764A9B131484FD"><enum>(iii)</enum><text>the
			 consolidation or elimination of government programs;</text>
						</clause><clause id="HBC83DD22496741069BBCBE2F64D5471C"><enum>(iv)</enum><text>actions to
			 improve government interaction with the manufacturing sector and communication
			 regarding the effects of proposed or active government regulations or other
			 executive actions on the manufacturing sector and its workforce;</text>
						</clause><clause id="H00BBE8A903EA4DEF814047F32F5C6C4F"><enum>(v)</enum><text>the
			 reform or elimination of regulations that place the United States manufacturing
			 sector at a disadvantage relative to other nations; and</text>
						</clause><clause id="H575AD2353DB14FCD8CD8650DB96BA25F"><enum>(vi)</enum><text display-inline="yes-display-inline">actions to reduce business uncertainty,
			 including, where appropriate, finalization of regulations applicable to
			 manufacturers.</text>
						</clause></subparagraph></paragraph><paragraph id="H17132DAA103E4C8FBC8BAA273F5A1F9A"><enum>(3)</enum><header>Report</header>
					<subparagraph id="H46912CDC9C4149868365FED12561F67D"><enum>(A)</enum><header>Draft</header><text display-inline="yes-display-inline">Not later than 150 days before the date on
			 which the President is required to submit to Congress a report containing a
			 national manufacturing competitiveness strategy under section 2, the Board
			 shall publish in the Federal Register and on a public website a draft report
			 containing a national manufacturing competitiveness strategy. At the same time,
			 the Board shall make available to the public the comprehensive analysis
			 required by subsection (b) and any underlying data or materials necessary to an
			 understanding of the conclusions reached.</text>
					</subparagraph><subparagraph id="H3877F40F6AEE47648D29CC652E02B367"><enum>(B)</enum><header>Public comment;
			 review and revision</header><text>A draft report published under subparagraph
			 (A) shall remain available for public comment for a period of not less than 30
			 days from the date of publication. The Board shall review any comments received
			 regarding such draft report and may revise the draft report based upon those
			 comments.</text>
					</subparagraph><subparagraph id="H0DD3FE8C87D14BF287B87D177574F9A7"><enum>(C)</enum><header>Publication</header><text>Not
			 later than 60 days before the date on which the President is required to submit
			 to Congress a report containing a national manufacturing competitiveness
			 strategy under section 2, the Board shall submit to the President for review
			 and revision a final report containing a national manufacturing competitiveness
			 strategy, and shall publish such final report on a public website.</text>
					</subparagraph><subparagraph id="HC4004286D18A423AA98C64D7EAEECE08"><enum>(D)</enum><header>Contents of
			 report</header><text>The final report submitted under subparagraph (C) shall,
			 to the extent feasible, include—</text>
						<clause id="HB2EC6F1945B04AB6A9BE3E7602A80A88"><enum>(i)</enum><text>an
			 estimate of the short- and long-term Federal Government outlays and revenue
			 changes necessary to implement the national manufacturing competitiveness
			 strategy and an estimate of savings that may be derived from implementation of
			 the national manufacturing competitiveness strategy;</text>
						</clause><clause id="H9FE1D32018C1414E87FCD756D7E18371"><enum>(ii)</enum><text>a
			 detailed explanation of the methods and analysis used to determine the
			 estimates included under clause (i);</text>
						</clause><clause id="H050DAF310BE64E03A49CCA8904F8A979"><enum>(iii)</enum><text>recommendations
			 regarding how to pay for the cost of implementation estimated under clause (i);
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H7B6DDEE405CD427D9F6AF5E8665CFCB0"><enum>(iv)</enum><text>a plan for how
			 the recommendations included in the report will be implemented and who is or
			 should be responsible for the implementation.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H152ABCA98B8845EC96A542196A59FAF7"><enum>(d)</enum><header>Consultation;
			 nonduplication of efforts</header><text display-inline="yes-display-inline">The
			 Board shall consult with and not duplicate the efforts of the Defense Science
			 Board, the President’s Council of Advisors on Science and Technology, the
			 Manufacturing Council established by the Department of Commerce, the Economic
			 Security Commission, the Labor Advisory Committee for Trade Negotiations and
			 Trade Policy, and other relevant governmental entities conducting any
			 activities related to manufacturing.</text>
			</subsection></section><section id="HD62E177D6F1841BDB0E39783FE1B4B39"><enum>5.</enum><header>Requirement to
			 consider national manufacturing competitiveness strategy in
			 budget</header><text display-inline="no-display-inline">In preparing the budget
			 for each of the fiscal years from fiscal year 2016 through fiscal year 2022
			 under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section
			 1105(a)</external-xref> of title 31, United States Code, the President shall
			 include information regarding the consistency of the budget with the goals and
			 recommendations included in the national manufacturing competitiveness
			 strategy.</text>
		</section><section id="HFF723D2B6A594A12A8EC0462070797B7"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H06F09A7C757A4C38BCCF68CF5AAB4289"><enum>(1)</enum><header>Board</header><text display-inline="yes-display-inline">The term <quote>Board</quote> means—</text>
				<subparagraph id="H1F07490D439843A8A2D72042535101FF"><enum>(A)</enum><text display-inline="yes-display-inline">during the first Presidential term that
			 begins after the date of enactment of this Act, the American Manufacturing
			 Competitiveness Board established by section 3(a) on the first day of such
			 term; and</text>
				</subparagraph><subparagraph id="H37CCC3F0984D4ED2894B03BBFE6A3A14"><enum>(B)</enum><text display-inline="yes-display-inline">during the second Presidential term that
			 begins after the date of enactment of this Act, the American Manufacturing
			 Competitiveness Board established by section 3(a) on the first day of such
			 term.</text>
				</subparagraph></paragraph><paragraph commented="no" id="H3E288E04E52A40639198F7809253C25D"><enum>(2)</enum><header>Private
			 Sector</header><text>The term <quote>private sector</quote> includes labor,
			 industry, industry associations, academia, universities, trade associations,
			 nonprofit organizations, and other appropriate nongovernmental groups.</text>
