		<section id="H5172D3A15D5341BAA64277C94E4C472E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Size Standard
			 Flexibility Act of 2011</short-title></quote>.</text>
		</section><section id="H4F1355656D2E496BA5594934FCBDB0E1"><enum>2.</enum><header>Establishment and
			 approval of small business concern size standards by Chief Counsel for
			 Advocacy</header>
			<subsection id="HBE4744CB68D946D6B4A9A302D884125A"><enum>(a)</enum><header>In
			 general</header><text>Subparagraph (A) of section 3(a)(2) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.
			 632(a)(2)(A)) is amended to read as follows:</text>
				<quoted-block act-name="Small Business Act" id="HB3C55CBD7D654C2BBF18FFA06C6464D6">
					<subparagraph id="HF8073E2DE8FD4AC1A71BB27AB9FF603D"><enum>(A)</enum><header>In
				general</header><text>In addition to the criteria specified in paragraph
				(1)—</text>
						<clause id="HCA5309F513F141E98E6872DAB3EFD3EA"><enum>(i)</enum><text>the Administrator
				may specify detailed definitions or standards by which a business concern may
				be determined to be a small business concern for purposes of this Act or the
				<act-name parsable-cite="SBIA">Small Business Investment Act of
				1958</act-name>; and</text>
						</clause><clause id="H53064B104BFF420DB57A588AABC1DEDF"><enum>(ii)</enum><text>the Chief Counsel
				for Advocacy may specify such definitions or standards for purposes of any
				other
				Act.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H160722F7D4B94186A0378DD3CCD71A48"><enum>(b)</enum><header>Approval by
			 Chief Counsel</header><text>Clause (iii) of section 3(a)(2)(C) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.
			 632(a)(2)(C)(iii)) is amended to read as follows:</text>
				<quoted-block act-name="Small Business Act" id="H2E1314B2D7464D03A81CBD815BEE7D55">
					<clause id="H5B990F8165F847B08BF47859C878D0CD"><enum>(iii)</enum><text>except in the
				case of a size standard prescribed by the Administrator, is approved by the
				Chief Counsel for
				Advocacy.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H80452D9F42D44776B4E35F0082A6A044"><enum>(c)</enum><header>Industry
			 variation</header><text>Paragraph (3) of section 3(a) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.
			 632(a)(3)) is amended—</text>
				<paragraph id="H45E90DDD883443D2BDFCF253B2E1E5D2"><enum>(1)</enum><text>by inserting
			 <quote>or Chief Counsel for Advocacy, as appropriate</quote> before
			 <quote>shall ensure</quote>; and</text>
				</paragraph><paragraph id="HF01340F255634185A98A4C716D4F6A43"><enum>(2)</enum><text>by inserting
			 <quote>or Chief Counsel for Advocacy</quote> before the period at the
			 end.</text>
				</paragraph></subsection><subsection id="H0012700C23DB4D35B56376222C59CBCD"><enum>(d)</enum><header>Judicial review
			 of size standards approved by Chief Counsel</header><text>Section 3(a) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 632(a))
			 is amended by adding at the end the following new paragraph:</text>
				<quoted-block act-name="Small Business Act" id="H820F2F38403B46258CC54D6BABD9C65C">
					<paragraph id="H4F2118CD62E24F7DA23D054460E0147B"><enum>(6)</enum><header>Judicial review
				of standards approved by Chief Counsel</header><text>In the case of an action
				for judicial review of a rule which includes a definition or standard approved
				by the Chief Counsel for Advocacy under this subsection, the party seeking such
				review shall be entitled to join the Chief Counsel as a party in such
				action.</text>
