		  Investment Act of 1958 to provide for additional loan programs for
		  veteran-owned small businesses, and for other purposes.</official-title>

		<section id="H1B28CB0E6A0F45BA9F6CB3101EFF13B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans Access to Capital Act of
			 2012</short-title></quote>.</text>
		</section><section id="HC36CD0CA215E469A812CAE0F44780250"><enum>2.</enum><header>Loan Program for
			 Veterans for certain projects</header><text display-inline="no-display-inline">Section 502 of the Small Business Investment
			 Act of 1958 (15 U.S.C. 696) is amended—</text>
			<paragraph id="H9173DFB934824B6F9E38374DCAC608FA"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1) by striking <quote>The Administration</quote> and
			 inserting <quote>(a) <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text>The Administration</quote>; and</text>
			</paragraph><paragraph id="HFB317606661B428383AF6AC5D26227F5"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H418CA12A519D4644974F8EB3D7CAC1D0" style="OLC">
					<subsection id="HEEF49AE9695041298BD636B095773ACE"><enum>(b)</enum><header>Loan Program for
				Veterans</header>
						<paragraph id="H876A7FEF35DC4F24B35FCD9F99AD0A10"><enum>(1)</enum><header>Loan
				program</header><text display-inline="yes-display-inline">From amounts made
				available under subsection (a), the Administrator of the Small Business
				Administration may make loans each fiscal year, totalling not more than 20
				percent of such amounts, directly to small business concerns owned and
				controlled by veterans (as such term is defined in section 3(q)(3) of the Small
				Business Act (15 U.S.C. 632(q)(3)).</text>
						</paragraph><paragraph id="HAEE479037CE04C158346E0B85A328F4A"><enum>(2)</enum><header>Terms and
				conditions</header><text display-inline="yes-display-inline">The Administrator
				may make loans under this subsection only in accordance with the
				following:</text>
							<subparagraph id="HA9D4B33A70054466BE47968507EBF4F9"><enum>(A)</enum><header>Use of
				funds</header><text display-inline="yes-display-inline">The proceeds of the
				loan shall be used only for a project with a sound business purpose approved by
				the Administration.</text>
							</subparagraph><subparagraph id="H42918AEE3EF247C395719B6B7FE19462"><enum>(B)</enum><header>Maximum
				amount</header><text>Loans made by the Administration under this subsection
				shall be limited to—</text>
								<clause id="HCE0A3535DD704DCAB794F3331E95CD2B"><enum>(i)</enum><text>$5,000,000, if the
				loan proceeds will not be directed toward a goal or project described in clause
				(ii), (iii), (iv), or (v);</text>
								</clause><clause id="HA6A1A3574FBE4D9685CC3EF4C37F6137"><enum>(ii)</enum><text>$5,000,000, if
				the loan proceeds will be directed toward 1 or more of the public policy goals
				described under section 501(d)(3);</text>
								</clause><clause id="H332CFA2FE1134105941B69D3590F5BE3"><enum>(iii)</enum><text>$5,500,000 for
				each project of a small manufacturer;</text>
								</clause><clause id="H36D64FF3CC5B4CF0A4DD5079963B345E"><enum>(iv)</enum><text>$5,500,000 for
				each project that reduces the borrower's energy consumption by at least 10
				percent; and</text>
								</clause><clause id="HAFBE912971E541E7B00491D2453D72B2"><enum>(v)</enum><text>$5,500,000 for
				each project that generates renewable energy or renewable fuels, such as
				biodiesel or ethanol production.</text>
								</clause></subparagraph><subparagraph id="H88DC90342DE24DA8BC8976EECEEA1264"><enum>(C)</enum><header>Funding by the
				small business concern</header><text display-inline="yes-display-inline">The
				small business concern (or its owners, stockholders, or affiliates) shall
				provide—</text>
								<clause id="H11969E6D3D1F4757A2110D0A832E2D1D"><enum>(i)</enum><text>at
				least 15 percent of the total cost of the project financed, if the small
				business concern has been in operation for a period of 2 years or less;</text>
								</clause><clause id="HBC8496D17CB247EA8ABCBB8B35CB4303"><enum>(ii)</enum><text>at least 15
				percent of the total cost of the project financed if the project involves the
				construction of a limited or single purpose building or structure;</text>
								</clause><clause id="HF442B7978268485BB0B7300EFA99BC61"><enum>(iii)</enum><text>at least 20
				percent of the total cost of the project financed if the project involves both
				of the conditions set forth in clauses (i) and (ii); or</text>
								</clause><clause id="HC2AA30FAB0794BEABE8DAB3B67562707"><enum>(iv)</enum><text>at least 10
				percent of the total cost of the project financed, in all other circumstances,
				at the discretion of the Administrator.</text>
								</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HAF3617AEAB12466C8C90668546A02D74"><enum>(D)</enum><header>Collateralization</header><text display-inline="yes-display-inline">Collateral provided by the small business
				concern shall be so provided in accordance with the requirements of subsection
				(a)(3)(E).</text>
							</subparagraph><subparagraph id="H1B581A59BB344A06842C1D7E1B8A7B1D"><enum>(E)</enum><header>Additional
				requirements</header><text display-inline="yes-display-inline">The small
				business concern shall comply with the requirements of paragraphs (4), (5),
				(6), and (7) of subsection (a), except that—</text>
								<clause id="H088AA037638C4D31A046ACB59D473D07"><enum>(i)</enum><text>for purposes of
				subparagraph (C)(i)(I) of such paragraph (7), the term <term>borrower</term>
				means a small business concern that submits an application to the Administrator
				under this subsection; and</text>
								</clause><clause id="H267AA1D920E84EFBB3870D4AD93167F7"><enum>(ii)</enum><text>clauses (iii)
				through (vi) of such paragraph (7)(C) shall not apply in the case of that small
				business concern.</text>
								</clause></subparagraph></paragraph><paragraph id="H66C673CE64464AA9A99A1A624D90C481"><enum>(3)</enum><header>Definition</header><text>As
				used in this subsection, the term <term>small manufacturer</term> means a small
				business concern—</text>
							<subparagraph id="HA1678DB801764B61B464F3A4797FF1D1"><enum>(A)</enum><text>the primary
				business of which is classified in sector 31, 32, or 33 of the North American
				Industrial Classification System; and</text>
							</subparagraph><subparagraph id="H314EE4E67A42440D9D07F83F8BE9C15B"><enum>(B)</enum><text>all of the
				production facilities of which are located in the United
				States.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HA345A68AD24B4F3E8379A71FDC966667"><enum>3.</enum><header>Loan Program for
			 Veterans</header><text display-inline="no-display-inline">Section 7(a) of the
			 Small Business Act is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H6DBFEEE73D7D45F0AFF90977457B036F" style="OLC">
				<paragraph id="H3A0D59EDBA6A4119883DEDE5D377669F"><enum>(36)</enum><header>Loan program
				for veterans</header><text display-inline="yes-display-inline">Not more than 20
				percent of loans made under this subsection in a fiscal year may be loans under
				this paragraph. The Administrator may make loans each fiscal year to small
				business concerns owned and controlled by veterans (as such term is defined in
				section 3(q)(3)) in the same manner as loans otherwise made under this
				subsection, except that such loans may only be made directly by the
				Administrator to the small business
				concern.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HCA78E17CBB604E45802A4EA1E982F020"><enum>4.</enum><header>Veteran credit
			 score relief</header>
			<subsection id="HBDE239C54BBC440B8043169D10F8F1CA"><enum>(a)</enum><header>Small Business
			 Act</header><text display-inline="yes-display-inline">The Small Business Act
			 (15 U.S.C. 631 et seq.) is amended by redesignating section 45 as section 46
			 and inserting after section 44 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9A5243A014654C65AAB1F847C69222E9" style="OLC">
					<section id="H8E0A3A2CBD9F4180A21FE13B4BD939E0"><enum>45.</enum><header>Veteran credit
				score relief</header><text display-inline="no-display-inline">For purposes of
				loans or loan guarantees under this Act to small business concerns owned and
				controlled by veterans or to small business concerns owned and controlled by
				service-disabled veterans, if a veteran has complied with such conditions as
				the Administrator may by rule require, the Administrator shall reduce any
				applicable requirement relating to a veteran’s credit score. No decrease in
				credit score attributable to a violation of the Servicemembers Civil Relief Act
				(50 U.S.C. App. 501 et seq.) shall
				apply.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H07052CBEFB2B495E8F05555214355017"><enum>(b)</enum><header>Small Business
			 Investment Act of 1958</header><text display-inline="yes-display-inline">Title
			 I of the Small Business Investment Act of 1958 (15 U.S.C. 661 et seq.) is
			 amended by inserting after section 103 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7920764910B54F6CBC028280F8D1123B" style="OLC">
					<section id="H411BC1E9C5964B09A795DDDE1AD0AFDB"><enum>104.</enum><header>Veteran credit
				score relief</header><text display-inline="no-display-inline">For purposes of
				loans or loan guarantees under this Act to small business concerns owned and
				controlled by veterans or to small business concerns owned and controlled by
				service-disabled veterans, if a veteran has complied with such conditions as
				the Administrator may by rule require, the Administrator shall reduce any
				applicable requirement relating to a veteran’s credit score. No decrease in
				credit score attributable to a violation of the Servicemembers Civil Relief Act
				(50 U.S.C. App. 501 et seq.) shall
				apply.</text>
