		<official-title>To amend the Small Business Act to permit agencies to
		  count certain contracts toward contracting goals.</official-title>

		<section id="H5B434575A38441FD810C0A19F77BC958" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Fairness Act of
			 2012</short-title></quote>.</text>
		</section><section id="H0EA14FB765124AD595AB8C550BF4FFCB"><enum>2.</enum><header>Teaming
			 arrangements and agency contracting goals</header><text display-inline="no-display-inline">Section 15(g) of the Small Business Act (15
			 U.S.C. 644(g)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HE8FC945DCE08443CA8BA940C09FFB5DD" style="OLC">
				<paragraph id="H04A8B9C84DBD4CB1B3B37FFCFF37AD6F"><enum>(3)</enum><header>Teaming
				arrangements and agency contracting goals</header>
					<subparagraph id="HD72DB250D7254A5FA2911793A23FD2D0"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph—</text>
						<clause id="H2188A28421B440EEB769F3FB9730D268"><enum>(i)</enum><text display-inline="yes-display-inline">the term <term>covered small business
				concern</term> means—</text>
							<subclause id="HEE07AF3FB83E4343B07FF158F1199918"><enum>(I)</enum><text display-inline="yes-display-inline">a small business concern owned and
				controlled by service-disabled veterans;</text>
							</subclause><subclause id="HB7C148F623A344659D59D50D3B30E7EC"><enum>(II)</enum><text display-inline="yes-display-inline">a small business concern owned and
				controlled by socially and economically disadvantaged individuals, as defined
				in section 8(d)(3)(C);</text>
							</subclause><subclause id="HCA8DEA3EB38049CC9888ADC25DD80465"><enum>(III)</enum><text display-inline="yes-display-inline">a small business concern owned and
				controlled by women, as defined in section 8(d)(3)(D); or</text>
							</subclause><subclause id="HB9691E133E4341CE87396D734105F826"><enum>(IV)</enum><text display-inline="yes-display-inline">a qualified HUBZone small business concern;
				and</text>
							</subclause></clause><clause id="H4C254796648141C5B595E9E63C2E18C4"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>teaming arrangement
				entity</term> means a prime contractor under a contractor team arrangement, as
				defined in section 9.601 of the Federal Acquisition Regulation, as in effect on
				October 1, 2009.</text>
						</clause></subparagraph><subparagraph id="HDD4AD53496F5461A854340EDC5A5D88E"><enum>(B)</enum><header>Contracting
				goals</header><text>If a covered small business concern performs the
				obligations of a teaming arrangement entity under a contract between the
				teaming arrangement entity and a Federal agency, the head of the Federal agency
				may deem the contract to be a contract awarded to the covered small business
				concern for purposes of determining whether the Federal agency has met the
				goals established by the head of the Federal agency under paragraph
				(2).</text>
