		<section display-inline="no-display-inline" id="H32F56CE90FA0491C88AF3B0DF47BE4D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>No Parole for Sex Offenders
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HA95F592381954631961B079C699A537E" section-type="subsequent-section"><enum>2.</enum><header>Reduction of grant
			 amounts</header>
			<subsection id="H207527FE5C164258A7CFA66BF42FF521"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">For each fiscal year
			 after the expiration of the period specified in
			 <internal-xref idref="H392671A8096145B39F4AE0ADDBF57865" legis-path="2.(b)(1)">subsection (b)(1)</internal-xref> in which a State
			 receives funds for the program referred to in
			 <internal-xref idref="H09FC0FD0130647DE859E2CC942F93CE0" legis-path="2.(b)(2)">subsection (b)(2)</internal-xref>, the State shall have
			 in effect throughout the State laws and policies that prohibit parole for any
			 individual who—</text>
				<paragraph id="H3EB94D55CE344E20A5626B9857ACECB3"><enum>(1)</enum><text>is convicted of a
			 criminal offense against a victim who is a minor; and</text>
				</paragraph><paragraph id="H0B50CA2103094AAAA825E5E9D370E071"><enum>(2)</enum><text>is a sexually
			 violent predator.</text>
				</paragraph></subsection><subsection id="HAF8F1D411DC04C259664F7DC0F603C9E"><enum>(b)</enum><header>Compliance and
			 ineligibility</header>
				<paragraph id="H392671A8096145B39F4AE0ADDBF57865"><enum>(1)</enum><header>Compliance
			 date</header><text>Each State shall have not more than 3 years from the date of
			 enactment of this Act in which to fully implement this Act, except that the
			 Attorney General—</text>
					<subparagraph id="H3EE2089586E94345BE47D9C52AE11CFA"><enum>(A)</enum><text>may grant an
			 additional 2 years to a State that is making good faith efforts to implement
			 this Act; and</text>
					</subparagraph><subparagraph id="HEFF1869C7291420FA7BEF0E8765E5E77"><enum>(B)</enum><text display-inline="yes-display-inline">shall waive the requirements of this Act if
			 compliance with this Act by a State would be unconstitutional under the
			 constitution of such State.</text>
					</subparagraph></paragraph><paragraph id="H09FC0FD0130647DE859E2CC942F93CE0"><enum>(2)</enum><header>Ineligibility
			 for funds</header><text display-inline="yes-display-inline">For any fiscal year
			 after the expiration of the period specified in
			 <internal-xref idref="H392671A8096145B39F4AE0ADDBF57865" legis-path="2.(b)(1)">paragraph (1)</internal-xref>, a State that fails to
			 fully implement this Act shall not receive 10 percent of the funds that would
			 otherwise be allocated for that fiscal year to the State under the Edward Byrne
			 Memorial Justice Assistance Grant Program under subpart 1 of part E of title I
			 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et
			 seq.).</text>
				</paragraph></subsection><subsection id="H9280BDFFAB5747DDB2230F0AB98F94C7"><enum>(c)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Amounts not allocated under the program
			 referred to in
			 <internal-xref idref="H09FC0FD0130647DE859E2CC942F93CE0" legis-path="2.(b)(2)">subsection (b)(2)</internal-xref> to a State for failure
			 to fully implement this Act shall be reallocated under that program to States
			 that have not failed to fully implement this Act.</text>
			</subsection></section><section id="HE4122D02244D4EA285A5AE405018D7A9"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
			<paragraph id="H4240CEBA8F6342798BF2D175530A9854"><enum>(1)</enum><header>Criminal offense
			 against a victim who is a minor</header><subparagraph commented="no" display-inline="yes-display-inline" id="H1673B67BE665448FB95A3DBE14EE11CC"><enum>(A)</enum><text>The term <term>criminal
			 offense against a victim who is a minor</term> means any criminal offense in a
			 range of offenses specified by State law which is comparable to or which
			 exceeds the following range of offenses—</text>
					<clause id="H23F6609A172946DDB29E8B767A2867C1"><enum>(i)</enum><text>kidnapping of a
			 minor, except by a parent;</text>
					</clause><clause id="H204B3183C30949EC91AA85D62531EEC0"><enum>(ii)</enum><text>false
			 imprisonment of a minor, except by a parent;</text>
					</clause><clause id="H3743136CE8EB4DEFAC841283951F2661"><enum>(iii)</enum><text>criminal sexual
			 conduct toward a minor;</text>
					</clause><clause id="HE311B37F9C1542E3938F39AC50976891"><enum>(iv)</enum><text>solicitation of a
			 minor to engage in sexual conduct;</text>
					</clause><clause id="HE326648CECC848CD987967C4C21C6F46"><enum>(v)</enum><text>use
			 of a minor in a sexual performance;</text>
					</clause><clause id="H4622638C39574781809D1F5043561F4E"><enum>(vi)</enum><text>solicitation of a
			 minor to practice prostitution;</text>
					</clause><clause id="H2147F4A330BC409F85E5B5534F08AEE7"><enum>(vii)</enum><text>any conduct that
			 by its nature is a sexual offense against a minor;</text>
					</clause><clause id="H3A31C1A6A04847D1A6D48976A2A65CA9"><enum>(viii)</enum><text>production or
			 distribution of child pornography, as described in section 2251, 2252, or 2252A
			 of title 18, United States Code; or</text>
					</clause><clause id="H1CFC3F948D924688AE7F6442051D3B03"><enum>(ix)</enum><text>an
			 attempt to commit an offense described in any of clauses (i) through (viii), if
			 the State—</text>
						<subclause id="H828C076F75DE4CE8B1D718F1A953E13F"><enum>(I)</enum><text>makes such an
			 attempt a criminal offense; and</text>
						</subclause><subclause id="H3351D8DD0D93467E9CF45EFDDF56AB5C"><enum>(II)</enum><text>chooses to
			 include such an offense in those which are criminal offenses against a victim
			 who is a minor for the purposes of this section.</text>
						</subclause></clause></subparagraph><subparagraph id="HCA43FD5EDB404092A3452326073BDABA" indent="up1"><enum>(B)</enum><text>For purposes of
			 <internal-xref idref="H4240CEBA8F6342798BF2D175530A9854" legis-path="3.(1)">paragraph (1)</internal-xref>, conduct which is criminal
			 only because of the age of the victim shall not be considered a criminal
			 offense if the perpetrator is 18 years of age or younger.</text>
				</subparagraph></paragraph><paragraph id="H114FB40D6DD1423298A678C4508E9AA4"><enum>(2)</enum><header>Sexually violent
			 predator</header><text>The term <term>sexually violent predator</term> means a
			 person who—</text>
				<subparagraph id="H1033E51606884EA49B77BFB4E13842B3"><enum>(A)</enum><text>has been convicted
			 of a sexually violent offense; and</text>
				</subparagraph><subparagraph id="H43148190532F4C18B610FC141FB25448"><enum>(B)</enum><text display-inline="yes-display-inline">has been diagnosed by a qualified mental
			 health professional as having a mental abnormality or personality disorder that
			 makes the person likely to engage in predatory sexually violent offenses, or
			 has been determined by a court to suffer from such an illness or
			 disorder.</text>
				</subparagraph></paragraph></section></legis-body>
