<official-title>To amend title 18, United States Code, to provide for limitations on detentions of certain individuals, and for other purposes.</official-title>

<section id="H0143BE99932B422EA295B8F017B00DE2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Detention without Charge Act of 2012</short-title></quote>.</text></section> 
<section id="H01D0A5F65DFF4CD291EB040D80C545D6"><enum>2.</enum><header>Limitation on detentions</header><text display-inline="no-display-inline">Section 4001 of title 18, United States Code, is amended by inserting after subsection (b) the following:</text>

<subsection id="H6EBBC24F63094311A259AFCCAEBE1E6F"><enum>(c)</enum> 
<paragraph id="H8B37DCBD501146E4922E603D886314BB" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">An authorization for the use of military force, a declaration of war, or any similar Act pertaining to the authority of the President over the use of the Armed Forces of the United States may not authorize the apprehension or detention of any person except to the extent that the Constitution, the law of war, and otherwise applicable human rights law permits.</text></paragraph> 
<paragraph id="HD956C1602ABB42FB84E5CAA48A49AA76" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Except as expressly provided by an Act of Congress, an authorization for the use of military force, a declaration of war, or any similar Act pertaining to the authority of the President over the use of the Armed Forces of the United States may not authorize the detention without charge of any person apprehended or detained in the United States, or a territory or possession of the United States.</text></paragraph></subsection> 
<subsection id="H46688C86C6B742DDBB4F169C95DC3738"><enum>(d)</enum><text display-inline="yes-display-inline">Subsection (c) applies to an authorization for the use of military force, a declaration of war, or any similar Act pertaining to the authority of the President over the use of the Armed Forces of the United States enacted before, on, or after the date of enactment of this subsection.</text></subsection> 
<subsection id="H8972DA37BC454EEF8574C88DDE29FEB7"><enum>(e)</enum><text display-inline="yes-display-inline">A person may assert a violation of this section as a claim or defense in a judicial proceeding and obtain appropriate relief against a government. Standing to assert a claim or defense under this section shall be governed by the general rules of standing under Article III of the Constitution. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF089504C0F2D4E8BB52350454DDCA415"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">For purposes of section 4001(c)(2) of title 18, United States Code, the Authorization for Use of Military Force (Public Law 107–40; 50 U.S.C. 1541 note) shall not constitute an Act of Congress expressly providing an exception to the prohibition in that subsection.</text></section> 
<section id="H382B997DB0C246D3B6935383D41FBEDB"><enum>4.</enum><header>Repeal of requirement for military custody</header> 
<subsection id="H0E299F3EDF18436CA6046C1D42EDA609"><enum>(a)</enum><header>Repeal</header><text>Section 1022 of the National Defense Authorization Act for Fiscal Year 2012 is hereby repealed.</text></subsection> 
<subsection id="H0B768B5D8DF4466DA79C5D6D8DDDF41D"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1029(b) of such Act is amended by striking <quote>applies to</quote> and all that follows through <quote>any other person</quote> and inserting <quote>applies to any person</quote>.</text></subsection> </section>
