		<section id="HC12A9500DF964D1C897BF2AB6D3B7136" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gulf Coast Restoration
			 Act</short-title></quote>.</text>
		</section><section id="H334237D53A9F4505B956AA45038CBF2C"><enum>2.</enum><header>Gulf Coast
			 ecosystem restoration</header>
			<subsection id="H4FCDDF177D9F4518A49F9C1C99A2EB56"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HC4515332966648C885FEE67D1E70AEEB"><enum>(1)</enum><header>Chair</header><text>The
			 term <term>Chair</term> means the Chair of the Task Force appointed under
			 subsection (d)(3).</text>
				</paragraph><paragraph id="HDAF1A5B613A947C19B19988FC9DB9168"><enum>(2)</enum><header>State coastal
			 ecosystem restoration plan</header><text>The term <term>State Coastal Ecosystem
			 Restoration Plan</term> means a plan submitted under subsection (c) by a
			 qualifying State to the Task Force.</text>
				</paragraph><paragraph id="H10CE6861E3D04C1E8605C292F08E7B38"><enum>(3)</enum><header>Fund</header><text>The
			 term <term>Fund</term> means the Gulf Coast Ecosystem Restoration Fund
			 established by subsection (b)(2)(A).</text>
				</paragraph><paragraph id="HA39BA97A43C545C9B4A2844C44658F45"><enum>(4)</enum><header>Governors</header><text>The
			 term <term>Governors</term> means the Governors of each of the States of
			 Alabama, Florida, Louisiana, Mississippi, and Texas.</text>
				</paragraph><paragraph id="HB6EB6304804F46F3A7EFEEE9C2AD04FA"><enum>(5)</enum><header>Gulf Coast
			 ecosystem</header><text>The term <term>Gulf Coast ecosystem</term> means the
			 coastal zones, as determined pursuant to the Coastal Zone Management Act of
			 1972 (16 U.S.C. 1451 et seq.), of the States of Alabama, Florida, Louisiana,
			 Mississippi, and Texas and adjacent State waters and areas of the outer
			 Continental Shelf, adversely impacted by the blowout and explosion of the
			 mobile offshore drilling unit Deepwater Horizon that occurred on April 20,
			 2010, and resulting hydrocarbon releases into the environment.</text>
				</paragraph><paragraph id="H71CF66A38B744562A8377E599EA2960B"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph><paragraph id="H5193B5E1E2F74CD19AA23A3D18129D36"><enum>(7)</enum><header>Qualifying
			 State</header><text>The term <term>qualifying State</term> means each of the
			 States of Alabama, Florida, Louisiana, Mississippi, and Texas.</text>
				</paragraph><paragraph id="HDE41D656295B44868489EF71EB56EE40"><enum>(8)</enum><header>Task
			 Force</header><text>The term <term>Task Force</term> means the Gulf Coast
			 Ecosystem Restoration Task Force established by subsection (d).</text>
				</paragraph></subsection><subsection id="H1A20B0EF3E0145F68F88B17E8C7CCFAB"><enum>(b)</enum><header>Gulf Coast
			 ecosystem restoration</header>
				<paragraph id="H9CB36BE914C648C89773B9D08484195A"><enum>(1)</enum><header>In
			 general</header><text>In accordance with this section, the Chair shall review
			 and approve or disapprove State Coastal Ecosystem Restoration Plans submitted
			 by the Governors that provide for restoration activities with respect to the
			 Gulf Coast ecosystem.</text>
				</paragraph><paragraph id="H50D358243A6240A4A5C580ADE51C663D"><enum>(2)</enum><header>Gulf Coast
			 Ecosystem Restoration Fund</header>
					<subparagraph id="HF31ECB50F96D47BF944BAFD1B8388A79"><enum>(A)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund to be known as the
			 <quote>Gulf Coast Ecosystem Restoration Fund</quote>.</text>
					</subparagraph><subparagraph id="HA9B31DF9E9AD44C2A43A1BA0B6C950F7"><enum>(B)</enum><header>Transfers to
			 Fund</header><text>Notwithstanding any other provision of law, the Secretary of
			 the Treasury shall deposit into the Fund amounts equal to not less than 80
			 percent of any amounts collected by the United States as penalties,
			 settlements, or fines under sections 309 and 311 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1319, 1321) in relation to the blowout and explosion of
			 the mobile offshore drilling unit Deepwater Horizon that occurred on April 20,
			 2010, and resulting hydrocarbon releases into the environment.</text>
					</subparagraph><subparagraph id="H329CEE560B5C42F4AD9C3747EF146284"><enum>(C)</enum><header>Authorized
			 uses</header><text display-inline="yes-display-inline">The Fund shall be
			 available to the Chair for the conservation, protection, and restoration of the
			 Gulf Coast ecosystem in accordance with State Coastal Ecosystem Restoration
			 Plans submitted by the Governors and approved by the Chair under this
			 section.</text>
					</subparagraph></paragraph><paragraph id="HB53DB0C1ED3849209DF610C91381BED6"><enum>(3)</enum><header>Disbursement</header><text>The
			 Chair shall disburse to each qualifying State for which the Chair has approved
			 a State Coastal Ecosystem Restoration Plan under this section such funds as are
			 allocated to the qualifying State under this section.</text>
				</paragraph><paragraph id="H4099DA6A2C834723ACE80A44AAE3B911"><enum>(4)</enum><header>Use of funds by
			 qualifying State</header><text>A qualifying State shall use all amounts
			 received under this section, including any amount deposited in a trust fund
			 that is administered by the State and dedicated to uses consistent with this
			 section, in accordance with all applicable Federal and State law, only for 1 or
			 more of the following purposes:</text>
					<subparagraph id="HEBB51DA7F49849009BFCD79F68398D0C"><enum>(A)</enum><text>Projects and
			 activities for the conservation, protection, or restoration of coastal areas,
			 including wetlands.</text>
					</subparagraph><subparagraph id="HFA7D7DD9F5314B68B20D46608F612ADB"><enum>(B)</enum><text>Mitigation of
			 damage to fish, wildlife, or natural resources.</text>
					</subparagraph><subparagraph id="HBA12F3B879474D17AE30C7251B85BB12"><enum>(C)</enum><text>Planning
			 assistance and the administrative costs of complying with this section.</text>
					</subparagraph><subparagraph id="H5E345D95041F49C099FC09E03CB22E94"><enum>(D)</enum><text>Implementation of
			 a federally approved marine, coastal, or comprehensive conservation management
			 plan.</text>
					</subparagraph></paragraph></subsection><subsection id="HC645BBC5857541228C545C34249D00C5"><enum>(c)</enum><header>State coastal
			 ecosystem restoration plan</header>
				<paragraph id="HB05BE23B1F5D41DD9D5564C01947316B"><enum>(1)</enum><header>Submission of
			 State plans</header>
					<subparagraph id="HDDDE749A2824486A8C9C9641571100B9"><enum>(A)</enum><header>In
			 general</header><text>Not later than October 1, 2011, the Governor of a
			 qualifying State shall submit to the Chair a State Coastal Ecosystem
			 Restoration Plan.</text>
					</subparagraph><subparagraph id="H6D6ADA4DD0184A55AD10CC9DF1E8CFC5"><enum>(B)</enum><header>Public
			 participation</header><text>In carrying out subparagraph (A), the Governor
			 shall solicit local input and provide for public participation in the
			 development of the plan.</text>
					</subparagraph></paragraph><paragraph id="H218B7F6A13B440909D4989554195EFBB"><enum>(2)</enum><header>Approval</header>
					<subparagraph id="H939513FF10514141BCB498607C552F2E"><enum>(A)</enum><header>In
			 general</header><text>The Chair must approve a plan of a qualifying State
			 submitted under paragraph (1) before disbursing any amount to the qualifying
			 State under this section.</text>
					</subparagraph><subparagraph id="HC9D994F72D7D48CEA04DBC071E6374E9"><enum>(B)</enum><header>Required
			 components</header><text>The Chair shall approve a plan submitted by a
			 qualifying State under paragraph (1) if—</text>
						<clause id="H24D0750123124065841F0D1081C61BF3"><enum>(i)</enum><text>the
			 Chair determines that the plan is consistent with the uses described in
			 subsection (b); and</text>
						</clause><clause id="HF7850DBFE8AA44EA974112E25B74E51E"><enum>(ii)</enum><text>the
			 plan contains—</text>
							<subclause id="HE2CE0A5E9EDB4B2AB183C1F664D2FCAF"><enum>(I)</enum><text>the name of the
			 State agency that will have the authority to represent and act on behalf of the
			 State in dealing with the Secretary for purposes of this section;</text>
							</subclause><subclause id="H031A675A6A3448EABD6BD208090B4C60"><enum>(II)</enum><text>a program for the
			 implementation of the plan that describes how the amounts provided under this
			 section to the qualifying State will be used; and</text>
							</subclause><subclause id="HA48DB1DF5C1C485689355FB4F4F41F3D"><enum>(III)</enum><text>a certification
			 by the Governor that ample opportunity has been provided for public
			 participation in the development and revision of the plan.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="HAEB65C6057534B8EBEB01FD297C1F5ED"><enum>(3)</enum><header>Amendments</header><text>Any
			 amendment to a plan submitted under paragraph (1) shall be—</text>
					<subparagraph id="H669311C75B3C4FE585A33DB3EF2CF4D0"><enum>(A)</enum><text>developed in
			 accordance with this subsection; and</text>
					</subparagraph><subparagraph id="HDB17A90796AA4E3E80C891A760DF31E4"><enum>(B)</enum><text>submitted to the
			 Chair for approval or disapproval under paragraph (4).</text>
					</subparagraph></paragraph><paragraph id="H6C4086D25C8E40559F36FC3A9D6D7E3D"><enum>(4)</enum><header>Procedure</header><text>Not
			 later than 60 days after the date on which a plan or amendment to a plan is
			 submitted under paragraph (1) or (3), respectively, the Chair shall approve or
			 disapprove the plan or amendment.</text>
				</paragraph></subsection><subsection id="H91D1761A436C45C7A7B7C3ADE6C164BE"><enum>(d)</enum><header>Gulf Coast
			 Ecosystem Restoration Task Force</header>
				<paragraph id="H8741F24FDAA3411C9148B2116A1682A8"><enum>(1)</enum><header>Establishment</header><text>There
			 is established the Gulf Coast Ecosystem Restoration Task Force.</text>
				</paragraph><paragraph id="HF5237E4C73B747AFA97D05B8903A4BEA"><enum>(2)</enum><header>Membership</header><text>The
			 Task Force shall consist of the following members, or in the case of a Federal
			 agency, a designee at the level of Assistant Secretary or the
			 equivalent:</text>
					<subparagraph id="HC000DB2FE28842738B1FBD950C7BA0E6"><enum>(A)</enum><text>The
			 Secretary.</text>
					</subparagraph><subparagraph id="H67344B5342D14D9294CEDF1974FBC0A2"><enum>(B)</enum><text>The Secretary of
			 Commerce.</text>
					</subparagraph><subparagraph id="HFC45A88B435B4BC382C263C2E04200BC"><enum>(C)</enum><text>The Secretary of
			 the Army.</text>
					</subparagraph><subparagraph id="H2BC33B5BAC23437B9767D9F991B5C65B"><enum>(D)</enum><text>The Attorney
			 General.</text>
					</subparagraph><subparagraph id="H4F0DB9B5A580489BBE5EE3A47FF2C201"><enum>(E)</enum><text>The Secretary of
			 Homeland Security.</text>
					</subparagraph><subparagraph id="HD2847999E1724168BF88480E5145E3C7"><enum>(F)</enum><text>The Administrator
			 of the Environmental Protection Agency.</text>
					</subparagraph><subparagraph id="H7D2E27E534BF48718C44509E660E4A99"><enum>(G)</enum><text>The Commandant of
			 the Coast Guard.</text>
					</subparagraph><subparagraph id="HE8133A76766D454BBB952019520082B9"><enum>(H)</enum><text>The Secretary of
			 Transportation.</text>
					</subparagraph><subparagraph id="HF2D3AC267AFD4D5FA434D30F0C734130"><enum>(I)</enum><text>The Secretary of
			 Agriculture.</text>
					</subparagraph><subparagraph id="HC6BE195299BE43718A2904C6CEE824F4"><enum>(J)</enum><text>A representative
			 of each affected Indian tribe, appointed by the Secretary based on the
			 recommendations of the tribal chairman.</text>
					</subparagraph><subparagraph id="H4C75AA79BA3A4AF5B0F6FD080AF3B20B"><enum>(K)</enum><text>Two
			 representatives of each of the States of Alabama, Florida, Louisiana,
			 Mississippi, and Texas, appointed by the Governor of each State,
			 respectively.</text>
					</subparagraph><subparagraph id="H9D2A26D0B12A4FE4AA106EE4D0B36923"><enum>(L)</enum><text>Two
			 representatives of local government within each of the States of Alabama,
			 Florida, Louisiana, Mississippi, and Texas, appointed by the Governor of each
			 State, respectively.</text>
					</subparagraph></paragraph><paragraph id="H39C27EB13573450F9FA09192230184AF"><enum>(3)</enum><header>Chair</header><text>The
			 Chair of the Task Force shall be appointed by the President from among the
			 members under paragraph (2) who are Federal officials.</text>
				</paragraph><paragraph id="HFF8C8C57BCD14E14BF1A2483265510BC"><enum>(4)</enum><header>Duties of the
			 Task Force</header><text>The Task Force shall—</text>
					<subparagraph id="HAFCDA92FC81349158DB9001E3C7E0BA6"><enum>(A)</enum><text display-inline="yes-display-inline">consult with, and provide recommendations
			 to, the Chair regarding the approval of State Coastal Ecosystem Restoration
			 Plans;</text>
					</subparagraph><subparagraph id="H52B90632B52B423990A414F2C00C7AEA"><enum>(B)</enum><text>coordinate
			 scientific and other research associated with restoration of the Gulf Coast
			 ecosystem; and</text>
					</subparagraph><subparagraph id="H68B370E616394B20ABDCD2A639840F5F"><enum>(C)</enum><text display-inline="yes-display-inline">submit an annual report to Congress that
			 summarizes the State Coastal Ecosystem Restoration Plans submitted by the
			 Governors and approved by the Chair.</text>
					</subparagraph></paragraph><paragraph id="HBACE174C794B4BD2855A52BB895F9BA2"><enum>(5)</enum><header>Application of
			 the Federal Advisory Committee Act</header><text>The Task Force shall not be
			 considered an advisory committee under the Federal Advisory Committee Act (5
			 U.S.C. App.).</text>
