		<section id="HED64230DCCDA498DBA1BB37A5230D256" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>S.O.S. (Save Our Schools) Act of
			 2012</short-title></quote>.</text>
		</section><section id="HAF00FB3E72614C1794CD913304DFDE7C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HF795E14A6A674F9F8D5C368B23A2EE3A"><enum>(1)</enum><text>The culture of
			 high-stakes testing created by the No Child Left Behind Act of 2001 has failed
			 our children, and has been especially harmful to America’s underserved
			 communities.</text>
			</paragraph><paragraph id="H283C7CB857AA4A1CB2661AE3E4EF2F4D"><enum>(2)</enum><text>The punitive
			 sanctions that schools face when testing scores do not improve have created a
			 culture of “teaching to the test” which leaves America students lacking in many
			 of the skills necessary to find success in life.</text>
			</paragraph><paragraph id="HF9BE275E70794481856E21C03C83DF40"><enum>(3)</enum><text>The pressure for
			 schools to achieve positive test results has directly resulted in thousands of
			 cheating scandals on standardized tests in which teachers, administrators, and
			 others have actively changed test results or encouraged students to cheat on
			 tests.</text>
			</paragraph><paragraph id="H2EF874964D534197B925DF6DD0616B9B"><enum>(4)</enum><text>An investigative
			 series published in the USA Today in March of 2011 documented 1,610 cases of
			 standardized test-score manipulation in 6 States and the District of Columbia,
			 between 2009 and 2010.</text>
			</paragraph><paragraph id="H56BB08734278400D94773FF4336A607B"><enum>(5)</enum><text>When America’s
			 laws incentivize bad behavior, it sends a clear signal that Congress must act
			 to change misguided public policy.</text>
			</paragraph></section><section id="H60B8D10E595744239F179BBB30EAA3FB"><enum>3.</enum><header>Amendments to the
			 Elementary and Secondary Education Act of 1965</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or a repeal of, a provision, the amendment or repeal shall be
			 considered to be made to a provision of the Elementary and Secondary Education
			 Act of 1965 (20 U.S.C. 6301 et seq.).</text>
		</section><section id="H765B34075E224FC89303893FDB9B8AFF"><enum>4.</enum><header>Elimination of
			 school improvement provisions</header><text display-inline="no-display-inline">Section 1003 (20 U.S.C. 6303) is
			 repealed.</text>
		</section><section commented="no" id="HA6E2E4B1120941D6B62F94566EE8E768"><enum>5.</enum><header>Elimination of
			 testing provisions from State plans</header><text display-inline="no-display-inline">Section 1111(b) (20 U.S.C. 6311(b)) is
			 amended—</text>
			<paragraph commented="no" id="HAB1EFB6A5CAB400F972C23BEAE5F2AEF"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph id="H8C41D27226664AB39AF5A33B8CD1B0B4"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraphs (A), (B), and
			 (D)(i)(II);</text>

			 (8)—</text>
				<subparagraph id="HE1B09974501B47EEA8AF63505FCF6F65"><enum>(A)</enum><text>in subparagraph
			 (A) by striking <quote>sections 1112(c)(1)(D), 1114(b), and 1115(c)</quote> and
			 inserting <quote>sections 1114(b) and 1115(c)</quote>; and</text>
				</subparagraph><subparagraph id="H2AD8F3C2D83741878BDD68EEF7CDA3D1"><enum>(B)</enum><text>in subparagraph

			 by striking <quote>that are identified under section 1116 and</quote>;

			</paragraph><paragraph id="HD5A8AF5367074701A22ED351C9916FCE"><enum>(5)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (5), (6), (7),
			 (8), and (9) as paragraphs (2), (3), (4), (5), and (6), respectively.</text>
			</paragraph></section><section commented="no" id="HF250A8AC19F5487EB7E20076B5F38B9A"><enum>6.</enum><header>Elimination of
			 testing provisions from local educational agency plans</header><text display-inline="no-display-inline">Section 1112 (20 U.S.C. 6312) is
			 amended—</text>
			<paragraph commented="no" id="HAD4373E0BFA94BDEADB67519CF4B679D"><enum>(1)</enum><text>by amending
			 subsection (b) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HB9F1B518ECA348CA84B3429313BFE08F" style="OLC">
					<subsection id="H5C946451D367402E952EEEA094DF624A"><enum>(b)</enum><header>Plan
				provisions</header><text display-inline="yes-display-inline">In order to help
				low-achieving children meet challenging achievement academic standards, each
				local educational agency plan shall include—</text>
						<paragraph id="HDE37D4F0E25B48FDA4FF08523DF9DBAC"><enum>(1)</enum><text display-inline="yes-display-inline">a description of high-quality student
				academic assessments, if any, that the local educational agency and schools
				served under this part will use to identify effectively students who may be at
				risk for reading failure or who are having difficulty reading, through the use
				of screening, diagnostic, and classroom-based instructional reading
				assessments, as defined under section 1208;</text>
						</paragraph><paragraph id="H1B6AB32D0A5C43DB8AFE54669721D989"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the strategy the local
				educational agency will use to coordinate programs under this part with
				programs under title II to provide professional development for teachers and
				principals, and, if appropriate, pupil services personnel, administrators,
				parents and other staff, including local educational agency level staff in
				accordance with sections 1118 and 1119;</text>
						</paragraph><paragraph id="H5B91AD8BB16349A4BF1097857F6490A8"><enum>(3)</enum><text display-inline="yes-display-inline">a description of how the local educational
				agency will coordinate and integrate services provided under this part with
				other educational services at the local educational agency or individual school
				level, such as—</text>
							<subparagraph id="HFA4EED6EC8DB4F6CBFDE48B95E9AAAFC"><enum>(A)</enum><text display-inline="yes-display-inline">Even Start, Head Start, Reading First,
				Early Reading First, and other preschool programs, including plans for the
				transition of participants in such programs to local elementary school
				programs; and</text>
							</subparagraph><subparagraph id="HF953CBE7D0EA45D4A9A7E320B37185E7"><enum>(B)</enum><text display-inline="yes-display-inline">services for children with limited English
				proficiency, children with disabilities, migratory children, neglected or
				delinquent youth, Indian children served under part A of title VII, homeless
				children, and immigrant children in order to increase program effectiveness,
				eliminate duplication, and reduce fragmentation of the instructional
				program;</text>
							</subparagraph></paragraph><paragraph id="HAFAAFEAFD4B44D4DAD4869A7DEE44B19"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the poverty criteria that
				will be used to select school attendance areas under section 1113;</text>
						</paragraph><paragraph id="H77BC2E5A6F3848D1A5409C50D51A0B8B"><enum>(5)</enum><text display-inline="yes-display-inline">a description of how teachers, in
				consultation with parents, administrators, and pupil services personnel, in
				targeted assistance schools under section 1115, will identify the eligible
				children most in need of services under this part;</text>
						</paragraph><paragraph id="H3A4C3F4EA1CB4516AC84FA4514BCB0BD"><enum>(6)</enum><text>a general
				description of the nature of the programs to be conducted by such agency's
				schools under sections 1114 and 1115 and, where appropriate, educational
				services outside such schools for children living in local institutions for
				neglected or delinquent children, and for neglected and delinquent children in
				community day school programs;</text>
						</paragraph><paragraph id="H8DF7F3A670CC4C95A7D89D727609D359"><enum>(7)</enum><text>a description of
				how the local educational agency will ensure that migratory children and
				formerly migratory children who are eligible to receive services under this
				part are selected to receive such services on the same basis as other children
				who are selected to receive services under this part;</text>
						</paragraph><paragraph id="H86F5428C46D74729AD1BD08E2D434F4B"><enum>(8)</enum><text>if appropriate, a
				description of how the local educational agency will use funds under this part
				to support preschool programs for children, particularly children participating
				in Early Reading First, or in a Head Start or Even Start program, which
				services may be provided directly by the local educational agency or through a
				subcontract with the local Head Start agency designated by the Secretary of
				Health and Human Services under section 641 of the Head Start Act, or an agency
				operating an Even Start program, an Early Reading First;</text>
						</paragraph><paragraph id="H5D27A34267F348A2810463B6003DB966"><enum>(9)</enum><text display-inline="yes-display-inline">a description of how the local educational
				agency will meet the requirements of section 1119;</text>
						</paragraph><paragraph id="HBA87E70E1D2549FC9ED14EB415397BA8"><enum>(10)</enum><text>a description of
				the services the local educational agency will provide homeless children,
				including services provided with funds reserved under section
				1113(c)(3)(A);</text>
						</paragraph><paragraph id="H72A08C44E6E64FC08A303D970299CD34"><enum>(11)</enum><text>a description of
				the strategy the local educational agency will use to implement effective
				parental involvement under section 1118; and</text>
						</paragraph><paragraph id="HEDF048CA9F5C463E8B964EFB9C762FCE"><enum>(12)</enum><text>where
				appropriate, a description of how the local educational agency will use funds
				under this part to support after school (including before school and summer
				school) and school-year extension
				programs.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="HE29826845E944E47A5DD565CD1EAABF1"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(1)—</text>
				<subparagraph id="H0D4A2705B4AD4063B2D7302BD58BCF2A"><enum>(A)</enum><text>by striking
			 subparagraphs (C), (D), (K), (M), (N), and (O); and</text>
				</subparagraph><subparagraph id="H7BCE1AD06818488FBB0E13385146B408"><enum>(B)</enum><text>by redesignating
			 subparagraphs (E), (F), (G), (H), (I), (J), and (L) as subparagraphs (C), (D),
			 (E), (F), (G), (H), and (I), respectively;</text>
				</subparagraph></paragraph><paragraph commented="no" id="HECD43081295D4833B8A5A7D44A3C41E2"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e), by amending paragraph
			 (2) to read as follows:</text>

					<paragraph id="HFC888C2FA5824BBB9F9DA5C5D530F975"><enum>(2)</enum><header>Approval</header><text display-inline="yes-display-inline">The State educational agency shall approve
				a local educational agency's plan only if the State educational agency
				determines that the local educational agency's plan meets the requirements of
				this section.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="H2890DCE4EECD4F598F3A2BFB52B54F80"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (g)—</text>
				<subparagraph id="HD0C832027BE648BBAC4296F26B8390F1"><enum>(A)</enum><text>by striking
			 paragraph (4);</text>
				</subparagraph><subparagraph id="H58394276F78E47D0AE43EF976DB6B18A"><enum>(B)</enum><text>by redesignating
			 paragraph (5) as paragraph (4); and</text>
				</subparagraph><subparagraph id="HF60D7BAB735B4E53B0275FA97167F0F8"><enum>(C)</enum><text>by amending
			 paragraph (1) to read as follows:</text>

						<paragraph id="HBC22191DE1C042359E1322A5FC346DA0"><enum>(1)</enum><header>Notice</header><text display-inline="yes-display-inline">Each local educational agency using funds
				under this part to provide a language instruction educational program as
				determined in part C of title III shall, not later than 30 days after the
				beginning of the school year, inform a parent or parents of a limited English
				proficient child identified for participation or participating in, such a
				program of—</text>
							<subparagraph id="HC32140502595417ABA94AA429526FEF2"><enum>(A)</enum><text display-inline="yes-display-inline">the reasons for the identification of their
				child as limited English proficient and in need of placement in a language
				instruction educational program;</text>
							</subparagraph><subparagraph id="H165F0BFACF804567B5B87DF28BCC9234"><enum>(B)</enum><text>the child's level
				of English proficiency, how such level was assessed, and the status of the
				child's academic achievement;</text>
							</subparagraph><subparagraph id="HEB62E7732211490280B23A92DF6DAD10"><enum>(C)</enum><text>the methods of
				instruction used in the program in which their child is, or will be
				participating, and the methods of instruction used in other available programs,
				including how such programs differ in content, instructional goals, and the use
				of English and a native language in instruction;</text>
							</subparagraph><subparagraph id="H7A4ED93386204853B5CA2FAB464557BC"><enum>(D)</enum><text>how the program in
				which their child is, or will be participating, will meet the educational
				strengths and needs of their child;</text>
							</subparagraph><subparagraph id="HECF4B963AB33454BB08A7DE775F81254"><enum>(E)</enum><text>how such program
				will specifically help their child learn English, and meet age-appropriate
				academic achievement standards for grade promotion and graduation;</text>
							</subparagraph><subparagraph id="H1F14EEAD048048DAB5EB63B7963EC39C"><enum>(F)</enum><text>the specific exit
				requirements for the program, including the expected rate of transition from
				such program into classrooms that are not tailored for limited English
				proficient children, and the expected rate of graduation from secondary school
				for such program if funds under this part are used for children in secondary
				schools;</text>
							</subparagraph><subparagraph id="H620859DBCED6450385DD610DC47DC7A2"><enum>(G)</enum><text>in the case of a
				child with a disability, how such program meets the objectives of the
				individualized education program of the child; and</text>
							</subparagraph><subparagraph id="H3C81DCE776BF4CB3922A889E6587DCEF"><enum>(H)</enum><text display-inline="yes-display-inline">information pertaining to parental rights
				that includes written guidance—</text>
								<clause id="HF0A66575F7294940BAD837EF4CC320DB"><enum>(i)</enum><text>detailing—</text>
									<subclause id="H50299F16CB5F4C83BB8CA3CE9539D632"><enum>(I)</enum><text display-inline="yes-display-inline">the right that parents have to have their
				child immediately removed from such program upon their request; and</text>
									</subclause><subclause id="H3723509EAAB648268B9433D5908F448A"><enum>(II)</enum><text>the options that
				parents have to decline to enroll their child in such program or to choose
				another program or method of instruction, if available; and</text>
									</subclause></clause><clause id="HFE6FAE6A694644E5855FC250DF830365"><enum>(ii)</enum><text display-inline="yes-display-inline">assisting parents in selecting among
				various programs and methods of instruction, if more than one program or method
				is offered by the eligible
				entity.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section commented="no" id="H981C3A94790C4D01B3EE78558CE0C79F"><enum>7.</enum><header>Elimination of
			 testing provisions from schoolwide programs</header><text display-inline="no-display-inline">Section 1114(b) (20 U.S.C. 6314(b)) is
			 amended—</text>
			<paragraph commented="no" id="H076DE8D3849E4686975FB821753EBBBB"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
				<subparagraph id="H847DF62E51994565BDF1E212D28EFA80"><enum>(A)</enum><text>by striking
			 subparagraphs (A), (B), (H), and (I); and</text>
				</subparagraph><subparagraph id="H4B239CA084D14B83A55FA28A4F313A05"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (C), (D),
			 (E), (F), (G), and (J) as subparagraphs (A), (B), (C), (D), (E), and (F),
			 respectively;</text>
				</subparagraph></paragraph><paragraph commented="no" id="HDB6493F482AC4A83958332577E28351F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)—</text>

			 <quote>or other technical assistance provider under section
			 1117</quote>;</text>

				</subparagraph><subparagraph id="H33E4A2D1C39346D2953E651093E09B99"><enum>(C)</enum><text>by inserting

				</subparagraph><subparagraph id="HB0E33397ED284959A7096CC6283D3439"><enum>(D)</enum><text>in clause (iii) by
			 striking <quote>; and</quote> and inserting a period; and</text>
				</subparagraph></paragraph><paragraph id="H6E379B5B2BA54002A69FB760106FCC25"><enum>(3)</enum><text>in paragraph
			 (2)(B)(i)(I) by striking <quote>, after considering the recommendation of the
			 technical assistance providers under section 1117,</quote>.</text>
			</paragraph></section><section commented="no" id="HB4D990289A41466484878CC26F7C5F28"><enum>8.</enum><header>Elimination of
			 testing provisions from targeted assistance schools</header><text display-inline="no-display-inline">Section 1115(c) (20 U.S.C. 6315(c)) is
			 amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H4D8FADA3C8EC4E5794E6B080770A2E6B" style="OLC">
				<subsection id="H09758EE0DE244D0EA7D85020B74B8331"><enum>(c)</enum><header>Components of a
				Targeted Assistance School Program</header><text display-inline="yes-display-inline">To assist targeted assistance schools and
				local educational agencies to meet their responsibility to provide for all
				their students served under this part the opportunity to meet the State's
				challenging student academic achievement standards in subjects as determined by
				the State, each targeted assistance program under this section shall—</text>
					<paragraph id="H33536F396158427F967A52340FB44F8A"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that planning for students served
				under this part is incorporated into existing school planning;</text>
					</paragraph><paragraph id="H5551AEABCE054A558E0DB347C4CEF21D"><enum>(2)</enum><text>use effective
				methods and instructional strategies that are based on scientifically based
				research that strengthens the core academic program of the school and
				that—</text>
						<subparagraph id="H637592CC08F744D69E1397C97FDE5791"><enum>(A)</enum><text>give primary
				consideration to providing extended learning time, such as an extended school
				year, before- and after-school, and summer programs and opportunities;</text>
						</subparagraph><subparagraph id="HBE64BAF34251417FB7B82497DD90E368"><enum>(B)</enum><text>help provide an
				accelerated, high-quality curriculum, including applied learning; and</text>
						</subparagraph><subparagraph id="HD81E431A74FB481A9EA010BB06844804"><enum>(C)</enum><text>minimize removing
				children from the regular classroom during regular school hours for instruction
				provided under this part;</text>
						</subparagraph></paragraph><paragraph id="HC8376BB2341E4A90B4FDF34EBC465B4D"><enum>(3)</enum><text>coordinate with
				and support the regular education program, which may include services to assist
				preschool children in the transition from early childhood programs such as Head
				Start, Even Start, Early Reading First or State-run preschool programs to
				elementary school programs;</text>
					</paragraph><paragraph id="H6A291F397EBC4C39B149C19E8AE932F3"><enum>(4)</enum><text>provide
				instruction by highly qualified teachers;</text>
					</paragraph><paragraph id="H3EA331FFE03344B19F4DFC983B6F04A6"><enum>(5)</enum><text>in accordance with
				subsection (e)(3) and section 1119, provide opportunities for professional
				development with resources provided under this part, and, to the extent
				practicable, from other sources, for teachers, principals, and
				paraprofessionals, including, if appropriate, pupil services personnel,
				parents, and other staff, who work with participating children in programs
				under this section or in the regular education program;</text>
					</paragraph><paragraph id="H19458AF9AB04413CBF6B42345020F7B7"><enum>(6)</enum><text>provide strategies
				to increase parental involvement in accordance with section 1118, such as
				family literacy services; and</text>
					</paragraph><paragraph id="H29B7AFDC10314AD8B316DC5003476E74"><enum>(7)</enum><text>coordinate and
				integrate Federal, State, and local services and programs, including programs
				supported under this Act, violence prevention programs, nutrition programs,
				housing programs, Head Start, adult education, vocational and technical
				education, and job
				training.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC5ACBD85B213438196D68BE17E295442"><enum>9.</enum><header>Elimination of
			 academic assessment and local educational agency and school
			 improvement</header><text display-inline="no-display-inline">Section 1116 (20
			 U.S.C. 6316) is repealed.</text>
		</section><section id="HC055F22A7C93448AA90E11DA9AB76562"><enum>10.</enum><header>Elimination of
			 school support and recognition</header><text display-inline="no-display-inline">Section 1117 (20 U.S.C. 6317) is
			 repealed.</text>

				prekindergarten program, a teacher organization, a principal organization, or a
				business.</text>

				enactment of the No Child Left Behind Act of 2001, and has a plan approved
				under subpart 1 of part A of title III of such Act after such date of
				enactment, the Secretary shall annually, starting with the beginning of the
				first school year following the first two school years for which such plans
				were implemented, review whether the State has met its annual measurable
				achievement objectives under section
				3122(a).</text>

			</subsection><subsection id="H6961CF2736A54555912A69A361EB6AAE"><enum>(gg)</enum><header>Technical
			 assistance</header><text display-inline="yes-display-inline">Section 6163 (20
			 U.S.C. 7325b) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H6BD5ADC2B3B1455686245D68EAC92E07" style="OLC">
					<subsection id="HC51F1F1AB8704B3CB092946D8E8A4B0C"><enum>(a)</enum><header>Provision of
				assistance</header><text display-inline="yes-display-inline">Based on the
				reviews described in section 6161, the Secretary may provide technical
				assistance to a State that has failed to meet its annual measurable achievement
				objectives under section 3122(a) for 2 consecutive years. The Secretary shall
				provide such assistance not later than the beginning of the first school year
				that begins after such determination is made.</text>
					</subsection><subsection id="HC65D2A8189A0482CB0DA0B4DF551B273"><enum>(b)</enum><header>Characteristics</header><text display-inline="yes-display-inline">The technical assistance described in
				subsection (a) shall be valid, reliable and rigorous and meet the annual
				measurable achievement objectives under section
				3122(a).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAC85D44E6F974CD79D33E02C271E5115"><enum>(hh)</enum><header>Report to
			 Congress</header><text>Section 6164 (20 U.S.C. 7325c) is amended—</text>
				<paragraph id="H781394622AAD434492560EB638BC0A40"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1);</text>
