		<official-title>To authorize the Secretary of the Interior to make grants
		  to facilitate certain acquisitions of property for conservation purposes, and
		  for other purposes.</official-title>

		<section id="H5C1EFC7FC01E41369EC3F19A2FFDB826" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Clean and Beautiful Communities Act of
			 2012</short-title></quote>.</text>
		</section><section id="HA0AF9DDC417D4811A7513FB593D90D06"><enum>2.</enum><header>Grants to
			 facilitate certain acquisitions of property for conservation purposes</header>
			<subsection id="H34DE482E2B34461EB34464B5ED4B7EE7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior, acting through the Rivers, Trails, and Conservation Assistance
			 Program of the National Park Service, may make grants to facilitate the
			 acquisition by a qualified organization of a qualified real property interest
			 exclusively for conservation purposes, that assist in the funding of
			 transactional and operational costs associated with the purchase and management
			 of preserved land or a qualified real property interest (including easements)
			 including—</text>
				<paragraph id="H0BC0B7B7A4C546A0A6546C4AE353E271"><enum>(1)</enum><text display-inline="yes-display-inline">stewardship costs, including costs of
			 standards and practices development and implementation;</text>
				</paragraph><paragraph id="H5551763FA0CF47CAB463EB9853EFC9B9"><enum>(2)</enum><text>land purchase
			 transaction costs;</text>
				</paragraph><paragraph id="H85526CB9D5FE44269120C7DB521A5803"><enum>(3)</enum><text>costs of preparing
			 for accreditation associated with land management; and</text>
				</paragraph><paragraph id="H5B455D7169AD4CD199489C1974ADCB60"><enum>(4)</enum><text display-inline="yes-display-inline">costs of due diligence, including
			 appraisal, title, survey, environmental hazard assessment, and recording
			 costs.</text>
				</paragraph></subsection><subsection id="HB0C16EA96B5242CFBA64B8B46785B43A"><enum>(b)</enum><header>Eligibility</header>
				<paragraph id="H84C652A491A4498A8964911007339168"><enum>(1)</enum><header>In
			 general</header><text>A person shall be eligible for a grant under this section
			 only if the person—</text>
					<subparagraph id="HC41847F95B7442DD9EE3D43D2EF0B652"><enum>(A)</enum><text display-inline="yes-display-inline">is an organization described in section
			 501(c)(3) of the Internal Revenue Code of 1986 and exempt from tax under
			 section 501(a) of such Code; and</text>
					</subparagraph><subparagraph id="HBA3240808D0C4F50BFD8CC389BDC5C3B"><enum>(B)</enum><text>is not a State or
			 local government entity.</text>
					</subparagraph></paragraph><paragraph id="H7BEA7E495A7E42C98CB2C3208B3EC230"><enum>(2)</enum><header>Application</header><text>To
			 be eligible to receive a grant under subsection (a), a qualified organization
			 shall submit to the Secretary of the Interior an application at such time, in
			 such form, and containing such information as the Secretary shall
			 require.</text>
				</paragraph></subsection><subsection id="HA304129989E446298B522388DC849552"><enum>(c)</enum><header>Priority</header><text>In
			 making grants under this section, the Secretary of the Interior shall give
			 priority to eligible persons that—</text>
				<paragraph id="H2D62F943F6004BDE9BFBE95B8196A965"><enum>(1)</enum><text>demonstrate a
			 record of successfully acquiring and competently managing a substantial
			 portfolio of conserved properties and easement holdings;</text>
				</paragraph><paragraph id="H171F30E03F11496EA6B28F9C30A9461D"><enum>(2)</enum><text>have established
			 and diverse capital and development programs;</text>
				</paragraph><paragraph id="H179DAFE82E794B03B2BE5A327925B1F3"><enum>(3)</enum><text>demonstrate a
			 record of working successfully with local and State governmental stakeholders
			 in building support for conservation acquisitions and leveraging funding
			 opportunities; and</text>
				</paragraph><paragraph id="H3B0B7A0E07964512B00342C0E309277D"><enum>(4)</enum><text>currently employ
			 full-time or part-time staff to manage their operations on a nonvoluntary basis
			 or can demonstrate capacity to employ such staff in the near-term.</text>
				</paragraph></subsection><subsection id="HA77F8F3C07E44C969BB9C14669559FC4"><enum>(d)</enum><header>Limitation</header><text>A
			 grant under this section may not be used to pay consideration for the purchase
			 of any interest in real property.</text>
			</subsection><subsection id="H8AD082DCA066455C9604079667166237"><enum>(e)</enum><header>Grant amount and
			 duration</header><text>A grant under this section shall be in an amount of not
			 more than $500,000 per year for 5 years.</text>
			</subsection><subsection id="H7FBA0732353D4DF193FC91994B42E5E0"><enum>(f)</enum><header>Matching
			 requirement</header><text display-inline="yes-display-inline">The Secretary of
			 the Interior may not make a grant under subsection (a) in an amount that
			 exceeds 50 percent of the costs such grant is made to assist.</text>
			</subsection><subsection id="HFEF66DF9A66B48B095FFB79723286B98"><enum>(g)</enum><header>No limitation on
			 number of grants</header><text display-inline="yes-display-inline">Receipt by a
			 qualified organization of a grant under subsection (a) shall not preclude the
			 Secretary of the Interior from making subsequent grants under subsection (a) to
			 such organization.</text>
			</subsection><subsection id="HAEDE1D7E358546CAA056CF8232D40011"><enum>(h)</enum><header>Technical
			 assistance</header><text>The Secretary of the Interior is authorized to provide
			 technical assistance to qualified organizations with respect to acquisitions of
			 qualified real property interests exclusively for conservation purposes.</text>
			</subsection><subsection id="H66DE5EEFB72646F4A45FD3F68A73E8B3"><enum>(i)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 5 years after the date of
			 the enactment of this Act, the Secretary of the Interior shall submit to
			 Congress a report that summarizes the activities carried out under this
			 section.</text>
			</subsection><subsection id="H9CC3EF95E9FE4E8A8BDDC4EF49E41853"><enum>(j)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H88025552FBA44A8CBF56DC8FC0A1492E"><enum>(1)</enum><text display-inline="yes-display-inline">The terms <term>conservation
			 purpose</term>, <term>exclusively for conservation purposes</term>, and
			 <term>qualified organization</term> have the meanings such terms have in
			 section 170(h) of the Internal Revenue Code of 1986.</text>
				</paragraph><paragraph id="H70580BB0C46A4B94997A10896C75EE35"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>qualified real property
			 interest</term> has the meaning given such term in section 170(h)(2) of the
			 Internal Revenue Code of 1986.</text>
				</paragraph></subsection><subsection commented="no" id="HC041A4289D05423BB61E28CA508AE5F3"><enum>(k)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">To carry out
			 this section, there is authorized to be appropriated to the Secretary of the
			 Interior $10,000,000 from the Land and Water Conservation Fund for each of
			 fiscal years 2013 through 2022.</text>
