		<section id="H78134CBE051A45F7A61D4D961884971F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">The Act may be cited as the
			 <quote><short-title>Relief for Educators To Adjust if
			 Necessary Act </short-title></quote> or the <quote><short-title>RETAIN Act</short-title></quote>.</text>
		</section><section id="HC8DCF8462A644E698715766811764652"><enum>2.</enum><header>Flexibility to
			 use Federal funds</header>
			<subsection id="H3B38A9E5269F43B296EDF245600A3A55"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart 2 of part A
			 of title VI of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7305 et seq.) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HEAE102C7763B4FBDAD27DBC5F60AAB49" style="OLC">
					<subpart id="H0BEC88CFE21543038DE26B61ECB5DC80"><enum>2</enum><header>Funding
				Flexibility for States and High-Need Local Educational Agencies</header>
						<section id="H6907387E4116479EAFC98DE5EE392080"><enum>6121.</enum><header>Short
				title</header><text display-inline="no-display-inline">This subpart may be
				cited as the <quote>State and Local Funding Flexibility Act</quote>.</text>
						</section><section id="HF796330274014DD69B0F0D876AA57E79"><enum>6122.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this subpart is to allow
				States and high-need local educational agencies the flexibility to—</text>
							<paragraph id="HAB3E9B5B29854E2CA79AA0EDF994DA4F"><enum>(1)</enum><text>design flexible
				programs that use Federal funds to support student achievement for all
				students, including students most at risk of failing to meet the State’s
				academic achievement standards; and</text>
							</paragraph><paragraph id="H3FADF54578E245D0A2F1F3879D48D699"><enum>(2)</enum><text>extend and enhance
				the funding flexibility provided to rural local educational agencies under
				section 6211 to all State educational agencies and local educational agencies
				by providing such agencies flexibility in using Federal formula funds received
				to prevent the layoff or termination of teachers or other staff.</text>
							</paragraph></section><section id="HC210B135D0064C2890E9796D26F3007E"><enum>6123.</enum><header>Flexibility to
				use Federal funds</header>
							<subsection id="H8D8928FABBEF4157B27A70D0CD7493DD"><enum>(a)</enum><header>Alternative uses
				of federal funds for state educational agencies</header>
								<paragraph id="H597F5BBCD9F340D8AD2931C1C3707847"><enum>(1)</enum><header>In
				general</header><text>Subject to subsections (c) and (d) and notwithstanding
				any other provision of law, a State educational agency may use the applicable
				funding that the agency receives for a fiscal year to provide funds to
				high-need local educational agencies under the jurisdiction of the State
				educational agency to prevent the layoff or termination of teachers or other
				staff in such local educational agencies.</text>
								</paragraph><paragraph id="H5C743CA835524ECEBE3DF0A34D17E8F0"><enum>(2)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than June 1 of each year, a State
				educational agency shall notify the Secretary of the State educational agency’s
				intention to use the applicable funding for the alternative uses under
				<internal-xref idref="H597F5BBCD9F340D8AD2931C1C3707847" legis-path="6123.(a)(1)">paragraph (1)</internal-xref>.</text>
								</paragraph><paragraph commented="no" id="H643A0E38AB894AB49D71100454706969"><enum>(3)</enum><header>Applicable
				funding defined</header>
									<subparagraph id="H263953FA2DA844CB8B55C484FC5502A9"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), in this
				subsection, the term <term>applicable funding</term> means funds provided to
				carry out State activities under one or more of the following
				provisions:</text>
										<clause commented="no" id="HBE107F6184604C5B9CA8174C94BF4688"><enum>(i)</enum><text>Section
				1003(g)(2).</text>
										</clause><clause id="H6539E1E259BB43DF8E97DC4E057B6A49"><enum>(ii)</enum><text>Section
				1004.</text>
										</clause><clause id="H32E7911EF8EB42DF8D28977F6A59F127"><enum>(iii)</enum><text>Subpart I of
				Part B of title I.</text>
										</clause><clause commented="no" id="H208DFB802C20457B8F4477F7A29D3606"><enum>(iv)</enum><text>Part C of title

										</clause></subparagraph><subparagraph id="H1E39A26842B24F98A1ABE8D23263206D"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">In this subsection, the term
				<term>applicable funding</term> does not include funds provided under any of
				the provisions listed in subparagraph (A) that State educational agencies are
				required by this Act—</text>
										<clause id="H4E115ACE1D9240DA8B43A1DA6BB03491"><enum>(i)</enum><text>to
				reserve, allocate, or spend for required activities;</text>
										</clause><clause id="H253E32636B4F4308936B33A24B8E395A"><enum>(ii)</enum><text>to allot or award
				to local educational agencies or other entities eligible to receive such funds;
				or</text>
										</clause><clause id="H2DE43BBAEF5340019041784369B55A3C"><enum>(iii)</enum><text>to use for
				technical assistance or monitoring.</text>
										</clause></subparagraph></paragraph><paragraph id="HA96BDD986E1D4B1CA8499F1CD35DA97F"><enum>(4)</enum><header>Disbursement</header><text>The
				Secretary shall disburse the applicable funding to State educational agencies
				for alternative uses under
				<internal-xref idref="H597F5BBCD9F340D8AD2931C1C3707847" legis-path="6123.(a)(1)">paragraph (1)</internal-xref> for a fiscal year at the
				same time as the Secretary disburses the applicable funding to State
				educational agencies that do not intend to use the applicable funding for such
				alternative uses for the fiscal year.</text>
								</paragraph></subsection><subsection id="HAC0291E3A6EC401A9F7521665F6AF70B"><enum>(b)</enum><header>Alternative uses
				of federal funds for high-Need local educational agencies</header>
								<paragraph id="H750327593CFC43F59C19196B6E556A23"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subsections (c) and (d) and notwithstanding any other provision of law, a
				high-need local educational agency may use the applicable funding that the
				agency receives for a fiscal year to prevent the layoff or termination of
				teachers or other staff in the agency.</text>
								</paragraph><paragraph id="H7AE88D5F6E0A41B5A7E74D29BBF29C6E"><enum>(2)</enum><header>Notification</header><text>A
				high-local educational agency shall notify the State educational agency of the
				local educational agency’s intention to use the applicable funding for the
				alternative uses under
				<internal-xref idref="H750327593CFC43F59C19196B6E556A23" legis-path="6123.(b)(1)">paragraph (1)</internal-xref> by a date that is
				established by the State educational agency for the notification.</text>
								</paragraph><paragraph commented="no" id="H6D89346EC3464D2290D8DEFC1CA6DF0B"><enum>(3)</enum><header>Applicable
				funding defined</header>
									<subparagraph commented="no" id="H44FE9E9815974C3482E7AF39AF1F8DC3"><enum>(A)</enum><header>In
				general</header><text>Except as provided in
				<internal-xref idref="H7243F4BD4BCF468082752F322B8CD377" legis-path="6123.(b)(3)(B)">subparagraph (B)</internal-xref>, in this
				subsection, the term <term>applicable funding</term> means funds provided to
				carry out local activities under one or more of the following
				provisions:</text>

										</clause><clause commented="no" id="H342123B056994231A11C4EA029B604B8"><enum>(iv)</enum><text>Part A of title
				II.</text>
										</clause><clause commented="no" id="HB54A314A17AD4DA8AAC55C2AB6F975DD"><enum>(v)</enum><text>Part A of title

										</clause></subparagraph><subparagraph commented="no" id="H7243F4BD4BCF468082752F322B8CD377"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">In this subsection, the term
				<term>applicable funding</term> does not include funds provided under any of
				the provisions listed in
				<internal-xref idref="H44FE9E9815974C3482E7AF39AF1F8DC3" legis-path="6123.(b)(3)(A)">subparagraph (A)</internal-xref> that high-need
				local educational agencies are required by this Act—</text>
										<clause commented="no" id="HEA387791EC12431FA1BFD278E2DEC2D1"><enum>(i)</enum><text>to reserve,
				allocate, or spend for required activities;</text>
										</clause><clause commented="no" id="H754E1B7C03FD46A0AF2751A66CCB9874"><enum>(ii)</enum><text>to allot or award
				to entities eligible to receive such funds; or</text>
										</clause><clause commented="no" id="H62B649D12A0E4032AACCC13D524B9E41"><enum>(iii)</enum><text>to use for
				technical assistance or monitoring.</text>
										</clause></subparagraph></paragraph><paragraph id="HDAC3BF17B29B471E9FC6C52A47C63902"><enum>(4)</enum><header>Disbursement</header><text>Each
				State educational agency that receives applicable funding for a fiscal year
				shall disburse the applicable funding to local educational agencies for
				alternative uses under
				<internal-xref idref="H750327593CFC43F59C19196B6E556A23" legis-path="6123.(b)(1)">paragraph (1)</internal-xref> for the fiscal year at
				the same time as the State educational agency disburses the applicable funding
				to high-need local educational agencies that do not intend to use the
				applicable funding for such alternative uses for the fiscal year.</text>
								</paragraph></subsection><subsection id="HF6B09C1BECE1469DA6FD42B9DA7508D1"><enum>(c)</enum><header>Rule for
				administrative costs</header><text>A State educational agency or a high-need
				local educational agency may only use applicable funding (as defined in
				subsection (a)(3) or (b)(3), respectively) for administrative costs incurred in
				carrying out a provision listed in subsection (a)(1) or (b)(1), respectively,
				to the extent that the agency, in the absence of this section, could have used
				funds for administrative costs with respect to a program listed in subsection
				(a)(3) or (b)(3), respectively.</text>
							</subsection><subsection id="HE1EE68743760431FBD6598665E148EF4"><enum>(d)</enum><header>Rule of
				construction</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed to relieve a State educational agency or local
				educational agency of any requirements relating to—</text>
								<paragraph id="HB2D52BD42CA841A087F79E4182AD22DE"><enum>(1)</enum><text display-inline="yes-display-inline">maintenance of effort;</text>
								</paragraph><paragraph id="HA6E58C661F7447CAAF00D215EFCF309B"><enum>(2)</enum><text>use of Federal
				funds to supplement, not supplant, non-Federal funds;</text>
								</paragraph><paragraph id="HDE1850DE3EC44638A2A484CAFE706464"><enum>(3)</enum><text>comparability of
				services;</text>
								</paragraph><paragraph id="HA3A8E6E96E2F457DB2C17BD66058F9E1"><enum>(4)</enum><text>equitable
				participation of private school students and teachers;</text>
								</paragraph><paragraph id="H29242525C3574D51A444761853CA02B3"><enum>(5)</enum><text>applicable civil
				rights requirements;</text>
								</paragraph><paragraph id="H718E606968AF45D29EBFC5D974DB01DA"><enum>(6)</enum><text>the selection of
				school attendance areas or schools under subsections (a) and (b), and
				allocations to such areas or schools under subsection (c), of section
				1113;</text>
								</paragraph><paragraph id="H250409996B854A7BA9E207CEA0FC098A"><enum>(7)</enum><text>section
				1111;</text>
								</paragraph><paragraph id="HD7C97FA7CBEE47BEAAC33B70D2CECC66"><enum>(8)</enum><text>section 1116;
				or</text>
								</paragraph><paragraph id="H87A81AA2EF73449F90EE951BEBAB63CB"><enum>(9)</enum><text>section
				3122.</text>
								</paragraph></subsection><subsection id="HF2577E8CB77D40919CD52EB426873BCD"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subpart:</text>
								<paragraph id="HF16778555B7E4ACF82E8FE461024F7CB"><enum>(1)</enum><header>High-need local
				educational agency</header><text>The term <term>high-need local educational
				agency</term> means a local educational agency—</text>
									<subparagraph id="H581C3D6F49124784A82F26AF02229ADE"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HF2D7A6D8298E4986A04EDC2F36747423"><enum>(i)</enum><text>that serves not fewer
				than 10,000 children from families with incomes below the poverty line;</text>
										</clause><clause id="H5D35AA33FE934C96A58BF142EA5A1BC8" indent="up1"><enum>(ii)</enum><text>for which not less than 20 percent
				of the children served by the agency are from families with incomes below the
				poverty line; or</text>
										</clause><clause id="H14E3400F3ABE4FB7B1B1A3013CEDF225" indent="up1"><enum>(iii)</enum><text>which has a teacher-to-student
				ratio of 1:25; and</text>
										</clause></subparagraph><subparagraph id="H628672736BD64CFBB1901451DAEDA464"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HF9F2E82FECA34C8D9A618A754865B949"><enum>(i)</enum><text>for which there is a
				high percentage of teachers not teaching in the academic subjects or grade
				levels that the teachers were trained to teach; or</text>
										</clause><clause id="H98F464831083488FB77071B4EA15C981" indent="up1"><enum>(ii)</enum><text>for which there is a high
				percentage of teachers with emergency, provisional, or temporary certification
				or licensing.</text>
										</clause></subparagraph></paragraph><paragraph id="H0A99BC0336324E2CA51CC6516121078C"><enum>(2)</enum><header>Other
				staff</header><text>The term <term>other staff</term> does not include
				administrators or administrative personnel.</text>
								</paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD637BEBFD32D4A34B766B974AE544192"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6301 et seq.) is amended by striking the items
			 relating to subpart 2 of part A of title VI and inserting the following:</text>
