		<section id="H47BF44A1A980404B9FE5E27FE4799F67" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Protection Act of
			 2011</short-title></quote>.</text>
		</section><section id="H4697F0B73D304E3590FD9C5BBD1DC8B8"><enum>2.</enum><header>Learned
			 intermediary defense</header>
			<subsection id="HB608014939BE475699BB804252078144"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">It shall not be a
			 defense to any tort claim in any court in the United States that a manufacture
			 of a product has fulfilled that manufacturer’s duty of care when the
			 manufacturer provides all of the necessary information to a learned
			 intermediary who then interacts with the consumer of the product.</text>
			</subsection><subsection id="H6E6109B38C2D4CA99A9BFB8884AC1AA7"><enum>(b)</enum><header>Definition</header><text>In
			 this section—</text>
				<paragraph id="HEE5050004B264F2095D384BFEA908EE2"><enum>(1)</enum><text>the term
			 <quote>learned intermediary</quote> means a person, licenced under applicable
			 State or Federal law, to advise a consumer whether or not to use the product in
			 question; and</text>
				</paragraph><paragraph id="H089C8C7385954B8AA93D4E3A2CD095DB"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>State</quote> includes the
			 District of Columbia, Puerto Rico, and any other commonwealth, possession, or
			 territory of the United States.</text>
