			 Space, and Technology</committee-name>, for a period to be subsequently
			 determined by the Speaker, in each case for consideration of such provisions as
			 fall within the jurisdiction of the committee concerned</action-desc>

		  United States and for the repatriation of manufacturing jobs off-shored to
		  other countries, and for other purposes.</official-title>

		<section id="H40B6815E295945A0AA88D3A4D89B523A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bring Jobs Back to America
			 Act</short-title></quote>.</text>
		</section><section id="H4664EC040E2E4D31A29BFEA244F94E72"><enum>2.</enum><header>National
			 manufacturing and repatriation strategy</header>
			<subsection id="HE4198E7692FD40408C8A9FD110EBC606"><enum>(a)</enum><header>National
			 manufacturing strategy</header><text display-inline="yes-display-inline">Not
			 later than 90 days after the date of the enactment of this Act, the Secretary
			 of Commerce (referred to in this Act as the <quote>Secretary</quote>)
			 shall—</text>
				<paragraph id="HD4418C2FA1B5470B88302E12D18EE972"><enum>(1)</enum><text>develop a
			 comprehensive national manufacturing strategy that aims to—</text>
					<subparagraph id="H71C59CD591534E2EB1E2E74BBEA4CE69"><enum>(A)</enum><text>increase overall
			 domestic manufacturing;</text>
					</subparagraph><subparagraph id="H048119E8FD2D4FB5A7B957320C64BEB7"><enum>(B)</enum><text>create private
			 sector jobs;</text>
					</subparagraph><subparagraph id="HA05D6D9949354DFB928C64967166D91E"><enum>(C)</enum><text>identify emerging
			 technologies to strengthen American competitiveness in the global marketplace;
			 and</text>
					</subparagraph><subparagraph id="H04D62F36F226492D8F513A42D4C4A6D9"><enum>(D)</enum><text>identify a
			 strategy for repatriating jobs to the United States;</text>
					</subparagraph></paragraph><paragraph id="H02ED9A67DD7B4ECC8423CE15D5B9E6EA"><enum>(2)</enum><text display-inline="yes-display-inline">submit a report to Congress summarizing the
			 progress and trends in manufacturing growth since the Secretary’s 2004 report,
			 <quote>Manufacturing in America: A Comprehensive Strategy to Address the
			 Challenges to U.S. Manufacturers</quote>;</text>
				</paragraph><paragraph id="HC642217EBCE7489B9F59086C1787ED7B"><enum>(3)</enum><text>establish targets
			 for manufacturing growth, including a subset of targets for jobs repatriated to
			 the United States, for each fiscal year 2012 through 2016, and report such
			 targets to Congress; and</text>
				</paragraph><paragraph id="HEE165588CCE64EB9BF750FB577DE3BA9"><enum>(4)</enum><text display-inline="yes-display-inline">conduct a survey of all existing Federal
			 manufacturing support programs and submit a report to Congress that includes
			 recommendations on how each Federal program surveyed can best support the
			 comprehensive national manufacturing strategy.</text>
				</paragraph></subsection><subsection id="H1C6E706C9E6C473981CE9391964EA951"><enum>(b)</enum><header>Biannual
			 American firm survey and report</header>
				<paragraph id="HA749419DBB7E4E78B58D7FCE56E0172A"><enum>(1)</enum><header>Survey</header><text>Not
			 later than 1 year after the date of the enactment of this Act and every 2 years
			 thereafter through fiscal year 2016, the Secretary shall conduct a survey of
			 all firms with headquarters in the United States that maintain manufacturing
			 facilities or customer service centers outside of the United States to
			 identify—</text>
					<subparagraph id="H87241DE8A09D4CE8BC358AB400D33FEA"><enum>(A)</enum><text>categories of
			 products manufactured or services provided at such facilities; and</text>
					</subparagraph><subparagraph id="H755925B555724FEF81AF4496500AA6A3"><enum>(B)</enum><text>the number of jobs
			 located at such facilities.</text>
					</subparagraph></paragraph><paragraph id="H561FF229667140CB86E1E8912AFF081F"><enum>(2)</enum><header>Database</header><text>The
			 Secretary shall create and maintain a database of the information collected
			 through each survey.</text>
				</paragraph><paragraph id="H5DB4E679B58F43D5BD787F7ABAB5092E"><enum>(3)</enum><header>Report</header><text>The
			 Secretary shall report to Congress on the information gathered in each survey,
			 including longitudinal trends in American manufacturing and the repatriation of
			 jobs.</text>
				</paragraph><paragraph id="HD7585B8DEBA9457D8AA3D030D3D2B90B"><enum>(4)</enum><header>Penalty</header><text>Any
			 firm described in paragraph (1) that chooses not to participate in the survey
			 shall not be eligible to receive Federal contracts or to renew existing Federal
			 contracts.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H8CAF98C9554144179087265446FE83B1" section-type="subsequent-section"><enum>3.</enum><header>Repatriation Task
			 Forces</header>
			<subsection id="HAE7D950DB5844A62AAED1A505CD9F5DF"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish such task
			 forces as the Secretary considers necessary to accomplish the established
			 targets for job repatriation and manufacturing growth established under section
			 2(a)(3).</text>
			</subsection><subsection id="H059547591DEC406AB77063ABE5DA1FEF"><enum>(b)</enum><header>Appointment</header><text>Each
			 task force established under subsection (a) shall be appointed by the Secretary
			 and include the following members:</text>
				<paragraph id="HBB0797844F15409DA69EDB2432AB44AB"><enum>(1)</enum><text>At least one
			 representative of each of the following components of the Department of
			 Commerce:</text>
					<subparagraph id="H04D6AA97CBB34AD1AF18B5B2600EA2C1"><enum>(A)</enum><text>Office of the
			 Secretary of Commerce.</text>
					</subparagraph><subparagraph id="H7C6A2F1313384BB9A8181EFCF99A8804"><enum>(B)</enum><text>Economic
			 Development Administration.</text>
					</subparagraph><subparagraph id="HABF446DDB9244A558871BFE3D559D702"><enum>(C)</enum><text>International
			 Trade Administration.</text>
					</subparagraph><subparagraph id="H410B535C35184FE0B0F04A4FB4C53415"><enum>(D)</enum><text>United States
			 Patent and Trademark Office.</text>
					</subparagraph><subparagraph id="H5A5AD944712B44E6B2B30C1E93B5EFCA"><enum>(E)</enum><text>National Institute
			 of Standards and Technology.</text>
					</subparagraph><subparagraph id="H4A1746A614A04216819A45C7CF1E1C0C"><enum>(F)</enum><text>Bureau of Industry
			 and Security.</text>
					</subparagraph></paragraph><paragraph id="H9DFB036884A444C2ACA2630913806AAC"><enum>(2)</enum><text>At least one
			 representative of the private sector.</text>
				</paragraph></subsection><subsection id="HC4D669B20F224B31BE918DBB3DF2E300"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">Each task force established under
			 subsection (a) shall—</text>
				<paragraph id="HB89A4B102A8C431987DFAA962BF2CF44"><enum>(1)</enum><text>identify United
			 States firms interested in repatriating production or services to the United
			 States;</text>
				</paragraph><paragraph id="HBAA9170B8B6641969869FDE34352BB38"><enum>(2)</enum><text>identify the
			 unique needs of each firm necessary to facilitate repatriation;</text>
				</paragraph><paragraph id="H4661B13A69A1486E8E22D695A39CE69F"><enum>(3)</enum><text>advise and assist
			 firms and State and local governments to promote and facilitate repatriation
			 opportunities;</text>
				</paragraph><paragraph id="H3B2944DFD5BF469A85CDD6A1857E70B3"><enum>(4)</enum><text>act as an
			 impartial advocate for all State and local governments choosing to compete for
			 a repatriating firm’s facility or jobs;</text>
				</paragraph><paragraph id="H01E1031FD9B84BBCA30703754D096D44"><enum>(5)</enum><text>to the maximum
			 extent practicable, work with Federal agencies to provide the technical
			 assistance necessary to firms and State and local governments to facilitate the
			 repatriation of facilities or jobs to the United States; and</text>
				</paragraph><paragraph id="H70FF601FD46B45748B44756116794196"><enum>(6)</enum><text>educate firms and
			 State and local governments on the National Manufacturing Strategy established
			 under section (2)(a), the task forces established under subsection (a), and all
			 Federal assistance available to facilitate repatriation.</text>
				</paragraph></subsection></section><section id="HD46DC2E80B914009B6BF3575A60A37FC" section-type="subsequent-section"><enum>4.</enum><header>American Economic
			 Security Commission</header>
			<subsection id="H683834389CF04CD28D20D539903E67AF"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is hereby established a commission to
			 be known as the <quote>American Economic Security Commission</quote>.</text>
			</subsection><subsection id="H3995ED83BB7942DFAE5B3401EF001620"><enum>(b)</enum><header>Duties</header><text>The
			 Commission shall carry out the following duties:</text>
				<paragraph id="H913EC432ED724E1B9AD37241BF285EF4"><enum>(1)</enum><header>Program for
			 American competitiveness</header><text>The Commission shall establish and carry
			 out a program to improve the competitiveness of the United States in the global
			 economy through technology-based planning. Under the program, the Commission
			 shall, on an ongoing basis—</text>
					<subparagraph id="H48DAD1776A88457B8247CB234A386758"><enum>(A)</enum><text>assess the
			 competitiveness of the United States in sectors of the global economy including
			 the manufacturing, aerospace, communications, information technology, energy,
			 and biotechnology sectors;</text>
					</subparagraph><subparagraph id="H72A8096628C64B9D89AEF6F44A684A6A"><enum>(B)</enum><text display-inline="yes-display-inline">identify, including through use of the
			 Technology Database and Mapping Program developed under paragraph (2)—</text>
						<clause id="H4A9E6482690A440FB2C0F3D1B77E13D7"><enum>(i)</enum><text>markets (including
			 anticipated markets) for new and developing technologies in such sectors of the
			 global economy; and</text>
						</clause><clause id="H333A6F59A8B34A3D81CF115B81E09EB5"><enum>(ii)</enum><text display-inline="yes-display-inline">new and developing technologies, including
			 manufacturing technologies, that may be used to gain a competitive advantage in
			 such sectors of the global economy; and</text>
						</clause></subparagraph><subparagraph id="H7A406530BA6C46409AA1AC65C2B92532"><enum>(C)</enum><text>identify measures
			 to take advantage of the markets and technologies identified under clauses (i)
			 and (ii) of subparagraph (B), respectively, to give the United States a
			 competitive advantage in such sectors of the global economy, including, as
			 appropriate, measures to encourage and facilitate the development, acquisition,
			 and use of technologies described in such clauses.</text>
					</subparagraph></paragraph><paragraph id="H241F7A7BD3674017B5A13CD781617AD4"><enum>(2)</enum><header>Technology
			 Database and Mapping Program</header><text>The Commission shall develop a
			 detailed, accurate, and comprehensive computer program, to be known as the
			 <quote>Technology Database and Mapping Program</quote>, to identify and keep
			 track of new and developing technologies described in clauses (i) and (ii) of
			 paragraph (1)(B).</text>
				</paragraph></subsection><subsection id="HF2D44CF0BE4848038DF0576705416776"><enum>(c)</enum><header>Membership</header>
				<paragraph id="HC6E66D3D2F474906A5B72D8F8472F22E"><enum>(1)</enum><header>Number and
			 appointment</header><text>The Commission shall be composed of 12 members
			 appointed as follows:</text>
					<subparagraph id="H3C63AAD758F7425D80B1BB33E3AEA18A"><enum>(A)</enum><text display-inline="yes-display-inline">Three members appointed by the majority
			 leader of the Senate.</text>
					</subparagraph><subparagraph id="H80A04A1DD4D147A4B0F2CF6F3AC5F0DB"><enum>(B)</enum><text>Three members
			 appointed by the minority leader of the Senate.</text>
					</subparagraph><subparagraph id="HF6866BA31E124BC89832E8EFE74FF6D2"><enum>(C)</enum><text>Three members
			 appointed by the Speaker of the House of Representatives.</text>
					</subparagraph><subparagraph id="H2B3D857DC48942BBB0FD4CFBB066E59A"><enum>(D)</enum><text>Three members
			 appointed by the minority leader of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="H8C621F523752483F9BAB2F3AE08934C5"><enum>(2)</enum><header>Deadline for
			 appointment</header><text>Each member of the Commission shall be appointed not
			 later than 180 days after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="H45A6A9A9FEA1463DB8498D795A06DAB2"><enum>(3)</enum><header>Terms</header><text>Each
			 member of the Commission shall be appointed for a term of 2 years, and may
			 serve no more than 3 terms.</text>
				</paragraph><paragraph id="HE2397BA7CEAC4135ADA0F3DE719B3E64"><enum>(4)</enum><header>Vacancies</header><text>A
			 vacancy in the Commission shall be filled in the same manner in which the
			 original appointment was made.</text>
				</paragraph><paragraph id="H7B65C8560D9745DBB1A165C9C9D39D53"><enum>(5)</enum><header>Service without
			 pay</header><text display-inline="yes-display-inline">The members of the
			 Commission shall serve without pay.</text>
				</paragraph><paragraph id="H01886F37469A4599B0EDEC3E9CA374AA"><enum>(6)</enum><header>Travel
			 expenses</header><text>Each member shall receive travel expenses, including per
			 diem in lieu of subsistence, in accordance with applicable provisions under
			 subchapter I of chapter 57 of title 5, United States Code.</text>
				</paragraph><paragraph id="HC43B8DC65FC7480FB3631241AB5EE119"><enum>(7)</enum><header>Quorum</header><text display-inline="yes-display-inline">Eight members of the Commission shall
			 constitute a quorum, except that if a majority of members in the quorum have
			 been appointed by a leader of the same political party, the quorum shall
			 include no fewer than 3 members appointed by a leader of the other political
			 party.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H203BE6F2AD354BC38AD438A31DF9C1B8"><enum>(8)</enum><header>Chair and Vice
			 Chair</header><text>The Commission shall elect a Chair and Vice Chair from
			 among its members. The term of office of the Chair and vice Chair shall be 2
			 years.</text>
				</paragraph><paragraph id="HA71FBBD5E06B4BC6B6B181D1BDD15587"><enum>(9)</enum><header>Meetings</header><text>The
			 Commission shall meet at least once each month at the call of the Chair or a
			 majority of its members. The Commission shall hold at least one meeting in
			 person in each of 6 months per year.</text>
				</paragraph></subsection><subsection id="H213DD0DE0AAE4859BDF5567D3307E204"><enum>(d)</enum><header>Director and
			 staff of Commission</header>
				<paragraph id="H0D0DC7D8608D4A088D631C808ACA8AE5"><enum>(1)</enum><header>Director</header>
					<subparagraph id="H4330027B7DCC4FEDB7CA773F48D0C85F"><enum>(A)</enum><header>In
			 general</header><text>Subject to paragraph (3) and to the extent provided in
			 advance in appropriation Acts, the Commission shall appoint and fix the
			 compensation of a director.</text>
					</subparagraph><subparagraph id="HA45C659CBE1E4ECFA6C277316B97B7FD"><enum>(B)</enum><header>Duties</header><text>The
			 director of the Commission shall be responsible for the administration and
			 coordination of the duties of the Commission and shall perform such other
			 duties as the Commission may direct.</text>
					</subparagraph></paragraph><paragraph id="H58715C83DFE6407CBBB10E2A92715FE1"><enum>(2)</enum><header>Staff</header><text>In
			 accordance with rules agreed upon by the Commission, subject to paragraph (3),
			 and to the extent provided in advance in appropriation Acts, the director may
			 appoint and fix the compensation of such additional personnel as may be
			 necessary to enable the Commission to carry out its duties.</text>
				</paragraph><paragraph id="HAFE9D137CF724A17969C9D2C4C5D9A1B"><enum>(3)</enum><header>Applicability of
			 certain civil service laws</header><text display-inline="yes-display-inline">The director and staff of the Commission
			 may be appointed without regard to the provisions of title 5, United States
			 Code, governing appointments in the competitive service, and may be compensated
			 without regard to the provisions of chapter 51 and subchapter III of chapter 53
			 of such title relating to classification and General Schedule pay rates, except
			 that compensation fixed under paragraph (1)(A) may not exceed $150,000 per
			 year, and compensation fixed under paragraph (2) may not exceed a rate equal to
			 the daily equivalent of the annual rate of basic pay for level V of the
			 Executive Schedule under section 5316 of title 5, United States Code.</text>
				</paragraph><paragraph id="H500E1959D30B482C943AC9AC5FE43025"><enum>(4)</enum><header>Experts and
			 consultants</header><text display-inline="yes-display-inline">In accordance
			 with rules agreed upon by the Commission and to the extent provided in advance
			 in appropriation Acts, the director may procure the services of experts and
			 consultants under section 3109(b) of title 5, United States Code, but at rates
			 for individuals not to exceed the daily equivalent of the annual rate of basic
			 pay for level V of the Executive Schedule under section 5316 of title 5, United
			 States Code.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H0B317FDDB1984CF7AE41A4955BC097A2"><enum>(5)</enum><header>Staff of Federal
			 agencies</header><text>Upon request of the Commission, the head of any Federal
			 department or agency may detail, without reimbursement from the Commission, any
			 of the personnel of that department or agency to the Commission to assist it in
			 carrying out its duties under this section. Such detailee shall retain the
			 rights, status, and privileges of their regular employment without
			 interruption.</text>
				</paragraph></subsection><subsection id="HEE998BA8D2AC4D50B96A4F9137D42481"><enum>(e)</enum><header>Powers of
			 Commission</header>
				<paragraph id="H7183CA0502584414A1282C8899F446C6"><enum>(1)</enum><header>Hearings and
			 evidence</header><text display-inline="yes-display-inline">The Commission may,
			 for the purpose of carrying out this section, hold hearings, sit and act at
			 times and places, take testimony, and receive evidence as the Commission
			 considers appropriate. The Commission may administer oaths or affirmations to
			 witnesses appearing before it.</text>
				</paragraph><paragraph id="HD3627D262DF04BC3A7ADA5514889E422"><enum>(2)</enum><header>Powers of
			 members and agents</header><text display-inline="yes-display-inline">Any member
			 or agent of the Commission may, if authorized by the Commission, take any
			 action which the Commission is authorized to take under this section.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H7A3A25CD046B43B2B138C9044D41A6B0"><enum>(3)</enum><header>Obtaining
			 official data</header><text>The Commission may secure directly from any
			 department or agency of the United States information necessary to enable it to
			 carry out this Act. Upon request of the Chair of the Commission, the head of
			 that department or agency shall, to the extent authorized by law, furnish such
			 information to the Commission.</text>
				</paragraph><paragraph id="HD357C45C49A449778983F8A1DA6622D8"><enum>(4)</enum><header>Gifts, bequests,
			 and devises</header><text>The Commission may accept, use, and dispose of gifts,
			 bequests, or devises of services or property, both real and personal, for the
			 purpose of aiding or facilitating the work of the Commission. Gifts, bequests,
			 or devises of money and proceeds from sales of other property received as
			 gifts, bequests, or devises shall be deposited in the Treasury and shall be
			 available for disbursement upon order of the Chair of the Commission.</text>
				</paragraph><paragraph id="H1508E7F8A6DB44FE855087CB869519B7"><enum>(5)</enum><header>Mails</header><text>The
			 Commission may use the United States mails in the same manner and under the
			 same conditions as other departments and agencies of the United States.</text>
				</paragraph><paragraph id="H347357500E254F249F840E281B4EACFB"><enum>(6)</enum><header>Administrative
			 support services</header><text display-inline="yes-display-inline">Upon the
			 request of the Commission, the Administrator of General Services shall provide
			 to the Commission, on a reimbursable basis, the administrative support services
			 necessary for the Commission to carry out its responsibilities under this
			 section.</text>
				</paragraph><paragraph id="H9DDD8789216A406C872E6C44B8099FBD"><enum>(7)</enum><header>Contract
			 authority</header><text display-inline="yes-display-inline">To the extent or in
			 the amounts provided in advance in appropriation Acts, the Commission may
			 contract with and compensate government and private agencies or persons to
			 enable the Commission to discharge its duties under this Act.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HEB9BA24284F94C0789885230A1BE1223"><enum>(f)</enum><header>Reports</header><text>The
			 Commission shall issue to Congress periodic reports on the following, as the
			 Commission considers appropriate:</text>
				<paragraph id="H55A6D30C1D404680BC769F2B654A120D"><enum>(1)</enum><text display-inline="yes-display-inline">The assessment of the competitiveness of
			 the United States under subsection (b)(1)(A).</text>
				</paragraph><paragraph id="H16085CCC2AB44EAFA896E74A9D3E1BEE"><enum>(2)</enum><text display-inline="yes-display-inline">The markets and technologies identified
			 under subsection (b)(1)(B).</text>
				</paragraph><paragraph id="H1417C4EF74504F21819E370BFAB8F035"><enum>(3)</enum><text display-inline="yes-display-inline">The measures identified under subsection
			 (b)(1)(C), and any factors affecting the implementation of such measures,
			 including—</text>
					<subparagraph id="H00074C7F2893490D895EBA742E9ADB60"><enum>(A)</enum><text>proposed trade
			 agreements and the enforcement of existing trade agreements;</text>
					</subparagraph><subparagraph id="H6C360F091FF54F3A98A617177E4FC27D"><enum>(B)</enum><text>taxation;</text>
					</subparagraph><subparagraph id="H95743A82153942BBBF7F241CFFF88CC4"><enum>(C)</enum><text>cybersecurity;</text>
					</subparagraph><subparagraph id="H1816E0584B06413F8DB34CF717C3DBB5"><enum>(D)</enum><text>the United States
			 patent system;</text>

				</paragraph></subsection><subsection id="HEDB5D0F96A264632A409F7A6B834F667"><enum>(g)</enum><header>Termination</header><text>The
			 authority for the Commission provided in this section shall terminate and the
			 Commission shall be dissolved on September 30, 2016.</text>
			</subsection><subsection id="H6AE688837FF348608103549F54DE90A9"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $1,000,000 for each of the fiscal years 2012 through 2016. No

			</subsection></section><section id="H52A62254DC5F436B92F63A4B56A112C5" section-type="subsequent-section"><enum>6.</enum><header>Study of tax
			 provisions to encourage repatriation of United States jobs</header>
			<subsection id="HD22C4F097D0449A0801FC891EF45D431"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Treasury, in consultation with the Secretary of Commerce, shall conduct a study
			 on the feasibility and potential impact of new tax provisions to encourage
			 United States companies to return jobs to the United States. Such study shall
			 include—</text>
				<paragraph id="HE29CDBA283AC4E5A8B6E2C3C549609F1"><enum>(1)</enum><text>a
			 review of—</text>
					<subparagraph id="HDB03642AF98442F79ADCB43AF3755486"><enum>(A)</enum><text>the past
			 effectiveness of section 956 of the Internal Revenue Code of 1986, and</text>
					</subparagraph><subparagraph id="HEF2097682FB94ABE996CFEC2525412C4"><enum>(B)</enum><text>the potential
			 effectiveness of other tax provisions which would encourage the repatriation
			 foreign earnings, and</text>
					</subparagraph></paragraph><paragraph id="H93A4184150AA4ADB85424AD64590BF53"><enum>(2)</enum><text>an estimate of the
			 loss in tax revenue associated with any provision for each job created.</text>
				</paragraph></subsection><subsection id="HDFFCF1E1A46447218D2F0E768CF40035"><enum>(b)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Secretary
			 of the Treasury shall submit to Congress a report of such study.</text>
