		<section id="H992CEE5B904649148F5041A8BF3781F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Belarus Democracy Reauthorization Act
			 of 2011</short-title></quote>.</text>
		</section><section id="HCC9AFD3D5D304022A5ED6ED1FF3367B1"><enum>2.</enum><header>Findings;
			 Statement of policy</header><text display-inline="no-display-inline">Sections 2
			 and 3 of the Belarus Democracy Act of 2004 (Public Law 109–480; 22 U.S.C. 5811
			 note) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H6E9EC312F1B6469F92F51E1CF755039D" style="OLC">
				<section id="H84DC323463104A62A4442E40E5E9E249"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
					<paragraph id="H08A5F9B0F2244A6698A346502F40E4D5"><enum>(1)</enum><text>The Government of
				Belarus has engaged in a pattern of clear and uncorrected violations of human
				rights and fundamental freedoms.</text>
					</paragraph><paragraph id="H69D8F225302B4BD89E67C864EEE99F57"><enum>(2)</enum><text>The Government of
				Belarus has engaged in a pattern of clear and uncorrected violations of basic
				principles of democratic governance, including through a series of
				fundamentally flawed presidential and parliamentary elections undermining the
				legitimacy of executive and legislative authority in that country.</text>
					</paragraph><paragraph id="H4BDC0727A9A6438689576EF780897AA0"><enum>(3)</enum><text>The Government of
				Belarus has subjected thousands of pro-democratic political activists to
				harassment, beatings, and jailings, particularly as a result of their attempts
				to peacefully exercise their right to freedom of assembly and
				association.</text>
					</paragraph><paragraph id="H0216A791C9884B628531EDE586ED8CA7"><enum>(4)</enum><text>The Government of
				Belarus has attempted to maintain a monopoly over the country’s information
				space, targeting independent media, including independent journalists, for
				systematic reprisals and elimination, while suppressing the right to freedom of
				speech and expression of those dissenting from the dictatorship of Aleksandr
				Lukashenka, and adopted laws restricting the media, including the Internet, in
				a manner inconsistent with international human rights agreements.</text>
					</paragraph><paragraph id="H20D8B355BF444FA08C625890ACBFD36E"><enum>(5)</enum><text>The Government of
				Belarus continues a systematic campaign of harassment, repression, and closure
				of nongovernmental organizations, including independent trade unions and
				entrepreneurs, and this crackdown has created a climate of fear that inhibits
				the development of civil society and social solidarity.</text>
					</paragraph><paragraph id="H012C6479AB9541EC8F8110E3991729EB"><enum>(6)</enum><text>The Government of
				Belarus has subjected leaders and members of select ethnic and religious
				minorities to harassment, including the imposition of heavy fines and denying
				permission to meet for religious services.</text>
					</paragraph><paragraph id="HEA4017E43006434F8689186084759C7F"><enum>(7)</enum><text>The Government of
				Belarus has attempted to silence dissent by persecuting human rights and
				pro-democracy activists with threats, firings, expulsions, beatings and other
				forms of intimidation, and restrictions on freedom of movement and prohibition
				of international travel.</text>
					</paragraph><paragraph id="HB1A1DDCD77CE4D54A00CC2E5679D645A"><enum>(8)</enum><text>The dictator of
				Belarus, Aleksandr Lukashenka, established himself in power by orchestrating an
				illegal and unconstitutional referendum that enabled him to impose a new
				constitution, abolishing the duly elected parliament, the 13th Supreme Soviet,
				installing a largely powerless National Assembly, extending his term in office,
				and removing applicable term limits.</text>
					</paragraph><paragraph id="H140C4CFB15A34394B3A88B3F8DACB8C9"><enum>(9)</enum><text>The Government of
				Belarus has failed to make a convincing effort to solve the cases of
				disappeared opposition figures Yuri Zakharenka, Viktor Gonchar, and Anatoly
				Krasovsky and journalist Dmitry Zavadsky, even though credible allegations and
				evidence links top officials of the Government to these disappearance.</text>
					</paragraph><paragraph id="H8615B4C1AB664701B5329D79A78945DF"><enum>(10)</enum><text>The Government of
				Belarus has restricted freedom of expression on the Internet by requiring
				Internet Service Providers to maintain data on Internet users and the sites
				they view and to provide such data to officials upon request, and by creating a
				government body with the authority to require Internet Service Providers to
				block Web sites.</text>
					</paragraph><paragraph id="H51A1DE2CFE4B4F5B8E38C3F53C07C07A"><enum>(11)</enum><text>On December 19,
				2010, the Government of Belarus conducted a presidential election that failed
				to meet the standards of the Organization for Security and Cooperation in
				Europe (OSCE) for democratic elections.</text>
					</paragraph><paragraph id="H993D198E34DF4907A1C33C27EB801FA1"><enum>(12)</enum><text>After the
				December 19, 2010, presidential election the Government of Belarus responded to
				opposition protests by beating an unknown number of protestors and detaining
				more than 600 peaceful protestors.</text>
					</paragraph><paragraph id="H9613262D6E7343B991AFFF08C9275908"><enum>(13)</enum><text>After the
				December 19, 2010, presidential election the Government of Belarus jailed seven
				of the nine opposition presidential candidates and abused the process of
				criminal prosecution to persecute them.</text>
					</paragraph><paragraph id="HFB2E796E82704117B888BBC6F301A8E2"><enum>(14)</enum><text>After the
				December 19, 2010, presidential election, the Government of Belarus disrupted
				independent broadcast and Internet media, and engaged in repressive actions
				against independent journalists.</text>
					</paragraph><paragraph id="H2A66ED4244AA48B1B677FF36D9442B88"><enum>(15)</enum><text>After the
				December 19, 2010, presidential election, Belarusian security services and
				police conducted raids targeting civil society groups, individual pro-democracy
				activists, and independent media.</text>
					</paragraph><paragraph id="H5AEE02B6AEB243358680B58F0CA56FB8"><enum>(16)</enum><text>After the
				December 19, 2010, presidential election, Belarusian officials refused to
				extend the mandate of the OSCE Office in Minsk.</text>
					</paragraph><paragraph id="HF5680B29195D4F50B9321A43FEACA4CA"><enum>(17)</enum><text>The Department of
				State, the Department of the Treasury, and other executive branch agencies have
				heretofore made effective use of this Act to promote the purposes of this Act,
				as stated in section 3 of this Act.</text>
					</paragraph></section><section id="H76CFEFF587A84D7CBF401509C484AB05"><enum>3.</enum><header>Statement of
				policy</header><text display-inline="no-display-inline">It is the policy of the
				United States to—</text>
					<paragraph id="HDB4739C64E1345BCAB265E9F2B331468"><enum>(1)</enum><text>condemn the
				conduct of the December 19, 2010, presidential election and crackdown on
				opposition candidates, political leaders, and activists, civil society
				representatives, and journalists;</text>
					</paragraph><paragraph id="H9E7C13AF9A8C4BCC91DE856D6B507BB2"><enum>(2)</enum><text>continue to call
				for the immediate release without preconditions of all political prisoners in
				Belarus, including all those individuals detained in connection with the
				December 19, 2010, presidential election;</text>
					</paragraph><paragraph id="H275181A82B6A48ACAB7CCEE575ED2971"><enum>(3)</enum><text>continue to
				support the aspirations of the people of Belarus for democracy, human rights,
				and the rule of law;</text>
					</paragraph><paragraph id="H17DA55B8CB3A4621A9AFE733ABE463CB"><enum>(4)</enum><text>continue to
				support the aspirations of the people of Belarus to preserve the independence
				and sovereignty of their country;</text>
					</paragraph><paragraph id="HD2E7FB6A5FB146D093EF340DD9FE71AB"><enum>(5)</enum><text>continue to
				support the growth of democratic movements and institutions in Belarus, with
				the ultimate goal of ending tyranny in that country;</text>
					</paragraph><paragraph id="H5C1003DBF12C498C9BD0F30A714E6AE5"><enum>(6)</enum><text>continue to refuse
				to accept the results of the fundamentally flawed December 19, 2010,
				presidential election held in Belarus, and to support calls for new
				presidential and parliamentary elections, conducted in a manner that is free
				and fair according to OSCE standards;</text>
					</paragraph><paragraph id="H3F24B8FA9C0146468175C1D73EAC9CFA"><enum>(7)</enum><text>continue to call
				for the fulfillment by the Belarusian government of Belarus’s freely undertaken
				obligations as an OSCE participating state;</text>
					</paragraph><paragraph id="H918D30D0B3754DD084E4B34EB10B9037"><enum>(8)</enum><text>continue to call
				for a full accounting of the disappearances of opposition leaders and
				journalists in Belarus, including Victor Gonchar, Anatoly Krasovsky, Yuri
				Zakharenka, and Dmitry Zavadsky, and the prosecution of those individuals who
				are in any way responsible for the disappearance of those opposition leaders
				and journalists;</text>
					</paragraph><paragraph id="HDCD9076873AF4B7088C48FC49C863E61"><enum>(9)</enum><text>continue to work
				closely with the European Union and other countries and international
				organizations, to promote the conditions necessary for the integration of
				Belarus into the European family of democracies; and</text>
					</paragraph><paragraph id="HEF160970469944EDB0DC96CA4AF9073C"><enum>(10)</enum><text>remain open to
				reevaluating United States policy toward Belarus as warranted by demonstrable
				progress made by the Government of Belarus consistent with the aims of this Act
				as stated in this section.

					</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H26FFAC35DAB34FEF9876B4A00D88BC9B"><enum>3.</enum><header>Assistance to
			 promote democracy and civil society in Belarus</header><text display-inline="no-display-inline">Section 4 of the Belarus Democracy Act of
			 2004 (Public Law 109–480; 22 U.S.C. 5811 note) is amended—</text>
			<paragraph id="H553227FA45844969B312872842F15184"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="HD9DB3C911F0B4FE4A085C118803DE81A"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>community</quote> and inserting <quote>family</quote>;
			 and</text>
				</subparagraph><subparagraph id="HF857331C27894A1C89A9AF0F695FD037"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>internationally accepted standards and under the supervision
			 of internationally recognized observers</quote> and inserting <quote>OSCE
			 standards and monitored by OSCE observers</quote>;</text>
				</subparagraph></paragraph><paragraph id="HA428520D22004B2CB2BE7C4C3384AFB6"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>primarily for indigenous</quote> and inserting <quote>for
			 independent, indigenous</quote>;</text>
			</paragraph><paragraph id="H6C66EDC343034769A6ACED3A68C75B03"><enum>(3)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="HFC4D4EE3FB8C4FD696533DC7E3B59B44"><enum>(A)</enum><text>by amending
			 paragraph (1) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H326B9A9647A742D89DE11F107D76F7FC" style="OLC">
						<paragraph id="HC4F53A7252974ED08E9D36BD4D06A5CD"><enum>(1)</enum><text display-inline="yes-display-inline">facilitating the development of
				independent, indigenous print, radio, television, and Internet broadcasting,
				whether working within Belarus or from locations outside the
				country;</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HC09BDDE7D62D44C2BE966C3E7702ECD7"><enum>(B)</enum><text>by redesignating
			 paragraphs (3) through (8) as paragraphs (2) through (7), respectively;
			 and</text>
				</subparagraph></paragraph><paragraph id="HCD5503C5AEB9495EB0478AF5BB8203D0"><enum>(4)</enum><text>in subsection
			 (d)(1), by striking <quote>such sums as may be necessary for each of the fiscal
			 years 2007 and 2008</quote> and inserting <quote>an amount not to exceed the
			 amount appropriated for fiscal year 2008 for each of fiscal years 2012 through
			 2014</quote>.</text>
			</paragraph></section><section id="HAC3384CA97C04465B3FD35C174A13272"><enum>4.</enum><header>Radio and
			 television broadcasting to Belarus</header><text display-inline="no-display-inline">Section 5 of the Belarus Democracy Act of
			 2004 (Public Law 109–480; 22 U.S.C. 5811 note) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="HE84737A7ACB64A67B3D4C5CB474A8DA0" style="OLC">
				<section id="H27C69AB6E17347629370802515A9048C"><enum>5.</enum><header>Radio,
				television, and internet broadcasting to Belarus</header><text display-inline="no-display-inline">It is the sense of Congress that the
				President should continue to support radio, television, and Internet
				broadcasting to the people of Belarus in languages spoken in Belarus, by Radio
				Free Europe/Radio Liberty, the Voice of America, European Radio for Belarus,
				and
				Belsat.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H362FC6D074B94238BE585CB4A84B61F4"><enum>5.</enum><header>Sanctions against
			 the Government of Belarus</header><text display-inline="no-display-inline">Section 6 of the Belarus Democracy Act of
			 2004 (Public Law 109–480; 22 U.S.C. 5811 note) is amended—</text>
			<paragraph id="HC93C464CC2B143F7B8554A0EB879F66A"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="HB75B3FC128D5455591740476C5FB5457"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>or expression, including those individuals jailed based on
			 political beliefs or expression in connection with repression that attended the
			 presidential election of December 19, 2010</quote> before the period at the
			 end;</text>
				</subparagraph><subparagraph id="HB475700B318D442DB0657826671DF875"><enum>(B)</enum><text>in paragraph (2),
			 by inserting <quote>, including politically motivated legal charges made in
			 connection with repression that attended the presidential election of December
			 19, 2010</quote> before the period at the end;</text>
				</subparagraph><subparagraph id="H3B3FDEED26EA499596AE55733F9C7615"><enum>(C)</enum><text>in paragraph (5),
			 by inserting <quote>and violations of human rights, including violations of
			 human rights committed in connection with the presidential election of December
			 19, 2010</quote> before the period at the end; and</text>
				</subparagraph><subparagraph id="H4C2D4C91CF354CD4BF1F09F0FEFEF1FB"><enum>(D)</enum><text>in paragraph (7),
			 by striking <quote>internationally recognized observers</quote> and inserting
			 <quote>OSCE observers</quote>;</text>
				</subparagraph></paragraph><paragraph id="H383D193F3D6F49A4B3444ED57F6EDCFB"><enum>(2)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="HB3D6BAFB2DFE41DB9123283E46ABAEAF"><enum>(A)</enum><text>in paragraph

				participated in the violent crackdown on opposition leaders, journalists, and
				peaceful protestors that occurred in connection with the presidential election

						</paragraph><paragraph id="H831C49FA6EC34BDBB983D083ADBA84DC"><enum>(5)</enum><text>is a member of any
				branch of the security or law enforcement services of Belarus and has
				participated in the persecution or harassment of religious groups, human rights
				defenders, democratic opposition groups, or independent media or
				journalists.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H3EB3287236DD4A9BA4D4D5C5665D74FF"><enum>(3)</enum><text>in subsection (e),
			 by striking <quote>of each international financial institution to which</quote>
			 and inserting <quote>at each international financial institution of
			 which</quote>; and</text>
			</paragraph><paragraph id="HFD8922B76C4A44A48BCF4C332FCDB3BF"><enum>(4)</enum><text>in subsection
			 (f)(2)(B)(ii), by striking <quote>(as defined in section 40102 of title 49,
			 United States Code)</quote>.</text>
			</paragraph></section><section id="HF06F6ED47D0246C6A23E4C8442CD2C6E"><enum>6.</enum><header>Report</header><text display-inline="no-display-inline">Section 8(a) of the Belarus Democracy Act of
			 2004 (Public Law 109–480; 22 U.S.C. 5811 note) is amended—</text>
			<paragraph id="H8DCF95F88400472EA040BA5F9F5660E9"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1)—</text>
				<subparagraph id="H41A3E0DBA54A426793EE79AAF79B18B6"><enum>(A)</enum><text>by striking
			 <quote>this Act</quote> and inserting <quote>the Belarus Democracy
			 Reauthorization Act of 2011</quote>; and</text>
				</subparagraph><subparagraph id="H902E6ED188AD4B28963C6B66E83F73AF"><enum>(B)</enum><text>by inserting
			 <quote>and the Commission on Security and Cooperation in Europe</quote> after
			 <quote>appropriate congressional committees</quote>;</text>
				</subparagraph></paragraph><paragraph id="H514DED82476C4210A93EF77CE7E7E64F"><enum>(2)</enum><text>in paragraph (1),
			 by striking <quote>sale or delivery of weapons or weapons-related
			 technologies</quote> and inserting <quote>sale or delivery or provision of
			 weapons or weapons-related technologies or weapons-related
			 training</quote>;</text>
			</paragraph><paragraph id="H42D3C3D79EAC4075A152F7470B4E3D57"><enum>(3)</enum><text>in paragraph (2),
			 by striking <quote>involved in the sale</quote> and inserting <quote>or
			 weapons-related training involved in the sale or delivery or
			 provision</quote>;</text>
			</paragraph><paragraph id="H05967E049CAB4CB3AB3C9561A4831017"><enum>(4)</enum><text>in paragraph (3),
			 by inserting <quote>or weapons-related training described in paragraph

				censorship or surveillance of the Internet, or the purchase or receipt by the
				Government of Belarus of any technology or training from any foreign government
				or organization for purposes related to the censorship or surveillance of the
				Internet.</text>

			</paragraph></section><section id="H3CF3AA11AACE45369F28C45F387CFD7C"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 9 of the Belarus Democracy Act of
			 2004 (Public Law 109–480; 22 U.S.C. 5811 note) is amended—</text>
			<paragraph id="H5EA5726C2BB34A45B394B50048CA11A9"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>Committee on International Relations</quote> and inserting
			 <quote>Committee on Foreign Affairs</quote>; and</text>
			</paragraph><paragraph id="H930D28B0A0F6469B8968166F4CC11884"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
				<subparagraph id="H35DFCD5200E94393AE90A559A2661BA1"><enum>(A)</enum><text>in subparagraph
			 (B)(i), by striking <quote>and prosecutors</quote> and inserting <quote>,
			 prosecutors, and heads of professional associations and educational
			 institutions</quote>; and</text>
				</subparagraph><subparagraph id="HD44925EF36AE420191244A794A2BE704"><enum>(B)</enum><text>in subparagraph
