<official-title display="yes">To prevent the termination of the temporary office of bankruptcy judges in certain judicial districts.</official-title>

<section id="H707C4675C89D4ADB929A418415EF7CE5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Temporary Bankruptcy Judgeships Extension Act of 2012</short-title></quote>.</text> </section> 
<section display-inline="no-display-inline" id="H7009E48D41694F498CF865464235B863" section-type="subsequent-section"><enum>2.</enum><header>Extension of temporary office of bankruptcy judges in certain judicial districts</header> 
<subsection id="H08280121775E427F8A4661AC75E5A838"><enum>(a)</enum><header>Temporary office of bankruptcy judges authorized by Public Law 109–8</header> 
<paragraph id="H340AAF18519F4F309F6550CBA9013BE4"><enum>(1)</enum><header>Extensions</header><text>The temporary office of bankruptcy judges authorized for the following districts by section 1223(b) of Public Law 109–8 (28 U.S.C. 152 note) are extended until the applicable vacancy specified in paragraph (2) in the office of a bankruptcy judge for the respective district occurs:</text> 
<subparagraph id="HEA665FFA9F6B4A25A88B41085C746CD8"><enum>(A)</enum><text display-inline="yes-display-inline">The central district of California.</text> </subparagraph> 
<subparagraph id="H3B892978792B4A6E9C0D62662B2E6F1A"><enum>(B)</enum><text>The eastern district of California.</text> </subparagraph> 
<subparagraph id="HB281159CC0E544C8AF5B45086A32943B"><enum>(C)</enum><text>The district of Delaware.</text> </subparagraph>

<clause id="H664F3813D4804D6D97FAC36DA7A320A5"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause> 
<clause id="H801A63C4EF6B47A1AFE0937CAD4B72E3"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph> 
<subparagraph display-inline="no-display-inline" id="H9845D8C9898C4E1490709D52E1C8386D"><enum>(B)</enum><header>Central district of California</header><text display-inline="yes-display-inline">The 1st, 2d, and 3d vacancies in the office of a bankruptcy judge for the central district of California—</text> 
<clause id="HFCF716A041AB46CFA95A38E68AE1BA6F"><enum>(i)</enum><text>occurring 5 years or more after the date of the enactment of this Act, and</text> </clause> 
<clause id="H31673F38F4D648C0BE972C4D97772BA1"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph> 
<subparagraph id="H958198A2166B4BC38731D092246C51D3"><enum>(C)</enum><header>District of Delaware</header><text display-inline="yes-display-inline">The 1st, 2d, 3d, and 4th vacancies in the office of a bankruptcy judge for the district of Delaware—</text> 
<clause id="HE7BC83B0317A4B5B95B021223C4B7591"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause> 
<clause id="HC6EDDB378C56410E903228BD8C529321"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph> 
<subparagraph id="H508734BA3B5E47FA8A42436734AA7BC4"><enum>(D)</enum><header>Southern district of Florida</header><text display-inline="yes-display-inline">The 1st and 2d vacancies in the office of a bankruptcy judge for the southern district of Florida—</text> 
<clause id="H751BE9952C3E40B58EA9B9A0FCB24401"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause> 
<clause id="HA0FE172B6DE44761B01F1384F3A678EA"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph> 
<subparagraph id="H818F6129E58346B5A5110B516CD5D998"><enum>(E)</enum><header>District of Maryland</header><text display-inline="yes-display-inline">The 1st, 2d, and 3d vacancies in the office of a bankruptcy judge for the district of Maryland—</text> 
<clause id="HF81DEB4EC74E4F4681B848EB0DCD30FE"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause> 
<clause id="H00FD2B8CDE024F5D94F549BF17F7C34A"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph></paragraph> 
<paragraph display-inline="no-display-inline" id="H34AB2D87AE5D49228C9A19939EFDC16E"><enum>(3)</enum><header>Applicability of other provisions</header><text display-inline="yes-display-inline">Except as provided in paragraphs (1) and (2), all other provisions of section 1223(b) of Public Law 109–8 (28 U.S.C. 152 note) remain applicable to the temporary office of bankruptcy judges referred to in paragraph (1).</text> </paragraph></subsection> 
<subsection id="H7E48B2B148D643C5900D7F1A9ECDFBBC"><enum>(b)</enum><header>Temporary office of bankruptcy judges extended by Public Law 109–8</header> 
<paragraph id="H9DBB0B88870243DCB21BDEB6CB700DB1"><enum>(1)</enum><header>Extensions</header><text display-inline="yes-display-inline">The temporary office of bankruptcy judges authorized by section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) and extended by section 1223(c) of Public Law 109–8 (28 U.S.C. 152 note) for the district of Delaware, the district of Puerto Rico, and the eastern district of Tennessee are extended until the applicable vacancy specified in paragraph (2) in the office of a bankruptcy judge for the respective district occurs.</text> </paragraph> 
<paragraph id="H4A3C9ACDAE8048099AE405915B90BC0A"><enum>(2)</enum><header>Vacancies</header> 
<subparagraph id="H773A54BF47C442C1B9C4B9B6E67DA00E"><enum>(A)</enum><header>District of Delaware</header><text display-inline="yes-display-inline">The 5th vacancy in the office of a bankruptcy judge for the district of Delaware—</text> 
<clause id="H73929D918C5644768535E8B5616286C8"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause> 
<clause id="H05886B599075451AA903D39D3B144EF4"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph> 
<subparagraph display-inline="no-display-inline" id="HB0F44CFD74E4491485A818FFCED3CDA3"><enum>(B)</enum><header>District of Puerto Rico</header><text display-inline="yes-display-inline">The 2d vacancy in the office of a bankruptcy judge for the district of Puerto Rico—</text> 
<clause id="HC77FE8F6794B4A34B84A459B01A9D0AA"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause> 
<clause id="HF7BE205F2AA145A995C0CBC641E202B5"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph> 
<subparagraph id="H9235F5875D7B48B9AC54203AA3031389"><enum>(C)</enum><header>Eastern district of Tennessee</header><text display-inline="yes-display-inline">The 1st vacancy in the office of a bankruptcy judge for the eastern district of Tennessee—</text> 
<clause id="H7DDB5B6FB3D648F0B0F8B617FF67E590"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause> 
<clause id="H7C00F6F42C404A98AD0CC13C188DDCB8"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph></paragraph> 
<paragraph display-inline="no-display-inline" id="HBFDCB6DB62584B89A2FE75DF0D773D24"><enum>(3)</enum><header>Applicability of other provisions</header><text display-inline="yes-display-inline">Except as provided in paragraphs (1) and (2), all other provisions of section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) and section 1223(c) of Public Law 109–8 (28 U.S.C. 152 note) remain applicable to the temporary office of bankruptcy judges referred to in paragraph (1).</text> </paragraph></subsection> 
<subsection id="HF0D94DE3AABB4934818583F5850775AB"><enum>(c)</enum><header>Temporary office of the bankruptcy judge authorized by Public Law 102–361 for the middle district of North Carolina</header> 
<paragraph id="H4EBD9D01DD2E44399FDC363A95F65825"><enum>(1)</enum><header>Extension</header><text display-inline="yes-display-inline">The temporary office of the bankruptcy judge authorized by section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) for the middle district of North Carolina is extended until the vacancy specified in paragraph (2) occurs.</text> </paragraph> 
<paragraph id="HBC2729C8767A4E8E889357FE1574CD76"><enum>(2)</enum><header>Vacancy</header><text display-inline="yes-display-inline">The 1st vacancy in the office of a bankruptcy judge for the middle district of North Carolina—</text> 
<subparagraph id="HE33D573C31134F92B5545AC397834797"><enum>(A)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </subparagraph> 
<subparagraph id="HF2B08BBF2BA04BC996C12DDE6314DFB3"><enum>(B)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall not be filled.</continuation-text></paragraph> 
<paragraph id="H2CD56A3AEC544828A51969E6BE051791"><enum>(3)</enum><header>Applicability of other provisions</header><text display-inline="yes-display-inline">Except as provided in paragraphs (1) and (2), all other provisions of section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) remain applicable to the temporary office of the bankruptcy judge referred to in paragraph (1).</text> </paragraph></subsection></section> 
<section id="H4E0F1F1BEF0D40D9806FFB274E70B690"><enum>3.</enum><header>Bankruptcy filing fee increase</header> 
<subsection id="H748EA89469F047498481213AF1EF5B61"><enum>(a)</enum><header>Bankruptcy filing fees</header><text>Section 1930(a)(3) of title 28, United States Code, is amended by striking <quote>$1,000</quote> and inserting <quote>$1,167</quote>.</text> </subsection> 
<subsection id="H31D776D11AFC4A92B9A39D6877B7DD48"><enum>(b)</enum><header>United States Trustee System Fund</header><text>Section 589a(b)(2) of title 28, United States Code, is amended by striking <quote>55</quote> and inserting <quote>48.89</quote>.</text> </subsection> 
<subsection id="HC9C8C64EC33B47479EBFC822CB3C8A3B"><enum>(c)</enum><header>Collection and deposit of miscellaneous bankruptcy fees</header><text>Section 406(b) of the Judiciary Appropriations Act, 1990 (28 U.S.C. 1931 note) is amended by striking <quote>25</quote> and inserting <quote>33.33</quote>.</text> </subsection> 
<subsection id="HF107AF40E6144358AC1918E9EAB8091E"><enum>(d)</enum><header>Paygo offset expenditure limitation</header><text>$42 of the incremental amounts collected by reason of the enactment of subsection (a) shall be deposited in a special fund in the Treasury to be established after the date of enactment of this Act. Such amounts shall be available for the purposes specified in section 1931(a) of title 28, United States Code, but only to the extent specifically appropriated by an Act of Congress enacted after the date of enactment of this Act.</text> </subsection> 
<subsection id="H09B5DE8088BD4685A5D6D89BE3B50FCA"><enum>(e)</enum><header>Effective date</header><text>This section and the amendments made by this section shall take effect 180 days after the date of enactment of this Act.</text> </subsection></section> 
<section id="HC3B72F5E95EA4E2DA0DBA33D5A3822A3"><enum>4.</enum><header>Subsequent reauthorization</header><text display-inline="no-display-inline">Prior to further reauthorization of any judgeship authorized by this Act, the Committee on the Judiciary of the Senate and House of Representatives shall conduct a review of the bankruptcy judgeships authorized by this Act to determine the need, if any, for continued reauthorization of each judgeship, to evaluate any changes in all bankruptcy case filings and their effect, if any, on filing fee revenue, and to require the Administrative Office of the Courts to submit a report to the Committee on the Judiciary of the Senate and House of Representatives on bankruptcy case workload, bankruptcy judgeship costs, and filing fee revenue.</text> </section>
