		<official-title>To require the reallocation and auction for commercial
		  use of the electromagnetic spectrum between the frequencies from 1755 megahertz
		  to 1780 megahertz.</official-title>

		<section id="H482D227170614093A3E72AA78938D806" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Efficient Use of Government Spectrum
			 Act of 2012</short-title></quote>.</text>
		</section><section id="H1B0AF2EDF2AA4C4F9FB20DE03179DC3F"><enum>2.</enum><header>Reallocation and
			 auction of 1755–1780 MHz band</header>
			<subsection id="H1F43E61FCF334A2AA8012BA44836F3CF"><enum>(a)</enum><header>Withdrawal or
			 modification of Federal Government station assignments</header><text display-inline="yes-display-inline">The President shall—</text>
				<paragraph id="H975048E09BF8403481679769BC5FB467"><enum>(1)</enum><text>not later than 5
			 years after the date of the enactment of this Act, withdraw or modify the
			 assignment to a Federal Government station of the electromagnetic spectrum
			 described in subsection (e); and</text>
				</paragraph><paragraph id="H6522BFE8B7C34366B0FDE798958DDB14"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 30 days after completing the
			 withdrawal or modification, notify the Commission that the withdrawal or
			 modification is complete.</text>
				</paragraph></subsection><subsection id="H3CCA543A2A8B43FF90A64D56B8100C83"><enum>(b)</enum><header>Reallocation and
			 auction</header><text display-inline="yes-display-inline">Notwithstanding
			 paragraph (15)(A) of section 309(j) of the Communications Act of 1934 (47
			 U.S.C. 309(j)), not later than 3 years after the date of the enactment of the
			 Middle Class Tax Relief and Job Creation Act of 2012 (Public Law 112–96), the
			 Commission shall—</text>
				<paragraph id="H15DD8E3406814DB2B94C2463D7E2BC66"><enum>(1)</enum><text display-inline="yes-display-inline">reallocate the electromagnetic spectrum
			 described in subsection (e) for commercial use; and</text>
				</paragraph><paragraph id="H1751B53EC04D48FEBC5ABE6FBBBB69F5"><enum>(2)</enum><text display-inline="yes-display-inline">as part of the system of competitive
			 bidding required by section 6401(b)(1)(B) of such Act (47 U.S.C.
			 1451(b)(1)(B)), grant new initial licenses, subject to flexible-use service
			 rules, for the use of such spectrum, paired with the spectrum between the
			 frequencies from 2155 megahertz to 2180 megahertz, inclusive.</text>
				</paragraph></subsection><subsection id="HDFFDE5222D3C431AAF10BEA70F61A9BF"><enum>(c)</enum><header>Auction
			 proceeds</header><text display-inline="yes-display-inline">For purposes of
			 depositing the proceeds from the competitive bidding described in subsection
			 (b)(2) that are attributable to the electromagnetic spectrum described in
			 subsection (e), such spectrum shall be treated as spectrum that is required to
			 be auctioned by section 6401(b)(1)(B) of the Middle Class Tax Relief and Job
			 Creation Act of 2012 (47 U.S.C. 1451(b)(1)(B)).</text>
			</subsection><subsection id="HF54FAEFD01FC47B481104B9C5D48916A"><enum>(d)</enum><header>Relocation of
			 and sharing by Federal Government stations</header>
				<paragraph id="H97F9AA940FBC4CE99C2FBA2C739D71EF"><enum>(1)</enum><header>Relocation
			 prioritized over sharing</header><text>Except as provided in paragraph (2), the
			 President shall withdraw under subsection (a)(1) the assignments to all Federal
			 Government stations of the electromagnetic spectrum described in subsection
			 (e).</text>
				</paragraph><paragraph id="H97D70C1FCAC64F8894E4F977D3D4E184"><enum>(2)</enum><header>Sharing if
			 relocation not possible</header>
					<subparagraph id="H12EA651BC3CF4568B655A8EEA11C999D"><enum>(A)</enum><header>In
			 general</header><text>If the President determines, based on an operational
			 impact assessment, that a Federal Government station cannot be relocated from
			 the electromagnetic spectrum described in subsection (e) without jeopardizing
			 essential military capability, the President shall modify under subsection
			 (a)(1) the assignment to such station of such spectrum to permit shared Federal
			 and non-Federal use.</text>
					</subparagraph><subparagraph id="H7FAC29788EF7429A8594973C2F1B57CC"><enum>(B)</enum><header>Identification
			 of stations</header><text display-inline="yes-display-inline">Not later than 18
			 months prior to the commencement of the competitive bidding described in
			 subsection (b)(2), the President shall—</text>
						<clause id="HBCCAC10404EF4A94A84B651D10FD176E"><enum>(i)</enum><text>identify any
			 Federal Government stations the assignments of which will be modified in
			 accordance with subparagraph (A); and</text>
						</clause><clause id="H6418848295B348269243C7D8AC132BF8"><enum>(ii)</enum><text>notify—</text>
							<subclause id="H5608E3FD68BB4C5DA7FC30D519D008C0"><enum>(I)</enum><text>the Assistant
			 Secretary of any stations so identified; and</text>
							</subclause><subclause id="H12E7D75B3F4A4D64934D22BC87059361"><enum>(II)</enum><text>each Federal
			 entity that operates such a station that the station has been so
			 identified.</text>
							</subclause></clause></subparagraph><subparagraph id="H5F04CE8364AC4240BA4EEBFA9BC1178D"><enum>(C)</enum><header>Development of
			 transition plan</header><text display-inline="yes-display-inline">For any
			 station identified by the President under subparagraph (B)(i), the transition
			 plan required by section 113(h)(1) of the National Telecommunications and
			 Information Administration Organization Act (47 U.S.C. 923(h)(1)) shall enable
			 non-Federal users to share with such station the electromagnetic spectrum
			 described in subsection (e). Where exclusion zones are necessary for the
			 protection of essential military capability, such plan shall provide for the
			 smallest possible zones consistent with such protection.</text>
					</subparagraph></paragraph></subsection><subsection id="H0D8B9D6724CE486BAFCEBEAFA122E602"><enum>(e)</enum><header>Spectrum
			 described</header><text>The electromagnetic spectrum described in this
			 subsection is the spectrum between the frequencies from 1755 megahertz to 1780
			 megahertz, inclusive.</text>
			</subsection><subsection id="H1148901F55D34583BF6EB5A3AFF3E74D"><enum>(f)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H609EF45E99464A6D814FD4EC66B53D09"><enum>(1)</enum><header>Assistant
			 Secretary</header><text display-inline="yes-display-inline">The term
			 <quote>Assistant Secretary</quote> means the Assistant Secretary of Commerce
			 for Communications and Information.</text>
				</paragraph><paragraph id="H3E3FE495435044ACAB3A28BFE7323704"><enum>(2)</enum><header>Commission</header><text>The
			 term <quote>Commission</quote> means the Federal Communications
			 Commission.</text>
