		  institute spending limits and transparency requirements for Federal conference
		  and travel expenditures, and for other purposes.</official-title>

		<section id="H6147E490CD7044DD8304F6840DC4062B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Government Spending Accountability Act
			 of 2012</short-title></quote> or the <quote><short-title>GSA Act of 2012</short-title></quote>.</text>
		</section><section id="H10E1E721A6454DDEB33DE938C096E14C"><enum>2.</enum><header>Limits and
			 transparency for conference and travel spending</header>
			<subsection id="H0359FA546F3A4296A343F576B49B6A8B"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">Chapter 57</external-xref> of title 5, United
			 States Code, is amended by inserting after
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5711">section
			 5711</external-xref> the following:</text>

					<section id="H744DA5BD72E241BDB2C0E7B9D677B11C"><enum>5712.</enum><header>Limits and
				transparency for conference and travel spending</header>
						<subsection display-inline="no-display-inline" id="HE31AC0DBB3AC4C7CA8F8252527D3800A"><enum>(a)</enum><header>Conference
				transparency and spending limits</header>
							<paragraph id="H10E03344CC184DFCBC46BD722248C5A6"><enum>(1)</enum><header>Public
				availability of conference materials</header><text display-inline="yes-display-inline">Each agency shall post on the public
				website of that agency detailed information on any presentation made by any
				employee of that agency at a conference (except to the extent the head of an
				agency excludes such information for reasons of national security)
				including—</text>
								<subparagraph id="HFF2894504CF44AE0A952D3E3AC6F37E9"><enum>(A)</enum><text display-inline="yes-display-inline">the prepared text of any verbal
				presentation made; and</text>
								</subparagraph><subparagraph id="HC4E35DBA53B74B748155E53BEE70B535"><enum>(B)</enum><text display-inline="yes-display-inline">any visual, digital, video, or audio
				materials presented, including photographs, slides, and audio-visual
				recordings.</text>
								</subparagraph></paragraph><paragraph id="H46AF051119194E5C90070F622C829FDD"><enum>(2)</enum><header>Limits on amount
				expended on a conference</header>
								<subparagraph id="H53EDDC55B9994914B2FD00EC632D666C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subparagraph (B), an agency may not expend more than $500,000 to support a
				single conference.</text>
								</subparagraph><subparagraph id="H9A7D6793C2D649708BBF8F5E7C47CC6A"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The head of an agency may waive the
				limitation in subparagraph (A) for a specific conference after making a
				determination that the expenditure is justified as the most cost-effective
				option to achieve a compelling purpose. The head of an agency shall submit to
				the appropriate congressional committees a report on any waiver granted under
				this subparagraph, including the justification for such waiver.</text>
								</subparagraph><subparagraph id="H41667BB9230C4134AD863092A04819B8"><enum>(C)</enum><header>Rule of
				construction</header><text display-inline="yes-display-inline">Nothing in this
				paragraph shall be construed to preclude an agency from receiving financial
				support or other assistance from a private entity to pay or defray the costs of
				a conference the total cost of which exceeds $500,000.</text>
								</subparagraph></paragraph></subsection><subsection id="H2AB8B13DB1BB4745B4AC2B4EA9073D63"><enum>(b)</enum><header>International
				conference rule</header><text display-inline="yes-display-inline">An agency may
				not pay the travel expenses for more than 50 employees of that agency who are
				stationed in the United States, for any international conference, unless the
				Secretary of State determines that attendance for such employees is in the
				national interest.</text>
						</subsection><subsection id="H663556C796684E7987089EB178CEAFCF"><enum>(c)</enum><header>Report on travel
				expenses required</header><text display-inline="yes-display-inline">At the
				beginning of each quarter of each fiscal year, each agency shall post on the
				public website of that agency a report on each conference for which the agency
				paid travel expenses during the preceding 3 months that includes—</text>
							<paragraph id="H8EB40DD0D0284515AEA0ABB7173E6C9E"><enum>(1)</enum><text display-inline="yes-display-inline">the itemized expenses paid by the agency,
				including travel expenses, and any agency expenditures to otherwise support the
				conference;</text>
							</paragraph><paragraph id="H5C729A2D6CD046E9BF10E9D005A2C6DB"><enum>(2)</enum><text display-inline="yes-display-inline">the primary sponsor of the
				conference;</text>
							</paragraph><paragraph id="HD168187573CC4C67A7FD58DCFF0358AA"><enum>(3)</enum><text display-inline="yes-display-inline">the location of the conference;</text>
							</paragraph><paragraph id="HB400D0C413C54B4E99F190709E25E9BC"><enum>(4)</enum><text display-inline="yes-display-inline">the date of the conference;</text>
							</paragraph><paragraph id="H664CC2E8C79948848900B189309E4685"><enum>(5)</enum><text display-inline="yes-display-inline">a brief explanation of how the
				participation of employees from such agency at the conference advanced the
				mission of the agency;</text>
							</paragraph><paragraph id="H5EA30A1D931346F1994B91982B663036"><enum>(6)</enum><text display-inline="yes-display-inline">the title of any employee, or any
				individual who is not a Federal employee, whose travel expenses or other
				conference expenses were paid by the agency;</text>
							</paragraph><paragraph id="H2FCA69F5FB10439B8BBE5BC92CE3697C"><enum>(7)</enum><text display-inline="yes-display-inline">the total number of individuals whose
				travel expenses or other conference expenses were paid by the agency;
				and</text>
							</paragraph><paragraph id="H6DC6E006748549A5AF88A084315886DD"><enum>(8)</enum><text display-inline="yes-display-inline">in the case of a conference for which that
				agency was the primary sponsor, a statement that—</text>
								<subparagraph id="H42EFF4E69063494C99D172561356D2AA"><enum>(A)</enum><text display-inline="yes-display-inline">describes the cost to the agency of
				selecting the specific conference venue;</text>
								</subparagraph><subparagraph id="HCAEE0B1886114F21A95BFF10C4D6692B"><enum>(B)</enum><text display-inline="yes-display-inline">describes why the location was selected,
				including a justification for such selection;</text>
								</subparagraph><subparagraph id="H3F7E4AE4ABEF442DB718389CC76E3485"><enum>(C)</enum><text display-inline="yes-display-inline">demonstrates the cost efficiency of the
				location;</text>
								</subparagraph><subparagraph id="HEE52616487814911803CBF4810932624"><enum>(D)</enum><text display-inline="yes-display-inline">provides a cost benefit analysis of holding
				a conference rather than conducting a teleconference; and</text>
								</subparagraph><subparagraph id="H5914ABC1ECC74A2C9925853EA964CD4D"><enum>(E)</enum><text display-inline="yes-display-inline">describes any financial support or other
				assistance from a private entity used to pay or defray the costs of the
				conference, and for each case where such support or assistance was used, the
				head of the agency shall include a certification that there is no conflict of
				interest resulting from such support or assistance.</text>
								</subparagraph></paragraph></subsection><subsection id="HADA4CB8A4AE0453AAA7AA4656345E85E"><enum>(d)</enum><header>Format and
				publication of report</header><text display-inline="yes-display-inline">Each
				report posted on the public website under subsection (c) shall—</text>
							<paragraph id="HB2AEE563E65E4D1EB60E96E31F74E924"><enum>(1)</enum><text display-inline="yes-display-inline">be in a searchable electronic format;
				and</text>
							</paragraph><paragraph id="HF90D9357629A4CA6B97686191B6AE784"><enum>(2)</enum><text display-inline="yes-display-inline">remain on that website for at least 5 years
				after the date of posting.</text>
							</paragraph></subsection><subsection id="HF9AA3FC0A8954E21A781E183A4ABDAC0"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph id="H5A5735CA31D746FE9B6F7C7E52F7C7C2"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <quote>agency</quote> has the
				meaning given that term under section 5701, but does not include the government
				of the District of Columbia.</text>
							</paragraph><paragraph id="H5480147E76DE4195A467DD34F0A0D9B8"><enum>(2)</enum><header>Conference</header><text display-inline="yes-display-inline">The term <term>conference</term> means a
				meeting, retreat, seminar, symposium, or event to which an employee travels 25
				miles or more to attend, that—</text>
								<subparagraph id="H2ADBFEF7E97B4306A48CF61073D33B90"><enum>(A)</enum><text>is held for
				consultation, education, discussion, or training; and</text>
								</subparagraph><subparagraph id="HA59C9A2C46BE408791BCCEABB996FF66"><enum>(B)</enum><text>is not held
				entirely at a Government facility.</text>
								</subparagraph></paragraph><paragraph id="HEFC4F8870A3A4AD397D419A97C5C1AC6"><enum>(3)</enum><header>International
				conference</header><text display-inline="yes-display-inline">The term
				<term>international conference</term> means a conference occurring outside the
				United States attended by representatives of—</text>
								<subparagraph id="H251BED4877C74331B4CE26B82DC27BD8"><enum>(A)</enum><text display-inline="yes-display-inline">the Government of the United States;
				and</text>
								</subparagraph><subparagraph id="H4A4556962BEC4F7199511CD4B72A27DD"><enum>(B)</enum><text>any foreign
				government, international organization, or foreign nongovernmental
				organization.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA312AC1388FE40CDB8B53017DFEED7BC"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text display-inline="yes-display-inline">The
			 table of sections for
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter
			 57</external-xref> of title 5, United States Code, is amended by inserting
			 after the item relating to
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5711">section
			 5711</external-xref> the following:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD5FA309DE30740309BA962AC155A3C7B"><enum>(c)</enum><header>Annual travel
			 expense limits</header>
				<paragraph id="HACA22CCF037149289DC912D13F23F43C"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In the case of each
			 of fiscal years 2013 through 2017, an agency (as defined under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5712">section
			 5712(e)</external-xref> of title 5, United States Code, as added by subsection
			 (a)) may not make, or obligate to make, expenditures for travel expenses, in an
			 aggregate amount greater than 70 percent of the aggregate amount of such
			 expenses for fiscal year 2010.</text>
				</paragraph><paragraph id="H9D1C7BA50D7B445C8E147B1B1B5BB872"><enum>(2)</enum><header>Identification
			 of travel expenses</header>
					<subparagraph id="H979C5FDB9212466B99A2C16C150F05FE"><enum>(A)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">Not later than December 31, 2012, and after
			 consultation with the Administrator of General Services and the Director of the
			 Administrative Office of the United States Courts, the Director of the Office
			 of Management and Budget shall establish guidelines for the determination of
			 what expenses constitute travel expenses for purposes of this subsection. The
			 guidelines shall identify specific expenses, and classes of expenses, that are
			 to be treated as travel expenses.</text>
					</subparagraph><subparagraph id="HFFD6B937296546F0955FE5FD11E97F1E"><enum>(B)</enum><header>Exemption for
			 military travel</header><text display-inline="yes-display-inline">The
			 guidelines required under subparagraph (A) shall exclude military travel
			 expenses in determining what expenses constitute travel expenses. Military
			 travel expenses shall include travel expenses involving military combat, the
			 training or deployment of uniformed military personnel, and such other travel
			 expenses as determined by the Director of the Office of Management and Budget,
			 in consultation with the Administrator of General Services and the Director of
			 the Administrative Office of the United States Courts.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
