		<section id="HE07FED0BAED0453EA4D8D4769C149F1C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Midnight Rule Relief Act of
			 2012</short-title></quote>.</text>
		</section><section id="H5F38CE8B4BB8487EBA14E3ED4F268855"><enum>2.</enum><header>Moratorium on
			 midnight rules</header><text display-inline="no-display-inline">Except as
			 provided under sections 3 and 4, during the moratorium period, an agency may
			 not propose or finalize any midnight rule that the Administrator of the Office
			 of Information and Regulatory Affairs of the Office of Management and Budget
			 finds is likely to result in—</text>
			<paragraph id="H6DC9694BB6CF4058BF6F1BA294858E28"><enum>(1)</enum><text display-inline="yes-display-inline">an annual effect on the economy of
			 $100,000,000 or more;</text>
			</paragraph><paragraph id="HBE4F7F0CFD7C4505BC03BC898CAE7BD9"><enum>(2)</enum><text>a
			 major increase in costs or prices for consumers, individual industries,
			 Federal, State, or local government agencies, or geographic regions; or</text>
			</paragraph><paragraph id="H24237AB5F35343298B7478E718E9CB86"><enum>(3)</enum><text>significant
			 adverse effects on competition, employment, investment, productivity,
			 innovation, or on the ability of United States-based enterprises to compete
			 with foreign-based enterprises in domestic and export markets.</text>
			</paragraph></section><section id="HF5BECAA7775E4A7C878279DF02CEE801"><enum>3.</enum><header>Special rule on
			 statutory, regulatory, and judicial deadlines</header>
			<subsection id="H80976D89EABC4D1982F55CE4FFFB0DB1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2 shall not
			 apply with respect to any deadline—</text>
				<paragraph id="HF2191F2D4D0C42E684B571F602FAE54C"><enum>(1)</enum><text>for, relating to,
			 or involving any midnight rule;</text>
				</paragraph><paragraph id="H39A11B3349BD4C2C8334FCF7731666B2"><enum>(2)</enum><text>that was
			 established before the beginning of the moratorium period; and</text>
				</paragraph><paragraph id="H4C45A26B36DC495599CDA85016855850"><enum>(3)</enum><text>that is required
			 to be taken during the moratorium period.</text>
				</paragraph></subsection><subsection id="H4EB57C3A58984FE6BF23BFED56FFB8B2"><enum>(b)</enum><header>Publication of
			 deadlines</header><text display-inline="yes-display-inline">Not later than 30
			 days after the beginning of a moratorium period, the Administrator of the
			 Office of Information and Regulatory Affairs of the Office of Management and
			 Budget shall identify and publish in the Federal Register a list of deadlines
			 covered by subsection (a).</text>
			</subsection></section><section id="HE629C63647404429AF361AF18A1DCDC1"><enum>4.</enum><header>Exception</header>
			<subsection id="HE6016D66D5A34DE2ADE573007FA4439C"><enum>(a)</enum><header>Emergency
			 exception</header><text display-inline="yes-display-inline">Section 2 shall not
			 apply to a midnight rule if the President determines that the midnight rule
			 is—</text>
				<paragraph id="HCFA5CEA8F0374AA3BA8A2A9443B526DB"><enum>(1)</enum><text display-inline="yes-display-inline">necessary because of an imminent threat to
			 health or safety or other emergency;</text>
				</paragraph><paragraph id="HA8F45307624C40A9AF7463646A23F7A7"><enum>(2)</enum><text>necessary for the
			 enforcement of criminal laws;</text>
				</paragraph><paragraph id="HECF1362BF13248F99E262DCF96F75D7E"><enum>(3)</enum><text>necessary for the
			 national security of the United States; or</text>
				</paragraph><paragraph id="H8F50C48E7C9545B2B5DE5BED65B59D94"><enum>(4)</enum><text>issued pursuant to
			 any statute implementing an international trade agreement.</text>
				</paragraph></subsection><subsection id="H52BDB5DC94354B77A8D682B06363B8CB"><enum>(b)</enum><header>Deregulatory
			 exception</header><text display-inline="yes-display-inline">Section 2 shall not
			 apply to a midnight rule that the Administrator of the Office of Information
			 and Regulatory Affairs within the Office of Management and Budget certifies in
			 writing is limited to repealing an existing rule.</text>
			</subsection><subsection commented="no" id="H9BA4721BA19A4458AE19154A484E2282"><enum>(c)</enum><header>Notice of
			 exceptions</header><text display-inline="yes-display-inline">Not later than 30
			 days after a determination under subsection (a) or a certification is made
			 under subsection (b), the head of the relevant agency shall publish in the
			 Federal Register any midnight rule excluded from the moratorium period due to
			 an exception under this section.</text>
			</subsection></section><section id="H8A13094A40444A8B9262A41471674EA2"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H4A5026C47DD64A23BE7673C13699C087"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the
			 meaning given that term under section 551 of title 5, United States Code,
			 except that such term does not include—</text>
				<subparagraph id="H008174F7B3094A73991717C592CE1AF0"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal Election Commission;</text>
				</subparagraph><subparagraph id="H6E88B3887779420592BB0B7F979F8F93"><enum>(B)</enum><text>the Board of
			 Governors of the Federal Reserve System;</text>
				</subparagraph><subparagraph id="HA883131D122A447ABF0951A1CAF4B01A"><enum>(C)</enum><text>the Federal
			 Deposit Insurance Corporation; or</text>
				</subparagraph><subparagraph id="HCB499BC1013A4866838294DCA6E12EDE"><enum>(D)</enum><text>the United States
			 Postal Service.</text>
				</subparagraph></paragraph><paragraph id="H6AEEDC97B57F4FC1A8597F47FA90C8DC"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">The term <term>deadline</term> means any
			 date certain for fulfilling any obligation or exercising any authority
			 established by or under any Federal statute or rule, or by or under any court
			 order implementing any Federal statute, regulation, or rule.</text>
			</paragraph><paragraph id="H731D2EEA3A044AE39119141C9363D502"><enum>(3)</enum><header>Moratorium
			 period</header><text display-inline="yes-display-inline">The term
			 <term>moratorium period</term> means the day after the day referred to in
			 section 1 of title 3, United States Code, through January 20 of the following
			 year, in which a President is not serving a consecutive term.</text>
			</paragraph><paragraph id="HB48ECF5AA1C145C687368297D93E8B9F"><enum>(4)</enum><header>Midnight
			 rule</header><text display-inline="yes-display-inline">The term <term>midnight
			 rule</term> means an agency statement of general applicability and future
			 effect, issued during the moratorium period, that is intended to have the force
			 and effect of law and is designed—</text>
				<subparagraph id="H4121B259A37B4A699DD34FE67A646468"><enum>(A)</enum><text display-inline="yes-display-inline">to implement, interpret, or prescribe law
			 or policy; or</text>
				</subparagraph><subparagraph id="H2A833E4D17694702B429DADB2E9EF8FF"><enum>(B)</enum><text>to describe the
			 procedure or practice requirements of an agency.</text>
				</subparagraph></paragraph><paragraph id="H3914315C8DC94A5E87B0F9D215ADE34E"><enum>(5)</enum><header>Rule</header><text>The
			 term <term>rule</term> has the meaning given that term under section 551 of
			 title 5, United States Code.</text>
