		<official-title>To direct the Secretary of Defense to work with
		  non-Federal entities and accept non-Federal funding under strict implementation
		  guidelines to promote efficiencies of the space transportation infrastructure
		  of the Department of Defense in commercial space activities.</official-title>

		<section id="HB30CEBCAF89D4EFD8F11168BB3FC306A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Revitalizing America’s Commercial
			 Entrepreneurs for Space Act</short-title></quote> or the <quote><short-title>RACE for Space Act</short-title></quote>.</text>
		</section><section id="HB03ADA1DE8674A759881C43E4F74C98C"><enum>2.</enum><header>Commercial space
			 launch cooperation</header>
			<subsection id="H38A7163A5C844E45BDC28E025EFD5D8E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 135 of title
			 10, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HFFB845854BBF4C4DA13D0AF111B2DDB2" style="USC">
					<section id="HC5207E68847B4FD9BD5A2BB60C1F0A66"><enum>2275.</enum><header>Commercial
				space launch cooperation.</header>
						<subsection id="H08C0346D08944DF984265090B472AFE2"><enum>(a)</enum><header>Authority</header><text>The
				Secretary of Defense may, to assist the Secretary of Transportation in carrying
				out responsibilities set forth in titles 49 and 51 with respect to private
				sector involvement in commercial space activities and public-private
				partnerships pertaining to space transportation infrastructure, take such
				actions as the Secretary considers to be in the best interest of the Federal
				Government to do the following:</text>
							<paragraph id="HAC553D21E5D84178896F4C38BE683E91"><enum>(1)</enum><text>Maximize the use
				of the capacity of the space transportation infrastructure of the Department of
				Defense by the private sector in the United States.</text>
							</paragraph><paragraph id="H59ED81FA1A00450BBCAA2B90F4B61429"><enum>(2)</enum><text>Maximize the
				effectiveness and efficiency of the space transportation infrastructure of the
				Department of Defense.</text>
							</paragraph><paragraph id="H13D1427BA56846C8AD6143E6347054D3"><enum>(3)</enum><text>Reduce the cost of
				services provided by the Department of Defense related to space transportation
				infrastructure at launch support facilities and space recovery support
				facilities.</text>
							</paragraph><paragraph id="H0FDE185523B54BA38628CB845B26D209"><enum>(4)</enum><text>Encourage
				commercial space activities by enabling investment in the space transportation
				infrastructure of the Department of Defense by covered entities.</text>
							</paragraph><paragraph id="H44B2A1322034460BAB3D156C70F54B93"><enum>(5)</enum><text>Foster cooperation
				between the Department of Defense and covered entities.</text>
							</paragraph></subsection><subsection id="HF4E50ACA57064DA6A6D76919C79B8B2A"><enum>(b)</enum><header>Authority for
				contract and other agreement relating to space transportation
				infrastructure</header><text>The Secretary of Defense—</text>
							<paragraph id="H872252EE6ED1405FAC013CF748A5173E"><enum>(1)</enum><text>may enter into a
				contract or other agreement with a covered entity to provide to the covered
				entity support and services related to the space transportation infrastructure
				of the Department of Defense; and</text>
							</paragraph><paragraph id="H37A31D7F3B8E425CA4EC03F544DE07D7"><enum>(2)</enum><text>upon the request
				of that covered entity, may include such support and services in the space
				launch and reentry range support requirements of the Department of Defense
				if—</text>
								<subparagraph id="H3BB1895E3CBC4D5DA3CF1653838A1680"><enum>(A)</enum><text>the Secretary
				determines that the inclusion of such support and services in such
				requirements—</text>
									<clause id="HC43AAE863050420FA3AC1B2807986DC5"><enum>(i)</enum><text>is
				in the best interest of the Federal Government;</text>
									</clause><clause id="HBD61B0AEBC254A0785C419F5FC6313DF"><enum>(ii)</enum><text>does not
				interfere with the requirements of the Department of Defense; and</text>
									</clause><clause id="H63A8180B3428440F96EB2727933BAFC5"><enum>(iii)</enum><text>does not compete
				with the commercial space activities of other covered entities, unless that
				competition is in the national security interests of the United States;
				and</text>
									</clause></subparagraph><subparagraph id="HC61E7C2B359246AAB967507F6200D35F"><enum>(B)</enum><text>any commercial
				requirement included in a contract or other agreement entered into under this
				subsection has full non-Federal funding before the execution of the contract or
				other agreement.</text>
								</subparagraph></paragraph></subsection><subsection id="HDC3B093D87F146CF85A273CCADFF089C"><enum>(c)</enum><header>Contributions</header>
							<paragraph id="H10595FF9118447218B262B5FD356E2AD"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Defense may enter into contracts or
				other agreements with covered entities on a cooperative and voluntary basis to
				accept contributions of funds, services, and equipment to carry out this
				section.</text>
							</paragraph><paragraph id="HA4B1162856FB4737A061D809586193B3"><enum>(2)</enum><header>Use of
				contributions</header><text>Any funds, services, or equipment accepted by the
				Secretary under this subsection—</text>
								<subparagraph id="H9C6188CB65FF44979E95012804999D61"><enum>(A)</enum><text>may be used only
				for the objectives specified in this section in accordance with terms of use
				set forth in the contract or other agreement entered into under this
				subsection; and</text>
								</subparagraph><subparagraph id="H65A5486AD7AA41DA96568E17DBB25EC8"><enum>(B)</enum><text>shall be managed
				by the Secretary in accordance with regulations of the Department of
				Defense.</text>
								</subparagraph></paragraph><paragraph id="H41B2CEEE9BBA4D56B7B64DCF3B289456"><enum>(3)</enum><header>Requirements
				with respect to agreements</header><text>A contract or other agreement entered
				into under this subsection shall address the terms of use, ownership and
				disposition of the funds, and services or equipment contributed pursuant to the
				contract or other agreement.</text>
							</paragraph></subsection><subsection id="H75C7A6E0F08E4E43B8EF70E3331A82ED"><enum>(d)</enum><header>Defense
				cooperation space launch account</header>
							<paragraph id="H6B6F0B25721B4788AE673833E992580F"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the Treasury of the United States a special account to be
				known as the <term>Defense Cooperation Space Launch Account</term>.</text>
							</paragraph><paragraph id="HEFB008AF30EC4F8B9264AE6F3623C4B3"><enum>(2)</enum><header>Crediting of
				funds</header><text>Funds received by the Secretary of Defense under subsection
				(c) shall be credited to the Defense Cooperation Space Launch Account and shall
				be available until expended without further authorization or appropriation only
				for the objectives specified in this section.</text>
							</paragraph></subsection><subsection id="HF68B623EC74C4505B882892D08649524"><enum>(e)</enum><header>Annual
				report</header><text>Not later than January 31 of each year, the Secretary of
				Defense shall submit to the congressional defense committees a report on the
				funds and equipment accepted and used by the Secretary under this section
				during the previous fiscal year.</text>
						</subsection><subsection id="HBBA44523484E4039954C8D5B6E1E128B"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HBBDB1ED37334452198D971B24A1F984E"><enum>(1)</enum><header>Covered
				entity</header><text>The term <term>covered entity</term> means a non-Federal
				entity that—</text>
								<subparagraph id="HB9E3B08D6E274E1B928BB2DA1533EA0E"><enum>(A)</enum><text>is organized under
				the laws of the United States or of any jurisdiction within the United States;
				and</text>
								</subparagraph><subparagraph id="H8B1C321C365444EC98AE0040AA0BE4E0"><enum>(B)</enum><text>is engaged in
				commercial space activities.</text>
								</subparagraph></paragraph><paragraph id="HBEFC6149655C4B2DBC0FBD42169AD088"><enum>(2)</enum><header>Launch support
				facilities</header><text>The term <term>launch support facilities</term> has
				the meaning given that term in section 50501(7) of title 51.</text>
							</paragraph><paragraph id="H67777D35CDA8417BAACEA26255F67FAE"><enum>(3)</enum><header>Space recovery
				support facilities</header><text>The term <term>space recovery support
				facilities</term> has the meaning given that term in section 50501(11) of title
				51.</text>
							</paragraph><paragraph id="H381BA1A4209A43CF81B0179EBA75680D"><enum>(4)</enum><header>Space
				transportation infrastructure</header><text>The term <term>space transportation
				infrastructure</term> has the meaning given that term in section 50501(12) of
				title
				51.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H929B6E1436714F6EB6FB4617A00D66A3"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>

			</subsection><subsection id="HD711A884BD6C453F900289183FA4A9BF"><enum>(c)</enum><header>Regulations</header><text>The
			 Secretary of Defense shall prescribe regulations relating to the activities of
			 the Department of Defense under section 2275 of title 10, United States Code,
			 as added by subsection (a).</text>
