to Fresh and Nutritious Food</header>
<section commented="no" id="H38AFC9BC8C0A4181BB3C3F1619659D81"><enum>101.</enum><header>Healthy corner
store initiative</header>
<subsection commented="no" id="H5083E17B2E44496F9EC99F82089F7510"><enum>(a)</enum><header>In
general</header><text>The Secretary of Agriculture shall carry out a program,
to be known as the Green and Healthy Corner Store Initiative, of awarding
grants to units of general local government, nonprofit organizations, and
tribal governments to assist qualified convenience stores to expand and sustain
their offering of fruits and vegetables.</text>
</subsection><subsection commented="no" id="H1244B060CD3F423AA14ACA64627B018B"><enum>(b)</enum><header>Priority</header><text>In
awarding grants under this section, the Secretary shall give priority to
applicants proposing to provide assistance to qualified convenience stores in
low-income communities.</text>
</subsection><subsection commented="no" id="HBA56ED3BCA9040828FEA83DE192CEF99"><enum>(c)</enum><header>Assistance</header><text>Assistance
provided to a qualified convenience store pursuant to this section may include
the following:</text>
<paragraph commented="no" id="H27A345FC8CF7478ABC34E742D3CD9321"><enum>(1)</enum><text>Seed money for the
purchase of fruits and vegetables and for equipment needed to sell fruits and
vegetables, such as but not limited to refrigerators.</text>
</paragraph><paragraph commented="no" id="H861E7A2FE10E4DD1B09B0D81472EDA4C"><enum>(2)</enum><text>Seed money for
converting to energy-saving equipment, such as but not limited to
energy-efficient lighting and refrigerators and a ductless HVAC system, to
minimize the additional energy costs associated with the refrigeration needed
to stock fruits and vegetables.</text>
</paragraph><paragraph commented="no" id="H8A138F83B0BD437E9D372D896FF07925"><enum>(3)</enum><text>Educational tools
and information on the importance of fresh fruits and vegetables.</text>
</paragraph><paragraph commented="no" id="HB9C26FFD0B2E46BB95E61394B2583B16"><enum>(4)</enum><text>Simple recipes to
assist customers in healthy food preparation.</text>
</paragraph></subsection><subsection commented="no" id="H3873B165840446A1B1AAD2431415103F"><enum>(d)</enum><header>Requirements for
convenience stores</header><text>As a condition on receipt of funds under this
section, a grantee shall agree to ensure that any qualified convenience store
receiving assistance through the grant will—</text>
<paragraph commented="no" id="H3DF8D0F1C1BC4B8A8D97B5D1B2C3872B"><enum>(1)</enum><text>maintain its
expanded offering of fruits and vegetables for a minimum time to be determined
by the Secretary;</text>
</paragraph><paragraph commented="no" id="H36056EFC4BD248A8AA7D9F22921B0201"><enum>(2)</enum><text>limit the number
of its advertisements for alcoholic beverages and cigarettes and offer at least
an equal amount of advertising for fruits and vegetables;</text>
</paragraph><paragraph commented="no" id="H9020D1D83C3B40C2B0CC04C0B7D33674"><enum>(3)</enum><text>place
advertisements for fruits and vegetables prominently in the front of the
store;</text>
</paragraph><paragraph commented="no" id="H995D4098BE2B4061A1D2607658F7E1FE"><enum>(4)</enum><text>advertise that the
store is participating in the Green and Healthy Corner Store Initiative;
and</text>
</paragraph><paragraph commented="no" id="H1FA1285B67BF48C0B559A6C29B121211"><enum>(5)</enum><text>work to partner
with rural and urban farmers markets to obtain fruits and vegetables for
sale.</text>
</paragraph></subsection><subsection commented="no" id="HF26285E2C90A4615B2FF985C0D8C0761"><enum>(e)</enum><header>Cooperation
among stores To decrease prices</header><text>The Secretary shall encourage
grant recipients under this section to encourage qualified convenience stores
receiving assistance through the grant to combine efforts with other
convenience stores when ordering fruits and vegetables from distributors in an
effort to decrease the price of such goods.</text>
</subsection><subsection commented="no" id="H860B3CFD2FF64827B6E8F3380250F59B"><enum>(f)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph commented="no" id="H730D977AB1504D1EA3F0B36CC7E1F211"><enum>(1)</enum><text>The term
<quote>Bureau-funded school</quote> has the meaning given to such term in
section 1141 of the Education Amendments of 1978 (25 U.S.C. 2021).</text>
</paragraph><paragraph commented="no" id="HC9A634598ACB451BA608A3722CB584A7"><enum>(2)</enum><text>The terms
<quote>elementary school</quote>, <quote>local educational agency</quote>, and
<quote>secondary school</quote> have the meanings given to such terms in
section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
7801).</text>
</paragraph><paragraph commented="no" id="HF7F2CD3094E74CDBA2F06E6139797826"><enum>(3)</enum><text>The term
<quote>low-income communities</quote> includes—</text>
<subparagraph commented="no" id="HD0E2C88EB8394038999CF7321B0266FD"><enum>(A)</enum><text>communities with a
high percentage of children eligible for free and reduced priced lunches under
the Richard B. Russell National School Lunch Act (42 U.S.C. 1751 et seq.);
and</text>
</subparagraph><subparagraph commented="no" id="H97446EFC4B90413995DFE02524AFA2AF"><enum>(B)</enum><text>any other
communities determined by the Secretary to be low-income for purposes of this
section.</text>
</subparagraph></paragraph><paragraph commented="no" id="HDCE2789B05EF47B59FCB9FB221877659"><enum>(4)</enum><text>The term
<quote>Secretary</quote> means the Secretary of Agriculture.</text>
</paragraph><paragraph commented="no" id="H49845E4BA2E446008E3B77A981B95C80"><enum>(5)</enum><text>The term
<quote>qualified convenience store</quote> means a convenience store located
within a quarter mile of an elementary school or a secondary school that is a
public school or a Bureau-funded school.</text>
</paragraph></subsection></section><section id="H11F39B40573545FCB9F1244C18F73645"><enum>102.</enum><header>Virtual
farmers’ markets</header>
<subsection id="H642B8184775E4E6EBBCEC2A3F712591F"><enum>(a)</enum><header>Establishment of
grant program</header><text>From the amounts appropriated to carry out this
section, the Secretary of Agriculture shall award grants, on a competitive
basis, to eligible entities to enable such entities to carry out a program that
provides access to farmers’ markets to communities that are food
deserts.</text>
</subsection><subsection id="HB25F48D459994F19A1E85440781B645B"><enum>(b)</enum><header>Use of
funds</header><text>An eligible entity receiving a grant under this section
shall use such funds for the following:</text>
<paragraph id="H3D796FEEC0C04931B52980B10512970F"><enum>(1)</enum><text>Purchasing virtual
farmers market software (including computer kiosks and swipe card stations), or
entering into a contract with an eligible organization to develop and maintain
the technology necessary, to carry out a virtual farmers market program to
enable individuals and organizations in communities that are food deserts to
order and purchase fruits and vegetables and other healthy food items using
such technology.</text>
</paragraph><paragraph id="H185175BDEF0346D0B66B6919066FD91E"><enum>(2)</enum><text>Training staff
to—</text>
<subparagraph id="HEF8D02B1FCC94F599273E87BF53970D8"><enum>(A)</enum><text>assist individuals
and organizations in communities that are food deserts to order and purchase
food products under the program described in paragraph (1); and</text>
</subparagraph><subparagraph id="H447D7521332949F9AEBB3277FEBB24E3"><enum>(B)</enum><text>purchase and order
food products under the program for the eligible entity.</text>
</subparagraph></paragraph><paragraph id="H85C68412A0DC463988F30F945C158CCA"><enum>(3)</enum><text>Packaging food
products purchased under the program in manner that makes transportation of the
products possible by foot.</text>
</paragraph><paragraph id="H3E31EA815C9A4DAC86BDAC57E2A68474"><enum>(4)</enum><text>Paying staff to
manage the program, and package and assist in the distribution and delivery of
food products purchased under the program.</text>
</paragraph><paragraph id="H63471EB6729F4CFDA843FA753BC08DF4"><enum>(5)</enum><text>Raising public
awareness about the program.</text>
</paragraph><paragraph id="HECF9E78C989F40588AAE3E1D924C41B4"><enum>(6)</enum><text>Developing simple
food preparation strategies and menus for customers of the program.</text>
</paragraph><paragraph id="H3DCC6EBEDCBC45ABAADB628D512000F7"><enum>(7)</enum><text>Coordinating with
the Secretary of Agriculture to develop mechanisms to enable reimbursement
under the supplemental nutrition assistance program established under the Food
and Nutrition Act of 2008 (7 U.S.C. 2011 et seq.) for purchases made under the
program.</text>
</paragraph><paragraph id="H8CD2B084A66D4A78A9E4A9DE3E7A6263"><enum>(8)</enum><text>Purchasing or
rehabilitating buses, including buses that were formerly used as school buses,
that may be used to transport to the eligible entity—</text>
<subparagraph id="HC75DDE89343D4780B03B783CE3E7AB1E"><enum>(A)</enum><text>the foods ordered
and purchased under the program using the technology described in paragraph
(1); or</text>
</subparagraph><subparagraph id="H6FAF35C294A84D19A8DA82C92B8E0546"><enum>(B)</enum><text>other fruits and
vegetables that meet the requirements of subsection (e) in order to provide
additional opportunities for individuals and organizations in communities that
are food deserts to purchase locally grown fruits and vegetables.</text>
</subparagraph></paragraph></subsection><subsection id="H84B6C9AAC86B4CFFA520B33A461C7A8C"><enum>(c)</enum><header>Application</header><text>In
order to receive a grant under this section, an eligible entity shall submit an
application to the Secretary at such time, in such manner, and containing such
information as the Secretary may require.</text>
</subsection><subsection id="HB685D92FCA2E4ABF9363D4E8AD19A9A2"><enum>(d)</enum><header>Grant
amount</header><text>A grant awarded under this section may not be greater than
$10,000.</text>
</subsection><subsection id="H97C149E532694B5C887E563E1EF0E64A"><enum>(e)</enum><header>Limitations on
food purchased</header><text>To the extent practicable, the majority of food
purchased under a virtual farmers market program carried out by an eligible
entity under this section shall be from farmers located within a 50 mile radius
of the site where the food is ordered and delivered under the program, except
in the case where the eligible entity demonstrates to the Secretary that no
such farmers exist or that the farmers are not able to provide a sufficient
variety or amount of food for the purposes of the program.</text>
</subsection><subsection id="H71C83D933FFD498BA11A20653381FFE2"><enum>(f)</enum><header>Report</header><text>Not
later than 1 year after the first fiscal year for which funds are appropriated
to carry out this section, the Secretary shall report to Congress on the
progress made in carrying out programs funded by grants under this section,
including—</text>
<paragraph id="H7827A8B4972C4DDBA359A051BFE94525"><enum>(1)</enum><text>the number of
individuals served by such programs and the barriers and opportunities for
additional such programs; and</text>
</paragraph><paragraph id="H80F15040062E440BB5B83FD241F0B5A3"><enum>(2)</enum><text>how such programs
have increased access or encouraged permanent farmers markets to be established
near communities that are food deserts.</text>
</paragraph></subsection><subsection id="H886969AE4D614E9C8757AE380FFBB15A"><enum>(g)</enum><header>Definitions</header><text>In
this section—</text>
<paragraph id="H1136014ABB294C4FB29898391304F18C"><enum>(1)</enum><header>Bureau-funded
school</header><text>The term <quote>bureau-funded school</quote> has the
meaning given such term in section 1146 of the Education Amendments of 1978 (25
U.S.C. 2026).</text>
</paragraph><paragraph id="HDB6F9268C5C84B33984972782BF17E2E"><enum>(2)</enum><header>Eligible
entity</header><text>The term <quote>eligible entity</quote> means an entity
that predominantly serves communities that are food deserts, including—</text>
<subparagraph id="H43E1CA54981C4E278E4BCBE26CE5C3CD"><enum>(A)</enum><text>a local
educational agency or bureau-funded school;</text>
</subparagraph><subparagraph id="H9B5840D89DAC41B880892188900ACB7C"><enum>(B)</enum><text>a nonprofit,
community-based organization or entity (including a park and recreation
department, recreation center, child care facility, or senior center);</text>
</subparagraph><subparagraph id="HC4B81AECD68B45BB87C318E1E0E230D2"><enum>(C)</enum><text>a convenience
store; or</text>
</subparagraph><subparagraph id="HDB3043B198AA47999379AE36821C3222"><enum>(D)</enum><text>other entity that
the Secretaries deem to be an eligible entity.</text>
</subparagraph></paragraph><paragraph id="H50A8B11F6DDB4234BE341D4F33A84AEB"><enum>(3)</enum><header>Eligible
organization</header><text>The term <quote>eligible organization</quote> means
an organization with expertise in developing and maintaining a virtual farmers
market.</text>
</paragraph><paragraph id="H9B94D385D23D4A1C88FBC97AC35BBDA4"><enum>(4)</enum><header>Local
educational agency</header><text>The term <quote>local educational
agency</quote> has the meaning given such term in section 9101 of the
Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).</text>
</paragraph><paragraph id="H48BBE09BA27F4037A16E07ECA8EED249"><enum>(5)</enum><header>Food
desert</header><text>The term <quote>food desert</quote> has the meaning given
such term in section 7527(a) of the Food, Conservation, and Energy Act of 2008
(Public Law 110–234).</text>
</paragraph><paragraph id="HFABF9ED94EBA4AF5BFDB8C252645C6AA"><enum>(6)</enum><header>Secretary</header><text>The
term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
</paragraph><paragraph id="H505C426B1C134A219AF62DD18A814EF3"><enum>(7)</enum><header>Swipe card
stations</header><text>The term <quote>swipe card stations</quote> shall
include support for the use of electronic benefit transfer cards.</text>
</paragraph><paragraph id="HE55F75A58B9143B4AA0C9D80BFB7EA8D"><enum>(8)</enum><header>Virtual farmers
market</header><text>The term <quote>virtual farmers market</quote> means an
online grocery store that enables individuals to purchase foods from local
farms and distributors.</text>
</paragraph></subsection></section><section display-inline="no-display-inline" id="H4F03E5156DD44F79BDD96D1ECD0B1DE4" section-type="subsequent-section"><enum>103.</enum><header>Local food
insecurity assessments: assessing the unique nutritional needs of local
communities</header>
<subsection id="H0F796982DBA94BEBB37D7A317AA02930"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary of
Health and Human Services shall establish a 3-year pilot program to award
grants to local and tribal governments, on a competitive basis, to allow such
local and tribal governments, in partnership with the local community
organizations under
<internal-xref idref="H96034B82F70B4BBA97CEF18022E74EE1" legis-path="__.(e)">subsection (e)</internal-xref>, to—</text>
<paragraph id="H86022B09C6CB4936B90159C2BE4A8274"><enum>(1)</enum><text>conduct a food
security assessment; and</text>
</paragraph><paragraph id="H2CA72FEECB8E4AF5899B3F256C010F11"><enum>(2)</enum><text>make an inventory
of the system in order to identify the strengths and gaps in such
system.</text>
</paragraph></subsection><subsection id="HB64EDCF6B477405EA188FAB2DC174540"><enum>(b)</enum><header>Data points for
Assessment</header><text>For purposes of conducting an Assessment and making an
inventory under a grant under
<internal-xref idref="H0F796982DBA94BEBB37D7A317AA02930" legis-path="__.(a)">subsection (a)</internal-xref>, with respect to the
community served by a local or tribal government, such government shall examine
the following food security and food system issues in the
community:<italic></italic></text>
<paragraph id="HA511F3D6D1774780B841A990EAF7219A"><enum>(1)</enum><text>The prevalence of
childhood obesity.</text>
</paragraph><paragraph id="HB11744204785448D8EE817A56026FBA2"><enum>(2)</enum><text>The availability
of safe routes to school for children.</text>
</paragraph><paragraph id="H7A629B2BCA3846ACB48605D6E2AA50F4"><enum>(3)</enum><text>The quality of
food served in school and child care settings.</text>
</paragraph><paragraph id="HEDFFA35BCEA044A29B93729D20FAC9A0"><enum>(4)</enum><text>The availability
of supermarkets.</text>
</paragraph><paragraph id="H793503475D074634A8123827F5FCC19A"><enum>(5)</enum><text>The cost and
availability of fresh fruits and vegetables.</text>
</paragraph><paragraph id="H65F0A0B438054C72BBAAC7F93CA25883"><enum>(6)</enum><text display-inline="yes-display-inline">The concentration of convenience stores,
and other food vendors that sell a disproportionate amount of foods that are
not fresh fruits and vegetables.</text>
</paragraph><paragraph id="H3CFED647ADD2415B964E053C6BC8BEFC"><enum>(7)</enum><text>The availability
of products.</text>
</paragraph><paragraph id="H3A70A8E4C3A542C1A0D753DCC0FA8DB5"><enum>(8)</enum><text>The concentration
of fast food restaurants.</text>
</paragraph><paragraph id="HE65AC790321A4C8AB800AC70E941DAF0"><enum>(9)</enum><text>The availability
of green space or recreation areas, and the extent to which such space or areas
encourage physical activity by adults and children.</text>
</paragraph><paragraph id="HD62D8955457E4E739B9BC4B564D2D9F5"><enum>(10)</enum><text>Any other issues
determined to be relevant by the local or tribal government.</text>
</paragraph><paragraph id="H5C7306EA7EAD4AC18FC8E45CC6CD078F"><enum>(11)</enum><text>Any other issues
determined to be relevant by the Secretary of Health and Human Services.</text>
</paragraph></subsection><subsection id="HAB5E3040815C4E6D8A93C9BEE016769A"><enum>(c)</enum><header>Number of
sites</header><text display-inline="yes-display-inline">The Secretary of Health
and Human Services, in awarding grants under
<internal-xref idref="H0F796982DBA94BEBB37D7A317AA02930" legis-path="__.(a)">subsection (a)</internal-xref>, shall award grants to no
more than—</text>
<paragraph id="H6153C127E88E46F7A24C46B1D4D47EFE"><enum>(1)</enum><text>20 local
governments; and</text>
</paragraph><paragraph id="HC59AB57E028C4176893BC8E1D231B96D"><enum>(2)</enum><text>5
tribal governments.</text>
</paragraph></subsection><subsection id="HD17CBCDECA9E478E9907653DA219E909"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under
<internal-xref idref="H0F796982DBA94BEBB37D7A317AA02930" legis-path="__.(a)">subsection (a)</internal-xref>, the Secretary of Health and
Human Services shall give priority to those local and tribal governments that
serve communities with the highest concentrations of poverty.</text>
</subsection><subsection id="H96034B82F70B4BBA97CEF18022E74EE1"><enum>(e)</enum><header>Requirement of
partnerships</header><text display-inline="yes-display-inline">In order to
qualify for a grant under
<internal-xref idref="H0F796982DBA94BEBB37D7A317AA02930" legis-path="__.(a)">subsection (a)</internal-xref>, a local or tribal
government shall demonstrate, to the satisfaction of the Secretary of Health
and Human Services, that the local or tribal government has entered into a
partnership (for the purpose of conducting an assessment and making an
inventory under
<internal-xref idref="H0F796982DBA94BEBB37D7A317AA02930" legis-path="__.(a)">subsection (a)</internal-xref>) with at least one of the
following local community organizations:</text>
<paragraph id="H485A318E01944F8B9FB38964CC258E71"><enum>(1)</enum><text>A
nonprofit community-based organization or entity.</text>
</paragraph><paragraph id="H6D662CEA78F748CA97D2A03F7956385D"><enum>(2)</enum><text>A
developer or urban planning institution.</text>
</paragraph><paragraph id="H4AB6CB66DE6241FCA14ACBBCED243C68"><enum>(3)</enum><text display-inline="yes-display-inline">An accredited college or university.</text>
</paragraph></subsection></section><section display-inline="no-display-inline" id="HB98A13F0B5094030A7740B5F6C2AEB24" section-type="subsequent-section"><enum>104.</enum><header>Extension of pilot
projects to evaluate health and nutrition promotion in the supplemental
nutrition assistance program</header><text display-inline="no-display-inline">Section 17(k)(5)(A) of the Food and
Nutrition Act of 2008 (7 U.S.C. 2036(k)(5)(A)) is amended by striking
<quote>2012</quote> and inserting <quote>2017</quote>.</text>
</section><section id="H4A9B313D51D84AF487A42086329F69B6"><enum>105.</enum><header>Fresh incentive
program</header>
<subsection id="H0A66F9988D5F44EB9DB90F0C9E1357DB"><enum>(a)</enum><header>Establishment of
program</header><text display-inline="yes-display-inline">The Secretary of
Agriculture shall provide assistance, through competitive matching grants and
technical assistance, to eligible entities for a Fresh Incentive Program
that—</text>
<paragraph id="H4DBD8846549143EDAB13E60080DE0282"><enum>(1)</enum><text>improves access to
local and regional nutritious, affordable fruits and vegetables to low-income
consumers participating in the supplemental nutrition assistance program by
providing a monetary incentive for the purchase of eligible foods through
programs that link consumers with American farmers through farmers markets,
grocery stores, corner stores, mobile markets, Community Supported Agriculture
(CSAs) and other food retailers,</text>
</paragraph><paragraph id="HA7E81B67E16F465BBC07511EAA2FAF16"><enum>(2)</enum><text>is designed
to—</text>
<subparagraph id="H01CAAE782A34487B9EF014B395503506"><enum>(A)</enum><text>improve the
nutritional health of low-income participants in USDA nutrition assistance
programs by encouraging the consumption of domestic fruits and
vegetables,</text>
</subparagraph><subparagraph id="H5D05423C8E7E45BE849C079DA979E340"><enum>(B)</enum><text>improve the food
environments in food deserts by stimulating demand for domestic fruits and
vegetables,</text>
</subparagraph><subparagraph id="H70B9EB2614674D16B6BCCB50AB6158FF"><enum>(C)</enum><text>increase market
opportunities for American specialty crop farmers,</text>
</subparagraph><subparagraph id="H232C5A9A2E614CD38BEAE4860B8822EC"><enum>(D)</enum><text>develop a
sustained connection between USDA nutrition assistance programs and USDA
agriculture marketing and development programs,</text>
</subparagraph><subparagraph id="H67A1865E95A74908BE9B827EFD13ED11"><enum>(E)</enum><text>increase local
farm income,</text>
</subparagraph><subparagraph id="HC079252409BE4D25A560C578170F831D"><enum>(F)</enum><text>reduce reliance on
imported fresh fruits and vegetables, and</text>
</subparagraph><subparagraph id="H1256866EB6C44B6787F360BBDF7EEA51"><enum>(G)</enum><text>decrease
healthcare costs resulting from diet-related health conditions including
diabetes and obesity.</text>
</subparagraph></paragraph><paragraph id="H6725934883F64C09B657A232B69C4DFA"><enum>(3)</enum><text>makes grants to
eligible entities that include—</text>
<subparagraph id="H4B330D6547B64C04893105D028913598"><enum>(A)</enum><text>nonprofit
organizations that have a demonstrated track record designing and implementing
successful nutrition incentive programs connecting low-income consumers and
family farmers,</text>
</subparagraph><subparagraph id="HAE0EF2197E0C43A3B240393BDF49A6A1"><enum>(B)</enum><text>State and local
agencies including Indian Tribal Organizations, agricultural producer groups,
and community health organizations, and</text>
</subparagraph><subparagraph id="HFE801A2A48574DDA8DFD0F8E3433D47F"><enum>(C)</enum><text>other entities
that the Secretary determines offer a unique ability to provide services for
the Fresh Incentive Program,</text>
</subparagraph></paragraph><paragraph id="HEC7A18595C8C416D841C7BFB296346DD"><enum>(4)</enum><text>provides to
eligible foods including—</text>
<subparagraph id="H3DE7B20CDF8C4C9590172472B19D99A8"><enum>(A)</enum><text>fresh, locally or
regionally produced fruit and vegetables that are fresh produce raised,
produced, and distributed in—</text>
<clause id="H9E48541FB5FB4202A789C12F059D88A4"><enum>(i)</enum><text>the
locality or region in which the final product is marketed, so that the total
distance that the product is transported is less than 400 miles from the origin
of the product, or</text>
</clause><clause id="H6C2240C5173C428F89DA73541D802B6D"><enum>(ii)</enum><text>the
State in which the product is produced,</text>
</clause></subparagraph></paragraph><paragraph id="H4F81BE728F814A2C9CD8D456FD97B3BE"><enum>(5)</enum><text>provides that the
Federal share of costs for a project funded through a grant awarded under this
subsection shall not exceed 50 percent of the total cost of the project, except
that—</text>
<subparagraph id="H363A021AB2214CE8B61C7477D37092D5"><enum>(A)</enum><text display-inline="yes-display-inline">as a condition of receiving a grant under
this subsection, a grant recipient shall provide matching support in the form
of cash or in-kind contributions, including facilities, equipment, or services
provided by State and local governments, nonprofit organizations, community
development organizations, and private sources; and</text>
</subparagraph><subparagraph id="H47985A783A6440628EB34E823FE67877"><enum>(B)</enum><text>grantees may use
Federal nutrition education and outreach funds as a match for a grant under
this subsection in order to maximize the effectiveness of the programs,</text>
</subparagraph></paragraph><paragraph id="H9B4B47DF36FC4A11A57C5579BFCE5C34"><enum>(6)</enum><text>provides that the
maximum extent practicable, in providing assistance under this subsection, the
Secretary shall give the highest priority to funding projects that, as
determined by the Secretary—</text>
<subparagraph id="H2229FBD7138A4BC79E7F198C0F75FFB1"><enum>(A)</enum><text>will make locally
and regionally produced fresh fruits and vegetables available in underserved,
low-income communities,</text>
</subparagraph><subparagraph id="H1C0A588583664184A47682A0B8570417"><enum>(B)</enum><text>have a the
likelihood of increasing nutrition program recipient purchases and consumption
of fresh, nutritious food,</text>
</subparagraph><subparagraph id="H0AC0C487D5684D34A8B763E0B8B39B91"><enum>(C)</enum><text>demonstrate
collaboration between farmers and agricultural producer groups, local
nongovernmental and community-based organizations, local and State government
agencies, and food retailers,</text>
</subparagraph><subparagraph id="HD31CCAC342F54FB9A98C63F35578DABB"><enum>(D)</enum><text>include effective
and efficient technologies for benefit redemption systems that can—</text>
<clause id="HAEE1BDE14464464BA2F01A64D1172787"><enum>(i)</enum><text>accommodate
multiple nutrition benefit instruments, and</text>
</clause><clause id="H6B0EC9BF0C344EE18D984B1E2A6E42CD"><enum>(ii)</enum><text>provide a model
for state and local entities to replicate, and</text>
</clause></subparagraph><subparagraph id="HDD1705B48F4E4E4BB0D1D354CC7C0B68"><enum>(E)</enum><text>include a thorough
program evaluation component that measures—</text>
<clause id="H3E276EB853F64595873C262534E9B3F2"><enum>(i)</enum><text>impacts on
nutrition program participants’ food purchasing and consumption
behavior,</text>
</clause><clause id="HA61C216FB2C547739A304247140236FF"><enum>(ii)</enum><text>the
effectiveness of and participation in nutrition education and outreach
programs,</text>
</clause><clause id="H3106951D21BE40CD8A10A2D37D84D0FE"><enum>(iii)</enum><text>the effect on
farmer income,</text>
</clause><clause id="H84B754E49F2D4DD1A055501FDF08C390"><enum>(iv)</enum><text>the
economic effects on participating food retailers,</text>
</clause><clause id="H40F921EDADC648E8B09B71ACA57F916D"><enum>(v)</enum><text>the
overall change in food environment of participating communities, and</text>
</clause><clause id="HEC468A1A2B29490EBCD605128D8DC146"><enum>(vi)</enum><text display-inline="yes-display-inline">such other outcomes that the Secretary
deems useful.</text>
</clause></subparagraph></paragraph></subsection><subsection id="H5BF0D7EA084E4869B7A8FDF475937B99"><enum>(b)</enum><header>Funding</header><text>Beginning
one year after enactment of this bill, the Secretary of the Treasury shall
transfer to the Secretary of Agriculture to carry out this subsection
$70,000,000 each fiscal year, to remain available until expended.</text>
</subsection><subsection id="H73BE9881619B433082E66C0E7DDEE846"><enum>(c)</enum><header>Other
considerations</header><text>The Secretary shall determine the maximum number
of grants, the maximum and minimum amounts of grants made, and the duration of
grants.</text>
</subsection></section><section id="HF4D9BC2FC5314C35A8ABC4EC9175F1CD"><enum>106.</enum><header>EBT farmers
market accessability program</header>
<subsection id="H81796D2E77E447CDA6135E1577B3A16E"><enum>(a)</enum><header>Authority for
program</header><text display-inline="yes-display-inline">The Secretary of
Agriculture shall develop and carry out a program to make grants to entities
that operate farmers markets in urban areas for the purchase of equipment and
to finance the installation of equipment necessary to operate EBT systems at
farmers markets.</text>
</subsection><subsection id="HA6527762B15348B7BB22A175FE5F5E5F"><enum>(b)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There is
authorized to be appropriated to carry out this section $10,000,000 for each of
the fiscal years in the 8-year period beginning on the October 1 of the first
fiscal year that begins after the date of the enactment of this Act.</text>
</subsection></section><section id="HD83FCC1E43384A4BA708A54AFB8DC64E"><enum>107.</enum><header>Farm-to-preschool
program</header>
<subsection id="H4A0059B64A544452AB5D0E58F285B8F4"><enum>(a)</enum><header>Authority for
program</header><text display-inline="yes-display-inline">The Secretary of
Agriculture shall develop and carry out a grant program to make grants to
community-based and nonprofit organizations to develop a Farm-to-Preschool
program that fosters the connection between preschools, Head Start programs,
childcare or daycare centers, kindergarten readiness programs in K–12 school
districts, and in-home care facilities, with small- or medium-sized
agricultural producers, for the purposes of—</text>
<paragraph id="HDD1E40BFD21B49A6894A41A371C55ADE"><enum>(1)</enum><text>developing an
industry-leading preschool nutrition education and meal program designed to
help prevent the onset of childhood obesity and develop foundational healthy
eating and lifestyle habits,</text>
</paragraph><paragraph id="HF98AACA0FC0D49519D4B3FE44BECC64A"><enum>(2)</enum><text>creating
nutritious and healthy made-from-scratch meals and menus using recipes that
include mostly locally grown and produced organic foods,</text>
</paragraph><paragraph id="H37CC5B85DD2348BE8F44A1E0EA3720B2"><enum>(3)</enum><text>developing recipes
and menus that will serve as a tool for parent awareness, access to healthy
food, food preparation, and eating, and engagement in nutrition
education,</text>
</paragraph><paragraph id="HFD384A753CED40BCB78D71063A6D09C0"><enum>(4)</enum><text>developing
experiential educational curricula centered around farms, farmers’ markets, and
school gardens for parents and children,</text>
</paragraph><paragraph id="H8AB3CA14A8A441FC8AA22C90315A2628"><enum>(5)</enum><text>replicating
<quote>Farm-to-Preschool</quote> parent awareness and engagement in nutrition
education, healthy eating and food preparation nationally,</text>
</paragraph><paragraph id="H51D48FEAF32B4E229E7755B48ED4DE72"><enum>(6)</enum><text>supporting local
and regional agriculture communities, and</text>
</paragraph><paragraph id="H0F2D21C8988645BE9EECD7F186E595E3"><enum>(7)</enum><text>promoting the
institutionalization of preschool wellness policies.</text>
</paragraph></subsection><subsection id="HFDC83D9DFD844906A9ED491BD10CAFBF"><enum>(b)</enum><header>Availability and
use of grants</header><text>The Secretary shall make grants under subsection
(a)—</text>
<paragraph id="H6CD95449BC9E42DB8A4C9C409DF70843"><enum>(1)</enum><text>to be used—</text>
<subparagraph id="H2B7FEB05B25C45EFB9D1F30A7924E49F"><enum>(A)</enum><text>to support the
initial costs of implementing a new, or expanding an existing,
Farm-to-Preschool program,</text>
</subparagraph><subparagraph id="HF9EDF44B96644295B607CD7C874DC947"><enum>(B)</enum><text>in an amount not
to exceed $500,000 to support the training and access to resources and
information necessary to conduct a successful Farm-to-Preschool program,
or</text>
</subparagraph><subparagraph id="HE44102E4D9B54189966FFF9ECFBCFD0C"><enum>(C)</enum><text>in an amount not
to exceed $100,000 to support the cost of conducting research, identifying
resources, and developing partnerships to design a successful and sustainable
Farm-to-Preschool program,</text>
</subparagraph></paragraph><paragraph id="H5DB7CB98528D4501AC2CAA97A2FAFE37"><enum>(2)</enum><text>to eligible
entities that agree to provide, in cash or in kind, not less that 20 percent of
the cost of the use for which the respective grants are made, and</text>
</paragraph><paragraph id="H55F4F2B5E43948D7A5E63E39C69EA979"><enum>(3)</enum><text display-inline="yes-display-inline">to achieve to the maximum extent
practicable geographical diversity and grantee participation in urban, rural
and tribal communities.</text>
</paragraph></subsection><subsection id="H6E980473FA6E4A2292DFD50FA74B596C"><enum>(c)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated for fiscal
years 2013, 2014, and 2015 in the aggregate $10,000,000.</text>
</subsection></section><section display-inline="no-display-inline" id="HC764B7EAD12140BF9686EDAF8378F8FA" section-type="subsequent-section"><enum>108.</enum><header>Expanding and
Improving the Affordability and Nutritional Integrity of the USDA Fresh Fruit
and Vegetable Program</header><text display-inline="no-display-inline">Subsection (b) of section 19 of the Richard
B. Russell National School Lunch Act (42 U.S.C. 1769a(b)) is amended to read as
follows:</text>

<subsection id="HA6B51BADD17148D78810F92145B160E5"><enum>(b)</enum><header>Program</header><text display-inline="yes-display-inline">A school participating in the

<paragraph id="HC1E39049A58F4BE3ADE75383B08BE298"><enum>(1)</enum><text>shall make free
fruits and vegetables available to students throughout the school day (or at
such other times as are considered appropriate by the Secretary) in 1 or more
areas designated by the school; and</text>
</paragraph><paragraph id="H3427202247A64E10A0CC62073DE81C89"><enum>(2)</enum><text>may make free
fruits and vegetables in any other form (such as fresh, frozen, dried, pureed,
or canned) available to students throughout the school day (or at such other
times as are considered appropriate by the Secretary) in 1 or more areas
designated by the school only if such fruits and vegetables meet any additional
nutrition specifications, as established by the
Secretary.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><enum>II</enum><header>Creation of the
Healthy Food Financing Initiative </header>
<section id="HC1AA28D1014D4043AD82259AC384CC9E"><enum>201.</enum><header>Purpose and
definitions</header>
<subsection id="HE4BD9558C958431FBEBC15100387225D"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the Healthy Food Financing
Initiative is to improve access to healthy foods in underserved areas, to
create and preserve quality jobs, and to revitalize low-income communities by
providing loans and grants to retailers of fresh and healthy food to overcome
the higher costs and initial barriers to entry in underserved urban, suburban,
and rural areas.</text>
</subsection><subsection id="H1D0FCCB5AAD74553B78C643CC48DD5D3"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this title:</text>
<paragraph id="HE13F7C14DD364587B3F2D1BFF90E466F"><enum>(1)</enum><header>Community
development financial institution</header><text>The term <term>community
development financial institution</term> has the meaning given the term in
section 103 of the Community Development Banking and Financial Institutions Act
of 1994 (12 U.S.C. 4702).</text>
</paragraph><paragraph id="H74531340D7AB461491A0546D332A7AB7"><enum>(2)</enum><header>Food access
organization</header><text>The term <term>food access organization</term> means
a nonprofit organization with expertise in improving access to healthy food in
underserved communities.</text>
</paragraph><paragraph id="HF187706F68E24904BBA56227C39EFDCC"><enum>(3)</enum><header>Initiative</header><text>The
term <term>Initiative</term> means the Healthy Food Financing
Initiative.</text>
</paragraph><paragraph id="HB5B4B9CD6DE84E3D9EF337F941245F52"><enum>(4)</enum><header>Local
funds</header><text>The term <term>local funds</term> means the allocation of
national funds and any other forms of financial assistance (including grants,
loans, and equity investments) that are raised by partnerships to carry out the
purposes of the Initiative.</text>
</paragraph><paragraph id="HA7998E62042F413283514DE736B18337"><enum>(5)</enum><header>National
funds</header><text>The term <term>national funds</term> means amounts
appropriated to carry out the Initiative and any other forms of financial
assistance (including grants, loans, and equity investments) that are raised by
the national fund manager to carry out the Initiative.</text>
</paragraph><paragraph id="HC85856119F18430AB0FD98223A2EF64C"><enum>(6)</enum><header>National fund
manager</header><text>The term <term>national fund manager</term> means a
community development financial institution in existence as of the date of
enactment of this Act and certified by the Community Development Financial
Institutions Fund of the Department of the Treasury that is designated by the
Secretary to manage the Initiative for purposes of—</text>
<subparagraph id="HFE6997909C6A441E9E08B9ACCF042F70"><enum>(A)</enum><text>raising private
capital;</text>
</subparagraph><subparagraph id="H0C9AED9E89864822ADBE5F304AE45F4E"><enum>(B)</enum><text>providing
financial and technical assistance to partnerships; and</text>
</subparagraph><subparagraph id="HE6ECA02C7FC045E384F9E46E5054BC25"><enum>(C)</enum><text display-inline="yes-display-inline">funding eligible projects directly at the
request of partnerships to attract retailers of fresh and healthy food to
underserved urban, suburban, and rural areas in accordance with this
title.</text>
</subparagraph></paragraph><paragraph id="HBD3F26E7F0574C44AB3F54B1EE2FC14D"><enum>(7)</enum><header>Partnership</header>
<subparagraph id="H582A7349836C451BB47F87F6900DB85A"><enum>(A)</enum><header>In
general</header><text>The term <term>partnership</term> means a regional,
State, or local public and private partnership that is organized to improve
access to fresh and healthy foods by providing financial and technical
assistance to eligible projects.</text>
</subparagraph><subparagraph id="H36C18C227DFD4C36A7D7CD29274E530E"><enum>(B)</enum><header>Inclusions</header><text>The
term includes—</text>
<clause id="H49888750999A4025A5C9D220F62C8173"><enum>(i)</enum><text>an
unit of State, local, or tribal government or a quasi-public State or local
government agency;</text>
</clause><clause id="HC388407AD0AB4816A3F2FBDE2C120ABA"><enum>(ii)</enum><text>a
food access or community health organization committed to improving access to
healthy foods;</text>
</clause><clause id="H97944FDE51424E5A943FAD02E7F1088A"><enum>(iii)</enum><text>a
community development financial institution or other organization that is
capable of administering a loan and grant program in accordance with this
title; and</text>
</clause><clause id="H997777DA93DB463482F7C7FA33E859CB"><enum>(iv)</enum><text>other
organizations interested in improving access to healthy foods in underserved
areas.</text>
</clause></subparagraph></paragraph><paragraph id="H202BE736D50647C68B1D27F4B3058D9A"><enum>(8)</enum><header>Secretary</header><text>The
term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
</paragraph></subsection></section><section id="H57CAC75F31A846309F36851D18880E3E"><enum>202.</enum><header>Establishment
of Healthy Food Financing Initiative and eligible projects</header>
<subsection id="H73C0FDE2416846F1AFCF21697BFA358F"><enum>(a)</enum><header>Establishment</header><text>There
is established in the Department of Agriculture a Healthy Food Financing
Initiative.</text>
</subsection><subsection id="H746972DD9D1F4CF482E7D4EEA74C120F"><enum>(b)</enum><header>Management</header><text>Not
later than 1 year after the date of enactment of this Act, the Secretary shall
select and enter into a grant agreement with a national fund manager that will
be responsible for the management of the Initiative.</text>
</subsection><subsection id="H9CFC95F9DB234C9DAE917D2B5A9D4D0F"><enum>(c)</enum><header>Eligible
projects</header>
<paragraph id="H6EDCF34F0D6945A7975E5AEBBE203BFA"><enum>(1)</enum><header>Eligibility
criteria</header><text>Subject to the requirements of this section, the
national fund manager shall establish the eligibility criteria for projects to
be assisted by the Initiative.</text>
</paragraph><paragraph id="HB2B099FFAB184D228D394B2A69B7AD1B"><enum>(2)</enum><header>Required project
elements</header><text>To be eligible to receive assistance through the
Initiative, a project shall—</text>
<subparagraph id="H3A42F0188DBB4F5EA85176068F2A01F1"><enum>(A)</enum><text>include a
supermarket, grocery store, farmers’ market, or other retailer of fresh and
healthy food;</text>
</subparagraph><subparagraph id="H011E775DADF8424D80D4657C8B9CEEE9"><enum>(B)</enum><text>consist of a
for-profit business enterprise, a member- or worker-owned cooperative, or a
nonprofit organization;</text>
</subparagraph><subparagraph id="H18354C12C27A41F2934B907B21273D7D"><enum>(C)</enum><text>meet the
eligibility criteria established under this section;</text>
</subparagraph><subparagraph id="H33C94C41031C47B8B6AC452E25B04CFA"><enum>(D)</enum><text>continue to be a
viable business enterprise with a financial viability plan;</text>
</subparagraph><subparagraph id="H31874FC6A9BA42D8A85A9E902E1AC2E7"><enum>(E)</enum><text>require an
investment of public funding to move forward and be competitive;</text>
</subparagraph><subparagraph id="HD3B3C709A0734820B3692535496AD432"><enum>(F)</enum><text>operate on a
self-service basis;</text>
</subparagraph><subparagraph id="HFCB873E3C4CD428FA5F92319EDCC77FF"><enum>(G)</enum><text>expand or preserve
the availability of healthy, fresh, high quality unprepared and unprocessed
foods, particularly fresh fruits and vegetables, in underserved areas;
and</text>
</subparagraph><subparagraph id="H5F277147EBF6427E95961F3723887CF5"><enum>(H)</enum><text>agree to accept
benefits under the supplemental nutrition assistance program established under
the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name>
(7 U.S.C. 2011 et seq.).</text>
</subparagraph></paragraph></subsection><subsection id="H429CD643A3BC4BAB8D21844E54FDBF7E"><enum>(d)</enum><header>Types of food
and variety criteria</header>
<paragraph id="H64A4BACE56AB47D69C9B0E7806EFA73D"><enum>(1)</enum><header>Definitions</header><text>In
this subsection:</text>
<subparagraph id="HB5C4538F4B834410BDD82C99046B701E"><enum>(A)</enum><header>Perishable
food</header>
<clause id="H72E67CD0DD79486796F9C2D77B948839"><enum>(i)</enum><header>In
general</header><text>The term <term>perishable food</term> means food that is
fresh, refrigerated, or frozen.</text>
</clause><clause id="H7BF7A0D9474B487598A8E59A9EA98211"><enum>(ii)</enum><header>Exclusion</header><text>The
term <term>perishable food</term> does not include packaged or canned
goods.</text>
</clause></subparagraph><subparagraph id="HC52DA2AFA3C140DCBA53BC242E57C7F9"><enum>(B)</enum><header>Staple
food</header>
<clause id="HD99B192243A04E42A28A175E881CD64D"><enum>(i)</enum><header>In
general</header><text>The term <term>staple food</term> means food that is a
basic dietary item, including bread, flour, fruits, vegetables, and
meat.</text>
</clause><clause id="H15759D03A7694AD2AC5F5ED8FBB462A5"><enum>(ii)</enum><header>Exclusions</header><text>The
term <term>staple food</term> does not include snack or accessory food (such as
chips, soda, coffee, condiments, and spices) or ready-to-eat, prepared
food.</text>
</clause></subparagraph><subparagraph id="H6FBCB2072EA04DE2B3C1D70049AB14E4"><enum>(C)</enum><header>Variety</header><text>The
term <term>variety</term> means an assortment of different types of food
items.</text>
</subparagraph></paragraph><paragraph id="H9DC2DB79A7E0484E9E55340144B56F1E"><enum>(2)</enum><header>In
general</header><text>For purposes of complying with the project element
specified in subsection (b)(2)(G) to expand or preserve the availability of
fresh fruits and vegetables in underserved areas, a project shall maintain a
store that—</text>
<subparagraph id="H4F26F86DCA824014B346A455A6210516"><enum>(A)</enum><text>carries a full
line of fresh produce, as defined by the national fund manager to reflect
differences in project size and overall store size;</text>
</subparagraph><subparagraph id="H3E09BB7DA2514B208DBFA02505861C93"><enum>(B)</enum><text>sells food for
home preparation and consumption; and</text>
</subparagraph><subparagraph id="H19CC4286392D43959CF2E2D87185718C"><enum>(C)</enum><text>at a
minimum—</text>
<clause id="H819D04705BF74BAC8F1B317A9256136D"><enum>(i)</enum><text>offers for sale at
least 3 different varieties of food in each of the 4 staple food groups (bread
and grains, dairy, fruits and vegetables, and meat, poultry, and fish), with
perishable food in at least 2 categories, on a daily basis; or</text>
</clause><clause id="H148A8BFE7A8A41CFB44EFA9C47B91CB7"><enum>(ii)</enum><text>has
a store at which at least 50 percent of the total sales of the store (including
food and nonfood items or services) are from the sale of eligible staple
food.</text>
</clause></subparagraph></paragraph></subsection><subsection id="HFFA7C62D40054CC28E5E1E84273249F8"><enum>(e)</enum><header>Income
criteria</header><text>Each eligible project shall be located in—</text>
<paragraph id="HCB375692D5194393A25BFC78BAB438F8"><enum>(1)</enum><text>a
low- or moderate-income census tract, as determined by the Bureau of the Census
of the Department of Commerce;</text>
</paragraph><paragraph id="H0996EFAD231B4D4380601ECB48688EF9"><enum>(2)</enum><text>a
population census tract that is treated as a low-income community under section
45D(e) of the Internal Revenue Code of 1986; or</text>
</paragraph><paragraph id="HA672EF3A7BBC40C381DC36FAF58195EC"><enum>(3)</enum><text>an area that
significantly serves an adjacent area that meets the criteria described in
paragraph (1) or (2), as approved by the national fund manager.</text>
</paragraph></subsection><subsection id="H9ACFCC0FE064468A8E15FEEB5C0FB517"><enum>(f)</enum><header>Underserved
criteria</header>
<paragraph id="HB9ED9DEB89444E2FB1C3B09FDBA3152B"><enum>(1)</enum><header>In
general</header><text>Each eligible project shall be located in an underserved
area, as determined by the partnerships according to criteria established by
the national fund manager.</text>
</paragraph><paragraph id="HA59682F9A1D941E394B8E59373CA1900"><enum>(2)</enum><header>Factors</header><text>In
determining whether an area is an underserved area, the following factors shall
be taken into consideration:</text>
<subparagraph id="HBDC122C9FBFA4D41975F7A6EB6E12E02"><enum>(A)</enum><text>Population
density.</text>
</subparagraph><subparagraph id="H1A3DAD714C3F45B689FA9023E4FC3186"><enum>(B)</enum><text>Below average
supermarket density or sales.</text>
</subparagraph><subparagraph id="HD2CAEF9453CA455CB2FBB6F7FE5122F5"><enum>(C)</enum><text>Car
ownership.</text>
</subparagraph><subparagraph id="H9E6BC91F512240CBA05A7C079464705E"><enum>(D)</enum><text display-inline="yes-display-inline">Geographical or physical barriers, such as
highways, mountains, major parks, bodies of water, or areas with large amounts
of vacant lots or foreclosed properties.</text>
</subparagraph></paragraph><paragraph id="H24840CFD31084E87AA6209859FF065D1"><enum>(3)</enum><header>Locations</header><text>On
an annual basis, the national fund manager shall collect data and publish maps
that show the location of underserved areas.</text>
</paragraph></subsection><subsection id="H54214A7D6E8C4E12948D5695110A497B"><enum>(g)</enum><header>Priority
projects</header>
<paragraph id="H9F3D9C5CF88745A087C54DB07EF63C7E"><enum>(1)</enum><header>In
general</header><text>Priority shall be given to projects that—</text>
<subparagraph id="H3A445AEF91B3456A9E4DF88AFFC628C2"><enum>(A)</enum><text>are located in
severely distressed low-income communities, as defined by the Community
Development Financial Institutions Fund of the Department of the Treasury;
and</text>
</subparagraph><subparagraph id="HB7DC3D0AAC68443DB75589DB51CCB9C7"><enum>(B)</enum><text>include 1 or more
of the following characteristics:</text>
<clause id="HAB28A970C23F492995EED557FE028937"><enum>(i)</enum><text>The
project will create or retain quality jobs in the community, as determined in
accordance with paragraph (2).</text>
</clause><clause id="H85F06FFFE3154233B481028726A2BFDD"><enum>(ii)</enum><text>The
project has community support in terms of store quality, affordability, site
location, and coordination with local community plans or other programs
promoting community and economic development.</text>
</clause><clause id="H10BA3231F1F046C9B5D0C8AFA2A79E15"><enum>(iii)</enum><text>The project
supports regional food systems and locally grown foods, to the extent
available.</text>
</clause><clause id="HF1AB27C2D593423889856FE8B13A8392"><enum>(iv)</enum><text>In
major metropolitan areas, the project is associated with a transit-oriented
development project.</text>
</clause><clause id="HF008717EA4C0492EA4342E590C32BC17"><enum>(v)</enum><text>In
areas with public transit, the project is accessible by public transit.</text>
</clause><clause id="H645D3A381BE24291BF1F2A0A5467E7D2"><enum>(vi)</enum><text>The
project involves the reuse of a building that is listed in or eligible for the
National Register of Historic Places.</text>
</clause><clause id="HC98BF74E56D345A293F487ACB61F66FC"><enum>(vii)</enum><text>The project
involves a brownfield or grayfield (as those terms are used in the
<act-name parsable-cite="CERCL">Comprehensive Environmental Response,
Compensation, and Liability Act of 1980</act-name> (42 U.S.C. 9601 et
seq.)).</text>
</clause><clause id="H5E821D2FF6754CEA902F6440B531D2A1"><enum>(viii)</enum><text>The estimated
energy consumption of the project, calculated using building energy software
approved by the Department of Energy, will qualify the project for designation
under the Energy Star program established by section 324A of the Energy Policy
and Conservation Act (42 U.S.C. 6294a).</text>
</clause><clause id="HC248DAB4B85E401582E5794651C174F5"><enum>(ix)</enum><text>The
project involves women- and minority-owned businesses.</text>
</clause></subparagraph></paragraph><paragraph id="HBABC2800A22D4D8F95B8CEB02453B8BA"><enum>(2)</enum><header>Quality
jobs</header><text>For purposes of paragraph (1)(B)(i), a quality job is a job
that—</text>
<subparagraph id="H8641560CC53B491388F787C1E7A53BE1"><enum>(A)</enum><text>provides wages
that are comparable to or better than similar positions in existing businesses
of similar size in similar local economies;</text>
</subparagraph><subparagraph id="HB2421B36DF53480DB377C8C3FB763AF0"><enum>(B)</enum><text>offers benefits
that are comparable to or better than what is offered for similar positions in
existing local businesses of similar size in similar local economies;
and</text>
</subparagraph><subparagraph id="H154E40DB5F5F47C681A736998049FAA6"><enum>(C)</enum><text>is targeted for
residents of neighborhoods with a high proportion of persons of low income (as
that term is defined in section 102(a) of the Housing and Community Development
Act of 1974 (42 U.S.C. 5302(a))) through local targeted hiring programs.</text>
</subparagraph></paragraph></subsection></section><section id="HE845670A344E48A6A042D740E310C759"><enum>203.</enum><header>Duties of
Secretary</header>
<subsection id="H214833157CE54A9E85F136B1779AB532"><enum>(a)</enum><header>In
general</header><text>The Secretary shall—</text>
<paragraph id="HAE756D0040E04D319505D894DC52DEC3"><enum>(1)</enum><text>designate a
national fund manager to manage national funds;</text>
</paragraph><paragraph id="HED0CB73221244929870E52F25EE604A2"><enum>(2)</enum><text>oversee the
Initiative nationally;</text>
</paragraph><paragraph id="HB6C10FA3A64B411AA26249673EBA60E8"><enum>(3)</enum><text>work closely with
the national fund manager—</text>
<subparagraph id="H79C7857CE7044D15B0F0B2AF5FCAC307"><enum>(A)</enum><text>to ensure that
funds are used appropriately and in the most effective manner practicable;
and</text>
</subparagraph><subparagraph id="HA3F5E24C84DE4E26896E6C7543B09594"><enum>(B)</enum><text>to develop the
program strategy into a detailed work plan, program, and operating
budget;</text>
</subparagraph></paragraph><paragraph id="H419ADC6147BA423987180DB125F49DBC"><enum>(4)</enum><text>review and approve
the operating budget for the national fund manager to ensure that the
administrative costs are—</text>
<subparagraph id="H0873232C4724479FB9C3A1A19832B6F7"><enum>(A)</enum><text>reasonable (not
more than 5 percent of the total budget);</text>
</subparagraph><subparagraph id="H1105C0EAB14745D9B8F09E3B78575952"><enum>(B)</enum><text>connected to the
costs of operations; and</text>
</subparagraph><subparagraph id="HC414EC163D034F5C854D2D5BAF210CB5"><enum>(C)</enum><text>reflect efficient
operations by the national fund manager; and</text>
</subparagraph></paragraph><paragraph id="H15E58AAE30714BB19E66197D76870547"><enum>(5)</enum><text>make available to
the public an annual report, using data obtained from the Department of
Agriculture, the Department of Health and Human Services, and the community
development financial institutions, that describes the impacts of the
Initiative, including tracking health and economic development indicators at
the local, State, and national levels to determine the impacts of individual
projects and the collective impact in local areas and statewide of funded
projects and the Initiative overall.</text>
</paragraph></subsection><subsection id="H1D55488676A14801B92A2F01A07C73FF"><enum>(b)</enum><header>Performance
targets</header>
<paragraph id="H5581EA160EA6408E9B34522B91182FE0"><enum>(1)</enum><header>In
general</header><text>The Secretary shall conduct financial audits of, and
establish performance targets for, the national fund manager, which shall
include, at a minimum, the requirements described in this subsection.</text>
</paragraph><paragraph id="HBA462714FF464AADB330CE6A06773CE3"><enum>(2)</enum><header>Geographic
spread</header><text>Partnerships funded by the Initiative shall be
geographically diverse and representative of the underserved areas across the
United States.</text>
</paragraph><paragraph id="HEB5DD7C21C024FE9B736C36CA36D6566"><enum>(3)</enum><header>Focus on
low-income communities</header><text>A substantial portion of the projects
funded by partnerships shall serve very low- and low-income communities, as
defined by the Bureau of the Census of the Department of Commerce.</text>
</paragraph><paragraph id="H882684365DA7402DB36280ACA984F02C"><enum>(4)</enum><header>Financial
effectiveness of the national fund manager</header><text>The national fund
manager and any local financial institution involved in a partnership shall
demonstrate on-going capacity and timeliness in raising private capital and
disbursing funds as required under the Initiative.</text>
</paragraph><paragraph id="HED74D03C9F394EF08B1C9267774F1493"><enum>(5)</enum><header>Technical
assistance effectiveness of the national fund manager</header><text>The
provision of technical assistance by the national fund manager shall be
evaluated based on—</text>
<subparagraph id="H78A518D4F77141509D4A50A2588FE665"><enum>(A)</enum><text>the responsiveness
of the national fund manager to requests for assistance; and</text>
</subparagraph><subparagraph id="HC35E34C68F894D1EA16D76638AFB27BF"><enum>(B)</enum><text>the ability of the
national fund manager to craft programs that develop needed new capacities in
partnerships.</text>
</subparagraph></paragraph><paragraph id="HAC11B53561154CDA95911729DF88E752"><enum>(6)</enum><header>Impact</header><text>Performance
targets shall address the allocation of funds by the national fund manager to
partnerships and the tracking and reporting of the impacts of the funds in
improving access to fresh, healthy foods and in achieving other related
impacts.</text>
</paragraph></subsection><subsection id="HC939A5645AF142C5B5FA0028A7EB8E3E"><enum>(c)</enum><header>Disbursement of
funds</header><text display-inline="yes-display-inline">The Secretary shall
assist in the administration of the Initiative by approving the disbursement of
funds to the national fund manager in a manner that facilitates the
implementation of the overall Initiative.</text>
</subsection></section><section id="HF22DD3E2B376418B8507F571C8846E25"><enum>204.</enum><header>National fund
manager</header>
<subsection id="H6A211E3E3C0B4A03AF8B19DF2B50BFB3"><enum>(a)</enum><header>Selection of
National fund manager</header><text>The Secretary shall select the national
fund manager through a competitive process from among community development
financial institutions that have a proven and recent track record of success
and effectiveness in—</text>
<paragraph id="HAF1ABD9672594C64A5440D4973A6AE96"><enum>(1)</enum><text>attracting private
capital;</text>
</paragraph><paragraph id="H0AE74C0640E04580B66D884DBC1CCEB5"><enum>(2)</enum><text>developing and
managing programs that provide grants and loans to support supermarkets and
other fresh, healthy food retail business enterprises in low- and
moderate-income communities, including the development of grocery stores,
farmers markets, and other fresh, healthy food retail models;</text>
</paragraph><paragraph id="H0E88C145005F4A1DA5B6D62AED929B8F"><enum>(3)</enum><text>making and
servicing loans that are similar to loans proposed in the Initiative or having
a record of otherwise successfully investing in fresh, healthy food retail
development projects;</text>
</paragraph><paragraph id="HBAF58ECEB6AC4442879AF2CA865D8613"><enum>(4)</enum><text>effectively
managing multiple contracts and subcontractors;</text>
</paragraph><paragraph id="H1FA5A09662E74EBBA4C37CFEFA210EB0"><enum>(5)</enum><text>effectively
managing large capital pools, of at least $100,000,000; and</text>
</paragraph><paragraph id="H1A1B8EA03D854036B5F85474A8927D18"><enum>(6)</enum><text>providing or
contracting for the provision of technical assistance.</text>
</paragraph></subsection><subsection id="HE9F8E96ACEDE4B71AB233B835E664908"><enum>(b)</enum><header>Responsibilities
of the national fund manager</header><text>The designated national fund manager
shall—</text>
<paragraph id="H2BBD136385124B2887E7F4B4671406A1"><enum>(1)</enum><text>raise other forms
of financial assistance to match or leverage the national funds;</text>
</paragraph><paragraph id="H71742A9B468642B993951C34A9C3752B"><enum>(2)</enum><text>use administrative
funds to develop appropriate training programs and offer technical assistance
services to—</text>
<subparagraph id="H237F292FF38F428DA33AA38B8017C478"><enum>(A)</enum><text>partnerships;</text>
</subparagraph><subparagraph id="HD83386F6624E4941BD1D975D373AF3D2"><enum>(B)</enum><text>State, local, and
tribal governments;</text>
</subparagraph><subparagraph id="HA51C3C38FC8347B785223B494B57E3D4"><enum>(C)</enum><text>the food retail
industry; and</text>
</subparagraph><subparagraph id="H35BDE6429B80484BA3F9317B155782FE"><enum>(D)</enum><text>food access and
health advocacy organizations to augment local capacities;</text>
</subparagraph></paragraph><paragraph id="H366D1BF8BA58481AB5762CEDE5148739"><enum>(3)</enum><text>develop financial
products such as loans, grants, and credit enhancement tools that can be used
by partnerships to incentivize and support the development and retention of
supermarkets and other fresh, healthy food retail in underserved areas;</text>
</paragraph><paragraph id="H3D10BFFD238B40ECB0A673AAF31FBEE6"><enum>(4)</enum><text>award Initiative
funds to eligible partnerships through an annual competitive process in
accordance with section ___05(d);</text>
</paragraph><paragraph id="H91AE30F978344033912E0328A114078C"><enum>(5)</enum><text>contract with a
national food access organization to assist in the review of applications from
partnerships and to provide technical assistance to local food access
organizations in the proposed partnerships;</text>
</paragraph><paragraph id="HF1A32491F77E4E12A61CAE5A3F714A27"><enum>(6)</enum><text>award and disburse
funds to partnerships or eligible local projects in a timely manner;</text>
</paragraph><paragraph id="H8E10BC58DEFD48EEB3068350D366BF4A"><enum>(7)</enum><text>create and meet
performance benchmarks and reporting guidelines, as approved by the Secretary,
including for—</text>
<subparagraph id="H9DF94E30AF8541F59240CB96AE6A109B"><enum>(A)</enum><text>the amount of
capital raised and leveraged from financial institutions, partnerships, and
other resources;</text>
</subparagraph><subparagraph id="HD6642B5D4666420BA6BF420568B5737A"><enum>(B)</enum><text>the geographic
diversity of partnerships; and</text>
</subparagraph><subparagraph id="HC8932D4DF11F40F8B201A6DF0FF50882"><enum>(C)</enum><text>the proportion of
projects funded by the partnership that are in severely distressed low-income
communities;</text>
</subparagraph></paragraph><paragraph id="H1AFBDD3B9F994D8F8BBC254CCDABE38B"><enum>(8)</enum><text>develop program
guidelines and operating procedures for the Initiative, including—</text>
<subparagraph id="HF5E3F256BF7D4B098AEC6F2FCC561DEB"><enum>(A)</enum><text>maximum grant and
loan amounts for projects;</text>
</subparagraph><subparagraph id="HACA428B87C6340EDA4C68906A9575A87"><enum>(B)</enum><text>eligible uses of
funds;</text>
</subparagraph><subparagraph id="H60FAC46C898E403087442409C64DBCF8"><enum>(C)</enum><text>prudent
underwriting criteria;</text>
</subparagraph><subparagraph id="H6C26B3F2F5CC4548A5FB855413FCD209"><enum>(D)</enum><text>performance
targets;</text>
</subparagraph><subparagraph id="H7AAAD38B9A474FE8ADBE0037F318A5D8"><enum>(E)</enum><text>reporting
guidelines;</text>
</subparagraph><subparagraph id="H3A216FA2C0EC4A0F9E94EACC7E502CAC"><enum>(F)</enum><text>limits on
administrative costs; and</text>
</subparagraph><subparagraph id="H35CED8BD267E4000998A5B5A407E1AC6"><enum>(G)</enum><text>implementation
milestones;</text>
</subparagraph></paragraph><paragraph id="H9AD2DFAD84E14983B2DF78C02A4B1644"><enum>(9)</enum><text>monitor the
performance of partnerships; and</text>
</paragraph><paragraph id="H753292E329574CA4921C0BF0975E9027"><enum>(10)</enum><text>collect data,
compile information, and conduct such research studies as the national fund
manager determines to be relevant to the successful implementation of the
Initiative, including—</text>
<subparagraph id="H05C19E4D33AE42D3B5B42853C3CC39A1"><enum>(A)</enum><text>to assess national
and local market conditions;</text>
</subparagraph><subparagraph id="HA6658A5C37F347A0925A5A1CFFE257D0"><enum>(B)</enum><text>to determine
barriers to market entry; and</text>
</subparagraph><subparagraph id="H83477977F573431FBBF0AA0E9616698F"><enum>(C)</enum><text>to identify
opportunities for the development or retention of supermarkets and other fresh,
healthy food retail enterprises in underserved communities.</text>
</subparagraph></paragraph></subsection><subsection id="HFA2C61D5CD364E449BB059A67471A75D"><enum>(c)</enum><header>Work
plan</header>
<paragraph id="H78301DECFBB6489983AAB2B53717CEF4"><enum>(1)</enum><header>In
general</header><text>Not later than 45 days after the date of receipt of an
award, the national fund manager shall develop, with guidance from and in
consultation with the Secretary, and submit to the Secretary, a detailed work
plan.</text>
</paragraph><paragraph id="HC856D09CDB1F461A9276268DC8069AE7"><enum>(2)</enum><header>Approval
required</header><text>The Secretary shall review and approve the work plan,
program budget, and administrative costs under subsection (e)(4)(C) prior to
entering into an agreement with the national fund manager to administer the
Initiative.</text>
</paragraph></subsection></section><section id="HB451C0FECFB24BCBA9B832744C3D67E3"><enum>205.</enum><header>Allocation and
use of funds</header>
<subsection id="HE996EE441AF64C2093ED9CD6074E5EEF"><enum>(a)</enum><header>Allocation</header><text>The
national fund manager shall—</text>
<paragraph id="HD9689E3177754EDC8191984F9E5C10C2"><enum>(1)</enum><text>allocate at least
70 percent of all funds appropriated for the Initiative for a fiscal year to
partnerships that are selected based on the criteria described in subsection
(d); and</text>
</paragraph><paragraph id="HE9C55D48D827453588481B891866D6B6"><enum>(2)</enum><text display-inline="yes-display-inline">retain not more than 30 percent of the
funds appropriated for the Initiative for a fiscal year to undertake financing
activities described in subsection (c), including a reasonable amount for
administrative costs (not to exceed 5 percent) approved by the
Secretary.</text>
</paragraph></subsection><subsection id="H63011347148449C5A756ECEEAFBFC8C2"><enum>(b)</enum><header>Use of the
national funds by partnership programs</header>
<paragraph id="HBFB19422D09446FFBD8A88E3CFD6D26D"><enum>(1)</enum><header>In
general</header><text>As a condition on the receipt of funds, each partnership
shall use—</text>
<subparagraph id="H38586CFFF1D94949A69F6E5BC13171A5"><enum>(A)</enum><text>the national funds
received from the national fund manager under subsection (a)(1) to create 1 or
more revolving loan programs or other revolving pools of capital or other
products to facilitate financing of local projects as determined by the
agreement between the partnership and the national fund manager; and</text>
</subparagraph><subparagraph id="H9C27033E3363448A8D703467BAD49711"><enum>(B)</enum><text>any remaining
funds for grants, or, as approved, for innovative financing mechanisms.</text>
</subparagraph></paragraph><paragraph id="H917C457C12764646962D8800B5FB0107"><enum>(2)</enum><header>Limitations</header>
<subparagraph id="HCE1DD162ECD74163B95B0E120D80345A"><enum>(A)</enum><header>In
general</header><text>Use of funds for administrative costs and other purposes
shall be—</text>
<clause id="HF239AA05128B4AEBBE359C31BF1D711F"><enum>(i)</enum><text>limited in
accordance with the terms of the agreement negotiated between the national fund
manager and partnerships;</text>
</clause><clause id="H7CEEE1FAD72847BD9B1443F23948F818"><enum>(ii)</enum><text>based on whether
administrative costs are reasonable, connected to the costs of operation, and
reflect efficient operations by the partnership; and</text>
</clause><clause id="H287A0746636B40939C4CEC2979883E5F"><enum>(iii)</enum><text>determined using
criteria including geographic coverage, program duration, and total funding
amount.</text>
</clause></subparagraph><subparagraph id="H7A383056A6864ED2AED8D3648ADE5BE2"><enum>(B)</enum><header>Goal</header><text>The
goal of this paragraph is to limit administrative costs to the maximum extent
practicable, but in no case may the amount used for administrative costs exceed
10 percent of the Federal funds allocated.</text>
</subparagraph></paragraph></subsection><subsection id="HA0E64B94578A47E1B65584368488AE81"><enum>(c)</enum><header>Use of the
national funds by the national fund manager</header><text>The national fund
manager shall use national funds described in subsection (a)(2) to undertake
financing and other activities to enhance and maximize the effectiveness of the
Initiative, as determined by the agreement with the Secretary,
including—</text>
<paragraph id="H2DAB44D921BE4A489458DC782B1BE86F"><enum>(1)</enum><text>attracting other
forms of financial assistance to match or leverage the national funds;</text>
</paragraph><paragraph id="H11DDA943E5E34901B5D16A80D54F48AE"><enum>(2)</enum><text>awarding national
funds to partnerships in accordance with subsection (d);</text>
</paragraph><paragraph id="HE1EFC445F60B4BC2BC2A1D727302D107"><enum>(3)</enum><text>creating and
managing pools of grant or loan capital that blend or leverage national funds
with other forms of financial assistance, including capital in the form of tax
credits under section 45D of the Internal Revenue Code of 1986, for the benefit
of partnerships;</text>
</paragraph><paragraph id="HEE06154302744DFA8C7F147AE8572DC0"><enum>(4)</enum><text>creating and
managing pools of grant or loan capital that blend or leverage the national
funds with other forms of financial assistance, including capital in the form
of tax credits under section 45D of the Internal Revenue Code of 1986, to
finance eligible local projects identified by partnerships or the national fund
manager that have special or unique characteristics;</text>
</paragraph><paragraph id="H88698E6FAD924410AE3DFFB4FC8E4AE9"><enum>(5)</enum><text>providing loans or
grants directly to eligible local projects as matching funds if requested by a
partnership;</text>
</paragraph><paragraph id="H4EF9770864854F1296F03EA975EB40B1"><enum>(6)</enum><text>providing credit
enhancement or other financial products and instruments for the benefit of
partnerships or eligible local projects;</text>
</paragraph><paragraph id="H508A5B37EF164D358AB19D76BADC8777"><enum>(7)</enum><text>providing
technical assistance; and</text>
</paragraph><paragraph id="HF5BA32C6BD1C4C5F9756231F5F1D48BF"><enum>(8)</enum><text>funding reasonable
administrative costs approved by the Secretary.</text>
</paragraph></subsection><subsection id="H6FA17DA33B6141919907A8075F2B147C"><enum>(d)</enum><header>Criteria for
awarding national funds to partnerships</header>
<paragraph id="H89A61B6CE73F4B61AE206C0FBCE29A56"><enum>(1)</enum><header>In
general</header><text>The national fund manager shall award national funds to
partnerships through a competitive process on an annual basis.</text>
</paragraph><paragraph id="H94D5005FF0B74CC7AD015CAD633343FA"><enum>(2)</enum><header>First round
priority</header><text>In the first round of funding, the national fund manager
shall give priority to existing partnerships that have demonstrable capacity to
implement fresh food financing programs in underserved areas quickly.</text>
</paragraph><paragraph id="HCD6205E5A4A649FD85221E7786790D62"><enum>(3)</enum><header>Additional
rounds</header><text>Additional rounds shall be designed to promote geographic
diversity.</text>
</paragraph><paragraph id="HD7C110EC751A452ABB8716C6F99824FA"><enum>(4)</enum><header>Criteria</header><text>In
awarding national funds to partnerships, the national fund manager shall
consider—</text>
<subparagraph id="HC82B3CBDAC2C4F35934D479F907E532D"><enum>(A)</enum><text>the amount of
funds and other resources pledged by a partnership to match or leverage
national funds;</text>
</subparagraph><subparagraph id="H15C55C031B5E468792EC2E2D434E9509"><enum>(B)</enum><text>the degree of
State, local, or tribal government support of the partnership as evidenced by
matching grant and loan funds or other types of support, such as allocation of
tax-exempt bonds, loan guarantees, and coordination of resources from other
State or local economic development programs;</text>
</subparagraph><subparagraph id="H916C6ACA1F094F6794E9101C06DE0848"><enum>(C)</enum><text>the capacity of
the partnership to successfully develop and manage loan and grant
programs;</text>
</subparagraph><subparagraph id="HB31BE5B93CAF4224AD830AF5A6E5B7CA"><enum>(D)</enum><text>the lack of
supermarkets and other fresh, healthy food retail enterprises in low- and
moderate-income areas that would be served by the partnership;</text>
</subparagraph><subparagraph id="H16F6B96D8D664D3DBDDDE9ABD0B16EC4"><enum>(E)</enum><text>the experience of
the food access or community health organization of the partnership in outreach
about access to healthy foods and local healthy food access issues;</text>
</subparagraph><subparagraph id="H080AEA63005E47F6967CECDBA984D4B3"><enum>(F)</enum><text>the degree of
community engagement and support in the development and retention of
supermarkets and other fresh, healthy food retail enterprises; and</text>
</subparagraph><subparagraph id="H2B863245C19F4E70A2ED17B7524AA545"><enum>(G)</enum><text>the contribution
of the program of the partnership to the overall geographic diversity of the
Initiative.</text>
</subparagraph></paragraph></subsection><subsection id="HA6B536BFB6F8481C99C3612E80E104E1"><enum>(e)</enum><header>Administrative
costs</header>
<paragraph id="H64E04DEE15FD4742A0F1868FE69F16C9"><enum>(1)</enum><header>In
general</header><text>Not later than 45 days after the date of receipt of an
award, the national fund manager shall submit to the Secretary for approval a
3-year program and operating budget and detailed work plan that shall
include—</text>
<subparagraph id="H8C9B0817CA414D0F8D8A8EF677CF5D3E"><enum>(A)</enum><text>costs for research
and evaluation, technical assistance, and training; and</text>
</subparagraph><subparagraph id="H1A12A264F65F44498A94E66C914E6660"><enum>(B)</enum><text>program and
operating costs.</text>
</subparagraph></paragraph><paragraph id="H7FBE248E54E248E1B207987A86544C00"><enum>(2)</enum><header>Earned
revenues</header><text>Earned revenues from loan fees and interest may be
expended on program and operating costs in accordance with the budget approved
by the Secretary.</text>
</paragraph><paragraph id="HF76BBB8933CE41EFB9DBE83C1C63FEE1"><enum>(3)</enum><header>Basis of
review</header><text>The Secretary shall base the review under subparagraph (A)
on—</text>
<subparagraph id="HB06671DB364043A4B0F31DA56BCCFB72"><enum>(A)</enum><text>the likelihood of
the plan and expenditures to further the purposes of this section; and</text>
</subparagraph><subparagraph id="H9A2AEC142805478E90722B1451A4C635"><enum>(B)</enum><text>whether the
administrative costs are reasonable, connected to the costs of operation, and
reflect efficient operations by the national fund manager.</text>
</subparagraph></paragraph></subsection></section><section id="H7B74190334E44C4C8D8C6D2684924039"><enum>206.</enum><header>Partnerships</header>
<subsection id="H1AF7C6C046C7436A98EC41886B8C8842"><enum>(a)</enum><header>In
general</header><text>Each partnership that receives assistance through the
Initiative shall provide financial and technical assistance to eligible fresh,
healthy food retail projects in underserved areas within the defined
communities of the partnership.</text>
</subsection><subsection id="H0D7EFA82CB524FF49C0F438230008461"><enum>(b)</enum><header>Administration</header><text>Each
partnership shall designate a community development financial institution or
other organization that is capable of administering a loan and grant
program—</text>
<paragraph id="H16EB8F7EA7844D40BD65AE2264027A07"><enum>(1)</enum><text>to execute grant
agreements with the national fund manager; and</text>
</paragraph><paragraph id="HBF221F1F7F3F426EA32E1D09E58A513E"><enum>(2)</enum><text>to serve as the
manager of local funds.</text>
</paragraph></subsection><subsection id="H4C1AFF1BED5B4A7FA91F116F8098E211"><enum>(c)</enum><header>Responsibilities
of partnerships</header><text>A partnership shall—</text>
<paragraph id="HFC7BEA9E0F494E809862C6D2A5F0263D"><enum>(1)</enum><text>raise other forms
of financial assistance to match the national funds received by the
partnership;</text>
</paragraph><paragraph id="H0DC373C7C404413BB819E4E0EAC1D4E5"><enum>(2)</enum><text>provide marketing
and outreach to communities, the supermarket industry, other fresh, healthy
food retailers, State and local government officials, and civic and public
interest organizations—</text>
<subparagraph id="H8C4FCCE771E94AB78D19ACA174BB176C"><enum>(A)</enum><text>to solicit
applications from underserved areas from across the State or locality to be
served by the partnership; and</text>
</subparagraph><subparagraph id="H924AF2EEB37A42C297E5A88F2A08B254"><enum>(B)</enum><text>to inform the
communities and other persons about the availability of grants, loans,
training, and technical assistance;</text>
</subparagraph></paragraph><paragraph id="HCF1DCD0DF7554C848025A6D858EF6131"><enum>(3)</enum><text>review and
underwrite projects to determine whether—</text>
<subparagraph id="H4DF9919E1D9447348D31BEB8D0F7A14D"><enum>(A)</enum><text>a proposed project
meets the criteria for eligible projects under section __02; and</text>
</subparagraph><subparagraph id="H43BE2D686658435F93646799DF5FB14F"><enum>(B)</enum><text>a proposed project
meets the criteria for priority projects under subsection (g) of such
section;</text>
</subparagraph></paragraph><paragraph id="H2F1EDCFF323A4561A4351970FCF08079"><enum>(4)</enum><text>provide technical
assistance services to eligible fresh, healthy food retail operators and
developers;</text>
</paragraph><paragraph id="H377B5C161C594FF6ADE1D28BAECA0F3C"><enum>(5)</enum><text>track and report
outcomes, including—</text>
<subparagraph id="H2EBEC44611E14A0B9765ED5FC32D11A8"><enum>(A)</enum><text>the number of jobs
created or retained;</text>
</subparagraph><subparagraph id="H004D9BFCCC944FA094EF3E7712A2894F"><enum>(B)</enum><text>the quantity of
fresh, healthy food retail space created or retained; and</text>
</subparagraph><subparagraph id="HBC007BDD25D24B3F92B4075672C0AB90"><enum>(C)</enum><text>such other health
and economic indicators as are required by the national fund manager;</text>
</subparagraph></paragraph><paragraph id="H9CBF0EBAF3874F468CEDE4702BEDD797"><enum>(6)</enum><text>monitor and audit
funded projects to ensure compliance with the Initiative, the national fund
manager, and partnership program requirements for a period of at least 3
years;</text>
</paragraph><paragraph id="H72F8853923E24FD2971BE01C34E39CB4"><enum>(7)</enum><text>submit an annual
report to the national fund manager that describes—</text>
<subparagraph id="HD55BC4C2AE0C4D8BAD3973CBA66D33B5"><enum>(A)</enum><text>the activities of
the partnership;</text>
</subparagraph><subparagraph id="H93B77C027A344C8E93BA9DB6FD52C6EC"><enum>(B)</enum><text>the expenditure of
local funds; and</text>
</subparagraph><subparagraph id="H70DC3E244F4B473CAA87AACAD634D18E"><enum>(C)</enum><text>success in meeting
performance targets and satisfying such other terms and conditions as are
specified in the agreement between the partnership and the national fund
manager; and</text>
</subparagraph></paragraph><paragraph id="H597A3DB1DB374C69BFD65F8D40FD3DA3"><enum>(8)</enum><text>coordinate with
the national fund manager for the smooth operation of the Initiative.</text>
</paragraph></subsection><subsection id="HFBD22FD95D3941ABBC34C78BDA0DE44A"><enum>(d)</enum><header>Administrative
costs</header>
<paragraph id="H52E48FA20CD64162B775475CB067AB97"><enum>(1)</enum><header>In
general</header><text>As a condition on the receipt of assistance under this
section, each partnership shall submit to the national fund manager for
approval a 3-year budget and plan for all program and operating costs,
including—</text>
<subparagraph id="H2ECCEA53FA384115A06DC1C52746980C"><enum>(A)</enum><text>costs for research
and evaluation, technical assistance, and training; and</text>
</subparagraph><subparagraph id="H2025B42A45A343D9857C3E4D568246D9"><enum>(B)</enum><text>administrative and
operating costs.</text>
</subparagraph></paragraph><paragraph id="HC6F175622F354EC499B1233EDFB8CA88"><enum>(2)</enum><header>Earned
revenues</header><text>Earned revenues from loan fees and interest may be
expended on program and operating costs in accordance with the budget approved
by the national fund manager.</text>
</paragraph><paragraph id="HD838FDDF26334A67A601E361FF2886B2"><enum>(3)</enum><header>Basis of
review</header><text>The national fund manager shall base the review of the
budget and plan under paragraph (1) on the likelihood of the budget and plan to
further the purposes of the Initiative.</text>
</paragraph></subsection></section><section id="H475940AE5F5F449183DF8BF713A2A7BE"><enum>207.</enum><header>Evaluation and
monitoring</header>
<subsection id="HE48B5319C35641E1ADF7581AB57BCE9C"><enum>(a)</enum><header>In
general</header><text>Program evaluation and financial audits shall occur at
all levels of the Initiative to ensure that—</text>
<paragraph id="HC354D76FA12149C38178B0956727704C"><enum>(1)</enum><text>national and local
funds are used properly; and</text>
</paragraph><paragraph id="H9B20B42FBFEA4F2E932612BC97D64690"><enum>(2)</enum><text>the objectives of
the Initiative are met.</text>
</paragraph></subsection><subsection id="H6D90AED642124039BC32FFC337EB3F9E"><enum>(b)</enum><header>Program
evaluation and financial audits</header>
<paragraph id="HBD45C4D6A1FB46B688BF233C7CF44F32"><enum>(1)</enum><header>In
general</header><text>The Secretary shall—</text>
<subparagraph id="HC2FCA4BA5F0E49ADB080A418BB2222EC"><enum>(A)</enum><text>conduct periodic
program evaluations and financial audits of the national fund manager,
partnerships, and projects funded by the Initiative; and</text>
</subparagraph><subparagraph id="H4BD4683A6A744F14A788249FA7BA5B7D"><enum>(B)</enum><text>share with the
national fund manager the results of the evaluations and audits.</text>
</subparagraph></paragraph><paragraph id="H5DA4AB4597AB4F76B978CFC020EA7EBA"><enum>(2)</enum><header>Funded
projects</header><text>The Secretary or the national fund manager shall
evaluate partnerships to assess the health and economic impacts of projects
funded by the Initiative.</text>
</paragraph><paragraph id="HEC7C7A26873A4D98833A10AA25B26FC4"><enum>(3)</enum><header>Other
impacts</header>
<subparagraph id="HFF3F3E7226C74558A2287398AFD6C8F4"><enum>(A)</enum><header>Secretary of
Health and Human Services</header><text>The Secretary of Health and Human
Services shall conduct research studies and evaluate the health impacts of the
Initiative.</text>
</subparagraph><subparagraph id="H856654AD9DF642CF988DCF691139F187"><enum>(B)</enum><header>Community
Development Financial Institutions</header><text>Representatives of the
community development financial institutions shall conduct research studies and
evaluate the economic impacts of the Initiative.</text>
</subparagraph></paragraph><paragraph id="HCE22589572CC46F2A72EFEDCCC09BBC1"><enum>(4)</enum><header>Partnerships</header>
<subparagraph id="H1F2F55C762ED4A898E202E5108ABFC2E"><enum>(A)</enum><header>In
general</header><text>Each partnership shall—</text>
<clause id="H47C3A79CA16E4006B0E9FB196860B832"><enum>(i)</enum><text>conduct periodic
administrative and financial audits of projects funded by the Initiative;
and</text>
</clause><clause id="H67E86A9D9E844B25AB3540C309BF3AA0"><enum>(ii)</enum><text>share with the
national fund manager the results of the audits.</text>
</clause></subparagraph><subparagraph id="H1FCA354DE7D24C6DB2358B07C6B21310"><enum>(B)</enum><header>Failure of
partnership</header><text>In a case in which a partnership fails, the national
fund manager shall take over the portfolio of the failed partnership.</text>
</subparagraph></paragraph></subsection></section><section id="H573DDBB5400940119160B5CEF6138F2F"><enum>208.</enum><header>Administrative
provisions</header><text display-inline="no-display-inline">Not later than 180
days after the date of enactment of this Act, the Secretary shall promulgate
such regulations as may be necessary to carry out the Initiative, including
regulations—</text>
<paragraph id="H276353907BB649FB859D94031C443A05"><enum>(1)</enum><text>for the conduct of
a performance evaluation at the end of the initial 5-year period;</text>
</paragraph><paragraph id="H2EBF7B7424304D11BE829EE29FCEBCE7"><enum>(2)</enum><text>to terminate the
contract for cause; and</text>
</paragraph><paragraph id="HCBFB51E6BAE34CA3BCCDB0A2D3D4C132"><enum>(3)</enum><text>to extend the
contract for an additional 5-year period.</text>
</paragraph></section><section id="HEDA4757F12F34F56A04EF21E3C0AEE8E"><enum>209.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There is
authorized to be appropriated to the Secretary to carry out the Initiative
$500,000,000. Amounts appropriated pursuant to this authorization of
appropriation shall remain available until expended.</text>
</section><enum>III</enum><header>Development of
Sustainable Urban Agriculture</header>
<section id="H92D7B63EAF5B4280940A39E325FBEBD6"><enum>301.</enum><header>Community
gardening grant program</header>
<subsection id="HED8374F8902F4096A5BA5878DD23E77B"><enum>(a)</enum><header>Program
established</header><text>From the amounts appropriated to carry out this
section, the Secretary of Agriculture shall award grants to eligible entities
to expand, establish, or maintain urban and Native American community
gardens.</text>
</subsection><subsection id="H8C37BCB9362E4AEB9EC33A7FC7209265"><enum>(b)</enum><header>Application</header><text>In
order to receive a grant under this section, an eligible entity shall submit to
the Secretary an application at such time, in such manner, and containing such
information as the Secretary may require, including—</text>
<paragraph id="H0C5907A26632418BAE093ADB815A315E"><enum>(1)</enum><text>an assurance that
priority for hiring for jobs created by the expansion, establishment, or
maintenance of an urban community garden funded with a grant received under
this section will be given to individuals who reside in the community where the
garden is located; and</text>
</paragraph><paragraph id="HD0388DD6E2D94B64A95E24F429C9C2B0"><enum>(2)</enum><text>a
demonstration that the eligible entity is committed to providing non-Federal
financial or in-kind support (such as, but not limited to, providing a water
supply) for the community garden for which the entity receives funds under this
section.</text>
</paragraph></subsection><subsection id="H48822E7020C64BC1A40926EC6C5B31D1"><enum>(c)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph id="H7811D26AA8194ED9971A6B9EBCF57D66"><enum>(1)</enum><header>Eligible
entity</header><text>The term <quote>eligible entity</quote> means—</text>
<subparagraph id="H01F8E63D1A384442A858E09EBF97DEDE"><enum>(A)</enum><text>a for profit or
nonprofit organization; or</text>
</subparagraph><subparagraph id="H37D268C1A1C84103B3AB6E31C5A66810"><enum>(B)</enum><text>a unit of general
local government, or tribal government, located on tribal land or in a
low-income community.</text>
</subparagraph></paragraph><paragraph id="HA54A64F80FD241C0B4C09AA96912965B"><enum>(2)</enum><header>Low-income
community</header><text>The term <quote>low-income community</quote> has the
meaning given such term by the Secretary of Agriculture.</text>
</paragraph><paragraph id="H2CD1EC30ACE0419CBF26113899D5E9D2"><enum>(3)</enum><header>Unit of general
local government</header><text>The term <quote>unit of general local
government</quote> means any city, county, town, township, parish, village, or
other general purpose political subdivision of a State.</text>
</paragraph><paragraph id="HFDB2627A5D9D45F98B0946909A2E2972"><enum>(4)</enum><header>State</header><text>The
term <quote>State</quote> includes, in addition to the several States of the
United States, the Commonwealth of Puerto Rico, the District of Columbia, the
Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern
Mariana Islands.</text>
</paragraph></subsection></section><section id="H29837511FF40420493A49AA2530EBC6B"><enum>302.</enum><header>Grants for
conversion of abandoned and foreclosed property to urban agricultural
uses</header>
<subsection id="H6E581219401C4472ABA807DCC4F398AC"><enum>(a)</enum><header>Grants
authorized</header><text display-inline="yes-display-inline">The Secretary of
Agriculture may make grants on a competitive basis to assist an eligible entity
described in subsection (b)—</text>
<paragraph id="H033AC034A2F74612B1098EAED349C41C"><enum>(1)</enum><text display-inline="yes-display-inline">to acquire, by purchase or lease, abandoned
or foreclosed real property in an urban area where there is limited or no
agricultural production; and</text>
</paragraph><paragraph id="H4F2F9EF4C79944438A09E8AA80C5FFF6"><enum>(2)</enum><text>to convert the
property to an agricultural use authorized by subsection (c).</text>
</paragraph></subsection><subsection id="H15AD9379611740DF8C902078E016C4B7"><enum>(b)</enum><header>Eligible
entities described</header><text display-inline="yes-display-inline">Grants may
be made under this section to a community organization, municipality,
institution of higher education, local school district, nonprofit organization,
or for-profit entity.</text>
</subsection><subsection id="H199D3147CFBE4435ADCB31626B97B1D7"><enum>(c)</enum><header>Authorized
agricultural uses</header><text>Real property acquired using grant funds may be
used for any of the following purposes:</text>
<paragraph id="HB652147FD0EA4027AACC653C3042B8BD"><enum>(1)</enum><text>Projects to
encourage the production of local foods in an urban area.</text>
</paragraph><paragraph id="H75551E25F5C54660A06ECBB6055339F4"><enum>(2)</enum><text display-inline="yes-display-inline">Projects to strengthen local food
distribution systems in an urban area.</text>
</paragraph><paragraph id="H377A76F5DE714975B57CC19FB2764334"><enum>(3)</enum><text display-inline="yes-display-inline">Projects to create sustainable food systems
in an urban area.</text>
</paragraph><paragraph id="HEA58100F0D8E4080BDD150917E6238D5"><enum>(4)</enum><text display-inline="yes-display-inline">Projects to create or expand the
opportunities to consume fresh fruits and vegetables in an urban area.</text>
</paragraph><paragraph id="HCF6DD93FC0484B888B0167830B58AC3C"><enum>(5)</enum><text display-inline="yes-display-inline">Projects to promote agricultural processing
in an urban area.</text>
</paragraph><paragraph id="H962597ABC691499FB7B836E11ECE1E3A"><enum>(6)</enum><text display-inline="yes-display-inline">Projects to encourage recipients of Federal
and State domestic food assistance programs to purchase locally grown or
produced foods.</text>
</paragraph><paragraph id="H1C9DAA69A9604ABAB2ED7DBDA877DE83"><enum>(7)</enum><text display-inline="yes-display-inline">Projects to promote education and training
related to best practices for agricultural production in an urban area.</text>
</paragraph><paragraph id="HCB3E63DEC27C4D889B767DCBE79DF551"><enum>(8)</enum><text>Projects to
promote education initiatives that promote the nutritional benefits of
consuming locally produced foods.</text>
</paragraph><paragraph id="HCEFE47AE191B4758906D59B2624E0A4F"><enum>(9)</enum><text display-inline="yes-display-inline">Other projects to promote economic
development through agricultural production in an urban area.</text>
</paragraph></subsection><subsection id="H07284D2BBCCD48BD9469BE8799C505C7"><enum>(d)</enum><header>Grant
limitation</header><text>The amount of a grant made under this section shall
not exceed $500,000.</text>
</subsection><subsection id="HFF867083AC124F2D9667C216A1C4FC3D"><enum>(e)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There are
authorized to be appropriated to the Secretary such amounts as may be necessary
to carry out this section.</text>
</subsection></section><section id="H649D3C18A6924383B935918C522D9625" section-type="subsequent-section"><enum>303.</enum><header>Expansion of
HarvestCorps program</header>
<subsection id="H36B4D56DDC7F460F81F27301144FBAAC"><enum>(a)</enum><header>Authority To
fund HarvestCorps grants</header><text display-inline="yes-display-inline">The
Secretary of Agriculture may enter into an agreement with the Director of the
Corporation for National and Community Service, under which the Secretary will
provide funds to the Corporation for National and Community Service to make up
to 10 annual grants under section 121 of the National and Community Service Act
of 1990 (42 U.S.C. 12571) to support the creation of the HarvestCorps
program—</text>
<paragraph id="H324861B774A64305901395910032A47D"><enum>(1)</enum><text>to alleviate
poverty and meet the food needs of low-income people by increasing their access
to supportive programs, such as the Summer Food Service Program, the
Supplemental Nutrition Assistance Program, tax credits, and other programs,
that increase the revenue and economic health of the low-income communities;
and</text>
</paragraph><paragraph id="HCA421838D0A346DCA37AE28DF1AEC289"><enum>(2)</enum><text>to engage
community resources and promote partnerships that address local food access
issues.</text>
</paragraph></subsection><subsection id="HF5BB3282CD084620B65FD4C94F05FA7D"><enum>(b)</enum><header>Grant process;
elimination of cost-Sharing requirements</header>
<paragraph id="H025E4FD030E54FEA893E48936F85C5A6"><enum>(1)</enum><header>Competitive
process</header><text display-inline="yes-display-inline">Grants funded by the
Secretary under subsection (a) shall be awarded by the Corporation on a
competitive basis. The Corporation shall extend a preference to eligible
entities (as described in section 121(a) of the National and Community Service
Act of 1990 (42 U.S.C. 12571(a))) operating in the 10 States with the highest
food insecurity rates, as measured by the Department of Agriculture.</text>
</paragraph><paragraph id="H6B9A704452FE49FBB1DF412D8A9CB639"><enum>(2)</enum><header>Grant amount;
duration</header><text display-inline="yes-display-inline">A grant funded by
the Secretary under subsection (a) may not exceed $1,000,000 per year. The
grant recipient may not receive a grant under this section for more than three
years.</text>
</paragraph><paragraph id="H4C75335B8D1344388BBF61743663D145"><enum>(3)</enum><header>Matching
funds</header><text display-inline="yes-display-inline">The matching funds
requirement of section 121(e) of the National and Community Service Act of 1990
(42 U.S.C. 12571(e)) shall not apply to grants funded by the Secretary under
subsection (a).</text>
</paragraph></subsection><subsection id="HA1A1199C9ECE449FAE1BE44762CEE0D5"><enum>(c)</enum><header>State-Wide use
of grant</header><text display-inline="yes-display-inline">The recipient of a
grant funded by the Secretary under subsection (a) shall agree to provide
services on a State-wide basis.</text>
</subsection><subsection id="H3035F9BDAA874DD8B8CC39B51181847D"><enum>(d)</enum><header>Sharing
information</header><text display-inline="yes-display-inline">The Secretary and
the Corporation may provide for the sharing of information concerning
HarvestCorps projects through publications, conferences, and other appropriate
forums, including sharing information with researchers, practitioners, and
other interested parties.</text>
</subsection><subsection id="HC2D7FED2D95549C29B896088F331F789"><enum>(e)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There is
authorized to be appropriated to the Secretary of Agriculture $10,000,000 for
each of fiscal years 2013, 2014, and 2015 to carry out this section.</text>
</subsection></section><section id="H09D28607E755400286490855CDC6A3CF" section-type="subsequent-section"><enum>304.</enum><header>Acquisition of
publically owned land and conversion to urban farms and community
gardens</header>
<subsection id="H0E622F2829874242B48A40723B9A138C"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="HFBD20D550B01434FAEEA199779F60BB0"><enum>(1)</enum><header>Food
desert</header><text display-inline="yes-display-inline">The term <quote>food
desert</quote> has the meaning given the term <quote>underserved
community</quote> in section 25(a)(3) of the Food and Nutrition Act of 2008 (7
U.S.C. 2034(a)(3)).</text>
</paragraph><paragraph id="H93FA6920DBAA431EBAB3B462C9A53667"><enum>(2)</enum><header>Community land
trust</header><text display-inline="yes-display-inline">The term
<quote>community land trust</quote> means a community housing development
organization, as such term is defined in section 104(6) of the
Cranston-Gonzalez National Affordable Housing Act (42 U.S.C. 12704(6)), except
that the requirements under subparagraphs (C) and (D) of such section shall not
apply for purposes of this section.</text>
</paragraph></subsection><subsection id="H5633B28524A3434AAFC991377C3EF798"><enum>(b)</enum><header>Grants
authorized</header><text display-inline="yes-display-inline">The Secretary of
Agriculture shall make competitive grants to nonprofit organizations, including
community land trusts, to assist the organizations—</text>
<paragraph id="H08FA0BE767D943F2B809E56F4E2B19E1"><enum>(1)</enum><text>to purchase
publically owned land in a food desert; and</text>
</paragraph><paragraph id="HCCE51DA40C394CFA8F23C4E09DF36108"><enum>(2)</enum><text>to convert the
land for use as an urban farm or community garden for the production of
affordable, nutritious foods.</text>
</paragraph></subsection><subsection id="H588B113C0D894EF78567CE3FF5ECD402"><enum>(c)</enum><header>Matching funds
requirement</header><text display-inline="yes-display-inline">As a condition of
receiving a grant under this section, the nonprofit organization shall provide
an amount of funds equal to not less than the amount of the grant.</text>
</subsection><subsection id="H6A1B0EC611834C8AB917FA4AE0916AC9"><enum>(d)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to the
Secretary of Agriculture such amounts as may be necessary to carry out this
section.</text>
</subsection></section><section id="HEA0EE751B0B84CBB9B59FB5A9EA18222" section-type="subsequent-section"><enum>305.</enum><header>Urban agricultural
workforce training pilot program</header>
<subsection id="H765B7A4A39D2404DA3521423FA4EB228"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of Agriculture, in
consultation with the Secretary of Labor, shall award not more than 25 grants
to eligible entities to develop and implement urban agricultural workforce
training programs.</text>
</subsection><subsection id="H661930645E8142418B4511D8F8C9BD08"><enum>(b)</enum><header>Grants</header>
<paragraph id="H4D04B676CB8442A189CF8058FA87E73F"><enum>(1)</enum><header>Application</header><text>An
eligible entity seeking a grant under this section shall submit to the
Secretary of Agriculture an application containing—</text>
<subparagraph id="HB30D083E487D4AE692CCC832940A6080"><enum>(A)</enum><text>a description of
the urban agricultural workforce training program such entity intends to
develop and implement using grant funds; and</text>
</subparagraph><subparagraph id="H3CC013C511D74B0FBD51DD45959FDC09"><enum>(B)</enum><text>such other
information as the Secretary may require.</text>
</subparagraph></paragraph><paragraph id="H55EBA5D480E44F26B1BD1373CB2943D9"><enum>(2)</enum><header>Equal
amounts</header><text>The Secretary of Agriculture shall award grants under
this section in equal amounts.</text>
</paragraph></subsection><subsection id="H037C9113E147422D83C3E0EE94B98A9D"><enum>(c)</enum><header>Term of grants;
condition</header>
<paragraph id="H9A1BE27E548D4B478E3F5A0048DC8B46"><enum>(1)</enum><header>Term</header><text>The
term of a grant awarded under this section shall be two years.</text>
</paragraph><paragraph id="H95EBD945C17D49BBA888E6E35CC2462F"><enum>(2)</enum><header>Condition</header>
<subparagraph id="H0D824A8369B141658A22F93AF6557E9D"><enum>(A)</enum><header>Two-year
availability of grant funds</header><text>Each recipient of a grant under this
section shall return to the Secretary of Agriculture any unused portion of such
grant at the end of the two-year period beginning on the date the grant was
awarded, together with any earnings on such unused portion.</text>
</subparagraph><subparagraph id="H30B4E84D76394647A6DC9458357D610B"><enum>(B)</enum><header>Amounts
returned</header><text>The Secretary of Agriculture shall return to the general
fund of the Treasury of the United States any amounts returned pursuant to
subparagraph (A).</text>
</subparagraph></paragraph></subsection><subsection id="H5C20115EEE6E4D0B91E4431D4B1E4222"><enum>(d)</enum><header>Use of
grants</header>
<paragraph id="H4A4CE7E63D3041D698C58EB307DAC239"><enum>(1)</enum><header>In
general</header><text>An eligible entity that receives a grant under this
section may only use grant funds for the following purposes:</text>
<subparagraph id="H37B9FF0BE5D04391B011EA0353425EEF"><enum>(A)</enum><text>To develop and
implement an urban agricultural workforce training program in accordance with
paragraph (2).</text>
</subparagraph><subparagraph id="H370704FA07074D1A9836558D2CD0B88A"><enum>(B)</enum><text>To provide funding
to trainees to defray the start-up costs for new urban agricultural businesses
of such trainees.</text>
</subparagraph></paragraph><paragraph id="H3438EED19CEF48408A1BD5D764679839"><enum>(2)</enum><header>Urban
agricultural activities</header><text>An urban agricultural workforce training
program developed and implemented by an eligible entity receiving a grant under
this section shall provide training for individuals to carry out any of the
following urban agricultural activities:</text>
<subparagraph id="HF0821E471F414201A94A346D20D91DE0"><enum>(A)</enum><text display-inline="yes-display-inline">Designing, constructing, and maintaining
biocellar structures.</text>
</subparagraph><subparagraph id="HB9AA2BADC71E40EE8E628791FA37BEF7"><enum>(B)</enum><text>Community
gardening.</text>
</subparagraph><subparagraph id="H4BE49D28929B4A35BC30C1849D081055"><enum>(C)</enum><text>Urban
farming.</text>
</subparagraph><subparagraph id="H5CE1D8E1C5214A66A5B3D3258B42344D"><enum>(D)</enum><text>Viticulture.</text>
</subparagraph><subparagraph id="H60A249987B044DF49DB4047D750949C9"><enum>(E)</enum><text>Agricultural
education.</text>
</subparagraph><subparagraph id="H99046E790E2A49B5AEF80C4F3EF5B117"><enum>(F)</enum><text>Rehabilitating
land for agricultural use.</text>
</subparagraph><subparagraph id="H89901C5E34844621B5BD4B7EBA713B46"><enum>(G)</enum><text>Developing
farmers’ markets.</text>
</subparagraph><subparagraph id="H4BB30A0681F64BA4A42D120375E3C013"><enum>(H)</enum><text>Transporting
fresh, local food.</text>
</subparagraph><subparagraph id="HEFB48B9E8C8942F5BC0555BA126FDDE7"><enum>(I)</enum><text display-inline="yes-display-inline">Developing mobile pantries for fresh
produce.</text>
</subparagraph></paragraph><paragraph id="HF834EEFC786F4C209C54598C23006A19"><enum>(3)</enum><header>Limitation</header><text>Not
less than 30 percent of the amount received through a grant awarded under this
section shall be used to provide the funding described in paragraph
(1)(B).</text>
</paragraph></subsection><subsection id="H560637DC82C64899AE86AF43FE607AD8"><enum>(e)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph id="H852E8B0AE6FD4953949817BC51D5A081"><enum>(1)</enum><header>Eligible
entity</header><text>The term <quote>eligible entity</quote> means—</text>
<subparagraph id="H2B746571318A41EBBA7B47844448F135"><enum>(A)</enum><text>a unit of general
local government located in an urban area (as defined by the Bureau of the
Census);</text>
</subparagraph><subparagraph id="HBC55B77539AE488387EC74C2504FA893"><enum>(B)</enum><text>a tribal
government;</text>
</subparagraph><subparagraph id="H9D6F2F6C731E4E2892CB76DC3B1724C9"><enum>(C)</enum><text>an accredited
college or university; or</text>
</subparagraph><subparagraph id="H51E1A1EC9AE14C97A234209D37E049E3"><enum>(D)</enum><text>a nonprofit
organization.</text>
</subparagraph></paragraph><paragraph id="H5933A851238D497AAB5DE86F655EFCBD"><enum>(2)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> includes, in
addition to the several States of the United States, the Commonwealth of Puerto
Rico, the District of Columbia, the Virgin Islands, Guam, American Samoa, and
the Commonwealth of the Northern Mariana Islands.</text>
</paragraph><paragraph id="HAB7F8C2B7E584629BBB19C1B58A8B60B"><enum>(3)</enum><header>Unit of general
local government</header><text display-inline="yes-display-inline">The term
<quote>unit of general local government</quote> means any city, county, town,
township, parish, village, or other general purpose political subdivision of a
State.</text>
</paragraph></subsection><subsection id="HB42B9C1E10434812A6BB2E74B7D96C17"><enum>(f)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There are
authorized to be appropriated to carry out this section $5,000,000 for each of
fiscal years 2013 through 2017.</text>
</subsection></section><section id="HB8F556829F214FEC91D37865D0AB7561" section-type="subsequent-section"><enum>306.</enum><header>Urban agriculture
development grants program</header>
<subsection id="H81E916FC9E6C40D8B764CBA2891996C0"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary of
Agriculture may make grants to persons to cover the cost of establishing or
operating a farm, garden, or aquacultural or other facility, in an urban area,
for the production of an agricultural or aquacultural product or the raising of
livestock for sale exclusively in the urban area.</text>
</subsection><subsection id="HB6A0153C0D844963853A1E36C700DAAA"><enum>(b)</enum><header>Limitations on
use of grant</header><text display-inline="yes-display-inline">A person to whom
a grant is made under subsection (a) shall not use the grant for any expense
other than for community educational programming, transportation, equipment,
utilities, construction, rehabilitation of property, feed, or operating
expenses (excluding salaries).</text>
</subsection><subsection id="H6E7648569D494FBA912C1E1E9848E7D6"><enum>(c)</enum><header>Limitations on
authorization of appropriations</header><text>For grants under subsection (a),
there are authorized to be appropriated to the Secretary of Agriculture not
more than $8,000,000,000 for each fiscal year.</text>
</subsection></section><section id="H25F955DCA8F944999D8C5D1D61940932" section-type="subsequent-section"><enum>307.</enum><header>Clean and safe
drinking water for urban areas and waterways</header><text display-inline="no-display-inline">Section 1234(c)(3)(B) of the Food Security
Act of 1985 (16 U.S.C. 3834(c)(3)(B)) is amended by inserting <quote>, or the
extent to which water quality in a metropolitan statistical area (as defined by
the Director of the Office of Management and Budget) downstream from the land
that is the subject of the contract offer may be improved</quote> before the
period at the end.</text>
</section><section id="H8DC5AACF6C1D4CB58428C32FB61DDA95"><enum>308.</enum><header>Extension of
assistance to socially disadvantaged urban farmers and ranchers</header>
<subsection id="H0062521BCC6E472D879D496197C0F565"><enum>(a)</enum><header>Eligible
land</header><text display-inline="yes-display-inline">Section 1240A(1)(B)(vi)
of the Food Security Act of 1985 (16 U.S.C. 3839aa–1(1)(B)(vi)) is amended by
inserting <quote>urban agricultural land,</quote> before <quote>and
agricultural land</quote>.</text>
</subsection><subsection id="H53056021C4024DAA91749BB9EA2B6070"><enum>(b)</enum><header>Increased
payments for certain producers</header><text>Section 1240B(d)(4)(A) of the Food
Security Act of 1985 (16 U.S.C. 3839aa–2(d)(4)(A)) is amended by inserting
<quote>, including a socially disadvantaged farmer engaged in farming in an
urban area of 50,000 or more people,</quote> before <quote>or a beginning
farmer or rancher,</quote>.</text>
</subsection><subsection id="H7EA2726195D04B2CA3A59FF0FF7A17EB"><enum>(c)</enum><header>Assistance to
certain farmers or ranchers for conservation access</header><text>Section
1241(g)(1)(B) of the Food Security Act of 1985 (16 U.S.C. 3841(g)(1)(B)) is
amended by inserting <quote>, including socially disadvantaged farmers engaged
in farming in an urban area of 50,000 or more people</quote> before the period
at the end.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="H25FA825FCD5444D6A19E82B7A65A609F" section-type="subsequent-section"><enum>309.</enum><header display-inline="yes-display-inline">Urban entrepreneur and microenterprise
assistance program</header><text display-inline="no-display-inline">Subtitle D
of the Consolidated Farm and Rural Development Act is amended by inserting
after section 365 (7 U.S.C. 2008) the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="HD10D93FC7208428A9163CD4DA167FAC7"><enum>(1)</enum><header display-inline="yes-display-inline">Economically disadvantaged
microentrepreneur</header><text display-inline="yes-display-inline">The term
<term>economically disadvantaged microentrepreneur</term> means an owner,
majority owner, or developer of a microenterprise that has the ability to
compete in the private sector but has been impaired because of diminished
capital and credit opportunities, as compared to other microentrepreneurs in
the industry.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8AED94DA7C2841DFADEC09A479590DE3"><enum>(2)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the
meaning given the term in section 4 of the Indian Self-Determination and
Education Assistance Act (25 U.S.C. 450b).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9508A88F55C64641992BB5754A14A6F9"><enum>(3)</enum><header display-inline="yes-display-inline">Intermediary</header><text display-inline="yes-display-inline">The term <term>intermediary</term> means a
private, nonprofit entity that provides assistance—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HE8AF677B21514890914851F3A5B77B62"><enum>(A)</enum><text display-inline="yes-display-inline">to a microenterprise development
organization; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3A406059780A49A184AEB65ABAC2E66B"><enum>(B)</enum><text display-inline="yes-display-inline">for a microenterprise development
program.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9C6AB3B2BF114DC6B12EC2CA636EE5EA"><enum>(4)</enum><header display-inline="yes-display-inline">Low-income individual</header><text display-inline="yes-display-inline">The term low-income individual means an
individual with an income (adjusted for family size) of not more than the
greatest of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HF481DE3D88284C4998483856BFA43BCC"><enum>(A)</enum><text display-inline="yes-display-inline">80 percent of median income of an
area;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDAA7515530CA442DA1D9DE5CE60E220A"><enum>(B)</enum><text display-inline="yes-display-inline">80 percent of the statewide
non-metropolitan area median income; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H266121AA704C4A1B8DAEECA3C83773E1"><enum>(C)</enum><text display-inline="yes-display-inline">80 percent of the national median
income.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEA2B13595BC34103870BE5C2241EA418"><enum>(5)</enum><header display-inline="yes-display-inline">Microcredit</header><text display-inline="yes-display-inline">The term <term>microcredit</term> means a
business loan or loan guarantee of not more than $50,000 that is provided to an
urban entrepreneur.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBA5092D6FD7B4BFDBC1045BEF49DCE88"><enum>(6)</enum><header display-inline="yes-display-inline">Microenterprise</header><text display-inline="yes-display-inline">The term <term>microenterprise</term>
means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HDB2DA41E50684AE5A527F1126807B6C9"><enum>(A)</enum><text display-inline="yes-display-inline">a sole proprietorship; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F0307D08D6B40C797F87C93F28E29C9"><enum>(B)</enum><text display-inline="yes-display-inline">a business entity with not more than 10
full-time-equivalent employees.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB338FBC4233247C89D6EB0BCEEE50D70"><enum>(7)</enum><header display-inline="yes-display-inline">Microenterprise development
organization</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HCB84CB36DFF04AEE9D04FE5641CF44AC"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>microenterprise development
organization</term> means a private, nonprofit entity that—</text>
<clause commented="no" display-inline="no-display-inline" id="H3616648E5AEB487EA88C55F187886E6C"><enum>(i)</enum><text display-inline="yes-display-inline">provides training and technical assistance
to urban entrepreneurs; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H5E54B4B343FE49708F859446D1515DFE"><enum>(ii)</enum><text display-inline="yes-display-inline">facilitates access to capital or another
service described in subsection (b) for urban entrepreneurs.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H37AC4A522FFD46A1946F2D0124C5EC7D"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>microenterprise development
organization</term> includes an organization described in subparagraph (A) with
a demonstrated record of delivering services to economically disadvantaged
microentrepreneurs, or an effective plan to develop a program to deliver
microenterprise services to urban entrepreneurs effectively, as determined by
the Secretary.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49E538FC3A7B4DD5B6ADD0C71EFAD4B5"><enum>(8)</enum><header display-inline="yes-display-inline">Microenterprise development
program</header><text display-inline="yes-display-inline">The term
<term>microenterprise development organization</term> means a program
administered by an organization serving an urban area.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E0ABFE1677C4B698D72B5F1B0297A4F"><enum>(9)</enum><header display-inline="yes-display-inline">Microentrepreneur</header><text display-inline="yes-display-inline">The term <term>microentrepreneur</term>
means the owner, operator, or developer of a microenterprise.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2D40DFAA9E354B1EB3EF13B115AB11CD"><enum>(10)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
urban entrepreneur and microenterprise program established under subsection
(b)(1).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H81E80ABAAEC241C69DFDB4915C81D15D"><enum>(11)</enum><header display-inline="yes-display-inline">Qualified organization</header><text display-inline="yes-display-inline">The term <term>qualified
organization</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HD3511481EECC4CE59507398E4DAEB3A2"><enum>(A)</enum><text display-inline="yes-display-inline">a microenterprise development organization
or microenterprise development program that has a demonstrated record of
delivering microenterprise services to urban entrepreneurs, or an effective
plan to develop a program to deliver microenterprise services to urban
entrepreneurs effectively, as determined by the Secretary;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF5754AC080294495B870BFAB7DA28621"><enum>(B)</enum><text display-inline="yes-display-inline">an intermediary that has a demonstrated
record of delivery assistance to microenterprise development organizations or
microenterprise development programs;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8B3A074BF89F4E67AA03AC16F468D628"><enum>(C)</enum><text display-inline="yes-display-inline">a microenterprise development organization
or microenterprise development program that serves urban entrepreneurs;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBAC91BD5017E42C4A6DD7654A4A35DD3"><enum>(D)</enum><text display-inline="yes-display-inline">an Indian tribe, the tribal government of
which certifies to the Secretary that no microenterprise development
organization or microenterprise development program exists under the
jurisdiction of the Indian tribe;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H29C6B74BBDB24D3E9550752BD0DE8BFB"><enum>(E)</enum><text display-inline="yes-display-inline">a group of 2 or more organizations or
Indian tribes described in any of subparagraphs (A) through (D) that agree to
act jointly as a qualified organization under this section; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H02785A42FD7844CAA5705280CE421E98"><enum>(F)</enum><text display-inline="yes-display-inline">for purposes of subsection (b), a public
college or university.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB0E41642724E4FFA98DFE8C4C510AB11"><enum>(12)</enum><header display-inline="yes-display-inline">Urban area</header><text display-inline="yes-display-inline">The term <term>urban area</term> means any
community that is urban in character and has—</text>
<subparagraph id="HA64430B89082456A8D4C430433964122"><enum>(A)</enum><text>a population of
more than 25,000 individuals; or</text>
</subparagraph><subparagraph id="H5813430504A7443A87B543E5E15CC791"><enum>(B)</enum><text>an average
population density of at least 1,000 individuals per square mile.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2E0D3AE3417C46F1826C6DF298C5087B"><enum>(13)</enum><header display-inline="yes-display-inline">Urban capacity building
service</header><text display-inline="yes-display-inline">The term <term>urban
capacity building service</term> means a service provided to an organization
that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H3090965C41F942B4BAF3CC2C1EBFB140"><enum>(A)</enum><text display-inline="yes-display-inline">is, or is in the process of becoming, a
microenterprise development organization or microenterprise development
program; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57B76DF580784E238AED677407759ED5"><enum>(B)</enum><text display-inline="yes-display-inline">serves urban areas for the purpose of
enhancing the ability of the organization to provide training, technical
assistance, and other related services to urban entrepreneurs.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2F8A706E65EE4309893EFFB7AC016531"><enum>(14)</enum><header display-inline="yes-display-inline">Urban entrepreneur</header><text display-inline="yes-display-inline">The term <term>urban entrepreneur</term>
means a microentrepreneur, or prospective microentrepreneur—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HD4BB338D443C4333BAEA83C2092CA935"><enum>(A)</enum><text display-inline="yes-display-inline">the principal place of business of which is
in a urban area; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD67855333CB840C8806AFC13CFFC08E2"><enum>(B)</enum><text display-inline="yes-display-inline">that is unable to obtain sufficient
training, technical assistance, or microcredit elsewhere, as determined by the
Secretary.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDB024EB4239A4249B7C932EEF3E7408F"><enum>(15)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
Secretary of Agriculture, acting through the Rural Business-Cooperative
Service.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41BFB22117504285B4E5F25FEB569AFA"><enum>(16)</enum><header display-inline="yes-display-inline">Tribal government</header><text display-inline="yes-display-inline">The term <term>tribal government</term>
means the governing body of an Indian tribe.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB15BC1A3236A40DF9D6090AB4AAB2460"><enum>(b)</enum><header display-inline="yes-display-inline">Urban Entrepreneurship and Microenterprise
Program</header>
<paragraph commented="no" display-inline="no-display-inline" id="H0BF2BC9E0E5C4F21863A507FF649BF00"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish an urban
entrepreneurship and microenterprise program.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H52E95FF529A14800B79AC88D8EA7B9CA"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the program shall be to
provide low-income individuals and moderate-income individuals with—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HC6E3BB7127CC4031AA537FEEAD61754E"><enum>(A)</enum><text display-inline="yes-display-inline">the skills necessary to establish new small
businesses in urban areas; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD58F9A29A88E4560B79264BBFB257158"><enum>(B)</enum><text display-inline="yes-display-inline">continuing technical and financial
assistance as individuals and business starting or operating small
businesses.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2289EA7571D8439695578B9FD64056A7"><enum>(3)</enum><header display-inline="yes-display-inline">Grants</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H0CBC3AEF0D8A43D4918F18666F806B80"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may make a grant under the
program to a qualified organization—</text>
<clause commented="no" display-inline="no-display-inline" id="HB879741B9ED1451F953471803366B3A8"><enum>(i)</enum><text display-inline="yes-display-inline">to provide training, operational support,
or an urban capacity building service to a qualified organization to assist the
qualified organization in developing microenterprise training, technical
assistance, market development assistance, and other related services,
primarily for business with 5 or fewer full-time-equivalent employees;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H9F8DC631FFEF45E6A369F13BCA4D66D8"><enum>(ii)</enum><text display-inline="yes-display-inline">to assist in researching and developing the
best practices in delivering training, technical assistance, and microcredit
tourban entrepreneurs; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="HCEC8E405A4274781BDD13E744F4060A9"><enum>(iii)</enum><text display-inline="yes-display-inline">to carry out such other projects and
activities as the Secretary determines to be consistent with the purposes of
this section.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9B458CC1B826447FA79C4583E9D6DF3E"><enum>(B)</enum><header display-inline="yes-display-inline">Subgrants</header><text display-inline="yes-display-inline">Subject to such regulations as the
Secretary may promulgate, a qualified organization that receives a grant under
this paragraph may use the grant to provide assistance to other qualified
organizations, such as small or emerging qualified organizations.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1A80CD46CC83441DAD4E42C30B6049A2"><enum>(C)</enum><header display-inline="yes-display-inline">Diversity</header><text display-inline="yes-display-inline">In making grants under this paragraph, the
Secretary shall ensure, to the maximum extent practicable, that grant
recipients include qualified organizations—</text>
<clause commented="no" display-inline="no-display-inline" id="H5639918380FE49E584426ACFB679DC3C"><enum>(i)</enum><text display-inline="yes-display-inline">of varying sizes; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H2C4CC74434EC4226A8F3C4ACB9701D95"><enum>(ii)</enum><text display-inline="yes-display-inline">that serve racially- and ethnically-diverse
populations.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F03F9BA6D6A430FB537625AAE58B101"><enum>(D)</enum><header display-inline="yes-display-inline">Cost sharing</header>
<clause commented="no" display-inline="no-display-inline" id="H32CEEA7D1E4A45948DEAF02469DCC6E0"><enum>(i)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of a project
carried out using funds from a grant made under this paragraph shall be 75
percent.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H5EEC03CD63674E20B9A5394DBDABBF7C"><enum>(ii)</enum><header display-inline="yes-display-inline">Form of non-Federal share</header><text display-inline="yes-display-inline">The non-Federal share of the cost of a
project described in clause (i) may be provided—</text>
<subclause commented="no" display-inline="no-display-inline" id="HE67554ECFC774153BFDB79AC80CC9B40"><enum>(I)</enum><text display-inline="yes-display-inline">in cash (including through fees, grants
(including community development block grants), and gifts); or</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="H5B4538A137EB4A1B8A85333CB0D8CF40"><enum>(II)</enum><text display-inline="yes-display-inline">in kind.</text>
</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H00C27901825C42AEBA19683EC1BA7794"><enum>(4)</enum><header display-inline="yes-display-inline">Urban microloan program</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H94B04928B6644F0F956D776CFD98EC85"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">In carrying out the program, the Secretary
may carry out an urban microloan program.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5352372E2C3C4437994DDDE01BB1BE43"><enum>(B)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the urban microloan program
shall be to provide technical and financial assistance to sole proprietorships
and small businesses located in urban areas with a particular focus on those
businesses with 5 or fewer full-time equivalent employees.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0E1F9837A5554FDCB0D50F023B3D842F"><enum>(C)</enum><header display-inline="yes-display-inline">Authority of secretary</header><text display-inline="yes-display-inline">In carrying out the urban microloan
program, the Secretary may—</text>
<clause commented="no" display-inline="no-display-inline" id="H2757C355DBBB48888B0357A2B71CDA9F"><enum>(i)</enum><text display-inline="yes-display-inline">make direct loans to qualified
organizations for the purpose of making short-term, fixed interest rate
microloans to startup, newly established, and growing urban microbusiness
concerns; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H7E6BFFE414F1419D99642C2C966B9FD3"><enum>(ii)</enum><text display-inline="yes-display-inline">in conjunction with those loans, provide
grants in accordance with subparagraph (E) to those qualified organizations for
the purpose of providing intensive marketing, management, and technical
assistance to small business concerns that are borrowers under this
paragraph.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC7061D57D07A46C48C4C3707A7B95B8C"><enum>(D)</enum><header display-inline="yes-display-inline">Loan duration; interest rates;
conditions</header>
<clause commented="no" display-inline="no-display-inline" id="HC8F9226699084CE3B4506732D8FBC18B"><enum>(i)</enum><header display-inline="yes-display-inline">Loan duration</header><text display-inline="yes-display-inline">A loan made by the Secretary under this
paragraph shall be for a term of 20 years.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H98D9945254054A65AD3F96EA5D606FE2"><enum>(ii)</enum><header display-inline="yes-display-inline">Applicable interest rates</header><text display-inline="yes-display-inline">A loan made by the Secretary under this
paragraph to a qualified organization shall bear an annual interest rate of at
least 1 percent.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H7D8913676A9C4B3CA2483ABD98929CE3"><enum>(iii)</enum><header display-inline="yes-display-inline">Deferral of interest and
principal</header><text display-inline="yes-display-inline">The Secretary may
permit the deferral of payments, for principal and interest, on a loan made
under this paragraph for a period of not more than 2 years, beginning on the
date on which the loan was made.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H88355B7D2DA44AC698B46AF81DE2032E"><enum>(E)</enum><header display-inline="yes-display-inline">Grant amounts</header>
<clause commented="no" display-inline="no-display-inline" id="H1C8AC64A661E4481A2C635F39291A206"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this
section, each qualified organization that receives a loan under this paragraph
shall be eligible to receive a grant to provide marketing, management, and
technical assistance to small business concerns that are borrowers or potential
borrowers under this subsection.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H76A50E2DD1774DBDB435255D8A59CC31"><enum>(ii)</enum><header display-inline="yes-display-inline">Maximum amount of grant for microenterprise
development organizations</header><text display-inline="yes-display-inline">Each microenterprise development
organization that receives a loan under this paragraph shall receive an annual
grant in an amount equal to not more than 25 percent of the total outstanding
balance of loans made to the microenterprise development organization under
this paragraph, as of the date of provision of the grant.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H2D639E70230047C49E0AA9C055C806FF"><enum>(iii)</enum><header display-inline="yes-display-inline">Matching Requirement</header>
<subclause commented="no" display-inline="no-display-inline" id="HC073A12222EA479784F9EBB3CB2E10AD"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As a condition of any grant made to a
qualified organization under this subparagraph, the Secretary shall require the
qualified organization to match not less than 15 percent of the total amount of
the grant.</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="HC5DB4590FD19435F86D29222E88FD2BE"><enum>(II)</enum><header display-inline="yes-display-inline">Sources</header><text display-inline="yes-display-inline">In addition to cash from non-Federal
sources, a matching share provided by the qualified organization may include
indirect costs or in-kind contributions funded under non-Federal
programs.</text>
</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H50F34B68CDB24177AF8DA7504F826C56"><enum>(c)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">Not more than 10 percent of assistance
received by a qualified organization for a fiscal year under this section may
be used to pay administrative expenses.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="H43CA8FD1701A423BA98156BF48298AC0"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header>
<paragraph commented="no" display-inline="no-display-inline" id="HBC7909713D1A4861ACAD1366A48BBA50"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
enactment of this section, and on October 1, 2012, and each October 1
thereafter through October 1, 2016, out of any funds in the Treasury not
otherwise appropriated, the Secretary of the Treasury shall transfer to the
Secretary to carry out this section $50,000,000, to remain available until
expended.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA1E8D37D076D4AD98711649A2931C54B"><enum>(2)</enum><header display-inline="yes-display-inline">Allocation of funds</header><text display-inline="yes-display-inline">Of the amount made available by paragraph
(1) for each fiscal year—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HAE92C1AD69464A61833D5BD1154C74E0"><enum>(A)</enum><text display-inline="yes-display-inline">not less than $30,000,000 shall be
available for use in carrying out subsection (b)(3); and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H45803862BA6240E2BDED99FCCCEE4082"><enum>(B)</enum><text display-inline="yes-display-inline">not less than $20,000,000 shall be
available for use in carrying out subsection (b)(4), of which not more than
$7,000,000 shall be used to support direct loans.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4108B4532DED4FC1A45783ED833327EB"><enum>(C)</enum><header display-inline="yes-display-inline">Receipt and acceptance</header><text display-inline="yes-display-inline">The Secretary shall be entitled to receive,
shall accept, and shall use to carry out this section the funds transferred
under paragraph (1), without further
appropriation.</text>
</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H25FE5741F7B94C7C9565C36CF9969129"><enum>310.</enum><header>Local farm
business and market garden competitive loan program</header>
<subsection id="HD34B896809AF46DE841698FE114573E4"><enum>(a)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph id="H7EFF332D1DF346439C6CAE01DA802802"><enum>(1)</enum><header>Agricultural
commodity</header><text>The term <term>agricultural commodity</term> has the
meaning given the term in section 102 of the Agricultural Trade Act of 1978 (7
U.S.C. 5602).</text>
</paragraph><paragraph id="H3548CEE47FCC453793D78F8A84E0550C"><enum>(2)</enum><header>Eligible lending
entity</header><text>The term <term>eligible lending entity</term> means a
government agency, nonprofit organization, or any other entity that the
Secretary designates to finance and facilitate the development of a local farm
business project or market garden project.</text>
</paragraph><paragraph id="H19FCC068D3644F18B85371C735558916"><enum>(3)</enum><header>Eligible
producer</header><text>The term <term>eligible producer</term> means an
individual or group of individuals who carry out a local farm business project
or market garden project.</text>
</paragraph><paragraph id="HBD6E7DB37CBF42469ED5F425CF730C60"><enum>(4)</enum><header>Food
desert</header><text display-inline="yes-display-inline">The term <term>food
desert</term> has the meaning given the term in section 7527(a) of the Food,
Conservation, and Energy Act of 2008 (Public Law 110–246; 122 Stat.
2039).</text>
</paragraph><paragraph id="HE51DA53F8B114B73A3D4BE8CE8780F84"><enum>(5)</enum><header>Local farm
business project</header><text>The term <term>local farm business
project</term> means a project on a farm or ranch that—</text>
<subparagraph id="H9D4786F785D84394AB44D58320592672"><enum>(A)</enum><text>is for the
production of an agricultural commodity for local markets in the local service
area; and</text>
</subparagraph><subparagraph id="H4E57B53F87214CC388E05036D171307F"><enum>(B)</enum><text>is located on 1 or
more property lots, the cumulative acreage of which shall be more than 1
acre.</text>
</subparagraph></paragraph><paragraph id="HCD7230DF41F843798A5EBE8CF9FC39BD"><enum>(6)</enum><header>Local service
area</header><text>The term <term>local service area</term> means an area
consisting of a certain mile radius (as determined by the Secretary) from the
physical location of production by an eligible local farm business or market
garden project.</text>
</paragraph><paragraph id="H3F7D98F0D97942C2A0CF7335BE7BA2D4"><enum>(7)</enum><header>Market garden
project</header><text>The term <term>market garden project</term> means a
project that—</text>
<subparagraph id="H9099F232B39D4A16B8AA6EA55E63DE3B"><enum>(A)</enum><text>is for the
production of an agricultural commodity for local markets in the local service
area; and</text>
</subparagraph><subparagraph id="H8B82AEC5ED214FE59D66BDC6D5605B2A"><enum>(B)</enum><text>is located on 1 or
more property lots (regardless of the population density of the area in which
the property lots are located), the cumulative acreage of which shall be more
than ¼ acre.</text>
</subparagraph></paragraph><paragraph id="H60B3715C5E8149B8974119EC516E055A"><enum>(8)</enum><header>Revolving loan
fund</header><text>The term <term>revolving loan fund</term> means a revolving
loan fund established by an eligible lending entity as described in subsection
(c).</text>
</paragraph><paragraph id="HAFFF5726DAE240748EB03D396A0F3E22"><enum>(9)</enum><header>Secretary</header><text>The
term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C9495AD909C46C991A955694ACE2582"><enum>(10)</enum><header>Socially
disadvantaged farmer or rancher</header><text>The term <term>socially
disadvantaged farmer or rancher</term> has the meaning given the term in
section 355(e) of the Consolidated Farm and Rural Development Act (7 U.S.C.
2003(e)).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H991D7A898D464ACB8F1FC5CC5400CF3F"><enum>(11)</enum><header>Specialty
crop</header><text>The term <term>specialty crop</term> has the meaning given
the term in section 3 of the Specialty Crops Competitiveness Act of 2004 (7
U.S.C. 1621 note; Public Law 108–465).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCF86A5361186485EBA1F427CA511E2CF"><enum>(12)</enum><header>Sustainable
agriculture</header><text>The term <term>sustainable agriculture</term> has the
meaning given the term in section 1404 of the National Agricultural Research,
Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3103).</text>
</paragraph></subsection><subsection id="H64E0E8E7F5234511B87AF24245F7FF8F"><enum>(b)</enum><header>Competitive loan
program for eligible lending entities</header>
<paragraph id="H67DE96CD123C43C58B86013FE26CB849"><enum>(1)</enum><header>In
general</header><text>To support new entrepreneurship and job creation, the
Secretary shall establish a local farm business and market garden competitive
loan program under which the Secretary shall make available to eligible lending
entities loans to develop revolving loan funds to assist—</text>
<subparagraph id="H08FB99729C6E4473A09DF2F933533822"><enum>(A)</enum><text>eligible producers
in establishing local farm business projects or market garden projects that
will locally produce fresh foods; and</text>
</subparagraph><subparagraph id="HFEC14A4FA1FA4A4EB73D31687C148AA9"><enum>(B)</enum><text>local farm
business projects and market garden projects to create local employment
opportunities by—</text>
<clause id="HE386437FCB004C6782FEB2CBB464FD68"><enum>(i)</enum><text>increasing farm
and garden income by connecting producers and consumers;</text>
</clause><clause id="H965FB6793CCF44BEB47ADE637CAC6D16"><enum>(ii)</enum><text>creating more
reliable local food systems;</text>
</clause><clause id="HF33797B64B3D4C00B9333E343058F9B8"><enum>(iii)</enum><text>diversifying
food production;</text>
</clause><clause id="HBC0428D99D69433EAEFAAF30A90C7B6B"><enum>(iv)</enum><text>increasing
consumer access to fresh, local healthful foods produced by local farms,
ranches, and market gardens in urban, suburban, or rural areas;</text>
</clause><clause id="HEC8B87F38A4A4439B523000DD8FF0A0A"><enum>(v)</enum><text>supporting
nutrition education that incorporates participation of school children in farm-
and garden-based agricultural education activities; and</text>
</clause><clause id="HF1F5CB6EF1D04726BA5B8B48151EC229"><enum>(vi)</enum><text>preserving
farmland.</text>
</clause></subparagraph></paragraph><paragraph id="HC7727AEA812E40B9A657F4581FAE0D21"><enum>(2)</enum><header>Eligibility</header><text>To
be eligible to receive a loan under the program established under paragraph
(1), an eligible lending entity shall submit to the Secretary an application at
such time, in such form, and containing such information as the Secretary may
require.</text>
</paragraph><paragraph id="H69793A2543EC437499EF810B1CCAC694"><enum>(3)</enum><header>Selection
criteria</header>
<subparagraph id="H0685C11DFA69440F95BD8FEC8061A7E8"><enum>(A)</enum><header>Approval</header><text>Not
later than 1 year after the date of enactment of this section and in accordance
with this paragraph, the Secretary shall, on a competitive basis, begin
assessing and approving such applications received under paragraph (2) as the
Secretary considers appropriate.</text>
</subparagraph><subparagraph id="H9E1E76FAD34F412294F6F4C3FA6A77DE"><enum>(B)</enum><header>Criteria</header><text>In
considering a loan application received under paragraph (2), the Secretary
shall—</text>
<clause id="HFE04BFFBB07C4AB2BBACC6C0F93ACBA9"><enum>(i)</enum><text>evaluate the
extent to which the application demonstrates the ability of the eligible
lending entity—</text>
<subclause id="H1142B8C3A26E4B40B6D5F625B16F6201"><enum>(I)</enum><text>to manage, market,
and administer a revolving loan fund;</text>
</subclause><subclause id="H6914634138C54B51862AD5CB1DEDD5F7"><enum>(II)</enum><text>to assist local
eligible producers to successfully meet local service area
opportunities;</text>
</subclause><subclause id="H3A823A8E7EB741EAAA5FEC528D388446"><enum>(III)</enum><text>to work with
partners to provide technical support to eligible local farm business projects
and market garden projects;</text>
</subclause><subclause id="HC6AF758B5DE54F25B06A6C98A131EFC9"><enum>(IV)</enum><text>to recruit,
educate, and assist local producers to advance local farming and ranching
opportunities that meet local service area needs; and</text>
</subclause><subclause id="HC1ACD07B242042DE8E2AD418661205CA"><enum>(V)</enum><text>subject to
paragraph (5), to provide matching funds in the form of cash or in-kind
services to properly implement and manage the revolving loan fund;</text>
</subclause></clause><clause id="HE57044C356B647AEB47F66840E64A26D"><enum>(ii)</enum><text>assess—</text>
<subclause id="H58609A68129D450FA81C5F7A9F640B91"><enum>(I)</enum><text>the number and
type of local farm business projects and market garden projects to be affected
by local farm business project loan funding;</text>
</subclause><subclause id="H38CCA8D0680445EAB7E43AA391878F6D"><enum>(II)</enum><text>the number of new
jobs and eligible local farm business projects and market garden projects to be
created by the revolving loan fund;</text>
</subclause><subclause id="H013DAE6629BF4CF799EB4775CC5C5774"><enum>(III)</enum><text>the ability of
an eligible local farm business project or market garden project—</text>
<item id="HFB6DB1115ADE4CB6BA369DDBA61B3726"><enum>(aa)</enum><text>to
preserve farmland through economically and environmentally sustainable
agriculture practices (as determined by the Secretary); and</text>
</item><item id="HC4C3410382DD475A91A63B7548917B9C"><enum>(bb)</enum><text>to
serve schools and institutions with a high proportion of students who are
eligible for free or reduced price lunches under the Richard B. Russell
National School Lunch Act (42 U.S.C. 1751 et seq.);</text>
</item></subclause><subclause id="HD58E63BE410646D797A2A327E21D8027"><enum>(IV)</enum><text>the degree to
which an eligible local farm business project or market garden project—</text>
<item id="H93C82F6A22B048F4BB44943884C3863D"><enum>(aa)</enum><text>incorporates
experiential nutrition education;</text>
</item><item id="H240BEAE4A83E4CA882B06A9699AE0AD2"><enum>(bb)</enum><text>demonstrates the
potential positive economic impact for the local economy;</text>
</item><item id="HCD871C7E4E66419387338A24F070A41E"><enum>(cc)</enum><text>demonstrates
environmentally sustainable agriculture practices; and</text>
</item><item id="HA9231564885A4341BDC225C8D6798E70"><enum>(dd)</enum><text>demonstrates a
collaboration between schools or educational institutions, nongovernmental
organizations, producer groups, and other community and business partners;
and</text>
</item></subclause><subclause id="H32F4267BF89E4A178D28E90C0A8AB476"><enum>(V)</enum><text>the market
opportunity for eligible local farm business projects or market garden projects
to sell products in the local community; and</text>
</subclause></clause><clause id="H2A200EA5A03442099A15310A37907BF8"><enum>(iii)</enum><text>consider any
other factors that the Secretary determines to be appropriate.</text>
</clause></subparagraph><subparagraph id="HF8725DD8752A4450A9C6B3CE1309D763"><enum>(C)</enum><header>Regional
balance</header><text>To the maximum extent practicable, in awarding loans
under this section, the Secretary shall ensure that loan recipients—</text>
<clause id="H22093868530246B0B6F2D339852DC028"><enum>(i)</enum><text>are
geographically diverse;</text>
</clause><clause id="H5C60740C2B12483EB74BA4690C1F57A9"><enum>(ii)</enum><text>serve clients
targeted by the loan program, including socially disadvantaged farmers or
ranchers;</text>
</clause><clause id="HF9D1B1537F09462BA1C89AC245198757"><enum>(iii)</enum><text>serve clients
located in areas with a variety of population densities, including rural,
suburban, urban, and tribal areas; and</text>
</clause><clause id="H20988028554E422FB54ABE5C73A6A255"><enum>(iv)</enum><text>identify and
serve food deserts within the local service area.</text>
</clause></subparagraph><subparagraph id="H0CE5508A9E024022B4CBC5AAAD492781"><enum>(D)</enum><header>Priority</header>
<clause id="H0228AC7FCFCF4DC180608CDC1C327726"><enum>(i)</enum><header>In
general</header><text>In considering loan applications received under paragraph
(2), the Secretary shall give priority to applications that demonstrate the
ability and willingness of the eligible lending entity—</text>
<subclause id="HF99E6C019B464AEAA5B2FD84D2528B4B"><enum>(I)</enum><text>to serve clients
targeted by the program, including, as appropriate, socially disadvantaged
farmers or ranchers;</text>
</subclause><subclause id="HC4E8137EFDED46238915199A0058726F"><enum>(II)</enum><text>to assist with
the financial management aspects of specialty crop farming and other types of
local agricultural projects; and</text>
</subclause><subclause id="H453B62AFBFCB44D080A3901B154C34E9"><enum>(III)</enum><text>to address the
nutritional needs of an underserved area, as determined in accordance with
clause (ii).</text>
</subclause></clause><clause id="H6C247CC509134530BB4A6FDEF5403DFB"><enum>(ii)</enum><header>Underserved
areas</header><text>In determining whether an area is an underserved area, the
Secretary shall consider—</text>
<subclause id="H0DC016E709B84048878EA8C9EB8E5AE2"><enum>(I)</enum><text>population
density;</text>
</subclause><subclause id="HAA6472F0A2CE4807B2B8154B255042DD"><enum>(II)</enum><text>below-average
supermarket density or sales;</text>
</subclause><subclause id="HC1B4A75EAD074808B42354AA9CC4F818"><enum>(III)</enum><text>the rate of
ownership of motor vehicles; and</text>
</subclause><subclause id="H05132BDAB1604A6EAD497578720D5F92"><enum>(IV)</enum><text>geographical or
physical barriers, such as highways, mountains, major parks, or bodies of
water.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="H92BC4F584CAB47EFABACD13F14F6F9C9"><enum>(4)</enum><header>Loan terms for
eligible lending entities</header>
<subparagraph id="H72A392BA0871410B8476756DE003B663"><enum>(A)</enum><header>In
general</header><text>For each fiscal year for which the Secretary makes a loan
to an eligible lending entity under this subsection, the loan shall—</text>
<clause id="H4089C16239AA479A84B94C3A072F405B"><enum>(i)</enum><text>be
in an amount that is not less than $200,000 and not more than $1,000,000;
and</text>
</clause><clause id="H29D4BD24EB0F4997B4074D1550334CDF"><enum>(ii)</enum><text>be
used by the eligible lending entity to establish a revolving loan fund to
provide loans for local farm business projects or market garden
projects.</text>
</clause></subparagraph><subparagraph id="H62280B301A2346D4956E88952561A1E8"><enum>(B)</enum><header>Term</header><text>The
term of a loan under this subsection shall not exceed 20 years from the date on
which the loan is finalized.</text>
</subparagraph><subparagraph id="HA5ABB10F0CE7467A93920278C55801B1"><enum>(C)</enum><header>Loan financing
terms</header><text>In making loans to eligible lending entities under this
subsection, the Secretary shall—</text>
<clause id="H9774285FA790462AB379FF53907F25AC"><enum>(i)</enum><text>set
the rate of interest at not more than 2 percent per year; and</text>
</clause><clause id="HEC89DBD1E6114F588E7BC3ACB799D184"><enum>(ii)</enum><text>ensure that no
payments are due on the loan during the first 2 years of the loan.</text>
</clause></subparagraph></paragraph><paragraph id="H1E6CF26EC0CF4F7FA8CC43C06D66A930"><enum>(5)</enum><header>Matching
funds</header><text>The Secretary may not require an eligible lending entity
that receives a loan under this subsection to provide, from non-Federal
sources, in cash or in-kind, the cost of carrying out activities under the
loan.</text>
</paragraph><paragraph id="HB211C81F22A04A3FAB2B9A643456505E"><enum>(6)</enum><header>Administrative
expenses</header>
<subparagraph id="HC42F732F8B5B4F06B2C4379615B12E25"><enum>(A)</enum><header>In
general</header><text>Each eligible lending entity that receives a loan under
this subsection shall be eligible additionally to receive a 1-time grant for
purposes described in subparagraph (B) in an amount that is not more than the
lesser of—</text>
<clause id="H046FE1DB5BA74925947FABDB83A8B7C2"><enum>(i)</enum><text>10
percent of the total amount of the loan received by the eligible lending
entity; or</text>
</clause><clause id="H83C1554B8D63447DBDC69D490B9962E8"><enum>(ii)</enum><text>$50,000.</text>
</clause></subparagraph><subparagraph id="H82D6555CF53446B5BB2DDE4C7BD18298"><enum>(B)</enum><header>Use of grant
funds</header><text>Grant funds received under subparagraph (A) may be used by
the eligible lending entity only to pay management and technical support costs
associated with the loan.</text>
</subparagraph><subparagraph id="H56532E55E4AD4044ACC076FD6BE3A676"><enum>(C)</enum><header>Interest
rate</header><text>If an eligible lending entity receives a grant under
subparagraph (A), the eligible lending entity may not set the interest rate of
loans made by the eligible lending entity to local farm business projects or
market garden projects at more than 3 percent per year.</text>
</subparagraph></paragraph><paragraph id="H57B224CC56B3405584DF0FBE516BD02B"><enum>(7)</enum><header>Progress
reports</header>
<subparagraph id="H3AA54026FAC7404FB77DFBC59DB35CD8"><enum>(A)</enum><header>In
general</header><text>Not later than 90 days after the last day of each fiscal
year, each eligible lending entity that has a loan under this subsection shall
submit to the Secretary a report that includes—</text>
<clause id="H506ADFB08DE5491B91CA0AB526CA0CEA"><enum>(i)</enum><text>an
evaluation of the progress of the revolving loan fund carried out by the
eligible lending entity;</text>
</clause><clause id="H3AF210C862BE4829965DB44540ACB3E6"><enum>(ii)</enum><text>a
description of the revolving loan fund, including information on all loans made
to local farm business projects or market garden projects;</text>
</clause><clause id="HD34B1614ACE64D0C9A453BAA357D365A"><enum>(iii)</enum><text>a
status update for the local farm business projects and market garden projects
funded by the revolving loan fund that describes—</text>
<subclause id="H6827CAA340B74EDD9189CCCBE1A2208E"><enum>(I)</enum><text>the amount of food
produced;</text>
</subclause><subclause id="HEA0C6EE40ADA4399B4E098A137A7984D"><enum>(II)</enum><text>the amount of
revenue generated; and</text>
</subclause><subclause id="HC787CBD749244C1F8B72D8412C49C407"><enum>(III)</enum><text>the number of
new and retained jobs; and</text>
</subclause></clause><clause id="H6460D12C16BE4DD7BA2C121C19BFBB7D"><enum>(iv)</enum><text>such other
information as the Secretary may require.</text>
</clause></subparagraph><subparagraph id="H12DF59B953E845D2A7C1991182BBEEDA"><enum>(B)</enum><header>Reports by the
Secretary</header><text>Not later than 3 years after the date of enactment of
this section, the Secretary shall submit to the Committee on Agriculture of the
House of Representatives and the Committee on Agriculture, Nutrition, and
Forestry of the Senate a report that describes the results and findings of the
loan program carried out under this subsection.</text>
</subparagraph></paragraph><paragraph id="H76C122112B3F4D0D923E6498DCB23B51"><enum>(8)</enum><header>Annual
review</header><text>The Secretary shall conduct an annual review of the
financial records of each eligible lending entity that receives funding under
this subsection—</text>
<subparagraph id="H18CED725127D407B86415F2B432C5057"><enum>(A)</enum><text>to assess the
financial soundness of the eligible lending entity; and</text>
</subparagraph><subparagraph id="HEA90F7CE2EEF4C3CA0B2F3DA8FE76559"><enum>(B)</enum><text>to determine the
effective use of loan and grant funds made available to the eligible lending
entity under this subsection.</text>
</subparagraph></paragraph></subsection><subsection id="H7B66F5EFA7B9472D90260F81F1C5A399"><enum>(c)</enum><header>Revolving loan
fund</header>
<paragraph id="H6F64DE6E6B5143F5BFE506391441B0F7"><enum>(1)</enum><header>Establishment
and purpose</header><text>Each eligible lending entity that receives a loan
under subsection (b) shall use the funds to establish a revolving loan fund to
provide loans to eligible producers in the local service area.</text>
</paragraph><paragraph id="HCA7D323B92934FEBA7498A802F69E211"><enum>(2)</enum><header>Eligible
activities</header><text>Loans made by an eligible lending entity under this
subsection shall be used by the eligible producer to carry out eligible
activities in the local service area, including—</text>
<subparagraph id="H1C691C367022473C999E9137EA3B16D2"><enum>(A)</enum><text>to carry out
production projects for value-added food products;</text>
</subparagraph><subparagraph id="H9EF5E0B1D27142CD896EE6C1A103D736"><enum>(B)</enum><text>to provide working
capital for general operational costs of the local farm business project or
market garden project;</text>
</subparagraph><subparagraph id="HFF21F10EF630468EB655CA7AE6680B7D"><enum>(C)</enum><text>to purchase
project-related equipment;</text>
</subparagraph><subparagraph id="H401E0C02C7654CC68B7A50CDBBE237D2"><enum>(D)</enum><text>to purchase seeds,
plants, and fruit or nut trees;</text>
</subparagraph><subparagraph id="H93FCF2FD80EF4B32A7642A4BF99B2BBA"><enum>(E)</enum><text>to purchase
livestock, poultry, and breeding stock;</text>
</subparagraph><subparagraph id="H87329AEBD75740BA980C86BFC29BF48F"><enum>(F)</enum><text>to construct and
maintain irrigation systems;</text>
</subparagraph><subparagraph id="H322B807BBCF246C9978F29C2E11B6ECE"><enum>(G)</enum><text>to construct
buildings (including barns, sheds, greenhouses, and dry and cold storage sheds)
necessary to support production;</text>
</subparagraph><subparagraph id="H383D04B9BF0D4D698AF99ACB25FD8B8A"><enum>(H)</enum><text>to lease, lease to
purchase, or directly purchase farmland or make a down payment on an accepted
purchase offer for farmland; or</text>
</subparagraph><subparagraph id="H8AC56E08EA7F4F2686F1DD3029B54EFF"><enum>(I)</enum><text>to carry out any
other activity that the Secretary determines to be in accordance with this
section.</text>
</subparagraph></paragraph><paragraph id="H5DAC2F67ED9D42289C24F65C4CE55CF7"><enum>(3)</enum><header>Loan
conditions</header>
<subparagraph id="HE869F2C1D1B24C68A3D14D9C036A8202"><enum>(A)</enum><header>In
general</header><text>To be eligible to receive a loan under this section from
an eligible lending entity, an eligible producer shall—</text>
<clause id="HFB0B53816EE744BCB0601F37249B059B"><enum>(i)</enum><text>supply a minimum
level of support of the cost of the local farm business project, market garden
project, or institution costs, as determined by the Secretary; and</text>
</clause><clause id="H1491AFCD86F341A7A0A0A041F4D0AE5F"><enum>(ii)</enum><text>submit to the
eligible lending entity—</text>
<subclause id="H53D27BFB67284321AAAF0985B0B26ECC"><enum>(I)</enum><text>documentation of,
as appropriate—</text>
<item id="H07D059D30D1F4D8786354F405733AB05"><enum>(aa)</enum><text>a
long-term land lease contract granting the right to perform local production
agriculture;</text>
</item><item id="H3492CAA77DE64D4F8C28F65C9102B6B1"><enum>(bb)</enum><text>a
building lease; or</text>
</item><item id="HED15FBB8D65C43828023F136E3CDC3B5"><enum>(cc)</enum><text>a
deed of property ownership; and</text>
</item></subclause><subclause id="H70446C49E157462A8207A189BF6407F9"><enum>(II)</enum><text>a conservation
plan and a sound business plan that is likely to result in a profitable
business with sustainable employment for the eligible producer and any
employees.</text>
</subclause></clause></subparagraph><subparagraph id="H819B67D366284E29B7F75B9367A90958"><enum>(B)</enum><header>Secretarial
approval; guarantee</header>
<clause id="HC7EF114394014211804555B71A4B8808"><enum>(i)</enum><header>Approval</header><text>Before
an eligible lending entity may make a loan or package of loans to an eligible
producer under this section, the Secretary shall approve the loan or package of
loans in accordance with the requirements of this section.</text>
</clause><clause id="HC7721BB8617343E781B8ECBC7EC226EF"><enum>(ii)</enum><header>Loan
guarantee</header><text>The Secretary shall guarantee not more than 85 percent
of the principal and interest on each loan approved under clause (i).</text>
</clause></subparagraph></paragraph><paragraph id="H2CAA3244D789454B9734B9D0E6288B0C"><enum>(4)</enum><header>Priority</header><text>In
making loans under this subsection, the eligible lending entity shall give
priority to eligible producers that are operated by, or that support—</text>
<subparagraph id="H5561202510E24C07885A59DEF71387EB"><enum>(A)</enum><text>qualified
beginning farmers or ranchers (as defined in section 343(a) of the Consolidated
Farm and Rural Development Act (7 U.S.C. 1991(a))) and socially disadvantaged
farmers or ranchers;</text>
</subparagraph><subparagraph id="H5297F502DC3D40A293673183770BDBC1"><enum>(B)</enum><text>existing eligible
producers, whether owners or tenants, who use loan funds to convert to
agricultural production systems approved by the Secretary;</text>
</subparagraph><subparagraph id="H632752DB41DF4130A2F524E4E69102F6"><enum>(C)</enum><text>eligible producers
who use loan funds to build conservation structures or carry out conservation
practices;</text>
</subparagraph><subparagraph id="H4AADB93D2E2B49FE965C4E57E65E6B2D"><enum>(D)</enum><text>eligible producers
who will supply fresh and locally produced food to underserved communities;
and</text>
</subparagraph><subparagraph id="HCEDCD636DA9F4B979D2E84F1175B2439"><enum>(E)</enum><text>existing eligible
producers of agriculture commodities who want to diversify farm, ranch, or
market garden production and income.</text>
</subparagraph></paragraph><paragraph id="H244882D77C8B4DCAB8CB5072EB78C556"><enum>(5)</enum><header>Loan terms for
eligible producers</header>
<subparagraph id="H0A0F2E5B2E6A4D5F9DBF1430A1411B4C"><enum>(A)</enum><header>In
general</header><text>A loan made by an eligible lending entity to an eligible
producer under this subsection shall be in an amount that is—</text>
<clause id="HF0E40EC340FD4B4AB47294F1BE19AE1D"><enum>(i)</enum><text>in
the case of a local farm business project, not less than $5,000 and not more
than $100,000; and</text>
</clause><clause id="H9B504A8E75AE4636B02CF9AE2E357B54"><enum>(ii)</enum><text>in
the case of a market garden project, not less than $3,000 and not more than
$50,000.</text>
</clause></subparagraph><subparagraph id="H044C5D105A95448FA90C2EFCF0965E34"><enum>(B)</enum><header>Term</header><text>The
term of a loan under this subsection shall not exceed—</text>
<clause id="H7627561989D44607BE7941A55C62536E"><enum>(i)</enum><text>in
the case of a loan in an amount that is not more than $35,000, 12 years from
the date on which the loan is finalized; and</text>
</clause><clause id="H140BB28D369448C68011F2917057BF2D"><enum>(ii)</enum><text>in
the case of all other loans, 20 years from the date on which the loan is
finalized.</text>
</clause></subparagraph><subparagraph id="HF7A7E36FE7184B2F993F4D864A2F276C"><enum>(C)</enum><header>Loan financing
terms</header><text>In making loans under this subsection, an eligible lending
entity shall—</text>
<clause id="HB0E35FEB4F15441F90DF0344EF4F4333"><enum>(i)</enum><text>set
the rate of interest at not more than 3 percent per year;</text>
</clause><clause id="H0EB3277D88814FEAA0C3447E204ADDBE"><enum>(ii)</enum><text>ensure that no
payments are due on the loan during the first 9 months of the loan; and</text>
</clause><clause id="HDBFBE8CCEDA7463AA9A28E47CB83A1D5"><enum>(iii)</enum><text>ensure that only
interest is due on the loan during the period beginning on the last day of the
period described in clause (ii) and ending 24 months after the issuance of the
loan.</text>
</clause></subparagraph><subparagraph id="HF9039030766744CE81F0E8C791059308"><enum>(D)</enum><header>Loan
forgiveness</header><text>If an eligible producer has received a loan under
this section to carry out a local farm business project or market garden
project, and after 3 years the Secretary determines that the project is
successful, the Secretary may offer to forgive—</text>
<clause id="HBB9BA9779B82421BAF47DDA148D20588"><enum>(i)</enum><text>up
to 10 percent of the outstanding amount of the loan; and</text>
</clause><clause id="HDC1E83F385FC4BCE819D42BFDCF36B5D"><enum>(ii)</enum><text>in
the case of an eligible producer supporting sustainable agriculture practices,
up to 20 percent of the outstanding amount of the loan.</text>
</clause></subparagraph></paragraph></subsection><subsection id="H80E7FFE09BA44A478CB0470CD875BB56"><enum>(d)</enum><header>Authorization of
appropriations</header><text>There are authorized to be appropriated to the
Secretary for each of fiscal years 2012 through 2022—</text>
<paragraph id="HF1D20617ED634DD6BF1A523C5B6D9EBA"><enum>(1)</enum><text>$20,000,000 to
provide loans and grants under subsection (b); and</text>
</paragraph><paragraph id="H1471912BEAD2497A9D54B38F7628E8B2"><enum>(2)</enum><text>$100,000 for the
administrative costs of carrying out this section.</text>
</paragraph></subsection></section><enum>IV</enum><header>Eradicating
Hunger</header>
<section id="H87A5D424B2174B809C8579D9587D8942" section-type="subsequent-section"><enum>401.</enum><header>Weekends and
holidays without hunger</header><text display-inline="no-display-inline">Section 18 of the Richard B. Russell
National School Lunch Act (42 U.S.C. 1769) is amended by adding at the end the
following:</text>

<subsection id="HF0BA71169E864F20BE2B216AE49E5363"><enum>(l)</enum><header>Weekends and
holidays without hunger</header>
<paragraph id="H474D04430527497D84886F17C7CE1862"><enum>(1)</enum><header>Definitions</header><text>In
this subsection:</text>
<subparagraph id="HC4FFE2026EB44458B489BAA3FA5E41ED"><enum>(A)</enum><header>At-risk school
child</header><text>The term <term>at-risk school child</term> has the meaning
given the term in section 17(r)(1).</text>
</subparagraph><subparagraph id="HF66E2651E3424B8FBCD54E1871452E48"><enum>(B)</enum><header>Eligible
institution</header>
<clause id="HB17D61B6250549869D388E264AE9CBC6"><enum>(i)</enum><header>In
general</header><text>The term <term>eligible institution</term> means a public
or private nonprofit institution that is determined by the Secretary to be able
to meet safe food storage, handling, and delivery standards established by the
Secretary.</text>
</clause><clause id="H2A2C4176471A40149F27D1370B54251A"><enum>(ii)</enum><header>Inclusions</header><text>The
term <term>eligible institution</term> includes—</text>
<subclause id="H11C4AFF0436F490082ACD25AC0AE8185"><enum>(I)</enum><text>an elementary or
secondary school or school food service authority;</text>
</subclause><subclause id="H644037639E834AC886A3A4316A594794"><enum>(II)</enum><text>a food bank or
food pantry;</text>
</subclause><subclause id="HA45D6B045EF9498CAD593BEB2419D7B9"><enum>(III)</enum><text>a homeless
shelter; and</text>
</subclause><subclause id="H92B00CAF2E7940868030EE757E8570F0"><enum>(IV)</enum><text>such other type
of emergency feeding agency as is approved by the Secretary.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="HA8B39511804D413287930080C5C53822"><enum>(2)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subject to the availability of
appropriations provided in advance in an appropriations Act specifically for
the purpose of carrying out this subsection, the Secretary shall establish a
program under which the Secretary shall provide commodities, on a competitive
basis, to eligible institutions to provide nutritious food to at-risk children
on weekends and during extended school holidays during the school year.</text>
</paragraph><paragraph id="H8A79CD73F9CD49F4BFD3D03B17BDECC1"><enum>(3)</enum><header>Eligibility</header>
<subparagraph id="HA2707B4CBA674A25947D6AA4FF1C5469"><enum>(A)</enum><header>In
general</header><text>To be eligible to receive commodities under this
subsection, an eligible institution shall submit an application to the
Secretary at such time, in such manner, and containing such information as the
Secretary may determine.</text>
</subparagraph><subparagraph id="H6505E50174634520B083191C5A14EA0E"><enum>(B)</enum><header>Plan</header><text>An
application under subparagraph (A) shall include the plan of the eligible
institution for the distribution of nutritious foods to at-risk school
children, including—</text>
<clause id="HA6389ED7F4C9437A8A553266F789ACDC"><enum>(i)</enum><text>methods of food
service delivery to at-risk school children;</text>
</clause><clause id="H12F2B6704ECA46CFB6B8987FF01ACBBA"><enum>(ii)</enum><text>assurances that
children receiving foods under the project will not be publicly separated or
overtly identified;</text>
</clause><clause id="HC1942CB4C15245B39DD211A072F08DC0"><enum>(iii)</enum><text>lists of the
types of food to be provided under the project and provisions to ensure food
quality and safety;</text>
</clause><clause id="HAA3DC0BD49914C04938F5307C391057F"><enum>(iv)</enum><text>information on
the number of at-risk school children to be served and the per-child cost of
providing the children with food; and</text>
</clause><clause id="H4BAAFABDE0DE4A458C222933006D4235"><enum>(v)</enum><text>such other
information as the Secretary determines to be necessary to assist the Secretary
in evaluating projects that receive commodities under this subsection.</text>
</clause></subparagraph></paragraph><paragraph id="H0CFD5A1CEF4A4DBB8176A8E0E8C25AA5"><enum>(4)</enum><header>Priority</header><text>In
selecting applications under this subsection, the Secretary shall give priority
to eligible institutions that—</text>
<subparagraph id="H04A2539740724BD887A67FBB4AB7C4E0"><enum>(A)</enum><text>have on-going
programs and experience serving populations with significant proportions of
at-risk school children;</text>
</subparagraph><subparagraph id="H532B2EFD293140E9A77CDA6AA482DADE"><enum>(B)</enum><text>have a good record
of experience in food delivery and food safety systems;</text>
</subparagraph><subparagraph id="HADD3C2C12F464FD884B389EC253E7904"><enum>(C)</enum><text>maintain high
quality control, accountability, and recordkeeping standards;</text>
</subparagraph><subparagraph id="H79F0BA1AF7074092AFF58EA074A97FA0"><enum>(D)</enum><text>provide children
with readily consumable food of high nutrient content and quality;</text>
</subparagraph><subparagraph id="H2AC4F3ED9F1E4FC98B340BD169AC2A84"><enum>(E)</enum><text>demonstrate cost
efficiencies and the potential for obtaining supplemental funding from
non-Federal sources to carry out projects; and</text>
</subparagraph><subparagraph id="HBC247D7BB61D4AFFA8ED022F731A183B"><enum>(F)</enum><text>demonstrate the
ability to continue projects for the full approved term of the pilot project
period.</text>
</subparagraph></paragraph><paragraph id="H0C63BF293203441F809F2B67D13A79AB"><enum>(5)</enum><header>Guidelines</header>
<subparagraph id="HC55C167D189B40ACAB0E5B1406CE5F26"><enum>(A)</enum><header>In
general</header><text>The Secretary shall issue guidelines containing the
criteria for projects to receive commodities under this section.</text>
</subparagraph><subparagraph id="H9FE37201070E4DBBAF006F087743B791"><enum>(B)</enum><header>Inclusions</header><text>The
guidelines shall, to the maximum extent practicable within the funds available
and applications submitted, take into account—</text>
<clause id="HDDD17C97759045D2BA18AC24F8E57291"><enum>(i)</enum><text>geographical
variations in project locations to include qualifying projects in rural, urban,
and suburban areas with high proportions of families with at-risk school
children;</text>
</clause><clause id="H3CC60724231F4D9E9D6D514B27633700"><enum>(ii)</enum><text>different types
of projects that offer nutritious foods on weekends and during school holidays
to at-risk school children; and</text>
</clause><clause id="HC7921BB3B20345FE8E9A61D896C5BB68"><enum>(iii)</enum><text>institutional
capacity to collect, maintain, and provide statistically valid information
necessary for the Secretary—</text>
<subclause id="H68FF8ED602E64261834C10E82368988C"><enum>(I)</enum><text>to analyze and
evaluate the results of the pilot project; and</text>
</subclause><subclause id="H34A888B50A444D28B3D59C6F70956E61"><enum>(II)</enum><text>to make
recommendations to Congress.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="H50B2B498ADC742819EAFB30D40D52192"><enum>(6)</enum><header>Evaluation</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H9A9FD98F4E804451AED0B9C5F24A5994"><enum>(A)</enum><header>Interim
evaluation</header><text display-inline="yes-display-inline">Not later than
November 30, 2013, the Secretary shall complete an interim evaluation of the
pilot program carried out under this subsection.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H41FBB43FFC2A487F85ACB92677038110"><enum>(B)</enum><header>Final
report</header><text display-inline="yes-display-inline">Not later than
December 31, 2015, the Secretary shall submit to Congress a final report that
contains—</text>
<clause commented="no" display-inline="no-display-inline" id="H70E586E9CD6E43CBB42E56FA41F29211"><enum>(i)</enum><text display-inline="yes-display-inline">an evaluation of the pilot program carried
out under this subsection; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="HE1218B7D71FA4C5AA8F6DD58546C92DA"><enum>(ii)</enum><text>any
recommendations of the Secretary for legislative action.</text>
</clause></subparagraph></paragraph><paragraph id="H1CE16D296D4E4CFB9CFBA3DD27252E35"><enum>(7)</enum><header>Funding</header>
<subparagraph id="H926C0F0017254DC58F41B913519F38FF"><enum>(A)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There is
authorized to be appropriated to carry out this section such sums as are
necessary, to remain available until expended.</text>
</subparagraph><subparagraph id="H5EECCC0F24594A7DAF202114353B71F9"><enum>(B)</enum><header>Availability of
funds</header><text>Not more than 3 percent of the funds made available under
subparagraph (A) may be used by the Secretary for expenses associated with
review of the operations and evaluation of the projects carried out under this
subsection.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H96C60873160C4AD0878DB2FD83FE4B51"><enum>402.</enum><header>Expansion and
modernization of the commodity supplemental food program</header><text display-inline="no-display-inline">Section 5 of the Agriculture and Consumer
Protection Act of 1973 (7 U.S.C. 612c note) is amended—</text>
<paragraph id="HB5625D248FE64916802055BBD5948013"><enum>(1)</enum><text>in subsection
(a)—</text>
<subparagraph id="H6D76A22A55B54170B7C10C7DBFA04C2A"><enum>(A)</enum><text>in paragraph (1)
by striking <quote>2008 through 2012</quote> and inserting <quote>2013 through
2017</quote>, and</text>
</subparagraph><subparagraph id="HBAD7064661F042A4893B9B8F36E709B4"><enum>(B)</enum><text>in paragraph
(2)(B) by striking <quote>2004 through 2012</quote> and inserting <quote>2013
through 2017</quote>, and</text>
</subparagraph></paragraph><paragraph id="H0CFDD541A7864D2284DE8C88D0FED47B"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g) by striking paragraph (2)

Secretary may not require the enrollment in the program of women, infants, and
children who are not participating in the program before the effective date of

</paragraph></section><section id="HB3CE0A7FBA9E49D289CB9145A4927A94"><enum>403.</enum><header>Expansion and
modernization of the emergency food assistance program</header>
<subsection id="H836A5FC153E74621BF8078358C8EC6A3"><enum>(a)</enum><header>Amendments to
the Food and Nutrition Act of 2008</header><text display-inline="yes-display-inline">Section 27(a)(2) of the Food and Nutrition
Act of 2008 (7 U.S.C. 2036(a)(2)) is amended—</text>
<paragraph id="H2CD9C8A8A1CA47098A750B9352E28F07"><enum>(1)</enum><text>by striking
subparagraphs (A) and (B) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="H84ED757058B74513BCB2F78C8C85FC74" style="traditional">
<subparagraph id="H5D37C694C2864F1380A3C507A883EE36"><enum>(A)</enum><text display-inline="yes-display-inline">for fiscal year 2013 through 2017,
$350,000,000; plus $100,000,000 for each percentage point that unemployment
exceeds the rate as of June 2008 (prorated such that each change of 0.1 percent
shall result in a change in funding of $10,000,000). The unemployment rate from
June of the immediately preceding fiscal year shall be used to compute change
from June 2008. In any fiscal year, the amount calculated in this subparagraph
shall not be less than
$350,000,000.</text>
</subparagraph><after-quoted-block>,</after-quoted-block></quoted-block>
</paragraph><paragraph id="H1E8144EB05EC48DD9EE741D70190905F"><enum>(2)</enum><text>in subparagraph

<subparagraph id="H8450E05EF3AD49EE81C427EF6FEC0CAA"><enum>(C)</enum><text display-inline="yes-display-inline">of the total funds made available under
subparagraphs (A) and (B), not less than $100,000,000 shall be to support State
and local storage and distribution costs. In addition, each year States may
transfer up to 5 percent of total funds provided for commodity purchases into
accounts used to fund storage and distribution costs at their
discretion</text>
</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="H156D7953126241D7A6B10FDC2261B529"><enum>(b)</enum><header>Amendments to
the emergency food assistance act of 1983</header><text display-inline="yes-display-inline">The Emergency Food Assistance Act of 1983
(7 U.S.C. 7501 et seq.) is amended—</text>
<paragraph id="H6C0B346BA73045C5BCA21F2B144D744D"><enum>(1)</enum><text>in section 202 by
adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H73F24203E3B14F808751F7BD2DCCE21E" style="traditional">
<subsection id="H5ACBE281370F4825AE49769C33EBB5F9"><enum>(h)</enum><text display-inline="yes-display-inline">In addition to other considerations,
including but not limited to the need to intervene in depressed domestic
agricultural markets, the Secretary shall consider the needs of States and
demands on emergency food providers in making commodity purchase
decisions.</text>

</paragraph><paragraph id="H1816B83733CD4FCF82C1F4085D90FE90"><enum>(2)</enum><text>in section 204 by
striking <quote>2008</quote> and inserting <quote>2013</quote>.</text>
</paragraph></subsection><subsection id="H62AADB113F71485CA99BB69DE611EA05"><enum>(c)</enum><header>Authority To use
section 32 funds To respond to situations of high rates of food insecurity or
unemployment</header><text>The second sentence of section 32 of the Act of
August 24, 1935 (7 U.S.C. 612c) is amended in paragraph (2) by inserting after
<quote>low-income groups</quote> the following: <quote>or in situations of high
rates of food insecurity or unemployment,</quote>.</text>
</subsection></section><section id="HC501FB6695F641B78A15B2F325980DC2"><enum>404.</enum><header>Food bank
equipment and technology program</header>
<subsection id="H4A6752926D574BD697BB7D5E89AAEF5A"><enum>(a)</enum><header>Authority for
program</header><text display-inline="yes-display-inline">The Secretary of
Agriculture shall develop and carry out a food bank equipment and technology
program to make grants to eligible entities to be used within a 1-year period
for the purchase of operating equipment and technology that increases the
efficiency of a food bank. Eligible entities include nonprofit entities that
operate food banks in urban areas.</text>
</subsection><subsection id="HD4E01A15DC5149FAA0CE092316D9C0FF"><enum>(b)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There is
authorized to be appropriated to carry out this section $10,000,000 for each of
the fiscal years in the 3-year period beginning on the October 1 of the 1st
fiscal year that begins after the date of the enactment of this Act.</text>
</subsection></section><enum>V</enum><header>Go
Green</header>
<section id="H8B83F3BE59024D96A0BB37FBB9DBE2C6" section-type="subsequent-section"><enum>501.</enum><header>Green and
Sustainable Schools, Museums, and Libraries Grant Program</header>
<subsection id="H48198BBF15F2408E845DFC02EDBAE988"><enum>(a)</enum><header>Grant
program</header><text display-inline="yes-display-inline">The Secretary of
Agriculture, in consultation with the Secretary of Energy, shall establish a
program to provide competitive grants to schools, museums, and libraries to
increase energy efficiency.</text>
</subsection><subsection id="H3F46367BE6164E5998A74E4449A3ED2A"><enum>(b)</enum><header>Criteria</header><text>In
awarding grants under subsection (a), the Secretary of Agriculture shall target
schools, museums, and libraries that are the most inefficient in the usage of
energy and whose insulation, lighting, and equipment would benefit most by
being upgraded to insulation, lighting, and equipment that is more energy
efficient.</text>
</subsection><subsection id="H1DEE6A168DFE440897005B2E02B8DFB2"><enum>(c)</enum><header>Use of
funds</header><text>A school, museum, or library receiving a grant under
subsection (a) shall use the funds received under such grant—</text>
<paragraph id="H173197AECBDF41C6A4B53E36C84016EB"><enum>(1)</enum><text>to increase energy
efficiency through new construction, rehabilitation, expansion, and upgrades;
and</text>
</paragraph><paragraph id="H69C76E81350647489DCC0B8CB01AC1FF"><enum>(2)</enum><text>for organized
programs, events, and initiatives to educate employees of schools, museums, or
libraries on how to become more energy efficient.</text>
</paragraph></subsection><subsection id="HD5979255A08B4F86AF5EC254C7444019"><enum>(d)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph id="H9B7A3BAB6AA64CB6A72E444FD2BAB38D"><enum>(1)</enum><header>Museum</header><text>The
term <quote>museum</quote> means a museum accredited by the American
Association of Museums.</text>
</paragraph><paragraph id="HE217A1B3B38A4BE084C273B38786FB0B"><enum>(2)</enum><header>School</header><text>The
term <quote>school</quote> means an elementary school or a secondary school, as
those terms are defined in section 9101 of the Elementary and Secondary
Education Act of 1965 (20 U.S.C. 7801).</text>
