<subsection id="HCB0CE2BFAB7E41D7B04B1FF87115F2C7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No person may construct, operate, or maintain the oil pipeline and related facilities described in subsection (b) except in accordance with a permit issued under this title.</text> </subsection> 
<subsection id="H18449BC995AA4E3F98AC0425F0C2E9D3"><enum>(b)</enum><header>Pipeline</header><text display-inline="yes-display-inline">The pipeline and related facilities referred to in subsection (a) are those described in the Final Environmental Impact Statement for the Keystone XL Pipeline Project issued by the Department of State on August 26, 2011, including any modified version of that pipeline and related facilities.</text> </subsection></section> 
<section display-inline="no-display-inline" id="H29748082DB914F109A400DF9A988DA98" section-type="subsequent-section"><enum>203.</enum><header>Permit</header> 
<subsection id="H42C539B22A6E40ACBDB657EC6029C969"><enum>(a)</enum><header>Issuance</header> 
<paragraph id="H6E5B073AB0D14CB99BD0B3A0ED86B50F"><enum>(1)</enum><header>By FERC</header><text display-inline="yes-display-inline">The Federal Energy Regulatory Commission shall, not later than 30 days after receipt of an application therefor, issue a permit without additional conditions for the construction, operation, and maintenance of the oil pipeline and related facilities described in section 202(b), to be implemented in accordance with the terms of the Final Environmental Impact Statement described in section 202(b). The Commission shall not be required to prepare a Record of Decision under section 1505.2 of title 40 of the Code of Federal Regulations with respect to issuance of the permit provided for in this section.</text> </paragraph> 
<paragraph id="H0E256A23E2BC44F1A8DEA8741743B700"><enum>(2)</enum><header>Issuance in absence of FERC action</header><text display-inline="yes-display-inline">If the Federal Energy Regulatory Commission has not acted on an application for a permit described in paragraph (1) within 30 days after receiving such application, the permit shall be deemed to have been issued under this title upon the expiration of such 30-day period.</text> </paragraph></subsection> 
<subsection id="H713093ACF7D1423B99B3C2EC3726E579"><enum>(b)</enum><header>Modification</header> 
<paragraph id="H1B38E1B29FBE4BC880D74B1461EDAAF2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The applicant for or holder of a permit described in subsection (a) may make a substantial modification to the pipeline route or any other term of the Final Environmental Impact Statement described in section 202(b) only with the approval of the Federal Energy Regulatory Commission. The Commission shall expedite consideration of any such modification proposal.</text> </paragraph> 
<paragraph id="H666F21D2D196464889F811D12822C97A"><enum>(2)</enum><header>Nebraska modification</header><text display-inline="yes-display-inline">Within 30 days after the date of enactment of this Act, the Federal Energy Regulatory Commission shall enter into a memorandum of understanding with the State of Nebraska for an effective and timely review under the National Environmental Policy Act of 1969 of any modification to the proposed pipeline route in Nebraska as proposed by the applicant for the permit described in subsection (a). Not later than 30 days after receiving approval of such proposed modification from the Governor of Nebraska, the Commission shall complete consideration of and approve such modification.</text> </paragraph> 
<paragraph id="H8D00FDB9002C49ECA5CD3DF5931F091E"><enum>(3)</enum><header>Issuance in absence of FERC action</header><text display-inline="yes-display-inline">If the Federal Energy Regulatory Commission has not acted on an application for approval of a modification described in paragraph (2) within 30 days after receiving such application, such modification shall be deemed to have been issued under this title upon expiration of the 30-day period.</text> </paragraph> 
<paragraph id="H8693F2CE43A74BB58DF940C12DE427E6"><enum>(4)</enum><header>Construction during consideration of Nebraska modification</header><text display-inline="yes-display-inline">While any modification of the proposed pipeline route in Nebraska is under consideration pursuant to paragraph (2), the holder of the permit issued under subsection (a) may commence or continue with construction of any portion of the pipeline and related facilities described in section 202(b) that is not within the State of Nebraska.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H70A809DD40A24F19AF8155E6A1A3DDD1"><enum>(c)</enum><header>National Environmental Policy Act of 1969</header><text display-inline="yes-display-inline">Except for actions taken under subsection (b)(1), the actions taken pursuant to this title shall be taken without further action under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text> </subsection></section> 
<section display-inline="no-display-inline" id="H6D79ECD684204EE292A1FBD51F1686FD" section-type="subsequent-section"><enum>204.</enum><header>Relation to other law</header> 
<subsection display-inline="no-display-inline" id="H11E85720662046DB9199E71014260F66"><enum>(a)</enum><header>General rule</header><text display-inline="yes-display-inline">Notwithstanding Executive Order No. 13337 (3 U.S.C. 301 note), Executive Order No. 11423 (3 U.S.C. 301 note), section 301 of title 3, United States Code, and any other Executive order or provision of law, no presidential permits shall be required for the construction, operation, and maintenance of the pipeline and related facilities described in section 202(b) of this Act.</text> </subsection> 
<subsection id="HC8DFB18166CF417BA4BFF9CDD7E7A7A8"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Nothing in this title shall affect the application to the pipeline and related facilities described in section 202(b) of—</text> 
<paragraph id="H7CCA0B813686406BAD7F29D28BEE0885"><enum>(1)</enum><text display-inline="yes-display-inline">chapter 601 of title 49, United States Code; or</text> </paragraph> 
<paragraph id="HAD06D051551147B48BAD2A166839248A"><enum>(2)</enum><text display-inline="yes-display-inline">the authority of the Federal Energy Regulatory Commission to regulate oil pipeline rates and services.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H0AF9FB86F4F94C8D9B5C798854FAA03F"><enum>(c)</enum><header>Final environmental impact statement</header><text display-inline="yes-display-inline">The final environmental impact statement issued by the Secretary of State on August 26, 2011, shall be considered to satisfy all requirements of the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text> </subsection></section></title> 
<title id="HD85A64A53A7E412EB78A61AB8F7432B9"><enum>III</enum><header>RESTORE Act</header> 
<section id="H174B7F76790C4A6597C1451A3A403978" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2012</short-title></quote>.</text> </section> 
<section id="H1B03EBE92A4E4D99B343EFD80FEE59DB"><enum>302.</enum><header>Gulf Coast Restoration Trust Fund</header> 
<subsection id="HB9754E58824C4895B9318F009756DB15"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Gulf Coast Restoration Trust Fund</quote> (referred to in this section as the <term>Trust Fund</term>), consisting of such amounts as are deposited in the Trust Fund under this section or any other provision of law.</text> </subsection> 
<subsection id="H2889E384395E4342AC7B1643FE462F87"><enum>(b)</enum><header>Transfers</header><text>The Secretary of the Treasury shall deposit in the Trust Fund an amount equal to 80 percent of all administrative and civil penalties paid by responsible parties after the date of enactment of this title in connection with the explosion on, and sinking of, the mobile offshore drilling unit Deepwater Horizon pursuant to a court order, negotiated settlement, or other instrument in accordance with section 311 of the Federal Water Pollution Control Act (33 U.S.C. 1321).</text> </subsection> 
<subsection id="HE9F3232E16CB4907B4BFBE6BCCC1AB7A"><enum>(c)</enum><header>Expenditures</header><text>Amounts in the Trust Fund, including interest earned on advances to the Trust Fund and proceeds from investment under subsection (d), shall be available, pursuant to a future Act of Congress enacted after the date of enactment of this Act—</text> 
<paragraph id="H92FBB4CCF3C542D8889670FDA6BB56A2"><enum>(1)</enum><text display-inline="yes-display-inline">for expenditure to restore the Gulf Coast region from the Deepwater Horizon oil spill for undertaking projects and programs in the Gulf Coast region that would restore and protect the natural resources, ecosystems, fisheries, marine and wildlife habitats, beaches, coastal wetlands, and economy of the Gulf Coast region; and</text> </paragraph> 
<paragraph id="HC1E20E0929AF48C09F4400901460D649"><enum>(2)</enum><text display-inline="yes-display-inline">solely to Gulf Coast States and coastal political subdivisions to restore the ecosystems and economy of the Gulf Coast region.</text> </paragraph></subsection> 
<subsection id="H24D7B7C083D54D918C01038F49D0EFD8"><enum>(d)</enum><header>Investment</header><text>Amounts in the Trust Fund shall be invested in accordance with section 9702 of title 31, United States Code, and any interest on, and proceeds from, any such investment shall be available for expenditure in accordance with this section.</text> </subsection> 
<subsection id="HBCD8A9C3BF95499A92B64A7157C7F420"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HF9ED41E2CBB54C3ABFEBB4F7EC254225"><enum>(1)</enum><header>Coastal political subdivision</header><text>The term <term>coastal political subdivision</term> means any local political jurisdiction that is immediately below the State level of government, including a county, parish, or borough, with a coastline that is contiguous with any portion of the United States Gulf of Mexico.</text> </paragraph> 
<paragraph id="HE825AF84C0EA416BBA66AF4177100F63"><enum>(2)</enum><header>Deepwater Horizon oil spill</header><text>The term <term>Deepwater Horizon oil spill</term> means the blowout and explosion of the mobile offshore drilling unit Deepwater Horizon that occurred on April 20, 2010, and resulting hydrocarbon releases into the environment.</text> </paragraph> 
<paragraph id="H5EE5F916178C47258B5A9AF7E78B6548"><enum>(3)</enum><header>Gulf Coast region</header><text>The term <term>Gulf Coast region</term> means—</text> 
<subparagraph id="HE1597E93F3DD4C55924AFC4525A1C4BA"><enum>(A)</enum><text>in the Gulf Coast States, the coastal zones (as that term is defined in section 304 of the Coastal Zone Management Act of 1972 (16 U.S.C. 1453)) that border the Gulf of Mexico;</text> </subparagraph> 
<subparagraph id="H45796A8C0E1B470F994A0364C22DC83E"><enum>(B)</enum><text>any adjacent land, water, and watersheds, that are within 25 miles of those coastal zones of the Gulf Coast States; and</text> </subparagraph> 
<subparagraph id="H0433F42D2DE84734ACB8096052D1BFDE"><enum>(C)</enum><text>all Federal waters in the Gulf of Mexico.</text> </subparagraph></paragraph> 
<paragraph id="H70E2E61A8A64407CA5F338B11E72CC5D"><enum>(4)</enum><header>Gulf Coast State</header><text>The term <term>Gulf Coast State</term> means any of the States of Alabama, Florida, Louisiana, Mississippi, and Texas.</text> </paragraph></subsection></section></title> 
<title id="H8EED1F87CD6F4AF7AF3E246B3A43FFF2"><enum>IV</enum><header>Harbor Maintenance Programs</header> 
<section id="H9B22070D93F74A568EDBA30D5CD91D8C"><enum>401.</enum><header>Funding for harbor maintenance programs</header> 
<subsection display-inline="no-display-inline" id="HBA269096089D44CB9910ABC52B6219E3"><enum>(a)</enum><header>Harbor maintenance trust fund guarantee</header> 
<paragraph id="H4252F56A4C5343E7B8BD061EA5CE848D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The total budget resources for a fiscal year shall be equal to the level of receipts for harbor maintenance for that fiscal year. Such amounts shall be used only for harbor maintenance programs.</text></paragraph> 
<paragraph id="H8DF9F1FFACE7496DBF1C9F14D189650C"><enum>(2)</enum><header>Guarantee</header><text display-inline="yes-display-inline">No funds may be appropriated for harbor maintenance programs unless the amount under paragraph (1) has been provided for all such programs.</text></paragraph></subsection> 
<subsection id="H3C6FCEE22B204DFA81F8B0B2E6EDFED9"><enum>(b)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="HC2E4D7D5A1CA4A6DBDE827373578B46C"><enum>(1)</enum><header>Harbor maintenance programs</header><text display-inline="yes-display-inline">The term <quote>harbor maintenance programs</quote> means expenditures under section 9505(c)(1) of the Internal Revenue Code of 1986 (relating to expenditures from the Harbor Maintenance Trust Fund).</text></paragraph> 
<paragraph id="H7848097B6D9E4FBD9AF52188E5E37BEA"><enum>(2)</enum><header>Level of receipts for harbor maintenance</header><text display-inline="yes-display-inline">The term <quote>level of receipts for harbor maintenance</quote> means the level of taxes credited to the Harbor Maintenance Trust Fund under section 9505(a)(1) of the Internal Revenue Code of 1986 for a fiscal year as set forth in the President’s budget baseline projection as defined in section 257 of the Balanced Budget and Emergency Deficit Control Act of 1985 (Public Law 99–177) for that fiscal year submitted pursuant to section 1105 of title 31, United States Code, reduced by the amount requested in such President’s budget for payments described in section 9505(c)(3) of the Internal Revenue Code of 1986.</text></paragraph> 
<paragraph id="H12E1AD46BD8541E29ECCF23FBB006981"><enum>(3)</enum><header>Total budget resources</header><text display-inline="yes-display-inline">The term <quote>total budget resources</quote> means the total amount made available by appropriations Acts from the Harbor Maintenance Trust Fund for a fiscal year for making expenditures under section 9505(c)(1) of the Internal Revenue Code of 1986.</text></paragraph></subsection></section></title> 
<title id="H5DA823EDF1FE4E91A9EF174A09FD745A"><enum>V</enum><header>Coal Combustion Residuals</header> 
<section id="H51C2262928694393A656FDE8B0AA8E6E"><enum>501.</enum><header>Highway and infrastructure safety through the protection of coal combustion residual recycling</header> 
<subsection id="H0548242180CE4BA1BE3C4E081ECFC5F7"><enum>(a)</enum><header>In general</header><text>Subtitle D of the Solid Waste Disposal Act (42 U.S.C. 6941 et seq.) is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H23581CB997D74E69BCECA1200058933B" style="OLC"> 
<section id="H99950235C2C74925BE18626A800758A9"><enum>4011.</enum><header>Management and disposal of coal combustion residuals</header> 
<subsection id="HF516F909CBDA469DBABFF8D9F0708CA3"><enum>(a)</enum><header>State permit programs for coal combustion residuals</header><text>Each State may adopt and implement a coal combustion residuals permit program.</text></subsection> 
<subsection id="H9C03ECF9BD314AEA946E9844669BA934"><enum>(b)</enum><header>State actions</header> 
<paragraph id="HBD8544E676404F12818B5354DBD3C7CA"><enum>(1)</enum><header>Notification</header><text>Not later than 6 months after the date of enactment of this section (except as provided by the deadline identified under subsection (d)(2)(B)), the Governor of each State shall notify the Administrator, in writing, whether such State will adopt and implement a coal combustion residuals permit program.</text></paragraph> 
<paragraph id="HE9D3E3B7A3DC42B6BA3AE58222E0A550"><enum>(2)</enum><header>Certification</header> 
<subparagraph id="HAAD0A59385E541C083302E9B98C45CA9"><enum>(A)</enum><header>In general</header><text>Not later than 36 months after the date of enactment of this section (except as provided in subsections (f)(1)(A) and (f)(1)(C)), in the case of a State that has notified the Administrator that it will implement a coal combustion residuals permit program, the head of the lead State agency responsible for implementing the coal combustion residuals permit program shall submit to the Administrator a certification that such coal combustion residuals permit program meets the specifications described in subsection (c)(1).</text></subparagraph> 
<subparagraph id="HDFF285701C7246E99F93D3B0A67FF153"><enum>(B)</enum><header>Contents</header><text>A certification submitted under this paragraph shall include—</text> 
<clause id="HEDB8D550C89F431AB8163567CD9251A4"><enum>(i)</enum><text>a letter identifying the lead State agency responsible for implementing the coal combustion residuals permit program, signed by the head of such agency;</text></clause> 
<clause id="H6087CC663F644F9696E4B7953324B94C"><enum>(ii)</enum><text>identification of any other State agencies involved with the implementation of the coal combustion residuals permit program;</text></clause> 
<clause commented="no" id="H5F77834CA54F42AEA27E5B91228C22FC"><enum>(iii)</enum><text display-inline="yes-display-inline">a narrative description that provides an explanation of how the State will ensure that the coal combustion residuals permit program meets the requirements of this section, including a description of the State’s—</text> 
<subclause id="HE4A3FD2CD549462890A703002A5B4743"><enum>(I)</enum><text display-inline="yes-display-inline">process to inspect or otherwise determine compliance with such permit program;</text></subclause> 
<subclause id="H733A095960614040AA2511442992E86F"><enum>(II)</enum><text>process to enforce the requirements of such permit program; and</text></subclause> 
<subclause id="H865A1C7E41294C58B1C47614A9538C4C"><enum>(III)</enum><text>public participation process for the promulgation, amendment, or repeal of regulations for, and the issuance of permits under, such permit program;</text></subclause></clause> 
<clause commented="no" id="H48CC3DE291634173AB6F278813B07B5D"><enum>(iv)</enum><text display-inline="yes-display-inline">a legal certification that the State has, at the time of certification, fully effective statutes or regulations necessary to implement a coal combustion residuals permit program that meets the specifications described in subsection (c)(1); and</text></clause> 
<clause id="HD00AF0949DE64BC19B7F0ACFD2B60A79"><enum>(v)</enum><text display-inline="yes-display-inline">copies of State statutes and regulations described in clause (iv).</text></clause></subparagraph></paragraph> 
<paragraph id="H3C4D4A7B213B44C28E33AE74ED5238BB"><enum>(3)</enum><header>Maintenance of 4005(c) or 3006 program</header><text>In order to adopt or implement a coal combustion residuals permit program under this section (including pursuant to subsection (f)), the State agency responsible for implementing a coal combustion residuals permit program in a State shall maintain an approved program under section 4005(c) or an authorized program under section 3006.</text></paragraph></subsection> 
<subsection id="H901DD748F72D4859A9E116E3A3D09CB8"><enum>(c)</enum><header>Permit program specifications</header> 
<paragraph id="H96D861B7B1854906B2D86BD97B3ABF1D"><enum>(1)</enum><header>Minimum requirements</header><text>The specifications described in this subsection for a coal combustion residuals permit program are as follows:</text> 
<subparagraph id="H366686E0FEA2483CA5E7978667F57702"><enum>(A)</enum><text display-inline="yes-display-inline">The revised criteria described in paragraph (2) shall apply to a coal combustion residuals permit program, except as provided in paragraph (3).</text></subparagraph> 
<subparagraph id="H2398DC4B589C4444BC3B090E69A1718C"><enum>(B)</enum><text display-inline="yes-display-inline">Each structure shall be, in accordance with generally accepted engineering standards for the structural integrity of such structures, designed, constructed, and maintained to provide for containment of the maximum volumes of coal combustion residuals appropriate for the structure. If a structure is determined by the head of the agency responsible for implementing the coal combustion residuals permit program to be deficient, the head of such agency has authority to require action to correct the deficiency according to a schedule determined by such agency. If the identified deficiency is not corrected according to such schedule, the head of such agency has authority to require that the structure close in accordance with subsection (h).</text></subparagraph> 
<subparagraph id="H9F76CF093C254325BFB733A924F4FA3E"><enum>(C)</enum><text>The coal combustion residuals permit program shall apply the revised criteria promulgated pursuant to section 4010(c) for location, design, groundwater monitoring, corrective action, financial assurance, closure, and post-closure described in paragraph (2) and the specifications described in this paragraph to surface impoundments.</text></subparagraph> 
<subparagraph id="H8FECC7E0F51B4C35B8612D79D26BDBC3"><enum>(D)</enum><text display-inline="yes-display-inline">If a structure that is classified as posing a high hazard potential pursuant to the guidelines published by the Federal Emergency Management Agency entitled <quote>Federal Guidelines for Dam Safety: Hazard Potential Classification System for Dams</quote> (FEMA Publication Number 333) is determined by the head of the agency responsible for implementing the coal combustion residuals permit program to be deficient with respect to the structural integrity requirement in subparagraph (B), the head of such agency has authority to require action to correct the deficiency according to a schedule determined by such agency. If the identified deficiency is not corrected according to such schedule, the head of such agency has authority to require that the structure close in accordance with subsection (h).</text></subparagraph> 
<subparagraph id="HF7916A8ACDD64DEDB0F32D822A1CEB29"><enum>(E)</enum><text display-inline="yes-display-inline">New structures that first receive coal combustion residuals after the date of enactment of this section shall be constructed with a base located a minimum of two feet above the upper limit of the natural water table.</text></subparagraph> 
<subparagraph id="H59744DF65D884250B86C73DAAAD513EB"><enum>(F)</enum><text>In the case of a coal combustion residuals permit program implemented by a State, the State has the authority to inspect structures and implement and enforce such permit program.</text></subparagraph> 
<subparagraph id="H067CF3C364A4490581CA241071E41DA4"><enum>(G)</enum><text display-inline="yes-display-inline">In the case of a coal combustion residuals permit program implemented by a State, the State has the authority to address wind dispersal of dust from coal combustion residuals by requiring dust control measures, as determined appropriate by the head of the lead State agency responsible for implementing the coal combustion residuals permit program.</text></subparagraph></paragraph> 
<paragraph id="H45499FC1201A4AE08BC338F5E4838C2E"><enum>(2)</enum><header>Revised criteria</header><text display-inline="yes-display-inline">The revised criteria described in this paragraph are—</text> 
<subparagraph id="H3C1FD86ACCFF4E52AF30D59890A48E83"><enum>(A)</enum><text>the revised criteria for design, groundwater monitoring, corrective action, closure, and post-closure, for structures, including—</text> 
<clause id="H62A31FD2223942EAB1190272E86EBB8A"><enum>(i)</enum><text>for new structures, and lateral expansions of existing structures, that first receive coal combustion residuals after the date of enactment of this section, the revised criteria regarding design requirements described in section 258.40 of title 40, Code of Federal Regulations; and</text></clause> 
<clause id="HDB5979B6B7174B20B281007029891639"><enum>(ii)</enum><text display-inline="yes-display-inline">for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria regarding groundwater monitoring and corrective action requirements described in subpart E of part 258 of title 40, Code of Federal Regulations, except that, for the purposes of this paragraph, such revised criteria shall also include—</text> 
<subclause id="HB8BC6A02110B46B0953322CB481A4D1D"><enum>(I)</enum><text display-inline="yes-display-inline">for the purposes of detection monitoring, the constituents boron, chloride, conductivity, fluoride, mercury, pH, sulfate, sulfide, and total dissolved solids; and</text></subclause> 
<subclause id="HF7B668886FD04268A06910D4096BCD36"><enum>(II)</enum><text display-inline="yes-display-inline">for the purposes of assessment monitoring, the constituents aluminum, boron, chloride, fluoride, iron, manganese, molybdenum, pH, sulfate, and total dissolved solids;</text></subclause></clause></subparagraph> 
<subparagraph commented="no" id="H1DDE17C6FA83441699725F0AC6BDCFA0"><enum>(B)</enum><text display-inline="yes-display-inline">the revised criteria for location restrictions described in—</text> 
<clause commented="no" id="HFA7F270D0BA340F882ACA309BBEC88F9"><enum>(i)</enum><text display-inline="yes-display-inline">for new structures, and lateral expansions of existing structures, that first receive coal combustion residuals after the date of enactment of this section, sections 258.11 through 258.15 of title 40, Code of Federal Regulations; and</text></clause> 
<clause commented="no" id="HD79ACDD454F044F2A397B516FE029158"><enum>(ii)</enum><text display-inline="yes-display-inline">for existing structures that receive coal combustion residuals after the date of enactment of this section, sections 258.11 and 258.15 of title 40, Code of Federal Regulations;</text></clause></subparagraph> 
<subparagraph id="H6590A7C3E1764B298477248147EB7D5D"><enum>(C)</enum><text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for air quality described in section 258.24 of title 40, Code of Federal Regulations;</text></subparagraph> 
<subparagraph id="HFC819A8389874132A30A0D38A7E4EFB8"><enum>(D)</enum><text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for financial assurance described in subpart G of part 258 of title 40, Code of Federal Regulations;</text></subparagraph> 
<subparagraph id="H9881A33BCB2F4E35A679136618DDF329"><enum>(E)</enum><text display-inline="yes-display-inline">for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for surface water described in section 258.27 of title 40, Code of Federal Regulations;</text></subparagraph> 
<subparagraph id="H185FD88EEAE74BBA879E00B6A3E1083C"><enum>(F)</enum><text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for recordkeeping described in section 258.29 of title 40, Code of Federal Regulations; </text></subparagraph> 
<subparagraph id="H4FEDC17C98114BDAB179C4E1D8394F8B"><enum>(G)</enum><text>for landfills and other land-based units, other than surface impoundments, that receive coal combustion residuals after the date of enactment of this section, the revised criteria for run-on and run-off control systems described in section 258.26 of title 40, Code of Federal Regulations; and</text></subparagraph> 
<subparagraph id="HF7C7B13A173A4631B962EE0C5814D4DC"><enum>(H)</enum><text>for surface impoundments that receive coal combustion residuals after the date of enactment of this section, the revised criteria for run-off control systems described in section 258.26(a)(2) of title 40, Code of Federal Regulations.</text></subparagraph></paragraph> 
<paragraph id="H5B4266EFED8A416BB15B85B2B10D6EB1"><enum>(3)</enum><header>Applicability of certain requirements</header><text display-inline="yes-display-inline">A State may determine that one or more of the requirements of the revised criteria described in paragraph (2) is not needed for the management of coal combustion residuals in that State, and may decline to apply such requirement as part of its coal combustion residuals permit program. If a State declines to apply a requirement under this paragraph, the State shall include in the certification under subsection (b)(2) a description of such requirement and the reasons such requirement is not needed in the State. If the Administrator determines that a State determination under this paragraph does not accurately reflect the needs for the management of coal combustion residuals in the State, the Administrator may treat such State determination as a deficiency under subsection (d).</text></paragraph></subsection> 
<subsection id="H2FF53A6CFE0D468BA2F5B772FC9F9844"><enum>(d)</enum><header>Written notice and opportunity to remedy</header> 
<paragraph id="H6000141DB51F4E5AA33AA3A90D7F08BA"><enum>(1)</enum><header>In general</header><text>The Administrator shall provide to a State written notice and an opportunity to remedy deficiencies in accordance with paragraph (2) if at any time the State—</text> 
<subparagraph id="H02F71DEA7E7747A6B11B9A97C7AEB3C2"><enum>(A)</enum><text>does not satisfy the notification requirement under subsection (b)(1);</text></subparagraph> 
<subparagraph id="HE9DC55CB6A1C454CB46D29708C403290"><enum>(B)</enum><text>has not submitted a certification under subsection (b)(2);</text></subparagraph> 
<subparagraph id="H47310B4FF06044B69F975F125F086C0B"><enum>(C)</enum><text>does not satisfy the maintenance requirement under subsection (b)(3); or</text></subparagraph> 
<subparagraph id="H38EAD89D95C44BC2A2E578EA59D3B83C"><enum>(D)</enum><text>is not implementing a coal combustion residuals permit program that meets the specifications described in subsection (c)(1).</text></subparagraph></paragraph> 
<paragraph id="H8C04150F0D89483E9FA08A0B5D67513E"><enum>(2)</enum><header>Contents of notice; deadline for response</header><text>A notice provided under this subsection shall—</text> 
<subparagraph id="H5D32E67F39F849478FA25DA70F1AB8D9"><enum>(A)</enum><text>include findings of the Administrator detailing any applicable deficiencies in—</text> 
<clause id="H01566E5D89F74315BD05A6DA21C816B2"><enum>(i)</enum><text>compliance by the State with the notification requirement under subsection (b)(1);</text></clause> 
<clause id="H171A74419DEA48A69B3BC5946BFEF7D0"><enum>(ii)</enum><text>compliance by the State with the certification requirement under subsection (b)(2);</text></clause> 
<clause id="HDEC41348278640C1AD7B1FB22D437EDF"><enum>(iii)</enum><text>compliance by the State with the maintenance requirement under subsection (b)(3); and</text></clause> 
<clause id="H41E0DCC1E6BE4137AC993D606530E2C2"><enum>(iv)</enum><text display-inline="yes-display-inline">the State coal combustion residuals permit program in meeting the specifications described in subsection (c)(1); and</text></clause></subparagraph> 
<subparagraph id="H041C805445A54841A7F28B36FE9BA11A"><enum>(B)</enum><text>identify, in collaboration with the State, a reasonable deadline, which shall be not sooner than 6 months after the State receives the notice, by which the State shall remedy the deficiencies detailed under subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="HE681A5AA7FFE4A1094DDFAEE7E5B94F6"><enum>(e)</enum><header>Implementation by Administrator</header> 
<paragraph id="H947B7223C6B54A4788AE19543B63548E"><enum>(1)</enum><header>In general</header><text>The Administrator shall implement a coal combustion residuals permit program for a State only in the following circumstances:</text> 
<subparagraph id="HA2282F5CE85846CEB2E65AD609841286"><enum>(A)</enum><text>If the Governor of such State notifies the Administrator under subsection (b)(1) that such State will not adopt and implement such a permit program.</text></subparagraph> 
<subparagraph id="H60D00B7E8B214368A523D2E6369BE3A1"><enum>(B)</enum><text>If such State has received a notice under subsection (d) and, after any review brought by the State under section 7006, fails, by the deadline identified in such notice under subsection (d)(2)(B), to remedy the deficiencies detailed in such notice under subsection (d)(2)(A).</text></subparagraph> 
<subparagraph id="H67C9AFF78F4C4A0182E5F30EDCC30638"><enum>(C)</enum><text>If such State informs the Administrator, in writing, that such State will no longer implement such a permit program.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H89761231340A4399A69A2671CF18ADD5"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">If the Administrator implements a coal combustion residuals permit program for a State under paragraph (1), such permit program shall consist of the specifications described in subsection (c)(1).</text></paragraph> 
<paragraph commented="no" id="H0324A4F26D1C4FA18C21D1AF521DB9AD"><enum>(3)</enum><header>Enforcement</header><text display-inline="yes-display-inline">If the Administrator implements a coal combustion residuals permit program for a State under paragraph (1), the authorities referred to in section 4005(c)(2)(A) shall apply with respect to coal combustion residuals and structures and the Administrator may use such authorities to inspect, gather information, and enforce the requirements of this section in the State.</text></paragraph></subsection> 
<subsection id="HBD44516058594A2EBAEBBA550D829104"><enum>(f)</enum><header>State control after implementation by Administrator</header> 
<paragraph id="HEF9E7948D70F4DBC8FA4D913804C5CB0"><enum>(1)</enum><header>State control</header> 
<subparagraph id="H8476C686B6944CFC946826AE3D99A76F"><enum>(A)</enum><header>New adoption and implementation by State</header><text>For a State for which the Administrator is implementing a coal combustion residuals permit program under subsection (e)(1)(A), the State may adopt and implement such a permit program by—</text> 
<clause id="H48B5E97285FC44BF9904E8DB94A4F0CA"><enum>(i)</enum><text>notifying the Administrator that the State will adopt and implement such a permit program;</text></clause> 
<clause id="HAA849525BACA40918ECA4EF456F58B2E"><enum>(ii)</enum><text>not later than 6 months after the date of such notification, submitting to the Administrator a certification under subsection (b)(2); and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HA52166C0A46E4750B1CA03B66A76EC95"><enum>(iii)</enum><text display-inline="yes-display-inline">receiving from the Administrator—</text> 
<subclause commented="no" id="HADB6527140494B9E9DE32712201B47DB"><enum>(I)</enum><text>a determination that the State coal combustion residuals permit program meets the specifications described in subsection (c)(1); and</text></subclause> 
<subclause commented="no" id="H9D47F6AFA4A240D19FC64275B532E2C4"><enum>(II)</enum><text>a timeline for transition of control of the coal combustion residuals permit program.</text></subclause></clause></subparagraph> 
<subparagraph id="H6CF8A053B2134A5993BDF2A570688E16"><enum>(B)</enum><header>Remedying deficient permit program</header><text>For a State for which the Administrator is implementing a coal combustion residuals permit program under subsection (e)(1)(B), the State may adopt and implement such a permit program by—</text> 
<clause id="H888F1BBA894A4787A87641C7937AB10D"><enum>(i)</enum><text>remedying the deficiencies detailed in the notice provided under subsection (d)(2)(A); and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H08934E8D85AB46F2BCF257F8AE82AD57"><enum>(ii)</enum><text display-inline="yes-display-inline">receiving from the Administrator—</text> 
<subclause commented="no" id="H4455F03193094E439A6E3F44F5225B85"><enum>(I)</enum><text>a determination that the deficiencies detailed in such notice have been remedied; and</text></subclause> 
<subclause commented="no" id="H7280CDB867E74E1F9CD3EF3DD3DCBD70"><enum>(II)</enum><text>a timeline for transition of control of the coal combustion residuals permit program.</text></subclause></clause></subparagraph> 
<subparagraph id="HC1EC427D2FEA4E55A159B711F5751320"><enum>(C)</enum><header>Resumption of implementation by State</header><text>For a State for which the Administrator is implementing a coal combustion residuals permit program under subsection (e)(1)(C), the State may adopt and implement such a permit program by—</text> 
<clause id="H2DE3C97E5E4A40C5892956B2227B88A2"><enum>(i)</enum><text>notifying the Administrator that the State will adopt and implement such a permit program;</text></clause> 
<clause id="H00A4D81CC54A42968F3BF182EBE2AEAB"><enum>(ii)</enum><text>not later than 6 months after the date of such notification, submitting to the Administrator a certification under subsection (b)(2); and</text></clause> 
<clause commented="no" id="HA24CCACDC468454895562860934EBEF7"><enum>(iii)</enum><text display-inline="yes-display-inline">receiving from the Administrator—</text> 
<subclause commented="no" id="H970CEEEE349F429AA2C8BE036412A10F"><enum>(I)</enum><text>a determination that the State coal combustion residuals permit program meets the specifications described in subsection (c)(1); and</text></subclause> 
<subclause commented="no" id="H38C29F66AB794806B405EFEE54A081ED"><enum>(II)</enum><text>a timeline for transition of control of the coal combustion residuals permit program.</text></subclause></clause></subparagraph></paragraph> 
<paragraph commented="no" id="HE23220CFFB72401989657B9FCE6F5095"><enum>(2)</enum><header>Review of determination</header> 
<subparagraph commented="no" id="H17EC05451A094E369297B2B34440E814"><enum>(A)</enum><header>Determination required</header><text>The Administrator shall make a determination under paragraph (1) not later than 90 days after the date on which the State submits a certification under paragraph (1)(A)(ii) or (1)(C)(ii), or notifies the Administrator that the deficiencies have been remedied pursuant to paragraph (1)(B)(i), as applicable.</text></subparagraph> 
<subparagraph commented="no" id="HDB838173D7AE4CF7831F303DA0745B95"><enum>(B)</enum><header>Review</header><text>A State may obtain a review of a determination by the Administrator under paragraph (1) as if such determination was a final regulation for purposes of section 7006.</text></subparagraph></paragraph> 
<paragraph id="H18A9108466214DBC9C66D58F392FA39D"><enum>(3)</enum><header>Implementation during transition</header> 
<subparagraph commented="no" id="H8528D20B5FE1401697F6B5E337303F93"><enum>(A)</enum><header>Effect on actions and orders</header><text display-inline="yes-display-inline">Actions taken or orders issued pursuant to a coal combustion residuals permit program shall remain in effect if—</text> 
<clause commented="no" id="H8344B37F99B944159700FA4C738A1380"><enum>(i)</enum><text>a State takes control of its coal combustion residuals permit program from the Administrator under paragraph (1); or</text></clause> 
<clause commented="no" id="H52BF5C585A444575A658A1C452ACA50A"><enum>(ii)</enum><text>the Administrator takes control of a coal combustion residuals permit program from a State under subsection (e).</text></clause></subparagraph> 
<subparagraph id="HB71F48D88CFC411AAFF1F36F4F820AC0"><enum>(B)</enum><header>Change in requirements</header><text>Subparagraph (A) shall apply to such actions and orders until such time as the Administrator or the head of the lead State agency responsible for implementing the coal combustion residuals permit program, as applicable—</text> 
<clause id="H92AD0D4CD19F44D5B3C15AC8B1744C27"><enum>(i)</enum><text>implements changes to the requirements of the coal combustion residuals permit program with respect to the basis for the action or order; or</text></clause> 
<clause id="H483AE73CF32E446A93445E401CF942AC"><enum>(ii)</enum><text>certifies the completion of a corrective action that is the subject of the action or order.</text></clause></subparagraph></paragraph> 
<paragraph id="HEE075FF733A844C5B6B906A9F1F32424"><enum>(4)</enum><header>Single permit program</header><text>If a State adopts and implements a coal combustion residuals permit program under this subsection, the Administrator shall cease to implement the permit program implemented under subsection (e) for such State.</text></paragraph></subsection> 
<subsection id="H744BF58242144212A553C3D8AFEE2468"><enum>(g)</enum><header>Effect on determination under 4005(c) or 3006</header><text>The Administrator shall not consider the implementation of a coal combustion residuals permit program by the Administrator under subsection (e) in making a determination of approval for a permit program or other system of prior approval and conditions under section 4005(c) or of authorization for a program under section 3006.</text></subsection> 
<subsection id="HF7BE90610F5D485E9094C95BDFD236AE"><enum>(h)</enum><header>Closure</header><text display-inline="yes-display-inline">If it is determined, pursuant to a coal combustion residuals permit program, that a structure should close, the time period and method for the closure of such structure shall be set forth in a closure plan that establishes a deadline for completion and that takes into account the nature and the site-specific characteristics of the structure to be closed. In the case of a surface impoundment, the closure plan shall require, at a minimum, the removal of liquid and the stabilization of remaining waste, as necessary to support the final cover.</text></subsection> 
<subsection id="H91E4710B121F4F258D93A2CA04CBFE00"><enum>(i)</enum><header>Authority</header> 
<paragraph id="H28A4F83B36D64664BEB198C0218B71BC"><enum>(1)</enum><header>State authority</header><text>Nothing in this section shall preclude or deny any right of any State to adopt or enforce any regulation or requirement respecting coal combustion residuals that is more stringent or broader in scope than a regulation or requirement under this section.</text></paragraph> 
<paragraph id="H7BE5725F68604C7595837136B422D2C0"><enum>(2)</enum><header>Authority of the administrator</header> 
<subparagraph id="HA38BDA50F8E74FBB804B5316F19D0EF1"><enum>(A)</enum><header>In general</header><text>Except as provided in subsection (e) of this section and section 6005 of this title, the Administrator shall, with respect to the regulation of coal combustion residuals, defer to the States pursuant to this section.</text></subparagraph> 
<subparagraph id="HDA002556004445108058276DCAE438B1"><enum>(B)</enum><header>Imminent hazard</header><text>Nothing in this section shall be construed to affect the authority of the Administrator under section 7003 with respect to coal combustion residuals.</text></subparagraph> 
<subparagraph id="H54F44DABD25E43CB8C8F53E416D16AE5"><enum>(C)</enum><header>Technical and enforcement assistance only upon request</header><text display-inline="yes-display-inline">Upon request from the head of a lead State agency that is implementing a coal combustion residuals permit program, the Administrator may provide to such State agency only the technical or enforcement assistance requested.</text></subparagraph></paragraph> 
<paragraph id="H3CBB2DC0B64946929158360381D600FF"><enum>(3)</enum><header>Citizen suits</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to affect the authority of a person to commence a civil action in accordance with section 7002.</text></paragraph></subsection> 
<subsection id="H146977053066427592EC4C59219F6636"><enum>(j)</enum><header>Mine reclamation activities</header><text>A coal combustion residuals permit program implemented under subsection (e) by the Administrator shall not apply to the utilization, placement, and storage of coal combustion residuals at surface mining and reclamation operations.</text></subsection> 
<subsection id="H4F50FDD17D95476C9397C6484413AC89"><enum>(k)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H19E18EE021AF4F9487CEEA0BB5D50987"><enum>(1)</enum><header>Coal combustion residuals</header><text>The term <term>coal combustion residuals</term> means—</text> 
<subparagraph id="HA9272BEED8D34826A1BDC12758B0C6D7"><enum>(A)</enum><text>the solid wastes listed in section 3001(b)(3)(A)(i), including recoverable materials from such wastes;</text></subparagraph> 
<subparagraph id="H6F43FB05AF204AFF8E3581910AA32C2C"><enum>(B)</enum><text>coal combustion wastes that are co-managed with wastes produced in conjunction with the combustion of coal, provided that such wastes are not segregated and disposed of separately from the coal combustion wastes and comprise a relatively small proportion of the total wastes being disposed in the structure;</text></subparagraph> 
<subparagraph id="HA2B620893279434E8245F70B1C652B68"><enum>(C)</enum><text>fluidized bed combustion wastes;</text></subparagraph> 
<subparagraph id="HF913CB99E9E64312918A3D69198B9BA6"><enum>(D)</enum><text>wastes from the co-burning of coal with non-hazardous secondary materials provided that coal makes up at least 50 percent of the total fuel burned; and</text></subparagraph> 
<subparagraph id="H68CA80770BB047DEAA57485AB6D4A749"><enum>(E)</enum><text>wastes from the co-burning of coal with materials described in subparagraph (A) that are recovered from monofills.</text></subparagraph></paragraph> 
<paragraph id="H3CF3AEDF3BCE4DDFA6B0065BC0BB0427"><enum>(2)</enum><header>Coal combustion residuals permit program</header><text>The term <term>coal combustion residuals permit program</term> means a permit program or other system of prior approval and conditions that is adopted by or for a State for the management and disposal of coal combustion residuals to the extent such activities occur in structures in such State.</text></paragraph> 
<paragraph id="H0B8B2CC6DC9E4A1DB060EDED60A08EFF"><enum>(3)</enum><header>Structure</header><text>The term <term>structure</term> means a landfill, surface impoundment, or other land-based unit which may receive coal combustion residuals.</text></paragraph> 
<paragraph id="H1A7E477D182B46389C9E0A2378F61666"><enum>(4)</enum><header>Revised criteria</header><text display-inline="yes-display-inline">The term <term>revised criteria</term> means the criteria promulgated for municipal solid waste landfill units under section 4004(a) and under section 1008(a)(3), as revised under section 4010(c) in accordance with the requirement of such section that the criteria protect human health and the environment.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3DF6E08156C94EF6A4F53EBF0E392706"><enum>(b)</enum><header>2000 regulatory determination</header><text>Nothing in this section, or the a<editorial></editorial>mendments made by this section, shall be construed to alter in any manner the Environmental Protection Agency’s regulatory determination entitled <quote>Notice of Regulatory Determination on Wastes from the Combustion of Fossil Fuels</quote>, published at 65 Fed. Reg. 32214 (May 22, 2000), that the fossil fuel combustion wastes addressed in that determination do not warrant regulation under subtitle C of the Solid Waste Disposal Act (42 U.S.C. 6921 et seq.).</text></subsection> 
<subsection id="H4CE50010FD2B4906917CD5031F442DDA"><enum>(c)</enum><header>Conforming Amendment</header><text>The table of contents contained in section 1001 of the Solid Waste Disposal Act is amended by inserting after the item relating to section 4010 the following:</text>

<section id="H6036E22E88CB4375B5DC1C621313B605"><enum>601.</enum><header>Amendments to title 23, United States Code</header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this title an amendment or repeal is expressed in terms of an amendment to, or a repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of title 23, United States Code.</text></section> 
<section id="H6A7BCC0779B6485E8FF34214D1DC00F8"><enum>602.</enum><header>Declaration of policy</header> 
<subsection id="HA491FBD10B2C4E749E6E1AEF102E169D"><enum>(a)</enum><header>Expedited project delivery</header><text>Section 101(b) is amended by adding at the end the following:</text> 
<quoted-block id="HDE39A6BA41624713845D4C9245762CAF" style="OLC"> 
<paragraph id="H64C44295583648588B8E5676F6A708B3"><enum>(4)</enum><header>Expedited project delivery</header><text>Congress declares that it is in the national interest to expedite the delivery of surface transportation projects by substantially reducing the average length of the environmental review process. Accordingly, it is the policy of the United States that—</text> 
<subparagraph id="HEB95C687DF5C4123A484F52A18E4C301"><enum>(A)</enum><text>the Secretary shall have the lead role among Federal agencies in carrying out the environmental review process for surface transportation projects;</text></subparagraph> 
<subparagraph id="H11BF2D70A60047BCB42AF3EDB820F03F"><enum>(B)</enum><text>each Federal agency shall cooperate with the Secretary to expedite the environmental review process for surface transportation projects;</text></subparagraph> 
<subparagraph id="HDAA396AE77ED404CBCC0739873887EAF"><enum>(C)</enum><text>there shall be a presumption that the mode, facility type, and corridor location for a surface transportation project will be determined in the transportation planning process, as established in sections 134 and 135 and sections 5303 and 5304 of title 49;</text></subparagraph> 
<subparagraph id="H2D0AAE06BA9B4ABC987687180DA43311"><enum>(D)</enum><text>project sponsors shall not be prohibited from carrying out pre-construction project development activities concurrently with the environmental review process;</text></subparagraph> 
<subparagraph id="HB9D7016DA1584F3E94EB3F072A000168"><enum>(E)</enum><text>programmatic approaches shall be used, to the maximum extent possible, to reduce the need for project-by-project reviews and decisions by Federal agencies; and</text></subparagraph> 
<subparagraph id="HF3F491744FE24689B48DACCC214A8691"><enum>(F)</enum><text>the Secretary shall actively support increased opportunities for project sponsors to assume responsibilities of the Secretary in carrying out the environmental review process.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H7B450D71C22F4BE684B6254A68741C66" commented="no"><enum>603.</enum><header>Exemption in emergencies</header><text display-inline="no-display-inline"> If any road, highway, or bridge is in operation or under construction when damaged by an emergency declared by the Governor of the State and concurred in by the Secretary, or declared by the President pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121), and is reconstructed in the same location with the same capacity, dimensions, and design as before the emergency, then that reconstruction project shall be exempt from any further environmental reviews, approvals, licensing, and permit requirements under—</text>

<paragraph id="HBCE166BE4E414FF78BCF0BF2BAC05175" commented="no"><enum>(3)</enum><text>the National Historic Preservation Act (16 U.S.C. 470 et seq.);</text></paragraph> 
<paragraph id="H0B691FC6210748AF888CD9FB4AE6720C" commented="no"><enum>(4)</enum><text>the Migratory Bird Treaty Act (16 U.S.C. 703 et seq.);</text></paragraph>

<subsection id="H487070B07BDE446B9B4FD061BC9FFDC0"><enum>(d)</enum><header>Federally funded early acquisition of real property interests</header> 
<paragraph id="HEF7A8F8B1FC64412AE071F20033BFCE7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may authorize the use of Federal funds for the acquisition of a real property interest by a State. For purposes of this subsection, an acquisition of a real property interest includes the acquisition of any interest in land, including the acquisition of a contractual right to acquire any interest in land, or any other similar action to acquire or preserve rights-of-way for a transportation facility.</text></paragraph> 
<paragraph id="H61C1023362F044A0B29D3D96C99E1938"><enum>(2)</enum><header>State certification</header><text>A State requesting Federal funding for an acquisition of a real property interest shall certify in writing that—</text> 
<subparagraph id="HC95606275E1546F6862C8A2F0A7812E5"><enum>(A)</enum><text display-inline="yes-display-inline">the State has authority to acquire the real property interest under State law;</text></subparagraph> 
<subparagraph id="H81FDDF54BCDE4A0D89EED6E04125A7EC"><enum>(B)</enum><text display-inline="yes-display-inline">the acquisition of the real property interest is for a transportation purpose; and</text></subparagraph> 
<subparagraph id="HD6065608E91C4D0589AE37FAAB0AEAC9"><enum>(C)</enum><text>the State acknowledges that early acquisition will not be considered by the Secretary in the environmental assessment of a project, the decision relative to the need to construct a project, or the selection of a project design or location.</text></subparagraph></paragraph> 
<paragraph id="HE3AEC1C18C8341E28E6F8DD5C2A519C9"><enum>(3)</enum><header>Environmental compliance</header><text display-inline="yes-display-inline">Before authorizing Federal funding for an acquisition of a real property interest, the Secretary shall complete for the acquisition the review process under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.). For purposes of the review process, the acquisition of a real property interest shall be treated as having independent utility and does not limit consideration of alternatives for future transportation improvements with respect to the real property interest.</text></paragraph> 
<paragraph id="H2B53EAE494584559B4644451B806CBA9"><enum>(4)</enum><header>Programming</header><text display-inline="yes-display-inline">The acquisition of a real property interest for which Federal funding is requested shall be included as a project in an applicable transportation improvement program under sections 134 and 135 and sections 5303 and 5304 of title 49. The acquisition project may be included in the transportation improvement program on its own, without including the future construction project for which the real property interest is being acquired. The acquisition project may consist of the acquisition of a specific parcel, a portion of a transportation corridor, or an entire transportation corridor.</text></paragraph> 
<paragraph id="HBA929FBD867149A8BA6F9BD7AA9D2D7C"><enum>(5)</enum><header>Other requirements</header><text display-inline="yes-display-inline">The acquisition of a real property interest shall be carried out in compliance with all requirements applicable to the acquisition of real property interests for federally funded transportation projects.</text></paragraph></subsection> 
<subsection id="HBEA873453B8B4890A416CA0FE2C6ACF4"><enum>(e)</enum><header>Consideration of long-Range transportation needs</header><text display-inline="yes-display-inline">The Secretary shall encourage States and other public authorities, if practicable, to acquire transportation real property interests that are sufficient to accommodate long-range transportation needs and, if possible, to do so through the acquisition of broad real property interests that have the capacity for expansion over a 50- to 100-year period and the potential to accommodate one or more transportation modes.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HE3A1FCCAA54B49969A43880B7A6E5F2A"><enum>605.</enum><header>Standards</header><text display-inline="no-display-inline">Section 109 is amended by adding at the end the following:</text>

<subsection id="H3D7D68C907A348788F399040F4C6F051"><enum>(r)</enum><header>Undertaking design activities before completion of environmental review process</header><text></text> 
<paragraph id="H39EA36AE60DA49FE8896BA72E5617814"><enum>(1)</enum><header>In general</header><text>A State may carry out, at the expense of the State, design activities at any level of detail for a project before completion of the review process required for the project under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) without affecting subsequent approvals of the project.</text></paragraph> 
<paragraph id="H2AF9A48CF9F347938695DCDBF9A2D338"><enum>(2)</enum><header>Eligibility for reimbursement</header><text>Subject to <internal-xref idref="H6D3C30AF476B4C7CAC221D3B02F71A26" legis-path="(r)(3)">paragraph (3)</internal-xref>, funds apportioned to a State under this title may be used to participate in the payment of costs incurred by the State for design activities, if the results of the activities are subsequently incorporated (in whole or in substantial part) into a project eligible for surface transportation program funds.</text></paragraph> 
<paragraph id="H6D3C30AF476B4C7CAC221D3B02F71A26"><enum>(3)</enum><header>Terms and conditions</header><text>The Federal share payable of the costs described in <internal-xref idref="H2AF9A48CF9F347938695DCDBF9A2D338" legis-path="(r)(2)">paragraph (2)</internal-xref> shall be eligible for reimbursement out of funds apportioned to a State under this title when the design activities are incorporated (in whole or in substantial part) into a project eligible for surface transportation program funds, if the State demonstrates to the Secretary and the Secretary finds that—</text> 
<subparagraph id="HF30D417AB37A4F06BCFCAEA065B6A8BE"><enum>(A)</enum><text>before the time that the cost incurred by a State is approved for Federal participation, environmental compliance pursuant to the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) has been completed for the project for which the design activities were conducted by the State; and</text></subparagraph> 
<subparagraph id="HE708A52C36F64073B529B775C29F298B"><enum>(B)</enum><text>the design activities conducted pursuant to this subsection did not preclude the consideration of alternatives to the project.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H7B5525956AA4476995AFD28BC84FC756"><enum>606.</enum><header>Letting of contracts</header> 
<subsection id="H8F0F0F402062462B8BEC7D3623F79CED"><enum>(a)</enum><header>Bidding requirements</header><text display-inline="yes-display-inline">Section 112(b)(1) is amended to read as follows:</text>

<paragraph id="H0455D3ECEA50445AB22E6FFEB6145A08"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H48F9E9035DB345F7A450F451A0B3F07E"><enum>(A)</enum><header>Competitive bidding requirement</header><text display-inline="yes-display-inline">Subject to paragraphs (2), (3), and (4), construction of each project, subject to the provisions of subsection (a), shall be performed by contract awarded by competitive bidding, unless the State transportation department demonstrates, to the satisfaction of the Secretary, that some other method is more cost effective or that an emergency exists.</text></subparagraph> 
<subparagraph id="HB01BA6C4CBFF4653AD1F4506B8240CC2"><enum>(B)</enum><header>Basis of award</header> 
<clause id="HA2E44360E18D4ACFB2549910FC8352FF"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Contracts for the construction of each project shall be awarded only on the basis of the lowest responsive bid submitted by a bidder meeting established criteria of responsibility.</text></clause> 
<clause id="HA6352C86622E41EC989D46A97601A159"><enum>(ii)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No requirement or obligation shall be imposed as a condition precedent to the award of a contract to such bidder for a project, or to the Secretary’s concurrence in the award of a contract to such bidder, unless such requirement or obligation is otherwise lawful and is specifically set forth in the advertised specifications.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H391052F74217423B9C6AD8CBA17DD8C0"><enum>(b)</enum><header>Design-build contracting</header><text display-inline="yes-display-inline">Section 112(b)(3) is amended—</text>

<subsection id="HBF304A7763A143669179095F902123FF"><enum>(c)</enum><header>Efficiencies in contracting</header><text display-inline="yes-display-inline">Section 112(b) is amended by adding at the end the following:</text>

<clause id="H152CFB59A49949658E58E6EC541191C7"><enum>(i)</enum><header>Two-phase contract</header><text display-inline="yes-display-inline">A contracting agency may award a two-phase contract for preconstruction and construction services.</text></clause> 
<clause id="HB874F15AC5E34ECAB629663B7094C11C"><enum>(ii)</enum><header>Pre-construction services phase</header><text display-inline="yes-display-inline">In the pre-construction services phase, the contractor shall provide the contracting agency with advice for scheduling, work sequencing, cost engineering, constructability, cost estimating, and risk identification.</text></clause> 
<clause id="HE948A6DBADC543C698D8CB0CF374643B"><enum>(iii)</enum><header>Agreement</header><text display-inline="yes-display-inline">Prior to the start of the construction services phase, the contracting agency and the contractor may agree to a price and other factors specified in regulation for the construction of the project or a portion of the project.</text></clause> 
<clause id="H83294312B15F4BDF847D1A31A60332E6"><enum>(iv)</enum><header>Construction phase</header><text display-inline="yes-display-inline">If an agreement is reached under <internal-xref idref="HE948A6DBADC543C698D8CB0CF374643B" legis-path="(4)(A)(iii)">clause (iii)</internal-xref>, the contractor shall be responsible for the construction of the project or portion of the project at the negotiated price and other factors specified in regulation.</text></clause></subparagraph> 
<subparagraph id="HDE85FBA16F31457296F1BE8CCC620EC4"><enum>(B)</enum><header>Selection</header><text display-inline="yes-display-inline">A contract shall be awarded to a contractor using a competitive selection process based on qualifications, experience, best value, or any other combination of factors considered appropriate by the contracting agency.</text></subparagraph> 
<subparagraph id="HC09C7EB709514FA292B4B31CE4A50436"><enum>(C)</enum><header>Timing</header> 
<clause id="H6C7D7F6D35E64CA18BD77B974B446B62"><enum>(i)</enum><header>Relationship to NEPA process</header><text display-inline="yes-display-inline">Prior to the completion of the process required under section 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4332), a contracting agency may—</text> 
<subclause id="H6E3D1D84106446699EF00A6E13487263"><enum>(I)</enum><text>issue requests for proposals;</text></subclause> 
<subclause id="H7F9497A1F1474A0882B5812D29E0F57B"><enum>(II)</enum><text>proceed with the award of a contract for preconstruction services under subparagraph (A); and</text></subclause> 
<subclause id="HBCEECA0EA0D3406796EAEA3AF9072738"><enum>(III)</enum><text>issue notices to proceed with a preliminary design and any work related to preliminary design.</text></subclause></clause> 
<clause id="HDA406317B8E946289643B8E428B1E517"><enum>(ii)</enum><header>Preconstruction services phase</header><text display-inline="yes-display-inline">If the preconstruction services phase of a contract under subparagraph (A)(ii) focuses primarily on one alternative, the Secretary shall require that the contract include appropriate provisions to achieve the objectives of section 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4332) and comply with other applicable Federal laws and regulations.</text></clause> 
<clause id="H177C99E9337647AD9816188D10DB2014"><enum>(iii)</enum><header>Construction services phase</header><text display-inline="yes-display-inline">A contracting agency may not proceed with the award of the construction services phase of a contract under subparagraph (A)(iv) and may not proceed, or permit any consultant or contractor to proceed, with construction until completion of the process required under section 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4332).</text></clause> 
<clause id="H5FCBED252AE84A67B8D9B1CCF98378E8"><enum>(iv)</enum><header>Approval requirement</header><text display-inline="yes-display-inline">Prior to authorizing construction activities, the Secretary shall approve the contracting agency’s price estimate for the entire project, as well as any price agreement with the general contractor for the project or a portion of the project.</text></clause> 
<clause id="HAB4A88BD2886499CB2EF2C4441C65399"><enum>(v)</enum><header>Design activities</header><text display-inline="yes-display-inline">A contracting agency may proceed, at its expense, with design activities at any level of detail for a project before completion of the review process required for the project under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) without affecting subsequent approvals required for the project. Design activities carried out under this clause shall be eligible for Federal reimbursement as a project expense in accordance with the requirements under section 109(r). </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H2FF37F678BB7421D8BDEE737DA68BC34"><enum>(b)</enum><header>Policy on lands, wildlife and waterfowl refuges, and historic sites</header><text>Section 303 of title 49, United States Code, is amended by adding at the end the following:</text>

<subparagraph id="H0D49948B23334596A4749552E8C6AAE7"><enum>(B)</enum><text>are less than $10,000,000.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H632AF46A7A8A4B6DB604EF410717143B"><enum>609.</enum><header>Efficient environmental reviews for project decisionmaking</header> 
<subsection id="HDA902087EFEE45CE911CE5B4CF0152F7"><enum>(a)</enum><header>Flexibility</header><text display-inline="yes-display-inline">Section 139(b) is further amended—</text> 
<paragraph id="HFFE63E16B7ED489189B630BA5FC56391"><enum>(1)</enum><text>in paragraph (2) by inserting <quote>, and any requirements established in this section may be satisfied,</quote> after <quote>exercised</quote>; and</text></paragraph>

<subsection id="H958FFE0677DF4EAE93DA354C712E3C0A"><enum>(b)</enum><header>Federal lead agency</header><text display-inline="yes-display-inline">Section 139(c) is amended—</text>

<subsection id="H563F3C679C954297AA420B471924075C"><enum>(d)</enum><header>Project initiation</header><text display-inline="yes-display-inline">Section 139(e) is amended by adding at the end the following: <quote>The project sponsor may satisfy this requirement by submitting to the Secretary a draft notice for publication in the Federal Register announcing the preparation of an environmental impact statement for the project.</quote>.</text></subsection>

<subclause id="H7F005980295F49F99D4280B398C761D7"><enum>(I)</enum><text>in any prior State or Federal environmental document with regard to the applicable long-range transportation plan or transportation improvement program; or</text></subclause> 
<subclause id="H75B66BF23F6A476EA4982B4FA5E96E38" commented="no"><enum>(II)</enum><text>after the preparation of a programmatic or tiered environmental document that evaluated alternatives to the project.</text></subclause></clause> 
<clause id="HBB6DE65D861F4ECE837555394687A781"><enum>(iv)</enum><header>Legal sufficiency</header><text>The evaluation of the range of alternatives shall be deemed legally sufficient if the environmental document complies with the requirements of this paragraph.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>

<clause id="HD8A203B030D64E55815D8C43D106388F"><enum>(ii)</enum><header>Legal sufficiency</header><text>The evaluation of cumulative impacts and growth inducing impacts shall be deemed legally sufficient if the environmental document complies with the requirements of this paragraph.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>

<subparagraph id="H95DE132AA3B1470FBB7B846E4DB5DA52"><enum>(B)</enum><header>Adoption of determination</header><text>If the participating agency concurs or does not object within the 30-day period, the participating agency shall adopt the lead agency’s determination for purposes of any reviews, approvals, or other actions taken by the participating agency as part of the environmental review process for the project.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5B15342C53654F20989DEC305795BE48"><enum>(f)</enum><header>Coordination plan</header><text display-inline="yes-display-inline">Section 139(g) is amended—</text> 
<paragraph id="H25D3C3549E464E27ABB755A14AFC29ED"><enum>(1)</enum><text>in paragraph (1)(A) by striking <quote>project or category of projects</quote> and inserting <quote>project, category of projects, or program of projects</quote>;</text></paragraph>

<subparagraph id="H03C30DDABC87417AB57B0AD370E36E00"><enum>(B)</enum><header>Other deadlines</header><text display-inline="yes-display-inline">With regard to any determination or approval of a participating agency that is not subject to <internal-xref idref="H816D7055BDF54F588A092114A3D36C5C" legis-path="(3)(A)">subparagraph (A)</internal-xref>, each participating agency shall make any required determination regarding or otherwise approve or disapprove the project not later than 90 days after the date that the lead agency approves the record of decision or finding of no significant impact for the project, or not later than such other date that is otherwise required by law, whichever occurs first.</text></subparagraph> 
<subparagraph id="HD71CE8A2284E45D4B3EEE905BE095FB5"><enum>(C)</enum><header>Deemed approved</header><text>In the event that any participating agency fails to make a determination or approve or disapprove the project within the applicable deadline described in subparagraphs (A) and (B), the project shall be deemed approved by such participating agency, and such approval shall be deemed to comply with the applicable requirements of Federal law.</text></subparagraph> 
<subparagraph id="H302B6F940505491BAB715F8D5D950B35"><enum>(D)</enum><header>Written finding</header><text>The Secretary may issue a written finding verifying the approval made in accordance with this paragraph.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5DD6538578F148FCB0F5CEFFBDC77C1D"><enum>(3)</enum><text>by striking paragraph (4).</text></paragraph></subsection>

<subsection id="H7730E9BEA9094973966E3B1CAD897FB0"><enum>(h)</enum><header>Streamlined documentation and decisionmaking</header><text>Section 139 is amended—</text> 
<paragraph id="H3911FE851FA44A1FA7DEA2D9B6AD5A83"><enum>(1)</enum><text>by redesignating subsections (i) through (l) as subsections (k) through (n), respectively; and</text></paragraph> 
<paragraph id="H8E13C8E25D3F4153913AC0D30EDEE31C"><enum>(2)</enum><text>by inserting after subsection (h) the following:</text>

<paragraph id="H6F8E9D24AF81423BBD0A26F7011EB16C"><enum>(2)</enum><header>Condensed format</header><text>A condensed final environmental impact statement for a project in the environmental review process shall consist only of—</text> 
<subparagraph id="H9ADD412EB0C9427BBFDEA682634947FC"><enum>(A)</enum><text>an incorporation by reference of the draft environmental impact statement;</text></subparagraph> 
<subparagraph id="HC77358F3B5E04F76ABE05727EF909903"><enum>(B)</enum><text>any updates to specific pages or sections of the draft environmental impact statement as appropriate; and</text></subparagraph> 
<subparagraph id="H6AD211C498874498853878B91148E03F"><enum>(C)</enum><text>responses to comments on the draft environmental impact statement and copies of the comments.</text></subparagraph></paragraph> 
<paragraph id="H4F40AC793F13426B9DAA74053A45B8E7"><enum>(3)</enum><header>Timing of decision</header><text>Notwithstanding any other provision of law, in conducting the environmental review process for a project, the lead agency shall combine a final environmental impact statement and a record of decision for the project into a single document if—</text> 
<subparagraph id="HBE709EDF1FD74AF9987BC1A159214E96"><enum>(A)</enum><text>the alternative approved in the record of decision is either a preferred alternative that was identified in the draft environmental impact statement or is a modification of such preferred alternative that was developed in response to comments on the draft environmental impact statement;</text></subparagraph> 
<subparagraph id="HD7B81884F7FD437ABD40F651923CAD87"><enum>(B)</enum><text>the Secretary has received a certification from a State under section 128, if such a certification is required for the project; and</text></subparagraph> 
<subparagraph id="H984CC92723164DD3BDBCDA5E016A9812"><enum>(C)</enum><text>the Secretary determines that the lead agency, participating agency, or the project sponsor has committed to implement the measures applicable to the approved alternative that are identified in the final environmental impact statement.</text></subparagraph></paragraph></subsection> 
<subsection id="HAB97AD62EEC141989BBD1CEEB5F124D3"><enum>(j)</enum><header>Supplemental environmental review and re-Evaluation</header> 
<paragraph id="H71E2DACF8B024952BAACD67B406A6DF7"><enum>(1)</enum><header>Supplemental environmental review</header><text>After the approval of a record of decision or finding of no significant impact with regard to a project, an agency may not require the preparation of a subsequent environmental document for such project unless the lead agency determines that—</text> 
<subparagraph id="H433BE754C7E746BB99DDDC995849A870"><enum>(A)</enum><text>changes to the project will result in new significant impacts that were not evaluated in the environmental document; or</text></subparagraph> 
<subparagraph id="H2DFE760DFA3F48C98F0ABF5063243137"><enum>(B)</enum><text>new information has become available or changes in circumstances have occurred after the lead agency approval of the project that will result in new significant impacts that were not evaluated in the environmental document.</text></subparagraph></paragraph> 
<paragraph id="H4BD66909A7F745989CB059AE02D10CB1"><enum>(2)</enum><header>Re-evaluations</header><text display-inline="yes-display-inline">The Secretary may only require the re-evaluation of a document prepared under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) if—</text> 
<subparagraph id="HE9A27D15F8B44EADBAD7306D9367759D"><enum>(A)</enum><text>the Secretary determines that the events in paragraph (1)(A) or (1)(B) apply; and</text></subparagraph> 
<subparagraph id="H673BCF6BC3DA4728B49A1689FD58DBC3"><enum>(B)</enum><text>more than 5 years has elapsed since the Secretary’s prior approval of the project or authorization of project funding. </text></subparagraph></paragraph> 
<paragraph id="H89B61E11A41E4E1EAD97959DE3EF8132"><enum>(3)</enum><header>Change to record of decision</header><text display-inline="yes-display-inline">After the approval of a record of decision, the Secretary may not require the record of decision to be changed solely because of a change in the fiscal circumstances surrounding the project.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0A1596B91A53458A93F94E752805D41D"><enum>(i)</enum><header>Regulations</header><text>Section 139(m) (as redesignated by <internal-xref idref="H7730E9BEA9094973966E3B1CAD897FB0" legis-path="408.(h)">subsection (h)(1)</internal-xref> of this section) is further amended to read as follows: </text>

<paragraph id="H6037B3CCCAF147AC84E5DF135836F80B"><enum>(2)</enum><header>Compliance with applicable law</header><text>Any environmental document that utilizes the methodologies and procedures established under this subsection shall be deemed to comply with the applicable requirements of—</text> 
<subparagraph id="H57BC2CB71F9147179CD3AE9195667C95"><enum>(A)</enum><text>the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) or its implementing regulations; or</text></subparagraph> 
<subparagraph id="HA35831EBB40F4865A0790E5F4FF361C1"><enum>(B)</enum><text>any other Federal environmental statute applicable to transportation projects.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<paragraph id="HA6214BA2766E4F1DAB5B90142336255E"><enum>(2)</enum><header>Planning product</header><text>The term <quote>planning product</quote> means any decision, analysis, study, or other documented result of an evaluation or decisionmaking process carried out during transportation planning.</text></paragraph> 
<paragraph id="HBAA363A64A754264A47CE7DC8E3D83D7"><enum>(3)</enum><header>Project</header><text>The term <quote>project</quote> means any highway project or program of projects, public transportation capital project or program of projects, or multimodal project or program of projects that requires the approval of the Secretary.</text></paragraph> 
<paragraph id="H168D15811BD04BB09B86AE253F5CA4BE"><enum>(4)</enum><header>Project sponsor</header><text>The term <quote>project sponsor</quote> means the agency or other entity, including any private or public-private entity, that seeks approval of the Secretary for a project.</text></paragraph></subsection>

<subparagraph id="HF94B0677F9D84470BE070AF85100ED65"><enum>(C)</enum><text>reduce duplication in work;</text></subparagraph>

<subparagraph id="H11802EAE667D4CB2B7308908249FB5CC"><enum>(A)</enum><text display-inline="yes-display-inline">This section is consistent with and is adopted in furtherance of sections 101 and 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4331 and 4332) and section 109 of this title.</text></subparagraph>

<paragraph id="H1078B1E5C4834325AD9396829C3066CD"><enum>(2)</enum><header>Partial adoption of planning products</header><text>The Federal lead agency may adopt a planning product under <internal-xref idref="H68733404E90A4BA6876CC236D453B614" legis-path="167.(c)(1)">paragraph (1)</internal-xref> in its entirety or may select portions for adoption.</text></paragraph> 
<paragraph id="H8BCD0C25A34D4860B2C2B43E83BC603E"><enum>(3)</enum><header>Timing</header><text>A determination under <internal-xref idref="H68733404E90A4BA6876CC236D453B614" legis-path="167.(c)(1)">paragraph (1)</internal-xref> with respect to the adoption of a planning product shall be made at the time the lead agencies decide the appropriate scope of environmental review for the project.</text></paragraph></subsection> 
<subsection id="H49A2927D226B46F8B837A3D029D26D8B"><enum>(d)</enum><header>Applicability</header><text></text> 
<paragraph id="HB75813A9B1364F66BB2C973AE2E02A34"><enum>(1)</enum><header>Planning decisions</header><text>Planning decisions that may be adopted pursuant to this section include—</text> 
<subparagraph id="H567C174925714C8DB0D4FE68009A8CE0"><enum>(A)</enum><text>a purpose and need or goals and objectives statement for the project, including with respect to whether tolling, private financial assistance, or other special financial measures are necessary to implement the project;</text></subparagraph> 
<subparagraph id="H3D5AE3A289044E858047BBA7514B0C69"><enum>(B)</enum><text>a decision with respect to travel corridor location, including project termini;</text></subparagraph> 
<subparagraph id="H1FF060FDB2604FD1B6D4145240A9218A"><enum>(C)</enum><text>a decision with respect to modal choice, including a decision to implement corridor or subarea study recommendations to advance different modal solutions as separate projects with independent utility;</text></subparagraph> 
<subparagraph id="HBE78E7C6D40042A1ABA7DA1100360B2A"><enum>(D)</enum><text display-inline="yes-display-inline">a decision with respect to the elimination of unreasonable alternatives and the selection of the range of reasonable alternatives for detailed study during the environmental review process;</text></subparagraph> 
<subparagraph id="H5127C5B1C2FB46D58EE54E2423BED3D2"><enum>(E)</enum><text>a basic description of the environmental setting;</text></subparagraph> 
<subparagraph id="HF679847F1E2C4897890B56AD985B1F84"><enum>(F)</enum><text display-inline="yes-display-inline">a decision with respect to methodologies for analysis; and</text></subparagraph> 
<subparagraph id="H81983206C4D5481A81A6F59834813457"><enum>(G)</enum><text>identifications of programmatic level mitigation for potential impacts that the Federal lead agency, in consultation with Federal, State, local, and tribal resource agencies, determines are most effectively addressed at a regional or national program level, including—</text> 
<clause id="H92790CCBAC9C4DE8BB7F1A74735D8F99"><enum>(i)</enum><text>system-level measures to avoid, minimize, or mitigate impacts of proposed transportation investments on environmental resources, including regional ecosystem and water resources; and</text></clause> 
<clause id="H103049ADD86D4985B653701AB547EE96"><enum>(ii)</enum><text>potential mitigation activities, locations, and investments.</text></clause></subparagraph></paragraph> 
<paragraph id="H29CCEC553E2E4F4D9CFFACC5A0C349D8"><enum>(2)</enum><header>Planning analyses</header><text>Planning analyses that may be adopted pursuant to this section include studies with respect to—</text> 
<subparagraph id="H64CE493D3DF94E5C827171A2257701F9"><enum>(A)</enum><text>travel demands;</text></subparagraph> 
<subparagraph id="H635F113E64FF48B39E2EC4C6CD97AAAC"><enum>(B)</enum><text>regional development and growth;</text></subparagraph> 
<subparagraph id="HFF896CB19AD649F6BA527BDB77E99390"><enum>(C)</enum><text>local land use, growth management, and development;</text></subparagraph> 
<subparagraph id="H299B339DEA5C4EF8B058367A611EF5C3"><enum>(D)</enum><text>population and employment;</text></subparagraph> 
<subparagraph id="HA116D48700944B2495149AE976B0FD61"><enum>(E)</enum><text>natural and built environmental conditions;</text></subparagraph> 
<subparagraph id="H06877CCCAE0B4F7EB952003D33745545"><enum>(F)</enum><text>environmental resources and environmentally sensitive areas;</text></subparagraph> 
<subparagraph id="H972BE78790854396B62B77EBFD3E9E44"><enum>(G)</enum><text>potential environmental effects, including the identification of resources of concern and potential cumulative effects on those resources, identified as a result of a statewide or regional cumulative effects assessment; and</text></subparagraph> 
<subparagraph id="H38E65852177A43C3BC6F12366A7C1B28"><enum>(H)</enum><text>mitigation needs for a proposed action, or for programmatic level mitigation, for potential effects that the Federal lead agency determines are most effectively addressed at a regional or national program level.</text></subparagraph></paragraph></subsection> 
<subsection id="HDAEDE40B7BF54CF2BA3DE7ECD8C01152"><enum>(e)</enum><header>Conditions</header><text>Adoption and use of a planning product under this section is subject to a determination by the Federal lead agency, in consultation with joint lead agencies and project sponsors as appropriate, that the following conditions have been met:</text> 
<paragraph id="HDBFD386145F64A358CDD8850FE9A4C44"><enum>(1)</enum><text>The planning product was developed through a planning process conducted pursuant to applicable Federal law.</text></paragraph> 
<paragraph id="H0C1793F7AFA74881B6E76FCE70E08169"><enum>(2)</enum><text>The planning process included broad multidisciplinary consideration of systems-level or corridor-wide transportation needs and potential effects.</text></paragraph> 
<paragraph id="H50DAA5EC1E334923B3A7F416A44B8222"><enum>(3)</enum><text>During the planning process, notice was provided through publication or other means to Federal, State, and local government agencies and tribal governments that might have an interest in the proposed project, and to members of the general public, of the planning products that the planning process might produce and that might be relied on during the environmental review process, and such entities have been provided an appropriate opportunity to participate in the planning process leading to such planning product.</text></paragraph> 
<paragraph id="HDF6A41B76A564A0597542306074D35A9"><enum>(4)</enum><text>Prior to determining the scope of environmental review for the project, the joint lead agencies have made documentation relating to the planning product available to Federal, State, and local governmental agencies and tribal governments that may have an interest in the proposed action, and to members of the general public.</text></paragraph> 
<paragraph id="H33C0050A340448E5BCB876EEDF556202"><enum>(5)</enum><text>There is no significant new information or new circumstance that has a reasonable likelihood of affecting the continued validity or appropriateness of the planning product.</text></paragraph> 
<paragraph id="H700AACD675C44A70B103A4B4D0D453D1"><enum>(6)</enum><text>The planning product is based on reliable and reasonably current data and reasonable and scientifically acceptable methodologies.</text></paragraph> 
<paragraph id="H8D4C11C2481D47848E7C9860B05DA0DA"><enum>(7)</enum><text>The planning product is documented in sufficient detail to support the decision or the results of the analysis and to meet requirements for use of the information in the environmental review process.</text></paragraph> 
<paragraph id="H6EE64B8ED80F4DF2AFCC967B7DE74F76"><enum>(8)</enum><text>The planning product is appropriate for adoption and use in the environmental review process for the project.</text></paragraph></subsection> 
<subsection id="HEA68FD8F59DA4D5EB380E871EB7DF228"><enum>(f)</enum><header>Effect of adoption</header><text>Notwithstanding any other provision of law, any planning product adopted by the Federal lead agency in accordance with this section shall not be reconsidered or made the subject of additional interagency consultation during the environmental review process of the project unless the Federal lead agency, in consultation with joint lead agencies and project sponsors as appropriate, determines that there is significant new information or new circumstances that affect the continued validity or appropriateness of the adopted planning product. Any planning product adopted by the Federal lead agency in accordance with this section may be relied upon and used by other Federal agencies in carrying out reviews of the project.</text></subsection> 
<subsection id="H050072D76C204F1CA1704D86271F3AF8"><enum>(g)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">This section may not be construed to make the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) process applicable to the transportation planning process conducted under chapter 52 of title 49. Initiation of the National Environmental Policy Act of 1969 process as a part of, or concurrently with, transportation planning activities does not subject transportation plans and programs to the National Environmental Policy Act of 1969 process. This section may not be construed to affect the use of planning products in the National Environmental Policy Act of 1969 process pursuant to other authorities under law or to restrict the initiation of the National Environmental Policy Act of 1969 process during planning.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H441EB9A355B44C1096A4D364A0D3F377"><enum>(b)</enum><header>Scope</header> 
<paragraph id="H0330CDC7A1A149D68EA4D237877D8518"><enum>(1)</enum><header>Scale</header><text display-inline="yes-display-inline">A programmatic mitigation plan may be developed on a regional, ecosystem, watershed, or statewide scale.</text></paragraph> 
<paragraph id="HB2FED86C35884ED6AF741B97C5C83992"><enum>(2)</enum><header>Resources</header><text display-inline="yes-display-inline">The plan may encompass multiple environmental resources within a defined geographic area or may focus on a specific resource, such as aquatic resources, parklands, or wildlife habitat.</text></paragraph> 
<paragraph id="H04078EE69B384A06A1C2D6CFD9073FB7"><enum>(3)</enum><header>Project impacts</header><text display-inline="yes-display-inline">The plan may address impacts from all projects in a defined geographic area or may focus on a specific type of project, such as bridge replacements.</text></paragraph> 
<paragraph id="H3A610A564BE3487A93E06C421843D273"><enum>(4)</enum><header>Consultation</header><text display-inline="yes-display-inline">The scope of the plan shall be determined by the State or metropolitan planning organization, as appropriate, in consultation with the agency or agencies with jurisdiction over the resources being addressed in the mitigation plan.</text></paragraph></subsection> 
<subsection id="HA29F679BBD2143C88B5B449C5CE1904B"><enum>(c)</enum><header>Contents</header><text>A programmatic mitigation plan may include—</text> 
<paragraph id="HE0D9AAE85B294841B678E2AEE1F4C469"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the condition of environmental resources in the geographic area covered by the plan, including an assessment of recent trends and any potential threats to those resources;</text></paragraph> 
<paragraph id="HB9CB201A7F45489D8C62503276B64DE2"><enum>(2)</enum><text>an assessment of potential opportunities to improve the overall quality of environmental resources in the geographic area covered by the plan, through strategic mitigation for impacts of transportation projects;</text></paragraph> 
<paragraph id="HB3E8D667EA0F44CEB2CC1885755CDA1A"><enum>(3)</enum><text>standard measures for mitigating certain types of impacts;</text></paragraph> 
<paragraph id="H1FCE558211ED4230A4C5174400F27CE6"><enum>(4)</enum><text>parameters for determining appropriate mitigation for certain types of impacts, such as mitigation ratios or criteria for determining appropriate mitigation sites;</text></paragraph> 
<paragraph id="H008FDF88B6C345B5B60ED42FD9841E8B"><enum>(5)</enum><text>adaptive management procedures, such as protocols that involve monitoring predicted impacts over time and adjusting mitigation measures in response to information gathered through the monitoring; and</text></paragraph> 
<paragraph id="HD675E48C2FC14B6C8456BB9FCD961C27"><enum>(6)</enum><text>acknowledgment of specific statutory or regulatory requirements that must be satisfied when determining appropriate mitigation for certain types of resources.</text></paragraph></subsection> 
<subsection id="H1D47B8BF4B524F79B200366F7912F75C"><enum>(d)</enum><header>Process</header><text display-inline="yes-display-inline">Before adopting a programmatic mitigation plan, a State or metropolitan planning organization shall—</text> 
<paragraph id="H994C151CFA6940FDA3671AA1F39A2743"><enum>(1)</enum><text>consult with the agency or agencies with jurisdiction over the environmental resources considered in the programmatic mitigation plan;</text></paragraph> 
<paragraph id="H621E4AD8FD384FFDA57DB2BC03BC6EA8"><enum>(2)</enum><text>make a draft of the plan available for review and comment by applicable environmental resource agencies and the public;</text></paragraph> 
<paragraph id="H9F9AF1CF24D94B3EB5D948DF3CA029BE"><enum>(3)</enum><text>consider any comments received from such agencies and the public on the draft plan; and</text></paragraph> 
<paragraph id="H593E2F3EDA164BCEBA01284C7F4FD534"><enum>(4)</enum><text>address such comments in the final plan.</text></paragraph></subsection> 
<subsection id="H47CE470D36814A10924F2A4CE5F73439"><enum>(e)</enum><header>Integration with other plans</header><text display-inline="yes-display-inline">A programmatic mitigation plan may be integrated with other plans, including watershed plans, ecosystem plans, species recovery plans, growth management plans, and land use plans.</text></subsection> 
<subsection id="H34F0EAB70629472DBDEEEEB73393F93B"><enum>(f)</enum><header>Consideration in project development and permitting</header><text display-inline="yes-display-inline">If a programmatic mitigation plan has been developed pursuant to this section, any Federal agency responsible for environmental reviews, permits, or approvals for a transportation project shall give substantial weight to the recommendations in a programmatic mitigation plan when carrying out their responsibilities under applicable laws.</text></subsection> 
<subsection id="H4A41C5299D2644A59D86CC5113561CAE"><enum>(g)</enum><header>Preservation of existing authorities</header><text display-inline="yes-display-inline">Nothing in this section limits the use of programmatic approaches to reviews under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H730F485E2AD44D72971F4BBC4114E8C6"><enum>(2)</enum><text>the Secretary provides to the State—</text> 
<subparagraph id="HB267FAD299A844289C7C08A4BB7FA00C"><enum>(A)</enum><text>notification of the determination of noncompliance; and </text></subparagraph> 
<subparagraph id="H494E8F2AEF9F4C97BAAA5087162795B5"><enum>(B)</enum><text>a period of at least 30 days during which to take such corrective action as the Secretary determines is necessary to comply with the applicable agreement; and </text></subparagraph></paragraph>

<subsection id="HF701CB5E4C1C407DA237A33321D8393F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline"></text> 
<paragraph id="HBF36AF59FB804DC1A75ED88B3489C6BB"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program to eliminate duplicative environmental reviews and approvals under State and Federal law of projects. Under this program, a State may use State laws and procedures to conduct reviews and make approvals in lieu of Federal environmental laws and regulations, consistent with the provisions of this section.</text></paragraph> 
<paragraph id="HB6F057162841435692A94953646F26E9"><enum>(2)</enum><header>Participating States</header><text display-inline="yes-display-inline">All States are eligible to participate in the program. </text></paragraph> 
<paragraph id="H7926B51F38254308BECE7E367FAFD2EF"><enum>(3)</enum><header>Scope of alternative review and approval procedures</header><text>For purposes of this section, alternative environmental review and approval procedures may include one or more of the following:</text> 
<subparagraph id="HBF5FDB58E3B443C890F0B43439847E58"><enum>(A)</enum><text>Substitution of one or more State environmental laws for one or more Federal environmental laws, if the Secretary determines in accordance with this section that the State environmental laws provide environmental protection and opportunities for public involvement that are substantially equivalent to the applicable Federal environmental laws.</text></subparagraph> 
<subparagraph id="HE929C74F087248A99709F42152D539A7"><enum>(B)</enum><text>Substitution of one or more State regulations for Federal regulations implementing one or more Federal environmental laws, if the Secretary determines in accordance with this section that the State regulations provide environmental protection and opportunities for public involvement that are substantially equivalent to the Federal regulations.</text></subparagraph></paragraph></subsection> 
<subsection id="H95D366D350B44AFABF82ACBE37FE8E0B"><enum>(b)</enum><header>Application</header><text>To participate in the program, a State shall submit to the Secretary an application containing such information as the Secretary may require, including—</text> 
<paragraph id="HFD2F9A4B22B84F31A74B05D88A568FFF"><enum>(1)</enum><text>a full and complete description of the proposed alternative environmental review and approval procedures of the State;</text></paragraph> 
<paragraph id="H7706B379ABE14B96965CF883ED26289D"><enum>(2)</enum><text>for each State law or regulation included in the proposed alternative environmental review and approval procedures of the State, an explanation of the basis for concluding that the law or regulation meets the requirements under <internal-xref idref="H7926B51F38254308BECE7E367FAFD2EF" legis-path="330.(a)(3)">subsection (a)(3)</internal-xref>; and</text></paragraph> 
<paragraph id="HC48722F01DC84CB1B08EF1B8C79582B7"><enum>(3)</enum><text>evidence of having sought, received, and addressed comments on the proposed application from the public and appropriate Federal environmental resource agencies.</text></paragraph></subsection> 
<subsection id="HD999C5C6A5994A55A4E57A79B3A3CFEC"><enum>(c)</enum><header>Review of application</header><text>The Secretary shall—</text> 
<paragraph id="H163C9967E5E34217BCA1EBEA88E386B8"><enum>(1)</enum><text>review an application submitted under <internal-xref idref="H95D366D350B44AFABF82ACBE37FE8E0B" legis-path="330.(b)">subsection (b)</internal-xref>;</text></paragraph> 
<paragraph id="HBFF96363168D4651A183858AE42A5800"><enum>(2)</enum><text>approve or disapprove the application in accordance with <internal-xref idref="HA95944C2E68247BABD34B30DC3DBF852" legis-path="330.(d)">subsection (d)</internal-xref> not later than 90 days after the date of the receipt of the application; and</text></paragraph> 
<paragraph id="HFD147A58EA124025A535CB03C5F9E232"><enum>(3)</enum><text>transmit to the State notice of the approval or disapproval, together with a statement of the reasons for the approval or disapproval.</text></paragraph></subsection> 
<subsection id="HA95944C2E68247BABD34B30DC3DBF852"><enum>(d)</enum><header>Approval of State programs</header> 
<paragraph id="H4C16F54EE2C24F91A7BCE1D941439C6B"><enum>(1)</enum><header>In general</header><text>The Secretary shall approve each such application if the Secretary finds that the proposed alternative environmental review and approval procedures of the State are substantially equivalent to the applicable Federal environmental laws and Federal regulations.</text></paragraph> 
<paragraph id="HF2FC4D3CB02342A1ADF1B74783E89844"><enum>(2)</enum><header>Exclusion</header><text>The National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) and the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.) shall not apply to any decision by the Secretary to approve or disapprove any application submitted pursuant to this section.</text></paragraph></subsection> 
<subsection id="H07FF400BD4464626BAB48174BAF5A891"><enum>(e)</enum><header>Compliance with permits</header><text>Compliance with a permit or other approval of a project issued pursuant to a program approved by the Secretary under this section shall be deemed compliance with the Federal laws and regulations identified in the program approved by the Secretary pursuant to this section.</text></subsection> 
<subsection id="H4729E0B7FBB44B7FAE350F9321C04320"><enum>(f)</enum><header>Review and termination</header><text></text> 
<paragraph id="HE82FB374DEA94DEF9F7E279FE3E62FA0"><enum>(1)</enum><header>Review</header><text>All State alternative environmental review and approval procedures approved under this section shall be reviewed by the Secretary not less than once every 5 years.</text></paragraph> 
<paragraph id="H7D41B5D0D38D4F3F92F8A12BCCDF98D2"><enum>(2)</enum><header>Public notice and comment</header><text>In conducting the review process under paragraph (1), the Secretary shall provide notice and an opportunity for public comment.</text></paragraph> 
<paragraph id="HD09A337447A345AF82D9EE1DD4CC23C3"><enum>(3)</enum><header>Extensions and terminations</header><text>At the conclusion of the review process, the Secretary may extend the State alternative environmental review and approval procedures for an additional 5-year period or terminate the State program.</text></paragraph></subsection> 
<subsection id="H55F2C4893D9842718A03EB1A1EF0C9AD"><enum>(g)</enum><header>Report to Congress</header><text>Not later than 2 years after the date of enactment of this section and annually thereafter, the Secretary shall submit to Congress a report that describes the administration of the program.</text></subsection> 
<subsection id="H7A6DED9FE98248079BABCDB78E068E50"><enum>(h)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HC8D1DF861B24423684DF10AFF2756EAD"><enum>(1)</enum><header>Environmental law</header><text display-inline="yes-display-inline">The term <quote>environmental law</quote> includes any law that provides procedural or substantive protection, as applicable, for the natural or built environment with regard to the construction and operation of projects.</text></paragraph> 
<paragraph id="H1CD2B00E95F145EF9CE0EA5135F1260B"><enum>(2)</enum><header>Federal environmental laws</header><text>The term <quote>Federal environmental laws</quote> means laws governing the review of environmental impacts of, and issuance of permits and other approvals for, the construction and operation of projects, including section 102(2)(C) of the National Environmental Policy Act of 1969 (42 U.S.C. 4332(2)(C)), section 404 of the Federal Water Pollution Control Act (33 U.S.C. 1344), section 106 of the National Historic Preservation Act (16 U.S.C. 470f), and sections 7(a)(2), 9(a)(1)(B), and 10(a)(1)(B) of the Endangered Species Act of 1973 (16 U.S.C. 1536(a)(2), 1538(a)(1)(B), 1539(a)(1)(B)).</text></paragraph> 
<paragraph id="H4BD205E2448347809F29712F5ACD5747"><enum>(3)</enum><header>Multimodal project</header><text>The term <quote>multimodal project</quote> means a project funded, in whole or in part, under this title or chapter 53 of title 49 and involving the participation of more than one Department of Transportation administration or agency.</text></paragraph> 
<paragraph id="HCBB502DF00EB477ABDC84E26588F4703"><enum>(4)</enum><header>Project</header><text>The term <quote>project</quote> means any highway project, public transportation capital project, or multimodal project that requires the approval of the Secretary. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HCFA866C1149B411CBE477C29454ECAEC"><enum>(a)</enum><header>In general</header><text>Chapter 3 (as amended by this title) is further amended by adding at the end the following:</text>

<section id="HBD71A067BC53413BA6EBEA8E12059CEC"><enum>331.</enum><header>State performance of legal sufficiency reviews</header> 
<subsection id="HC03585707E154DB3BDF9506728E72BC1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">At the request of any State transportation department, the Federal Highway Administration shall enter into an agreement with the State transportation department to authorize the State to carry out the legal sufficiency reviews for environmental impact statements and environmental assessments under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) in accordance with this section.</text></subsection> 
<subsection id="H2180115640E345C298FFA372BC76AFB8"><enum>(b)</enum><header>Terms of agreement</header><text>An agreement authorizing a State to carry out legal sufficiency reviews for Federal-aid highway projects shall contain the following provisions:</text> 
<paragraph id="H3E562D0FE7244765A01CDDA7757A1B52"><enum>(1)</enum><text display-inline="yes-display-inline">A finding by the Federal Highway Administration that the State has the capacity to carry out legal sufficiency reviews that are equivalent in quality and consistency to the reviews that would otherwise be conducted by attorneys employed by such Administration.</text></paragraph> 
<paragraph id="H6A761EFE73124201B989B9EFC46A8C9B"><enum>(2)</enum><text display-inline="yes-display-inline">An oversight process, including periodic reviews conducted by attorneys employed by such Administration, to evaluate the quality of the legal sufficiency reviews carried out by the State transportation department under the agreement.</text></paragraph> 
<paragraph id="H9485805682BA461F887B1FD68192C0C5"><enum>(3)</enum><text display-inline="yes-display-inline">A requirement for the State transportation department to submit a written finding of legal sufficiency to the Federal Highway Administration concurrently with the request by the State for Federal approval of the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) document.</text></paragraph> 
<paragraph id="H37B219B9BDDA413E9357B433192349EF"><enum>(4)</enum><text display-inline="yes-display-inline">An opportunity for the Federal Highway Administration to conduct an additional legal sufficiency review for any project, for not more than 30 days, if considered necessary by the Federal Highway Administration.</text></paragraph> 
<paragraph id="H4D84BCDA5A3E464685A9CDB888F27E7C"><enum>(5)</enum><text display-inline="yes-display-inline">Procedures allowing either party to the agreement to terminate the agreement for any reason with 30 days notice to the other party.</text></paragraph></subsection> 
<subsection id="HB497E6D120CF4BF3B360FB0212756559"><enum>(c)</enum><header>Effect of agreement</header><text display-inline="yes-display-inline">A legal sufficiency review carried out by a State transportation department under this section shall be deemed by the Federal Highway Administration to satisfy the requirement for a legal sufficiency review in sections 771.125(b) and 774.7(d) of title 23, Code of Federal Regulations, or other applicable regulations issued by the Federal Highway Administration.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDFD6A703E41441869A87C36ECA127090"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for such chapter (as amended by this title) is further amended by adding at the end the following:</text>

<subsection id="H08457374C7084E46AC87D04A3809952A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall treat an activity carried out under title 23, United States Code, or project within a right-of-way as a class of action categorically excluded from the requirements relating to environmental assessments or environmental impact statements under section 771.117(c) of title 23, Code of Federal Regulations.</text></subsection> 
<subsection id="H2AFF984A0FD245FE808DFE2D073F8C0C"><enum>(b)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="HA37FB381B2284F5781DE3E65BB615243"><enum>(1)</enum><header>Multimodal project</header><text display-inline="yes-display-inline">The term <quote>multimodal project</quote> means a project funded, in whole or in part, under title 23, United States Code, or chapter 53 of title 49 of such Code and involving the participation of more than one Department of Transportation administration or agency.</text></paragraph> 
<paragraph id="H62FEBDC345E841B980685C7E8E146052"><enum>(2)</enum><header>Project</header><text>The term <quote>project</quote> means any highway project, public transportation capital project, or multimodal project that requires the approval of the Secretary.</text></paragraph></subsection></section> 
<section id="H602213DAEE4E4E4FAD5A2156AC5C47C7"><enum>618.</enum><header>Environmental review process deadline</header> 
<subsection id="HA40547D53838466B897AF808C2A400D6"><enum>(a)</enum><header>In general</header><text></text> 
<paragraph id="H3BA30468B6414CC0982D444731556CD1"><enum>(1)</enum><header>Deadline</header><text>Notwithstanding any other provision of law, the environmental review process for a project shall be completed not later than 270 days after the date on which the notice of project initiation under section 139(e) of title 23, United States Code, is published in the Federal Register.</text></paragraph> 
<paragraph id="HDECB3E36289D4CB4944ADDC3D7F038A1"><enum>(2)</enum><header>Consequences of missed deadline</header><text>If the environmental review process for a project is not completed in accordance with <internal-xref idref="H3BA30468B6414CC0982D444731556CD1" legis-path="419.(a)(1)">paragraph (1)</internal-xref>—</text> 
<subparagraph id="HB47A77578B69447C9E9066EDE323C352"><enum>(A)</enum><text>the project shall be considered to have no significant impact to the human environment for purposes of the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); and</text></subparagraph> 
<subparagraph id="HF630BAC5BC9E40A188EC9F1895DFB089"><enum>(B)</enum><text>that classification shall be considered to be a final agency action.</text></subparagraph></paragraph></subsection> 
<subsection id="HB760DE6A07FB4F408503DFEBCA7B85FC"><enum>(b)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="H3DB169B6102240F2AF2A028D8D57ABD6"><enum>(1)</enum><header>Environmental review process</header><text></text> 
<subparagraph id="H3E571DBB91194463838CAC13C36DE8CF"><enum>(A)</enum><header>In general</header><text>The term <quote>environmental review process</quote> means the process for preparing for a project an environmental impact statement, environmental assessment, categorical exclusion, or other document prepared under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text></subparagraph> 
<subparagraph id="H280387391D834A27B802CEFE3841AD2D"><enum>(B)</enum><header>Inclusions</header><text>The term <quote>environmental review process</quote> includes the process for and completion of any environmental permit, approval, review, or study required for a project under any Federal law other than the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text></subparagraph></paragraph> 
<paragraph id="HFC9ADDB9FA6A40C9BE8195CD818E6D5A"><enum>(2)</enum><header>Lead agency</header><text>The term <quote>lead agency</quote> means the Department of Transportation and, if applicable, any State or local governmental entity serving as a joint lead agency pursuant to this section.</text></paragraph> 
<paragraph id="H56F04B09423641C3882E74ACFEB166F4"><enum>(3)</enum><header>Multimodal project</header><text>The term <quote>multimodal project</quote> means a project funded, in whole or in part, under title 23, United States Code, or chapter 53 of title 49 of such Code and involving the participation of more than one Department of Transportation administration or agency.</text></paragraph> 
<paragraph id="H07907D40C89943CCBE9B4D339BE1C873"><enum>(4)</enum><header>Project</header><text>The term <quote>project</quote> means any highway project, public transportation capital project, or multimodal project that requires the approval of the Secretary.</text></paragraph></subsection></section> 
<section id="H2DBE86C2AE1249288EE7AD8E5C90C8A3" display-inline="no-display-inline" section-type="subsequent-section"><enum>619.</enum><header>Relocation assistance</header> 
<subsection id="H1B3836DC032C47FEBEDBAF1634471C46"><enum>(a)</enum><header>Alternative relocation payment process</header> 
<paragraph id="HEB20F9C2824847AB9637A303EAD9D2AE"><enum>(1)</enum><header>Establishment</header><text>For the purpose of identifying improvements in the timeliness of providing relocation assistance to persons displaced as a result of Federal or federally-assisted programs and projects, the Secretary shall establish an alternative relocation payment process under which payments to displaced persons eligible for relocation assistance pursuant to the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.), are calculated based on reasonable estimates and paid in advance of the physical displacement of the displaced person.</text></paragraph> 
<paragraph id="H05229EC00FB04B4E9AEA40018B0010F3"><enum>(2)</enum><header>Payments</header> 
<subparagraph id="H76A33E40824A40DEABD0FEE814D69287"><enum>(A)</enum><header>Timing of payments</header><text>Relocation assistance payments may be provided to the displaced person at the same time as payments of just compensation for real property acquired for a program or project of the State.</text></subparagraph> 
<subparagraph id="H93BF0C453F674BB7A1D4375F01BAFFFF"><enum>(B)</enum><header>Combined payment</header><text>Payments for relocation and just compensation may be combined into a single unallocated amount.</text></subparagraph></paragraph> 
<paragraph id="HE1D33BD6059647D8A0985C8B052C0916"><enum>(3)</enum><header>Conditions for State use of alternative process</header> 
<subparagraph id="HF00F0593F8094C418D401EB531453F7D"><enum>(A)</enum><header>In general</header><text>After public notice and an opportunity to comment, the Secretary shall adopt criteria for States to use the alternative relocation payment process established by the Secretary.</text></subparagraph> 
<subparagraph id="H561D5E5C7BC6427F92176E6AE0CDD43E"><enum>(B)</enum><header>Memorandum of agreement</header><text>In order to use the alternative relocation payment process, a State shall enter into a memorandum of agreement with the Secretary that includes provisions relating to—</text> 
<clause id="H3D6BFC778322458E9C1E4A7C1AF35BDF"><enum>(i)</enum><text>the selection of projects or programs within the State to which the alternative relocation payment process will be applied;</text></clause> 
<clause id="H1DF611FD9B0447B69B3D6AEC818CC8B7"><enum>(ii)</enum><text>program and project-level monitoring;</text></clause> 
<clause id="H258A0E54038D4E3EB8AD73A817FF65E9"><enum>(iii)</enum><text>performance measurement;</text></clause> 
<clause id="H3DF721D5412C4B3BA503508642809E0A"><enum>(iv)</enum><text>reporting requirements; and</text></clause> 
<clause id="HA0417FFAC6D34793B964D3C18AC0D66A"><enum>(v)</enum><text>the circumstances under which the Secretary may terminate or suspend the authority of the State to use the alternative relocation payment process.</text></clause></subparagraph> 
<subparagraph id="HFCF439F20A924D239622242F68600BFA"><enum>(C)</enum><header>Required information</header><text>A State may use the alternative relocation payment process only after the displaced persons affected by a program or project—</text> 
<clause id="HE5811FB7347F4422958ED05CC3FA260D"><enum>(i)</enum><text>are informed in writing—</text> 
<subclause id="HC4F7309B1BCC4D3FA2773B4ED3AD56C6"><enum>(I)</enum><text>that the relocation payments the displaced persons receive under the alternative relocation payment process may be higher or lower than the amount that the displaced persons would have received under the standard relocation assistance process; and</text></subclause> 
<subclause id="H52D13A3065D6403F940E1FF4CAA90EDC"><enum>(II)</enum><text>of their right not to participate in the alternative relocation payment process; and</text></subclause></clause> 
<clause id="H661D081BA7764C54BD39B191CE7B785B"><enum>(ii)</enum><text>agree in writing to the alternative relocation payment process.</text></clause></subparagraph> 
<subparagraph id="HB71BDDE49BFB4CD28EDA72A2874394DD"><enum>(D)</enum><header>Election not to participate</header><text>The displacing agency shall provide any displaced person who elects not to participate in the alternative relocation payment process with relocation assistance in accordance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.).</text></subparagraph></paragraph> 
<paragraph id="H89B55C8CEAC44D50A48ACCC6F37FB89B"><enum>(4)</enum><header>Protections against inconsistent treatment</header><text>If other Federal agencies plan displacements in or adjacent to an area of a project using the alternative relocation payment process within the same time period as a project acquisition and relocation action of the project, the Secretary shall adopt measures to protect against inconsistent treatment of displaced persons. Such measures may include a determination that the alternative relocation payment process authority may not be used on a specific project.</text></paragraph> 
<paragraph id="H4BCEE8ACDFAC4DC58D4B3DD324DBF00C"><enum>(5)</enum><header>Report</header> 
<subparagraph id="HA8D02C3418A446048DA2AACF6F88FC1A"><enum>(A)</enum><header>In general</header><text>The Secretary shall submit to Congress an annual report on the implementation of the alternative relocation payment process.</text></subparagraph> 
<subparagraph id="H0AA2C584F3914CEDB5763A13B0666122"><enum>(B)</enum><header>Contents</header><text>The report shall include an evaluation of the merits of the alternative relocation payment process, including the effects of the alternative relocation payment process on—</text> 
<clause id="H916DD29D24624D14BF9CFE255C665E04"><enum>(i)</enum><text>displaced persons and the protections afforded to such persons by the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.);</text></clause> 
<clause id="H145964DA673C435586CD3397E8DDF7F7"><enum>(ii)</enum><text>the efficiency of the delivery of Federal-aid highway projects and overall effects on the Federal-aid highway program; and</text></clause> 
<clause id="HFB627327813544999EC87574F7C3FC5E"><enum>(iii)</enum><text>the achievement of the purposes of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.).</text></clause></subparagraph></paragraph> 
<paragraph id="H93B1643BB541490FBFB7A13E459CEF02"><enum>(6)</enum><header>Limitation</header><text>The alternative relocation payment process under this section may be used only on projects funded under title 23, United States Code, in cases in which the funds are administered by the Federal Highway Administration.</text></paragraph> 
<paragraph id="HD48CE98EBC614CCC9F69A11F13D9E5FD"><enum>(7)</enum><header>NEPA applicability</header><text>Notwithstanding any other provision of law, the use of the alternative relocation payment process established under this section on a project funded under title 23, United States Code, and administered by the Federal Highway Administration is not a major Federal action requiring analysis or approval under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text></paragraph></subsection> 
<subsection id="H83B96B6F799B48ECB2C427FD1BD895BD"><enum>(b)</enum><header>Uniform relocation assistance act amendments</header> 
<paragraph id="H99D56AEA4B4D4B5997FA0C94EF5D740D"><enum>(1)</enum><header>Moving and related expenses</header><text>Section 202 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4622) is amended—</text> 
<subparagraph id="H1C449DCCEC3845AF8D561E6B517C3447"><enum>(A)</enum><text>in subsection (a)(4) by striking <quote>$10,000</quote> and inserting <quote>$25,000, as adjusted by regulation, in accordance with section 213(d)</quote>; and</text></subparagraph> 
<subparagraph id="HAEAED1158A80424B9F2E342B4D355F02"><enum>(B)</enum><text>in the second sentence of subsection (c) by striking <quote>$20,000</quote> and inserting <quote>$40,000, as adjusted by regulation, in accordance with section 213(d)</quote>.</text></subparagraph></paragraph> 
<paragraph id="H3CC29503BA494EDC8299359332017ED2"><enum>(2)</enum><header>Replacement housing for homeowners</header><text>The first sentence of section 203(a)(1) of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4623(a)(1)) is amended by—</text> 
<subparagraph id="H26BBFC657BD74B7EBFC666F6D485C583"><enum>(A)</enum><text>striking <quote>$22,500</quote> and inserting <quote>$31,000, as adjusted by regulation, in accordance with section 213(d),</quote>; and</text></subparagraph> 
<subparagraph id="H8B1321AD27984BCA84779A7BAAC591D9"><enum>(B)</enum><text>striking <quote>one hundred and eighty days prior to</quote> and inserting <quote>90 days before</quote>.</text></subparagraph></paragraph> 
<paragraph id="H9C8978AB2C2B4D099FBF204D14724EA6"><enum>(3)</enum><header>Replacement housing for tenants and certain others</header><text>Section 204 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4624) is amended—</text> 
<subparagraph id="H59CEA119263E46CDBB9C429E0DFDA7EB"><enum>(A)</enum><text>in the second sentence of subsection (a) by striking <quote>$5,250</quote> and inserting <quote>$7,200, as adjusted by regulation, in accordance with section 213(d)</quote>; and</text></subparagraph> 
<subparagraph id="H3F5D3C5B4EFF4E4B9EFA293EE4B92C9C"><enum>(B)</enum><text>in the second sentence of subsection (b) by striking <quote>, except</quote> and all that follows through the end of the subsection and inserting a period.</text></subparagraph></paragraph> 
<paragraph id="H761D19D8576E4F3A94FDEF4DBDC9AEBD"><enum>(4)</enum><header>Duties of lead agency</header><text>Section 213 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4633) is amended—</text> 
<subparagraph id="HF443C08BE44D435B926EF207EECB5351"><enum>(A)</enum><text>in subsection (b)—</text> 
<clause id="H6E38EF026BA74383A13DF4AE7D36E7A6"><enum>(i)</enum><text>in paragraph (2) by striking <quote>and</quote>;</text></clause> 
<clause id="H0FF14F2B4DD242F79E2DBE3F07B77F3F"><enum>(ii)</enum><text>in paragraph (3) by striking the period and inserting <quote>; and</quote>; and</text></clause> 
<clause id="H8FDEA19C6F484E59A887FF055A1245F6"><enum>(iii)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H667C5802473844C5A069B66A1397601E" style="OLC"> 
<paragraph id="H7E6C58E21B3A46B6AD5CCAAFB380FA1D"><enum>(4)</enum><text>that each Federal agency that has programs or projects requiring the acquisition of real property or causing a displacement from real property subject to the provisions of this Act shall provide to the lead agency an annual summary report that describes the activities conducted by the Federal agency.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="HF4DDB267B49544AB9F347CD0913D7D37"><enum>(B)</enum><text>by adding at the end the following:</text>

<subsection id="H8C073480ED9D4EC2B5D41B5002C98536"><enum>(d)</enum><header>Adjustment of payments</header><text>The head of the lead agency may adjust, by regulation, the amounts of relocation payments provided under sections 202(a)(4), 202(c), 203(a), and 204(a) if the head of the lead agency determines that cost of living, inflation, or other factors indicate that the payments should be adjusted to meet the policy objectives of this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H85ED0A0AB9464460B9C449F31619C068"><enum>(5)</enum><header>Agency coordination</header><text>Title II of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.) is amended by inserting after section 213 (42 U.S.C. 4633) the following:</text>

<section id="H626350B1BA794EA28867818D9AD50DE4"><enum>214.</enum><header>Agency coordination</header> 
<subsection id="H8A54DC1A74964608BAA8AE0DDD4A4C88"><enum>(a)</enum><header>Agency capacity</header><text>Each Federal agency responsible for funding or carrying out relocation and acquisition activities shall have adequately trained personnel and such other resources as are necessary to manage and oversee the relocation and acquisition program of the Federal agency in accordance with this Act.</text></subsection> 
<subsection id="H074892280A1349D9A35742A904202EA6"><enum>(b)</enum><header>Interagency agreements</header><text>Not later than 1 year after the date of the enactment of this section, each Federal agency responsible for funding relocation and acquisition activities (other than the agency serving as the lead agency) shall enter into a memorandum of understanding with the lead agency that—</text> 
<paragraph id="H97A9A901B00447AF85A22F14069118FA"><enum>(1)</enum><text>provides for periodic training of the personnel of the Federal agency, which in the case of a Federal agency that provides Federal financial assistance, may include personnel of any displacing agency that receives Federal financial assistance;</text></paragraph> 
<paragraph id="H948DB28E6EB6483090174E335D73CC0C"><enum>(2)</enum><text>addresses ways in which the lead agency may provide assistance and coordination to the Federal agency relating to compliance with this Act on a program or project basis; and</text></paragraph> 
<paragraph id="HC147A0A8A65D4293BCD4B0DDC1847851"><enum>(3)</enum><text>addresses the funding of the training, assistance, and coordination activities provided by the lead agency, in accordance with subsection (c).</text></paragraph></subsection> 
<subsection id="H4CAD4A0E7F394063A0C2B3D4CA5C0B18"><enum>(c)</enum><header>Interagency payments</header> 
<paragraph id="HFFCE7304A89745FFBF64C646A117DD7D"><enum>(1)</enum><header>In general</header><text>For the fiscal year that begins 1 year after the date of the enactment of this section, and each fiscal year thereafter, each Federal agency responsible for funding relocation and acquisition activities (other than the agency serving as the lead agency) shall transfer to the lead agency for the fiscal year, such funds as are necessary, but not less than $35,000, to support the training, assistance, and coordination activities of the lead agency described in subsection (b).</text></paragraph> 
<paragraph id="HBE6D5A842D5A42F893154FCF50D556F1"><enum>(2)</enum><header>Included costs</header><text>The cost to a Federal agency of providing the funds described in paragraph (1) shall be included as part of the cost of 1 or more programs or projects undertaken by the Federal agency or with Federal financial assistance that result in the displacement of persons or the acquisition of real property.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H02446CF277C144E79B0624D544964099"><enum>(c)</enum><header>Cooperation with Federal agencies</header><text>Section 308(a) is amended to read as follows:</text>

<subsection id="HF692BC479D8342CB9590ACB94BE78795"><enum>(a)</enum><header>Authorized activities</header> 
<paragraph id="HCCD9971D953E4116B134E44ADC893A99"><enum>(1)</enum><header>In general</header><text>The Secretary may perform, by contract or otherwise, authorized engineering or other services in connection with the survey, construction, maintenance, or improvement of highways for other Federal agencies, cooperating foreign countries, and State cooperating agencies.</text></paragraph> 
<paragraph id="H1B8F401215534534B579D5D85C49B9C3"><enum>(2)</enum><header>Inclusions</header><text>Services authorized under paragraph (1) may include activities authorized under section 214 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.).</text></paragraph> 
<paragraph id="HA9B654C06BE04F9D82B162AE232D66BD"><enum>(3)</enum><header>Reimbursement</header><text>Reimbursement for services carried out under this subsection, including depreciation on engineering and road-building equipment, shall be credited to the applicable appropriation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title>
