		<official-title>To amend title 39, United States Code, to allow the
		  Postal Regulatory Commission to set aside determinations by the United States
		  Postal Service to close or consolidate postal facilities that would deny
		  essential postal services to rural areas, communities, or small towns, and for
		  other purposes.</official-title>

		<section id="id19D8CF69B3444BD5AB11EF0E24C4EE73" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Postal Service Accountability Act of
			 2012</short-title></quote>.</text>
		</section><section id="H54BFF893A4B64EBAB9B75FDB5264EDEE" section-type="subsequent-section"><enum>2.</enum><header>Closing or
			 consolidation of post offices</header>
			<subsection id="H4044203435234A76B88014D30317A1A0"><enum>(a)</enum><header>Economic
			 effects</header><text>Section 404(d)(2)(A)(i) of title 39, United States Code,
			 is amended by striking the semicolon and inserting <quote>, including any
			 economic effects;</quote>.</text>
			</subsection><subsection id="HBE0B55C417EC48928664234D0A624433"><enum>(b)</enum><header>Increase in
			 length of waiting period</header><text>Section 404(d)(4) of title 39, United
			 States Code, is amended by striking <quote>60</quote> and inserting
			 <quote>120</quote>.</text>
			</subsection><subsection id="H2FB8B75B985D4D2FB5EE7F36BF0EA8FB"><enum>(c)</enum><header>Specific basis
			 To exercise authority To set aside</header><text>Subparagraph (C) of section
			 404(d)(5) of title 39, United States Code, is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H8E2A9C0E671D4E658207BC7424C62432" style="USC">
					<subparagraph id="H21F8967AF5734996947E2BCD82372963" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">unsupported by substantial evidence on the
				record, including any determination, finding, or conclusion of the Postal
				Service with respect to clause (i), (ii), (iii), or (iv) of paragraph (2)(A)
				(each of which clauses the Postal Service shall specifically address under
				paragraph (3) with respect to the post office
				involved).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0FFA2B819EBB47739D32A05961F7CF57"><enum>(d)</enum><header>PRC concurrence
			 required</header><text display-inline="yes-display-inline">Section 404(d) of
			 title 39, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H4EBB58D979FA4DC692A094A5979FCF2F" style="USC">
					<paragraph id="H9839A37B29E74578B19A9ADB60D5A336" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">If an appeal is filed under paragraph (5)
				with respect to the closure or consolidation of a post office, the Postal
				Service may not proceed with its determination to close or consolidate such
				post office without the written concurrence of at least 3 of the
				Commissioners.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H57A8CDB3D7FB43C7A27790312ED5BFBE"><enum>(e)</enum><header>Review</header><text>Section
			 404(d) of title 39, United States Code, is amended by adding after paragraph
			 (7) (as added by subsection (d)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H18A1C63CE8A24A348435B58F3A89F6F8" style="USC">
					<paragraph id="HB32D7DE506744F57B9871DB5FA2EB4D4" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Within 1 year after the date on which a
				post office is closed or consolidated, the Postal Service shall conduct a
				review and make public its findings and determinations in regard to—</text>
						<subparagraph id="H0B897AFE05014395A06263B106F6B289"><enum>(A)</enum><text display-inline="yes-display-inline">the accuracy of the findings which the
				Postal Service had made earlier, with respect to the considerations under
				paragraph (2)(A), in connection with the proposed closing or consolidation of
				such post office; and</text>
						</subparagraph><subparagraph id="H1D5572184FE54064815CF186BE44E43A"><enum>(B)</enum><text display-inline="yes-display-inline">what substitute services are being provided
				for those previously provided by the post office that was closed or
				consolidated, and whether those substitute services are meeting community
				needs.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H9544B77E773648E398680854CD6D6199"><enum>3.</enum><header>Provisions
			 relating to certain other facilities</header><text display-inline="no-display-inline">Section 404 of title 39, United States Code,
			 is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HF52E428A0359417AAE5E333C0C7D873A" style="USC">
				<subsection id="H59D667ADE3454DEAACFA757380905C9C"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H493BE949CA7443008BE0BA1E22AEFD34"><enum>(1)</enum><text display-inline="yes-display-inline">The Postal Service, prior to making a
				determination as to the necessity for the closing or consolidation of any mail
				processing facility, shall provide adequate notice of its intention to close or
				consolidate such mail processing facility at least 60 days prior to the
				proposed date of such closing or consolidation to the employees at that
				facility and the community in which such facility is located to ensure that
				such persons will have an opportunity to present their views.</text>
					</paragraph><paragraph id="H1BAB4FE856674271860CF0C083C8F8D8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Postal Service, in making a
				determination whether or not to close or consolidate a mail processing
				facility—</text>
						<subparagraph id="HBA91BF4D97E34042BDA289B8039789F7"><enum>(A)</enum><text>shall consider—</text>
							<clause id="HEE5A31A779F5413B93A0CA1007D094A4"><enum>(i)</enum><text display-inline="yes-display-inline">the effect of such closing or consolidation
				on the community in which such facility is located, including any economic
				effects;</text>
							</clause><clause id="HF28C64F915F3437F913098AB08017CDE"><enum>(ii)</enum><text>the effect of such closing or
				consolidation on employees of the Postal Service employed at such
				facility;</text>
							</clause><clause id="H2754596416D340459110E5D30CBCC624"><enum>(iii)</enum><text>whether such closing or
				consolidation is consistent with the policy of the Government, as stated in
				section 101(b), that the Postal Service shall provide a maximum degree of
				effective and regular postal services to rural areas, communities, and small
				towns where post offices are not self-sustaining;</text>
							</clause><clause id="HFBA6F57402774974BB4FBF4F92E980C5"><enum>(iv)</enum><text>the economic savings to the Postal
				Service resulting from such closing or consolidation; and</text>
							</clause><clause id="H543F19D8B421461A987F7917F237703D"><enum>(v)</enum><text>such other factors as the Postal
				Service determines are necessary; and</text>
							</clause></subparagraph><subparagraph id="H773D1D40E9764DD08475BD48C6D22133"><enum>(B)</enum><text>may not consider compliance with any
				provision of the Occupational Safety and Health Act of 1970 (29 U.S.C. 651 et
				seq.).</text>
						</subparagraph></paragraph><paragraph id="H7514AF6D906D4F0BA6B340026946F845" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any determination of the Postal Service to
				close or consolidate a mail processing facility shall be in writing and shall
				include the findings of the Postal Service with respect to the considerations
				required to be made under paragraph (2). Such determination and findings shall
				be made available to employees at the facility and the community in which such
				facility is located.</text>
					</paragraph><paragraph id="HFD166C8CDD694266BAEE7EAD0CC79C32" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Postal Service shall take no action to
				close or consolidate a mail processing facility until 120 days after its
				written determination is made available to employees of that facility and the
				community in which such facility is located.</text>
					</paragraph><paragraph id="H3A7E940DBFF14FCF8F0BB9B1A70CC035" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">A
				determination of the Postal Service to close or consolidate any mail processing
				facility may be appealed to the Postal Regulatory Commission, by any employee
				at such facility or member of the community in which such facility is located,
				within 30 days after such determination is made available to such person under
				paragraph (3). The Commission shall review such determination on the basis of
				the record before the Postal Service in the making of such determination. The
				Commission shall make a determination based upon such review no later than 120
				days after receiving any appeal under this paragraph. The Commission shall set
				aside any determination, findings, and conclusions found to be—</text>
						<subparagraph id="HF835212E831D4FE6815BD0078036851B"><enum>(A)</enum><text display-inline="yes-display-inline">arbitrary, capricious, an abuse of
				discretion, or otherwise not in accordance with the law;</text>
						</subparagraph><subparagraph id="HABB635850ABD4FB78B1101B4F233DBAF"><enum>(B)</enum><text>without observance of procedure
				required by law; or</text>
						</subparagraph><subparagraph id="HFD73CD6BB5F54DF0BBE1FB05E8FADE81"><enum>(C)</enum><text display-inline="yes-display-inline">unsupported by substantial evidence on the
				record, including any determination, finding, or conclusion of the Postal
				Service with respect to clause (i), (ii), (iii), or (iv) of paragraph (2)(A)
				(each of which clauses the Postal Service shall specifically address under
				paragraph (3) with respect to the facility involved).</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">The
				Commission may affirm the determination of the Postal Service or order that the
				entire matter be returned for further consideration, but the Commission may not
				modify the determination of the Postal Service. The Commission may suspend the
				effectiveness of the determination of the Postal Service until the final
				disposition of the appeal. The provisions of section 556, section 557, and
				chapter 7 of title 5 shall not apply to any review carried out by the
				Commission under this paragraph.</continuation-text></paragraph><paragraph id="H7B3C2540BA884571BAF4608C1DCA26CA" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">For purposes of paragraph (5), any appeal
				received by the Commission shall—</text>
						<subparagraph id="H03BD09609E90429CACDF201033E46393"><enum>(A)</enum><text display-inline="yes-display-inline">if
				sent to the Commission through the mails, be considered to have been received
				on the date of the Postal Service postmark on the envelope or other cover in
				which such appeal is mailed; or</text>
						</subparagraph><subparagraph id="H0EE62DC0909E4F48A1035BEC87D1E878"><enum>(B)</enum><text>if otherwise lawfully delivered to the
				Commission, be considered to have been received on the date determined based on
				any appropriate documentation or other indicia (as determined under regulations
				of the Commission).</text>
						</subparagraph></paragraph><paragraph id="HCBCCDF4698DF4E0DA830A8399B7F8F7F" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">If an appeal is filed under paragraph (5)
				with respect to the closure or consolidation of a mail processing facility, the
				Postal Service may not proceed with its determination to close or consolidate
				such facility without the written concurrence of at least 3 of the
				Commissioners.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="H4D55F21159CF4CBB905B784005EB7F86" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Within 1 year after the date on which a
				mail processing facility is closed or consolidated, the Postal Service shall
				conduct a review and make public its findings and determinations in regard
				to—</text>
						<subparagraph id="HFED3939038DA43E9A89976BFE9A9EEC3"><enum>(A)</enum><text display-inline="yes-display-inline">the accuracy of the findings which the
				Postal Service had made earlier, with respect to the considerations under
				paragraph (2)(A), in connection with the proposed closing or consolidation of
				such facility; and</text>
						</subparagraph><subparagraph id="H89A09C09655847BE9678B3DDF4B93853"><enum>(B)</enum><text>what substitute services are being
				provided for those previously provided by the facility that was closed or
				consolidated, and whether those substitute services are meeting community
				needs.</text>
						</subparagraph></paragraph><paragraph id="H622233351BAF4B899F2EB325B3CDA9D4" indent="up1"><enum>(9)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the term
				<term>mail processing facility</term> means a processing and distribution
				center, processing and distribution facility, network distribution center, or
				other facility which is operated by the Postal Service, and the primary
				function of which is to sort and process
				mail.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD867B1EB815D45ACACDEA70F876E4EB0"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply with respect to closings and consolidations taking effect
			 on or after the date of the enactment of this Act.</text>
