		<official-title>To amend title 10, United States Code, to provide for the
		  payment of monthly annuities under the Survivor Benefit Plan to a supplemental
		  or special needs trust established for the sole benefit of a disabled dependent
		  child of a participant in the Survivor Benefit Plan.</official-title>

		<section id="HAEA632EBAE9D4063BDF703C4E22B7A19" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Disabled Military Child Protection Act
			 of 2012</short-title></quote>.</text>
		</section><section id="H0D092CF2581F49DDA1ACBB03700EC508"><enum>2.</enum><header>Survivor Benefit
			 Plan annuities for special needs trusts established for the benefit of
			 dependent children incapable of self-support</header>
			<subsection id="HA298BC5CC86A4B1FA0811EEB1FF73AA5"><enum>(a)</enum><header>Special needs
			 trust as eligible beneficiary</header>
				<paragraph id="H0F3DCA8FAA16401891F2599BA8F83204"><enum>(1)</enum><header>In
			 general</header><text>Subsection (a) of section 1450 of title 10, United States
			 Code, is amended—</text>
					<subparagraph id="H78093167EF3A4E9DA951B5829EEF9825"><enum>(A)</enum><text>by redesignating
			 paragraph (4) as paragraph (5); and</text>
					</subparagraph><subparagraph id="HD26A66810A3248A3BF376DE9A67C224D"><enum>(B)</enum><text>by inserting after
			 paragraph (3) the following new paragraph (4):</text>
						<quoted-block id="H4F12CB9A739C4D3F85C23CF9AE6018E2" style="OLC">
							<paragraph id="H1B785A84614A415BBDFEBA99ED3D175C"><enum>(4)</enum><header>Special needs
				trusts for sole benefit of certain dependent
				children</header><text>Notwithstanding subsection (i), a supplemental or
				special needs trust described in subparagraph (A) or (C) of section 1917(d)(4)
				of the Social Security Act (42 U.S.C. 1396p(d)(4)) that is established for the
				sole benefit of a dependent child considered disabled under section 1614(a)(3)
				of that Act (42 U.S.C. 1382c(a)(3)) who is incapable of self-support because of
				mental or physical
				incapacity.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H85B2CEFB1C1444D391526E1D0192D478"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Subsection (i) of such section is amended by inserting
			 <quote>(a)(4) or</quote> after <quote>subsection</quote>.</text>
				</paragraph></subsection><subsection id="H9A84FEBD930E4D86AF4C714527D4D824"><enum>(b)</enum><header>Regulations</header><text>Section
			 1455(d) of such title is amended—</text>
				<paragraph id="HBE64F8EC8AD64A00BDC0F53D8E0C1F08"><enum>(1)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection" style="OLC">and
			 fiduciaries</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, fiduciaries, and special needs
			 trusts</header-in-text></quote>;</text>
				</paragraph><paragraph id="HF50E78C502D540038F6CC342746B84E3"><enum>(2)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="HC182DE6004434FA4AAB1E3BD69A8CA74"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HA4B113A7AED0400DB3806BB0C5CD6A9A"><enum>(B)</enum><text>in subparagraph
			 (B), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="HA14CE77A931F4B3FB2295B7172F5D46C"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block id="H99294C30E29E4D0A8DAD24CE07AF4FB4" style="OLC">
							<subparagraph id="H27242960B77C47AF9D83BC86B40AE1FE"><enum>(C)</enum><text display-inline="yes-display-inline">a dependent child incapable of self-support
				because of mental or physical incapacity for whom a supplemental or special
				needs trust, as described in subparagraph (A) or (C) of section 1917(d)(4) of
				the Social Security Act (42 U.S.C. 1396p(d)(4)), has been
				established.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HF6177ACCE6D54050B309D5B272BF3CA0"><enum>(3)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HB4ECE9207A0D48B882D427C46A18DAEB"><enum>(A)</enum><text>by redesignating
			 subparagraphs (C) through (H) as subparagraphs (D) through (I),
			 respectively;</text>
					</subparagraph><subparagraph id="H82977554816842C5849661C14D3DE2A6"><enum>(B)</enum><text>by inserting after
			 subparagraph (B) the following new subparagraph (C):</text>
						<quoted-block id="H78D927A825154949AEE165BAC5F183E8" style="OLC">
							<subparagraph id="HC7760BC1B11349D8AC399BD5D8A16F8D"><enum>(C)</enum><text>In the case of an
				annuitant referred to in paragraph (1)(C), payment of the annuity to the
				supplemental or special needs trust established for the
				annuitant.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H2568307641D9407989296E574D79E4A3"><enum>(C)</enum><text>in subparagraph
			 (D), as redesignated, by striking <quote>subparagraphs (D) and (E)</quote> and
			 inserting <quote>subparagraphs (E) and (F)</quote>; and</text>
					</subparagraph><subparagraph id="H4756F615E052418BA6DE2ACBBFF1CE9C"><enum>(D)</enum><text>in subparagraph
			 (H), as so redesignated—</text>
						<clause id="H58B231F4A70F4A62A83E0059C5DFD6DA"><enum>(i)</enum><text>by
			 inserting <quote>or (1)(C)</quote> after <quote>paragraph (1)(B)</quote> in the
			 matter preceding clause (i);</text>
						</clause><clause id="H152C881B703C47F1A2F57B663DF7719F"><enum>(ii)</enum><text>in
			 clause (i), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="HDB7937E7CE4645699768F644E23BBA4A"><enum>(iii)</enum><text>in
			 clause (ii), by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
						</clause><clause id="H6AF9D16843014C55B615320ADC9A730E"><enum>(iv)</enum><text>by
			 adding at the end the following new clause:</text>
							<quoted-block id="H183452D7EF8740B1BCF4AA6CCA71FD04" style="OLC">
								<clause id="HC338BD9EF52B42E8848285FF69ADF5D5"><enum>(iii)</enum><text>procedures for
				determining when annuity payments to a supplemental or special needs trust
				shall end based on the death or marriage of the dependent child for which the
				trust was established.</text>
								</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="H86A1E70D1D904D50B88743DE8F71CA8A"><enum>(4)</enum><text>in paragraph (3),
			 by striking <quote><header-in-text level="paragraph" style="OLC">to guardian or
			 fiduciary</header-in-text></quote> in the paragraph heading.</text>
