		<official-title>To amend the Truth in Lending Act to improve upon the
		  definitions provided for points and fees in connection with a mortgage

		<section id="HDC1638EC963A42FABA4BF7CCEEC7928C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Mortgage Choice
			 Act</short-title></quote>.</text>
		</section><section id="H4F67EF80C120437393D587C015FBBBB8"><enum>2.</enum><header>Definition of
			 points and fees</header>
			<subsection id="H59AD3B688BE34ED0A9D42C770EF3C7D9"><enum>(a)</enum><header>Amendment to
			 Section 103 of TILA</header><text display-inline="yes-display-inline">Section
			 103(bb)(4) of the Truth in Lending Act (15 U.S.C. 1602(bb)(4)) is
			 amended—</text>
				<paragraph id="HFDD23FE13FB447E989E57EFF61145775"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>,
			 but not including compensation paid by a mortgage originator or a creditor to
			 an individual person employed by the mortgage originator or creditor</quote>
			 after <quote>transaction</quote>; and</text>
				</paragraph><paragraph id="HDFE9ACB2F74449B0AD5F7823C9E6232C"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text>
					<subparagraph id="HD5AF3E1B395F41A9A807C102CD48ECDD"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>an escrow for future
			 payment of taxes</quote> and inserting <quote>the charges set forth under
			 section 106(e)(3)</quote>;</text>
					</subparagraph><subparagraph id="H3CEE5C16B0D547299A1FCA0339139C86"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by inserting <quote>,
			 except as retained by a creditor or its affiliate as a result of their
			 participation in an affiliated business arrangement (as defined in section 2(7)
			 of the Real Estate Settlement Procedures Act of 1974 (12 U.S.C.
			 2602(7))</quote> after <quote>compensation</quote>; and</text>
					</subparagraph><subparagraph id="HFC807ED5CFEA40E1B3487795C7699B2F"><enum>(C)</enum><text display-inline="yes-display-inline">by striking clause (iii) and inserting the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H36A97E63AAA64C90AA21789050C55996" style="OLC">
							<clause id="HC263877DE1FD484EA713FCBBFA95D8D1"><enum>(iii)</enum><text display-inline="yes-display-inline">the charge is—</text>
								<subclause id="H2AF24462811748888954C7B46195384A"><enum>(I)</enum><text>a bona fide
				third-party charge not retained by the mortgage originator, creditor, or an
				affiliate of the creditor or mortgage originator; or</text>
								</subclause><subclause id="H8C12979627FF460E95E5EACD7119C9BA"><enum>(II)</enum><text>a charge set
				forth in section
				106(e)(1).</text>
								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H9D67CA2CB367446DAE9B4CF70551CCCE"><enum>(b)</enum><header>Amendment to
			 Section 129C of TILA</header><text display-inline="yes-display-inline">Section
			 129C of the Truth in Lending Act (15 U.S.C. 1639c) is amended—</text>
				<paragraph id="H69E08FBAE19E419A8B57BE4CB00AA4F4"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(5)(C), by striking
			 <quote>, other</quote> and all that follows through <quote>or mortgage
			 originator</quote>; and</text>
				</paragraph><paragraph id="H258DEE6528804F768DB0F2C0F1F4F4E3"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(C)(i), by striking
			 <quote>(other</quote> and all that follows through <quote>or mortgage
			 originator)</quote>.</text>
