		<section id="H712A497CBE354B4AA2E9E3C444C7BC9A" section-type="section-one"><enum>1.</enum><header>Short title;
			 references</header>
			<subsection id="H90EDE582819E4A53A65770DBE5A5A2E5"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>International Child Support Recovery Improvement Act of
			 2012</short-title></quote>.</text>
			</subsection><subsection id="HC27FBBF69B4B4AF4B70780C18930A6C5"><enum>(b)</enum><header>References</header><text display-inline="yes-display-inline">Except as otherwise expressly provided in
			 this Act, wherever in this Act an amendment is expressed in terms of an
			 amendment to a section or other provision, the amendment shall be considered to
			 be made to a section or other provision of the Social Security Act.</text>
			</subsection></section><section id="HDDCCF35346D14D0BBA089E357704E232"><enum>2.</enum><header>Amendments to
			 ensure access to child support services for international child support
			 cases</header>
			<subsection id="HB9BA515222A34125920573B29F431CBB"><enum>(a)</enum><header>Authority of the
			 secretary of HHS To ensure compliance with multilateral child support
			 conventions</header>
				<paragraph id="H626839D389DB470F9B4E89B282864A39"><enum>(1)</enum><header>In
			 general</header><text>Section 452 (42 U.S.C. 652) is amended—</text>
					<subparagraph id="H60B6298389AF45CB85AFD867EC1366A1"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating the second subsection (l)
			 (as added by section 7306 of the Deficit Reduction Act of 2005) as subsection
			 (m); and</text>
					</subparagraph><subparagraph id="H525EC9C035A64731B31F970253343CBC"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H15D601A4E9D7465B821BA06EE93016B6" style="OLC">
							<subsection id="H4D8C0CB4420B4A43A63B60E5C9D1E18C"><enum>(n)</enum><text display-inline="yes-display-inline">The Secretary shall use the authorities
				otherwise provided by law to ensure the compliance of the United States with
				any multilateral child support convention to which the United States is a
				party.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H64D0EB6C87F54DF5B19C663BEEAD869F"><enum>(2)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 453(k)(3)
			 (42 U.S.C. 653(k)(3)) is amended by striking <quote>452(l)</quote> and
			 inserting <quote>452(m)</quote>.</text>
				</paragraph></subsection><subsection id="H58C6A42967644C59A6601C6B7E645EB6"><enum>(b)</enum><header>Access to the
			 federal parent locator service</header><text>Section 453(c) (42 U.S.C. 653(c))
			 is amended—</text>
				<paragraph id="HDC51BB41A273458282FF0C12810A7A09"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (3);</text>
				</paragraph><paragraph id="H27A48C3FC85D4EF7AC3744B9A59C93E2"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (4) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H1FC346936059475BB788B5B59A8525DD"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H42276D30E35C4AF581D76A4B4794DC58" style="OLC">
						<paragraph id="HDAB81D53E97F4DF3AB2EFD89702B0C71"><enum>(5)</enum><text>an entity
				designated as a Central Authority for child support enforcement in a foreign
				reciprocating country or a foreign treaty country for purposes specified in
				section
				459A(c)(2).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H82E1BD7AFB914DDE8AECA5223F74929A"><enum>(c)</enum><header>State option To
			 require individuals in foreign countries To apply through their country’s
			 appropriate central authority</header><text>Section 454 (42 U.S.C. 654) is
			 amended—</text>
				<paragraph id="HB80748AC587D49A9AD1CFD33997A2B05"><enum>(1)</enum><text>in paragraph
			 (4)(A)(ii), by inserting before the semicolon <quote>(except that, if the
			 individual applying for the services resides in a foreign reciprocating country
			 or foreign treaty country, the State may opt to require the individual to
			 request the services through the Central Authority for child support
			 enforcement in the foreign reciprocating country or the foreign treaty country,
			 and if the individual resides in a foreign country that is not a foreign
			 reciprocating country or a foreign treaty country, a State may accept or reject
			 the application)</quote>; and</text>
				</paragraph><paragraph id="H5E64273EA7964111BF443D56172C6377"><enum>(2)</enum><text>in paragraph
			 (32)—</text>
					<subparagraph id="H5E8AD3E4C0694A0EB0FB917F15044AF4"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>, a foreign treaty country,</quote> after <quote>a
			 foreign reciprocating country</quote>; and</text>
					</subparagraph><subparagraph id="HAEA665CEFB8C4F6D9122492A1DD24E64"><enum>(B)</enum><text>in subparagraph

					</subparagraph></paragraph></subsection><subsection id="HF2EB3683643647008993EECFEF528784"><enum>(d)</enum><header>Amendments to
			 international support enforcement provisions</header><text>Section 459A (42
			 U.S.C. 659a) is amended—</text>
				<paragraph id="H07C31D8D053B459A85BD8D4C3C54F047"><enum>(1)</enum><text>by adding at the
			 end the following:</text>

				this part:</text>
							<paragraph id="HDD36F891147D4BB98EE6468212B0013E"><enum>(1)</enum><header>Foreign
				reciprocating country</header><text>The term <term>foreign reciprocating
				country</term> means a foreign country (or political subdivision thereof) with
				respect to which the Secretary has made a declaration pursuant to subsection
				(a).</text>
							</paragraph><paragraph id="HFB40BE2B5EF3420E94502402505F19B7"><enum>(2)</enum><header>Foreign treaty
				country</header><text>The term <term>foreign treaty country</term> means a
				foreign country for which the 2007 Family Maintenance Convention is in
				force.</text>
							</paragraph><paragraph id="H9595625E17784ACB85F4B4103F2D84FB"><enum>(3)</enum><header>2007 Family
				maintenance convention</header><text>The term <term>2007 Family Maintenance
				Convention</term> means the Hague Convention of 23 November 2007 on the
				International Recovery of Child Support and Other Forms of Family
				Maintenance.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8A293D9997B9458DAC17823D0B92F6BC"><enum>(2)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H2861BF35CA0F47B5BD87831B8DEB5588"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>foreign countries that are the
			 subject of a declaration under this section</quote> and inserting
			 <quote>foreign reciprocating countries or foreign treaty countries</quote>;
			 and</text>
					</subparagraph><subparagraph id="H6752848A082842B6BA4134DDB700C0EF"><enum>(B)</enum><text>in paragraph (2),

				</paragraph></subsection><subsection id="H497DD77EFAB24EAD9B6AA5065C4636AC"><enum>(e)</enum><header>Collection of
			 past-Due support from Federal tax refunds</header><text>Section 464(a)(2)(A)
			 (42 U.S.C. 664(a)(2)(A)) is amended by striking <quote>under section
			 454(4)(A)(ii)</quote> and inserting <quote>under paragraph (4)(A)(ii) or (32)
			 of section 454</quote>.</text>
			</subsection><subsection id="HEA714487277F496CB0D95DC7A8E1F884"><enum>(f)</enum><header>State law
			 requirement concerning the Uniform Interstate Family Support Act
			 (UIFSA)</header>
				<paragraph id="H067483EAE08C439F94C6E791D947E3F2"><enum>(1)</enum><header>In
			 general</header><text>Section 466(f) (42 U.S.C. 666(f)) is amended—</text>
					<subparagraph id="H62887E96277B45F1BC005458E1B16D53"><enum>(A)</enum><text>by striking
			 <quote>on and after January 1, 1998,</quote>;</text>
					</subparagraph><subparagraph id="H05D42CBF49EE44838F7B12A2A1AA22D7"><enum>(B)</enum><text>by striking
			 <quote>and as in effect on August 22, 1996,</quote>; and</text>
					</subparagraph><subparagraph id="H7E1EB1CF3E27432C8781D151D759F610"><enum>(C)</enum><text>by striking
			 <quote>adopted as of such date</quote> and inserting <quote>adopted as of
			 September 30, 2008</quote>.</text>
					</subparagraph></paragraph><paragraph id="HBC51510C97CE4A3D9A76858E77ADA525"><enum>(2)</enum><header>Conforming
			 amendment to title 28, United States Code</header><text>Section 1738B of title
			 28, United States Code, is amended—</text>
					<subparagraph id="HA13BE87DD3A744E3949D7EF2C2D2AC81"><enum>(A)</enum><text>in subsection (d),
			 by striking <quote>individual contestant</quote> and inserting
			 <quote>individual contestant or the parties have consented in a record or open
			 court that the tribunal of the State may continue to exercise jurisdiction to
			 modify its order,</quote>;</text>
					</subparagraph><subparagraph id="H255AAC0A828842E9BE8F9CA75B9841BB"><enum>(B)</enum><text>in subsection
			 (e)(2)(A), by striking <quote>individual contestant</quote> and inserting
			 <quote>individual contestant and the parties have not consented in a record or
			 open court that the tribunal of the other State may continue to exercise
			 jurisdiction to modify its order</quote>; and</text>
					</subparagraph><subparagraph id="H8DF39BAF47B647939287375AEBBA1A68"><enum>(C)</enum><text>in subsection
			 (b)—</text>

			 striking <quote><quote>contestant</quote> means</quote> and inserting
			 <quote>(6) The term <term>contestant</term> means</quote>;</text>
						</clause><clause id="H5DAB8C154E6448BFAF0DA6C7B70B9AFF"><enum>(vii)</enum><text>by
			 striking <quote><quote>court</quote> means</quote> and inserting <quote>(7) The
			 term <term>court</term> means</quote>;</text>
						</clause><clause id="H808CA7432DEA4248971A4CDD9C9C5694"><enum>(viii)</enum><text>by striking
			 <quote><quote>modification</quote> means</quote> and inserting <quote>(8) The
			 term <term>modification</term> means</quote>; and</text>
						</clause><clause id="H08C9D3F8B6444FD79E1C09AFAE315CA2"><enum>(ix)</enum><text>by
			 striking <quote><quote>State</quote> means</quote> and inserting <quote>(9) The
			 term <term>State</term> means</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="H84E725B3CAFC4190BC0DFD4FE42D1237"><enum>(3)</enum><header>Effective date;
			 grace period for state law changes</header>
					<subparagraph id="H364248E983D54E7B8ACE784C48713FCC"><enum>(A)</enum><header>Paragraph
			 (1)</header><clause commented="no" display-inline="yes-display-inline" id="H17199C80492E48EBAB326D790A3E3DCF"><enum>(i)</enum><text>The
			 amendments made by paragraph (1) shall take effect with respect to a State on
			 the later of—</text>
							<subclause id="HEE05DCA5C995435BA7115C2AC493D00A" indent="up1"><enum>(I)</enum><text>October 1, 2013; or</text>
							</subclause><subclause id="HD278707275EC470CA758A82361DF0D77" indent="up1"><enum>(II)</enum><text>the effective date of laws enacted by
			 the legislature of the State implementing such paragraph, but in no event later
			 than the first day of the first calendar quarter beginning after the close of
			 the first regular session of the State legislature that begins after the date
			 of the enactment of this Act.</text>
							</subclause></clause><clause id="HB3B776CAC65248C6848F74F086D3E9E7" indent="up1"><enum>(ii)</enum><text>For purposes of clause (i), in the
			 case of a State that has a 2-year legislative session, each year of the session
			 shall be deemed to be a separate regular session of the State
			 legislature.</text>
						</clause></subparagraph><subparagraph id="H92D815452CF546C2A1E18040FE2C0076"><enum>(B)</enum><header>Paragraph
			 (2)</header><clause commented="no" display-inline="yes-display-inline" id="H22A66C59E5D546BC9FE34C82899EB82A"><enum>(i)</enum><text display-inline="yes-display-inline">The amendments made by subparagraphs (A)
			 and (B) of paragraph (2) shall take effect on the date on which the Hague
			 Convention of 23 November 2007 on the International Recovery of Child Support
			 and Other Forms of Family Maintenance enters into force for the United
			 States.</text>
						</clause><clause id="HAD4A2E347A734A8485F794AEDB347D08" indent="up1"><enum>(ii)</enum><text>The amendments made by
			 subparagraph (C) of paragraph (2) shall take effect on the date of the
			 enactment of this Act.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="H69A70CFA323A44309D3A69003A3EF26C"><enum>3.</enum><header>Data exchange
			 standardization for improved interoperability</header>
			<subsection id="H393BECD021154BC29CC854A892762688"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 452 (42
			 U.S.C. 652), as amended by section 2(a)(1) of this Act, is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HABDECA6FD72D48B180B8678DF5B35F5B" style="OLC">
					<subsection id="H6E96BD91D5FF44D69171D978EF4B5474"><enum>(o)</enum><header>Data exchange
				standardization for improved interoperability</header>
						<paragraph id="HF9E6868ACF6E4A4E85817FA98D3CEF27"><enum>(1)</enum><header>Data exchange
				standards</header>
							<subparagraph id="HE882CB812B1C467B9A1FE7A73AAC0968"><enum>(A)</enum><header>Designation</header><text display-inline="yes-display-inline">The Secretary, in consultation with an
				interagency work group which shall be established by the Office of Management
				and Budget, and considering State and tribal perspectives, shall, by rule,
				designate a data exchange standard for any category of information required to
				be reported under this part.</text>
							</subparagraph><subparagraph id="H64EF296762DC4550B30E2D67D345BDD1"><enum>(B)</enum><header>Data exchange
				standards must be nonproprietary and interoperable</header><text>The data
				exchange standard designated under subparagraph (A) shall, to the extent
				practicable, be nonproprietary and interoperable.</text>
							</subparagraph><subparagraph id="H2A2B721E1FB942D1A3FB811F00FBB56C"><enum>(C)</enum><header>Other
				requirements</header><text>In designating data exchange standards under this
				section, the Secretary shall, to the extent practicable, incorporate—</text>
								<clause id="H88F406A4FA81438B8F3A8DB5BDF6284B"><enum>(i)</enum><text>interoperable
				standards developed and maintained by an international voluntary consensus
				standards body, as defined by the Office of Management and Budget, such as the
				International Organization for Standardization;</text>
								</clause><clause id="H555B12B7C7C543BBB8460F61A8E78532"><enum>(ii)</enum><text>interoperable
				standards developed and maintained by intergovernmental partnerships, such as
				the National Information Exchange Model; and</text>
								</clause><clause id="HB26378DA94C5484D87E2F69FC88A7280"><enum>(iii)</enum><text>interoperable
				standards developed and maintained by Federal entities with authority over
				contracting and financial assistance, such as the Federal Acquisition
				Regulatory Council.</text>
								</clause></subparagraph></paragraph><paragraph id="H9AB020EB2EED46ECB47EEC9DFAF74BA4"><enum>(2)</enum><header>Data exchange
				standards for reporting</header>
							<subparagraph id="H1137E06D13154E298B710FE40D700B65"><enum>(A)</enum><header>Designation</header><text>The
				Secretary, in consultation with an interagency work group established by the
				Office of Management and Budget, and considering State and tribal perspectives,
				shall, by rule, designate data exchange standards to govern the data reporting
				required under this part.</text>
							</subparagraph><subparagraph id="H4B55141B29C24CA1BDE4F47C1F813F9B"><enum>(B)</enum><header>Requirements</header><text>The
				data exchange standards required by subparagraph (A) shall, to the extent
				practicable—</text>
								<clause id="HBA7A27FBA2284BC4BEF595B59DC30D71"><enum>(i)</enum><text>incorporate a
				widely-accepted, nonproprietary, searchable, computer-readable format;</text>
								</clause><clause id="H123A888669F949609D39CDEAA07A143C"><enum>(ii)</enum><text>be consistent
				with and implement applicable accounting principles; and</text>
								</clause><clause id="H846E5D67D63B4E0DA86EA7B79B7182F3"><enum>(iii)</enum><text>be capable of
				being continually upgraded as necessary.</text>
								</clause></subparagraph><subparagraph id="HAFDB11CB7F134E35914FD617B38B9E95"><enum>(C)</enum><header>Incorporation of
				nonproprietary standards</header><text>In designating reporting standards under
				this paragraph, the Secretary shall, to the extent practicable, incorporate
				existing nonproprietary standards, such as the eXtensible Markup
				Language.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3D2840F652F0445EB4932F2AEA98D353"><enum>(b)</enum><header>Effective
			 dates</header>
				<paragraph id="H655212C6D4AE451C87234F34DF45DAE6"><enum>(1)</enum><header>Data exchange
			 standards</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall issue a proposed rule under section 452(o)(1)
			 of the Social Security Act within 12 months after the date of the enactment of
			 this section, and shall issue a final rule under such section 452(o)(1), after
			 public comment, within 24 months after such date of enactment.</text>
				</paragraph><paragraph id="HDC338120C56A4C8EBD26EA0A4D873392"><enum>(2)</enum><header>Data reporting
			 standards</header><text>The reporting standards required under section
			 452(o)(2) of such Act shall become effective with respect to reports required
			 in the first reporting period, after the effective date of the final rule
			 referred to in paragraph (1) of this subsection, for which the authority for
			 data collection and reporting is established or renewed under the Paperwork
			 Reduction Act.</text>
				</paragraph></subsection></section><section id="H3B42B162CCB047449E2735ECBC20D4A8"><enum>4.</enum><header>Efficient use of
			 the National Directory of New Hires database for federally sponsored research
			 assessing the effectiveness of Federal policies and programs in achieving
			 positive labor market outcomes</header><text display-inline="no-display-inline">Section 453 (42 U.S.C. 653) is
			 amended—</text>
			<paragraph id="H7631F0D3ECCD492B9C65D71F95A0F711"><enum>(1)</enum><text>in subsection
			 (i)(2)(A), by striking <quote>24</quote> and inserting <quote>48</quote>;
			 and</text>
			</paragraph><paragraph id="H223D51AB8C71492394D2C436D9DA75EA"><enum>(2)</enum><text>in subsection (j),
			 by striking paragraph (5) and inserting the following:</text>

				general</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B) of this paragraph, the Secretary may provide access to data in
				each component of the Federal Parent Locator Service maintained under this
				section and to information reported by employers pursuant to section 453A(b),
				for—</text>
							<clause id="H52ACBF0907F64D798D3E01FA454356C6"><enum>(i)</enum><text>research
				undertaken by a State or Federal agency (including through grant or contract)
				for purposes found by the Secretary to be likely to contribute to achieving the
				purposes of part A or this part; or</text>
							</clause><clause id="H979E99F5BE8143148B463BEE7E17D72D"><enum>(ii)</enum><text>an evaluation or
				statistical analysis undertaken to assess the effectiveness of a Federal
				program in achieving positive labor market outcomes (including through grant or
				contract), by—</text>
								<subclause id="HE993D2C70617407DB847BE95C1F3A129"><enum>(I)</enum><text display-inline="yes-display-inline">the Department of Health and Human
				Services;</text>
								</subclause><subclause id="H88788FDF81364961BCD685FA345333DF"><enum>(II)</enum><text>the Social
				Security Administration;</text>
								</subclause><subclause id="H3F2127BB5380482E922D891ED4448832"><enum>(III)</enum><text>the Department
				of Labor;</text>
								</subclause><subclause id="HB0F988CA7B8E4C3497ECE688BA9E1CE1"><enum>(IV)</enum><text>the Department of
				Education;</text>
								</subclause><subclause id="H284AC31E480841A9BAC6FB561A9BFAF9"><enum>(V)</enum><text>the Department of
				Housing and Urban Development;</text>
								</subclause><subclause id="H5B6DB184D64A4DAF8470215A13C9A687"><enum>(VI)</enum><text>the Department of
				Justice;</text>
								</subclause><subclause id="HCF4D0F175D1443F0AD9B83AD2DCCB2A3"><enum>(VII)</enum><text>the Department
				of Veterans Affairs;</text>
								</subclause><subclause id="H0FE10A67D93F4DD382F29F1861DA4C95"><enum>(VIII)</enum><text>the Bureau of
				the Census;</text>
								</subclause><subclause id="H7D75890B1A274BBFAFA08BFCBD0D8CD6"><enum>(IX)</enum><text>the Department of
				Agriculture; or</text>
								</subclause><subclause id="HDBD5028B61474D458AF93ECDFE154A07"><enum>(X)</enum><text>the National
				Science Foundation.</text>
								</subclause></clause></subparagraph><subparagraph id="HBC5D3807C1A54003BBED7130A5F20C91"><enum>(B)</enum><header>Personal
				identifiers</header><text>Data or information provided under this paragraph may
				include a personal identifier only if, in addition to meeting the requirements
				of subsections (l) and (m)—</text>
							<clause id="HC68F88EB3E6D41F5B61BD405A6B074E9"><enum>(i)</enum><text>the State or
				Federal agency conducting the research described in subparagraph (A)(i), or the
				Federal department or agency undertaking the evaluation or statistical analysis
				described in subparagraph (A)(ii), as applicable, enters into an agreement with
				the Secretary regarding the security and use of the data or information;</text>
							</clause><clause id="H40D4D346274C4590ADE60513753B8856"><enum>(ii)</enum><text>the agreement
				includes such restrictions or conditions with respect to the use, safeguarding,
				disclosure, or redisclosure of the data or information (including by
				contractors or grantees) as the Secretary deems appropriate;</text>
							</clause><clause id="H20E5113B9E9B4456AD3D8FD0EB82D4C2"><enum>(iii)</enum><text>the data or
				information is used exclusively for the purposes defined in the agreement;
				and</text>
							</clause><clause id="HF3AAC6FB74064DD6B25C08634DEAEE6E"><enum>(iv)</enum><text>the Secretary
				determines that the provision of data or information under this paragraph is
				the minimum amount needed to conduct the research, evaluation, or statistical
				analysis, as applicable, and will not interfere with the effective operation of
				the program under this part.</text>
							</clause></subparagraph><subparagraph id="H244D7AE7EC3D4A7596838B6DB6314EDD"><enum>(C)</enum><header>Penalties for
				unauthorized disclosure of data</header><text>Any individual who willfully
				discloses a personal identifier (such as a name or social security number)
				provided under this paragraph, in any manner to an entity not entitled to
				receive the data or information, shall be guilty of a class E felony under
				title 18, United States Code. Any penalty imposed under the preceding sentence
				shall be in addition to any applicable penalty under subsection
				(l).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H6074D1E20A7E47F297A832C9A9400152"><enum>5.</enum><header>Budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the Senate Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>
