			 wilderness, Uinta-Wasatch-Cache National Forests, Utah</header>
			<subsection id="H372ADB91D9974C89AF403D13A404A78C"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">In furtherance of the purposes of the
			 Wilderness Act (16 U.S.C. 1131 et seq.), the following Federal lands within the
			 Uinta-Wasatch-Cache National Forests in Salt Lake County, Utah, are designated
			 as wilderness and as either a new component of the National Wilderness
			 Preservation System or as an addition to an existing component of the National
			 Wilderness Preservation System:</text>
				<paragraph id="H268460BC2ED04800B787CAE5A48C85C6"><enum>(1)</enum><header>Lone Peak
			 Wilderness addition</header><text display-inline="yes-display-inline">Certain
			 lands in the vicinity of the Lone Peak Wilderness comprising approximately
			 4,627 acres, as generally depicted on the map titled <term>Wasatch Mountains
			 Wilderness and Watershed Protection</term> and dated January 29, 2010 (in this
			 subsection referred to as the <term>map</term>), which shall be added to and
			 administered as part of the Lone Peak Wilderness designated by section 2(I) of
			 Public Law 95–237 (92 Stat. 42).</text>
				</paragraph><paragraph id="H21ADDB0D692C43C594BDC0B148552B8F"><enum>(2)</enum><header>Mount Olympus
			 Wilderness addition</header><text display-inline="yes-display-inline">Certain
			 lands in the vicinity of the Mount Olympus Wilderness comprising approximately
			 3,155 acres, as generally depicted on the map, which shall be added to and
			 administered as part of the Mount Olympus Wilderness designated by section
			 102(a)(3) of Public Law 98–428 (98 Stat. 1658).</text>
				</paragraph><paragraph id="H1C8C414559A940C98D1E888A8FCEA263"><enum>(3)</enum><header>Wayne Owens
			 Grandeur Peak/Mount Aire Wilderness</header><text display-inline="yes-display-inline">Certain lands comprising approximately
			 7,759 acres, as generally depicted on the map, which shall be known as the
			 <term>Wayne Owens Grandeur Peak/Mount Aire Wilderness</term>.</text>
				</paragraph></subsection><subsection id="H9ECDE85A301A48BAAA3F3948D8A6F0EF"><enum>(b)</enum><header>Map and
			 description</header>
				<paragraph id="H530CD779EC5B438D821F955579AEEF42"><enum>(1)</enum><header>Filing and
			 availability</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of the enactment of this Act, the Secretary of
			 Agriculture, acting through the Chief of the Forest Service, shall file with
			 the Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate a map and legal
			 description of each wilderness area designated or expanded by subsection (a).
			 The maps and legal descriptions shall be on file and available for public
			 inspection in the office of the Chief of the Forest Service.</text>
				</paragraph><paragraph id="H719F31D7E321430D805B58F35141F1E6"><enum>(2)</enum><header>Force of
			 law</header><text>The maps and legal descriptions filed under paragraph (1)
			 shall have the same force and effect as if included in this Act, except that
			 the Secretary of Agriculture may correct clerical and typographical errors in
			 the maps and legal descriptions.</text>
				</paragraph></subsection><subsection id="H4AC0FB924C9D4BE0AB241300C14F8593"><enum>(c)</enum><header>Special rule for
			 Lone Peak Wilderness addition</header><text display-inline="yes-display-inline">Notwithstanding the wilderness designation
			 made by subsection (a)(1), the White Pine Reservoir, together with the ingress
			 and egress routes thereto in existence as of the date of the enactment of this
			 Act, shall continue to be operated, maintained, and upgraded as necessary,
			 subject to reasonable requirements to protect wilderness values.</text>
			</subsection></section><section id="H03A3702DDF6F449A8C4E366D2D8FA157"><enum>3.</enum><header>Special
			 management area, Uinta-Wasatch-Cache National Forests, Utah</header>
			<subsection id="H90FCC4F196B34B2886BDA30C18171074"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">Subject to valid existing rights, the
			 following Federal lands in the Uinta-Wasatch-Cache National Forests are
			 established as special management areas:</text>
				<paragraph id="H21A7435E6BDF44DFBD428CF7738767EF"><enum>(1)</enum><header>Mt. Aire Special
			 Management Area</header><text display-inline="yes-display-inline">Certain lands
			 comprising approximately 1,275 acres, as generally depicted on a map titled
			 <term>Wasatch Mountains Wilderness Protection and Watershed Protection</term>
			 and dated January 29, 2010 (in this subsection referred to as the
			 <term>map</term>), which shall be known as the <term>Mt. Aire Special
			 Management Area</term>.</text>
				</paragraph><paragraph id="H80BFC63B0BF84902A2A08DED2164F52F"><enum>(2)</enum><header>Mt. Olympus
			 Special Management Area</header><text>Certain lands comprising approximately
			 1,957 acres, as generally depicted on the map, which shall be known as the
			 <term>Mt. Olympus Special Management Area</term>.</text>
				</paragraph><paragraph id="HFB9E22A0D5924E48AA2910CCCC7E3AC7"><enum>(3)</enum><header>Twin Peaks
			 Special Management Area</header><text>Certain lands comprising approximately
			 5,835 acres, as generally depicted on the map, which shall be known as the
			 <term>Twin Peaks Special Management Area</term>.</text>
				</paragraph><paragraph id="H54FF59711ED54644B8CCB01CD07A3AE7"><enum>(4)</enum><header>Lone Peak
			 Special Management Area</header><text>Certain lands comprising approximately
			 1,413 acres, as generally depicted on the map, which shall be known as the
			 <term>Lone Peak Special Management Area</term>.</text>
				</paragraph></subsection><subsection id="H805932070EA54159830BC5198E41A467"><enum>(b)</enum><header>Maps and
			 descriptions</header>
				<paragraph id="H2595F1FA7B1F4CEB887CC75216B4E228"><enum>(1)</enum><header>Filing and
			 availability</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of the enactment of this Act, the Secretary of
			 Agriculture, acting through the Chief of the Forest Service, shall file with
			 the Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate a map and legal
			 description of each special management area established by subsection (a). The
			 maps and legal descriptions shall be on file and available for public
			 inspection in the office of the Chief of the Forest Service.</text>
				</paragraph><paragraph id="HD954C0AFAFCF4E80B7C1F5845AA1D286"><enum>(2)</enum><header>Force of
			 law</header><text display-inline="yes-display-inline">The maps and legal
			 descriptions filed under paragraph (1) shall have the same force and effect as
			 if included in this Act, except that the Secretary of Agriculture may correct
			 typographical errors in the maps and legal descriptions.</text>
				</paragraph></subsection><subsection id="HAC0AF9F02ABB4940B52985C9FE873744"><enum>(c)</enum><header>Management</header>
				<paragraph id="H99EEBA9C00AB4A1BBDD7FA5D897CE2E4"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall manage the special management area established by subsection
			 (a) to maintain the presently existing wilderness character of the special
			 management area and the potential for inclusion of the area in the National
			 Wilderness Preservation System.</text>
				</paragraph><paragraph id="H845186A2F3F247B88ADA9D5AAA19DA55"><enum>(2)</enum><header>Prohibitions</header>
					<subparagraph id="HC4C95D702C5946F0B3A84FA33C04503E"><enum>(A)</enum><header>Permanent
			 roads</header><text display-inline="yes-display-inline">Permanent roads may not
			 be established in the special management areas.</text>
					</subparagraph><subparagraph id="H4C9580406BB24E639AC6168FC3ACA6C3"><enum>(B)</enum><header>Temporary roads
			 and vehicles</header><text display-inline="yes-display-inline">Except as
			 necessary to meet the minimum requirements for the administration of the
			 special management areas and to protect public health and safety—</text>
						<clause id="H7DB8D8EF52A342D8B214F8F6B948B4B6"><enum>(i)</enum><text display-inline="yes-display-inline">the use of motorized or mechanized
			 vehicles, except as described in paragraph (3), is prohibited in the special
			 management area; and</text>
						</clause><clause id="H2B55302EC6B64D17B107B36A3199A7B1"><enum>(ii)</enum><text display-inline="yes-display-inline">the establishment of temporary roads is
			 prohibited in the special management areas.</text>
						</clause></subparagraph></paragraph><paragraph id="H842215C84F9943A0A2B39C160E684CB3"><enum>(3)</enum><header>Allowable
			 activities</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture may authorize commercial helicopter-assisted skiing and
			 snowboarding activities (known as <term>heliskiing</term>), as authorized on
			 the Federal lands included within the special management areas as of the date
			 of the enactment of this Act, to continue within the special management area.
			 Except as provided in subsection (d), upon the expiration of an authorization
			 in effect as of the date of enactment of this Act for heliskiing, the Secretary
			 may reissue such authorizations in accord with Forest Service
			 procedures.</text>
				</paragraph><paragraph id="HF040E78557BE46FE883CA103336DBB11"><enum>(4)</enum><header>Applicable
			 law</header><text display-inline="yes-display-inline">Any uses of the Federal
			 lands included within the special management area, including activities
			 described in paragraph (3), shall be carried out in accordance with applicable
			 law.</text>
				</paragraph></subsection><subsection id="H9D837CE182B442699C9D9A63925BA67D"><enum>(d)</enum><header>Eventual
			 wilderness designation</header>
				<paragraph id="H2D2C1833FB004ED58EBC4B4E1CC8D16D"><enum>(1)</enum><header>Timeline</header><text display-inline="yes-display-inline">Within one year from the time in which all
			 commercial helicopter-assisted skiing and snowboarding activities within any
			 special management area established by subsection (a) are no longer authorized
			 or have otherwise terminated within the special management area, the Secretary
			 of Agriculture shall publish notice to that effect in the Federal
			 Register.</text>
				</paragraph><paragraph id="HB10FB034B477476F9F6D6980887CD3C1"><enum>(2)</enum><header>Designation as
			 wilderness</header><text display-inline="yes-display-inline">The Federal lands
			 included within a special management area for which notice has been published
			 under paragraph (1) shall be designated as wilderness and added to the National
			 Wilderness Preservation System, effective on the date of the notice, as
			 follows:</text>
					<subparagraph id="H9795DDD332B340C6B934A50BF8B70FEE"><enum>(A)</enum><text display-inline="yes-display-inline">The lands included in the Mt. Aire Special
			 Management Area shall be added to and administered as part of the Wayne Owens
			 Grandeur Peak/Mount Aire Wilderness established by section 2.</text>
					</subparagraph><subparagraph id="H636692696656482D90A88F0B06B865E9"><enum>(B)</enum><text>The lands included
			 in the Mt. Olympus Special Management Area shall be added to and administered
			 as a part of the Mount Olympus Wilderness designated by section 102(a)(3) of
			 Public Law 98–428 (98 Stat. 1658) and expanded by section 2.</text>
					</subparagraph><subparagraph id="H548F9961985042B1A44A65E12131E9BC"><enum>(C)</enum><text display-inline="yes-display-inline">The lands included in the Twin Peaks
			 Special Management Area shall be added to and administered as a part of the
			 Twin Peaks Wilderness designated by section 102(a)(4) of Public Law 98–428 (98
			 Stat. 1658).</text>
					</subparagraph><subparagraph id="HFBDBDF1A0D2B4AEF897BC2668ABD20CC"><enum>(D)</enum><text display-inline="yes-display-inline">The lands included in the Lone Peak Special
			 Management Area shall be added to and administered as part of the Lone Peak
			 Wilderness designated by section 2(I) of Public Law 95–237 (92 Stat. 42) and
			 expanded by section 2.</text>
					</subparagraph></paragraph></subsection></section><section id="H52CCA7FE62BF4CC4962AD5601715C57D"><enum>4.</enum><header>Administrative
			 provisions related to wilderness areas</header>
			<subsection id="H97C239EEBB994BB497B97E238875A625"><enum>(a)</enum><header>Covered land
			 defined</header><text>In this section, the term <term>covered land</term>
			 means—</text>
				<paragraph id="H4A1BCAADA2D04CAC855B092ED58B9B8C"><enum>(1)</enum><text display-inline="yes-display-inline">the wilderness areas designated or expanded
			 by sections 2 and 3; and</text>
				</paragraph><paragraph id="H961D619E68134A5A99C4DF807F762A1D"><enum>(2)</enum><text display-inline="yes-display-inline">the special management areas designated by
			 section 3.</text>
				</paragraph></subsection><subsection id="HC742D30217244D16A1954E0802DEE19E"><enum>(b)</enum><header>Administration
			 generally</header><text>Subject to valid rights in existence on the date of the
			 enactment of this Act, land designated as wilderness by section 2 or 3 shall be
			 administered by the Secretary of Agriculture in accordance with—</text>
				<paragraph id="H650E8C16B8C84BFDBD6F5244AFFCBA1F"><enum>(1)</enum><text>the Wilderness Act
			 (16 U.S.C. 1131 et seq.); and</text>
				</paragraph><paragraph id="H61DFF7FF91D848C1A4A3FAA0B6BEAC5E"><enum>(2)</enum><text>this Act.</text>
				</paragraph></subsection><subsection id="HD9DBC70F56094DE990B4B95DBC51E7B6"><enum>(c)</enum><header>Treatment of
			 effective date of wilderness act</header>
				<paragraph id="H280932DB72674E899AEE373D41FC55B2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">With respect to land
			 designated as wilderness by section 2, any reference in the Wilderness Act (16
			 U.S.C. 1131 et seq.) to the effective date of the Wilderness Act shall be
			 deemed to be a reference to the date of the enactment of this Act.</text>
				</paragraph><paragraph id="H4500112D289E43F7BC6488A981709466"><enum>(2)</enum><header>Special
			 management areas</header><text display-inline="yes-display-inline">With respect
			 to the lands designated as wilderness by section 3, any reference in the
			 Wilderness Act to the effective date of the Wilderness Act shall be deemed to
			 be a reference to the date of the applicable Federal Register notice referred
			 to in section 3(d)(1).</text>
				</paragraph></subsection><subsection id="H07FCC9DDD4D64B699FC86B846C79AF70"><enum>(d)</enum><header>Fish and
			 wildlife</header><text>Nothing in this Act shall affect the jurisdiction or
			 responsibility of the State of Utah with respect to wildlife and fish.</text>
			</subsection><subsection id="H6FD40061DB42497B88AD33E9D7DE67E4"><enum>(e)</enum><header>No Buffer
			 Zones</header>
				<paragraph id="H09D69389072D42F5B377B83D0FFC467F"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this Act shall create a protective perimeter
			 or buffer zone around covered land.</text>
				</paragraph><paragraph id="H32918E1D56EC4AC6916AEDB25CC3371D"><enum>(2)</enum><header>Activities
			 outside wilderness</header><text>The fact that a nonwilderness activity or use
			 can be seen or heard from within covered land shall not preclude the conduct of
			 the activity or use outside the boundary of the covered land.</text>
				</paragraph></subsection><subsection id="H96B69F81BD7441D9837DA590722A4CB8"><enum>(f)</enum><header>Withdrawal</header><text>Subject
			 to valid rights in existence on the date of the enactment of this Act, covered
			 land is withdrawn from all forms of—</text>
				<paragraph id="H8E75BBFD6DBD4125A84E69BC8E8CA528"><enum>(1)</enum><text>entry,
			 appropriation, or disposal under public land laws;</text>
				</paragraph><paragraph id="H8D08F4F12FD04A98BCC5273D22F12665"><enum>(2)</enum><text>location, entry,
			 and patent under mining laws; and</text>
				</paragraph><paragraph id="H5206A008E29E435EB020709B70437362"><enum>(3)</enum><text>disposition under
			 all laws pertaining to mineral and geothermal leasing or mineral
			 materials.</text>
				</paragraph></subsection><subsection id="H0072026FB7B9496DB5E2FC9BE18E9D32"><enum>(g)</enum><header>Acquired
			 Land</header><text>Any land or interest in land located inside the boundaries
			 of covered land that is acquired by the United States after the date of the
			 enactment of this Act shall become part of the relevant wilderness or special
			 management area and shall be managed in accordance with this Act and other
			 applicable law.</text>
			</subsection><subsection id="HD2F3E30E44B04FFB91EBCC0D62BABFAD"><enum>(h)</enum><header>Fire, insects,
			 and disease</header><text display-inline="yes-display-inline">In accordance
			 with section 4(d)(1) of the Wilderness Act (16 U.S.C. 1133(d)(1)), the
			 Secretary of Agriculture may take such measures in the covered land as the
			 Secretary determines to be necessary for the control of fire, insects, and
			 diseases, including, as the Secretary determines to be appropriate, the
			 coordination of those activities with a State or local agency.</text>
			</subsection></section><section id="HF849BD2FD6D64AC89D0E7BA3739917B6"><enum>5.</enum><header>Existing water
			 facilities</header><text display-inline="no-display-inline">Nothing in this Act
			 affects the ability to continue to maintain the Mount Haven, Mill D Summer
			 Home, Beartrap, and Cardiff water systems that exist as of the date of the
			 enactment of this Act (as shown on the map titled <term>Wasatch Mountains
			 Wilderness and Watershed Protection</term> and dated January 10, 2010, outside
			 the boundaries of the wilderness additions and special management areas
			 designated by this Act.</text>
		</section><section id="H34B5FD348C3F4B01B519A6661DACDA7B" section-type="subsequent-section"><enum>6.</enum><header>Land exchange,
			 Uinta-Wasatch-Cache National Forests, Utah</header>
			<subsection id="H130EDF16ED8D41A3AC7829C073B209FE"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H84A1BEBF929F429FB004E499A45C508B"><enum>(1)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the approximately
			 331 acres of National Forest System land in the Uinta-Wasatch-Cache National
			 Forest in Salt Lake County, Utah, identified as <term>NFS Land to be
			 Conveyed</term> on the map.</text>
				</paragraph><paragraph id="HAD914B5453E74074B15F7D9D0FDDA725"><enum>(2)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <term>Wasatch Mountains Wilderness
			 and Watershed Protection</term> and dated August 31, 2010, which map shall be
			 on file and available for public inspection in the Office of the Chief of the
			 Forest Service.</text>
				</paragraph><paragraph id="H7530EE0E2D234893ADF4540B884F2086"><enum>(3)</enum><header>Non-Federal
			 land</header><text>The term <term>non-Federal land</term> means the parcels of
			 private land identified as <term>Land to be acquired by USFS</term> on the map,
			 including—</text>
					<subparagraph id="HE596E42309E041B3A9213B15438486AC"><enum>(A)</enum><text display-inline="yes-display-inline">the approximately 116 acres of private land
			 identified as <term>White Pine parcel</term> on the map, which will be
			 incorporated into the Lone Peak Wilderness as provided in subsection
			 (h)(1);</text>
					</subparagraph><subparagraph id="H76061ECA836C4F528C6C329621BDFBD2"><enum>(B)</enum><text display-inline="yes-display-inline">the approximately 266 acres of private land
			 identified as <term>Superior parcels</term> on the map, which will be
			 administered as a special management area as provided in subsection
			 (h)(2);</text>
					</subparagraph><subparagraph id="HB354F48BBBD1498599F84E8D9C0D0547"><enum>(C)</enum><text display-inline="yes-display-inline">the approximately 160 acres of private land
			 identified as <term>High Uintas</term> parcel on the map, which will be
			 incorporated into the High Uintas Wilderness as provided in subsection (h)(3);
			 and</text>
					</subparagraph><subparagraph id="H82FA8EC2E9784AF8AD6DF951EA93ED9E"><enum>(D)</enum><text>such other lands
			 owned by Snowbird that are acceptable to the Secretary as components of the
			 land exchange authorized and directed by this section, except that such lands
			 may not replace any of the lands identified in a preceding subparagraph.</text>
					</subparagraph></paragraph><paragraph id="HBE1E7B1540884571A4D15EAD570CD745"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Agriculture.</text>
				</paragraph><paragraph id="H2F336E8A44804FE3816D03BE7DBB1E95"><enum>(5)</enum><header>Snowbird</header><text>The
			 term <term>Snowbird</term> means Snowbird Ltd., a Utah Limited
			 Partnership.</text>
				</paragraph></subsection><subsection id="H72ADF430914B4B61BB19FC6C57C9E23B"><enum>(b)</enum><header>Land
			 exchange</header>
				<paragraph id="HF0943A0DBB514AD29B92AAFDF9852F3E"><enum>(1)</enum><header>Authorized and
			 directed</header><text display-inline="yes-display-inline">If Snowbird offers
			 to the Secretary the land described in paragraph (2), the Secretary
			 shall—</text>
					<subparagraph id="H0ED6AEDC56F948A7954EE4D9687DFB21"><enum>(A)</enum><text>accept the land
			 for management as provided in subsection (h); and</text>
					</subparagraph><subparagraph id="HDD5F4F6BBDDD45BEB3439FB96504AFA1"><enum>(B)</enum><text>convey and
			 quitclaim to Snowbird all right, title, and interest of the United States in
			 and to the Federal land.</text>
					</subparagraph></paragraph><paragraph id="HC4B7B4C86A2F4C65B9CC9E98AAC44B11"><enum>(2)</enum><header>Snowbird offered
			 lands</header><text display-inline="yes-display-inline">The private land
			 offered by Snowbird in the land exchange shall include, in priority order, all
			 right, title, and interest of Snowbird in the parcels identified in
			 subparagraphs (A), (B), and (C) of subsection (a)(3) and such other lands
			 agreed upon as part of the exchange to be conveyed to the United States under
			 subparagraph (D) of such subsection.</text>
				</paragraph><paragraph id="H866F9147D3594EFFBA82D4CECFE9CF75"><enum>(3)</enum><header>Existing
			 rights</header><text display-inline="yes-display-inline">The conveyance of the
			 Federal land under this section shall be subject to valid existing
			 rights.</text>
				</paragraph><paragraph id="H8C6DCC133E6B456EAC89DF418BE02C6F"><enum>(4)</enum><header>Title</header><text display-inline="yes-display-inline">As a condition on the consummation of the
			 land exchange, title to the non-Federal land must be acceptable to the
			 Secretary, which shall be determined in conformity with the title standards of
			 the Attorney General.</text>
				</paragraph><paragraph id="H387594392DC5422EB82FB922E73A226E"><enum>(5)</enum><header>Compliance with
			 existing law</header><text display-inline="yes-display-inline">Except as
			 otherwise provided in this section, the Secretary shall carry out the land
			 exchange under this section in accordance with section 206 of the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1716).</text>
				</paragraph></subsection><subsection id="H7A915EBD5394419B9C4178F2C95A9BD3"><enum>(c)</enum><header>Land
			 descriptions</header>
				<paragraph display-inline="no-display-inline" id="H39B9E3D963644FA79A9B77B5944C5781"><enum>(1)</enum><header>Survey
			 requirement</header><text>The exact acreage and legal description of the
			 Federal land and non-Federal land to be exchanged under this section shall be
			 determined by surveys approved by the Secretary.</text>
				</paragraph><paragraph id="H0CBF226A13B144BE82ECC94539603B66"><enum>(2)</enum><header>Reconfiguration
			 of lands</header><text display-inline="yes-display-inline">By mutual agreement,
			 the Secretary and Snowbird may reconfigure the land to be exchanged under this
			 section to facilitate management of the land or eliminate fragmented parcels
			 whose management is uneconomical. The use of such reconfiguration authority
			 shall be minimized and involve the smallest quantity of acreage practicable to
			 achieve the objectives of improving management of the exchanged land or
			 eliminating fragmented parcels.</text>
				</paragraph></subsection><subsection id="H0C185B42DAC741D78A9D18D57EEC76F5"><enum>(d)</enum><header>Valuation</header>
				<paragraph id="H8CC81E741C784058A2772D481156BA93"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The value of the
			 Federal land and the non-Federal land to be exchanged under this
			 section—</text>
					<subparagraph id="H64676BC0E92F4997AC0C4E194B8A0655"><enum>(A)</enum><text>shall be equal, as
			 determined by appraisals conducted in accordance with subsection (e); or</text>
					</subparagraph><subparagraph id="HB5462DB5A6024B419D8E9D5DE5D8636B"><enum>(B)</enum><text display-inline="yes-display-inline">if not equal, shall be equalized in the
			 manner provided in section 206(b) of the Federal Land Policy and Management Act
			 of 1976 (43 U.S.C. 1716(b)), except that the Secretary may accept cash
			 equalization payments in excess of 25 percent to facilitate the land
			 exchange.</text>
					</subparagraph></paragraph><paragraph id="H7C6C3B69A4DD4A7CBE2792B4CCA2D195"><enum>(2)</enum><header>Deposit and use
			 of cash equalization payments</header><text display-inline="yes-display-inline">Any cash equalization payments received by
			 the Secretary under paragraph (1) shall be deposited into the account
			 established by Public Law 90–171 (commonly known as the Sisk Act; 16 U.S.C.
			 484a). The amounts deposited shall be available, in such amounts as may be
			 provided in advance in appropriation Acts, until expended for the acquisition
			 of lands and interests in lands for the National Forest System.</text>
				</paragraph></subsection><subsection id="H6486772E52B947BD89B6B93DCF053E89"><enum>(e)</enum><header>Appraisals</header><text display-inline="yes-display-inline">Section 206(d) of the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1716(d)) shall apply to the appraisal of
			 the Federal land and non-Federal land, including the conservation easement
			 described in subsection (g), to be exchanged under this section, except that
			 the Secretary and Snowbird shall consult with the proposed recipient of the
			 conservation easement in the selection of the appraiser.</text>
			</subsection><subsection id="H0CE196A3DDB845008D35CC78DE36D0AD"><enum>(f)</enum><header>Administrative
			 costs</header><text>Snowbird shall cover the costs of survey, appraisal, and
			 any other administrative expenses related to the land exchange under this
			 section.</text>
			</subsection><subsection id="HD16B4D394DD54FCCA13DBE608EB72298"><enum>(g)</enum><header>Conservation
			 easement</header>
				<paragraph id="H771DEEABBB4940A996305E5FF062E4E7"><enum>(1)</enum><header>Contingency</header><text display-inline="yes-display-inline">The obligation of the Secretary to
			 consummate the land exchange under this section is contingent upon the
			 execution of a binding agreement to convey a conservation easement, consistent
			 with the terms of this subsection, for the approximately 298 acres of private
			 land identified as <term>Flagstaff parcel</term> on the map from Snowbird
			 to—</text>
					<subparagraph id="H7205873E0BF3484A95AEA3E1B1590211"><enum>(A)</enum><text>Utah Open Lands (a
			 non-profit land trust incorporated in the State of Utah); or</text>
					</subparagraph><subparagraph id="H5AEA423FB2C644D999AAC1C428826AE8"><enum>(B)</enum><text>another land trust
			 or the Salt Lake City Department of Public Utilities if Utah Open Lands is
			 unwilling to accept conveyance of the conservation easement.</text>
					</subparagraph></paragraph><paragraph id="HFFE8A606837D4F5AA658EF384F309918"><enum>(2)</enum><header>Required
			 terms</header><text display-inline="yes-display-inline">Except as determined to
			 be necessary by the holder of the conservation easement described in paragraph
			 (1) to meet the minimum requirements for the administration of the easement
			 area in its undeveloped state or to protect public health and safety, the
			 conservation easement shall contain the following prohibitions:</text>
					<subparagraph id="H6C38317185E0403DAAD30BEB9C1C3BF1"><enum>(A)</enum><text display-inline="yes-display-inline">No subdivision.</text>
					</subparagraph><subparagraph id="H65AA7EED3A064D6EA8C5DC6D64B9D8C2"><enum>(B)</enum><text display-inline="yes-display-inline">No roads, other than temporary roads
			 constructed and used for cleanup of mining areas.</text>
					</subparagraph><subparagraph id="HDA6BBA1324B0481DAD62DEE74C4BF3AD"><enum>(C)</enum><text display-inline="yes-display-inline">No commercial enterprises.</text>
					</subparagraph><subparagraph id="HEB08E4B1F18544A29A3B25D74D477765"><enum>(D)</enum><text display-inline="yes-display-inline">No permanent structures, except structures
			 associated with avalanche control that serve to mitigate avalanche hazards to
			 the Town of Alta, Utah, and Little Cottonwood Canyon Road.</text>
					</subparagraph></paragraph><paragraph id="HC68DEBBFCE90417AA86D66D41B152877"><enum>(3)</enum><header>Occupancy and
			 use of easement area</header><text>The conservation easement shall grant the
			 easement holder sole authority to regulate the occupancy and use of the
			 easement area including—</text>
					<subparagraph id="HEED0F35B50E34D7AB7B9D4602260552E"><enum>(A)</enum><text>the prohibition or
			 restriction of motorized vehicles and equipment; and</text>
					</subparagraph><subparagraph id="HDE88A881201D42EBADE0D9917932E518"><enum>(B)</enum><text>the conduct of
			 avalanche control activities.</text>
					</subparagraph></paragraph><paragraph id="H5A27B1BC210848ADA536694BC6042604"><enum>(4)</enum><header>Restoration and
			 remediation</header><text display-inline="yes-display-inline">The conservation
			 easement shall reserve, in the fee owner of the land encumbered by the
			 easement, the right to conduct restoration and remediation of hazardous
			 substances from past mining and related construction activities on the
			 land.</text>
				</paragraph><paragraph id="HF089163708E24B88BFC4A243257E963A"><enum>(5)</enum><header>Effect of
			 failure to convey easement</header><text display-inline="yes-display-inline">If
			 an entity described in paragraph (1) is unwilling to accept conveyance of the
			 conservation easement subject to the terms provided in this subsection, the
			 Secretary is relieved of any obligation to consummate the land exchange under
			 this section.</text>
				</paragraph></subsection><subsection id="H4A6C0EDB9DDE4B4FA12AC31E807A9E0C"><enum>(h)</enum><header>Management of
			 land acquired by the Secretary</header>
				<paragraph id="HBA6705C25A1A48C295BBF2D184658B32"><enum>(1)</enum><header>White pine
			 parcel</header><text display-inline="yes-display-inline">On acquisition by the
			 Secretary, the parcel identified as <term>White Pine parcel</term> on the map
			 shall be—</text>
					<subparagraph id="H9F0F073E8B584059A959ED9C9BC21380"><enum>(A)</enum><text>incorporated into
			 the Lone Peak Wilderness established by section 2(i) of Public Law 95–237 (92
			 Stat. 42; 16 U.S.C. 1132 note) and expanded by section 2; and</text>
					</subparagraph><subparagraph id="H07E225A892FE4088BD282050FDA0C070"><enum>(B)</enum><text>administered in
			 accordance with the Wilderness Act (16 U.S.C. 1131 et seq.) and this
			 Act.</text>
					</subparagraph></paragraph><paragraph id="H1DD8392BC5804FFA99CC50607DA9FD7A"><enum>(2)</enum><header>Superior
			 parcel</header><text display-inline="yes-display-inline">On acquisition by the
			 Secretary, the parcel identified as <term>Superior parcel</term> on the map
			 shall be—</text>
					<subparagraph id="H148787B99A1342F8A5CEC238F2A9D2B3"><enum>(A)</enum><text display-inline="yes-display-inline">added to the Uinta-Wasatch-Cache National
			 Forests as a special management area; and</text>
					</subparagraph><subparagraph id="HDE001C0FD83C4273A78D8B6DCF7E8393"><enum>(B)</enum><text display-inline="yes-display-inline">administered in accordance with subsection
			 (c) of section 3, except paragraph (3) of such subsection shall not apply to
			 the parcel and the Secretary may allow avalanche control devices within the
			 parcel for the sole purpose of protecting public health and safety.</text>
					</subparagraph></paragraph><paragraph id="H8204BDEAFC38404582F51F22729EF4CA"><enum>(3)</enum><header>High uintas
			 parcel</header><text display-inline="yes-display-inline">On acquisition by the
			 Secretary, the parcel identified as <term>High Uintas parcel</term> on the map
			 shall be—</text>
					<subparagraph id="H0FDFD6270A904B71896D6EA020CFA45F"><enum>(A)</enum><text>incorporated into
			 the High Uintas Wilderness designated by section 102(a)(5) of Public Law 98–428
			 (98 Stat. 1658); and</text>
					</subparagraph><subparagraph id="H10A65FFB702B476E89646ED0FCE52978"><enum>(B)</enum><text>administered in
			 accordance with the Wilderness Act (16 U.S.C. 1131 et seq.).</text>
					</subparagraph></paragraph><paragraph id="H02FF152F3B704C41AF91A8CDD85DEE3C"><enum>(4)</enum><header>Other
			 lands</header><text display-inline="yes-display-inline">On acquisition by the
			 Secretary of any non-Federal land included in the land exchange pursuant to
			 subsection (a)(3)(D), the acquired land shall be added to and administered as
			 part of the Uinta-Wasatch-Cache National Forest, subject to the laws and
			 regulations applicable to the National Forest System.</text>
				</paragraph></subsection><subsection id="H617CC901CB584BF88E0FDC5E3FB8BE9C"><enum>(i)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the land acquired by the Secretary in the land
			 exchange under this section is withdrawn from—</text>
				<paragraph id="H7E683CEC58464B22B2394302AF18A8E2"><enum>(1)</enum><text>all forms of
			 entry, appropriation, or disposal under the public land laws;</text>
				</paragraph><paragraph id="HB1304A8DE406411BAF6337DA76100570"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
				</paragraph><paragraph id="H10D182B610AD4F66B217CB102E15E6DC"><enum>(3)</enum><text>disposition under
			 all laws relating to mineral and energy leasing.</text>
				</paragraph></subsection><subsection id="HBC5F88D5C7104B39884432D856F4DA0E"><enum>(j)</enum><header>Environmental
			 liabilities</header>
				<paragraph id="HCB3C234858804942B3FFF6BDE2F85CE6"><enum>(1)</enum><header>Effect of
			 existence of contamination</header><text display-inline="yes-display-inline">If
			 any of the non-Federal land is determined to be contaminated, including
			 contamination resulting from solid wastes, hazardous wastes or substances,
			 pollutants or contaminants, or other regulated substances, or that the
			 non-Federal land is in a condition that would constitute a violation of any
			 applicable Federal, State, or local laws or regulations related to health,
			 safety, or the environment, and that such contamination or violation existed
			 before the date of the enactment of this Act—</text>
					<subparagraph id="H8500F88B709247F78763FFA11AC66AF8"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary may require that such land,
			 or the contaminated portion of the land, be removed from the exchange before
			 consummation of the land exchange; or</text>
					</subparagraph><subparagraph id="H837AFC6942AE4B6FA154006597F38500"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary may retain such land in the
			 land exchange, subject to the condition that Snowbird agree to indemnify the
			 United States or Salt Lake City, as appropriate, and pay all costs to restore
			 or remediate any damages caused by the past release, spill, or disposal of
			 hazardous substances, pollutants, or contaminants necessary to bring the land
			 into compliance with all applicable health, safety, and environmental laws, and
			 furthermore, for any discharges or draining from any man-made features on the
			 non-Federal lands which the Secretary retains, Snowbird will obtain, and
			 maintain, in perpetuity, any Federal or State permits that may be or become
			 necessary to comply with applicable health, safety, or environmental
			 laws.</text>
					</subparagraph></paragraph><paragraph id="HEC10D92543D24612A83F9CB58E4831AA"><enum>(2)</enum><header>Conservation
			 easement</header><text display-inline="yes-display-inline">Acceptance by Utah
			 Open Lands, or another land trust or the Salt Lake City Department of Public
			 Utilities, of the conservation easement described in subsection (g) shall not
			 make the holder of the conservation easement either an owner or operator with
			 respect to the land encumbered by the easement under the Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9601
			 et seq.), nor shall the conveyance of the easement absolve the fee owner of the
			 land of any liability under such Act, the Federal Water Pollution Control Act
			 (33 U.S.C. 1251 et seq.), or any other Federal, State, or local environmental
			 law or regulation.</text>
				</paragraph><paragraph id="H8821048DB8EB48CFA50D5D491F9897B0"><enum>(3)</enum><header>Hold
			 harmless</header><text display-inline="yes-display-inline">Snowbird shall hold
			 the United States harmless for any liability for the condition of the Federal
			 land received by Snowbird in the land exchange under this section, whether the
			 condition on the Federal land was caused by the negligence of the United
			 States, or the result of any approval by the United States of an authorized
			 activity on the Federal land.</text>
				</paragraph><paragraph id="H6FFAC8CBEFA040609C54B4B6A209C02C"><enum>(4)</enum><header>Exception of
			 federal land from certain covenants</header><text>Clauses (ii) and (iii) of
			 section 120(h)(3)(A) of the Comprehensive Environmental Response, Compensation,
			 and Liability Act of 1980 (42 U.S.C. 6920(h)(3)(A)) shall not apply to the
			 conveyance of the Federal land under this section.</text>
				</paragraph></subsection></section></legis-body>
