			 mortgage insurance premiums</header>
			<subsection id="H31AE847BB6524892820E94F4781B8A86"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (B) of
			 section 203(c)(2) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(c)(2)(B)</external-xref>) is
			 amended—</text>
				<paragraph id="H66F0DE8E5D6245F7B523648FD1793EE7"><enum>(1)</enum><text>in the matter
			 preceding clause (i)—</text>
					<subparagraph commented="no" id="HCF2C35B74459474790CE182D7A3FFD13"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>may</quote> and
			 inserting <quote>shall</quote>;</text>
					</subparagraph><subparagraph id="HEDC065AC8B364F6FAEEE03A56E698DF8"><enum>(B)</enum><text>by striking
			 <quote>not exceeding 1.5 percent</quote> and inserting <quote>not less than
			 0.55 percent</quote>; and</text>
					</subparagraph><subparagraph id="HFF994D228BAD4ACD9CCB8B2F4249B030"><enum>(C)</enum><text>by inserting
			 <quote>and not exceeding 2.0 percent of such remaining insured principal
			 balance</quote> before <quote>for the following periods:</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H1A82C808CB6640DCA442BD2FC1A0EDF9"><enum>(2)</enum><text>in clause (ii), by
			 striking <quote>1.55 percent</quote> and inserting <quote>2.05
			 percent</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H415503F4E1944AF2AF036A7AE8EB52A4"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) take effect upon the expiration of the 6-month period beginning
			 on the date of the enactment of this Act.</text>
			</subsection></section><section id="HB17E1585C9BB461FBC90BFC26EACF3BE"><enum>3.</enum><header>Indemnification
			 by FHA mortgagees</header><text display-inline="no-display-inline">Section 202
			 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708</external-xref>) is amended by
			 adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H054CF0E1BCC14FA6B7B2BF88CBADFF00" style="OLC">
				<subsection id="HA1298C0BE9B049CAA2C547002AB37295"><enum>(i)</enum><header>Indemnification
				by mortgagees</header>
					<paragraph id="HD9AD14DF2B3647BBB5231382A560715D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">If the Secretary
				determines that the mortgagee knew, or should have known, of a serious or
				material violation of the requirements established by the Secretary with
				respect to a mortgage executed by a mortgagee approved by the Secretary under
				the direct endorsement program or insured by a mortgagee pursuant to the
				delegation of authority under section 256 such that the mortgage loan should
				not have been approved and endorsed for insurance, and the Secretary pays an
				insurance claim with respect to the mortgage within a reasonable period
				specified by the Secretary, the Secretary may require the mortgagee approved by
				the Secretary under the direct endorsement program or the mortgagee delegated
				authority under section 256 to indemnify the Secretary for the loss,
				irrespective of whether the violation caused the mortgage default.</text>
					</paragraph><paragraph id="H0A4FF48DAC14443EA7434DB7CCBF53C8"><enum>(2)</enum><header>Fraud or
				misrepresentation</header><text display-inline="yes-display-inline">If fraud or
				misrepresentation was involved in connection with the origination or
				underwriting and the Secretary determines that the mortgagee knew or should
				have known of the fraud or misrepresentation, the Secretary shall require the
				mortgagee approved by the Secretary under the direct endorsement program or the
				mortgagee delegated authority under section 256 to indemnify the Secretary for
				the loss regardless of when an insurance claim is paid.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="H5BDA815FD0254EA28D73A98B116FDC7E"><enum>(3)</enum><header>Appeals
				process</header><text display-inline="yes-display-inline">The Secretary shall,
				by regulation, establish an appeals process for mortgagees to appeal
				indemnification determinations made pursuant to paragraph (1) or (2).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBA0DF0BFD8B944A1AFA1A94AB1C01D8A"><enum>(4)</enum><header display-inline="yes-display-inline">Requirements and procedures</header><text display-inline="yes-display-inline">The Secretary shall issue regulations
				establishing appropriate requirements and procedures governing the
				indemnification of the Secretary by the mortgagee, including public reporting
				on—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HB7B4EE50DC2544D588960342617F520A"><enum>(A)</enum><text display-inline="yes-display-inline">the number of loans that—</text>
							<clause commented="no" display-inline="no-display-inline" id="HA1AB7E9354BE4BF9822A63D4168393C0"><enum>(i)</enum><text display-inline="yes-display-inline">were not originated or underwritten in
				accordance with the requirements established by the Secretary; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H30998F06D43C40DF893BE1F589DF3F1C"><enum>(ii)</enum><text display-inline="yes-display-inline">involved fraud or misrepresentation in
				connection with the origination or underwriting; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA47E1BC5519B485586D87EF0585C7475"><enum>(B)</enum><text display-inline="yes-display-inline">the financial impact on the Mutual Mortgage
				Insurance Fund when indemnification is
				required.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="HD80DF9166DCA4CEFB1AB3C23FDFBD75F"><enum>4.</enum><header display-inline="yes-display-inline">Early period delinquencies</header><text display-inline="no-display-inline">Subsection (a) of section 202 of the
			 National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(a)</external-xref>) is amended by
			 adding at the end the following new paragraphs:</text>
			<quoted-block display-inline="no-display-inline" id="HC0B4516FC682493A91637AFFB68FF573" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="H82F97AF50CEA4C0993BCDFE915F6A0AD"><enum>(8)</enum><header display-inline="yes-display-inline">Programmatic review of early period
				delinquencies</header><text display-inline="yes-display-inline">The Secretary
				shall establish and maintain a program—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H80327574BDFB4A7FBAE2B2621D78EE46"><enum>(A)</enum><text display-inline="yes-display-inline">to review the cause of each early period
				delinquency on a mortgage that is an obligation of the Mutual Mortgage
				Insurance Fund;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4ECEEEA5B948432780836BBCB1CC6019"><enum>(B)</enum><text display-inline="yes-display-inline">to require indemnification of the Secretary
				for a loss associated with any such early period delinquency that is the result
				of a material violation, as determined by the Secretary, of any provision,
				regulation, or other guideline established or promulgated pursuant to this
				title; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD498BAA1151B496EAC92E857327EE6B3"><enum>(C)</enum><text display-inline="yes-display-inline">to publicly report—</text>
						<clause commented="no" display-inline="no-display-inline" id="HFEA23234E2574C22903D1F5E752FE50C"><enum>(i)</enum><text display-inline="yes-display-inline">a summary of the results of all early
				period delinquencies reviewed under subparagraph (A);</text>
						</clause><clause id="H4C947551740B40C18B7B8BCDA56DFB08"><enum>(ii)</enum><text>any
				indemnifications required under subparagraph (B); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HB4442547CCB9427387EFC686C520F19B"><enum>(iii)</enum><text display-inline="yes-display-inline">the financial impact on the Mutual Mortgage
				Insurance Fund of any such indemnifications.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H725575516CE14E4299FF934C33D1AD3E"><enum>(9)</enum><header display-inline="yes-display-inline">Definition of early period
				delinquency</header><text display-inline="yes-display-inline">For purposes of
				this section, the term <term>early period delinquency</term> means, with
				respect to a mortgage, that the mortgage becomes 90 or more days delinquent
				within 24 months of the origination of such
				mortgage.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7EE99F502D71430E850A08E673788971"><enum>5.</enum><header>Semiannual
			 actuarial studies of MMIF during periods of capital depletion</header>
			<subsection id="HFE68512AD13741B9A8884590C0EC5AF8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (4) of
			 section 202(a) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(a)(4)</external-xref>) is
			 amended—</text>
				<paragraph id="H39144276E95D43A2BB77C5DC55B3B70E"><enum>(1)</enum><text>in the first
			 sentence, by inserting <quote>except as provided in subparagraph (B),</quote>
			 after <quote>to be conducted annually,</quote>;</text>
				</paragraph><paragraph id="HB8FBB90C4890442394C29365754A7C09"><enum>(2)</enum><text display-inline="yes-display-inline">in the second sentence, by inserting
			 <quote>, except as provided in subparagraph (B),</quote> after
			 <quote>annually</quote>;</text>
				</paragraph><paragraph id="H78190159B8A84EA4BFEB054BB3D1BC35"><enum>(3)</enum><text>by striking the
			 paragraph designation and heading and all that follows through <quote>The
			 Secretary shall provide</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H03CAC7A7CAB54FB1A4E6DD821B52AC13" style="OLC">
						<paragraph id="H2E60CEAD092644D2981D5D6B6088F1A6"><enum>(4)</enum><header>Independent
				actuarial study</header>
							<subparagraph id="HA617ED2D781949BB8BA0DD232AAFED21"><enum>(A)</enum><header>Annual
				study</header><text display-inline="yes-display-inline">The Secretary shall
				provide</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC1E095C107A14D9E9F5269F000909FDB"><enum>(4)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H009EA7092FED47389B4CB98A54ED4F39" style="OLC">
						<subparagraph id="HE149F947A47B4B4990C3761E5E32331B"><enum>(B)</enum><header>Semiannual
				studies during periods of capital depletion</header><text display-inline="yes-display-inline">During any period that the Fund fails to
				maintain sufficient capital to comply with the capital ratio requirement under
				section 205(f)(2)—</text>
							<clause id="H6E2EAF125BA940EABA9618DA4D78201C"><enum>(i)</enum><text display-inline="yes-display-inline">the independent study required by
				subparagraph (A) shall be conducted semiannually and shall analyze the
				financial position of the Fund as of September 30 and March 31 of each fiscal
				year during such period; and</text>
							</clause><clause id="HF16A2D1441FE41589F5CF2C14262F0A9"><enum>(ii)</enum><text>the Secretary
				shall submit a report meeting the requirements of subparagraph (A) for each
				such semiannual
				study.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HAB84F9C922E140E0B30C0D3D01B5EC70"><enum>(b)</enum><header>Analysis of
			 quarterly actuarial studies</header><text>The Secretary of Housing and Urban
			 Development shall conduct an analysis of the cost and feasibility of providing
			 for an independent actuarial study of the Mutual Mortgage Insurance Fund on a
			 calendar quarterly basis, which shall compare the cost and feasibility of
			 conducting such a study on a quarterly basis as compared to a semi-annual basis
			 and shall determine whether such an actuarial study can be conducted on a
			 quarterly basis without substantial additional costs to the taxpayers. Not
			 later than the expiration of the 90-day period beginning on the date of the
			 enactment of this Act, the Secretary shall submit a report to the Congress
			 setting forth the findings and conclusion of the analysis conducted pursuant to
			 this subsection.</text>
			</subsection></section><section id="H477EED37184D411EBC3674A84C62E768"><enum>6.</enum><header>Delegation of FHA
			 insuring authority</header><text display-inline="no-display-inline">Section 256
			 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-21">12 U.S.C. 1715z–21</external-xref>) is
			 amended—</text>
			<paragraph id="H16ED28426C8942AF92B4C7370745241B"><enum>(1)</enum><text>by striking
			 subsection (c);</text>
			</paragraph><paragraph id="HA12853AF346C44D6997AF4A13254242E"><enum>(2)</enum><text>in subsection (e),
			 by striking <quote>, including</quote> and all that follows through <quote>by
			 the mortgagee</quote>; and</text>
			</paragraph><paragraph id="H4E8F4ADD2FDD42989C8971F80BD21A79"><enum>(3)</enum><text>by redesignating
			 subsections (d) and (e) as subsections (c) and (d), respectively.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H0D2FE7C6086748C7997131473FD8F9CD" section-type="subsequent-section"><enum>7.</enum><header>Authority to terminate
			 FHA mortgagee origination and underwriting approval</header><text display-inline="no-display-inline">Section 533 of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1735f-11">12 U.S.C.
			 1735f–11</external-xref>) is amended—</text>
			<paragraph id="H1C742BF18A0B4CF78128A020364A9617"><enum>(1)</enum><text>in the first
			 sentence of subsection (b), by inserting <quote>or areas or on a nationwide
			 basis</quote> after <quote>area</quote> each place such term appears;
			 and</text>
			</paragraph><paragraph id="H6683D1E5BAC04D599261CE33656E83ED"><enum>(2)</enum><text>in subsection (c),
			 by striking <quote>(c)</quote> and all that follows through <quote>The
			 Secretary </quote> in the first sentence of paragraph (2) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H2FCB561CE00048B69A70ECA74EDEE8BE" style="OLC">
					<subsection id="H03D6A10274B746BA8C0F5902C7B0CF40"><enum>(c)</enum><header>Termination of
				mortgagee origination and underwriting approval</header>
						<paragraph id="HD33C74F8A35D4D5BAFF5B5D692C78DC3"><enum>(1)</enum><header>Termination
				authority</header><text display-inline="yes-display-inline">If the Secretary
				determines, under the comparison provided in subsection (b), that a mortgagee
				has a rate of early defaults and claims that is excessive, the Secretary may
				terminate the approval of the mortgagee to originate or underwrite single
				family mortgages for any area, or areas, or on a nationwide basis,
				notwithstanding section 202(c) of this Act.</text>
						</paragraph><paragraph id="H04171C218DED42E58EB7C2827F8E0A12"><enum>(2)</enum><header>Procedure</header><text>The
				Secretary</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="H3AF8F3636E464794BC19ACCA1938EFCE"><enum>8.</enum><header>Authorization to
			 participate in the origination of FHA-insured loans</header>
			<subsection id="H3A82DC61CE7D4D19A97F613DDE4D482C"><enum>(a)</enum><header>Single family
			 mortgages</header><text>Section 203(b) of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C.
			 1709(b)</external-xref>) is amended by striking paragraph (1) and inserting the
			 following new paragraph:</text>
				<quoted-block id="HC454A1F57D2441BD81F8B7AAED2A9DD0" style="OLC">
					<paragraph id="HC005AA4AA76E4627BDDFE4200E89BE9D"><enum>(1)</enum><text>Have been made to
				a mortgagee approved by the Secretary or to a person or entity authorized by
				the Secretary under section 202(d)(1) to participate in the origination of the
				mortgage, and be held by a mortgagee approved by the Secretary as responsible
				and able to service the mortgage
				properly.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6ADD369837A84185B7DCAA273D35A17E"><enum>(b)</enum><header>Home equity
			 conversion mortgages</header><text>Section 255(d) of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C.
			 1715z–20(d)</external-xref>) is amended by striking paragraph (1) and inserting
			 the following new paragraph:</text>
				<quoted-block id="HC2149A5378AB414E9F0916A695495F83" style="OLC">
					<paragraph id="H27E136FAD7C945E99C50C288DB2B3283"><enum>(1)</enum><text>have been
				originated by a mortgagee approved by, or by a person or entity authorized
				under section 202(d)(1) to participate in the origination by, the
				Secretary;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H90021F29F5364E8CB04229997E89FB0D"><enum>9.</enum><header>Reporting of
			 mortgagee actions taken against other mortgagees</header><text display-inline="no-display-inline">Section 202 of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C.
			 1708</external-xref>), as amended by the preceding provisions of this Act, is
			 further amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H1321528E96D845AB8671AD56D6843D68" style="OLC">
				<subsection id="H0EC4B1389A6E4640BB61A39C5F6B6FCF"><enum>(j)</enum><header>Notification of
				mortgagee actions</header><text display-inline="yes-display-inline">The
				Secretary shall require each mortgagee, as a condition for approval by the
				Secretary to originate or underwrite mortgages on single family or multifamily
				housing that are insured by the Secretary, if such mortgagee engages in the
				purchase of mortgages insured by the Secretary and originated by other
				mortgagees or in the purchase of the servicing rights to such mortgages, and
				such mortgagee at any time takes action to terminate or discontinue such
				purchases from another mortgagee based on any determination or evidence of
				fraud or material misrepresentation in connection with the origination of such
				mortgages, to notify the Secretary of the action taken and the reasons for such
				action not later than 15 days after taking such
				action.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD53AF78106E04262B7DDFCCDEAF7A5BA"><enum>10.</enum><header>Default and
			 origination information by loan servicer and originating direct endorsement
			 lender</header>
			<subsection id="H66A61E5B6D24452391FBC63CF8F04CD7"><enum>(a)</enum><header>Collection of
			 information</header><text display-inline="yes-display-inline">Paragraph (2) of
			 section 540(b) of the National Housing Act (12 U.S.C.
			 <external-xref legal-doc="usc" parsable-cite="usc/1712/1735f-18">1712 U.S.C.
			 1735f–18(b)(2)</external-xref>) is amended by adding at the end the following
			 new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H2B0B521AE6B741648576B3843D4D9C81" style="OLC">
					<subparagraph id="HE6FFE487C2D54F65A6996842D73B35DE"><enum>(C)</enum><text display-inline="yes-display-inline">For each entity that services insured
				mortgages, data on the number of claims paid to each servicing mortgagee during
				each calendar quarter occurring during the applicable collection
				period.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1A5C0AC05A064F929740FB4885B93722"><enum>(b)</enum><header>Applicability</header><text>Information
			 described in subparagraph (C) of section 540(b)(2) of the National Housing Act,
			 as added by subsection (a) of this section, shall first be made available under
			 such section 540 for the applicable collection period (as such term is defined
			 in such section) relating to the first calendar quarter ending after the
			 expiration of the 12-month period that begins on the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="H29718EE79157411C8DA5B1776F83DB08" section-type="subsequent-section"><enum>11.</enum><header>Deputy Assistant
			 Secretary of FHA for Risk Management and Regulatory Affairs</header>
			<subsection commented="no" id="HB934583169444DB390405A06E286DAB4"><enum>(a)</enum><header>Establishment of
			 position</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 4 of the Department of Housing and Urban Development Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/3533">42 U.S.C.
			 3533(b)</external-xref>) is amended—</text>
				<paragraph commented="no" id="HDFB1F3DA7EBA45B0BC480A13D488F22B"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(b)</quote>; and</text>
				</paragraph><paragraph commented="no" id="H5A98175FC0EC4E46975E3C4D1B56DB83"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB3C5999AE29748B3B26268A7847EA9DE" style="OLC">
						<paragraph commented="no" id="HC90179A8C34545F98090C22FFF81907B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">There shall be in the Department, within
				the Federal Housing Administration, a Deputy Assistant Secretary for Risk
				Management and Regulatory Affairs, who shall be appointed by the Secretary and
				shall be responsible to the Federal Housing Commissioner for all matters
				relating to managing and mitigating risk to the mortgage insurance funds of the
				Department and ensuring the performance of mortgages insured by the
				Department.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H29F4F0E4D4B148C89881EB4C37CCD205"><enum>(b)</enum><header>Termination</header><text display-inline="yes-display-inline">Upon the appointment of the initial Deputy
			 Assistant Secretary for Risk Management and Regulatory Affairs pursuant to
			 section 4(b)(2) of the Department of Housing and Urban Development Act, as
			 amended by subsection (a) of this section, the position of chief risk officer
			 within the Federal Housing Administration, filled by appointment by the Federal
			 Housing Commissioner, is abolished.</text>
			</subsection></section><section id="H1797190E22614648B912997F94A7ED07" section-type="subsequent-section"><enum>12.</enum><header>Establishment of
			 Chief Risk Officer for GNMA</header><text display-inline="no-display-inline">Section 4 of the Department of Housing and
			 Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3533">42 U.S.C. 3533</external-xref>) is amended by
			 adding after subsection (g), as added by section 1442 of the Dodd-Frank Wall
			 Street Reform and Consumer Protection Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/203">Public Law
			 111–203</external-xref>; 124 Stat. 2163), the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HD08E39492F03460E896F3C89FD7387F8" style="OLC">
				<subsection id="H24929455E4F84A67BF1242E1232875FD"><enum>(h)</enum><text display-inline="yes-display-inline">There shall be in the Department a Chief
				Risk Officer for the Government National Mortgage Association, who
				shall—</text>
					<paragraph id="H5E5F066D62F84A718CD52662226AC73C"><enum>(1)</enum><text>be designated by
				the Secretary;</text>
					</paragraph><paragraph id="HC072658E25884F2CBF45F54F2A1B5DA8"><enum>(2)</enum><text display-inline="yes-display-inline">be responsible to the President of the
				Association for all matters related to evaluating, managing, and mitigating
				risk to the programs of the Association;</text>
					</paragraph><paragraph commented="no" id="H1926EF2942384222BAE553A8F765DB40"><enum>(3)</enum><text>be in the
				competitive service or the senior executive service;</text>
					</paragraph><paragraph commented="no" id="H6D5C20EE95874D6EABAB3FE466D64CB1"><enum>(4)</enum><text>be a career
				appointee;</text>
					</paragraph><paragraph commented="no" id="H3B21C01B1B7345CC8972E039FB5BAF03"><enum>(5)</enum><text>be designated from
				among individuals who possess demonstrated ability in general management of,
				and knowledge of and extensive practical experience in risk evaluation
				practices in large governmental or business entities; and</text>
					</paragraph><paragraph commented="no" id="HFB87B1F9AAFF4055A7BF4796C15E357A"><enum>(6)</enum><text>shall not be
				required to obtain the prior approval, comment, or review of any officer or
				agency of the United States before submitting to the Congress, or any committee
				or subcommittee thereof, any reports, recommendations, testimony, or comments
				if such submission include a statement indicating that the views expressed
				therein are those of the Chief Risk Officer of the Association and do not
				necessarily represent the views of the
				Secretary.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H65480FDDB4354C0FA4B1CE49453C2F5D"><enum>13.</enum><header>Report on
			 mortgage servicers</header>
			<subsection id="H5BBEC4C9DEF74731BD58DEFD33D0D146"><enum>(a)</enum><header>Examination</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban
			 Development shall conduct an examination into mortgage servicer compliance with
			 the loan servicing, loss mitigation, and insurance claim submission guidelines
			 of the FHA mortgage insurance programs under the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701">12 U.S.C. 1701 et
			 seq.</external-xref>), and an estimate of the annual costs to the Mutual
			 Mortgage Insurance Fund, since 2008, resulting from any failures by mortgage
			 servicers to comply with such guidelines.</text>
			</subsection><subsection id="H65766257BDF74649A7B651C572F03C17"><enum>(b)</enum><header>Report</header><text>Not
			 later than the expiration of the 120-day period that begins upon the date of
			 the enactment of this Act, the Secretary shall submit a report to the Congress
			 on the results of the examination conducted pursuant to subsection (a),
			 including recommendations for any administrative and legislative actions to
			 improve mortgage servicer compliance with the guidelines referred to in
			 subsection (a).</text>
			</subsection></section><section id="H123379FF9BC64B14A0C54C2D2D45A59D"><enum>14.</enum><header>FHA emergency
			 capital plan</header>
			<subsection id="H787F2A02434E4B3381494CCD0AD92F3D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than the expiration of the 30-day
			 period beginning on the date of the enactment of this Act, the Secretary of
			 Housing and Urban Development shall develop, submit to the Congress, and
			 commence implementation of an emergency capital plan for the restoration of the
			 fiscal solvency of the Mutual Mortgage Insurance Fund (in this section referred
			 to as the <term>Fund</term>).</text>
			</subsection><subsection id="H95CA0CFF869E47909671402C1655D02E"><enum>(b)</enum><header>Contents</header><text>The
			 emergency capital plan developed pursuant to this section shall—</text>
				<paragraph id="HDB4ED043951C4087B9B62C2A6C2E75E3"><enum>(1)</enum><text>provide a detailed
			 explanation of the processes and controls by which amounts of capital that are
			 assets of the Fund are monitored and tracked;</text>
				</paragraph><paragraph id="HE663B8CC42904A259B26C3365AB01843"><enum>(2)</enum><text>establish a plan
			 to ensure the financial safety and soundness of the Fund that avoids the need
			 for borrowing amounts from the Treasury of the United States to meet
			 obligations of the Fund; and</text>
				</paragraph><paragraph id="H96B2A6CB766049698E6E9CB0E40FDD58"><enum>(3)</enum><text display-inline="yes-display-inline">describe the procedure by which, if
			 necessary, any amounts from the Treasury needed to meet obligations of the Fund
			 will be obtained from the Treasury.</text>
				</paragraph></subsection><subsection id="H1DFBDA46D9B74FD0B6591A86B5ECD346"><enum>(c)</enum><header>Monthly
			 reports</header>
				<paragraph id="HD69CA8BB79A94B9DA8DCB2D532FDAE63"><enum>(1)</enum><header>Reports</header><text display-inline="yes-display-inline">Subject to paragraph (3), upon the
			 conclusion of each calendar month ending after the 14-day period that begins on
			 the date of the enactment of this Act, the Secretary of Housing and Urban
			 Development shall submit to the Congress a report assessing the financial
			 status of the Fund at the conclusion of such month and setting forth the
			 information described in paragraph (2).</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HBDEB98ED4DCE4BB590638492B6DCA10A"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report required under paragraph (1)
			 for a month shall contain the following information regarding the Fund as of
			 the conclusion of such month:</text>
					<subparagraph id="H81C56E71D8B048658E8FE402B3EC1B3E"><enum>(A)</enum><text display-inline="yes-display-inline">The number of mortgages that are
			 obligations of the Fund that are 60 or more days delinquent, the expected
			 losses to the Fund associated with such delinquent mortgages, and the
			 methodology used to make such calculation.</text>
					</subparagraph><subparagraph id="H0F5715745FE641ED9A9A810255330F6E"><enum>(B)</enum><text display-inline="yes-display-inline">The number of mortgages that are
			 obligations of the Fund that have a loan-to-value ratio at the time of
			 origination that is less than 80 percent and the percentage of all mortgages
			 that are obligations of the Fund having such a ratio.</text>
					</subparagraph><subparagraph id="HD3674A9C640246008F21D8E85A20F7B9"><enum>(C)</enum><text display-inline="yes-display-inline">The number of mortgages that are
			 obligations of the Fund that had an original principal obligation exceeding 125
			 percent of the median house price, for a home of the size of the residence
			 subject to the mortgage, for the area in which such residence is located, and
			 the percentage of all mortgages that are obligations of the Fund having such an
			 original principal obligation.</text>
					</subparagraph><subparagraph id="H993754D620F246729C019AC59896EA95"><enum>(D)</enum><text display-inline="yes-display-inline">The number of mortgages that are
			 obligations of the Fund for which the mortgagor’s income at the time of
			 origination of the mortgage is greater than the median income for the area in
			 which the residence subject to the mortgage is located, and the percentage of
			 all mortgages that are obligations of the Fund for which the mortgagor has such
			 an income.</text>
					</subparagraph><subparagraph id="H8F8AA6B4696B4ECEBA02B5D32DD86BED"><enum>(E)</enum><text>The balances for
			 the financing and capital reserve accounts of the Fund.</text>
					</subparagraph><subparagraph id="H70AC8C72329F45BEA309269151E51BB5"><enum>(F)</enum><text>Any actions taken
			 during such month to help ensure the financial soundness of the Fund and
			 compliance with section 205(f) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1711">12 U.S.C. 1711(f)</external-xref>;
			 relating to a capital ratio requirement).</text>
					</subparagraph></paragraph><paragraph id="H3C7919E276744D5E9249BEA032459C61"><enum>(3)</enum><header>Termination of
			 reporting requirement</header><text>The requirement to submit reports under
			 paragraph (1) shall terminate on the first date after the date of the enactment
			 of this Act that the Fund attains a capital ratio (as such term is defined in
			 section 205(f)(3) of the National Housing Act) of 2.0 percent.</text>
				</paragraph></subsection></section><section id="HAAEB6C5E84C44DD08557BB79DBE0C814"><enum>15.</enum><header>FHA safety and
			 soundness review</header>
			<subsection id="H6B0739BA2BFA4DFC8EC3EEF93B0E854E"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall provide for an independent third party to—</text>
				<paragraph id="H89BC37E8012A4BEBBEC932A2E9279549"><enum>(1)</enum><text>conduct a one-time
			 review of the mortgage insurance programs and funds of the Secretary of Housing
			 and Urban Development that shall determine, as of the time of such
			 review—</text>
					<subparagraph id="HADD4293909C747E5ACD77745EE096430"><enum>(A)</enum><text>the financial
			 safety and soundness of such programs and funds; and</text>
					</subparagraph><subparagraph id="HCCC4FF81A3AE4B0B914C2F70DD18170D"><enum>(B)</enum><text>the extent of loan
			 loss reserves and capital adequacy of such programs and funds; and</text>
					</subparagraph></paragraph><paragraph id="H643950A79EEB4A638E58D957C0D5032B"><enum>(2)</enum><text>to submit a report
			 under subsection (b).</text>
				</paragraph><continuation-text continuation-text-level="subsection">Such review
			 shall be conducted in accordance with generally accepted accounting principles
			 applicable to the private sector and Federal entities.</continuation-text></subsection><subsection id="H9540D3979E254254B16E2EC86E302940"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The report under this subsection shall
			 describe the methodology and standards used to conduct the review under
			 subsection (a)(1), set forth the results and findings of the review, including
			 the extent of loan loss reserves and capital adequacy of the mortgage insurance
			 programs and funds of the Secretary of Housing and Urban Development, and
			 include recommendations regarding restoring such reserves and capital to
			 maintain such programs and funds in a safe and sound condition.</text>
			</subsection><subsection id="H93EE8263F9A544F89F548921D5335945"><enum>(c)</enum><header>Timing</header><text display-inline="yes-display-inline">The review required under subsection (a)
			 shall be completed, and the report required under subsection (b) shall be
			 submitted, not later than the expiration of the 60-day period beginning on the
			 date of the enactment of this Act.</text>
			</subsection><subsection id="H992AED7B62F34BF985EBAE330CE725B6"><enum>(d)</enum><header>Rule of
			 construction</header><text>Nothing in this section may be construed to alter or
			 affect, or exempt the Secretary of Housing and Urban Development from complying
			 with, any laws, regulations, or guidance relating to preparation or submission
			 of budgets or audits or financial or management statements or reports.</text>
			</subsection></section><section id="H9AFE614EABA14F45B4E1186484BA7974"><enum>16.</enum><header>FHA disclosure
			 standards</header><text display-inline="no-display-inline">Not later than the
			 expiration of the 90-day period beginning on the date of the enactment of this
			 Act, the Secretary of Housing and Urban Development shall review and revise all
			 standards and requirements relating to disclosure of information regarding the
			 mortgage insurance programs and funds, including actuarial studies conducted
			 under section 202(a)(4) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C.
			 1708(a)(4)</external-xref>), quarterly reports under section 202(a)(5) of such
			 Act, and annual audited financial statements under section 538 of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1735f-16">12 U.S.C.
			 1735f–16</external-xref>), to ensure that, after the date of the enactment of
			 this Act, such disclosures—</text>
			<paragraph id="H6235B6A453634C3A836FBB51BC884DC4"><enum>(1)</enum><text display-inline="yes-display-inline">provide meaningful financial and other
			 information that is timely, comprehensive, and accurate;</text>
			</paragraph><paragraph id="HEB9C29B41BA148059C6F9D40B72563DB"><enum>(2)</enum><text>do not contain any
			 material misstatements or misrepresentations;</text>
			</paragraph><paragraph id="HBBA5E3B5C85D40B68279A5EFDB07BB66"><enum>(3)</enum><text>make available all
			 relevant information; and</text>
			</paragraph><paragraph id="HC0976919A8D2467BBDB60693299E6AC8"><enum>(4)</enum><text>prohibit material
			 omissions that make the contents of the disclosure misleading.</text>
			</paragraph></section><section id="HDAF5BC0DA1034994B30120BAAF769C98"><enum>17.</enum><header>Report on
			 streamlining FHA programs</header>
			<subsection id="H4136B05C91B3434D8D58D3088EB399BA"><enum>(a)</enum><header>Examination</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban
			 Development shall conduct an examination of the mortgage insurance and any
			 other programs of the Federal Housing Administration to identify—</text>
				<paragraph id="HDFE8DBECCABA4495831A816D533F95A5"><enum>(1)</enum><text>the level of use
			 and need for such programs;</text>
				</paragraph><paragraph id="H6DD6CD24347045B4B852EFCB90D13A58"><enum>(2)</enum><text>any such programs
			 that are unused or underused; and</text>
				</paragraph><paragraph id="HDCCDED849CB143019CF3E823951DFE60"><enum>(3)</enum><text>methods for
			 streamlining, consolidating, simplifying, increasing the efficiency of, and
			 reducing the number of such programs.</text>
				</paragraph></subsection><subsection id="H3CA6A5DA7F2440658385B25ED2DF4BAF"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than the expiration of the
			 12-month period that begins upon the date of the enactment of this Act, the
			 Secretary shall submit a report to the Congress on the results of the
			 examination conducted pursuant to subsection (a), including recommendations for
			 any administrative and legislative actions to streamline, consolidate,
			 simplify, increase the efficiency of, and reduce the number of such
			 programs.</text>
			</subsection></section><section id="HDFFD0EDD718C44C7B89FE94EEF2B27C6"><enum>18.</enum><header>Budget
			 compliance</header><text display-inline="no-display-inline">The Secretary of
			 Housing and Urban Development shall allocate $2,500,000 from the account for
			 Administrative Contract Expenses each fiscal year through<linebreak></linebreak> September
			 30, 2017, which amounts shall be available only for the purposes of this Act
			 and the amendments made by this Act, including such additional actuarial
			 reviews as may be required by section 5 of this Act and the amendments made by
			 such section.</text>
