			<paragraph id="H310CDD599A204B54A58072207496C4F5"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text display-inline="yes-display-inline">The
			 term <term>appropriate congressional committees</term> has the meaning given
			 such term in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>).</text>
			</paragraph><paragraph id="H587FADC2988749A0BC4E15AF7880590C"><enum>(2)</enum><header>Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the
			 Department of Homeland Security.</text>
			</paragraph><paragraph commented="no" id="H62F0B2D18BE84AAE8C2E4333017BAA90"><enum>(3)</enum><header>Function</header><text>The
			 term <term>function</term> includes authorities, powers, rights, privileges,
			 immunities, programs, projects, activities, duties, and
			 responsibilities.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B9485FE27A94CC9BADDDF899E8FE86A"><enum>(4)</enum><header>Local
			 government</header><text>The term <term>local government</term> means—</text>
				<subparagraph commented="no" id="H6B3EC96B8EA24D2F837E9817EB340770"><enum>(A)</enum><text>a county,
			 municipality, city, town, township, local public authority, school district,
			 special district, intrastate district, council of governments (regardless of
			 whether the council of governments is incorporated as a nonprofit corporation
			 under State law), regional or interstate government entity, or agency or
			 instrumentality of a local government;</text>
				</subparagraph><subparagraph commented="no" id="HEF7C50841F004A589CBAC7A45F219E8E"><enum>(B)</enum><text>an Indian tribe or
			 authorized tribal organization, or in Alaska a Native village or Alaska
			 Regional Native Corporation; and</text>
				</subparagraph><subparagraph commented="no" id="H35C5D2A1005D44B39D5E559E7E82B795"><enum>(C)</enum><text>a rural community,
			 unincorporated town or village, or other public entity.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H30B5D9023E624E0C825C9FDB66D4E645"><enum>(5)</enum><header>Personnel</header><text>The
			 term <term>personnel</term> means officers and employees.</text>
			</paragraph><paragraph id="H1A00CECFC18A440EADB81B2BB1A35EE7"><enum>(6)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Homeland Security.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H084F6CEA8AB447B8B8AAF8BBD011529E"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means any State of the United States, the District of
			 Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands,
			 Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any
			 possession of the United States.</text>
			</paragraph><paragraph commented="no" id="HC86EA97099DE4A4C971A73D774F65B35"><enum>(8)</enum><header>Terrorism</header><text>The
			 term <term>terrorism</term> has the meaning given such term in section 2 of the
			 Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41CF2294D209452D96C2933ADAC9585C"><enum>(9)</enum><header>United
			 States</header><text display-inline="yes-display-inline">The term <term>United
			 States</term>, when used in a geographic sense, means any State of the United
			 States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin
			 Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana
			 Islands, any possession of the United States, and any waters within the
			 jurisdiction of the United States.</text>
			</paragraph></section><title id="H2F45D6842D7046F6B8D892DD61506656"><enum>I</enum><header>Department of
			 Homeland Security port security programs</header>
			<section id="HA414220F382D4F3BB064F4663CBFD2BD"><enum>101.</enum><header>Updates of
			 maritime operations coordination plan</header>
				<subsection id="H5E96F87FBA1B411CB89CAFCF41483807"><enum>(a)</enum><header>In
			 general</header><text>Not later than July 1, 2014, the Secretary shall submit
			 to the appropriate congressional committees a maritime operations coordination
			 plan for the coordination and cooperation of maritime operations undertaken by
			 the agencies within the Department. Such plan shall update the maritime
			 operations coordination plan released by the Department in July 2011, and shall
			 address the following:</text>
					<paragraph id="H70B615060707463D846D65387A96CAB8"><enum>(1)</enum><text>Coordination of
			 planning, integration of maritime operations, and development of joint
			 situational awareness of any office or agency of the Department with
			 responsibility for maritime homeland security missions.</text>
					</paragraph><paragraph id="H0DD774F41EC44D279359BD627555B9AC"><enum>(2)</enum><text>Maintaining
			 effective information sharing and, as appropriate, intelligence integration,
			 with Federal, State, and local officials and the private sector, regarding
			 threats to maritime security.</text>
					</paragraph><paragraph id="HB6925A2780FE40B98A4FAFFD96614179"><enum>(3)</enum><text display-inline="yes-display-inline">Leveraging existing departmental
			 coordination mechanisms, including the Interagency Operational Centers, as
			 authorized under <external-xref legal-doc="usc" parsable-cite="usc/46/70107A">section 70107A</external-xref> of title 46,
			 United States Code, the U.S. Customs and Border Protection Air and Marine
			 Operations Center, the U.S. Customs and Border Protection Operational
			 Integration Center, and other regional maritime operational command
			 centers.</text>
					</paragraph><paragraph id="H0D9183B3669448F9AA9EC3E8BBE3DBC2"><enum>(4)</enum><text>Cooperation and
			 coordination with other agencies of the Federal Government, and State and local
			 agencies, in the maritime environment, in support of maritime homeland security
			 missions.</text>
					</paragraph><paragraph id="H3EBC18D0BF7F4CDF89DBD0DF4DF90E97"><enum>(5)</enum><text>Work conducted
			 within the context of other national and Department maritime security strategic
			 guidance.</text>
					</paragraph></subsection><subsection id="H82E271C0E0024E37884A20B60EC70D1F"><enum>(b)</enum><header>Additional
			 updates</header><text display-inline="yes-display-inline">Not later than July
			 1, 2019, the Secretary, acting through the Department’s Office of Operations
			 Coordination and Planning, shall submit to the appropriate congressional
			 committees an additional update to the maritime operations coordination
			 plan.</text>
				</subsection></section><section id="H36093F9523154D44B28BF2F57F5AA416"><enum>102.</enum><header>U.S. Customs
			 and Border Protection Office of Air and Marine Asset Deployment</header>
				<subsection id="H3AFAB250767F4DD2B63DC8ED2FD713F1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any new asset
			 deployment by the U.S. Customs and Border Protection’s Office of Air and
			 Marine, following the date of the enactment of this Act, shall, to the greatest
			 extent practicable, occur in accordance with a risk-based assessment that
			 considers mission needs, performance results, threats, costs, and any other
			 relevant factors identified by the Secretary. Specific factors to be included
			 in such assessment shall include, at a minimum, the following:</text>
					<paragraph id="HA23F1A942B184DBB91040ACF3EA9D367"><enum>(1)</enum><text display-inline="yes-display-inline">Mission requirements that prioritize the
			 operational needs of field commanders to secure the United States border and
			 ports.</text>
					</paragraph><paragraph id="HFA5896606C3941D59BCAA64E3FAD09C1"><enum>(2)</enum><text>Other Department
			 assets available to help address any unmet border and port security mission
			 needs.</text>
					</paragraph><paragraph id="HFA31808710DF4832B3F3D039B3CAE2DA"><enum>(3)</enum><text>Risk analysis
			 showing positioning of the asset at issue to respond to intelligence on
			 emerging terrorist and other threats.</text>
					</paragraph><paragraph id="HE5EC24CD980040DEA11B4ECE1E16C4DB"><enum>(4)</enum><text>Cost-benefit
			 analysis showing the relative ability to use the asset at issue in the most
			 cost-effective way to reduce risk and achieve mission success.</text>
					</paragraph></subsection><subsection id="HC449F3967B1C4546AF4AEB8D85827C96"><enum>(b)</enum><header>Considerations</header><text display-inline="yes-display-inline">An assessment required under subsection (a)
			 shall consider applicable Federal guidance, standards, and agency strategic and
			 performance plans, including the following:</text>
					<paragraph id="H29182D45052D417481FE49834A9F6A8E"><enum>(1)</enum><text display-inline="yes-display-inline">The most recent Departmental Quadrennial
			 Homeland Security Review, and any follow-up guidance related to such
			 Review.</text>
					</paragraph><paragraph id="H1E3C375A37D34502925260E139ACA63F"><enum>(2)</enum><text>The Department’s
			 Annual Performance Plans.</text>
					</paragraph><paragraph id="H2D942CAF0F604B2F911237353841914F"><enum>(3)</enum><text>Department policy
			 guiding use of integrated risk management in resource allocation
			 decisions.</text>
					</paragraph><paragraph id="HA1E282B9BF0642958DA82116B8D7C410"><enum>(4)</enum><text>Department and
			 U.S. Customs and Border Protection Strategic Plans and Resource Deployment
			 Plans.</text>
					</paragraph><paragraph id="HAAAAD454C5F449429D19BA2BBB76B51C"><enum>(5)</enum><text>Applicable
			 aviation guidance from the Department, including the DHS Aviation Concept of
			 Operations.</text>
					</paragraph><paragraph id="H1CAFA012CF31408DA1D6A578F4073C92"><enum>(6)</enum><text>Other strategic
			 and acquisition guidance promulgated by the Federal Government as the Secretary
			 determines appropriate.</text>
					</paragraph></subsection><subsection id="H999C5A2B45DE4516A62E867FA7BE56E6"><enum>(c)</enum><header>Audit and
			 report</header><text display-inline="yes-display-inline">The Inspector General
			 of the Department shall biennially audit the deployment of new assets within
			 U.S. Customs and Border Protection’s Office of Air and Marine and submit to the
			 appropriate congressional committees a report on the compliance of the
			 Department with the requirements of this section.</text>
				</subsection></section><section id="H1B6933B499654868B606B95A2119A018"><enum>103.</enum><header>Cost-benefit
			 analysis of co-locating operational entities</header>
				<subsection id="H4B6D03BEBACF418EA261019235F76AF7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">For all locations in
			 which U.S. Customs and Border Protection’s Office of Air and Marine operates
			 that are within 25 miles of locations where any other Department agency also
			 operates air and marine assets, the Secretary shall conduct a cost-benefit
			 analysis to consider the potential cost of and savings derived from co-locating
			 aviation and maritime operational assets of the different agencies of the
			 Department. In analyzing the potential cost savings achieved by sharing
			 aviation and maritime facilities, the study shall consider at a minimum the
			 following factors:</text>
					<paragraph id="H1F6722D7CFBC4BDBA4E0EDD33A461CDE"><enum>(1)</enum><text display-inline="yes-display-inline">Potential enhanced cooperation derived from
			 Department personnel being co-located.</text>
					</paragraph><paragraph id="H052732132D9241A5A701991A1400E567"><enum>(2)</enum><text display-inline="yes-display-inline">Potential cost of, and savings derived
			 through, shared maintenance and logistics facilities and activities.</text>
					</paragraph><paragraph id="H26C0998B5D9F49FF85D8F1650AC0AEFB"><enum>(3)</enum><text>Joint use of base
			 and facility infrastructure, such as runways, hangars, control towers,
			 operations centers, piers and docks, boathouses, and fuel depots.</text>
					</paragraph><paragraph id="H75BD556E80BB46E49434D21B63E6079D"><enum>(4)</enum><text>Short term moving
			 costs required in order to co-locate facilities.</text>
					</paragraph><paragraph id="H8C79EA1860694D7EBB4D637C89BFA1B2"><enum>(5)</enum><text>Acquisition and
			 infrastructure costs for enlarging current facilities as needed.</text>
					</paragraph></subsection><subsection id="H070BED54DEC84831B003C8E7AB1CD33A"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 the enactment of this Act, the Secretary shall submit to the appropriate
			 congressional committees a report summarizing the results of the cost-benefit
			 analysis required under subsection (a) and any planned actions based upon such
			 results.</text>
				</subsection></section><section id="H9B86A243B46341B79475BFF4CFA0CB4E"><enum>104.</enum><header>Study of
			 maritime security redundancies</header><text display-inline="no-display-inline">The Comptroller General of the United States
			 shall by not later than 1 year after the date of enactment of this Act—</text>
				<paragraph id="H454E33B772B14D698954B6CD93444C58"><enum>(1)</enum><text>conduct a review
			 of port security and maritime law enforcement operations within the Department
			 to identify initiatives and programs with duplicative, overlapping, or
			 redundant goals and activities, including the cost of such duplication;
			 and</text>
				</paragraph><paragraph id="H4A9A8D07BD6247DBB394326BE66BB1CB"><enum>(2)</enum><text>submit to the
			 appropriate congressional committees a report on the findings of the study,
			 including—</text>
					<subparagraph id="H69F7729C10C145AC99835055427ED14D"><enum>(A)</enum><text>recommendations
			 for consolidation, elimination, or increased cooperation to reduce unnecessary
			 duplication found in the study; and</text>
					</subparagraph><subparagraph id="HF58D4C4EAE2344B38AEA14FD30B0AA05"><enum>(B)</enum><text>an analysis of
			 personnel, maintenance, and operational costs related to unnecessarily
			 duplicative, overlapping, or redundant goals and activities found in the
			 study.</text>
					</subparagraph></paragraph></section><section id="H748811A7E48045DA95E750E39A16A833"><enum>105.</enum><header>Acquisition and
			 strategic sourcing of marine and aviation assets</header>
				<subsection id="H79DDEEEAF6F84F00A2B5B85B55E58C75"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Before initiating the
			 acquisition of any new boat or aviation asset, the Secretary shall coordinate
			 across the agencies of the Department, as appropriate, to—</text>
					<paragraph id="HD6752006D84E40B38AAE494580B22598"><enum>(1)</enum><text>identify common
			 mission requirements before initiating a new acquisition program; and</text>
					</paragraph><paragraph id="H6DE49356C479403087B3E0FAADA489F9"><enum>(2)</enum><text>standardize, to
			 the extent practicable, equipment purchases, streamline the acquisition
			 process, and conduct best practices for strategic sourcing to improve control,
			 reduce cost, and facilitate oversight of asset purchases prior to issuing a
			 Request for Proposal.</text>
					</paragraph></subsection><subsection id="H22315FE88FDD4BD7A65A3D89A0CB6EC2"><enum>(b)</enum><header>Establishment of
			 aviation and maritime coordination mechanism</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary shall establish a coordinating
			 mechanism for aviation and maritime issues, including issues related to the
			 acquisition, administration, operations, maintenance, and joint management
			 across the Department, in order to decrease procurement and operational costs
			 and increase efficiencies.</text>
				</subsection><subsection id="H9228D967F96B4811A473C14E30CFA7B6"><enum>(c)</enum><header>Special
			 rule</header><text display-inline="yes-display-inline">For the purposes of this
			 section, a boat shall be considered any vessel less than 65 feet in
			 length.</text>
				</subsection></section><section id="H5855B7BEEDBD4CC890360D6F74FE7595"><enum>106.</enum><header>Port security
			 grant program management</header>
				<subsection id="H4A65E805BF554C2F95378D21B276DA73"><enum>(a)</enum><header>Determination of
			 applications</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/70107">Section 70107(g)</external-xref> of title 46,
			 United States Code, is amended—</text>
					<paragraph id="HBDAB3D3BE9C545C3B5BE4CA3E6DEB050"><enum>(1)</enum><text>by striking
			 <quote>Any entity</quote> and inserting the following:</text>
						<quoted-block changed="added" id="H6AC5CA0E8CC24FEAB81BF38CBB1EF457" style="OLC">
							<paragraph id="H1D106A3B76FB47648951E6A82D47D64F"><enum>(1)</enum><header>In
				general</header><text>Any entity</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HCAE7DA9E564C4BC1A5C7141D54462486"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block changed="added" id="HF489749C875C405CB57444188A2B9636" style="OLC">
							<paragraph id="H6B78C99217334C90AD0E467ED7ECAFCD"><enum>(2)</enum><header>Determination</header><text>Notwithstanding
				any other provision of law, the Secretary shall, not later than 60 days after
				the date on which an applicant submits a complete application for a grant under
				this section, either approve or disapprove the
				application.</text>

			 of title 46, United States Code, is amended by adding after paragraph (4) the
			 following:</text>

						<paragraph id="HF45CFF975FE04FE9B57E5809EB025E99"><enum>(5)</enum><header>Release of
				funds</header><text>To the maximum extent practicable, the Secretary shall
				complete all necessary programmatic reviews and release grant funds awarded
				under this section to the appropriate entity not later than 180 days after the
				date on which an applicant submits a complete application.</text>
						</paragraph><paragraph id="H9B8A5DD9884C41AEB0B04D9A72F02FE7"><enum>(6)</enum><header>Performance
				period</header><text>The Secretary shall utilize a period of performance of not
				less than 3 years for expenditure of grant funds awarded under this
				section.</text>
						</paragraph><paragraph id="H8CA9AA8EE84347B58D92DB195E23C2BE"><enum>(7)</enum><header>Extension
				determinations</header><text>Notwithstanding any other provision of law, not
				later than 60 days after the date on which an applicant submits a complete
				application for an extension of the period of performance for a grant, the
				Secretary shall either approve or disapprove the
				application.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H9C01B56A45BB4DFF9B726D9F550228DE"><enum>107.</enum><header>Port security
			 grant funding for mandated security personnel</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/70107">Section
			 70107(b)(1)</external-xref> of title 46, United States Code, is amended by
			 striking the period and inserting the following: <quote>, including overtime
			 and backfill costs incurred in support of other expenditures authorized under
			 this subsection, except that not more than 50 percent of amounts received by a
			 grantee under this section for a fiscal year may be used under this
			 paragraph.</quote>.</text>
			</section><section id="HA9EA0ACCAFFD4E49825D30B4B42C63D1"><enum>108.</enum><header>Interagency
			 operational centers for port security</header>
				<subsection id="HA5CB75936A6F410DB7F5EDCE1A054364"><enum>(a)</enum><header>Participating
			 personnel</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/70107A">Section 70107A(b)(1)(B)</external-xref> of title
			 46, United States Code, is amended—</text>
					<paragraph id="H31A9A5A63D2C4DA58F7CBE48B502EEB0"><enum>(1)</enum><text>by inserting
			 <quote>, not less than part-time representation from U. S. Customs and Border
			 Protection and U.S. Immigration and Customs Enforcement,</quote>after
			 <quote>the Coast Guard</quote>; and</text>
					</paragraph><paragraph id="HD3E10D659E6546CDAA1E3F2D4D436A00"><enum>(2)</enum><text>by striking
			 <quote>the United States Customs and Border Protection, the United States
			 Immigration and Customs Enforcement,</quote>.</text>
					</paragraph></subsection><subsection id="HCC3094076B49459AA51394AF68583376"><enum>(b)</enum><header>Assessment</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 enactment of this Act the Secretary (as that term is used in that section)
			 shall transmit to the appropriate congressional committees an assessment
			 of—</text>
					<paragraph id="H64FE7A1507464A979FDFD1F230ACFECF"><enum>(1)</enum><text display-inline="yes-display-inline">interagency operational centers under such
			 section and the implementation of the amendments made by this section;</text>
					</paragraph><paragraph id="H2C8D662DC60143EA8FF30E8E146F036D"><enum>(2)</enum><text>participation in
			 such centers and by Federal agencies, State and local law enforcement agencies,
			 port security agencies, and other public and private sector entities, including
			 joint daily operational coordination, training and certifying of non-Federal
			 law enforcement personnel, and joint training exercises;</text>
					</paragraph><paragraph id="H2A503E2E74F24802927EABE463BBCD94"><enum>(3)</enum><text>deployment of
			 interoperable communications equipment under subsection (e) of such section,
			 including—</text>
						<subparagraph id="H739F4A2EA0EE4295A4121691F7ADD7E1"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of the cost-effectiveness and
			 utility of such equipment for Federal agencies, State and local law enforcement
			 agencies, port security agencies, and other public and private sector
			 entities;</text>
						</subparagraph><subparagraph id="HDE750DEEBA8C4F449848CCCF53452D00"><enum>(B)</enum><text>data showing which
			 Federal agencies, State and local law enforcement agencies, port security
			 agencies, and other public and private sector entities are utilizing such
			 equipment;</text>
						</subparagraph><subparagraph id="HA427BB346BB44FDB852C5DAFC00C4E13"><enum>(C)</enum><text>an explanation of
			 the process in place to obtain and incorporate feedback from Federal agencies,
			 State and local law enforcement agencies, port security agencies, and other
			 public and private sector entities that are utilizing such equipment in order
			 to better meet their needs; and</text>
						</subparagraph><subparagraph id="HFBEABFAEE34C45DAA8ABD7EDE99712A6"><enum>(D)</enum><text>an updated
			 deployment schedule and life cycle cost estimate for the deployment of such
			 equipment; and</text>
						</subparagraph></paragraph><paragraph id="HEE3C6D80BB804A12B3BF7A74473EF66F"><enum>(4)</enum><text display-inline="yes-display-inline">mission execution and mission support
			 activities of such centers, including daily coordination activities,
			 information sharing, intelligence integration, and operational planning.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H05B4BE6A76E0466483172F9B7A095AAC"><enum>109.</enum><header>Report on DHS
			 aviation assets</header>
				<subsection id="H162A226AA4424E6A8A3D325649F78201"><enum>(a)</enum><header>In
			 general</header><text>Not later than one year after the date of the enactment
			 of this Act, the Comptroller General of the United States shall submit to the
			 appropriate congressional committees a report that analyzes and compares the
			 costs, capabilities, and missions of different aviation assets, including
			 unmanned aerial vehicles, utilized by the Department to assess the relative
			 costs of unmanned aerial vehicles as compared to manned aerial vehicles, and
			 any increased operational benefits offered by unmanned aerial vehicles as
			 compared to manned aviation assets.</text>
				</subsection><subsection id="HCDCF50528648450A8A96E21455169196"><enum>(b)</enum><header>Required
			 data</header><text>The report required under subsection (a) shall include a
			 detailed assessment of costs for operating each type of asset described in such
			 report, including—</text>
					<paragraph id="HD03EB6ED343147AEB4BA933659DC53B8"><enum>(1)</enum><text>fuel costs;</text>
					</paragraph><paragraph id="H92768276547041B2AF5A8009B5ECF22D"><enum>(2)</enum><text>crew and staffing
			 costs;</text>
					</paragraph><paragraph id="H04ECCD13123C4B7ABDE1E4ABE72B14CF"><enum>(3)</enum><text>maintenance
			 costs;</text>
					</paragraph><paragraph id="HCB354898D67E41E491D156E19A763559"><enum>(4)</enum><text>communication and
			 satellite bandwidth costs;</text>
					</paragraph><paragraph id="H95497732260C4F3383CE457AF0CDBD76"><enum>(5)</enum><text>costs associated
			 with the acquisition of each type of such asset; and</text>
					</paragraph><paragraph id="H6AC7115E0A014241981F1F9FBC14C535"><enum>(6)</enum><text>any other relevant
			 costs necessary to provide a holistic analysis and to identify potential cost
			 savings.</text>
					</paragraph></subsection></section><section id="HA58741FD66A74F7388D115518CCDD467"><enum>110.</enum><header>Small vessel
			 threat analysis</header><text display-inline="no-display-inline">Not later than
			 1 year after the date of enactment of this Act, the Secretary shall submit to
			 the appropriate congressional committees a report analyzing the threat of,
			 vulnerability to, and consequence of an act of terrorism using a small vessel
			 to attack United States vessels, ports, or maritime interests.</text>
			</section><section id="HB73CD8FC272B48F79FF06AFFAD3907E0"><enum>111.</enum><header>U.S. Customs
			 and Border Protection workforce plan</header>
				<subsection id="H49F1CADAFE71403A82A9C841BDC1DC08"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, the Secretary shall submit to
			 the appropriate congressional committees a plan for optimizing staffing levels
			 for U.S. Customs and Border Protection personnel to carry out the mission of
			 the Department, including optimal levels of U.S. Customs and Border Protection
			 staffing required to conduct all border security functions.</text>
				</subsection><subsection id="H11219EB6312D4CCE933904EE1DF6655A"><enum>(b)</enum><header>Consideration of
			 prior staffing resources</header><text display-inline="yes-display-inline">The
			 staffing plan required under subsection (a) shall consider previous staffing
			 models prepared by the Department and assessments of threat and
			 vulnerabilities.</text>
				</subsection></section><section id="H6A2524CCCA004FC7A0E2BAE9CABCA189" section-type="subsequent-section"><enum>112.</enum><header>Integrated
			 cross-border maritime operations between the United States and Canada</header>
				<subsection id="HCC77428BAD9B4FEA984D8D575116F61F"><enum>(a)</enum><header>In
			 general</header><text>Subtitle C of title IV of the Homeland Security Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/201">6 U.S.C. 201 et
			 seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block changed="added" id="H5CBDC45520454839AE55B1CC3CC56FD8" style="OLC">
						<section id="H6E15A4B3C5F34A6D9D8C4ABDBB8F7BBD"><enum>432.</enum><header>Integrated
				cross-border maritime operations between the United States and Canada</header>
							<subsection id="H6A04D10956394D2DA641C692F5C2F50D"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary is authorized to establish an Integrated Cross-Border Maritime
				Operations Program to coordinate maritime security operations between the
				United States and Canada (in this section referred to as the
				<quote>Program</quote>).</text>
							</subsection><subsection id="H889134B5EE704EC5832BAE727392716D"><enum>(b)</enum><header>Purpose</header><text>The
				Secretary, acting through the Commandant of the Coast Guard, shall administer
				the Program in a manner that results in a cooperative approach between the
				United States and Canada to strengthen border security and detect, prevent,
				suppress, investigate, and respond to terrorism and violations of law related
				to border security.</text>
							</subsection><subsection id="H17960381B16241648C7E5F7CFAE40CBA"><enum>(c)</enum><header>Training</header><text>The
				Secretary, acting through the Commandant of the Coast Guard, in consultation
				with the Secretary of State, may—</text>
								<paragraph id="HE544D2AC5C79451785701D397DA7BF07"><enum>(1)</enum><text>establish, as an
				element of the Program, a training program to create designated maritime law
				enforcement officers;</text>
								</paragraph><paragraph id="H08CCCC6EFDB34886BE598CE7DD909A52"><enum>(2)</enum><text>conduct training
				jointly with Canada, including training—</text>
									<subparagraph id="H0D7A2EEAB06C4F2396F389B99698BE74"><enum>(A)</enum><text>on the detection
				and apprehension of suspected terrorists and individuals attempting to
				unlawfully cross or unlawfully use the international maritime border between
				the United States and Canada, to enhance border security;</text>
									</subparagraph><subparagraph id="H060E3919902E479383069C7F55BD0DA1"><enum>(B)</enum><text>on the
				integration, analysis, and dissemination of port security information between
				the United States and Canada;</text>
									</subparagraph><subparagraph id="HAB81A144C6A4483B8B7E2ECE38955ADD"><enum>(C)</enum><text>on the respective
				policy, regulatory, and legal considerations related to the Program;</text>
									</subparagraph><subparagraph id="H96F04CC8779947908AE783AA0A03BAA4"><enum>(D)</enum><text>on the use of
				force and maritime security;</text>
									</subparagraph><subparagraph id="HF61E3ADFDA70471497194DF1E710DC35"><enum>(E)</enum><text>in operational
				procedures and protection of information and other sensitive information;
				and</text>
									</subparagraph><subparagraph id="H7AA4A0728B964EDC88EE469AD80BD1EF"><enum>(F)</enum><text>on preparedness
				and response to maritime terrorist incidents.</text>
									</subparagraph></paragraph></subsection><subsection id="HE2CDAC86156B4E7BB6BDE983D8737D14"><enum>(d)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary, acting through the
				Commandant of the Coast Guard, shall coordinate the Program with other similar
				border security and antiterrorism programs within the Department.</text>
							</subsection><subsection id="H516B40BFBF434A98B7542C0E5EEC84E2"><enum>(e)</enum><header>Memoranda of
				agreement</header><text>The Secretary may enter into any memorandum of
				agreement necessary to carry out the Program.</text>
							</subsection><subsection id="HB7D4A5CAC7644B96BC9445F2F31BB63C"><enum>(f)</enum><header>Authorization of
				appropriations</header><text>To carry out this section there is authorized to
				be appropriated to the Secretary $2,000,000 for each of fiscal years 2013 and
				2014.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HE9FFFE685E2B4142AB80FC997AB393CE"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 1(b) of such Act is
			 amended by adding at the end of the items relating to such subtitle the

					</paragraph><paragraph id="HDA95E6D80B484C898004C273AD77A2B8"><enum>(3)</enum><text>In subsection
			 (b)(1), by amending subparagraphs (A) and (B) to read as follows:</text>

				opportunity for public comment, may develop and publish training curricula for

								<clause id="H6230B9F8019744F6AE0736FD60A3DE5C"><enum>(i)</enum><text>test and deliver
				training for which the curriculum is developed under subparagraph (A);</text>
								</clause><clause id="H1567196B4CD147029CFFEB1506DCB6FC"><enum>(ii)</enum><text>enter into an
				agreement under which any Federal, State, local, tribal, or private sector
				entity may test and deliver such training; and</text>
								</clause><clause id="H8368E8D92AC84EBFBB4D827281C7F6A6"><enum>(iii)</enum><text>accept the
				results of training conducted by any Federal, State, local, tribal, or private
				sector entity under such an
				agreement.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HA8CABAF4A99B40BC8E650E50636D959A"><enum>(4)</enum><text>By striking
			 subsection (b)(2) and inserting the following:</text>

					</paragraph><paragraph id="H024C1D0FBED247EC8007B393C67339A1"><enum>(7)</enum><text>By adding at the
			 end the following:</text>

							<subsection id="H582A1BF0B37F4A34A5AD277E3973208A"><enum>(d)</enum><header>Tactical
				training for law enforcement personnel</header><text>The Commandant of the
				Coast Guard may make such training developed under this section available to
				law enforcement officers employed by a law enforcement agency, on either a
				reimbursable or a non-reimbursable basis, if the Commandant determines
				that—</text>
								<paragraph id="HA97C5EB3C61346B8A6BA61A2ADEDF454"><enum>(1)</enum><text>a member of the
				Coast Guard is unable or unavailable to undertake tactical training the
				authorization of which had been previously approved, and no other member of the
				Coast Guard is reasonably available to undertake such training;</text>
								</paragraph><paragraph id="HFD5C2FD120304DC4B3650BA340D5FC51"><enum>(2)</enum><text>the inability or
				unavailability of Coast Guard personnel to undertake such training creates
				training capacity within the training program; and</text>
								</paragraph><paragraph id="H8C7C9BBDED904A2CBD8EA5898A7F2D85"><enum>(3)</enum><text display-inline="yes-display-inline">such training, if made available to such
				law enforcement officers, would contribute to achievement of the purposes of
				this
				section.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 to allow routine operation of medium-sized unmanned aerial vehicles, including
			 autonomously piloted drones, within the national airspace for border and
			 maritime security missions without any degradation of existing levels of
			 security-related surveillance or of safety for all national airspace system
			 users.</text>
				</subsection><subsection id="H3E02E724E95F423F8DC4562120660BD4"><enum>(b)</enum><header>Pilot
			 project</header><text>No later than 180 days after the date of enactment of
			 this Act, the Secretary shall commence a pilot project in segregated airspace
			 along the northern border to conduct experiments and collect data in order to
			 accelerate the safe integration of medium-sized unmanned aircraft systems into
			 the national airspace system.</text>
				</subsection></section><section id="HE5E6138228FE49678CF20BCFF6A3AFC9"><enum>115.</enum><header>Recognition of
			 port security assessments conducted by other entities</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/70108">Section 70108</external-xref> of
			 title 46, United States Code, is amended by adding at the end the following new
			 subsection:</text>

					<subsection id="HEE547885D4D64DD080B15DA226AA1A7D"><enum>(f)</enum><header>Recognition of
				assessment conducted by other entities</header>
						<paragraph id="HD55796D1674E4A6C9E013A2840B8594C"><enum>(1)</enum><header>Certification
				and treatment of assessments</header><text display-inline="yes-display-inline">For the purposes of this section and
				section 70109, the Secretary may treat an assessment conducted by a foreign
				government or international organization as an assessment by the Secretary
				required by subsection (a), if the Secretary certifies that the assessment was
				conducted in accordance with subsection (b).</text>
						</paragraph><paragraph id="HFD12DE18E5A54CCC9D02154B28CD2AA2"><enum>(2)</enum><header>Authorization to
				enter into agreements or arrangements</header><text>The Secretary may enter
				into an agreement or arrangement with a foreign government or international
				organization, under which—</text>
							<subparagraph id="H400C2EBE033C4F8B9CD7FB6870C4BB71"><enum>(A)</enum><text>such government or
				organization may, on behalf of the Secretary, conduct an assessment required
				under subsection (a), or share with the Secretary information pertaining to
				such assessments; and</text>
							</subparagraph><subparagraph id="H2BFB71FD7CBF41C993751FE3EF2A3227"><enum>(B)</enum><text>the Secretary may,
				on behalf of such foreign government or organization, conduct an assessment
				described in subsection (a), or share with such foreign government or
				organization information pertaining to such assessments.</text>
							</subparagraph></paragraph><paragraph id="HE8A9D08EBFE74B93995AB5F4AB4C0E24"><enum>(3)</enum><header>Limitations</header><text display-inline="yes-display-inline">Nothing in this subsection—</text>
							<subparagraph id="HE846112186554F6787C487056EC94858"><enum>(A)</enum><text>requires the
				Secretary to recognize an assessment that a foreign government or an
				international organization conducts pursuant to this subsection; or</text>
							</subparagraph><subparagraph id="HB71541BE749746DEB4118DAD22106F99"><enum>(B)</enum><text>limits the
				discretion or ability of the Secretary to conduct an assessment under this
				section.</text>
							</subparagraph></paragraph><paragraph id="H440727BFEE2D468AB1FF20439B8F33B0"><enum>(4)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 30 days before entering into
				an agreement or arrangement with a foreign government under paragraph (2), the
				Secretary shall notify the appropriate congressional committees of the proposed
				terms of such agreement or
				arrangement.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HFAB113FA467E412AA27C9AA0570C5429"><enum>116.</enum><header>Use of port
			 security grant funds for replacement of security equipment or
			 facilities</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/70107">Section
			 70107(b)(2)</external-xref> of title 46, United States Code, is amended by
			 inserting <quote>(including replacement)</quote> after
			 <quote>acquisition</quote>.</text>

			 chain security</header>
			<section id="HBC87275976554EE4B37DFA96BCCF48E2"><enum>201.</enum><header>Strategic plan
			 to enhance the security of the international supply chain</header><text display-inline="no-display-inline">Section 201 of the SAFE Port Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/6/941">6 U.S.C.
			 941</external-xref>) is amended—</text>
				<paragraph id="H128847D59AF3450A8A41F13015BDAE49"><enum>(1)</enum><text>by amending
			 subsection (b) to read as follows:</text>

				redundancies or overlaps in Federal transportation security credentialing

				redundancies or overlaps in Federal trusted shipper or trusted trader
				programs;</text>
								</subparagraph></paragraph><paragraph id="H03AC63CE4C8744EDB44FF70C5D9EDB4B"><enum>(2)</enum><text>review ongoing
				efforts to align activities throughout the Federal Government to—</text>

								</subparagraph></paragraph><paragraph id="H82501CFDD82B401FA714106ECC12CFD5"><enum>(3)</enum><text display-inline="yes-display-inline">identify further regulatory or
				organizational changes necessary to—</text>
								<subparagraph id="H52A1F72A84DC4DFD85F4ED77E7932A11"><enum>(A)</enum><text>improve
				coordination among the agencies referred to in paragraph (1);</text>
								</subparagraph><subparagraph id="H64EAAE6501FE4F479773A51AFEAA6EFC"><enum>(B)</enum><text>facilitate the
				efficient flow of legitimate commerce;</text>
								</subparagraph><subparagraph id="HBD2DF56CB7C84B198456A69A1F9FB3C5"><enum>(C)</enum><text>enhance the
				security of the international supply chain; or</text>

				or overlaps described in paragraph (1);</text>
								</subparagraph></paragraph><paragraph id="H1DC73032343945F4B48F8EC11098622F"><enum>(4)</enum><text>provide measurable
				goals, including objectives, mechanisms, and a schedule, for furthering the
				security of commercial operations from point of origin to point of
				destination;</text>
							</paragraph><paragraph id="HDB9FCFA8C5564BD79231380793FA4349"><enum>(5)</enum><text>build on available
				resources and consider costs and benefits;</text>
							</paragraph><paragraph id="HD40317731F494E2280439EBCB7B78A8E"><enum>(6)</enum><text>recommend
				additional incentives for voluntary measures taken by private sector entities
				to enhance supply chain security, including additional incentives for such
				entities participating in the Customs-Trade Partnership Against Terrorism in
				accordance with sections 214, 215, and 216;</text>
							</paragraph><paragraph id="H474C94AAA6B04799929C805909F171D1"><enum>(7)</enum><text>consider the
				impact of supply chain security requirements on small- and medium- sized
				companies;</text>

				framework for prudent and measured response in the event of a transportation
				security incident involving the international supply chain;</text>

				protocols for the expeditious resumption of the flow of trade in accordance
				with section 202;</text>

				address implementation of lessons learned from recent exercises conducted under
				sections 114 and 115, and other international supply chain security, response,
				or recovery exercises that the Department participates in, as
				appropriate;</text>
							</paragraph><paragraph id="HCA3EA1905B9B431DB5A6406D6492825F"><enum>(11)</enum><text>consider the
				linkages between supply chain security and security programs within other
				systems of movement, including travel security and terrorism finance
				programs;</text>
							</paragraph><paragraph id="HA4A6CDA5B84D49DFBA54731D9EC1EDE8"><enum>(12)</enum><text>be informed by
				technologies undergoing research, development, testing, and evaluation by the
				Department; and</text>
							</paragraph><paragraph id="H9D0E11FBB95C470298655B78898EA3EC"><enum>(13)</enum><text>expand upon and
				relate to existing strategies and plans for securing supply chains, including
				the National Response Plan, the National Maritime Transportation Security Plan,
				the National Strategy for Maritime Security, and the eight supporting plans of
				such National Strategy for Maritime Security, as required by Homeland Security
				Presidential Directive

				vulnerabilities, attacks, and exploitations described in subparagraph
				(A).</text>
								</subparagraph></paragraph><paragraph id="HF43C349E6EF444C0887286B9ED54AF06"><enum>(2)</enum><header>Contents</header><text>The
				information sharing required under paragraph (1) may include—</text>
								<subparagraph id="H5CE0C953FC71499B90EAFB80BFC863A8"><enum>(A)</enum><text>the creation of
				classified and unclassified means of accessing information that may be used by
				appropriately cleared personnel and that will provide, as appropriate, ongoing
				situational awareness of the security of the international supply chain;
				and</text>
								</subparagraph><subparagraph id="HFFC24D212BBA4207A897DE40F5F2CF00"><enum>(B)</enum><text>the creation of
				guidelines to establish a mechanism by which owners and operators of
				international supply chain infrastructure may report actual or potential
				security
				breaches.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H8843FBE2223F4F7A9EB19D7BB1380087"><enum>203.</enum><header>Recognition of
			 other countries’ trusted shipper programs</header><text display-inline="no-display-inline">Section 218 of the SAFE Port Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/6/968">6 U.S.C.
			 968</external-xref>) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block changed="added" display-inline="no-display-inline" id="HA06DB4067B3643959C219DEE01C78B3A" style="OLC">
					<subsection id="HD706E68B9F4647899ED08B12D39E812B"><enum>(j)</enum><header>Recognition of

				arrangement between the United States and a foreign government providing for
				mutual recognition of supply chain security practices which might result in the
				utilization of benefits described in section 214, 215, or 216, the Secretary
				shall—</text>
						<paragraph id="HDAF95D3CD35F48E380EF117E7BDFCC64"><enum>(1)</enum><text display-inline="yes-display-inline">notify the appropriate congressional
				committees of the proposed terms of such arrangement; and</text>
						</paragraph><paragraph id="H782E97E50FDD4011809B2085992A4DDF"><enum>(2)</enum><text display-inline="yes-display-inline">determine, in consultation with the
				Commissioner, that the foreign government’s supply chain security program
				provides comparable security as that provided by
				C-TPAT.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H59C3CD054C6B4751AFCAC96393697629"><enum>204.</enum><header>Pilot program
			 for inclusion of non-asset based third party logistics providers in the
			 Customs-Trade Partnership Against Terrorism</header>
				<subsection commented="no" id="H1EC5D1A74C55473CAEEEE36EDF57E33E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Secretary shall develop a
			 pilot program to determine whether allowing non-asset based third party
			 logistics providers that arrange international transportation of freight to
			 participate in the Customs-Trade Partnership Against Terrorism program, as
			 described in section 211 of the SAFE Port Act (<external-xref legal-doc="usc" parsable-cite="usc/6/961">6 U.S.C. 961</external-xref>), would enhance port
			 security, combat terrorism, prevent supply chain security breaches, or meet the
			 goals of the Customs-Trade Partnership Against Terrorism established pursuant
			 to section 211 of the SAFE Port Act (<external-xref legal-doc="usc" parsable-cite="usc/6/961">6 U.S.C. 961</external-xref>).</text>
				</subsection><subsection id="HA00053F194C2419E9962B51AA1AA739D"><enum>(b)</enum><header>Requirements</header>
					<paragraph id="HD2AC1325D4774914B5F6D8DC85FC4E5F"><enum>(1)</enum><header>Voluntary
			 participation</header><text display-inline="yes-display-inline">Participation
			 by non-asset based third party logistics providers that arrange international
			 transportation of freight taking part in the pilot program shall be
			 voluntary.</text>
					</paragraph><paragraph id="H3CB00A8EDE8847F8AADD0E166D530C2D"><enum>(2)</enum><header>Minimum
			 number</header><text display-inline="yes-display-inline">The Secretary shall
			 ensure that not fewer than five non-asset based third party logistics providers
			 that arrange international transportation of freight take part in the pilot
			 program.</text>
					</paragraph><paragraph id="H01601E0D065641F5A31CB2BEA82B93DF"><enum>(3)</enum><header>Duration</header><text display-inline="yes-display-inline">The pilot program shall be conducted for a
			 minimum duration of one year.</text>
					</paragraph></subsection><subsection id="HD22E5D7421F94A0AB25471C76F6FBF08"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the
			 conclusion of the pilot program, the Secretary shall submit to the appropriate
			 congressional committees a report on the findings and any recommendations of
			 the pilot program concerning the participation in the Customs-Trade Partnership
			 Against Terrorism of non-asset based third party logistics providers that
			 arrange international transportation of freight to combat terrorism and prevent
			 supply chain security breaches.</text>
				</subsection></section><section id="HFFBE99D3053D47ABB3A680DDB046350B"><enum>205.</enum><header>Transportation
			 Worker Identification Credential process reform</header>
				<subsection id="HA2781ECE10074875AD6BC2B329B4FC2A"><enum>(a)</enum><header>Sense of
			 Congress</header><text display-inline="yes-display-inline">To avoid further
			 imposing unnecessary and costly regulatory burdens on United States workers and
			 businesses, it is the sense of Congress that it is urgent that the
			 Transportation Worker Identification Credential (in this section referred to as
			 the <quote>TWIC</quote>) application process be reformed by not later than the
			 end of 2012, when hundreds of thousands of current TWIC holders will begin to
			 face the requirement to renew their TWICs.</text>
				</subsection><subsection id="HFE50FBE4EDD34ACC983494828798F3DA"><enum>(b)</enum><header>TWIC application
			 reform</header><text>Not later than 270 days after the date of the enactment of
			 this Act, the Secretary shall reform the process for the enrollment,
			 activation, issuance, and renewal of a TWIC to require, in total, not more than
			 one in-person visit to a designated enrollment center except in cases in which
			 there are extenuating circumstances, as determined by the Secretary, requiring
			 more than one such in-person visit.</text>
				</subsection></section><section id="HD9D1943DCC284288BA9B3DCE00D53A16"><enum>206.</enum><header>Expiration of
			 certain transportation worker identification credentials</header>
				<subsection id="H1B7083ABFED448758B8703F0DBA1299D"><enum>(a)</enum><header>In
			 general</header><text>A valid Transportation Worker Identification Credential
			 required under part 101.514 of title 33, Code of Federal Regulations, that was
			 issued before the date of enactment of this Act shall not expire before the
			 earlier of—</text>
					<paragraph id="H7DA442CE702F4C31B85603300137773A"><enum>(1)</enum><text>the deadline for
			 full implementation of a final rule issued by the Secretary for electronic
			 readers designed to work with Transportation Worker Identification Credentials
			 as an access control and security measure issued pursuant to the advanced
			 notice of proposed rulemaking published March 27, 2009 (74 Fed. Reg. 58), as
			 established by the final rule; or</text>
					</paragraph><paragraph id="H788B6668C9A049C1A6DBAA09959E908D"><enum>(2)</enum><text>June 30,
			 2014.</text>
					</paragraph></subsection><subsection id="H9ACE4D6FBA914023B09D8323F57DD754"><enum>(b)</enum><header>Revocation
			 authority not affected</header><text>This section shall not be construed to
			 affect the authority of the Secretary to revoke a Transportation Worker
			 Identification Credential—</text>
					<paragraph id="H8674CFA551C840B0B8B5D4459D3B45D0"><enum>(1)</enum><text>based on
			 information that the holder is not qualified to hold such credential; or</text>
					</paragraph><paragraph id="HC1F03F832A7E412D9BF9F4176D11F99D"><enum>(2)</enum><text>if the credential
			 is lost, damaged, or stolen.</text>
					</paragraph></subsection></section><section id="H869F8753BDAF4061B0963CCE4E2C576B"><enum>207.</enum><header>Securing the
			 Transportation Worker Identification Credential against use by unauthorized
			 aliens</header>
				<subsection id="HEE9BCADA09434BC08CBE1EF1095013A2"><enum>(a)</enum><header>Process</header>
					<paragraph id="H46FF7645EBB44320A40719AB10A10CA0"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Secretary shall establish a
			 process to ensure, to the maximum extent practicable, that an individual who is
			 not lawfully present in the United States cannot obtain or continue to use a
			 Transportation Worker Identification Credential (in this section referred to as
			 the <quote>TWIC</quote>).</text>
					</paragraph><paragraph id="H24576445815B41BF8981962FDFC60F33"><enum>(2)</enum><header>Components</header><text>In
			 establishing the process under subsection (a), the Secretary shall—</text>
						<subparagraph id="H4983E22F26584A29804D6455C634F49B"><enum>(A)</enum><text>publish a list of
			 documents that will identify non-United States citizen TWIC applicants and
			 verify their immigration statuses by requiring each such applicants to produce
			 a document or documents that demonstrate—</text>
							<clause id="H9E23F914CA7F4B7CBFAB40EDB9C2A29C"><enum>(i)</enum><text>identity;
			 and</text>
							</clause><clause id="H73630FCA77BD4B7A8DA5E14F6C6E3318"><enum>(ii)</enum><text>proof of lawful
			 presence in the United States; and</text>
							</clause></subparagraph><subparagraph id="HD7AE0AE72CB34E7588B4DACAE2BCE0F0"><enum>(B)</enum><text>establish training
			 requirements to ensure that trusted agents at TWIC enrollment centers receive
			 training to identify fraudulent documents.</text>
						</subparagraph></paragraph></subsection><subsection id="H0A809438883D4858829535C731094D04"><enum>(b)</enum><header>Expiration of
			 TWICs</header><text>A TWIC expires on the date of its expiration, or in the
			 date on which the individual to whom such a TWIC is issued is no longer
			 lawfully present in the United States, whichever is earlier.</text>
				</subsection></section><section display-inline="no-display-inline" id="H1D2555D14A9B48519EBC96511BE67F37" section-type="subsequent-section"><enum>208.</enum><header>Report on Federal
			 transportation security credentialing programs</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary shall submit to the appropriate
			 congressional committees a report that identifies unnecessary redundancies or
			 overlaps in Federal transportation security credentialing programs, including
			 recommendations to reduce or eliminate such redundancies or overlaps.</text>
