		<official-title>To amend the Communications Act of 1934 to prohibit
		  mobile service providers from providing service on mobile electronic devices
		  that have been reported stolen and to require such providers to give consumers
		  the ability to remotely delete data from mobile electronic devices, and for
		  other purposes.</official-title>

		<section id="H79DD3DDA578C4D7C80FB680F0339193C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cell Phone Theft Prevention Act of
			 2012</short-title></quote>.</text>
		</section><section id="H0A6F3525878B4CB3BAA303DB79DF9A49"><enum>2.</enum><header>Stolen mobile
			 electronic devices</header>
			<subsection id="H5EF3EA5686D943EA9522D71B0EAD8F15"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part I of title III
			 of the Communications Act of 1934 (47 U.S.C. 301 et seq.) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9B4AB05223904C91B2E49F1E65ECB12B" style="OLC">
					<section id="H50573B604837425499FC92ED0DB4EA49"><enum>343.</enum><header>Stolen mobile
				electronic devices</header>
						<subsection id="HCDF9DA89C4794E4E8AE65D2B48CA0EA1"><enum>(a)</enum><header>Prohibition on
				provision of service</header>
							<paragraph id="H56C640BB30B447FF9573F15CA62CE66B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A provider of
				commercial mobile service or commercial mobile data service may not provide
				service on a mobile electronic device that has been reported to such provider
				as stolen—</text>
								<subparagraph id="H6E20785D69154786B64C9EE3EBB8D5F9"><enum>(A)</enum><text display-inline="yes-display-inline">by the person who holds the account with
				respect to such service, if such person submits to such provider a copy of a
				report made to a law enforcement agency regarding the theft; or</text>
								</subparagraph><subparagraph id="H5CBCDFF403044ABE83F76D72542EE085"><enum>(B)</enum><text>by another
				provider of commercial mobile service or commercial mobile data service, in
				accordance with paragraph (2).</text>
								</subparagraph></paragraph><paragraph id="HB43F0AAC221E4DAFA332D7F894483EC4"><enum>(2)</enum><header>Reporting by
				service providers</header><text display-inline="yes-display-inline">A provider
				of commercial mobile service or commercial mobile data service to which a
				mobile electronic device is reported stolen as described in paragraph (1)(A)
				shall inform all other providers of such service—</text>
								<subparagraph id="H22615247B1CA4568992DBA0312E5780B"><enum>(A)</enum><text>that such device
				has been reported stolen; and</text>
								</subparagraph><subparagraph id="HCC6F26A4820943B881F71DB50A2D3B2A"><enum>(B)</enum><text>of any information
				necessary for the identification of such device.</text>
								</subparagraph></paragraph></subsection><subsection id="H86FA67B1A80F447A9485261F0E257958"><enum>(b)</enum><header>Remote deletion
				of data</header><text display-inline="yes-display-inline">A provider of
				commercial mobile service or commercial mobile data service on a mobile
				electronic device shall make available to the person who holds the account with
				respect to such service the capability of deleting from such device, from a
				remote location, all information that was placed on such device after its
				manufacture.</text>
						</subsection><subsection id="HA1FDEA0D39164F7E8FBA1014AFDF466F"><enum>(c)</enum><header>Device
				standards</header><text>A person may not manufacture in the United States or
				import into the United States for sale or resale to the public a mobile
				electronic device unless such device is—</text>
							<paragraph id="H6FC294584C4A49C9A93634BBFCCA0660"><enum>(1)</enum><text>equipped with a
				unique identifier (such as a Mobile Equipment Identifier) that allows a
				provider of commercial mobile service or commercial mobile data service to
				identify such device for purposes of complying with subsections (a) and (b);
				and</text>
							</paragraph><paragraph id="H16BFD037DC3241E19569D9BBEA862B24"><enum>(2)</enum><text>configured in such
				a manner that the provider of commercial mobile service or commercial mobile
				data service on the device is able to make available the remote deletion
				capability required by subsection (b).</text>
							</paragraph></subsection><subsection id="H80843FC31ABB4EF9874063BB262E9BCF"><enum>(d)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HA68E4D86C5674BDD997B32DC1FEC36DD"><enum>(1)</enum><header>Commercial
				mobile data service</header><text>The term <term>commercial mobile data
				service</term> has the meaning given such term in section 6001 of the Middle
				Class Tax Relief and Job Creation Act of 2012 (Public Law 112–96).</text>
							</paragraph><paragraph id="HEEE0A3AB831F4A99B181AE44AB2BBF59"><enum>(2)</enum><header>Commercial
				mobile service</header><text display-inline="yes-display-inline">The term
				<term>commercial mobile service</term> has the meaning given such term in
				section 332.</text>
							</paragraph><paragraph id="HF1D29C97CB8E41E6B724C142FCF643B7"><enum>(3)</enum><header>Mobile
				electronic device</header><text>The term <term>mobile electronic device</term>
				means a personal electronic device on which commercial mobile service or
				commercial mobile data service is provided, except that such term does not
				include a device—</text>
								<subparagraph id="HD0FAF0D63EE44F04B14B0F90671888B5"><enum>(A)</enum><text>for which the
				consumer purchases service by paying in advance for a specified amount of
				calling or data usage; or</text>
								</subparagraph><subparagraph id="HC79B03A9D9BB44A7A89FF445181D8D3B"><enum>(B)</enum><text>with respect to
				which the consumer does not have a direct relationship with the provider of
				commercial mobile service or commercial mobile data
				service.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3E3B2D0D8C12435CBFB6CA5FC292B4F8"><enum>(b)</enum><header>Report to
			 FCC</header><text>Not later than 1 year after the date of the enactment of this
			 Act, each provider of commercial mobile service or commercial mobile data
			 service that provides such service on a mobile electronic device shall submit
			 to the Federal Communications Commission a report on—</text>
				<paragraph id="H7025CDD84F2E49FF872FEA2C8060F24C"><enum>(1)</enum><text display-inline="yes-display-inline">the efforts such provider is making in
			 order to be prepared to comply, not later than the effective date described in
			 subsection (c)(1), with the requirements of subsections (a) and (b) of section
			 343 of the Communications Act of 1934, as added by subsection (a) of this
			 section; and</text>
				</paragraph><paragraph id="H7428C4DB54884D978788634AE4D9DEC5"><enum>(2)</enum><text>the progress of
			 such provider toward being prepared to comply with such requirements by such
			 date.</text>
				</paragraph></subsection><subsection id="H265E3B1BBC764051A9ED4B14020D3289"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph id="HA928558EC7454E6ABD191F338B54EB2D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Such section 343
			 shall take effect on the date that is 2 years after the date of the enactment
			 of this Act.</text>
				</paragraph><paragraph id="H3D97B147A3F04DC08B0EC6A57C4C1157"><enum>(2)</enum><header>Devices
			 previously manufactured or imported</header><text>In the case of a mobile
			 electronic device that was manufactured in the United States (or imported into
			 the United States, if such device was manufactured outside the United States)
			 before the date that is 2 years after the date of the enactment of this Act, a
			 provider of commercial mobile service or commercial mobile data service shall
			 only be required to comply with subsections (a) and (b) of such section to the
			 extent technologically feasible.</text>
				</paragraph></subsection><subsection id="H67FF7213E23844F0AE1FCB2B48950EFC"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, a term that is defined in
			 such section 343 shall have the meaning given such term in such section.</text>
