		<section id="HB600FEC7868948F2AC407666F307D5F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Traumatic Brain Injury Act of 2012</short-title></quote> or
			 the <quote><short-title>TBI Act of 2012</short-title></quote>.</text>
		</section><section id="HEF365F68ABE64C02803606F800E53086"><enum>2.</enum><header>Traumatic Brain
			 Injury Act reauthorization</header>
			<subsection id="HAECF768790024F789F47C37EFD8ED470"><enum>(a)</enum><header>Prevention and
			 control of injuries</header>
				<paragraph id="H40C5C5C1C0E74DA887D997F3C07F5195"><enum>(1)</enum><header>Prevention of
			 traumatic brain injury</header><text>Section 393B of the Public Health Service
			 Act (42 U.S.C. 280b–1c) is amended—</text>
					<subparagraph id="H41448957A53149F0882B2305E2B8EC32"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="section" style="OLC">Prevention of
			 traumatic brain injury</header-in-text></quote> and inserting
			 <quote><header-in-text level="section" style="OLC">Preventing, Recognizing, and
			 Responding to traumatic brain injury</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H37D44041E650493FB4043A668C53248A"><enum>(B)</enum><text>in subsection (a),
			 by striking <quote>to reduce the incidence of</quote> and inserting <quote>that
			 help prevent, recognize, and respond to</quote>;</text>
					</subparagraph><subparagraph id="H48466DD569D549F7A84B4460B971AC5A"><enum>(C)</enum><text>in subsection
			 (b)(1), by striking <quote>for the prevention of</quote> and inserting
			 <quote>preventing, recognizing, and responding to</quote>; and</text>
					</subparagraph><subparagraph id="H8B7A42A7AF924B83A87EEF25FC9308A1"><enum>(D)</enum><text>in subsection
			 (b)(3), by striking each place it appears <quote>2010</quote> and inserting
			 <quote>2020</quote>.</text>
					</subparagraph></paragraph><paragraph id="H635F120310A74B2DBB8EF25F96DE86AA"><enum>(2)</enum><header>National program
			 for traumatic brain injury surveillance and registries</header><text>Section
			 393C(b) of such Act (42 U.S.C. 280b–1d(b)) is amended, in the first
			 sentence—</text>
					<subparagraph id="HE616D02897E145E494A48A8AF743201E"><enum>(A)</enum><text>by striking
			 <quote>18 months after the date of enactment of the Traumatic Brain Injury Act
			 of 2008</quote> and inserting <quote>3 years after the date of the enactment of
			 Traumatic Brain Injury Act of 2012</quote>; and</text>
					</subparagraph><subparagraph id="H0BBC857991B24811BA072F5EB08BB045"><enum>(B)</enum><text>by striking
			 <quote>Veterans Affairs, shall submit</quote> and all that follows through the
			 period and inserting <quote>Veterans Affairs, shall submit to the relevant
			 committees of Congress a report on Federal agency collaboration, including
			 collaboration within the Department of Health and Human Service, with respect
			 to collecting and disseminating compatible epidemiological studies on the
			 incidence and prevalence of individuals with traumatic brain injury who were
			 formally in the military and on treatment, prevention, and outreach provided to
			 such individuals. Such report shall include efforts to standardize the clinical
			 definition of traumatic brain injury for use by all Federal
			 agencies.</quote>.</text>
					</subparagraph></paragraph><paragraph id="HB036311C55634E22BB6E6856BAC8CE95"><enum>(3)</enum><header>Study on
			 traumatic brain injury</header><text>Section 393C–1 of such Act (42 U.S.C.
			 280b–1e) is amended—</text>
					<subparagraph id="H5A9EF2E0FB014B64AEC97C860055C909"><enum>(A)</enum><text>in subsection (a),
			 in the matter preceding paragraph (1), by striking <quote>and in
			 consultation</quote> and all that follows through <quote>conduct a
			 study</quote> and inserting <quote>and in consultation with the head of each
			 agency within the Department of Health and Human Services (including the
			 National Institutes of Health), the Veterans Administration, the Department of
			 Defense, the Department of Transportation, the Department of Education, the
			 Department of Labor, and the Department of Housing and Urban Development, and
			 other appropriate entities with respect to paragraphs (2), (3), and (4), may
			 conduct a studies</quote>; and</text>
					</subparagraph><subparagraph id="HFDE9025C7EC2408CA586D742A0D79F83"><enum>(B)</enum><text>in subsection (b),
			 by striking <quote>Traumatic Brain Injury Act of 2008</quote> and inserting
			 <quote>Traumatic Brain Injury Act of 2012</quote>.</text>
					</subparagraph></paragraph><paragraph id="HA0DA2A83856744C391EEB486A4CC9884"><enum>(4)</enum><header>Authorization of
			 appropriations</header><text>Section 394A of such Act (42 U.S.C. 280b–3) is
			 amended by striking <quote>$50,000,000</quote> and all that follows through the
			 period at the end and inserting <quote>such sums as may be necessary for each
			 of the fiscal years 2013 through 2017.</quote>.</text>
				</paragraph></subsection><subsection id="HE82B19C7F01643E2AD2B18CB1AE17C91"><enum>(b)</enum><header>Trauma
			 Care</header>
				<paragraph id="H6F4868EE641C479EA9CD56630B6C8424"><enum>(1)</enum><header>State grants for
			 projects regarding traumatic brain injury</header><text>Section 1252 of such
			 Act (42 U.S.C. 300d–52) is amended—</text>
					<subparagraph id="H1B55DD57CC594CA5B3F6CF628AB88BDB"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="section" style="OLC">projects
			 regarding</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H8C7764E75CC84386A5BE674A23374FEC"><enum>(B)</enum><text>in subsection (a),
			 by striking <quote>for the purposes of carrying out projects</quote>;</text>
					</subparagraph><subparagraph id="H0926F2CA05474AE2B17AB3C66BDF8222"><enum>(C)</enum><text>in subsection
			 (b)(3)—</text>
						<clause id="H7552AABA0ED94A8E87218C7F6201B3FB"><enum>(i)</enum><text>in
			 subparagraph (A)(iii), by inserting <quote>, private,</quote> after
			 <quote>public</quote>; and</text>
						</clause><clause id="HF00B838306084F32AD499DFC1F1F0C5D"><enum>(ii)</enum><text>by
			 adding at the end, after subparagraph (B), the following new sentence:</text>
							<quoted-block display-inline="no-display-inline" id="H300D73537596436E9C068BFBB4F01185" style="OLC">
								<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Such an
				advisory board may include State entities that administer funds provided under
				Federal laws related to individuals with disabilities, including the
				Rehabilitation Act of 1973, the Individuals with Disabilities Education Act,
				the Older Americans Act of 1965, and titles V and XIX of the Social Security
				Act.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H5D454C04C55D420692D8A49D77FB1466"><enum>(D)</enum><text>in subsection (e),
			 by striking <quote>Traumatic Brain Injury Act of 2008</quote> and inserting
			 <quote>Traumatic Brain Injury Act of 2012</quote>;</text>
					</subparagraph><subparagraph id="HFE54C1F771444FE98C4BA61761279DE7"><enum>(E)</enum><text>in subsection
			 (f)(1)(A), by inserting <quote>provide,</quote> after
			 <quote>change,</quote>;</text>
					</subparagraph><subparagraph id="H6EED1262203B4FDEBD40767C57A82612"><enum>(F)</enum><text display-inline="yes-display-inline">by amending subsection (g) to read as
			 follows:</text>
						<quoted-block display-inline="no-display-inline" id="H25BD0713BA6042979221016E10AC4BC1" style="OLC">
							<subsection id="H1AAF9B638242426AB5717B42848471FE"><enum>(g)</enum><header>Coordination of
				activities</header>
								<paragraph id="H4CDECA2F64CE413F8A19F24C32166C9A"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				ensure that activities under this section are—</text>
									<subparagraph id="H814D910F62DC4D0788C8C005B6418936"><enum>(A)</enum><text>coordinated as
				appropriate with other Federal agencies that carry out activities regarding
				traumatic brain injury; and</text>
									</subparagraph><subparagraph id="H0E57F45539584FD18C266F85B306B62B"><enum>(B)</enum><text>are consistent
				with priorities and recommendations obtained from input from appropriate
				stakeholders, including consumers, State and local government agencies,
				professionals, and consumer and professional organizations.</text>
									</subparagraph></paragraph><paragraph id="HC37B66B6A7994B86905AF296579197BA"><enum>(2)</enum><header>National
				plan</header><text display-inline="yes-display-inline">The Secretary, in
				consultation with individuals with traumatic brain injury, families of such
				individuals, State and local government agencies, other Federal agencies,
				appropriate professionals, and consumer and professional organizations, shall,
				not later than the date that is 3 years after the date of the enactment of the
				Traumatic Brain Injury Act of 2012, establish and implement a national plan for
				carrying out the activities under this section in collaboration with other
				appropriate Federal, State, and local agencies. The Secretary shall
				periodically review and revise the plan as
				appropriate.</text>
								</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H0CB71813D23A4513BEE0E8BFEACDF84A"><enum>(G)</enum><text>in subsection (h),
			 by adding at the end the following new sentence: <quote>Such report shall be
			 made available to the public.</quote>;</text>
					</subparagraph><subparagraph id="H10CFD4810C1D4E6C9F3D542A5BEC91CB"><enum>(H)</enum><text>in subsection (j),
			 by striking <quote>2001 through 2005</quote> and all that follows through
			 <quote>2009 through 2012.</quote> and inserting <quote>2012 through
			 2017</quote>; and</text>
					</subparagraph><subparagraph id="HD291001A4BEB46A6A6A65C5A912E2605"><enum>(I)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subsection:</text>
						<quoted-block display-inline="no-display-inline" id="HAB79202588574F21AB3108A27F6EB106" style="OLC">
							<subsection id="HBD48750D82544B73B69C99378BF36274"><enum>(k)</enum><header>Distribution and
				amounts of grants</header><text display-inline="yes-display-inline">For
				purposes of awarding grants under this section with respect to a fiscal year
				2013 or a subsequent fiscal year the following shall apply:</text>
								<paragraph id="H9BB6AE40267647AC879FE9000DC9DF85"><enum>(1)</enum><text>For the period
				beginning with the first such fiscal year for which the total amount
				appropriated for grants under this section is equal to at least such amount
				that would allow for each applicant that would otherwise qualify for a grant
				under this section to receive such a grant in an amount of at least $100,000
				and ending with the first such fiscal year described in paragraph (2), the
				Secretary shall award a grant under this section to each such applicant in
				equal amounts.</text>
								</paragraph><paragraph id="H2B5CB3F6338641DD8C2D61B2356FB497"><enum>(2)</enum><text>Beginning with the
				first such fiscal year for which the total amount appropriated for grants under
				this section is equal to at least such amount that would allow for each
				applicant that would otherwise qualify for a grant under this section to
				receive such a grant in an amount of at least $250,000, the Secretary shall
				award a grant under this section to each such applicant in an amount determined
				according to a formula specified by the Secretary that is based on the
				population of the applicant, with applicants with larger populations receiving
				grants of proportionately greater amounts than applicants with smaller
				populations.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H768BD9C519B6412AB220320F35DAC8DC"><enum>(2)</enum><header>State grants for
			 protection and advocacy services</header><text>Section 1253 of such Act (42
			 U.S.C. 300d–53) is amended—</text>
					<subparagraph id="H54566AA837D747DBA2E22457D0D9B4C6"><enum>(A)</enum><text>subsection (d)(1),
			 by striking <quote>within States</quote>;</text>
					</subparagraph><subparagraph id="H49E96DD92A0E45C88C2F9C58451528E0"><enum>(B)</enum><text>in subsection
			 (e)(1), by striking <quote>a protection and advocacy system within each
			 State</quote> and inserting <quote>each protection and advocacy
			 system</quote>;</text>
					</subparagraph><subparagraph id="H3E7B4705C4824053A01920BBAB5CC0E3"><enum>(C)</enum><text>in subsection (g),
			 by striking <quote>each fiscal year not later than October 1</quote> and
			 inserting <quote>for each fiscal year beginning on October 1</quote>;</text>
					</subparagraph><subparagraph id="H5EEF5D1CA34A4723990E9DBB39D2485F"><enum>(D)</enum><text>in subsection
			 (h)—</text>
						<clause id="H8C9A013C9F97441DBF6E7E4E1B0EE401"><enum>(i)</enum><text>in
			 the heading, by inserting <quote><header-in-text level="subsection" style="OLC">to the Administrator</header-in-text></quote> after
			 <quote><header-in-text level="subsection" style="OLC">Annual
			 report</header-in-text></quote>; and</text>
						</clause><clause id="H46DBD9AA28204044BCC1F973CD75A080"><enum>(ii)</enum><text>by
			 inserting <quote>, in accordance, to the greatest extent practicable, with the
			 uniform model format created under subsection (i),</quote> after <quote>the
			 Administrator</quote>;</text>
						</clause></subparagraph><subparagraph id="H971467ECB3BB4F24A44EEE619E0D0F3A"><enum>(E)</enum><text>by amending
			 subsection (i) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HC22F8B029639427D8A476919ECC88F6C" style="OLC">
							<subsection id="HB6A0E8AC5E15433795454A61F9752D1D"><enum>(i)</enum><header>Uniform format
				for annual reports</header><text display-inline="yes-display-inline">The
				Administrator of the Health Resources and Services Administration and the
				Commissioner of the Administration on Developmental Disabilities shall enter
				into an agreement to create a uniform model format for the annual reports
				submitted under subsection
				(h).</text>
							</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HD11EE73B6ACE497DA568392D02FA1BCB"><enum>(F)</enum><text>in subsection
			 (k)—</text>
						<clause id="H67A48B76AACF4CDE93C7C68D82BFCC53"><enum>(i)</enum><text>in
			 the heading, by striking <quote><header-in-text level="subsection" style="OLC">authority</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">rights and
			 authorities</header-in-text></quote>;</text>
						</clause><clause id="H478DC7148A684CAB8A1B0AA88EAAB33D"><enum>(ii)</enum><text>by
			 inserting <quote>general rights and</quote> after <quote>the
			 same</quote>;</text>
						</clause><clause id="H9A3AD15BD34B4F4383C799F192B57CEE"><enum>(iii)</enum><text>by
			 adding at the end the following new sentence: <quote>Additionally, each
			 protection and advocacy system when providing services shall have access to
			 medical centers of the Department of Veterans Affairs and other related
			 treatment facilities, both inpatient and outpatient, and residential facilities
			 to provide training to residents and staff, advocate for clients, provide
			 information and referrals to residents, work with residents on discharge
			 planning, and monitor and investigate conditions and treatment.</quote>;</text>
						</clause></subparagraph><subparagraph id="H70372870DAD84494ADE185F1F6924139"><enum>(G)</enum><text>in subsection (l),
			 by striking each of <quote>2001</quote> and <quote>2009 through 2012</quote>
			 and inserting <quote>2013</quote> and <quote>2014 through 2017</quote>,
			 respectively; and</text>
					</subparagraph><subparagraph id="HACDA5263AE2E49889D5E96F5B4056E74"><enum>(H)</enum><text display-inline="yes-display-inline">in subsection (m)—</text>
						<clause id="HD3979AA29C3A4D539D5641B5F17D4AA3"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>Developmental Disabilities Assistance Bill of Rights Act (42 U.S.C. 6042
			 et seq.)</quote> and inserting <quote>Developmental Disabilities Assistance and
			 Bill of Rights Act of 2000 (42 U.S.C. 15041 et seq.)</quote>; and</text>
						</clause><clause id="HAEBBDA4575814D16998613AE179E078A"><enum>(ii)</enum><text>in
			 paragraph (2), by striking <quote>Developmental Disabilities Assistance and
			 Bill of Rights Act (42 U.S.C. 6042 et seq.)</quote> and inserting
			 <quote>Developmental Disabilities Assistance and Bill of Rights Act of 2000 (42
			 U.S.C. 15041 et seq.)</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="HB0F327B58419490391DAB8C2FAA4C3C6"><enum>(3)</enum><header>Interagency
			 program for trauma research</header><text>Section 1261 of such Act (42 U.S.C.
			 300d–61) is amended—</text>
					<subparagraph id="H48D626EB31CC49ABBA75DA857DB9BE2E"><enum>(A)</enum><text>in subsection
			 (d)(4)—</text>
						<clause id="HBBC60DFC7BC942F89E02438A636D66C0"><enum>(i)</enum><text>in
			 subparagraph (D), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="H85D057EF00A546288F95C9BCFF45241C"><enum>(ii)</enum><text>by
			 redesignating subparagraph (E) as subparagraph (F);</text>
						</clause><clause id="HEBC3075B4E204AAB9F9EFDB0A548735A"><enum>(iii)</enum><text>in
			 subparagraph (F), as redesignated by clause (ii), by striking <quote>through
			 (D)</quote> and inserting <quote>through (E)</quote>; and</text>
						</clause><clause id="H47B314BF813E430B84EB47FF71D3FE83"><enum>(iv)</enum><text>by
			 inserting after subparagraph (D), the following new subparagraph:</text>

				needs of children and youth with traumatic brain injury with regard to
				identification, diagnosis, and treatment of traumatic brain injury, transition
				to home and community, and short-term and long-term outcomes;
				and</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HBE26FA389C774AF499432194CED73CDB"><enum>(B)</enum><text>in subsection (i),
			 by striking <quote>2012</quote> and inserting <quote>2017</quote>.</text>
