		<section id="HB5764675064C4CE291A61C0555FDCAB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote>Kadyn’s
			 Act</quote>.</text>
		</section><section id="H0CC0AD8C0B85468B967B090B9BD2909E"><enum>2.</enum><header>Withholding
			 apportionments for noncompliance with school bus passings</header>
			<subsection id="H5B6E1926F17F4D688EB84F653387B911"><enum>(a)</enum><header>Withholding
			 apportionments</header><text display-inline="yes-display-inline">Chapter 1 of
			 title 23 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HACF0795FC7A24B4196DA66209BB52FA2" style="USC">
					<section id="H9EEF4961A1BB4D5F9F64E650F64C9104"><enum>167.</enum><header>Withholding
				apportionments for noncompliance with school bus passings</header>
						<subsection id="H8703495FA2274D76808F503E0B9D8E48"><enum>(a)</enum><header>Withholding of
				apportionments for noncompliance</header>
							<paragraph id="HEC5CD11C588340C59147FFB824251F99"><enum>(1)</enum><header>Withholding</header><text>The
				Secretary shall withhold 10 percent of the amount required to be apportioned to
				any State under paragraphs (1), (3), and (4) of section 104(b) on October 1,
				2014, and on each October 1 thereafter if the State does not meet the
				requirements of paragraph (2).</text>
							</paragraph><paragraph id="H35F35EF6D7804D158BC985EFACD60ABC"><enum>(2)</enum><header>Requirement</header><text>A
				State meets the requirements of this paragraph if the State has enacted and is
				enforcing a law that imposes the following penalties to a motorist who is found
				guilty of illegally passing a stopped school bus:</text>
								<subparagraph id="HBD0727CBD65C4818A342C09441D7B289"><enum>(A)</enum><header>First
				offense</header><text>For a first offense, a fine of not less than $250 with
				the possibility of jail time and license suspension.</text>
								</subparagraph><subparagraph id="H9946EAA1BFCF476083C32536214D34CB"><enum>(B)</enum><header>Second offense
				within a 5-year period of a first offense</header><text>For a second offense
				within a 5-year period of a first offense, a fine of not less than $315 with
				the possibility of jail time and license suspension.</text>
								</subparagraph></paragraph></subsection><subsection id="HA05FEBB856DB427DADBC3ED7A86AAE21"><enum>(b)</enum><header>Period of
				availability; effect of compliance and noncompliance</header>
							<paragraph id="H4DAAB1F60AC34D50BD479009C3992247"><enum>(1)</enum><header>Period of
				availability of withheld funds</header>
								<subparagraph id="H301724B9D15F44F48191C81003CF2EC3"><enum>(A)</enum><header>Funds withheld
				on or before September 30, 2015</header><text>Any funds withheld under
				subsection (a) from apportionment to any State on or before September 30, 2015,
				shall remain available until the end of the third fiscal year following the
				fiscal year for which the funds are authorized to be appropriated.</text>
								</subparagraph><subparagraph id="H8EC0D6F7D33F47A885ADF267F3633B84"><enum>(B)</enum><header>Funds withheld
				after September 30, 2015</header><text>No funds withheld under this section
				from apportionment to any State after September 30, 2015, shall be available
				for apportionment to the State.</text>
								</subparagraph></paragraph><paragraph id="H39601673B9D846A2A26A269F6AB56D90"><enum>(2)</enum><header>Apportionment of
				withheld funds after compliance</header><text>If, before the last day of the
				period for which funds withheld under subsection (a) from apportionment are to
				remain available for apportionment to a State under paragraph (1), the State
				meets the requirement of subsection (a)(2), the Secretary shall, on the first
				day on which the State meets the requirement, apportion to the State the funds
				withheld under subsection (a) that remain available for apportionment to the
				State.</text>
							</paragraph><paragraph id="HEBF651E758F345F59F5E6D24D1985B34"><enum>(3)</enum><header>Period of
				availability of subsequently Apportioned funds</header><text>Any funds
				apportioned pursuant to paragraph (2) shall remain available for expenditure
				until the end of the third fiscal year following the fiscal year in which the
				funds are so apportioned. Sums not obligated at the end of that period shall
				lapse.</text>
							</paragraph><paragraph id="H632C404D5B044F469CE53BE28DDF772E"><enum>(4)</enum><header>Effect of
				noncompliance</header><text>If, at the end of the period for which funds
				withheld under subsection (a) from apportionment are available for
				apportionment to a State under paragraph (1), the State does not meet the
				requirement of subsection (a)(2), the funds shall
				lapse.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEE1E2914ED6B47E1929F467AC6D749F5"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for chapter 1 of title 23, United States
			 Code, is amended by adding at the end the following:</text>
