		<legis-type>A BILL</legis-type>
		<official-title>To amend section 552 of title 5, United States Code
		  (popularly referred to as the Freedom of Information Act), to provide that the
		  exemptions to that section shall not apply to matters relating to certain
		  transactions executed by an instrumentality of the Federal Government operating
		  in a commercial manner.</official-title>

		<section id="H1CDF3E2D3119401583529077941BA7C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Restoring Essential Safeguards for a
			 Transparent, Open, and Reliable Executive under FOIA
			 Act</short-title></quote>.</text>
		</section><section id="H98BCBDD2035547878C8AE6577325C364" section-type="subsequent-section"><enum>2.</enum><header>Exclusion of certain
			 matters from coverage under Freedom of Information Act exemptions</header><text display-inline="no-display-inline">Section 552 of title 5, United States Code,
			 is amended—</text>
			<paragraph id="H38F7C0088E61459699A0D4692E4E331E"><enum>(1)</enum><text>in subsection (b),
			 by striking <quote>This section</quote> and inserting <quote>Subject to
			 subsection (m), this section</quote>; and</text>
			</paragraph><paragraph id="H79D5851E7A56403CAE1423A0DCF67513"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H2C973E726DD54C72B8AB8F1708880EB7" style="USC">
					<subsection id="HF75F7ACF58104F8E969AD84BCDD6B0B2"><enum>(m)</enum><header>Special rule
				relating to Federal instrumentalities operating in commercial
				manner</header><paragraph commented="no" display-inline="yes-display-inline" id="H253A99CE41E84053B7326CA611FF6992"><enum>(1)</enum><text>Notwithstanding
				subsection (b), in the case of any instrumentality described in paragraph (2),
				this section shall apply to matters that are exempt under subsection (b) if the
				matters are related to a transaction described in paragraph (2).</text>
						</paragraph><paragraph id="HF57332A7D13A4377A7475191C8397475" indent="up1"><enum>(2)</enum><text>An instrumentality described in this
				paragraph is any instrumentality of the Federal Government (or its employees or
				agents) executing authority of the Federal Government in any
				transaction—</text>
							<subparagraph id="HA7560217687B4020ADCA79567401C61E"><enum>(A)</enum><text>which results in the United States
				owning, subscribing to, or otherwise having any interest in the stock or equity
				of any company, association, or corporation, except for any investments through
				any pension funds; or</text>
							</subparagraph><subparagraph id="H5A7E29E80127451F8BD88EEDB74F9D67"><enum>(B)</enum><text>in which the instrumentality or its
				employees or agents execute authority of the Federal Government’s interests in
				owning, subscribing to, or otherwise having any interest in the stock or equity
				of any company, association, or
				corporation.</text>
