		<section id="H835B7F64F03D4078BB1ED0447F02112E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Strengthening and Focusing Enforcement
			 to Deter Organized Stealing and Enhance Safety Act of
			 2012</short-title></quote> or the <quote><short-title>SAFE
			 DOSES Act</short-title></quote>.</text>
		</section><section id="H166AA818F1174130B4188C3C7CE2C8A1"><enum>2.</enum><header>Theft of medical
			 products</header>
			<subsection id="HDEE2B628A3B641D195011861841D65B6"><enum>(a)</enum><header>Prohibited
			 conduct and penalties</header><text>Chapter 31 of title 18, United States Code,
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF5B036D824E9483CB190F1CCFD1C2FCD" style="USC">
					<section id="H0C3FB2619EA7487482C2B316E6610979"><enum>670.</enum><header>Theft of
				medical products</header>
						<subsection id="HF383E9B0F89C472B841166BC78B67B0D"><enum>(a)</enum><header>Prohibited
				conduct</header><text display-inline="yes-display-inline">Whoever, in, or using
				any means or facility of, interstate or foreign commerce—</text>
							<paragraph id="H7A7B03FE9CB1439588B5CCC17E4228C5"><enum>(1)</enum><text display-inline="yes-display-inline">embezzles, steals, or by fraud or deception
				obtains, or knowingly and unlawfully takes, carries away, or conceals a
				pre-retail medical product;</text>
							</paragraph><paragraph id="H703AA3CDDA184AE2B4D1469D65C47EEB"><enum>(2)</enum><text display-inline="yes-display-inline">knowingly and falsely makes, alters,
				forges, or counterfeits the labeling or documentation (including documentation
				relating to origination or shipping) of a pre-retail medical product;</text>
							</paragraph><paragraph id="H9BEE14372F764861B3602BE742763621"><enum>(3)</enum><text>knowingly
				possesses, transports, or traffics in a pre-retail medical product that was
				involved in a violation of paragraph (1) or (2);</text>
							</paragraph><paragraph id="H480CB16466E041CCAC384C87467148C7"><enum>(4)</enum><text>with intent to
				defraud, buys, or otherwise obtains, a pre-retail medical product that has
				expired or been stolen;</text>
							</paragraph><paragraph id="H652A6A7113FD4F34B3026D4C55ABBB2C"><enum>(5)</enum><text>with intent to
				defraud, sells, or distributes, a pre-retail medical product that is expired or
				stolen; or</text>
							</paragraph><paragraph id="H5D8E25919B6746A1B800F9C0B076A835"><enum>(6)</enum><text>attempts or
				conspires to violate any of paragraphs (1) through (5);</text>
							</paragraph><continuation-text continuation-text-level="subsection">shall be
				punished as provided in subsection (c) and subject to the other sanctions
				provided in this section.</continuation-text></subsection><subsection id="HE008170252AD435EAB83A94325B1F46B"><enum>(b)</enum><header>Aggravated
				offenses</header><text display-inline="yes-display-inline">An offense under
				this section is an aggravated offense if—</text>
							<paragraph id="HF1032DFDA4094B81A265C88F4B31E860"><enum>(1)</enum><text>the defendant is
				employed by, or is an agent of, an organization in the supply chain for the
				pre-retail medical product; or</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HBB3A07112229425887C54BBE1D0ED596"><enum>(2)</enum><text>the
				violation—</text>
								<subparagraph id="HEC6C7DE4C6424B66B0FC49BC9CC1C44D"><enum>(A)</enum><text>involves the use
				of violence, force, or a threat of violence or force;</text>
								</subparagraph><subparagraph id="H32C0E960F9994DF39470606ACD2F03A6"><enum>(B)</enum><text>involves the use
				of a deadly weapon;</text>
								</subparagraph><subparagraph id="HA6F7D9072ED64624928095D573BF2736"><enum>(C)</enum><text>results in serious
				bodily injury or death, including serious bodily injury or death resulting from
				the use of the medical product involved; or</text>
								</subparagraph><subparagraph id="HE2E3D13DE0DC4351A54EA41B60B47BB7"><enum>(D)</enum><text>is subsequent to a
				prior conviction for an offense under this section.</text>
								</subparagraph></paragraph></subsection><subsection id="HC2E165D7BEEE49EF9F0ACC417B895AA5"><enum>(c)</enum><header>Criminal
				penalties</header><text>Whoever violates subsection (a)—</text>
							<paragraph id="HC0661E47E006421084FB4DA1429CAC0F"><enum>(1)</enum><text>if the offense is
				an aggravated offense under subsection (b)(2)(C), shall be fined under this
				title or imprisoned not more than 30 years, or both;</text>
							</paragraph><paragraph id="HF901CB2EE1544514905771700A98ECD1"><enum>(2)</enum><text>if the value of
				the medical products involved in the offense is $5,000 or greater, shall be
				fined under this title, imprisoned for not more than 15 years, or both, but if
				the offense is an aggravated offense other than one under subsection (b)(2)(C),
				the maximum term of imprisonment is 20 years; and</text>
							</paragraph><paragraph id="H7470F0FFDF7F4ABB95D032191B55F10D"><enum>(3)</enum><text display-inline="yes-display-inline">in any other case, shall be fined under
				this title, imprisoned for not more than 3 years, or both, but if the offense
				is an aggravated offense other than one under subsection (b)(2)(C), the maximum
				term of imprisonment is 5 years.</text>
							</paragraph></subsection><subsection id="H7B6A5F17D3B14141A4BEAC692125BF90"><enum>(d)</enum><header>Civil
				penalties</header><text display-inline="yes-display-inline">Whoever violates
				subsection (a) is subject to a civil penalty in an amount not more than the
				greater of—</text>
							<paragraph id="H13BA384465884C83AB9007B4940B60B8"><enum>(1)</enum><text>three times the
				economic loss attributable to the violation; or</text>
							</paragraph><paragraph id="HDEB904CC50CE493BB397E6B118DE6AC5"><enum>(2)</enum><text>$1,000,000.</text>
							</paragraph></subsection><subsection id="H4564ECB6F984479787B729F6CF7E82F4"><enum>(e)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="H5B34F6E726984EE4BB621158E9ABC268"><enum>(1)</enum><text>the term
				<term>pre-retail medical product</term> means a medical product that has not
				yet been made available for retail purchase by a consumer;</text>
							</paragraph><paragraph id="HCCB393BA17DF4C53905A87E2B8E03137"><enum>(2)</enum><text>the term
				<quote>medical product</quote> means a drug, biological product, device,
				medical food, or infant formula;</text>
							</paragraph><paragraph id="H33383034F7C148C0B6870833CC51DB2A"><enum>(3)</enum><text>the terms
				<term>device</term>, <term>drug</term>, <term>infant formula</term>, and
				<term>labeling</term> have, respectively, the meanings given those terms in
				section 201 of the Federal Food, Drug, and Cosmetic Act;</text>
							</paragraph><paragraph id="H5432B3493FF94C7C8D402541F76869AA"><enum>(4)</enum><text>the term
				<term>biological product</term> has the meaning given the term in section 351
				of the Public Health Service Act;</text>
							</paragraph><paragraph id="H50DFB35F3B60477CBD8B06C068335662"><enum>(5)</enum><text>the term
				<term>medical food</term> has the meaning given the term in section 5(b) of the
				Orphan Drug Act; and</text>
							</paragraph><paragraph id="HCB084725920B487A8A551E92F8635CF2"><enum>(6)</enum><text>the term
				<quote>supply chain</quote> includes manufacturer, wholesaler, repacker,
				own-labeled distributor, private-label distributor, jobber, broker, drug
				trader, transportation company, hospital, pharmacy, or security
				company.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4CF62E723DCC467081973CA9D4006F61"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 31 of
			 title 18, United States Code, is amended by adding after the item relating to
			 section 669 the following:</text>

			</subsection></section><section id="H7CA4A46E4912473889D2E78912E692EA"><enum>3.</enum><header>Civil
			 forfeiture</header><text display-inline="no-display-inline">Section
			 981(a)(1)(C) of title 18, United States Code, is amended by inserting
			 <quote>670,</quote> after <quote>657,</quote>.</text>
		</section><section id="H32B29F5C7007406F9F67B56FA0287437"><enum>4.</enum><header>Penalties for
			 theft-related offenses</header>
			<subsection id="H7D8DC38360C2478C97767E17A80F0AAE"><enum>(a)</enum><header>Interstate or
			 foreign shipments by carrier</header><text>Section 659 of title 18, United
			 States Code, is amended by adding at the end of the fifth undesignated
			 paragraph the following: <quote>If the offense involves a pre-retail medical
			 product (as defined in section 670), it shall be punished under section 670
			 unless the penalties provided for under this section are
			 greater.</quote>.</text>
			</subsection><subsection id="HE352EB4195984DE3887705F35F7B6502"><enum>(b)</enum><header>Racketeering</header>
				<paragraph id="H5A0E6CAAA5164D039175BBDAF6ED9825"><enum>(1)</enum><header>Travel Act
			 Violations</header><text>Section 1952 of title 18, United States Code, is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE52B9803DDBF47A3A282DF3F556B89FF" style="USC">
						<subsection id="H3AF21F2E368D4C56963EDC071AA921FC"><enum>(d)</enum><text display-inline="yes-display-inline">If the offense under this section involves
				an act described in paragraph (1) or (3) of subsection (a) and also involves a
				pre-retail medical product (as defined in section 670), the punishment for the
				offense shall be the same as the punishment for an offense under section 670
				unless the punishment under subsection (a) is
				greater.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE74AE6AE2F7D4D6180E621F61DDCCACD"><enum>(2)</enum><header>Money
			 Laundering</header><text>Section 1957(b)(1) of title 18, United States Code, is
			 amended by adding at the end the following: <quote>If the offense involves a
			 pre-retail medical product (as defined in section 670) the punishment for the
			 offense shall be the same as the punishment for an offense under section 670
			 unless the punishment under this subsection is greater.</quote>.</text>
				</paragraph></subsection><subsection id="HAD5965FD943C44489228E766BB3C415B"><enum>(c)</enum><header>Breaking or
			 entering carrier facilities</header><text display-inline="yes-display-inline">Section 2117 of title 18, United States
			 Code, is amended by adding at the end of the first undesignated paragraph the
			 following: <quote>If the offense involves a pre-retail medical product (as
			 defined in section 670) the punishment for the offense shall be the same as the
			 punishment for an offense under section 670 unless the punishment under this
			 section is greater.</quote>.</text>
			</subsection><subsection id="HF28671280416482686C19B7BEBECF202"><enum>(d)</enum><header>Stolen
			 property</header>
				<paragraph id="HA44572E1B5A54D5897F7C60112400372"><enum>(1)</enum><header>Transportation
			 of stolen goods and related offenses</header><text display-inline="yes-display-inline">Section 2314 of title 18, United States
			 Code, is amended by adding at the end of the sixth undesignated paragraph the
			 following: <quote>If the offense involves a pre-retail medical product (as
			 defined in section 670) the punishment for the offense shall be the same as the
			 punishment for an offense under section 670 unless the punishment under this
			 section is greater.</quote>.</text>
				</paragraph><paragraph id="HF82FBE028C574729ABA904F2C5823618"><enum>(2)</enum><header>Sale or receipt
			 of stolen goods and related offenses</header><text display-inline="yes-display-inline">Section 2315 of title 18, United States
			 Code, is amended by adding at the end of the fourth undesignated paragraph the
			 following: <quote>If the offense involves a pre-retail medical product (as
			 defined in section 670) the punishment for the offense shall be the same as the
			 punishment for an offense under section 670 unless the punishment under this
			 section is greater.</quote>.</text>
				</paragraph></subsection><subsection id="H10C344A34B6342B396A2E623ED143E94"><enum>(e)</enum><header>Priority given
			 to certain investigations and prosecutions</header><text display-inline="yes-display-inline">The Attorney General shall give increased
			 priority to efforts to investigate and prosecute offenses under section 670 of
			 title 18, United States Code, that involve pre-retail medical products.</text>
			</subsection></section><section id="HC91265F58C6A46E5A5F47F570EC5131E"><enum>5.</enum><header>Amendment to
			 extend wiretapping authority to new offense</header><text display-inline="no-display-inline">Section 2516(1) of title 18, United States
			 Code, is amended—</text>
			<paragraph id="HCB9C96073D2D4B7EAD10DF94BFAA4C3F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (s) as paragraph
			 (t);</text>
			</paragraph><paragraph id="H943CB9D1D448492E969FF680BC7AEB99"><enum>(2)</enum><text>by striking
			 <quote>or</quote> at the end of paragraph (r); and</text>
			</paragraph><paragraph id="HC6580E0FA5E34B5FB2E15FEE092B058F"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (r) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HC05BD51D3F304E85B71A686564601985" style="OLC">
					<subsection id="H79E88FC462A9490196364CF8BFF95905" indent="down1"><enum>(s)</enum><text display-inline="yes-display-inline">any violation of section 670 (relating to
				theft of medical products);
				or</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H71621BC36BDE4C4DAF8718B3572C2478"><enum>6.</enum><header>Required
			 restitution</header><text display-inline="no-display-inline">Section
			 3663A(c)(1)(A) of title 18, United States Code, is amended—</text>
			<paragraph id="H175EBDC13B164A2398AF48212F7861F5"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii), by striking
			 <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="H1B0A1DCD046C453DAA46F15C638C797B"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iii), by striking
			 <quote>and</quote> at the end and inserting <quote>or</quote>; and</text>
			</paragraph><paragraph id="HE88FCB83FE7F4B7C9FA81A6AB148C13E"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF386063F911D4A3D9A0660C706CA6CFE" style="OLC">
					<clause id="H6798E452E7BE4E03B5B0708D9A568E48" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">an offense under section 670 (relating to
				theft of medical products);
				and</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HE6220386F86C4AB69977A689E3C2C3DA"><enum>7.</enum><header>Directive to
			 United States Sentencing Commission</header>
			<subsection id="H4E1EC5074D214D05B97FFF3D6D14595B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Pursuant to its
			 authority under section 994 of title 28, United States Code, and in accordance
			 with this section, the United States Sentencing Commission shall review and, if
			 appropriate, amend the Federal sentencing guidelines and policy statements
			 applicable to persons convicted of offenses under section 670 of title 18,
			 United States Code, as added by this Act, section 2118 of title 18, United
			 States Code, or any another section of title 18, United States Code, amended by
			 this Act, to reflect the intent of Congress that penalties for such offenses be
			 sufficient to deter and punish such offenses, and appropriately account for the
			 actual harm to the public from these offenses.</text>
			</subsection><subsection id="H4764213E9CFC47C6A3B433BDCC8123DF"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this section, the United
			 States Sentencing Commission shall—</text>
				<paragraph id="HA746B7939FBB4FF5B456015FD60915C7"><enum>(1)</enum><text>consider the
			 extent to which the Federal sentencing guidelines and policy statements
			 appropriately reflect—</text>
					<subparagraph id="HBE6C1C7339F84E8790C489F3F13F3994"><enum>(A)</enum><text>the serious nature
			 of such offenses;</text>
					</subparagraph><subparagraph id="HD91641A7EB6345A09BBAB8D8EBFF0F58"><enum>(B)</enum><text>the incidence of
			 such offenses; and</text>
					</subparagraph><subparagraph id="HE2D166674CA644EF89501EC0889CA062"><enum>(C)</enum><text>the need for an
			 effective deterrent and appropriate punishment to prevent such offenses;</text>
					</subparagraph></paragraph><paragraph id="H68E61840C781450A94F0771B1B2C25A6"><enum>(2)</enum><text>consider
			 establishing a minimum offense level under the Federal sentencing guidelines
			 and policy statements for offenses covered by this Act;</text>
				</paragraph><paragraph id="HB258AB72C1524EF6BDB68AA93A56CA47"><enum>(3)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="H9BB1427DD91A4226A309DD1FC71EEFD0"><enum>(4)</enum><text>ensure reasonable
			 consistency with other relevant directives, Federal sentencing guidelines and
			 policy statements;</text>
				</paragraph><paragraph id="H0A5BE89E65CA4E9AA5BF3D58B3A0FF42"><enum>(5)</enum><text>make any necessary
			 conforming changes to the Federal sentencing guidelines and policy statements;
			 and</text>
				</paragraph><paragraph id="HF373031E202A4E438F904405994879B6"><enum>(6)</enum><text>ensure that the
			 Federal sentencing guidelines and policy statements adequately meet the
			 purposes of sentencing set forth in section 3553(a)(2) of title 18, United
			 States Code.</text>
				</paragraph></subsection></section></legis-body>
