		<official-title display="yes">To prevent the introduction into commerce
		  of unsafe drywall, to ensure the manufacturer of drywall is readily
		  identifiable, to ensure that problematic drywall removed from homes is not
		  reused, and for other purposes.</official-title>

		<section id="HF83DC4F74B5941FC830A5AB969BA5DC1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Drywall Safety Act of
			 2012</short-title></quote>.</text>
		</section><section id="H54E3601AA17B450FBEEB8B8681212AC0"><enum>2.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
			<paragraph id="H7D9920113DBB44D1A0D35B337EEFE221"><enum>(1)</enum><text>the Secretary of
			 Commerce should insist that the Government of the People’s Republic of China,
			 which has ownership interests in the companies that manufactured and exported
			 problematic drywall to the United States, facilitate a meeting between the
			 companies and representatives of the United States Government on remedying
			 homeowners that have problematic drywall in their homes; and</text>
			</paragraph><paragraph id="H9B69E9FBCD6E49BC89CC211C9A92ABCA"><enum>(2)</enum><text>the Secretary of
			 Commerce should insist that the Government of the People’s Republic of China
			 direct the companies that manufactured and exported problematic drywall to
			 submit to jurisdiction in United States Federal Courts and comply with any
			 decisions issued by the Courts for homeowners with problematic drywall.</text>
			</paragraph></section><section id="H79816A196AC44D5ABA9E7914B9D26945"><enum>3.</enum><header>Drywall labeling
			 requirement</header>
			<subsection id="H4EB3D1588BB54405A1B3F474F4E78B03"><enum>(a)</enum><header>Labeling
			 requirement</header><text display-inline="yes-display-inline">Except as
			 provided in subsection (b), not later than one year after the date of enactment
			 of this Act, the Consumer Product Safety Commission shall promulgate a final
			 rule under section 14(c) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063(c)</external-xref>)
			 requiring that each sheet of drywall manufactured or imported for use in the
			 United States be permanently marked with the name of the manufacturer and the
			 month and year of manufacture.</text>
			</subsection><subsection id="H282420E85F1F49ACABFE8A7E9800C540"><enum>(b)</enum><header>Exception</header>
				<paragraph id="H4291DEBAD40E4513A374868EE64348B7"><enum>(1)</enum><header>Voluntary
			 standard</header><text>Subsection (a) shall not apply if the Consumer Product
			 Safety Commission determines that—</text>
					<subparagraph id="H98A8F0CBBECF45698022FC0018017520"><enum>(A)</enum><text>a voluntary
			 standard pertaining to drywall manufactured or imported for use in the United
			 States is adequate to permit the identification of the manufacturer of such
			 drywall and the month and year of manufacture; and</text>
					</subparagraph><subparagraph id="H91BE1BA551AC42309AA6E1050438CB38"><enum>(B)</enum><text>such voluntary
			 standard is or will be in effect not later than 2 years after the date of
			 enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="HB1704BC147874EE1A1E0D41E62255BBB"><enum>(2)</enum><header>Federal
			 Register</header><text>Any determination made under paragraph (1) shall be
			 published in the Federal Register.</text>
				</paragraph></subsection><subsection id="HF533E742B5F5444A8FE6C53CCE910D1A"><enum>(c)</enum><header>Treatment of
			 voluntary standard for purposes of enforcement</header><text>Except as provided
			 in subsection (d), if the Commission determines that a voluntary standard meets
			 the conditions under subsection (b)(1), then the labeling requirement of that
			 standard shall be enforceable as a Commission rule promulgated under section
			 14(c) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063(c)</external-xref>) beginning on the
			 date that is the later of—</text>
				<paragraph id="H1287AD17345B4A3D8EB2F8463A88DD00"><enum>(1)</enum><text>180 days after
			 publication of the determination under subsection (b); or</text>
				</paragraph><paragraph id="HE116B09477484D7D89F08C5D1D7ED64B"><enum>(2)</enum><text>the effective date
			 contained in the voluntary standard.</text>
				</paragraph></subsection><subsection id="HCB35B4D0A4384F1BA30785E48D4638D1"><enum>(d)</enum><header>Revision of
			 voluntary standard</header><text display-inline="yes-display-inline">If the
			 labeling requirement of a voluntary standard that met the conditions of
			 subsection (b)(1) is subsequently revised, the organization responsible for the
			 standard shall notify the Commission no later than 60 days after final approval
			 of the revision. The labeling requirement of the revised voluntary standard
			 shall become enforceable as a Commission rule promulgated under section 14(c)
			 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063(c)</external-xref>), in lieu of the
			 prior version, effective 180 days after the Commission is notified of the
			 revision (or such later date the Commission may specify), unless within 90 days
			 after receiving that notice the Commission determines that the labeling
			 requirement of the revised voluntary standard does not meet the requirements of
			 subsection (b)(1)(A), in which case the Commission shall continue to enforce
			 the prior version.</text>
			</subsection></section><section id="HE1E9262C57414F24AF62766288C6E54C"><enum>4.</enum><header>Sulfur content in
			 drywall standard</header>
			<subsection id="HA8868027EA4D4CB38D7F97AB63E39B83"><enum>(a)</enum><header>Rule on sulfur
			 content in drywall required</header><text display-inline="yes-display-inline">Except as provided in subsection (c), not
			 later than 1 year after the date of enactment of this Act, the Consumer Product
			 Safety Commission shall promulgate a final rule pertaining to drywall
			 manufactured or imported for use in the United States that limits sulfur
			 content to a level not associated with elevated rates of corrosion in the
			 home.</text>
			</subsection><subsection id="HB0372875A16E41C6A4903BD7F02FF0F3"><enum>(b)</enum><header>Rule making;
			 consumer product safety standard</header><text>A rule under subsection
			 (a)—</text>
				<paragraph id="H8F50EE4121314B67B33C6E82546649FB"><enum>(1)</enum><text>shall be
			 promulgated in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/5/553">section
			 553</external-xref> of title 5, United States Code; and</text>
				</paragraph><paragraph commented="no" id="HE7F1ED896B814B04A9C2023D7A2954AB"><enum>(2)</enum><text display-inline="yes-display-inline">shall be treated as a consumer product
			 safety rule promulgated under section 9 of the Consumer Product Safety Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C.
			 2058</external-xref>).</text>
				</paragraph></subsection><subsection id="HCD89ECCFAB4C4CEA88CA75C64571DB7F"><enum>(c)</enum><header>Exception</header>
				<paragraph id="HBBA116A0A28E4CA39EA9F79F1D8FD933"><enum>(1)</enum><header>Voluntary
			 standard</header><text display-inline="yes-display-inline">Subsection (a) shall
			 not apply if the Commission determines that—</text>
					<subparagraph id="H9ABE39E1E467402F8222C22E87F3A3CB"><enum>(A)</enum><text display-inline="yes-display-inline">a voluntary standard pertaining to drywall
			 manufactured or imported for use in the United States limits sulfur content to
			 a level not associated with elevated rates of corrosion in the home; and</text>
					</subparagraph><subparagraph id="H08E705ADAF194DE6B85EA80F6855F254"><enum>(B)</enum><text>such voluntary
			 standard is or will be in effect not later than two years after the date of
			 enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="H89C822BC690A47EBBDF07997DD1056AE"><enum>(2)</enum><header>Federal
			 Register</header><text>Any determination made under paragraph (1) shall be
			 published in the Federal Register.</text>
				</paragraph></subsection><subsection id="HCCC39A4C8F76473AAE4603B956B2E8B7"><enum>(d)</enum><header>Treatment of
			 Voluntary Standard for Purposes of Enforcement</header><text>If the Commission
			 determines that a voluntary standard meets the conditions in subsection (c)(1),
			 the sulfur content limit in such voluntary standard shall be treated as a
			 consumer product safety rule promulgated under section 9 of the Consumer
			 Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>) beginning on the
			 date that is the later of—</text>
				<paragraph id="HFB2F0596D594481CA4F62E1F4DCD2293"><enum>(1)</enum><text>180 days after
			 publication of the Commission’s determination under subsection (c); or</text>
				</paragraph><paragraph id="H50D795D462184EE58F3732CF77860B85"><enum>(2)</enum><text>the effective date
			 contained in the voluntary standard.</text>
				</paragraph></subsection><subsection id="HE1B9632E94DB4600AFE1B0CF742F1A05"><enum>(e)</enum><header>Revision of
			 voluntary standard</header><text display-inline="yes-display-inline">If the
			 sulfur content limit of a voluntary standard that met the conditions of
			 subsection (c)(1) is subsequently revised, the organization responsible for the
			 standard shall notify the Commission no later than 60 days after final approval
			 of the revision. The sulfur content limit of the revised voluntary standard
			 shall become enforceable as a Commission rule promulgated under section 9 of
			 the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>), in lieu of the
			 prior version, effective 180 days after the Commission is notified of the
			 revision (or such later date as the Commission may specify), unless within 90
			 days after receiving that notice the Commission determines that the sulfur
			 content limit of the revised voluntary standard does not meet the requirements
			 of subsection (c)(1)(A), in which case the Commission shall continue to enforce
			 the prior version.</text>
			</subsection><subsection id="H8FF1DCBADA234185B940D8B0F1B02FAB"><enum>(f)</enum><header>Future
			 rulemaking</header><text>Notwithstanding any other provision of this Act, the
			 Commission, at any time subsequent to publication of the consumer product
			 safety rule required by subsection (a) or a determination under subsection (c),
			 may initiate a rulemaking in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/5/553">section
			 553</external-xref> of title 5, United States Code, to reduce the sulfur
			 content limit or to include any provision relating to the composition or
			 characteristics of drywall that the Commission determines is reasonably
			 necessary to protect public health or safety. Any rule promulgated under this
			 subsection shall be treated as a consumer product safety rule promulgated under
			 section 9 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>).</text>
			</subsection></section><section id="HC1D3DFDABB3844F989D9CE599DD38EC0"><enum>5.</enum><header>Revision of
			 remediation guidance for drywall disposal required</header><text display-inline="no-display-inline">Not
			 later than 120 days after the date of enactment of this Act, the Consumer
			 Product Safety Commission shall revise its <quote>Remediation Guidance for
			 Homes with Corrosion from Problem Drywall</quote> to specify that problematic
			 drywall removed from homes pursuant to the guidance should not be reused or
			 used as a component in production of new drywall.</text>
